On XX/XX/2023, I received a TEXT MESSAGE on my phone, stating - - " Hey XXXX- this is XXXX XXXX over at Reliable Home Lenders. Thanks for submitting your info to get pre-approved. Do you prefer text or a quick call? '' I have not applied for a Mortgage in the last 3 years, and certainly not today. I contacted XXXX XXXX at Reliable Home Loans via email at XXXX. My email asked for the information associated with the " pre-approval application '' and I informed her that I did not complete any application. After some back and forth, she stated - " No reason to be concerned. I am working with a new real estate team that has used XXXX for a bit. They provided my team with a list of leads and I didnt realize the leads were dated. '' - - - - WELL, there are a couple of problems - the first, they are violating the CAN-SPAM ACT by soliciting me through a list they received from a third party without my opting in. Secondly, they are misleading people into thinking that an application was filled out in their name- which is cause for alarm and now I am spending time and resources doing a credit check, etc to make sure I have not been subject to any identity theft. Additionally, I have asked her for copies of the information submitted to her and the name of the real estate agent, which she refuses to provide to me. This is the epitome of bad business and bad ethics. Seems like some type of license law violation - and if it isn't, it should be. This is the type of activity that should be specifically forbidden and is frustrating, at the least. I want to know what actions can be taken by your agency to prevent these actions from occurring again. This agent is also likely misleading others since she is blindly messaging people she obtained from some random real estate agent.
