On XX/XX/XXXX I pull my credit report and found out that RMC OF AMERICA/ ORIGINAL CREDITOR : XXXX XXXX XXXX XXXX XXXX XXXX AND XXXX two account they said I owed them. I am filing this complaint against them for non-compliance violations. I wrote them a letter of validation on XX/XX/XXXX certified mail with return receipt ( I have attach of copy of that letter ). They wrote me back on XX/XX/XXXX. The RMC OF AMERICA has the following non-compliance violations : 1 ) They have no copy of a signed contract where I allegedly agreed to pay the charges. 2 ) The medical bill reveals personal medical information about me. ( This is violation HIPAA- HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996 ), rules prohibit disclosing my individual 's protected health information unless you specifically authorized them to. 3 ) Creditor is reporting history inaccurately such as last date reported and last activity dates are all wrong : The case US Court of Appeals, Ninth Circuit, No. 00-15946, XXXX XXXX XXXX XXXX This defamation and causing me financial injury. The fine extent of damages incurred by the wronged party as deemed by the court. 4 ) Collection agencies " Re-Age '' by reporting the date of last activity instead of the date of the first delinquency. 5 ) Collection Agency, has not validated my debt and they are still continue to report to the credit bureaus. Consumer protection afforded by the FDCPA Sec. 809 ( b ) FTC opinion letter XXXX from XXXX fine of 1000.00.6 ) Last and not least I am not committing to pay this debt. I ask them to validate by answering the following questions and provide documents. sent a validation letter to the company they did not send the correct information I asked for. This company has broken the law Pursuant to 15 usc 1681 ( a ) ( 1 ) the banking system is dependent upon my consumer report being fair and accurate. After taking a look at my consumer report. I realized that report was inaccurate, and this inaccurate report is unfair to me because i was never notified when this inaccurate information was furnished and i was never notified when during your company 's initial investigation that you were going to report this information Pursuant to 15 us 1681 ( a ) ( 1 ) This gave error has undermining my confidence in your company 's procedure and as a result of this I will no longer be extending credit and if this information is not removed, I no longer want my information reported in your companies database Pursuant to 15 usc 1681 ( a ) ( 2 ) Your company is a powerless elaborate mechanism. This mishap that your company has caused and has ruined my reputation and it has adversely affected my credit worthiness Pursuant to 15 usc 1681 ( a ) ( 3 ) Your company assumed this role. You were not given express permission by me XXXX XXXX!!!! the consumer competent court jurisdiction so not only did you fail in the initial investigation of this information. Youve also assumed this information was valid which is a VIOLATION of my consumer rights. Pursuant to 15 usc 1681 ( a ) ( 4 ) You did not ensure that the information is accurate, and you did not exercise your grave responsibility with fairness and impartiality. You took one side of the story and never consulted with me to find out if this transaction even took place. As a result of this my privacy was breached and this VIOLATED my rights to privacy. Congress makes it clear that a consumer report should not include transactions between the consumer and the person making the report. This alleged transaction that you are reporting and failed to investigate. whether or not it factually took place can be categorized as a transaction that took place between the consumer and person making the report. Which means it should not be included in my consumer report and infract is a VIOLATION of my consumer rights. Pursuant to 15 usc 1681a ( d ) ( 2 ) ( iii ) In your initial investigation I ws never given the opportunity to deny this information being communicated on my consumer report. This is a infract another VIOLATION!! ( Please see form attached ) Due to your companies negligence, I am demanding each and everything in the attached letter. If each thing I am demanding can not be provided, then you are too block and delete this inaccurate information

There a re five steps to submit your complaint : Step 1 : What is this complaint about? RMC Of America {$350.00} lawsuit filed against me in error. I have the letters stating it. They removed it from my credit bureau after I spent months dealing with it. However, the debt wa s 2 years old a nd the employer I was working for at that time said the debt was " written off ''. When I expressed to him I was going to move my company a few months ago he started planning a way to hurt me and put me out of business. I am suing over it. He affected my credit, my bank account funds because he was using my construction company but not paying it and forced me out of house and home. He is now trying to state an unlawful detainer even though I was never actually given a reason. I was treated in the manner of " either quit or resign or else ''. I have it on camera and proof of this man. Step 2 : What type of problem are you having? Unable to use my credit because it was so poorly affected. I have never been late or denied for anything in my life. I am unable to buy a house to move from that situation. Not only that he hurt my cash liquid funds and I have lost so many contract jobs over it. I was never served a notice of " warning '' for a lawsuit or any late notice. In fact, I made communications about this by email as his office was not very organized with this sort of thing. A collection agency is trying to collect a debt from me that has been paid by my insurance company. XXXX county medical center is trying to collect for services render XX/XX/XXXX. The Insurance company informed the medical center the debt has been paid but the medical center continue to harass me. This is the second time that the center turned this bill over to collection. I informed the collection agency the bill had been paid and they pulled the bill back. Now it has been almost 1 year and I get another letter from the collect agency, I asked for proof from the insurance co and they sent me a ltter showing bill paid in full and there was nothing owed by me, I informed the agency that I had a letter showing nothing owed by me and they wanted a copy of the letter. I mailed a copy of the letter that I received on XXXX XXXX, XXXX and to my surprise I received another letter with a copy of the validation of the debt and there was no mention of the copy of the letter that I sent them showing I did not owe this bill. Enclose is copies of correspondences from the collection agency. I consider this a form of harassment. I am XXXX XXXX XXXX that is why I pay for a supplemental insurance policy to pay medical bills that medicare dose not pay. I have been harassed for over 1 year with this hospital, I have tried to settle this account by asking the hospital to a XXXX way conference call and they refuse to speak with insurance company while I am on the line

