A few years ago I had a huge financial hardship resulting in my credit going from good credit to very bad credit. This is not something I am proud of but life happened. Since then I have been working with several of my creditors to resolve my financial burden. XXXX XXXX was next on my list. On XXXX/XXXX/XXXX I received a call from a XXXX XXXX XXXX at my place of employment regarding my past due XXXX XXXX account. He asked for me by name yet said he was calling to verify my employment. He stated XXXX XXXX is going to file a civil judgement on me to garnish my wages. I explained to him I could not take his call at work and would call him back the next business day after work as I got off to late to reach him on XXXX/XXXX/XXXX. After several phone calls today XXXX XXXX/XXXX/XXXX XXXX, I finally reached him and inquired about my options to get my {$1200.00} debt paid off. The options offered were out of my budget. He transferred me to the office XXXX whose name is XXXX and who would not provide me with his last name. I advised XXXX I could not afford the options offered and could we come up with a better option that better fits my budget. Although XXXX XXXX was very polite when talking to him, XXXX was the complete opposite. XXXX attacked my character, asked me very rudely why I could n't get a family member to pay my bill, why I could n't defer a car payment and why I got the credit in the first place if I could n't pay it back. Among other rude remarks he made as well as there were many. ( Please refer to the recorded phone conversation if possible ). I proposed a payment arrangement of {$54.00} a month for 24 months which was refused. He kept talking over me and would not let me explain my full financial situation to him. He offered 18 months at {$75.00} a month which I just can not afford at this time because XXXX is not the only creditor I am working with to get all of my debt resolved. He said the payment is only {$20.00} more than the {$54.00}. I explained to him that {$20.00} is a lot of money to me. I advised him if they could accept the {$54.00} a month now, once my financial situation changes, I may be able to afford higher payments later. Again, he refused to accept a {$54.00} payment. I asked if I could have my account number and an address where I could send in a payment myself since he was refusing to accept the {$54.00} and I was ignored and never given the information. He eventually hung up on me. It is already upsetting having a financial difficulty but being treated the way he treated me on the phone was even more upsetting and uncalled for. I would also like to mention I asked him several times if there was someone else I could talk to because I did not like the way he was talking to me and he advised me he was the office XXXX and there was no one else I could talk to. I was responding to a call made to me XXXX at work XXXX to handle my debt and to be refused when trying to give the payment amount I can afford is ridiculous. I called back and was transferred to XXXX again and received the exact same treatment and was hung up on again. I called back again and spoke to XXXX XXXX who gave me the web address to make a payment. He also refused to give me XXXX 's last name as he said he did not want to " get into trouble. '' He also refused to give me my account information and referred me to the website. On the website you need account information in order to make a payment. I did place an email on the website for someone other than XXXX or XXXX XXXX to call me back so I can get the information I need to handle this. I am still waiting for a response. I would like to add while speaking to XXXX XXXX XXXX told him I was starting to feel very uncomfortable with the phone call as no one would help me and/or give me information. I was beginning to wonder if this was a fraudulent phone call. I may be reached at XXXX after XXXX every weekday but Wednesday. Thank you so much for your time in helping me resolve this matter. On XX/XX/XXXX, I received a letter dated XX/XX/2023 from XXXX XXXX XXXX, XXXX. It stated I owe a debt of {$5000.00}. This puts XXXX XXXX XXXX, XXXX in violation the Fair Debt Collection Practices Act ( FDCPA ). I do not owe this debt. The Fair Debt Collection Practices Act ( FDCPA ) states debt collectors can't use false, deceptive, or misleading practices. This includes misrepresentations about the debt, including : * The amount owed * That the person is an attorney if they are not * False threats to have you arrested * Threats to do things that can not legally be done * Threats to do things that the debt collector has no intention of doing '' XXXX XXXX XXXX, XXXX is in direct violation of the FDCPA since I do not owe this debt. They are attempting to collect a debt from a brokerage firm. I have never had an account with this firm. Even if I did have an account with the alleged firm, the customer agreement states all disputes go to arbitration and both parties waive their right to sue in court ( attached ). This is a debt I do not owe, is uncollectible, and XXXX XXXX XXXX, XXXX is making threats that legally can not be done and they don't have intent on doing. An additional violation of the FDCPA, on XX/XX/2023, I mailed a certified mail letter to dispute these claims to their address at XXXX XXXX XXXX as stated in the letter received on XX/XX/2023. This is well within the 30 day dispute window. However, XXXX XXXX XXXX, XXXX has refused to sign my certified mail letter after XXXX attempted deliveries so I have NOT been afforded my rights under the Fair Debt Collection Practices Act ( FDCPA ) to officially dispute this debt. Tracking Number for Certified Mail Letter to Dispute Debt XXXX XXXX Number : XXXX I am seeking the following : * XXXX XXXX XXXX, LLC to immediately stop all collection efforts * Provide written proof of stopping all collection efforts Any continued pursuit of this debt not owed will be met by swift legal action to get it disassociated from my name. All necessary debt regulatory bodies will be notified and multiple complaints will be filed until collection efforts are ceased and proof is provided in writing. Thank You

