I worked with Owning Corp to obtain a refi for a 2.5 % fixed rate, 30 year term, no cost loan. XXXX and XXXX assured me the loan was approved, they even competed with XXXX who had offered me the 2.5 % rate ( which they matched ). I only opted to go with Owning because we were already in the middle of the process. I was told it would be a 14 day process to close and fund when we begain the process on XX/XX/XXXX. I signed documents with a notary ( XXXX ) on XX/XX/XXXX at my home. I was told I would not have to make a payment to my new mortgage company until XXXX. I did not hear from anyone or reciece final copies of the documents signed on XX/XX/XXXX prior to XX/XX/XXXX. I did request hardcopies back in addition to softcopies at time of signing. I did not want to miss a mortgage payment or have a late payment on my record, so I made the payment to my current lender. I was not told of any delays in funding until I called. At that time XXXX told me that they were waiting on proof of a lein from child support from County of XXXX to be removed. I immediatly called, received confirmation that it was to be removed over a year ago and provided documentation that I had received when I refinanced in XXXX with XXXX that the lein was to be removed. Again, I did not hear from them reached back out to learn that they were now waiting on confirmation that leins for old taxes were now showing up on my credit report, which they ran prior to approving me and did not have impact on my XXXX refinance with XXXX. I called IRS who confirmed that there are no leins in existance for me. I again shared what I learned and was told they were still waiting and that I should call IRS again to see if I can obtain info faster they them waiting. I've requested contact info for their Managers and Vice Presidents and have yet to receive any info. Discolsure deadlines were missed, I signed documents and missed the 3 day recission to accept XXXX refi options that would have had me closed and funded, I am currently being charged almost 1 % more than my new rate would have been for at least 30 days longer ( and counting ), there is a serious lack of communication and I'm not sure how to resolve this. I have communicated with XXXX and XXXX on the following dates : XX/XX/XXXX XXXX requested info, XX/XX/XXXX signed consent to process electronically, XXXX requested updated estimate to match XXXX rate since we were already in the process, XXXX requested estimate again from XXXX, XX/XX/XXXX XXXX requested signature to remove items from Title to be able to close this week, XX/XX/XXXX emailed XXXX to inform that if I did not hear from her I would accept XXXX offer/she replied back she confirmed receipt of my email and Statement of Information sent to tile to clear items found on credit and set up docment signing for XX/XX/XXXX, XX/XX/XXXX docs signed at my home, XX/XX/XXXX I reached out to assure loan payment was made since I had not heard back from them, XX/XX/XXXX I reached back out to find out what was going on, found out leins from XXXX were still being worked on and I requested info on what was being done, timeline, options for going with someone else and why lack of communicaton to inform me. XX/XX/XXXX emailed requesting Vice President info again to escalate. I signed with them over one month ago and still no funding has taken place, I am paying almost 1 % more per month and still do not know where I stand. Please assist in resolution. I just want the loan funded and finalized with reimbursement of the financial impacts of this delay.

