My name is XXXX XXXX and I am a nature person and have researched and file this complaint from my knowledge and facts that are attached. 1. ( FACT ) The following entities listed below have and continue to violate the Federal laws, that have grant me, by the Fair Credit Reporting Act and Fair Debt Collection Practices. I have dealt in good faith from XXXX, XXXX to this present and to no avail. The following entities have refuse to correct the blatant and obvious errors on my credit report, as required by the following Federal 15 USC codes : XXXX, XXXX, XXXX ( XXXX XXXX XXXX XXXX ) and XXXX XXXX XXXX, XXXXXXXX XXXX XXXX and XXXX XXXX 2. ( FACT ) 1681 ( a ) ( 4 ) & B1681b ( a ) ( 2 ) Accuracy and fairness of credit reporting There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( FACT ) 1681b ( a ) ( 2 ) ( a ) Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. 3. ( FACT ) 1681i ( 2 ) ( A ) & ( B ) ( 2 ) PROMPT NOTICE OF DISPUTE TO FURNISHER OF INFORMATION ( A ) Before the expiration of the 5-business-day period beginning on the date on which a consumer reporting agency receives notice of a dispute from any consumer or a reseller in accordance with paragraph ( 1 ), the agency shall provide notification of the dispute to any person who provided any item of information in dispute, at the address and in the manner established with the person. The notice shall include all relevant information regarding the dispute that the agency has received from the consumer or reseller. 4 ( FACT ) 1681i ( 2 ) ( B ) ( B ) Provision of other information The consumer reporting agency shall promptly provide to the person who provided the information in dispute all relevant information regarding the dispute that is received by the agency from the consumer or the reseller after the period referred to in subparagraph ( A ) and before the end of the period referred to in paragraph ( 1 ) ( A ). 5. ( FACT ) 1681c ( a ) & ( 5 ) ( a ) INFORMATION EXCLUDED FROM CONSUMER REPORTS Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : ( 5 ) Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 6. ( FACT ) 1681s-2 ( a ) ( b ) ( i ) ( ii ) ( A ) Reporting information with actual knowledge of errors A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors. A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate. 7. ( FACT ) 1692b ( 2 ) ( 5 ) Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall 2 ) not state that such consumer owes any debt ; ( 5 ) not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt. The Debt collector verbiage is offensive to me and makes me very upset and drives my XXXX XXXX up.. I am offended that this debt hasnt been removed and I have received documents that are clearly altered and edited. In my belief and based on documents I received. 8. ( FACT ) 1692C ( A ) ( A ) COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of a Debt. 9. ( FACT ) 1692D ( 2 ) A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 2 ) The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader. The language is offensive, Debt Collector, balance amount due are very offensive, when my request for a investigation and validation has not been conducted as set forth by Federal law. The entities have oppressed my financially and harmed my quality of life. I feel worried and depressed when I check the mail or every time my phone rings. They have continuously abused my rights for over a year now, by not correcting the errors that I have documented time and time again. The financial hardship and XXXX created by the continuous certified mailing to all parties involved. The cost of these mailings has a large financial commitment attached to them. 10. ( FACT ) 1681n ( a ) ( 1 ) Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00}. 11. ( FACT ) Improper investigation and/or no investigation conducted as prescribed by the following terms of investigation. 1681 ( a ) ( e ) ( e ) The term investigative consumer report means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or who may have knowledge concerning any such items of information. However, such information shall not include specific factual information on a consumers credit record obtained directly from a creditor of the consumer or from a consumer reporting agency when such information was obtained directly from a creditor of the consumer or from the consumer. All entities involved have stated several times that the account ( s ) have been verified, validated and investigated. Yet based on the credit reports, all data must be 100 percent accurate or be removed. The credit reports differ and has information between all 3 reports, that are completely different. ( Drastically different ) See attached credit report.

RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT XXXX XXXX data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with XXXX XXXX XXXX XXXXu, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section XXXX of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. INNOVATIVE R bal. {$2300.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. Resident Collect ( aka Innovative Recovery ) reported an overcharge of {$7700.00} alleged apartment " moving out charge '' to the credit bureau without informing me, or validating the " debt ''. They di d not even wait for 30-days before reporting to credit bureau. My old apartment sent my account with unjustified charges to the collection on XXXX XXXX. Immediately, they turned my account to credit bureau in XXXX without notifying me or giving me a chance to dispute. I just found out that the collection record was shown on my credit report in XXXX. Resident Collect practice seemed to be unlawful, violating FCRA act I called ResidentCollect a few times and finally spoke to XXXX XXXX XXXX XXXX who claimed to be my XXXX XXXX. XXXX stated that they, as a collection agency, has no responsibilities to notify me to verify the " debt '', but directly report my " debt '' to credit bureau. They do n't have to wait for any days before reporting. That does not sound lawful at all. When I questioned the legitimacy of their collection practice, XXXX hung up on me. Subsequent calls received no response. I am disputing the move out overcharges of {$7700.00} which was a ripoff and totally unjustified. The thousands dollars of bedbug inspection /pest control expenses XXXX added onto my moving out charge is unlawful, unjustified. I am a victim of the bedbug horrors. Many other units also got infested by bedbugs. Mine was not the only unit. In addition, bedbugs expense incurred nearly one year prior to my moving out. How come it was reported and collected as moving out charge? XXXX was lying when they say that my unit was the ONLY one infested with bedbugs, therefore I should be responsible for bedbug inspection and treatment. The apartment used XXXX as their pest control vendor. XXXX have a total of ~15 bedbug inspections and treatments for the past year, including unit XXXX XXXX/XXXX/XXXX XXXX -- XXXX unit XXXX, unit XXXX XXXX -- XXXX, unit XXXX XXXX/XXXX/XXXX XXXX/XXXX/XXXX unit XXXX vacant {$2500.00} There was confirmed report the theatre @ XXXX was also got infested with bedbugs. Why my apartment was holding me financially responsible and adding the pest control/treatment expenses onto my moving out chargest? That was a ripoff and totally unjustified. I lived across trash bin room and across the stairway. Unfortunately, my unit got infested. I was a victim of bedbug. I suffered tremendous distresses at the time, mentally financially. Both my health and my job were negatively affected. Once again, I am disputing the move out overcharges of {$7700.00}. In addition, bedbug expenses incurred nearly one year before my moving out, yet they were added as a major part of my moving out cost as you confirmed below? I am disputing the charge. California just passed a new bedbug law. As some landlords are trying on passing bedbug treatment expenses to tenants, bedbug infestations may not getting reported promptly as tenants are afraid to bear the burden of pest control costs ( see my case as a perfect real example ). So bedbugs maynot get treated promptly but instead are getting wider spread. It 's way too common and convenient for a landlord to use this kind of excuses, something like, " You are the only one who got this bedbug or pest issue '' to shame the victims to shut up. Obviously, It is not to tenants ' advantages to fight this type of claim as tenants have no accesses to other tenants information nor current and rental history of any units. I am a highly clean and hygiene person. I never had any pets. I did not even cook as meals were provided by my employer. I never had guests coming over. I even never known what bedbugs were before. I had to XXXX it to learn those tiny insects fest on human bloods. They move around and find their perfect victims/hosts. They can survive for up to half a year without a blood meal. Being an engineer myself, I had attempted to figure out where those bugs were actually from : from neighbors moving in and out, from moving trucks, movers, from vacant apartments, from trash collectors, from common areas, pools, parking, mail room, theaters, trash bin area ( I lived across the trash bin room, lots traffic in going and out of the trash bin room ), traffic on the stairs ( I lived across from the staircase ), club house, gym, or cleaning staff passing by, maintenance staff who came in or out of my unit or from the hall way traffic, even possibly by XXXX XXXX themselves as they travel among different XXXX properties where got bedbugs infested, and could be easily carried by them. In summary, my apartment has no proof that I actually financially responsible for the expense pest control charged to the apartment. XXXX was just dumping those cost to me unlawfully. Stop the collection and remove the fraudulent charges from my account. * i left my apartment spotlessly clean. I am a single working professional with no kids, no pets. I never had any pictures or not a single nail on the wall. I spent 4 days to clean my apartment before moving out * I have never been late on my rent payment, always pay my rent on time. * No any damages in my apartment.