I have a previous CFPB complaint that I filed on XXXX against RMC. On XXXX XXXX compliance Officer XXXX XXXX responded to CFPB stating that RMC will be removing the amount from my credit report. I called RMC on XXXX and asked when would they send in proper documentation to XXXX to remove this debt for my credit report. XXXX XXXX told me that she has someone that does that and will handle it. I called XXXX XXXX to make sure that the account was remove. I not only did I find out that its still there but also found out that RMC reported it XXXX after sending that they would have it removed XXXX according to the response from XXXX XXXX. XXXX updates daily. I call daily. RMC is FALSIFYING documents. The account amount should not only be changed but also the account should be deleted. In my attachment there is the Letter that RMC XXXX XXXX statement on XXXX. The report should not have reported as a collection. I would also like documentation from RMC stating that the account has been removed not that it will be removed.

I was a victim of Identity theft for medical bills in XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX, and XXXX XXXX I knew nothing about this until the collection agency sent a garnishment letter to my employer and I now have garnishment every week taken out on my checks. There was a judgement on me in XXXX and the collection agency process served the person that did this to me. We weren't living together nor married. Which she lied and told them that we were married so they let her sign for it. I have spoken several times with the collection agency about this medical identity theft that is going on. Which they told me basically it is up to them no matter what process I take to prove this is identity theft that they wouldn't take the garnishment off me. So I don't know what to do??

On XXXX XXXX XXXX compliance officer at RMC responded to my complaint stating that they deleted the amount from my XXXX file XX/XX/2021 via the XXXX XXXX. It was deleted and removed but then reported on XXXX. See attachments of the response from XXXX XXXX stating it had been deleted and also attachments of when it was last reported. I would like this to be REMOVE AND DELETED from my credit report immediately. I would also like for RMC to get rid of the file obtaining my personal information because it clear that they are falsying documents. I have the proof. This has hurt my ability to obtain credit and has hurt my character. PLEASE REMOVE AND DELETE. I called RMC but no one has reached back out to me.

This organization started calling me yesterday XX/XX/22 while I was at work and again this morning while I was asleep. I returned their call to see what they were needing and before I could say yes I was who they were looking for or no, they started asking me to verify my personal info, SSN, mailing address or anything of that nature and I then ask before I disclosed any thing, what was the nature of the call. The response was that it was a personal matter. If it is a personal matter, then use the post office. I would have been more receptive if I was told who they were and it was an attempt to collect. They didn't need to say who or what was owed.

RMC contacted me repeatedly, I informed them this debt was part of a XXXX settlement and they should contact my attorney. I gave them his name and phone number and explained to them I am at work. I told them they needed to put all of this in writing so I could get it to my attorney. They did not call or write to him, they continued to contact me. When the settlement came in the original creditor denied ever contracting or selling my account to RMC. The debt was paid by my lawyer directly to XXXX XXXX XXXX. RMC will not take this off my credit report and has not responded to my letter.

On XXXX I received a summons that I was being sued by RMC of America for medical debt from XXXX. I never received any sort of bill in the mail and I'm being charged for bills from an agency I don't recognize. The original bill was with XXXX XXXX XXXX XXXX in XXXX XXXX, AR and they sold my debt to RMC of America. I also received no notification of that transaction. I had no medical insurance and asked the hospital for financial assistance options multiple times. There was XXXX communication with me, it was shocking and the bill is astronomical.

I sent a letter to RMC of America specifically asking them to verify debt with breakdown of fees including any and all collection cost and medical charges. I ask for a copy of my signature with the provider of service to release medical information. I was told that they could not validate because the place of service has been closed for years. RMC of America is a place of business and DO NOT have proof of validation. They are violating FCRA and FDCPA laws.

I recently reviewed a copy of my credit report. I was shocked to learn that I have been a victim of identity theft. I found numerous accounts on my credit report that were not open by me. This has been hurting me significantly as I am in the process of buying a home for my family. Please remove the fraudulent accounts and their balances ( two accounts one in the amount of {$4100.00} and the other {$1200.00} ) from my credit report as soon as possible.

I was never notified of this debt, per 15 USC 1692 I was to be notified within 5 days. Per 15 USC 1692gf, unfair practices. No information given regarding debt. FTC Report filed and other reports filed. Unknown debt over 3 months now and no information given. Not sure who this company is and how I even owe them or ever entered into contract.

I asked for them to verify @ RMC of America which they could not provide 100 % accurate information or validate that the debt was mine. In return I was informed that she could not validate that the debt was mine because the original creditor was no longer in business.