I received my original LE with Rate Lock on XXXX 2.5 % with 0.25 % points, {$450000.00} Loan Amount and {$600000.00} Appraisal Value. The Total Closing Costs were {$1500.00} with ( D ) {$2400.00} + ( I ) {$590.00} - ( Lender Credits ) {$1400.00}. On XX/XX/XXXX, I received the Appraisal report valuing the property at {$550000.00}. Based on a phone conversation with the MLO XXXX ( NMLS # XXXX ), he informed me that I would need to bring additional cash to closing to reduce the LTV and keep the same pricing. I agreed to bring an additional $ XXXX to closing and reduce the Loan Amount to $ XXXX to keep the same pricing. Concurrently, I also asked XXXX to discuss with his Underwriting team to see if they would consider a Reconsideration or Value as the same 4-bedroom condo plan sold for {$560000.00} on XX/XX/XXXX and is currently estimated at {$580000.00} on XXXX, XXXX, etc. so I could leave the Loan Amount at {$450000.00}. XXXX called me back on XX/XX/XXXX and informed me that even though I agreed to bring in the additional {$10000.00}, the pricing had changed due to the LTV originally at 75 % and now at 80 % with {$440000.00} Loan Amount. I was upset to hear that loan cost had changed by {$1100.00} a week before closing and emailed XXXX to get the updated LE or CD and get my finances ready. On XX/XX/XXXX XXXXXXXX XXXX, I received my Closing Disclosure@ 2.5 % with 0.5 % points ( {$2200.00} ), {$440000.00} Loan Amount and {$550000.00} Appraisal Value. The Total Closing Costs were now {$2300.00} with ( D ) {$2200.00} + ( I ) {$180.00} - ( Lender Credits ) {$1400.00}. I signed the CD and returned it to the lender and asked to change the closing date from XX/XX/XXXX to XX/XX/XXXX in order to organize my finances for the additional cost. The rate lock expiration is XX/XX/XXXX. On XX/XX/XXXX XXXX XXXX I emailed the Loan Processor and asked for a status update as I was kept in the dark since signing the CD. I just received an email back from the MLO at XXXXXXXX XXXX stating the following : " XXXX your options are as follows. 2.5 rate costs you 1pt or you can get a 2.75 and pay only the .5pt fee. Let us know to you wish to proceed. '' Having worked in the financial industry for 15 years, I checked with my employer XXXX XXXXXXXX XXXX XXXX Director of Compliance who informed me that you should not be changing the pricing or loan cost once I've returned them a signed CD. I emailed XXXX back and asked for him to review with his compliance team and not change the pricing days before closing. The MLO informed me that he made an error in the property type and obtained a rate lock for a PUD, rather than an attached condominium and that is why there was a change in pricing. I informed him that my application was submitted as a condominium and that even the Appraisal returned was listed as a condominium. He admitted that he made a mistake on his end however, I don't know if this was truly a mistake or a bait and switch attempt. The lender has already done a hard pull on my credit and because we had a rate lock, I stopped shopping with other lenders and focused my efforts on closing my loan with Owning.

On or about XXXX, I contacted Owning.com and spoke wXXXX XXXX. I expressed my concern about being able to refinance my home w/no cash out prior to the end of the year. While there are no guarantees, she agreed this was a possibility. She ran my credit, pulled all my information and quoted me a rate of 2.375 %. Like any process, there were items that needed clarification in order to proceed. On XX/XX/XXXX some time before XXXX XXXXXXXX informed me this was the last day they could submit and still close prior to XX/XX/XXXX. At approximately XXXX XXXX., she notified me that they had approval and the documents needed to be signed ASAP. When I reviewed the documents the rate had gone from XXXX to 2.626 %. When I questioned her about the rate increase, I was told rates had started increasing due to the vaccine and political events. I was then informed to shop around and if I found a better rate, that they do rate match. With that information, I signed off on all the documents and went online to inquire about rates. While inquiring one lender asked why I was searching for a new lender if I already had approval. I explained I wanted a better rate and that I was told rates were creeping back up due to the vaccine. This lender proceeded to tell me that rates had in fact gone down the last couple of days and pulled rates to show me. He told me that this happens from time to time and it's called a bait and switch which is unethical. With that information I sent XXXX an email inquiring about the rate, provided her with the rates I had been provided and asked her why she was charging more when the rates had gone down. I also asked her about the bait/switch comment. Within 5 mins XXXX called me and was noticeably upset that I had questioned her integrity. With that she proceeded to tell me that she would be canceling my loan because she could not work with someone who did not trust her and that it would only get worse from here. She suggested I contact a new lender and wished me luck. I at no time asked her to cancel my loan, I was simply looking for clarification and I sent her an email that evening advising her of the same and asked her to have her manager contact me. When I did not hear back I contacted owning.com on Friday XX/XX/XXXX @ XXXX. The individual who answered went over my file and put me on hold. When someone came back on the line it was XXXX, not the individual I had been conversing with. I reiterated to her that I did not cancel my loan and that if she took offense I was sorry but if she read the email that was not the intent, I simply wanted clarification regarding the increased rate if rates had in fact gone down, they my rate should have remained the same, not increase. She said her manager would contact me and I haven't heard from either of them since.

