Complaint against : XXXX XXXX XXXX & Debt Collector- XXXX XXXX , Attorney At Law, XXXX XXXX XXXX XXXX , XXXX XXXX , XXXX TX XXXX ( XXXX ) XXXX Rausch, Sturm, Israel, Enerson & Hornik LLC On XXXX XXXX , XXXX , I noticed an error on my XXXX credit report. An erroneous bad debt was noted for XXXX XXXX XXXX for approximately {$8000.00}. I immediately submitted an online dispute of the charge and it was subsequently removed. I received no other notification at that point. XXXX XXXX , XXXX I received a letter from XXXX XXXX XXXX XXXX XXXX Debt relief attorneys offering their services for a " Register of Actions '' filed with the XXXX XXXX , Texas Court with Judici al Officer XXXX XXXX . The " copy '' of th e Register of Action referred to case no. XXXX . It stated it was Plaintiff 's Original Petition for Discovery an d stated that I was cited, but unserved on XXXX / XXXX / XXXX . No additional information regarding my account was in this copy of the " action. '' The plaintiff attorney was listed as XXXX XXXX at the address above. Suspicious of the advertisement for XXXX XXXX services, but alarmed, I contacted the Plaintiff attorney listed as XXXX XXXX at XXXX XXXX XXXX XXXX . I provided the Case number on the document I received and was told no one could locate my information and I needed a " file number. '' I told them I had no file number, but that it was regarding a XXXX XXXX XXXX account. I made multiple attempts to reach a different person at their organization that could help me, to no avail. I provided my name and all other pertinent information. I SPECIFICALLY ASKED MULTIPLE TIMES FOR PROOF OF MY DEBT AND/OR A COPY OF THE LOAN AGREEMENT I SUPPOSEDLY SIGNED. They said they had no file for me. I thought it very suspicious that they were suing me, but could n't locate any information about me. I then called XXXX XXXX XXXX multiple times over the course of several days. I had an account in the past with them that was assumed by my former spouse as a part of our divorce settlement. My ex-wife had said that the account was paid off. I provided all of this information to the XXXX XXXX XXXX representative. She did find an account under my name, but said that they no longer had it and provided me the toll free number for the XXXX attorney. I asked her for a copy of the loan agreement for the loan with their company or a file number associated with my account. She said she could n't help me and to call the attorney. Alas, she could provide me no details about the account at all and simply referred me to the attorney. I contacted the attorney again who asked for my file number and said they could n't help me without it. At this point I assumed that this was not a valid attempt to collect a debt and that it must be a clerical issue. I based this on the fact that the disputed record was removed from my credit report with XXXX and neither XXXX XXXX XXXX or the collection attorney could provide me with any information or even show they had a record of my account. XXXX XXXX , XXXX : At XXXX XXXX a gentleman with no official identification or apparent association with any law enforcement or legal agency came to my home and " served '' me with a citation regarding Cause No. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Vs. my name. The man represented himself only as a courier and none of the documentation I received identified him. The document had a handwritten date written and crossed out and then that date written in. The citation gave notice of a lawsuit filed with XXXX XXXX XXXX XXXX XXXX , XXXX , TX. XXXX XXXX XXXX XXXX XXXX . The notice lacked the official stamped seal and did n't look official and was not served to me in the manner expected of a legal notice. It stated that I have 20 days to respond to the discovery request on the front page, but says 50 days inside. Also, it states that exhibit A is a copy of a loan agreement. I was not provided with a copy of this document and, furthermore, I have requested it multiple times and was told it could n't be provided. I am aware of my rights to receive proof of this debt. Facts : I obtained a loan from XXXX XXXX XXXX approximately 8 years ago. My account was open at the time of my divorce on XXXX XXXX , XXXX . In my decree, my ex-wife assumed responsibility for the account balance of {$2500.00}. She also assumed rights to our home that was currently financed and deeded in my name only. She was given 12 months to get the home in her name. She was provided a limited power of attorney to conduct business necessary to get the home in her name. I was told that the XXXX XXXX XXXX account had been paid. The home ownership transfer was completed in XXXX XXXX . She stated to me that she had to take out a loan to buy new carpet for the house. She did n't provide any details or information. I made no assumption that this would have been in my name as our divorce was final and she had assumed all rights and responsibilities associated with our home. I think the personal loan we had through XXXX XXXX XXXX may have h ad a lien associated with our home, but this was all left to her responsibility. The limited power of attorney she had was limited to use for transfer of the home. It would not have included extending or acquiring any debts in my name. I share this information because I have reason to believe that the account in question may have fraudulently been extended without my knowledge, authorization or signature. My ex-wife has dismissed any requests I have made for information. In the information provided to the court by XXXX XXXX XXXX , it states that I entered into a contract with them on XXXX XXXX , XXXX for a credit. They have been unable to provide an account number for this loan. They state that a payment was made on XXXX XXXX , XXXX and then defaulted. They also state that the account was closed unpaid on XXXX XXXX , XXXX . I have not received any correspondence from the creditor or collector until the XXXX solicitation from XXXX mentioned above. I am not responsible for this debt. This debt collecto r ( Rausch, Sturm, Israel, Enerson & Hornik LLC ) is using threatening tactics to attempt to extort money from me without providing any proof that it belongs to me. They have not been able to provide any information whatsoever regarding this debt. Either it is a bookkeeping error on the creditor 's part or the debt was incurred fraudulently in my name by the loan originator and/or my ex spouse. She has not been willing to share any information to assist me in clearing up this issue. She simply states that it was paid. I would like to dispute this debt. I am filing a complaint with the XXXX XXXX XXXX XXXX in XXXX XXXX TX against the loan originator and my former spouse alleging identity theft and fraud. I believe the limited power of attorney could have been used beyond its authorization and her signature on my behalf would be void, the loan originator and my ex spouse colluded in defrauding XXXX XXXX XXXX , or the loan has been paid and the basis for collection is false. The dates associated with the loan provided to the County Court seem to align with the dates of the transfer of my home to my former spouse. This does raise my suspicion as to the circumstances. It could be construed that the amounts would seem to align with the payment of the previous balance assumed by her in our divorce decree with an extension and additional loan to cover the cost of the flooring required by the lender for her to get the loan for the house in her name. The dates of this contract are 12 months after our divorce was final. I would like to receive proof of the debt : 1. Specifically a copy of my signature on the loan agreement dated XXXX XXXX . I absolutely was not a party to this contract and any signature was made fraudulently via outright forgery or was made outside the parameters of the authority of an authorizations made to my former spouse. At this point I am really just conjecturing as to all of this because XXXX XXXX XXXX and the attorney have not been able to provide me any information of any kind including account numbers or even the information provided in the legal notice. The very people they say to call ca n't even find my information. 2. I would like to receive proof that the funds were ever distributed. I did not receive the proceeds of the loan in question. The loan originator should be able to determine to whom they were released and ascertain that they were not provided to me or anyone on my behalf. I appreciate your assistance in clearing up this issue. I intend to provide a copy of this complaint to the XXXX XXXX XXXX XXXX alleging fraud, to the FTC for potential identity theft, will copy the Attorney and XXXX XXXX XXXX and all of this will be provided to the XXXX XXXX , TX County Cl erk. I will also be notifying all XXXX major credit reporting agencies of this error and potential identity theft and fraud.