NEVER received proof that debt belongs to me or that I agreed in writing to pay Innovative Recovery ( IR ) for alleged debt. IR reported to the credit bureaus a collection account that is fraudulent and frivolous in nature. Be advised this is a notice that your claim is disputed and validation is requested immediately. Under the Fair Debt Collection Practices Act ( FDCPA ) /FCRA, I have the right to request immediate validation of the debt IR says I alleged owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation that is binding on me to pay this debt to IR. This is a request for VALIDATION made pursuant to 15 USC 1692g Sec. 809 ( b ) of the FDCPA. I request that your offices provide me and CFPB with competent evidence that I have any legal obligation to pay IR. At this time I will also inform IR that if their offices have or continue to report invalidated information to any of the three major credit bureaus ( XXXX, XXXX, XXXX ) or specialty bureaus, this action does constitute fraud under both federal and state laws. Due to this fact, if any negative items or marks are found or continues to be reported on any of my credit reports by IR or the companies you represent, I will not hesitate in bringing legal action against IR and their client for the following : Violation of the Fair Debt Collection Practices Act and Defamation of Character. My consumer rights attorneys and your legal staff will agree that non-compliance with this request could put IR in serious legal trouble with the FTC and other state or federal agencies. If your offices are able to provide the proper documentation as requested in the following declaration, I require 30 days to investigate this information and during such time all collection activity must cease and desist. All items of collection added to credit bureaus must be removed immediately per federal consumer rights guidelines meant to protect consumer. Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my attorney to continuing filing suit. This includes any listing of any information to a credit-reporting repository that could be inaccurate or invalidated. If IR fails to respond to this validation request within 3 days from the date of this complaint, all references to this account must be deleted from my credit file and a copy of such deletion request shall be sent to me immediately. I had rented an apartment from XXXX XXXX XXXX XXXX about XXXX XXXX, XXXX. After about two months of living there, my next door neighbors began to make loud noises virtually every night and this would go on from around about XXXX XXXX until as late as XXXX XXXX. On three occasions spread out over some months, I went to the management office of the apartment and told them about the noise and each time they said to let them take care of it, or something to that effect. The noise continued and this was not normal noise that a tenant should expect in an apartment. This was a running, jumping, pounding noise and it would shake my floors and also shake me in my bed. There was nothing I could do to not hear the noise. After complaining to the apartment office, I hired an attorney XXXX XXXX XXXX, who advised me of Georgia law as to apartment leases and excessive noise. He wrote a letter to the manager of XXXX XXXX XXXX XXXX and advised that I would be moving out of the apartment because of excessive noise and constructive eviction. He also requested that both parties consider the matter to be settled and that I not be charged any penalties since it is the fault of XXXX XXXX XXXX XXXX for not doing anything about the noise. XXXX XXXX XXXX XXXX did not respond to the letter and would not communicate with me or my attorney about the matter. They claimed that any person who moves out of an apartment before the lease has ended, must pay one month of rent as an early termination fee. In my case that comes to a little over {$1000.00}. My attorney advised me that I should not have to pay such a fee as it is the fault of XXXX XXXX XXXX XXXX that I had to move out of the apartment before the lease had ended. Instead of communicating with me or my attorney and making any effort to resolve the matter, XXXX XXXX XXXX XXXX sent me a letter notifying me that they were keeping my security deposit to pay part of the {$1000.00}. I do not believe that XXXX XXXX XXXX XXXX XXXX has any regard for the law based on their conduct. It is their fault for breaching the contract/lease as they did not ever follow up with me about doing anything about the noise and it states in the lease that residents can not disturb other residents. It should not be resolved by falsely claiming that I owe them money and making it appear on my credit report as if I just suddenly decided not to pay them their rent. I sent a certified letter to the collection agency " Resident Collect '' and advised them as to why this is not a valid debt. This did not make any difference to them. They also put the collection on my credit report before I ever received any notification from them. Then when I sent my letter to them. They suddenly sent me a collection letter and I called them on the phone. They claim they had sent a previous collection letter in XXXX XXXX however I never received it. The address they had on file for me is correct, so I do not believe them when they claim that they sent a collection letter before reporting the collection on my XXXX credit report. I made a complaint with XXXX and sent it via certified mail. I wrote a separate piece of paper and explained what happened in full detail, in addition to the complaint form and asked to have the collection removed from my credit report. I included documents with my complaint. Within just a few days XXXX sent me a notification by mail dated XXXX XXXX, XXXX that they had completed their investigation of the dispute I submitted. They said that that the collection agency, Resident Collect, had verified it as accurate. That does not surprise me as all they are doing is verifying the same wrongful debt.

In XX/XX/XXXX, myself and XXXX others entered into an apartment lease agreement with XXXX in XXXX, TX. The " inventory and condition form '' completed by us and provided to, and signed by, an official of XXXX states clearly the existence of mold before we even moved in. A copy of this form was provided to ResidentCollect, the agency that claims to currently own the debt, in my dispute directly with them, as well as disputes with XXXX, XXXX, and XXXX. Over the next 4 months after moving into the apartment, signs of considerable water leaks from unknown locations revealed themselves. Significant black mold growth was negatively affecting the health of all tenants, and particularly myself, who suffers from XXXX and XXXX. The issue was repeatedly brought to the attention of XXXX XXXX via phone and letter. We did not receive any response until a certified letter was sent to XXXX XXXX in XX/XX/XXXX notifying them of their requirement to hire a licensed consultant for mold assessment and remediation as required by the Texas Mold Assessment and Remediation Rules ( 25 TAC Sec. 295.301-295.338 ). The TMARR is a state statute requiring a landlord to secure the services of a state licensed mold assessment consultant for performing an inspection and taking samples of the mold for analysis by a state licensed laboratory. Amongst other legal requirements, the analysis must be provided to the tenant before beginning remediation, a work plan must be maintained at the job site, the work must be filed with the Health Department, and the work performed must be maintained, including photographs of the scene. None of the previously mentioned legal requirements were conducted. When I requested a receipt for the mold remediation, the maintenance director for XXXX XXXX refused to provide us with a copy. The company they claimed performed the work, " Floor to Ceiling Restoration '', was not on file with the Health Department at all, much less as a licensed mold assessor. As such, the mold assessment and remediation performed in our apartment unit was not done legally. The Texas Property Code Sec. 92 provides tenants the right to terminate a lease without fear of liability should a landlord fail to properly remediate mold in a reasonable time ( Sec. 92.056 ( d ) defines " reasonable time '' as 7 days ). Later, an additional certified letter was sent to XXXX XXXX again stating their failure to legally remedy the worsening mold issue and that we were executing our right under Texas Property Code Sec. 92 to terminate our lease without fear of liability. As we did not receive a response, we terminated our lease. Due to breach of contract by XXXX XXXX XXXX, the lease agreement has been rendered invalid and unenforceable. An explanation, along with copies of proof, were sent certified to ResidentCollect in XX/XX/XXXX. I received a response claiming that I do, in fact, owe the balance of the lease agreement, despite XXXX XXXX being the one responsible for the breach of contract and me being within my legal right to terminate the lease. A fruitless call was made to ResidentCollect. The agent claimed our apartment lease superseded the Texas Property Code and, therefore, our right to terminate our lease, despite section XXXX of our lease agreement specifically stating our right to terminate in such a situation. ResidentCollect continues to report the account in violation of the Fair Credit Reporting Act to all three major credit bureaus for myself and the other XXXX occupants.