As a precursor to my and others problem, this is my current status. Im a XXXX YO woman with two pieces of real estate. Together worth aprox. $ XXXX. The debt on my primary residence is {$350000.00}. Value is $ XXXX On or about XX/XX/XXXX, I decided to refinance my residence and take advantage of the now low interest rates. CA is very expensive to live. Owning sent me an offer for a new lower mortgage of about 1.5 % less than my current loan of 3.75 %. I spoke with XXXX. I forwarded my financial backup. At that time I had excellent credit. After much trying there was no longer a response from owning. On or about XX/XX/XXXX I received a offer from XXXX XXXX. XXXX. Again I supplied backup, and again after much trying they disappeared. On or about XX/XX/XXXX and again receiving an office from XXXX, XXXX XXXX, XXXX. Sent backup, all was good and they disappeared ( yes same company. On or about XX/XX/XXXX I contacted interactive mortgage who was the company who initially gage me the loans for my two properties in XXXX. XXXX XXXX. XXXX. Who was absolutely certain that all my financial backup was fine. ultimately disappeared. Lastly on or about XX/XX/XXXX my neighbor gave me a name of a person she had just refinanced with XXXX XXXX. XXXX XXXX XXXX. XXXX. His response to date is the file is in the IT department where they are trying to fix the automated underwriting. That was XX/XX/XXXX and Ive contacted him twice since with no reply. A conversation with a real estate agent has confirmed that other people are having the same problem. I did possibly have a credit rating problem. XXXX XXXX ( Mortgage on my rental house ) who I asked in writing for forbearance, may have filed a missed payment on my credit, saying that they did not send an acceptance letter of the forebearance, but I never received a rejection letter either. As of today, my credit reports are fine, one good and one excellent. My thought on this is that XXXX who I have my residence mortgage does not want to exchange a 3.75 % mortgage to a 2.5 % or lower mortgage. Can you help with this. Something is definitely amiss. On or before XX/XX/2020 I made an inquiry to Owning to refinance our home mortgage. I provided all of the required information to the representative, XXXX XXXX. I told the representative two very crucial factors : 1. My husband has lost his primary employment due to COVID but was woking as pert time adjunct faculty at XXXX XXXX XXXX University, and was still subsequently receiving unemployment benefits. The representative stated that this should not be an issue so long as he was still employed. 2. My husband and I attended XXXX XXXX and had federal student loans. Since the cost of law school is so extensive the monthly payment that is reported on our credit report is far beyond what we actually pay. I explained to the representative that we only pay 10 % of our income as we are on a federal income baed student loan repayment program. She said she would communicate this information to the underwriter. This is imperative because in the calculation of our debt to income ratio the representative stated that we were over the threshold of 50 %. Yet our student loan debt reported was in excess of {$1600.00} for my self and my husband in which we pay XXXX and XXXX monthly respectively. I asked the representative to communicate this to the underwriters and to let them know that we would provide authenticating payment history of our student loan payments, income based repay-payment plan, and any other supporting documents and I was told to " contact the credit bureaus to fix an inaccuracies ''. I can not be the first borrower who is under an income based repayment plan. We have never run into this issue in the past with other lenders. Also, I have never received notification of the denial or the reason for the denial. I only found out this information after i contacted the representative directly. The responses that I have received from the representative have been very antagonistic and almost accusatory that this is my issue that I need to resolve. I have never come across a company that was so unwilling to assist in a home refinance.