Back in XX/XX/XXXX I called XXXX XXXX to inquire about buying a home. The gentlemen at XXXX XXXX informed me I had a Judgment against me and until that was taken care he was not going to be able to help me buy a home. I asked him who the Judgment was from and he gave me the name of Rausch, Sturm, Israel, Enerson & Hornick, LLC. After being informed about this Judgment placed against me in XX/XX/XXXX I immediately called Rausch, Sturm, Israel, Enerson & Hornick, LLC to find out what the Judgment was for and how I could resolve this judgment, even though I believe it was a debt I did not create. Upon calling Rausch, Sturm, Israel, Enerson & Hornick, LLC I spoke to XXXX XXXX at ext. XXXX. XXXX explained there was a Judgment against me from XXXX XXXX with the original debtor being XXXX XXXX. I asked when this account was opened and he told me XXXX. I asked for the information from this debt and he said I would have to contact XXXX XXXX. So to protect my name and my credit XXXX offered me a monthly payment of {$200.00} or a settlement of {$6100.00}. I explained to him that I would take the monthly payment arrangement as I did not have {$6100.00}. I sent in my 1st payment of {$200.00} on XX/XX/XXXX. As time went on I continued to make payments, but unfortunately being I am a single mother I was unable to continue the $ 200 monthly payments. I reduced my payments to {$100.00} or less a month as I just didnt have the funds to continue with large monthly payments. I made all my payments on the website of Rausch, Sturm, Israel, Enerson & Hornick, LLC so I could keep track of my payments that posted and I could also keep track of the balance of the account. As I was making payments I noticed my balance was not decreasing and in fact it was growing. On XX/XX/XXXX, I was notified by mail from XXXX XXXX County, WI XXXX XXXX that a Transcript of Judgment was filed on XX/XX/XXXX. I called XXXX, XXXX, XXXX, XXXX XXXX XXXX, XXXX on XX/XX/XXXX and spoke to XXXX XXXX at ext. XXXX and asked him about my payments and also asked why the balance was not dropping. XXXX explained that the balance would never decrease as I was paying an interest rate of 12 % plus lawyer fees. I explained to XXXX that this debt isnt even mine and that I would like the information regarding the debt and what it was for. At that time XXXX offered me a settlement of {$6700.00}, which again I explained I did not have that kind of money. I explained to XXXX that all the money I had paid from XX/XX/XXXX to XX/XX/XXXX went nowhere and I was basically paying on a debt that would never be settled and I would be XXXX years old by the time I had it paid off. XXXX said he was sorry, but that he couldnt do anything for me, but that I could call back and make an offer to settle. I called Rausch, Sturm, Israel, Enerson & Hornick, LLC on XX/XX/XXXX and offered to settle for {$2500.00}, even though I still had no idea what I was paying on, but I wanted it to go away. XXXX said the original Debtor of XXXX XXXX would not settle for that amount, but he advised me to keep making payments. I called Rausch, Sturm, Israel, Enerson & Hornick, LLC on XX/XX/XXXX and spoke to XXXX at ext. XXXX and she offered me a settlement of {$6800.00}, but I explained yet again to her that I would like the information from the debt. I advised her that I did not have that kind of money, but I was willing to make monthly payments to get this debt taken care of. XXXX advised me they could give me monthly payments of $ XXXX for 24 months, but again I explained I could not afford an additional $ XXXX a month with my income. XXXX told me they would continue to accept my payments and to call back when I could settle. At this time I just continued to make payments when I could. On XX/XX/XXXX I received the mail at my employer of XXXX XXXX and I came across the Affidavit of Mailing from XXXX XXXX County addressed to XXXX XXXX to start Garnishment proceedings against me. I immediately called XXXX, XXXX, XXXX, XXXX XXXX XXXX, XXXX and spoke to XXXX XXXX at ext. XXXX. I was completely unaware a garnishment was in the works to take place and I was never notified by mail or by personal service from someone who represented XXXX, XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX, so I was completely blindsided by this action. XXXX XXXX went through a financial questioner with me and I gave her my earnings after taxes and she advised me I would need to send in my last 4 paystubs to her email of XXXX. XXXX advised once she received my information she would go over it with her boss and would call me back later that day. I told her on the phone that I would like all of the original documents from when this account was opened and the signature card. XXXX didnt respond to me about that, but advised me again to send my paystubs to her email. Around XXXX on XX/XX/XXXX I had emailed XXXX thanking her for talking to me and I explained before I could send in my paystubs I would need the signature card from XXXX when the account was opened. I waited for her response, but I did not receive one. Around XXXX on XX/XX/XXXX I called XXXX , XXXX , IXXXX , XXXX XXXX XXXX , XXXX and spoke to XXXX and he was going to transfer me to XXXX , but explained she was on a long call and she would have to call me back. I waited for a call back, but never received a call back, so I emailed XXXX again at XXXX asking for the signature card and a copy of all of the charges from this debt. I told XXXX I was more than willing to work with them, but I would like the information before I was able to proceed. I did not hear anything back. On XX/XX/XXXX, I called XXXX, XXXX, XXXX, XXXX XXXX XXXX, XXXX and spoke to XXXX XXXX and I had asked her if she could provide me with the original documents and the signature card and she said she did not have that information but has reached out to the original debtor and was waiting on a response. XXXX advised me that she would send me an email later that day with all of the information she did have from my file, but as of XXXX XX/XX/XXXX I had not received an email from XXXX . I took it upon myself and called XXXX XXXX XX/XX/XXXX, being they are the firm that turned my account over to XXXX, XXXX, XXXX, XXXX XXXX XXXX, XXXX. I had spoken to XXXX and I had asked her if she had the original documents from the account and she explained to me that she did not have that information, but I could try and call XXXX XXXX. I took her advice and called XXXX XXXX and spoke to XXXX, who then transferred me to XXXX. XXXX told me in order to get the original documents I would have to write a letter to XXXX XXXX requesting the information and they would have to send it to my home. XXXX gave me the address of : XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX UT XXXX. On XX/XX/XXXX, I sent my written request Certified Mail to XXXX XXXX for the original documents from this account that was opened in XXXX. As of XX/XX/XXXX, I have yet to receive any information from this original debt they say I owe. The Judgment is noted in XXXX XXXX County Circuit Court in the amount of {$7600.00}, which as of XX/XX/XXXX I have paid a total of {$1400.00}.