I was a loyal tenant at XXXX XXXX which later changed their name XXXX XXXX XXXX. My rent was never late and was turned in before the due date frequently. I never had any issues until I had a disagreement with the office manager. One afternoon she began putting tow stickers on all vehicles in the parking lot. A flatbed showed up and began hooking cars up. Once I noticed I checked my vehicle and noticed a tow sticker. i immediately took it off and went to the office to find out what was the reasoning behind this. The office always had two females in the main section who handled the majority of the work. They have a manager who has her own office on the side of them. I only say this because i have never had any interaction with her prior to this day. I entered the office and one of the ladies stated the manager was still riding around the lot applying tow stickers. I located her and asked her why she would attempt to tow my vehicle. She stated that multiple tenants were having their company stay over and they were taking up to many spaces so she was having any vehicles she didn't recognize towed. I was shocked and we began to argue because I knew she had no clue who I even was because she had never seen me before. She was severely unprofessional and we both left the conversation upset and clearly not fans of each other. This incident takes place just a few weeks before I give notice that I am not renewing my lease. I gave the proper information and time of notice and the two females in the office were completely aware. They had me fill out paperwork agreeing to the terms and everything was completely fine. I asked for copies but she stated they don't give copies. I told her I was closing on my house on the XXXX of XXXX and my lease expired the end of XXXX. She stated that they could possibly get a tenant for XXXX and I wouldn't have to pay rent and they could just keep my security deposit. I told her that was great news and we agreed that they could just keep the deposit. After I moved I received a letter stating I owed money all the way through the first week of XXXX. The letter was from the office manager. I immediately called and explained to her the agreement the other ladies in the office told me and that they had paperwork proving the agreement. The office manager laughed and stated the paperwork was misplaced and since she couldn't locate it I would have to pay. We then began to argue again. She then said she would mail me a new letter stating I did not owe anything but she was not giving me my security deposit. I agreed that was fine with me. I never received the letter. Instead she sent a letter stating I owed money for carpet cleaning fees and locks and that I breached my contract for leaving early. She stated that had a fee and that it automatically voided my security deposit. Every time I called her back she would not take my calls and even hung up on me once I stated my name. Approximately one year later I get a collection call. I find it heartbreaking how someone could hold a personal issue or grudge with a tenant and abuse their position just to ruin someone's credit. I am now attempting to get it removed from my credit report but having difficulty. I am frustrated because it is something I truly don't owe and now I might have to pursue it legally which is also expensive.

The collection agency innovative recovery has reported an account owing XXXX dollars from original creditor XXXX XXXX. I have been disputing the balance for months with XXXX and XXXX for removal ; which keeps coming back as validated debt. Innovative recovery has reported false information to credit bureaus and they have added additional fees, not expressed in the original contract with the original lender. The original creditor XXXX place provided me with my rental contract and and a resident ledger. When i called the original creditor they stated the balance they reported to Innovative Recovery as XXXX ; and that included all fees that i owed on the debt. They stated XXXX should be all thats on my credit report and nothing more. I asked them was there any additional fees stated in my rental agreement that i had to cover for the balance being sent to collections. They stated, no the only additional fees collected was a XXXX legal which was for the apartment complex ; that was included in my final balance of XXXX. In the ledger they provided you see the legal fee of XXXX $ assessed on XX/XX/2019 and the final balance after a water charge of XXXX was XXXX on XX/XX/2019. Innovative Recovery provided a letter stating that to the best of there knowledge the account balance of XXXX is accurate in owing. They provided me with the rental contract and the ledger from XXXX XXXX. Innovative recovery added please note, the ledger does not reflect any additional fees added to the account as a result of the account being placed with Innovative Recovery, Inc for collections. The ledger showed a final balance of XXXX. In the rental agreement it stated A XXXX $ legal will be assessed on the XXXX of the month if the rent is not paid in full by XXXX. It also states that in the event the resident fails to timely establish gas and electric utility/ services, owner/agent may charge you XXXX per occurrence. No where does it state anything about additional fees for collections are to be paid by resident. Innovated recovery reported a balance different from the original creditors violating 15 U.S. Code 1692e : False or misleading representations A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. The false representation of ( A ) the character, amount, or legal status of any debt ; or ( B ) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt. ( 8 ) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed. ( 10 ) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer. The rental agreement does not state the tenant is responsible for additional fees associated with collections. Innovative recovery stated they added additional fees for collections. Innovative recovery used false information to collect debt. Because of the violation of The Fair Debt Collection Practices Act this account should be removed IMMEDIATELY.