On XX/XX/XXXX I applied with XXXX XXXX of XXXX California for a loan of {$170000.00} at an annual interest rate of 2-7/8 % to refinance my existing home loan and fold in an existing Home Equity Line of Credit. During the processing of the loan the loan officer, Mr XXXX XXXX, overstated my outstanding debts and understated my income. Specifically, he included as a debt an annual one-time XXXX XXXX membership fee of {$95.00} as a monthly debt, manufactured a mandatory monthly homeowner association fee of {$60.00} per month ( there is none ) without consulting me, inflated a small credit card debt of {$74.00} to be a monthly debt and used a gas credit card debt which is paid monthly as other debt. With regard to income, he listed on XXXX XXXX form 1003 income from a commercial building I own ( with partners ) as a residential 2-4 unit building and a separate condo I own as another residential 2-4 plex. As reported on my XXXX federal tax return my total XXXX income was {$3400.00} per month while Mr XXXX listed it as {$2200.00} per month, a discount of over 33 %. In addition, Mr XXXX refused to include my federal Required Minimum Disbursement from my IRA, saying it wasn't appropriate. For XXXX this is {$8300.00}. As a result of these shenanigans Mr XXXX increased my interest rate by 1/4 % to 3-1/8 %. He also required that a car loan of {$3400.00} ( at 0.9 % annual interest with only 16 months to go ) be paid off. He then raised the loan amount to {$170000.00}. Unfortunately I never had a chance to review the loan application before closing. Loan documents were drawn three times by the escrow company, with the first two times having the name of the borrower ( me ) incorrect. These documents were returned to the escrow company without a review. The third time the mobile notary public was pressed for time and hurried me through the signing, not giving me a chance to review the documents. I only discovered these discrepancies later.

In late XX/XX/2020 I contacted Owning Corporation to inquire about refinancing my home. They were advertising a 1.75 15-year rate that I was interesting in. After agreeing to move forward based on the information XXXX XXXX XXXX Owning ) provided I was told by XXXX that some rules would change on XX/XX/XXXX and they needed to charge me more money than originally quoted. After talking to XXXX and thinking about it, I emailed XXXX on XX/XX/2020 stating " Regardless of why the terms are different from what we discussed over the phone and you reviewed with me, I'm not comfortable moving forward. Please cancel my refinance with Owning. I will let the appraiser know so there isn't a charge for his services at your end. " XXXX emailed back on XX/XX/2020, at XXXX XXXX, XXXX XXXX XXXX wrote : > I will cancel it immediately. In late XXXX I received a phone call from XXXX asking me if I had 5 minutes to review my application and go over some questions. I told him I decided not to move forward with the refinance and he said, " you're right, I called the wrong person. ". Then, on XX/XX/XXXX I received a large packet in the mail from Owning Corporation addressed to XXXX XXXX at my home address. The first page of the packet has my name, XXXX XXXX 's name and my address listed on a document as if we were co-signers of a mortgage. To be clear, I do not know anyone named XXXX XXXX and a XXXX XXXX does not live at this address. I called XXXX XXXX and he said " Oh, there was a mix up with names, address and files. By law, I had to mail that document to you since it was produced but it has been cancelled. '' I am concerned that either Owning or XXXX XXXX is trying to take out a mortgage with my address and/or credit. This is fraudulent activity if that is the case and I do not authorize Owning to run my credit, start a mortgage application or produce mortgage documents with my name and personal information.