Rausch and Sturm continues to threaten me continuously, unclear sent letters and lawsuits threats without including the name of the credit card but just XXXX, keep in mind XXXX holds numerous credit card accounts. They have taken advantage of me, continues to threaten me by 3 law suits claiming its from XXXX only, having a constable come to my home to place notes & filed lawsuits taped in front of my door when they NEVER provided proof of the debt as I sent over a letter attached to Rausch to prove the debts as I did not know my rights at the time I was served/threatened. Rausch refused to provide proof of the debts and the amounts. I had several accounts with XXXX and informed Rausch I lost my job and going through a hardship as they informed me that I had by law to pay the min of XXXX to XXXX and asked for my for my checking act routing no, act no and credit card no and asked where I was working as I also recorded the conversations. On XX/XX/XXXX another document see attached XXXX ; serving papers taped on my front door. It states XXXX-Im thinking what credit card is this as it s not indicated on order. Signed by a judge notice of law suit for {$1100.00} in damages etc, citation states XX/XX/XXXX opened act but no proof or copy of the agreement, no valid copies, or pay history, no bonding comp giving them the right to collect in the State of TX, or copies of the agreement. eventhough I sent a letter requesting this info. Due to the suit and threats I agreed to pay Rausch after talking to their Attorney on XX/XX/XXXX her name was XXXX XXXX as she stated she was cllecting this debt, recorded conversation, 1st she said she couldnt accept anything under XXXX as we agreed to XXXX a mon How do I know this amount is correctand Rausch had the right to collect and sue me? I asked whos the creditor she said XXXX, I said theres no indication in your law suit papers its XXXX. When Im being sued, do I not have a right to know whom Im paying? i come to research and found I already agreed making pmts to Rausch for this XXXX act, I made 2 pmts XXXX XXXX and XX/XX/XXXX, XXXX I sent debt validation letter to Rausch for proof of debt and never received proof. I asked XXXX how was I supposed to know who the debtor was? She said I could have called XXXX- i said I did and they informed me they no longer hold this act and was sold to collections law firm. Do I not have any rights and just obey Rausch for any amount and any credit card from XXXX? So Rausch tried to collect Twice for this XXXX suit and did not credit me the 2, XXXX payments on the balance as the balance in the law suit is incorrect. This law suit has too many errors and very threatening and misleading. I dont care if its a dollar, the amt is incorrect. Rausch refused and failed to provide me with this info but Iwas sued, my rights violated, no verification of this debt, companys name is missing, amount incorrect and I am required to obey and be sued? Its also reported on my credit report Chargeoff. This action must be stopped due to this law firms incorrect info. After we discussed she XXXX said I have another suit coming. I said from who, she said the same creditor, XXXX XXXX, I said that act. is with another collection agency called XXXX, I read the info to her, including the dates, amounts and pmts made thru my act, she said send it to her via email and we will have to pend the act for 2 weeks for research. I sent via email proof XXXX to XXXX next day-see attached. I made pmts to XXXX as Rausch proceed to sue me eventhought they received proff I paid thru collection agency. see attached, I received XX/XX/XXXX a yellow notice a constable came by and contact them-see law suit as I recei ved today XXXX from the XXXX county Constables office of law suit with XXXX., again not credits name, Amount is incorrect, I made pmts to XXXX and now Rausch is also collecting the debt knowing I paid XXXX, again rights violated, no proof of the validaity of the debt and Im supposed to obey and be sued? I obeyed XXXX and they reneged, I had auto pays thru XXXX and mon pmts stopped as I did what I was supposed to do, they stopped pulling pmts and now Im being sued, this action must be stopped. Wheres proof Rausch had to the right to collect this debt as my rights have been violated by Rausch, Rausch should have provided proof before collecting both XXXX and XXXX. They also called me few days ago, I called back and spoke with XXXX as she said shes collecting a debt for XXXX XXXX XXXX, as I never gave Rausch the right to call, she claimed I never paid, I said thats a lie, I said I have been paying monthly and she lied to say I made one pmt in XXXX, Rausch is committing scams and trying to collect the same debt twice to make extra money off of me as I will assume they think Im crazy and will agree obey to any and everything. They have no right to receive multiple pmts and aware of the situation, cant get the amts correct and did not disclose company name.My rights have been violated. Their communication are all threats and misleading, amts are incorrect. How many mistakes are they allowed while filing suits against me and reported to the credit bureau of chargeoffs. They improperly collected 3 debts and lawsuits, XXXX, XXXX and XXXX thru XXXX. Their indication of a crime and they are incorrect in the amounts and not proved the validity of the debts. Their communication tactics are unfair and clearly violated my rights. They were totally aware a collection agency took auto pays thru XXXX and continued to proceed with the law suit to collect. My neighbor gave me a intent to sue that was found in their yard in XX/XX/XXXX. The neighbor across the street saw someone in a gray XXXX XXXX XXXX leave it one the door. So, Im assuming it blew off and into my neighbors yard ... Leaving a third party knowing My personal business. Anyway, so after talking to my lawyer I decided to go on and settle instead of paying a lawyer. So, I set up three payments ; made the first payment XX/XX/XXXX ( which my XXXX checking would not pay it because they thought it was fraud ) the money was on the account I have proof of that. Anyway I finally got it settled it was paid, the second and the last payment was made XX/XX/XXXX. To pay it in full. I called the law firm collecting the debt and told her ( XXXX XXXX ) that it was paid she said okay it will be three weeks before we send you a settlement letter. That as strange to me I had this same issue about three years ago and they sent me a letter outlining my payments and as soon as it paid off they sent me a letter. Okay that was another dishonest thing she said. They the law firm would send me a letter. I found out when I called 6 weeks later to find out when I would receive my letter ... So, she said you didnt finish paying this I said what I did, she started talking about that first payment I said what after I clear it up with Discover it clear a few days after.. Also reminded her of our conversation in XXXX re : Discover messed that up but the payment would be clearing and it did. So, she checked that out and contacted me again saying it still not paid in full because I owe a {$1.00} I said WHAT????? A {$1.00} after I paid over XXXX. She said yes the last payment was XXXX not XXXX I said oh my goodness. I went online and made it immediately and emailed her and sent a copy of the {$1.00} payment and asked again when will I receive the letter showing its paid in full. She said soon, so I waited again and nothing!!! So, I contacted XXXX XXXX again and she said We sent it to the courts to dismiss I said what why did it have to go to the courts if nothing was every filed. She said it up to the courts to dismiss. I said what again I said why is that when you guys are the ones who originated this. So anyway the letter as supposedly sent to the courts so I called the courts and found they had not received anything from them. And said it wasnt a court date for me and to call them and ask them to resend to me ... So, I did that and XXXX told me they resent it and for me Wait for a letter from the courts. That was in XXXX. So I waited and waited and on Thursday, XX/XX/XXXX I went to the mail and received a letter from the courts and was so happy excited that oh I finally received the letter showing it was dismissed. But oh no it was a letter from the courts saying a hearing notice that I will be going to trial for this paid debt. So, I emailed XXXX Last night and told her what was going on and she email me today and said it was emailed the courts this morning XX/XX/XXXX ... So, I sent the courts at their request asking why was I was getting a hearing notice. So they ask me to put it in writing and email it to them. So I did, I called to see if courts got the email from the law firm/debt collector and the only emails they received were the two that I sent and that was about 30 minutes after I sent them ... Again, the email that was supposedly sent by the courts the morning of XX/XX/XXXX was not received yet. Im just not understanding this, I feel harassed and stress above measure. Why hadnt two mailed letters and an email make it to the courts???. But the original filing made it there with no problems. Now that is strange and unusually. The letter the courts need to stop this mess has not made it? Im sick and tired if this. This has caused my XXXX XXXX to exceed where it should be ... I had to spend money to go to the doctor and just to stressed. I did my part after I ran into back circumstances and couldnt pay the original debt. But finally got the money to make a settlement and did just that in the three months allowed.. she told me as long as I had it paid but XX/XX/XXXX. I was good to go ... But its 6 months after the last payment and Im still be threatened and having to stress over going to court on this. Why and what is so hard about this to get me the information that its settled in full? I can and will send all documents but its to many emails to send ... ..

AMERICAS BIGGEST SCAM TO EACH CREDIT REPORTING AGENCY, XXXX, XXXX AND XXXX XXXX RESPECTIVELY : A scam is being presented to each credit reporting agency in millions of cases. The Federal Trade Commission agreed years ago that the debt collection business is broken, and now, because of a loosely held Supreme Court decision, the debt collection industry has gone off the charts on illegal activity of the transfer of trade for personal credit matters. Each of these violations where proof of ownership is not sustained is a serious breach of an implied agreement between the collection agencies and the credit bureaus through the subscriber agreement between the parties. Your credit reporting agency needs to investigate this abusive practice and the Consumer Financial Protection Bureau ( CFPB ) must initiate a serious investigation on this abusive practice. My files should be purged permanently as the fraud has already been committed, and I am subject to my rights to sue for damages. I am one of millions of American consumers who has been entwined into a scam by various collection agencies in America. Attached is a document known as a qualified written request or QWR. There are several posted collections on this QWR, all with account numbers backed by copies of collections from Rausch Strum. On each of these collection notices it specifically states that Rausch Strum is the new owner of a debt or debts that were originally with another creditor. However, a fully completed QWR on each of these debts will prove that not only is Rausch Strum the new owner, but that any transfer would have been illegal unless said transfer came from a securitized trust agreement. All of these debts were sold off into a trust, and the QWR for each debt will prove so. Now Ill explain how this scam originated in the United Stated over the past year. On XX/XX/2017 a decision was handed down in the United States Supreme Court on a case called XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX. This 11-page decision comes right to the point on the application of the Fair Debt Collection Practices Act ( FDCPA ), the rights consumers should have under this act, and the tracking of new ownership. This decision left a window open for the debt collection agencies and their counterpart original creditors to pass off charged off debts without the proper documented trail. The decision states that a buyer of debt ( s ) can work outside the FDCPA protections guaranteed to consumers. The problem is becoming a giant problem pertaining to trade rights for Americans who should be protected under FDCPA. Im making the claim that each and every one of these collection has perpetuated a fraudulent activity that should be beyond a civil complaint, but more criminal in nature. Rausch Strum has never acquired these debts legally. There was no tracking of the debts from originality to a securitized trust, and from a trust with multiple signatures to Rausch Strum. Your credit reporting agency needs to investigate this abusive practice and the Consumer Financial Protection Bureau ( CFPB ) must initiate a serious investigation on this abusive practice. Creditor never notified debtor that they sent the Writ of Garnishment to the wrong employer of debt. They provided the following information : Re : My first and last name Creditor to Whom the Debt is Owed : XXXX XXXX XXXX, XXXX Our File Number : ( listed file # ) Account # : ************* ( last four of acct ) Account balance : ( amount listed ) They later filed a civil motion on behalf of this company. The judgement that they received substantiated the debt owed via their purchase from the original creditor. Debtor contacted to make payment offer via email and never received a reply. Debtor contacted agency via phone and established a payment plan, but it appears that the creditor also attempted to garnish the debtor 's wages. After payment plan was accepted, debtor made payments and appropriated funding for the payments as required. However, the creditor started to change the dates of the payment plan, which the debtor never agreed. Without speculation it is not entirely known why. Debtor then received a letter in the mail from a third party. This third party appeared to be some sort of private security agency somewhere in the state where the debtor resides. The creditor had submitted for a Writ of Garnishment around when the payment plan was accepted, and they attempted to reach out to the Debtor 's employer to establish the garnishment. The debtor had no affiliation with this third party at all. This Writ included personal information regarding this debt, his address, full name and the state case number for the civil suit against him. This violates the Fair Debt Collection Practice 's Act, Section 805, ( b ). Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.