Dear Sir/Madame, The purpose of this complaint is to inform you of an Account Manager by the name of XXXX who was extremely rude to me. I reached out to Innovative Recovery Inc. on XX/XX/2020 due to a settlement letter I received in the mail. The letter didn't indicate the settlement amount which I found to be a little odd, so I decided to call to see what was offered to settle account. XXXX stated that she can settle account for {$2500.00}. I offered her {$900.00} which is all I had to settle the account but she was very difficult to talk to. She begin to over talk me and cut me off each time that I mentioned that there is no way I can come up with her offer. I informed her that I do not have that amount and she tells me to call back when I save up then hangs up. There was no opportunity to negotiate at all. She was very insensitive to my situation. I have tried to settle this account last year before it was sent to collections and have been getting the run around from the Property Manager. In addition, I reached out to Corporate and they also gave me the run around as well. Long story short-The apartment was infested with bugs, some bed bugs droppings and mold and XXXX agreed to let me out of the lease. We even exchanged emails prior to my decision and she knew of my child with a XXXX who also has XXXX XXXX as well. After, I decided to move out within 2 months of moving there, the manager ceased communication. All of a sudden she was never in the office to speak with to settle account which is not accurate of what she says I owe. There were leasing agent ( s ) and an assistant manager who was aware that the property manager was avoiding my calls because they were frustrated of having to tell me she just left and she knew I had called numerous times. Now that my account is in collections with Innovative Recovery Inc- I have to speak with XXXX who is assigned to my account and she is very unprofessiona l and inconsiderate. I feel as though they are in contact with the apartment complex/corporate which they treat me with the same disrespect as both parties. This is unacceptable and unprofessional. I feel as I'm being bullied and something needs to be done or else I will be forced to take further actions. I didn't ask for this to happen but I should not be disrespected as a second class citizen. I have never been in this situation ever-and I have tried so many times to speak with someone who has compassion and understanding. I lived in the apartments in XXXX, TX XXXX XXXX @ XXXX XXXX XXXX XXXX XXXX number XXXX. I lived in this apartment for two years, and put in several work order request for needed repairs. I can count on one hand the number of times they came to fix a request and that was for a request I put in maybe a year prior to when they actually came to address it and even then still did not fix the issue. I have provided the letter that was sent to the corporate office prior to moving out 1 month before my lease ended. I moved out because the apartment was unlivable and I was never offered a replacement apartment until mine was fixed. I also sent the front office a certified letter advising them that I was going to move out if they did not honor their end of the lease agreement. I went to the office and was talked to very badly and even was threatened to have the police called if I didn't leave the office. My ceiling had water pour through the ceiling fan, the top of the base of the window and through the roof in the corner above my TV. My bed, TV and dresser were ruined. The bathroom had water pour through a vent above the tub that caused black mold to form around the vent. I reported maybe a year prior that my plugs in the living room and guest bedroom couldn't have anything plugged into them or it would smell like a fire was started inside the wall. I just didn't use the plugs in those areas for the time I was there. In the response to my letter sent to corporate, they sent it to the manager who replied and her reply is attached. This lady was very rude and treated people as if she was doing the residents a favor for having such cheep rental amounts. She stated this in so many words to me on the two occasions I went in there to complain. Her words were " Why are you complaining the rent is only {$700.00} dollars ''. I advised here that I did not ask for that price, this was the price listed on the internet and it was something I could afford at the time to make sure my son didn't have to attend a DISD school, We were living in XXXX prior to this move. I have video of of the ceiling leaking and the mold I just need to locate the phone I recorded it on. Mind you this was back in XX/XX/XXXX, I figured they knew they were wrong and would let it go to show they tried to make it right by not placing this on my credit report. I have tried to make sure my credit was in order for this important time in my life, I am trying to become a home owner and am due to close on XX/XX/XXXX if I pay this {$1000.00} to the collection company or have the item removed. Resident Collect ( XXXX ) is a credit reporting agency that was sent a debt of {$6400.00} ( all XXXX credit bureaus ) for me from an apartment that I leased and do to some XXXX XXXX XXXX issue I allowed myself to be evicted to get away from the person that was making my life crazy, I also had an eviction amount ( judgment on my credit report ) for the amount of {$1100.00}, so in a since this amount was being reported twice, since its makes of part of the XXXX , plus relating fees, and inflation fees. I contacted resident to pay the XXXX , and get the judgment removed in XXXX . But they could not take that partial payment and so I went to the apartment complex and XXXX XXXX XXXX XXXX ( XXXX ) XXXX and XXXX worked with me and took the XXXX payment and went to the courts and got me a release of judgement and I submitted that to the credit bureaus and it was removed and one was updated to satisfied, showing that it had been paid. I was assured by XXXX that there would be an updated amount sent to Resident Collect o n XX/XX/XXXX , wh en I was in her office, she has since never returned my phone call, when I would call, they would act like she wasnt there and when I did get her, she stated she didnt know what to do because no one has every come in to pay a judgment, so it was new to her and she was relaying on her corporate office to send a updated version removing the XXXX from the XXXX amount. I so contacted Resident collect 4 times since then, the first time, they asked me to send them the release of Judgement and they would update it, that was back in XX/XX/XXXX . Innovative Recovery , Inc. continues to pursue collection of a debt they know to be entirely invalid. The claim is on behalf of XXXX XXXX XXXX ( XXXX XXXX XXXX ), for a fabricated account ledger. Background : In 2018 XXXX terminated my lease and evicted me from the apartment. It's worth noting that I had never been even 1 day late on any rent payment in 6 years living there. The eviction was part of a group of 30+ evictions of longstanding tenants, immediately following a change in management. This is a matter of public record ( XXXX XXXX magistrate court ). At the eviction hearing, they and I signed a consent agreement sating that " Tenant agrees to vacate the property on or beforeXX/XX/2018 at XXXX XXXX XXXX Plaintiff dismisses its monetary claim. '' I vacated by the agreed-upon date and left the keys in the apartment ( they did not have a drop-box ). I have photos and a moving receipt to corroborate that the apartment was in-fact left vacant ( and clean ) on the required date. Despite my move out as agreed, they decided to file a collection for all rents due through the original lease end date, plus late fees, utilities, and interest totaling {$8500.00}. The lease itself states that " In lieu of liability for the remainder of the lease term for breach of the lease... Management shall be entitled to recover liquidated damages from Resident in the amount of {$1100.00} as the estimated rent that will come due after management obtains possession of the apartment through either the end of the lease term or the re-letting of the apartment to another resident. '' And, that {$1100.00} ( equal to a single month 's rent ) was dismissed by the court order. No balance is due on this account. I have repeatedly sent all of the documentation and supporting information to Innovative Recovery and requested that they send me a written notice that the claim has been dismissed and the account closed. Instead, they entirely ignore my requests, and continue to send me statements demanding payment of the false debt. Calling them is of no help, as their representatives only ask how I will pay them, and hang up on me as soon as I tell them the debt is invalid and won't be paid. They have previously reported this false debt to my credit report, causing damage to my credit, resulting in declined credit, and costing me higher interest rates and therefor significant expense. They have since removed it from my credit reports, with no trace of it having been there ( though I have the prior reports showing it ), after I informed them I intended legal action for their violation of the FCRA. The fact that they removed it seems to indicate that they are aware it is invalid. Yet, they continue to harass me for payment, in direct violation of the FDCPA.