On XX/XX/XXXX I began working with a Loan originator to refinance my mortgage. Interest rates dropped and shopping for lower rate. I submitted items that were requested and on XX/XX/2020 I received an email confirming my loan was eligible. XX/XX/2020 my loan was submitted to Processing. My appraisal was completed on XX/XX/2020 everything was going smoothly. I did not hear back so I emailed my processor at Owning on XX/XX/2020 to follow up. The processor wrote she was having issues with the loan, saying the debt to income exceed allowable guideline. I did not hear back for two days and followed up XX/XX/2020, the processor replied stating " we're working on the month end funding for XXXX ''. I never heard back, I followed up again XX/XX/2020. I asked " is this loan rejected and to please escalate the loan to management because this was going on 2 months. The processor replied stating underwriting is asking for a detailed letter of explanation why my income and assets show my previous address in order to continue. On XX/XX/2020 I received a Closing disclosure because rates were better now. On XX/XX/2020 the Loan originator emailed me again to resign the Closing disclosure and to date it XX/XX/2020. Loan originator also said what time is best for notary to meet tomorrow XX/XX/2020 ( its the last day to sign ). I explained I was not available to sign until this week XX/XX/XXXX. On XX/XX/2020 I asked the processing manager to reassign my loan because I felt this was not closing fast enough. The manager again said he needed the items that I had already sent it. I had to also send in my Solar lease agreement. On XX/XX/2020 the manager said my LOE was not sufficient and could not proceed without me changing address on my bank accounts. Rates have gone down and back up and feel the company owes me. Everyday the rates move I lose out on money.

The first week of XX/XX/XXXX, I completed a Telephone Application with XXXX of Owning Corporation for a home refinance. On XX/XX/XXXX, I was contacted by XXXX ( Loan Processor ) and was asked for some of the same information that had already been provided to XXXX. On XX/XX/XXXX I was asked by XXXX about a XXXX Lien on said property, I informed her that that issue had been settled in XXXX. I then had to at her request provide proof. First I found a copy of the dated XXXX check to the owner of that loan. This was still not enough. Then I followed that with the specifically requested settlement statement that included that transaction. There were many moments of concern during this process. Even at document signing with place and date discussed the initial signing did not occur on XX/XX/XXXX. After my reaching out for explanation, it eventually took place on XX/XX/XXXX. Curious, the Notary only had copies of " Notice Of Right To Cancel " but did not provide copies of documents for us to have during this period. On XX/XX/XXXX I received the most incredulous request from XXXX. She requested my spouses work information for verification. I was dumbfounded as this is Day One information provided. Then we were back to the lien of XXXX. Finally this, " signed loan documents have expired " due to the unresolved XXXX lien. I had earlier challenged this inquiry due to the fact that we had been serviced by XXXX XXXX XXXX, XXXX XXXX XXXX and presently XXXX XXXX since XXXX and this was not an issue with their servicing the loan. We feel bias has a role in this. This has been an unbelievable process as we have excellent credit reports and steady employment. It is sad to say that in XXXX, we feel that as a XXXX, XXXX older married couple we have been unfairly discriminated against.

I called Owning Corporation at XXXX XXXX XXXX XXXX on Wednesday, XX/XX/20 to inquire about a 30yr cash-out refinance. Phone conversation took place at XXXX PST for 3 minutes with an agent named XXXX . He asked me basic loan questions but the conversation didnt last long. When I stated my husband was self employed, XXXX told me ( not verbatim ) that due to everything happening with COVID, they were not accepting self employed applicants. He asked me if my husband owned 25 % + of the company, I answered yes. He then repeated what he said before and said they are only looking at applicants with W-2s. XXXX said he wasnt sure when they would open up to all. It could be a week from now or longer but said he would call me. The phone call ended with no interest rate quote or loan application. Im filing this complaint because Owning Corporation violated ECOA. We were not given an opportunity to apply for a refinance. We were blatantly discriminated against due to my husbands self employed status. We were prematurely turned away only because of his employment status.

I refinanced my mortgage with Owning Corporation. I got very good service up until the day I signed all the paperwork to close on the refinance. Since that day, I haven't been able to talk to anyone, after several emails back and forth, I got my closing disclosure etc. ISSUE : Owning Corporation refuses to respond to my queries regarding when and how I should make my mortgage payments. I have called several times and no one picks up/answers my calls. I left messages and no one responds. Several weeks ago, I was able to talk to someone and they indicated that I would get something in my mail in XXXX indicating how to make mortgage payments but I don't have anything in my mail. I still don't know how to make my mortgage payments. Email response to my query resulted in a link shared by Owning with Closing disclosure again but no information on how to make my payment. ISSUE SUMMARY : My payment is due early XXXX but I believe Owning is intentionally not providing me information on how to make my mortgage payment.