I didn't have a XXXX credit card so I disputed it right away by certified mail return receipt asking for records or a contract showing that I have a credit card with them and received nothing in return. On XX/XX/XXXX, I spoke with a representative ( XXXX XXXX ) who assisted with a settlement agreement to pay off a credit card originally with XXXX XXXX Account ending in XXXX who then turned it over to XXXX. Because I was not aware of who XXXX was when they called, they never left voice messages, but would hang up. My account was then turned over to another debt collector/Rausch Sturm/Another debt collector, Account No. XXXX The total balance owed to XXXX XXXX was {$1800.00} and the settlement agreement with Rausch Sturm was {$1400.00} in 12 installments monthly of {$120.00}. As you will see from the bank statements provided, I have been faithful in paying monthly up until XX/XX/XXXX. When I went online to make my payment, I noticed my balance had changed from {$480.00} to {$730.00} ( see copies attached ). I contacted Rausch Sturm to find out why the balance was more than what I was showing last month XX/XX/XXXX when I made my payment. As stated by XXXX one of the Representatives. My account went in settlement default. I first asked why? And that I had not missed any payments. She could not tell me why. I then asked her if a letter had been sent out stating why? She said no, I requested a letter of all payments made, my agreement as well as the reason for settlement default. XXXX stated ; not sure we can do that. After making the request again and ending the call. I felt it necessary to contact Rausch Sturm again and spoke with XXXX XXXX ( debt collector ) and informed him that until I receive documentation in the mail due to my settlement being defaulted. All payments would be placed on hold. Mr. XXXX informed me that it was noted to provide me with the documents as well as review my settlement agreement to determine what could be done. I would like to also add that in the first 3 months of making my payments, I could never go on the website as it would not allow me access, so I had to contact a representative to make my payment of {$120.00}. After three months the service was up and working. Almost 3 months left to making my final payment, they decide to put my account in settlement default and request an additional {$240.00}. Im not sure exactly what their goal or plan was however, as a customer in good standing, I believe I am entitled to the documentation that I should have received when the agreement was first put in place. However, you will see that with every conversation, I noted the amount indicated to settle. I also believe that if I have been faithful with making my payments then why the settlement default. In XX/XX/XXXX, I was receiving calls from XXXX, however upon my returning there call they stated we can not speak with you as we do not have your loan. I then contacted Rausch Sturm and spoke with a representative ( debt collector ) who indicated they had not received a payment from me. I stated the payment was made on XX/XX/XXXX. The debt collector argued with me that she didnt know what the payment was going towards to that comment, I was puzzled. his is my second complaint about XXXX XXXX and their associated law firm. My first complaint was settled. However, the tactics at which these individuals use to settle their debt is concerning. I originally filed a complaint in late XX/XX/XXXX. I received a response letter dated XX/XX/XXXX. I first received original correspondence in XXXX of XXXX of which I did not respond initially, as I thought this was a scam. I will admit that I did not remember signing up for a credit card at first, but then I was doing some research on my own. On XX/XX/XXXX at XXXX CST there was a knock at my door, which is in a secure apartment complex so I am not positive as to how this person gained entry, I answered and he handed me papers and walked away. These papers contained nothing but the file number, bland information as to what I was being charged with ( which was a shock to me as this was the first I was hearing of potential court issues ). Email correspondence between XXXX XXXX XXXX and I happened on XX/XX/XXXX ; I was reaching out to XXXX about any settlement opportunities that may be available. He responded asking for a good phone number at which I could be reached, I replied with a phone number and told him the best times that I could be reached to discuss. After, I received no further emails or calls. On a letter dated XX/XX/XXXX I received an offer letter from RSIEH about an offer to settle the claim against me for {$420.00}, the letter included a website to where I could pay online. I received a letter in the mail in early XXXX containing an order from the XXXX County court letting me know that an action was filed on XX/XX/XXXX against me. The letter contained a file number that the state has for this judgement, however no such court dates. After receiving this letter, I decided that I should pay the amount that I owed and I would move on. I submitted a payment for {$590.00} on XX/XX/XXXX using their website, the funds were deducted on XX/XX/XXXX from my bank account. I then called their office on XX/XX/XXXX requesting a receipt be sent to me, the individual I spoke with said that I should be receiving it within 3-4 days and the letter would be sent out that same day. After waiting over the time period, I then called again requesting a letter on XX/XX/XXXX and they said that one would be sent out and they did not see my first request. As of XX/XX/XXXX I have not received any correspondence from the company, I also have submitted online requests for contact and they have not been fulfilled. I have requested a receipt and would like them to remove this from my credit report. Due to their lack of professionalism in this matter, it has caused increased stress in my life upon fear of a lawsuit that I am not sure is even happening. They have not been fair in trying to resolve this matter, and I can say that I would have rather reached a compromise than have been threatened with legal force. Dear Sir or Maam : This letter is to file an official complaint about a law firm by the name of Rausch, Sturm, a debt collections firm out of XXXX, WI. In XX/XX/2018, I entered into a payment agreement with Rausch, Sturm when they were retained by XXXX to collect a debt I incurred when I bought furniture from them a few years ago. XXXX refused to assist me with a temporary reduction in payments when I lost my job a few months later at which point they turned me over to Rausch, Sturm. From the beginning of my arrangement with Rausch, Sturm, my account has been mishandled numerous times and I believe they are in breach of a contract that I have with them. Since my agreement has been in place, I have made my payments as I was supposed to. Rausch, Sturm was expected to process my payments and apply them to the balance each month. Instead, my account has been closed without explanation numerous times, payments have not been processed and or applied, and I can never get a straight answer out of anyone when I ask for reasons why my account is being mishandled. The response is typically one that leads me to believe they are working on finding a resolution or reason but to date, I have not received any kind of explanation for why my case is being handled this way. It seems as though Rausch, Sturm is trying to set me up to fail to meet the agree arrangements so they can then take me to court for failing to uphold my end of the agreement, as was their original intent before I contacted them to set up a payment plan. In addition, this account has been turned over to other law firms ( by XXXX 's - the original creditor ) - in spite of me being in an agreement with this other law firm. My understanding is a company can NOT collect twice on the same account using different collection agencies. XXXX 's also should be named in the unethical practice complaint as well for this and the initial occurrence that led to them turning me over to an attorney 's office. When I lost my job several months after I purchased to furniture from them I called to make arrangements for a temporary reduced payment until I could afford to pay the full payment. Being a single mom and a XXXX I was unable to make the full payment. When I explained my situation to the representative named XXXX he told me if I didn't make the full payment I may as well not pay anything at all because a partial payment would not do me any good and they would reject it. I tried anyhow and they rejected my payments. SO I stopped trying then was hit with legal papers several months later. The agreement I entered into with Rausch, Sturm is the pre-hearing/pre-judgement agreement that kept me form incurring additional court fees that I do not have the funds for. This company has garnished my bank account for a XXXX XXXX account that does not belong to me and viewing all of the other various other complaints against this company, I am not the first person that they have done this to. My first phone call was to my bank and they advised me to contact the court house which I did. When I gave the court house the Case number associated on the paperwork I received from my bank she advised that the case was named to someone with a similar name to mine, but not in my name. She also advised that the case was from 2007 and that the summons for the court case was not ever served to anyone and she could not explain how that happened and could not offer any additional information and advised me to contact the attorney handling the case. I contacted the attorney and spoke to a representative that could not provide any information other than to set up a payment arrangement on an account that was not mine which is absurd! I asked her for the process servers name and telephone number so that I can get the information on who and when this summons was served and she advised that she did not have that information and transferred me to an actual attorney by the name of XXXX XXXX ( who is not the attorney listed on the paperwork I received from my bank. ) He could not find my account in their system whatsoever. He listed addresses and last 4 of social security numbers asking if they were mine but none of them were ( the name on the paperwork is not my name and this account does not show up on my credit report either but somehow it is being garnished from my bank account. ) XXXX XXXX could not offer any help at all because he could not even find the account with their file number that was listed on the paperwork. He asked me to scan and email the paperwork that I received from the bank to him which would not be a problem except for the fact that I do not have access to a scanner and my only bank account is overdrawn and my bank said that they can not release the funds until they receive a release from the attorney 's office ( that apparently ca n't find the account. ) Meanwhile, I am being charged with late fees, overdraft fees and have NO money and no one can assist in resolving this. I have already filed a complaint with the XXXX so my next step is to contact the MI XXXX along with getting an attorney referral in my area for someone that specializes in these types of twilight scenarios!