For months this company has been reporting inaccurate, unverifiable erroneous things on my credit report and ruining my credit score and I am sick of it. This company has ruined my credit score so bad I got denied a loan for my house!! Now I can not provide for my family because of these derogatory marks. These medical bills and other derogatory collection accounts listed on my credit report, are incorrect and NOT mine. Simply verifying that someone used my name, social security number and/or address is insufficient to confirm that I am the person in question and owe this debt. The court has ruled that in Hinkle v. Midland Credit Management , IncXXXX, that during a dispute and subsequent investigation with the original creditor, collector or a credit bureau, that the original creditor or collector, must provide account-level documentation that would hold up when presented to a jury. That means an original contract or similar proof. To this end, I am demanding an itemized bill to be sent to me! The account information that this company is providing can not be proven because they do not have the original signed document saying that I owe them a debt which is A direct violation of my CIVIL RIGHTS according to the FCRA section 609. I 've been communicating with the XXXX of XXXX manager, XXXX regarding a debt they 've originally noted to be XXXX and I challenged the amount. They then reduced it to XXXX and I challenged that amount as well. I never owed any of these amounts, and they 've since re-aged the debt and are submitting XXXX debts to the bureaus. XXXX of the debts are listed under the Apartment XXXX and the other under Resident Collect. The manager at apartment gave me the number to XXXX XXXX at the Collection agency who she had spoken to that very day regarding my file and suggested I speak to her myself. XXXX XXXX was extremely rude to me. She cut me off before i finished my concern. She said she would transfer me to someone else and when i told her that i preferred speaking to her because she was familiar with my case, she told me since i didnt want to write down the number, she would just transfer me and hung up. When I attempted to reach her several times after that on the same day, she transferred call to another area. When they picked up I asked for XXXX XXXX 's supervisor and the lady questioned me why I wanted to know that, said she would n't give it to me and hung up. I called again several times and they just kept putting me on hold or transferring the call. I finally left a message for XXXX XXXX and to this day, I 've still not gotten a return call. They were rude, disrespectful, did n't offer me any assistance at all. I am trying to buy a house and it is critical that I get this straightened out as it can possibly cause me to lose my chances of purchasing a home. They never gave me proper documentation that said there were damages I did n't make. I did n't leave the apartment in the state they noted. I am losing something far greater than they are trying to collect. As advised by the CFPB representative, I am filing the repeat complaint as the defaulter company is not responding to the orginal complaint # XXXX. XX/XX/2018 - collection worth {$160.00} added in my XXXX credit report by this agency for not settling pending dues for apartment rented for XXXX XXXX XXXX. Informed collection agent that, I did not receive any statement and asked for dues statement 2. XX/XX/2018 - Statement received from collection via email 3. XX/XX/2018 - Dispute raised via email. Statement had many discrepancies and invalid amounts. Main discrepancy in the statement is {$90.00} added under the head of " XXXX - Error Charge ''. They have also added additional collection charges on top of original dues. 4. XX/XX/2018 - Sent the dispute by post as no response from agency for email for more than a month 5. XX/XX/2018 - Agency replied that they have done the review and the amount found to be correct and did not provide any clarification on the discrepancies. They are now applying confusing communication tactics to forcibly collect invalid amount which they are not able to clarify. here is how they respond to the calls : 1. Telling me the dispute is still in review and do not provide ETA when the they have done with their review on XX/XX/2018. 3. i have a debt with resident collect that is a valid debt but wrong dollar amount. I have called over phone and they verify the correct amount but they are refusing to send report with the correct balance to XXXX and XXXX. Experian already has it updated because they called Resident Collect and received it verbally. Innovative Recovery ( " IR '' ) posted an incorrect debt to my credit reporting. I contacted them with their information from credit reporting years ago and learned that it was related to claimed rent for a month post my move-out at XXXX Apartments XXXX I contacted XXXX Apartments and provided them with the email correspondence with the prior property manager confirming my move-out dates and that my account had no amounts outstanding. I never received any communication from XXXX and the first time I became aware of this debt was as a result of a decline in my credit score where IR reported an incorrect debt owed. XXXX told me they could not do anything about it, since they already turned it over to IR and I needed to work with IR. I contacted IR again and provided them with my supporting paper trail via email. They proceeded to call me several times requesting payment and threatening the impact to my credit report. I explained to them several times they have an incorrect/invalid information and provided them with supporting documentation and they've ignored it. I've disputed with all of the credit agencies ( including providing my documentation ) and they've told me that IR has certified in their response that it is valid and therefore since it is certified they need to keep it. This is absolutely ridiculous that simply just saying " valid '' in an electronic response is an acceptable basis for a collections agency to operate. A grave injustice has been done by this Company and my supporting documentation has been ignored and continues to be ignored. I have no history of a single late payment nor any debt collection. I am responsible with my credit, as demonstrated with my long history. This situation has impacted my access to credit and the rates at which I am being provided debt ; and with a collector reporting incorrect information and telling me they will only remove it if I pay something that I do not owe, this is just an unacceptable business practice. This was showing up on the report of my ex as well and they bullied her into paying half, which she needed to get this removed from her report to apply to law school. I am seeking help to remedy this situation. They must be doing this to other consumers as well and this should be investigated and put to a stop. I have noticed a collection charge on my credit report listed by XXXX XXXX apartment complex that is listed to have been reported in XXXX and have been placed on my file in XXXX, XXXX. Resident Collect verified the amount but could not find any record of me. They found record of my ex-husband and the above mentioned charge listed entirely under his name. I moved out of the apartment complex in XXXX and did not sign any contract, nor lived together with my XXXX The apartment complex, as proof of the delinquency has provided the collection agency a lease contract signed in XXXX by both me and my XXXX XXXX as a basis of the joint responsibility for the incurred debt which contract terminated in XXXX. The lease term was for less than a year period. The collection agency has agreed that it is very unlikely that a lease term of 6 years even existed at the time when the lease contract was signed ( XXXX ). The lease term had to be renewed every XXXX period. After further investigation the collection agency has found a lease contract on record signed in XXXX ( XXXX XXXX, XXXX ) solely by my XXXX XXXX in the same apartment complex. I have verified in XXXX with the apartment complex that they have incorrect information and no basis to claim I would have anything to do with this debt when XXXX XXXX XXXX has first tried to claim it to be my responsibility, and the apartment complex admitted the error and the claim had been removed from my credit file. This collection charge has not reappeared for 5 years until this XXXX, without any prior notification or contact with me. It is negligent and wrongful business practice on the part of XXXX XXXX XXXX complex to try to collect a debt on me after 5 years that has been proven not to belong to me. I have been advised their actions are illegal, they are breaking the law and to report their action to the Consumer Financial Protection Bureau to prevent them for further wrongdoing.

There are actually several things that occurred with my situation. I received a debt collection letter from Innovative Recovery , Inc a few days ago stating this is an attempt to collect a debt and that I had 30 days to dispute the validity or any portion. The first issue is that I believe I only received this letter after I disputed the debt on my credit report thru XXXX XXXX. I first started seeing Innovative Recovery on my credit report on XX/XX/2020 and they submitted the debt daily on my credit report but I had never received a letter from them stating the debt had been sent to them for collection. So that was the first issue, how do you start reporting me to the credit bureau prior to contacting me? No letter, no phone calls nothing. So I was surprised to see it show on my credit report. Then that they had it hit my credit daily from XX/XX/XXXX, XXXX, XXXX, XXXX, XX/XX/XXXX, XXXX, XXXX, XXXX, the XXXX again, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX which is around the time I filed a dispute with XXXX. So then when I looked at my last statement from XXXX XXXX, the Creditor, my statement was for {$71.00} but the letter from Innovative Recovery shows I owe {$96.00}. So that's another issue. Did I get charged a late fee by the creditor on a move out statement? Well I called Innovative Recovery today and spoke to XXXX. She advised that they have sent letters prior to the current one and they attempted to call me but no response. I advised XXXX that was incorrect because I have never received a letter until a few days ago but then I asked her about the amount due. I advised XXXX that my last statement from the creditor was for {$71.00} but my debt letter was showing {$96.00} owed so where did the additional fee come from. XXXX advised that her company tacked on a {$25.00} fee for their services. Is that legal? I do owe the {$71.00} and I am willing to pay it but I wish the creditor had reached out to remind me of what I owed prior to going to the debt collector who then went straight to sending hits to my credit prior to contacting me then adding their fee to what I owe. Please let me know if I am required to pay the {$25.00} fee added by the debt collector. I feel like they are doing shady practices and it's affecting my credit in the process.

Innovate Recovery has been trying to collect a debt from a previous apartment complex. This debt was first dismissed by a justice of the peace judge on XX/XX/2019. After countless attempts of letting them know this, they are still trying to collect on the debt. Even with the information they are sending, the amount is not the correct amount that they are showing from the apartment complex. On my credit report, the amount is {$3200.00} is not the correct amount, but are sending the final bill verification from the apartment complex that is showing {$3200.00}. There is an extra {$50.00} that is not accounted for nor was I made of any additional fees that were going to add to the original amount by this collection agency, which under the Texas Finance Code is a violation as I am asking for them to show that the debt that they have is valid. So that means any additional fees that the collection agency is attempting to collect, which is cited under Texas Finance Code Sec. 392.303 ( a ) ( 2 ) that states " collecting or attempting to collect interest or a charge, fee, or expense incidental to the obligation unless the interest or incidental charge, fee, or expense is expressly authorized by the agreement creating the obligation or legally chargeable to the consumer. '' Innovate Recovery and I have not entered an agreement nor was I as a consumer made aware of any extra added fees that are trying to be collected on. I have spoken verbally to the company and have asked for them to explain the extra fees and also I have sent written communication, to which they have responded with no information or any agreement that this extra {$50.00} is my legal obligation to pay. They have also verified with all 3 credit bureaus that this debit is accurate, which this debt is not accurate nor should this debt have been referred to collections, as the debt in its entirety was dismissed in a Justice of the peace court in XXXX County Texas. Which Innovate Recovery has been made aware of and it is known, but are still trying to collect and verifying that this debt is accurate.