I was contacted on XX/XX/2022 by XXXX a third party collector for XXXX XXXX. XXXX XXXX is the current owner of the debt. My original creditor was XXXX XXXX. I was told by XXXX that when I pay the debt they will notify XXXX who will then notify Lendmark to update the tradeline as paid. Due to this agreement that XXXX was sure would happen I set up the payment arrangement and made my first payment of {$300.00}. I spoke to a rep from XXXX on XX/XX/2022, who contacted me from phone number XXXX, who stated that even though I pay XXXX they will not update my tradeline. I also spoke to all three credit bureaus who also advised me that XXXX is not obligated to update my tradeline. I reached out to XXXX and relayed this information to them and they stated that I was lying because this is what she tells all her customers. The agent from XXXX asked that I pick one of the credit bureaus and call while she was on the line because she wanted to hear this information from the credit bureau herself. I reached out to XXXX while she was on the line and XXXX confirmed that the information that XXXX relayed is correct and they do not have to update their tradeline. Now that it has been confirmed that the information XXXX has given as a means of collection under false pretenses, I am asking that they return the money that I have already paid and to discharge the debt because I was not given correct information during the collection process. The agent proceeded to threaten me by stating well how about we go ahead and have Plaza add their tradeline to your credit so you can get double dinged and then we can mark that tradeline as paid. Which she stated that she was not being malicious or threatening, however, she knows that would scare me into thinking they will harm me further if I do not think it is fair to pay after they gave me false information. XXXX used incorrect collection practices and they need to rectify this issue.

I received a voicemail this morning from XXXX XXXX a t Recovery Management Solutions. I returned the call and XXXX XXXX informed me that a civil action was going to happen soon for a debt of {$840.00} which was incurred in XXXX to XXXX XXXX . I explained that the contract in question was fulfilled as of XX/XX/XXXX . I further explained that the collection amount was for a contract renewal which I had not requested and for a service I never received. In XXXX I went through BBB mediation and the amount was subsequently removed from my credit report by XXXX XXXX . XXXX XXXX informed me that XXXX XXXX had no right to do this, that the company he represents now owns the debt, and that they could take action to make the charge appear on my credit report again. He informed me that I had until Tuesday to respond to an email he was sending and he would then decide whether or not to take civil action. I sent the following email : " I do not acknowledge this debt. The terms of the contract were fulfilled. The amount in question is for an " auto-renewal '' that occurred after the initial 36 month term of this contract. This auto-renewal occurred despite multiple requests to cancel any further services. Through Better Business Bureau mediation for an amount owed, the company agreed this was an invalid charge. Complaint # XXXX . Given that this is not a valid debt and that the statute of limitations is in force, I would ask not to be contacted about this again. XXXX XXXX ''

On XX/XX/19, I received a voicemail regarding a debt owed before legally prosecuting me. I used the information provided to contact a XXXX from RMS. XXXX ask me if I was aware any debt owe which I thought was strange. If you have a debt there with my name on it, RMS should be able to provide the information. I am a Fraud Victim that's taken me over 2 years to follow up on fraudulent accounts so I am very careful and proactive with important issue as this one. Although I was on a short break, I verified my Date of Birth which I usually will not do. I told her I did not have very much time but insisted on placing me on hold. I could not wait any longer but told I do not owe any debt that requires RMS services. The call made me very uncomfortable because she was so vague. I formally disputed any of there clients debt since she did not provide the information. XXXX stated a letter was sent to me over 45 days ago which is incorrect. This is the first I've heard of RMS so I further researched on RMS, I found they will send notification under a different business then collect under RMS. This is done to exhaust the 30 days deadline to dispute the debt. I do not believe RMS sent a letter to me 45 days ago and using this tactic as a form of Harassment. I did not receive any notification from RMS and never heard of them until XX/XX/19. I have no clue what the debt is nor do I know anything about RMS!

Recovery Management Solutions has been told on multiple occasions by family members who they have contacted about a debt they claim I owe to stop calling. They will not stop. They have been informed that their calls are considered harassment and have continued to call back. I personally have requested that all communication be made by mail and the calls have continued. I have never received a bill or any other written communication from this company. I have never been informed to whom a debt is owed or an amount. I absolutely will not entertain debt collection activity without an opportunity to validate the debt. This is not an agreement to pay or an acknowledgment that any amount is owed.

To whom concerns, My name is XXXX XXXX and I been recovering repeated phone call from the above phone number with in Minutes. Also the Debt Collector calling a family member asking her to return the call. Leaving a voicemail on a 3rd party cell phone. This is harassment and violation of the FDCPA. The 3rd Party call me worried about someone calling and trying to locate me when they have my phone number and address. The reason I didnt answer is because my phone identified the number as a spam risk. Plus I work. I have records of all the information by your request. I have only received 2 messages from the girls calling me. The 3rd part phone number she call was XXXX.

XXXX from prelegal office for covering management solution has called SEVERAL TIMES. Every time he has stated we have to call back by end of business today and in addition when he talked to my husband he told my husband that they were going to garnish his wages, and seize his vehicles. There was never a lawsuit filed. We have NOT received anything via Mail, just harassing phone calls. I called him back and he told me it was a recorded line and I asked him if he had a judgement and he said no I told him that he has not sued us and he can not threaten us like this and he preceded to talk over me and told me to visit their website.

The company called from XXXX, stating that I owed around 1200 in a loan from XXXX that I never applied for and threatened to take legal action. They stated that I received a loan in the amount of {XXXX} deposited into a XXXX account that I never had. I called XXXX and they have no record of me and stated that I would have to live in Georgia or Florida. Which I live in Ohio and have always. The loan was supposed to be taken out in 2014. On XX/XX/2019, a hard credit inquiry was placed on my XXXX report by the referenced company RMS below. After researching this company, it appears to be an aggressive debt collection agency. I have several back to back phones calls daily from this company. Then some how they got a company phone number that would not have been listed on any loan applications. I spoke with a lady here a requested that she not call my company phone and to refer all matters to XXXX XXXX XXXX. Then after a few days go by once again they called my company phone harassing me at my place of employment.