Since I had not been notified, I did not appear in my own defense, so they won a judgment. ( XXXX XXXX ) and placed a lien on my property. They did not notify me in any manner. XXXX, XXXX, and XXXX is the company who won the judgement against me, stated that I had been lawfully served, and filed a lien on my property. Part of the troublesome path I have been through is that these three companies stall and waste time by blaming the other. I got a lawyer in XXXX of XXXX, who won for me ( XXXX XXXX XXXX XXXX XXXX for Naught Judgement Lien that has been filed with Registrar of Deeds. Also a judgement for lawyers fees. I have suffered other financial damage because of being denied a loan from my bank. I have suffered other damage because of the time and stress in trying to deal with this series of events. I have documentation for all these activities, but I do not know how to attach them. It is all on hard copy because my computer blew last fall and this electronic file went with it! I'm quite informed on the legal proceedings in regards to preventing judgements from being entered ( in terms of submitting an answer/requesting a trial date and such ), so I never let me summons/trial notices go ignored ( learned the hard way with a 12 year judgement that took months of research and years finally getting removed without having to satisfy payment ), but was recently issued from small claims a Default Judgment against me, granted to the Plaintiff, XXXX XXXX XXXX, XXXX. I'm quite familiar with the array of debt collecting companies, and I, nor my husband, said that I was served for this said judgement, or I would have answered to it like I normally do, by sending certified answers to both the Plaintiff and the Court. I have no idea how this was granted without my knowledge at all that it was happening. I did access XXXX 's site and logged in, it then said that it can not display my account info at this time and to call Rausch, Sturm, Israel, Enerson. I'm assuming said debt has been sold again? How is a judgement without my knowledge of any of this occurring? The stranger thing is that I DID receive a summons 10 days prior to this judgment being granted, with XXXX XXXX, XXXX, suing me as well. I did send a certified answer to that case number, and received my trial date for XXXX, but I am very confused on how this is possible, if it is, what steps I should take if I swear I was not notified via mail, and if I was, how far back can that summons/serving to the defendant be substantiated for? I was under the impression that there is always 14 days to answer. My only thought is that I possibly may have been served in a previous year, but don't see how that could be possible if the judgement was just granted, since court dates are typically within the next 1-2 months ( that I've experienced, and I've gone to several of these trials ). I'm located in Alabama and would love your input/advice. Should I pay to seek court documents? I do not want to have to pay several hundred dollars to appeal in Circuit Court for a {$1100.00} judgment, but I do not think this judgement is fair. Not sure if I should contact FDCPA or what my next step should be.

While I made every effort to pay my debts and fulfill my responsibilities, in this instance Rausch Sturm was unfortunately unable to do the same. I have since gotten any letters through mail or email stating this debt has been paid in full and the account will be reported to all three-credit bureau. I've spoken to several of their representatives such has XXXX XXXX on XX/XX/2020 & XXXX XXXX on XX/XX/2020 about my account and both ladies took notes and gave accusation such as : on XX/XX/2020 the account will be officially closed on their end and give 21 days afterwards for the updates/process. I was also supposed to receive a call from their Attorney XXXX XXXX after speaking with another representative on XX/XX/2020 and to allow 24 -- 48 hours to hear for a response. Also, on XX/XX/2020 a representative stated it does " shows in their system that an attorney is aware that nothing has been filed or sent out ''. On XX/XX/2020 I spoke with XXXX XXXX and again nothing was resolved, I couldn't get any answers as to why my account hasn't been updated. Now I know that everything has been delayed due to the pandemic/Covid-19 but do not give a customer false information/misworded information if you are not going to meet the accommodation. The loss of customer respect/trust has been ruined. I just want to know why hasn't there been any information reported to " XXXX XXXX XXXX '' about this account and why haven't I yet receive a letter about the account being resolved? We are in a new year and it going on 1 year since anything has been done about this account. I need answers and i need them now. I've learned this the hard way once any company sell your debt to a collection agency, they also write off your debt on their taxes which write off your obligation to pay. You can dispute the transaction via XXXX along with any other collection agency owned items lingering on your report. Your dispute reason is " contract was cancelled '' and write " no contract '' in the dispute comments. Peace and love to all! I received about a year ago a letter from Rausch Sturm attorneys at law concerning a debt I have with XXXX XXXX, for a credit card for XXXX XXXX XXXX. I called and spoke to an agent explaining my situation that I am unemployed due to a handicap and unable to work. That I am trying to get SSDI but have not been approved yet. I worked out the issue with the agent who was in Wisconsin I believed. In the next few days I started receiving calls from agent for Rausch Sturm who were obviously calling from offshore because of their heavy XXXX accents. Even though I explained my situation to them they continued to call me every day claiming they needed a resolution with the debt. I finally had to send a cease and desist order to Rausch Sturm in Wisconsin to stop it. This year on XX/XX/2019 ; I received a letter from Rausch Sturm again inquiring about the debt. I called them and explained that I am still unemployed. The agent noted it on the account and asked about the Cease and Desist order. I told her to remove it because I wanted to work with them to resolve the debt. The next day I received a call from an offshore agent claiming to represent Rausch Sturm concerning the debt. I told him that I already spoke to an agent about it yesterday and explained it to them. His response again was but we need to have a resolution to the debt. I then remembered the last time when they would call every day. I called the number back on the letter and spoke to a XXXX at Ex XXXX and explained what happened. We determined that the Cease and Desist order should be reinstated. XXXX said she did put it back on. I figured that the Issue was resolved until today when I received a call from an Offshore agent claiming to be with Rausch Sturm about the debt. Her accent was so heavy I could hardly understand her, but I told her that there was a Cease and Desist order and she admitted that it was on there and she would make sure no more calls came. Unfortunately, my experience is these offshore agents do not respect no call orders. I would like these Offshore calls to cease and only work with on shore agents. I do want to resolve this debt.

I received a letter in the mail requesting collection of debt XX/XX/XXXX for a XXXX card. The letter I received says I allegedly owe {$1400.00}. I contacted XXXX to verify what information was in their system to validate the legitimacy of the letter, at which point I was informed that the debt was being managed by a separate collection agency/law office. I found this odd because the debt was not on my credit report and in XX/XX/XXXX, I received a letter stating my inactive account was being credited for an identity or credit protection service I had during the time my account had been active. Also in XX/XX/XXXX, I received in the mail a pre-approval letter for the XXXX XXXX XXXX card, which further confused me. Yesterday, XX/XX/XXXX, I received another XXXX card offer for a XXXX XXXX card. If I had outstanding debt with XXXX, why would I be eligible for their top cards? The 3rd party organization also sent a letter claiming to file a foreign judgment with the current state I 'm living in, which I do n't even understand what that means. This matter has resulted in further research and I uncovered that XXXX broke the law by providing inaccurate and inflated interest rate information for about 130,000 credit card accounts it sold to debt buyers. The bank also was accused of failing to promptly forward about 14,000 payments from customers, totaling about XXXX XXXX, to the debt buyers. When I reached out to the 3rd party company that sent the letter, I was told that only {$200.00} worth of payments to XXXX was recorded associated with the inactive card account, which again makes no sense. I also learned that from at least XX/XX/XXXX to XX/XX/XXXX, XXXX used misleading statements to get people to sign up for debt protection services, and charged for credit monitoring services it sometimes did n't provide, the consumer protection bureau said. XXXX also charged a {$14.00} fee for same-day payment on delinquent accounts, a service that most users did n't need, according to the agency. Which I had clearly been a victim of due to the refund letter received.