I have a debt of {$1600.00}. I called to find out options on settling. They informed me XX/XX/XXXX I could settle for {$1000.00}. After seeking counsel, I was told to call back and speak to a supervisor to try to negotiate payment since I am a XXXX single female who is working hard to improve my quality of life and pay off debt acquired during my XXXX/ XXXX time. I called back XX/XX/XXXX to speak to a supervisor. My agent was incredibly rude and said they would n't transfer me even though I 've requested numerous times to speak with a supervisor. Naturally I called back multiple times to see what other department could help me. The different departments apparently were all the same 3 people, ( did not know that ), so the other agent yelled at me and was so rude. When i contacted the company by phone the rep could not give me an explanation of what the extra {$50.00} was for. Then he stated well there was an extra charge after we received the collection. I asked what was it for. & he still could not give me an explanation. I said can i have proof of that. HE said sure, I still have not received it as of today. I once again called the company asking to speak w/ the supervisor which is XXXX, I asked to for all documentation on file to be sent to my address. Which i only received a letter saying they are attempting collection on the debt, with no explanation of the charges. This account is ruining my credit. In a previous complaint filed w/ cfpb the collector stated that the collection was for breach of contract of a lease agreement and would settle for {$600.00} but still did not explain the amount in detail of why there was a difference in the amounts that were listed in the requested validation of debt documents. 3 years ago I and my mother in law rented the apartment at XXXX XXXX in XXXX, IL. My mother in law 's health deteorated very much that after 2 weeks of living there she had to move and be closer to her doctors and hospitals. Plus she needed a 24 hr caretaker. She could have told me from the beginning that I will owe this amount, but no she lied to me. On XXXX XXXX at approximately XXXX, a male representative from Innovative Recovery Inc with a foreign accent decided to use only my birthday to verify it was actually " me '' he was talking to, stating my balance owed, the original balance, and whatever else that was listed on my account, not knowing it was actually my friend who had called to make a payment. After the male representative learned that it was not me who he was talking to, he stated he had to end the call immediately. So basically, this company isn't teaching their employees how to properly verify their consumer 's information. It's obvious that this company is teaching their employees to use only one piece of information to verify the rightful account owner. I have since disputed this account to be deleted for violation of the FCRA. Ever since XXXX, when I first made a payment, I have asked to be sent a copy of my contract with my wet signature upon it, displaying my balance and confirmation of payments. I have also requested proof of their license to collect debt and XXXX stated they don't provide copies of licenses to the consumer. Resident Collect, Inc. continues in their attempt to collect a debt that was discharged in a Chapter XXXX bankruptcy in XXXX 2013. They have sent collection notices and have called my cell phone. My attempts to contact them to inform them that they were listed as a creditor in the discharged bankruptcy have been met with accusations of me lying about the bankruptcy ( I tried to provide them with the case number ), hanging up on me and then calling me back a few minutes later and when I answer they hang up on me again. During a phone call to them, I was explaining that this had been discharged and the rep said in a very sarcastic, belittling manner, " Yeah ... ok ... I highly doubt it ''. When I informed him that I was going to call my attorney about this he stated, " You do that if you really even have one ''. I asked them why they were continuing to attempt to collect a debt that was discharged in a bankruptcy, I was told, " Obviously you owe the money and there was no bankruptcy - so sounds like you need to pay up ''. I called my attorney and they verified that RCI was listed as a creditor and that this activity was indeed illegal. She advised me to fax or send them a letter explaining what I have tried already and to include a copy of the discharge. I have tried to contact them to obtain a fax number and as soon as I explain to the rep what I need the fax number for and give them my account number, they hang up on me. In XXXX of 2019 i sent a request to the company Innovative Recovery to get information on a claim for a debt owed. I sent XXXX certified letter between XXXX and XXXX of 2019. In XXXX of 2019 the company sent a letter of the amount owed but still not a single copy of proof of the debt. I contact several companies i may have done business with that might have a debt of this amount owed. In which i failed to receive anything showing this balance. I have contact the company and advised of the legal lays and request that they have failed to meet the federal guidelines regarding debt collection and verification. I have sent over several copies of legal documents requesting to remove this debt from my credit report for failing to prove the debt, for failing to send a copy of any bill relating to this debt. as well as the claims to take legal action against me, i have advised that will out any verification or bill i will not make any sort of payment or payment terms. I have sent 2 follow up letter by certified mail and company has refused to send any communication regarding the debt. RESIDENTCOLLECT INC claims I broke lease by not providing " Intent to Vacate Notice '' and that I owe 2 months rent. I have document that proves I gave 30-Day Notice with copy of Military Orders. Document was signed by Property Management personnel on XXXX XXXX 2011. After finding out I was in collection, I called property manager and she agreed to remove account from collection which never happened. Collector did not accept my document and became abusive, used profanity and obscene language and threatened me with legal action. I received a collections notice in the mail on XXXX XXXX. The date on the letter was XXXX XXXX. The letter stated that unless I asked for validation of the debt, they would assume the debt was valid. I sent a letter on XXXX XXXX asking for validation of the debt. On XXXX XXXX I called the collection agency and explained that the 30 days to get back to me was up and the collection needed to be removed. I spoke to XXXX with XXXX XXXX. He verified with me that he received my request for validation of the debt yet refused to remove the collection even though the legal time frame for validation had expired. I called again on XXXX XXXX to follow up about removing the collection and he refused to speak to me due to him being on speaker phone which he had no way of of knowing. He then disconnected the phone call. I called back and again he refused to speak to me stating that he was on speaker but what he really heard was children in the background. I asked to speak to a supervisor due to the unprofessional like conduct from all calls, he did not transfer me to a supervisor, he sent me to a voicemail. Not only did I want to complain about his behavior, I wanted to follow up on the removal of the collection. Since I was sent to voicemail, I never got an update. I would like this collection removed due to the debt never being validated with me. The time allotted by the Federal Fair Debt Collection Practices Act has now passed. According to that act, after XXXX days with no validation, the collection agency must cease collection efforts and remove negative items.

As a federally protected consumer I revoke remedy against INNOVATIVE RECOVERY, INC for illegally furnishing false information on my consumer report without my permission which is a violation of 15 USC 1692c ( a ) of the fair credit reporting act. Which states Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt. I was never given a notice about the alleged debt before it was furnished on my credit file illegally. As the consumer pursuant to 15 USC 1692a ( 3 ) I demand this account be removed. I demand you cease all collection attempts through all mediums even phone calls and mail Pursuant to 15 USC 1692c ( c/ 1X2/ ( 3 ) I will invoke remedy for my damages pursuant to 15 USC 1692k . Pursuant to 15 USC 1692d ( 2 ) furnishing this alleged debt is abuse and me seeing it just hurt my heart. I was a resident at XXXX XXXX XXXXXXXX in XXXX, Florida. After many attempts ( months ) to have the gates of the complex closed because of a home invasion in the apartment near me, As a single woman, I no longer felt safe and I gave my notice that I was moving. I paid for a gated community because of safety. For months the gates remained open. Once the shooting occurred, I contacted the property 2-3 times a week. I left my new address for follow up on my deposits. I received the attached and immediately responded in writing that the amount they were trying to collect was not valid and actually made no sense. I requested for them to review the payment information that had been made and provide an actually true account of the amount they were trying to collect. This request is also attached. I never heard back from this company. Then I see that a collection agency is on my credit report. I disputed several times. XXXX XXXX came back as verified. I contacted the collection company and asked why I received no response from the original creditor and once again stated the debt is not valid. I also let them know that what they were doing was against the FCRA. They told me to pay the amount and it would be removed. I don't feel this is right. That debt is not valid. I have contacted Resident Collect and informed them the amount they are reporting is not correct if any balance is owed. I informed Resident Collect that I spoke with Leasing Agent at XXXX and they were not able to verify any balance owed as my name did not show in their database. I also informed Resident Collect that the documents they have sent me are fabricated. In a previous request to Resident Collect requesting they verify the balance and update my credit report. I also informed Resident Collect of payments I made directly to the creditor and thst my deposit was not showong on the paperwork I recrived. Resident Collect then sends me documents that show the deposit amount on lease was {$10.00} with initials that do not match the initials at bottom of page and they also included a document that indicated a deposit in amount of {$510.00} was the deposit amount received from me. On XX/XX/2016 I received the same documents from Resident Collect this time the the amount of deposit on lease shows nothing the initials were gone andthere was nothing listed where the {$10.00} was previous also the line is removed. On the same document previously sent does not show the security deposit but current amount owed but that is all no description. I informed Resident Collect of the falsified documents received but they still did not verify or correct the issue.