I have been going through the refinance process for primary residence with Owning Corporation for a few weeks now. I signed the final loan documents on XX/XX/2020, and as of of today XX/XX/2020, my new loan has not been funded and closed. Now, my payment with the existing lender is due and I am not sure what I need to do. I have sent multiple emails to the Owning closing agent and for the most part, I have been ignored. On Friday XX/XX/2020, I sent another email to the Owning closing agent and I mentioned that I was in the process of filing a complaint with CFPB. Immediately after that, I received a response and I was told my loan would close in 48 hours. As I mentioned earlier, I just checked my existing mortgage account online, and it appears that the loan has not funded yet. Due to this unwarranted delay in funding my loan, I am incurring higher interests and I am in the danger of being late with my current lender.

Owning.com claims on the home page of their web site that they will " refinance your mortgage with no closing costs ''. However, after talking with the agent from owning, they claim that XXXX XXXX XXXX charges a 1 % fee for the loan. After investigating this, I have found that this is a false statement. They do NOT charge anything. There are two issues : 1. Owning.com is claiming that there are no closing costs. This implies a no cost refinance for the person refinancing and 2. XXXX/XXXX do not charge a fee, which one can only assume is another way for Owning.com to get paid to do the loan. A refinance fee on a $ XXXX loan at 1 % is {$5000.00}. This misleading fee is a " bad faith '' charge and is not legal. I have yet to see this in writing from Owning. Owning needs to tell the truth or stop this practice. This is NOT a " no closing costs '' loan, as they are claiming.

My previous mortgage servicer issued a payoff statement to them that was very clear about what was needed to payoff the loan. Unbeknown to me at the time, Owning decided to pay a completely different amount that was several XXXX dollars short. Because of this, my servicer did not accept the partial payment. When it was finally brought my attention 3 weeks later that Owning did not pay in full, I had accumulated XXXX dollars of additional mortgage interest that I was forced to pay out of pocket. I thought that Owning would certainly own their mistake and reimburse my expense. Boy was I wrong, after weeks working with XXXX and XXXX in customer service they accomplished nothing and refused to take any ownership of the error. I will never work with them again and I caution anyone to steer clear. There are plenty of other competent lenders out there that are trustworthy.

I rescind from my refinance and waiting for the full refund check ( {$1900.00} ) for my payment. It's been more than a month after I rescind and still not getting the refund. I tried to contact the mortgage company multiple times and most of times they don't respond. Their last response was they are collecting informations for my refund and this response was identical to the response I got three weeks ago. The officer never pickup the call or respond to email further so I'm filing the complaint to expedite my refund process.

Owning.com has issued misleading ads. They heavily cite an interest rate and terms ( no closing costs ) and do not disclose that those rates and terms are only available for transactions exceeding {$300000.00}. They do disclose an upper bound, making it sound like all mortgages up to that amount would qualify. My credit and qualifications otherwise meet all of their standards but I did not go through with the loan when they changed the rate and fees on me.

contacted owning for advertised mortgage rate with no closing costs $ XXXX loan, 1.99 % rate & APR 15year term meet all requirements per disclosure but was told there is 0.25 % cost. the representative was up front with this cost but can not explain it is not reflected in either disclosures or advertisement. this is false advertising in my opinion and should not be allowed. attached ad content

Applied for a refinance mortgage loan at owning corporation. I was told my home value to loan ratio did not meet their requirements, A month later I received a letter ( statement of credit denial ) stating my loan application was closed due to a lack of response from me, which is not what happened.

The mortgage with Owning Corporation has been funded, but they are calling/emailing me 2 months afterwards saying they need additional documents and rental income information, to provide an investor, which seems like a breach of confidentiality/privacy. I have not provided these documents.

The Owning Corporation will not accept my refinance application because I own a business. This is discrimination especially in today 's environment where small business owners need the support and help of our financial communities. I more than qualify financially for this loan.