Around the end of XX/XX/XXXX I received a letter from a 3rd party collection agency, Rausch Sturm stating I had 30 days to dispute the charged off debt. On the XX/XX/XXXX I sent a Debt Validation letter to them per FDCPA section 15 USC 1692g Sec 809 ( b ) ( see attached ) Two months later and not 30 days as required by FDCPA I received a letter where they cited a case XXXX v XXXX from XX/XX/XXXX where all they had to produce was the last four of my SS #, the amount that was charged off and the current creditor, again which was incorrect because XXXX XXXX had already charged off this allegded debt in XX/XX/XXXX. I Should also state XXXX XXXX was not the orginal creditor and I have asked them several times to provide that to me. In researching the case they referenced I found that in XXXX v XXXX, XXXX, XXXX XXXX XXXX, XXXX in XX/XX/XXXX the court had established new guidelines for debt validation which included an itemized accounting. They also referred to the case from the letter sent to me where the court was quick to point out in that case and in another case the debt collector went beyone the standard verification and sent an itemized accounting from the date the account was opened with every transaction. I sent another letter to this 3rd party collection agency stating the case law they had reference they did not fully disclose the true findings of the court. I also informed them that they bought this charged off debt for pennies on the dollar and any monies paid to them would be a direct profit and would not clear the charged off debt. They then sent me a letter stating they were collecting this debt now under Texas Finance Code 392.202. I informed them that the orginal letter they sent in which I replied to was under FDCPA regulations and now they are changing it over to state which is way outside of the 30 day requirement. They produced nothing with my name on it or how the debt was incurred and as I stated they were way past the 30 day requirement in sending me this information as they stated in their orginal letter.

The creditor, XXXX XXXX XXXX XXXX XXXX of XXXX XXXX XXXX, Original creditor was XXXX XXXX placed my debt account with collection attorneys XXXX, XXXX, XXXX, XXXX and XXXX XXXX XXXX. The XXXX filed for an appointment of a receiver on a judgement on the account from XXXX. I was unaware of the judgement from XXXX and well as the recent filing for the appointment for the receiver until after the fact. The original amount owed on the account I do not know and can not get a copy of it. I do know it is less than {$1000.00}. The amount of requested property to be updated with receiver appointment was {$4900.00} plus receiver fees. The receiver put a hold on my bank account for the amount of {$5400.00} on XXXX. I had {$850.00} in my bank account at the time. I called the collection company on XXXX, as per the suggestion of my banking XXXX and made an offer of {$3000.00}. This was to be paid with {$500.00} from my checking account and $ XXXX for the next 10 months. The person I spoke with, XXXX XXXX said she would present my offer and let me know in a day or XXXX. I checked my bank account today and the receiver had debited my account for {$1100.00}. This was more than the amount that I had in the account and was not the agreed offer. My banker said they were probably just trying to catch another deposit that I might not have disclosed. I called the XXXX back today and the representative pleaded ignorance of the situation, she said she does n't have access to what the receiver does. Then why do I have to deal with the collection company? I tried speaking with the receiver 's company and they refered me to the collection company. I resended my offer and offered them the amount they tried to debit my account, actually {$1200.00}, because the rep said they wanted a lump sum and this was all I could offer. She said they probably would not accept it, but would present it. I have called the court that the judgement was filed in to see if I have any options there.

On Wednesday XX/XX/XXXX ; Rausch, Sturm, Israel, Enerson and Hornik filed a debt claim lawsuit on me in XXXX County, Tx ( Case XXXX ). The claim stated that it was made on behalf of XXXX XXXX and XXXX on a credit card that I previously owned. It wasn't until I began to receive solicitations via United States Postal Service offering their services to represent me did I find out about the lawsuit. During this phone conversation, I was advised that XXXX was no longer in control of the debt and that it had been turned over to debt collection offices of Rausch, Sturm, Israel, Enerson and Hornik. Rausch, Sturm, Israel, Enerson and Hornik has never advised me that they were assigned, purchased, or otherwise took over this debt. At no time did Rausch, Sturm, Israel, Enerson and Hornik provide me with : The amount of the debt. The name of the creditor to whom the debt is owed. A statement that, unless I dispute the validity of the debt, or any portion thereof, within 30 days after receiving the notice, the debt will be assumed to be valid by the debt collector. A statement that, if I notify the debt collector in writing within the 30-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer. The debt collector must mail a copy of this verification or judgment to the consumer. A statement that, upon my written request within the 30-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. On XX/XX/XXXX, I was informed by my bank, there was a lien placed on my house by Rausch, Sturm, Israel, Enerson & Hornikllc. When I contacted them, I asked why this lien was placed on my house. They stated, it was a debit from capital one. I told them this was not my debit. The birthdate they had was not my birthdate. I disputed this twice and I never received a response. I was trying to get a equity loan but I could not do it because of this lien. My bank told me I could put this debit on my equity loan all I needed was a statement from them. They could not provide me that information. They stated they could, I waited a week and they still could not provide me this information. I decided to pay the debit and they still have not taken my house off of the lien. I paid them on XX/XX/XXXX th and I have been asking for a release of lien letter and I have been getting different answers of why they have not sent me this information. I went to my county court house on XX/XX/XXXX and they stated they have not received any paperwork that I paid this. I showed them my receipt and they stated they did not know why I haven't received the release of lien letter. I called rausch and I was told that they sent me and my county court a letter on XX/XX/XXXX stating the debit was paid and they could not email me the letter. I have not received any letter. This company has been telling me that they were going to send me this letter for XXXX weeks and now they told me they can not. This is a horrible law firm. Rausch Sturm filed a lawsuit to collect on a fraudulent debt. They had been notified repeatedly that this debt fraudulent yet they continued knowing that they lacked the evidence to substantiate the debt in court. This is part of a larger scheme by XXXX XXXX XXXX XXXX which uses various law firms around the country like XXXX XXXX XXXX XXXX ( which has finally been driven out of business ) and XXXX XXXX XXXX XXXX to harass and threaten American Citizens for fraudulent debts that exist only on spreadsheets and in purchase agreements between dishonest creditors, XXXX XXXX XXXX and the dishonest law firms they hire. This is a plain and simple violation of the The Fair Debt Collection Practices Act, Pub. L. 95-109 ; 91 Stat. 874, codified as 15 U.S.C. 1692 1692p. In the present case there is a specifi violation of 812. " Furnishing certain deceptive forms ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. ( b ) Any person who violates this section shall be liable to the same extent and in the same manner as a debt collector is liable under section 1692k of this title for failure to comply with a provision of this subchapter. 15 USC 1692k In this case, Rausch and Sturm falsely claimed that they were suing on behalf of XXXX. In fact, XXXX had acknowledged that the debt was fraudulent in 2019 and claimed that XXXX XXXX had been notified.

I had received a letter from Rausch, Sturm, Isreal, Enerson & Hornick, LLC. Attorneys at Law (? ) representing XXXX XXXX XXXX, XXXX regarding a XXXX XXXX XXXX . The letter states they are attorneys. Yet online no listing in the XXXX XXXX XXXX nor Wisconsin Bar ; the letter states that they work out of XXXX, WI. The only time a debt collector needs to hire attorneys is to protect the firm against the Unfair Debt Collection Act and other regulatory complaint. The firm is asking me to pay an additional {$120.00} to take the case. It is XXXX XXXX XXXX that hired them not I. Again, Debt Collection agencies only hire law firms if the Debt Collector has broken the law or are knowingly engaged in illegal or unethical practices. The law firm in question has several illegal and unethical outstanding complaints. I believe there is collusion on both companies and would like my debt handle by another firm not has no association with the law firm or this debt collector. I have been contacted by Rausch, Sterm, Israel, Enerson & Hornik LLC ; a law office out of XXXX, Minnesota in regards to a debt that I apparently owe to XXXX XXXX XXXX, Assignee of XXXX XXXX XXXX, XXXX. I have received a letter stating that I owed the amount of {$590.00}, and if I have any questions to contact them regarding a resolution dated XXXX XXXX, 2017. On XXXX XXXX, 2017 I was contacted at my home by an unnamed individual whom served me papers from the State of North Dakota -- XXXX XXXX Judicial District stating that I have been summoned and required to appear and defend this action, within twenty-one ( 21 ) days. This notice was dated XXXX XXXX, 2017. Therefore, it is apparent that the judgement with the court was submitted before the notice to contact them was even drafted and sent out. As well as, there was no previous contact noted from XXXX XXXX or XXXX XXXX XXXX regarding the supposed debt. Therefore, I have had no notice that I had the debt against me. If I would have had proper notice I would have gladly setup a payment plan, or even paid the balance in full. However, now I am looking to seek legal consultation regarding this matter. There has not been proper notification regarding this debt and now they are using legal tactics that are threatening or otherwise demanding. I have tried to contact the law office and the original company multiple times, and I have reached no one due to the lack of information on websites and the sites that you must go through in order to even reach a site that states how to contact.