In XX/XX/2019 I was notified by my identity protection company that I had a new collections account. This showed up as Innovative Recovery. I had never heard of or done business with this company nor have I ever received any contact from them stating I owed a debt. When I contacted them they claimed this debt was for an apartment at ( XXXX XXXX XXXX ) an address I had not lived in but for an apartment company ( XXXX XXXX XXXX ) that I lived at over 4 years ago. XXXX XXXX XXXX has a completely different address and zip code. XXXX XXXX XXXX also claims I have no debt with them nor have I ever. When I asked Innovative Recovery for verification of debt, they sent a statement with bogus charges for dates I didnt even live at the supposed complex. Again, the address on this statement is an apartment I did not reside in. Next they sent me a bill that looked like a bill a magazine subscription would give you. Complete with a fill out your card information and send it back section. Then this company began calling my cell phone, my parents landline, and my mothers cell phone. They continually try to offer to settle for a lesser amount then they are claiming I owe. I never gave them mine or my parents contact info other than the address to send the verification of debt to. I disputed a debt on my credit report with Resident Collection for {$1200.00} with an open date XXXX XXXX, 2014 and it was deleted out of my XXXX credit file because the debt was n't mine well the company quickly put it back on my credit report using a different name but the same address the new name is Innovative Recovery Inc and they placed it in my XXXX credit report without notifying me of rights to dispute the debt before placing it in my credit file! They did n't give me a chance to dispute the debt or notice to dispute. Matter of fact I did n't know of this company until saw it on my credit report. On XXXX XXXX I was sent a notice of collection from resident collect, Inc. that I owed XXXX from XXXX which I moved out from on XXXX XXXX 2016. A few days prior to this notice, I received several move out statements from XXXX XXXX with misleading charges. On XXXX form I 'm being charged a higher rate for the replacement of carpet and vinyl flooring. While on a XXXX form it list charges to replace the carpet and vinyl flooring at a combined price for much less. I spoke with XXXX concerning these charges and they say it amounts to the same charges which it does not. I was also charges for the replacement of vinyl for the entire flooring in the kitchen although I only cause minor scratches to a portion of the flooring. I was told that the entire flooring must be replaced. Another section of the vinyl flooring was damaged by water due to the negligence of the apartment maintence by not cleaning out the drains for the washer machine connections. Several maitnence calls were placed to correct the drainage issue as well. In total, I have three different total for the same damage and requested a dispute of these charges. Instead, resident collect reported this incorrect debt to the XXXX credit reporting agencies without acknowledging my dispute.

I received notification via online that I had a debt collection filled back in XX/XX/XXXX from a previous apartment complex I lived in. The debt was XXXX $ from XXXX XXXX XXXX filled with the company Innovative Recovery. I called the collection agency on XX/XX/XXXX about the debt and they stated my old complex put that I still owed rent even though I left early for the prior month. I sent over emails between me and the property manager as proof that all I was advised to do was turn in keys and he would take care everything. Innovative Recovery never got back to me and when I recently did an application for rent I was denied because of this debt. I reached out to Innovative Recovery and spoke with XXXX around XXXX XXXX in which she stated XXXX XXXX responded that I returned keys on XX/XX/XXXX and owed rent for those days. I have documentation proving I returned keys XX/XX/XXXX and XXXX XXXX with held my security deposit of XXXX $ and also put on my credit report that I still owed them XXXX $ for 12 days of rent. This Item continues to be reported on my credit report. I have written several letters to the Innovation Recovery and the credit bureaus and this inaccurate information remains on my report. I say inaccurate because they can not prove that this account belongs to me. I have asked on several occasions for them to supply me with a breakdown of the amount that they say I owe. I have been battling with this issue since it was reported on my credit report. On XX/XX/2022 I spoke with a supervisor by the name of XXXX who informed me that she was going to email me the breakdown but now it is XXXX XXXX and still I have not received anything. The only thing that they continue to send me is a collection letter, this is not proof of the account. I feel that this account needs to be removed from my report due to inaccurate information and them not complying within the 30 day period. I have attached a copy of the last letter that I wrote and I have proof from the post office of delivery. This item needs to be removed. I am applying for a mortgage and Resident Collect of XX/XX/XXXX, Texas put an item on my credit report that says I owe {$7000.00}. I had disputed this debt years ago, and requested the company give me a breakdown of the alleged debt and they failed to do so at the time. Now, the piece is still on my credit report and I attempted to contact Resident Collect to get a letter clearing me of the debt. When they did not respond to me, I hired an attorney to discuss it with them and they emailed the case was closed to him. However, they did not provide him a letter, and later the same employed tried to email me directly and said I needed to pay {$3600.00} to solve the issue. My lawyer, the credit company my mortgage company uses and I have all tried to get this letter and this issue close, but Resident Collect is unresponsive and uncooperative. I need a letter clearing me of this debt, as the company that originally claimed the debt has dissolved and the statute of limitations for collections has expired in my home state, the state the defunct company is in and the state of the collection agency. The mortgage company will not issue it until I get this cleared up, and we have tried to clear this matter for 4 weeks.

