My husband and I refinanced our home in XX/XX/XXXX through a broker, Residential Mortgage Solutions , Inc. ( RMS ) out of XXXX, MD. In XX/XX/XXXX our new lender, XXXX XXXX, sent us a letter stating that after performing an escrow analysis they found we have a {$700.00} shortage. This came as a huge surprise since both our property taxes and our homeowners ' insurance have reduced. If anything, we should have had excess. After reaching out to XXXX, and getting no satisfactory answers for months, eventually getting no return phone calls I threatened to reach out to the CFPB. Only after that did XXXX XXXX, owner of RMS, contact me again. He eventually sent us a check for {$300.00}. This was his offering to " split the difference '' of our {$700.00} shortage. This seemed to be odd business practice and raised a red flag to me. Meanwhile, during my research into finding our lost money through the title agency, our county tax collector and our previous lender XXXX XXXX XXXX XXXX XXXX XXXX, I learned we were actually shorted {$2300.00} from RMS. This amount represents our 4th quarter taxes and insurance, which unbeknownst to us at the time, we had already paid two days prior to closing through automatic withdrawal. Meanwhile, XXXX XXXX insisted his company ( RMS ) paid. While XXXX XXXXXXXX XXXX did send in a check for {$1800.00} to our county for taxes it was returned to them, since we already paid. ( see attached documents ) We signed a promissory note to RMS for {$2300.00} during the closing. This was to be for them for a " lender advance '' to alleviate a financial burden caused by the {$2300.00} plus our monthly mortgage payment of {$1800.00}. We would repay once we received our refund from XXXX. This never happened though since we already paid our own 4th quarter and did not need the " lender advance '. I emailed XXXX XXXX all the documents I gathered proving the above and in XX/XX/XXXX he mailed us a check for {$1400.00}. However, XXXX XXXX mistakenly deducted {$620.00} from the {$2300.00} since that is the refund we received from XXXX. We were owed that amount in full. That {$620.00} was our excess funds in our XXXX. account and should've remained our money. After pointing out his error multiple times XXXX XXXX is no longer communicating with me. I have been quite patient throughout this long ordeal putting up with XXXX XXXX brusque responses and I respectfully request your assistance in getting reimbursed our {$620.00} to make us whole. I thank you Kindly for your consideration.