XXXX, XXXX, XXXX XXXX XXXX and their debt collector Rausch Sturm are using threats of a lawsuit to attempt to collect a debt that is not owed. They are doing this in violation of the FDCPA. They know that they can not prove that I owe the debt in court, because it was the product of identity theft so they are using a threat of legal action in order to try to fraudulently collect on a debt that I do not owe. They should be fined under the FDCPA and now that President Biden has been sworn in, I would expect that the CFPB will start actually doing its job again which means bringing lawsuits against these rogue debt collectors that were allowed to flourish over the last four years. The XXXX credit card that they are trying to collect on was paid in full about four or five years ago. I actually took out a HELOC and consolidated credit card debt. The account ( along with a few others ) was reactivated and used by an identity thief. XXXX, XXXX, XXXX XXXX XXXX and Rausch Sturm have all been supplied with the police reports and the FTC reports. YET they continue to try to fraudulently collect on this debt in violation of the FDCPA. I understand that the former chair of XXXX was a close friend of the former President, Donald Trump, and that may be why CFPB never did anything about this before -- but now, we have a new President who is upholding the laws, so I would like the FDCPA enforced in this matter and in ALL accounts that XXXX if fraudulently trying to collect on.

On XXXX XXXX , XXXX , I sent a letter certified, return receipt requested ( USPS Tracking No. XXXX ), disputing the validity of the claim and requested verification of the alleged debt. The letter was received on Rausch on XXXX XXXX , XXXX . I never received any response. On XXXX XXXX , XXXX , Rausch filed a small claims action against me in XXXX XXXX , WI ( XXXX ). I appeared in court on XXXX XXXX , XXXX and again disputed the validity of the claims and requested verification of the alleged debt. I have appeared in court three tim es to date and Rausch still has not provided the requested verification ( they have provided an account statement for an account I have never had, and for which I have provided proof that it does not match the account I had with the company ). I am now required to appear in court yet a fourth time. This action was taken in violation of the FDC PA Sec. 809 ( b ) as Rausch was notified in writing within the thirty-day period described in subsection 809 ( a ) that the debt, or any portion thereof, is disputed, and the debt collector failed to obtain or provide verification of the debt to me.

I have been attempting to gather the correct balance of my deficiency balance for the past 6 months. I submitted a validation of debt dispute with Rausch, Sturm, Isreal, Enerson and Hornik LLC on XXXX/XXXX/2015 through email along with certified mail. The balance of XXXX was incorrect. I received a response to my dispute of the debt from this law office on XXXX/XXXX/2015, in which they indicated that they verified the debt. Once I reviewed the documentation that Rausch, Sturm, Israel, Enerson and Hornik provide. I noticed that the sale proceeds from my car was never applied to my account balance. I reviewed the documentation in 5 minutes and it was clear that the proceeds had never been applied. Based upon my dispute this company continued to misrepresent my debt balance. Once the dispute was submitted it was on this company or the company that retained them to review all documentation thoroughly prior to responding to my dispute. In which this company did not. This is a clear violation of the fair debt collection act, due to the misrepresentation of the balance that is owed. Please be advised that this loan was originated through first investors financial corporation. This incorrect balance has also been misrepresented on my XXXX credit report as well. This is an issue that XXXX has been penalized for in the past.

My house went foreclosure in 2009, had XXXX mortgages, XXXX mortgage said they served me letter to court which l never got, but later went to the count, it indicated that they had served my daughter who was XXXXyears then who were being watched by my mom who did not know english and it also showed that the house was sold already, and according to what l asked them when l was getting the loan they had said if am not able to pay they were to take the house and not garnish my wages.IT seems they passed it over to the creditors who are garnishing me, and yet when l talked to XXXX they said the loan was written off because they got bail out besides house was sold, and even the credit bureau states that it was deleted by the court and it is written off. so now is there any way l can get help, or should go ahead and file for bankruptcy, please help with better option, am single mom with XXXX kids struggling to make ends meet, and working really hard but this is killing me l need better solution than bankruptcy, because that means l can never get the cheap house for the kids in the next XXXX years, struggle is really and this is really for me please give me quick solution before plan for bankruptcy, Thanks, God bless America, please help.

I received a letter from a third party mediator informing me that I was about to receive a court summons for a civil suit against me for defaulting on a credit card from XXXX XXXX. I called the bank. They told me they no longer handle this debt and gave me the contact information for a collection agency, Rausch Sturm, located in XXXX, Wisconsin. I called this agency and spoke to an agent. I am XXXX and my sole source of income is Social Security Disability. I told them that it is against Federal Law for a private debtor to garnish or levy a persons Social Security Income. It is against the law to garnish or levy a persons bank account to which Social Security is directly deposited. Even in the case of a court judgment. I offered a small monthly payment arrangement, but they wanted a higher payment that I can not afford. I have a financial hardship, and need money for basic necessities and my prescription medications. They said they did not care, and unless I paid them {$46.00} per month for four years, they would continue court proceedings. They said their goal was to obtain a judgment in court to garnish my Social Security income. I believe this threat is a violation of Fair Credit Laws.

I filed an earlier complaint regarding the collection practices of a third party organization assigned by XXXX XXXX. XXXX XXXX did not respond with validation of the alleged debt being collected on. Checks were sent via postal mail years ago to satisfy the outstanding balance on the credit card account I had with XXXX XXXX. I had been under the impression the matter was resolved many years ago. XXXX XXXX instead replied with NO documentation : no canceled checks, no financial ledger, no account statements reflecting the alleged outstanding debt, etc. I 've been the victim of financial fraud in the past and am leery of the absence of proper documentation as well as illegal collections practices XXXX XXXX has participated in over the years. I would like for XXXX XXXX to halt possibly predatory collections practices on alleged debt, debt that there has been no documentation provided to validate. Hello, I really was not sure which drop down to select. I have been getting a notice of intent of garnishment from a law firm. The debt is from 2007 and I believe it may be a credit card debt but I am not sure and I not really sure of the cost as it is not listed on the letter that I continue to receive. I am a single father with some major health issues and have had to receive food support from time to to get by. Can this company continue to collect and send me these notice of garnishment from a 2007 case? When I look up the case on public court website it says the debt was paid in 2007 and XXXX is owed. I just dont get it. Can you help me resolve this issue. I have XXXX and things like this does not only put additional stress on me but causes symptoms to react. I had two separate XXXX gallery Jewelry account. One has been settled and paid in full due to account balance was incorrect. The second account has been back and forth in XXXX county court. We came to a payment agreement however I lost my job and was unable to make my 1st payment. About a month or so after I contacted the to try to settle the account however they are not willing to negotiate the balance and they wanted to include interest. I have repeatedly called and sent notarized letter requesting to pay off account and the refuse to accept my offer due to the fact they want to include interest. The debt owed was XXXX this debt was settled through Rausch Sturm on XX/XX/20 in the amount of XXXX. this account stills shows as open collection and has dropped my credit 30 points, as we are in the process of buying a house. I contacted XXXX XXXX, they show it as open, yes they are not trying to collect the full amount, but what I had agreed to settle with rausch sturm. They told me to contact rausch sturm, which i did. They show it as paid!!! They do not know why it wasnt reported back to XXXX XXXX, and said they would send it to the back office, so XXXX XXXX is trying to collect on a debt that has been settled 5 months ago, and damaging my credit in the process. I asked rausch sturm how is it that XXXX XXXX is trying to collect the amount we settled on and not the whole debt if you have had no contact with them?? Below is the text of an email I sent to the Collector today. I also attached the certified cease and desist letters. I received a voice mail today from your firm and returned the call this afternoon. I spoke with an XXXX who stated I had two accounts assigned to your firm and only those two accounts. I received 30 day notices for two accounts with your firm in 2015 and sent certified cease and desist letters. I have the letters and return receipts. Your agent stated neither account was marked cease and desist. I find this hard to believe considering it has been a little over two year since hearing about this. I believe the more likely explanation is that your firm has a policy of calendaring accounts for some time in hopes the debtor has n't kept the records to prove a cease and desist letter was sent. I am on Social Security XXXX and I have no assets. Regardless of the explanation this is a clear violation of The Fair Debt Collection Practices Act. I will be sending a copy of this email and copies of the certified letters with receipts to the Consumer Financial Protection Bureau for whatever actions they deem necessary.