It has come to my attention that the a collection company Innovative Recovery has added a collection that does not belong to me on my XXXX. I have spoken to them directly and they have verified with me that the information they have in file does not match my information given. I have never resided in the State of Texas, therefore it was a mistake from either the Credit Bureau or the collection agency to have wrongfully added it on my XXXX. I have filed a police report and have also opened up multiple disputes with XXXX that have been a waste of my time as they continue to deny them. We lived at XXXX XXXX XXXX apartments before they were purchased by XXXX. Upon purchase, they replaced most of the staff, including my wife who had worked there from XXXX to XXXX. We moved out and into the new property she was employed by. Upon moving, my vehicle was struck by their gate and damaged. The property manager XXXX said they would compensate me for the damage, but never did. A few months later, we noticed a collections on our credit reports for over {$2000.00}. We were not provided with any notification of the debt, nor any detailed list of charges. We contacted XXXXXXXX XXXX and they told us it was no longer with them. We tried to obtain an itemized list of the charges, because we did not agree that we owed them. We were not furnished any such list. My dispute results came back from transunion dated on XXXX XXXX. I received a letter from innovative recovery dated on XXXX XXXX stating that a balanced owed from XX/XX/2014 and i had 30 days to disputed this debt. So following the letter i received. i sent a response with a validation letter, requesting all information about this debt before the 30 day window is up. In response from innovative recovery i received a packet dated on XXXX XXXX. Clearly the packet only included a lease and some invalid paper thats inaccurate with the wrong amount that is not shown on my credit report and the incomplete name of the alleged original creditor.. Nothing was validated in response to the things i asked for in the validation letter i sent to innovative recovery.. And they are violating my consumers rights. Because they continue reporting to the credit agencies, and never validated a debt. Which im the consumer is entitled to ask for validation and they fail to comply with the request. I have contacted Resident Collect on several occasions asking for them to present me with a contract that states that I owe them money or that I am legally obligated to pay Resident Collect. Per the Fair Debt Collection Practices Act, 15 U.S. Code 1681, Fair Credit Reporting Act section 623 ( a ) ( 1b ) and section 623 ( b2 ) this company must be able to present a contract between themselves and me in order for them to report on my credit. They have no such agreement. Once again RESIDENT COLLECT HAS NO AGREEMENT WITH ME STATING THAT I OWE THEM MONEY. They are illegally listing entries on my credit reports. This item must be returned to the original creditor. It was advised that I try to have this issue resolved though the mediation of the CFPB before I filed suit in state court seeking remuneration for several things including but not limited to : Violation of the FCRA, Violation of the FDCPA, Defamation of character and Identity Theft as they have opened this account without my knowledge or consent. I was constructively eviction from the XXXX XXXX XXXX XXXX managed by XXXX XXXX XXXX, where I had been a resident for sometime, when the management company hired a new manager, XXXX XXXX. This new manager started harassing me by filtering noise, and vibrations through my apartment. I complained to the management office and was told that I had no proof, so nothing was going to be done. I reported it to the police, but the police told me that the manager had to be caught in the act. This company is wrongfully charging college students for monies they do not owe. This company is holding back deposit monies and charging for something that is not owed. they allowed some stranger to stay in there apartment, for free and charged the other students the same amount as if the the XXXX person was not there. Students complained over and over again with no results. Then continue to charge the students and kept their deposit. they are seriously taking advantage of these college students. This debt according to the placement on my credit report was from XX/XX/XXXX, my wife and I have never received notice. This was just placed on our reports on XX/XX/XXXX. We have never had a chance to fight it. Tenant/Landlord laws in Florida state that a landlord has only 30 days after a tenant vacates the property to collect damages. Also I have personal proof that this property was rented back out immediately after the landlord refused to cure a 7 day notice. I can provide proof that the landlord allowed race to control a situation and that this debt in illegal under the law. The landlord showed up to the property without notice and told me that it was ok that we were leaving. This was witnessed by myself, my wife and my mother in law. This landlord will lose if this goes to court. You have taken on a debt that is unsubstantiated. F.S. 83.595 states that if the landlord relets the property the tenant is only responsible for the difference between when they breeched the lease and when the new tenant rented.

This company is a collection agency and they added an item to my credit illegally. By law they have to notify me of the debt and allow me 30 days to dispute it. I was never notified of this debt, nor given a chance to dispute it. This debt is not valid as I was living in an apartment unit that was not safe to live in and had to move. Shortly after I moved, the units floor collapsed and rendered the property condemned. Since this company failed to notify me of the debt in a timely manner and failed to allow me to dispute it, I can not rent with any other landlords. Them adding this to my credit illegally has affected my ability to get a place to live. The landlord was given proper notices and opportunities to fix the unit I lived in but failed to do so. I legally vacated the unit and there should have been no further charges or debts. If this company would have notified me of the debt, I would have showed all the proper evidence to justify my moving out, therefore it would have never appeared on my credit.

I never received notification this company was trying to collect a debt from me. I did however, make a {$100.00} payment on XX/XX/XXXX. However, the company apparently only reflects receiving {$50.00} The representative I spoke to on XX/XX/XXXX, named XXXX, is not only hostile and unprofessional, she refuses to give a copy of my payment history, refuses to send any kind of confirmation I made a payment nor will she assist in determining why the full payment on XX/XX/XXXX wasn't posted. I received a collection notice from ResidentCollect, Inc., in the amount of of {$380.00} in XXXX of XXXX. I sent a money order in the amount of {$380.00} soon after receiving the letter to pay the debt. In XXXX of XXXX I tried to obtain a mortgage loan from XXXX XXXX and got pre-approved but the collection debt is showing on my credit report, and the bank said the loan is not going to be released until the derogatory mark gets removed from my credit report. That same month a requested a copy of the cashed money order from XXXX XXXX and I received the proof that the money order was cashed 30 days later, and I sent it to ResidentCollect. I called them a couple of days later to follow up on the issue, and they said they did n't receive the proof of payment. I have tried several times to work with ResidentCollect to resolve the issue, but it seems like they are unwilling to do it. I have attached a copy of the letter I mailed off to Innovative Recovery over a month ago. I also have proof that they did receive my letter because it was sent certified mail and required a signature upon delivery. I have not received any response from them about the investigation regarding the alleged debt. They have avoided my CFPB Complaint that was submitted XX/XX/2020 as well as my letter I sent late XX/XX/2020. I feel that they have had much time to respond to either of these mediums, yet they have failed to make any contact whatsoever. I responded per the FDCP Act Validations of debts with a phone call. I attempted to advise the company that this is an open court case that has no decision for any debt owed. I was told I had no rights unless I was an attorney. When I read the Fair Credit Act I was told they would continue to collect in violation of my call. When I told her she was violating the act and my rights as a consumer requesting to speak with a supervisor, she placed me on hold and then came back and hung up. When I called back the phone call was sent to voice mail and I did leave a message letting them again know this was an unlawful harassment and that I did not consent to third party involvement in an open court case and that it required settlement in court.

Innovative Recovery contacted me about three weeks ago about a supposed debt I owed. Every single person I have spoken to on the phone has been rude and refuses to be helpful. I asked for a detailed itemized receipt of the supposed debt to try and ascertain why I would possibly if at all owe anything to anyone. They sent a letter to my job initiating my boss to ask why a debt collector was coming after me. They constantly call during the day while I am at work. They refused to send me an itemized receipt and the most recent communique I received has the wrong name on it. I do not believe I owe this debt at all since they will not provide me with evidence I do and instead opt to harass me and badger me hoping I will give them money. I sent Innovative Recovery Inc a Debt Validation Letter on XX/XX/2022. I first received a letter from them a few days after XX/XX/2022 as the first letter is dated XX/XX/2022. Innovative Recovery Inc has failed to respond to my Debt Validation Letter which is a violation of the FDCPA. I have all my documents to prove that I sent them a Letter. Back in 2012 I live in XXXX XXXX XXXX and I was evicted and they tried to sue me for XXXX and we went to court and the judge awarded them XXXX and told them that are all I owe them. I was renting an apartment from a complex called XXXX XXXX XXXX in XXXX, TX. I was required to pay my first and last months rent up front. I gave them my 30 days notice when they gave me my renewal notice on the last month of the contract. Now I have debt collectors calling me saying that I owe the complex {$2600.00} for breaking the lease, even though I did n't break the lease at all. The only reason I put in my 30 days notice to leave at the end of my contract was because of the lack of promised amenities, such as pool and office, and the apartment units not being up to code. When trying to buy a house XXXX weeks ago, I was declined because I had a negative item reported to the credit bureaus. I called and reported that the debt was included in a bankruptcy and was not collectible by this collection agency. I volunteerly moved out of the apartment before eviction due to non payment of rent when I filed for bankruptcy. I was in the hospital for an extended period of time and not collecting a paycheck which is why we moved. Innovative responded with a partial lease agreement although the supposedly final balance statement shows an amount of {$1200.00} owed for " insufficient notice charge '' in addition to {$510.00} reletting fee. I have contacted the collection agency to inform them that the account they have reported to the credit bureaus is inaccurate and erroneous. I was told by the apartment agents that if I left the apartment, that my deposit of around {$2000.00} would be kept. I told them I would be moving out and not staying the next month. I was never told about an additional penalty when signing the lease on the apartment nor prior to move out.