1. I was 'served ' a Summons and Complaint with the statement " You are being sued. " ; however, there is not lawsuit filed against me. The person delivering the document said, " You are being served. " ; however, in reality I was not being served actual legal documents. I was handed a document that looks like a court document. Their document should have stated they were intending on suing me, especially if I do n't answer their 'summons and complaint. ' Instead they made it look like a court document to use it as a means to intimidate and scare me. I am currently in a settlement agreement with Rausch Sturm Collection concerning a debt for XXXX XXXX XXXX aka XXXX. The agreement was dated XX/XX/XXXX from XXXX XXXX, Director of Collections for Rausch Sturm to the Debt Consolidation Agency , XXXX XXXX XXXX XXXX XXXX, I am currently working with, in reference to my debt. I have been getting at least three calls per day from rausch sturm XXXX enerson & hornik. It is a robo-call, and I have no idea what it is in regards to because I filed bankruptcy and it was discharged last year, and I have checked my credit report and not found any accounts in collection. On top of this, I sent a cease and desist letter which included my bankruptcy discharge notice to the " law firm '' which was received by someone there back on XXXX XXXX, 2015. I have still been getting at least three calls per day. I am being harassed. I even had my attorney call and ask them to stop. The person with whom he spoke told him the calls would stop, then I got yet another call just now. I finally called them myself and XXXX XXXX from the XXXX office basically said he thought I was lying about the calls and declined to listen to XXXX of the XXXX+ messages I have saved to my phone from after the firm received my cease and desist. I requested for that letter alnostv2 weeks ago and I never got it. I called em yesterday and asked bout it and the guy I talked to told me to call 1/2 hour later which I did. once I asked bout it again the guy hang up on me. I called XXXX or XXXX tines more without any luck finally I ended up talking to a different person who asked me for some information and told me he will get somebody to call me but nobody did. I called this morning again and after several calls in which I was left waiting until they hang up on me every time I finally talked to a guy whose namevas XXXX. He asked me for the same information the other guy asked and promised me to send me an email with the info I requested but he never sent me the email and by law if I requested the info bout how many payments left I have they have to provide it but they never did.

Hello! Thank you for your help. I recently received notice in XX/XX/XXXX that I have an account with XXXX XXXX XXXX. They work with another company called RSEIH ( Rausch Sturm ). I received notice that I am going to be sued by RSEIH on behalf of XXXX XXXX XXXX. This doesnt seem right as I have no clue who owns the debt. I am extremely dissatisfied as I was not notified of this debt by XXXX XXXX XXXX or the above mentioned company that is contacting me for payment. This debt is old and is beyond the statute of limitations. In addition, the debt is less than {$900.00}. I did some research and I believe that this company is acquiring old debts and then reselling them and then trying to sue people to pay. This is not right and seems very predatory. I have even contacted the original creditor as of XX/XX/XXXX and they have no record of this supposed debt. In addition XXXX XXXX XXXX did not provide any type of proof of ownership or any type of proof that they this debt is even valid.

A judgment was levied against me after credit card debt was sold from XXXX to XXXX XXXX XXXX, and I was XXXX XXXX and on Social Security XXXX. I did not even know there was a judgment against me until I began to look for apartments and realized that suddenly no one agreed to rent to me unless I paid a year 's rent upfront, which was and has been impossible. The law firm that rendered the judgment will not remove it and I can not afford to pay it. My understanding has been that because I have been XXXX XXXX, this judgment should not have been rendered in the first place. This judgment occurred sometime in late 2008. It is for {$12000.00}. It has been the last 2 years of me requesting Debt Validation ( FTCA section 609 ), filed theft affidavits that showed my XXXX XXXX credit cards was stolen and used at the time and I was not legally responsible. I wrote to the company XXXX XXXX , 2017 and asked for verification, the name of original debtor, and amount of original debt. Then on XXXX XXXX , 2017 they filed court papers charging me with the debt.I filed a request for dismissal because they failed to tell inform me of the original debt information. On XX/XX/2016 I was unable to use my bank account, called the bank and was told that the account had a receivership placed against my account from a law firm. I only received the notice of a lawsuit, I did not sign for anything. When I called the firm I was told that the only way to stop the block was to pay off the amount and was asked if I could " borrow '' or get a credit advance to pay it off. The firm is XXXX, XXXX. The number is XXXX. When I first called them to try and offer a plan I was told that I can only pay the full amount and that they have a hold on my account so nothing they can or will do. I received a letter for Rausch Sturm Attorneys at Law, located in XXXX Wisconsin. They were notifying me of a debt owed to XXXX student loans. I am disputing the amount and want to request more information but they have not returned any of my phone calls/voicemails. I did some research on the company and they have been a part of several lawsuits for deceptive practices and trying to revive old debts. Clearly they are a shady company and this is ridiculous they are allowed to handle this. I can not afford the debt amount and will need to work with someone to make an arrangement that works for me, however they refuse to answer me and they are doing it on purpose so the 30 days runs out. I had two separate XXXX XXXX XXXX account. One has been settled and paid in full due to account balance was incorrect. The second account has been back and forth in XXXX county court. We came to a payment agreement however I lost my job and was unable to make my 1st payment. About a month or so after I contacted the to try to settle the account however they are not willing to negotiate the balance and they wanted to include interest. I was victim of identity theft as a result of being homeless and did not have a physical address in 2012. Numerous accounts were open without my permission. The creditors calls and harass me daily for debt. I explained the set is not mines. They sent me some billing info with incorrect addresses and i explained are not mines. I was also told by the credit bureaus that my personal data was breached from the credit bureaus and i am still fighting that. I recently set up a payment agreement with Raush Sturm on XX/XX/2018 for a payment agreement and paid {$1000.00} to start the agreement. I have been calling and trying to get resolution from this account over a year. My card was stolen and used. They only provide a statement as proof. They have passed this account off so many times. I was contacted by Rausch Sturm on XX/XX/2019 and was informed that my wages would be garnished in the amount of {$1400.00}. The garnishment started on XX/XX/2019 and continued until XX/XX/2019 totaling {$1400.00}. On XX/XX/XXXX I closed on a house and was supposed to have a negative closing cost of {$470.00}, which was supposed to be refunded to me. Rausch Sturm bought this account from XXXX XXXX XXXX, XXXX - I spoke to XXXX let them know my credit card was stolen and they send statements of the account which has no idea of how to handle fraud properly or by law. Now the new debt collector calls daily, sends letters and I have told them the card was stolen and I have been through this 2 years. They have failed to help me and just send statements of the account they was used fraudulently. After several requests I have hired legal assistance because its absurd they are still trying to collect a back s they was stolen from me. Debt collectors have n't called outside of proper hours, however I am having an issue with debt collection companies not providing me with a receipt for my monthly payments. I 've spoken with multiple representatives and supervisors who always claim they 're going to resend it but they never do. A common practice for these companies is to only allow you to speak with XXXX person who is authorized to handle your account. The issue with this is very rarely is that specific person available to take my call and when I leave a voice message my calls are never returned. It is ridiculous that I have to make demands for something as simple as a payment receipt. These companies need to improve their customer service now!

I have contacted this company multiple times on multiple occasions this company never lets you speak to a representative all they do is continue to bounce me around from place to place to place, they keep you on hold for ages and transferring you from person to person they never let you work with someone, they hang up on you, and they never call you back. My credit score has gone down.The only way I can improve my credit is to give the past due bill to XXXX, and not a debt collector.Paying a debt collector will not improve my credit and I will still owe XXXX. How can I owe Rausch Strum collection agency any money when I did not incur the debt with them? How can I be sued when XXXX has written the debt off as bad debt? Rausch Sturm has tried collecting a debt that is over 10 years old. In less than a weeks time they sent three letters trying to collect payment i wasnt even aware of. I called them the young lady said it was from a company name XXXX XXXX never heard of them. I explained that i dont know who they are she said it was from XXXX and XXXX. I am in my massachusetts and the statue of limitations is 6 years here. I told her this is too old to collect. I had a levy placed on my account by Rausch Sturm for about {$2000.00}. {$21.00} of which was taken directly from my back account. I then was ordered to pay the full sum ( not minus the {$21.00} ) and did so because I didnt have any other options. So the account was paid in full and then some. However, Rausch Sturm again placed a levy on my account a couple weeks later. This company calls my landline several time per day about what I do not know. I have put their number on a blocking list and have spam blockers on my system, but the number still gets through.
