Here is a copy of the complaint I sent to the branch manager after I exhausted all other remedies. I have removed my identifying information and address. [ My name ] I am sending this email to you in hopes that everyone at RaboBank 's XXXX branch is not heartless and cruel. My father XXXX XXXX on XX/XX/XXXX He was an account holder with your bank, and I am his daughter and the beneficiary on his account. In XX/XX/XXXX I came in and cashed out the bank account to which I am the beneficiary. I live in Georgia, so I can not bank with RaboBank as we do not have branches in XXXX I was told by XXXX the employee that was helping me, that there was a deposit made just before he XXXX from Social Security, and that those funds would need to be held for a few days until it was determined that the transaction would not be reversed. If the funds were not reclaimed, RaboBank would send me a cashier 's check for the remaining amount in the account. I did not hear anything more from XXXX or anyone else. I called again in early XX/XX/XXXX and was told she had not received a notice from Social Security that they did not intend to reclaim the funds, which was necessary for her to release the funds. I called back at the end of XX/XX/XXXX and was told that she still did not have the letter needed from Social Security and that she would call when it was received. I did not hear anything again. I called XX/XX/XXXXand was told by XXXX that she made a mistake initially and that the deposit was not actually from Social Security but from my father 's retirement, and would not be reclaimed. A letter was not necessary and that she would mail the check for a little over {$5000.00} out to me the next day certified mail. I then asked her if she had my address and I gave her my address of [ my address ], as she had my former address of [ former address ]. I waited about a week and did not receive the cashier 's check in the mail. She said to wait a few days due to the XXXX Holiday and if I did not have it by the Friday after XXXX to call her back so she could track it. I did not received the check and called again the Monday after XXXX. I was told by XXXX XXXX at that time that the check was not mailed out from the branch in XXXX that all of the mail from the XXXX branch is sent to to be sent out from the processing center until Monday XX/XX/XXXX, two weeks after it was initially supposed to have been mailed. I was told it would take an extra week to get to me because of having to go to the XXXX branch to be processed and mailed from there. I was told to call back if I did not get it in a couple of weeks. I asked them to trace the package and to provide me with a tracking number, and was initially given an incorrect tracking number. When I did not receive the check the first week of XX/XX/XXXX I called back. I was then given the correct tracking number and told that the package was received on XX/XX/XXXXand refused at the door. I verified the address to which the check was sent because I knew that no one at my home would have refused the package nor had anyone received a package as we were all waiting for the check. I was told the check was mailed to [ wrong address ] which I verified using the tracking number, refused as I do not live there, and returned to sender by the US Postal Service. I then, with my sister on the phone as my witness, asked XXXX if she could please cancel that money order and overnight a new one to me since they sent it to the wrong address. She said she would do so onXX/XX/XXXX. I told her I really needed the money because my water was about to be turned off and I had paid my dad 's estate bills and needed money to pay my bills. She assured me that she would overnight it. She then called me back a little later and told me she needed me to complete a lost cashier 's check form in order to overnight the new check to me. I completed it and faxed it and emailed it to her on Saturday XX/XX/XXXX and again on XX/XX/XXXX when she said she was missing a page. She then promised to overnight the check. I did not receive the check and called her again. She told me she needed to wait until the check was received by the bank to send another check out, and she said she would call the XXXX processing center branch to check. She called me back and said that they indeed had the cashiers check and were holding it so she could overnight the check to me. I did not receive it and called her again. She did not answer, but XXXX answered the phone and said he was aware of what was going on and that I would have to wait 90 days to have a new cashier 's check cut and sent to me since it was lost. If the check was returned to the bank before that, they could cut another check and send it to the correct address. I explained that the check was on hold at the XXXX office per XXXX and he said that there is no branch in XXXX and no one can call the processing centers. The centers send returned mail to the issuing branch. I called the post office to have them locate the lost mail and they said that it was returned to sender but is not tracked on the way back to sender and can take awhile to get back to California as it is no longer a priority package. They also agreed that it should have it by now. I called XXXX again yesterday on XX/XX/XXXXwith my sister on the phone as my witness. I was told by an representative after asking XXXX who was in a meeting XXXX that the check was returned to the branch but i would have to talk to XXXX about getting a new check cut. I called XXXX and he denied that the check had been received at the bank and again said I would have to wait 90 days from the date it was issued. I have no idea what the original issue date was and have been lied to several times. I need my money now. I made payment arrangements based on XXXX 's lies and now am way past due on bills and am facing eviction, repossession, utility disconnections, and no XXXX for my children. I am hoping you have the heart and power to help me. Given the horrible treatment I have received and for the following reasons, I believe you should cut me another cashier 's check and overnight it to me for receipt by SaturdayXX/XX/XXXX/ I should have been given all of my money in XX/XX/XXXX when I walked in the bank. Holding my money was wrong and possibly illegal. It was at best inconvenient and what made the mailing of the funds necessary to begin with. I was lied to several times and relied on these lies to my detriment with creditors. The check was mailed to the wrong address through no fault of my own. The bank caused the check to be sent to the wrong address and mailed it to a state 3,000 miles away without adequate tracking capabilities to locate it if it was lost. The bank did not notify me that a lost cashier 's check could not be replaced for 90 days prior to sending it, or offer for me to pay to have it sent via a trackable method. This money belongs to me and I requested my funds three months ago in XX/XX/XXXXand should have had them released 90 days ago. Holding my funds after request for over 90 days is unconscionable. I hope that this nightmare ends with you and that you have the foresight and power to get my check overnighted to me by Saturday. If you can not, my next step is to file a formal complaint with the Consumer Financial Protection Commission and the Better Business Bureau. I asked for the bank president 's name and email and was hung up on by XXXX. I called again and was immediately disconnected. I called an additional 8 times and was sent to general voicemail once and to XXXX XXXX 's voice mail once before filing this complaint onXX/XX/XXXX. Please help me. I just want my money. I am in probate and need it badly until I can get reimbursed from the estate for all of my expenses. In addition, I filed a complaint with RaboBank customer service with regard to this branch last week to no avail.

On XX/XX/XXXX I wrote a check to XXXX for annual membership fee ( ck # XXXX for {$120.00} ) and mailed in postbox. The check was cashed to the order of " XXXX XXXX '' in the amount of {$950.00} on XX/XX/XXXX and I discovered error when bank statement arrived XX/XX/XXXX. I took my checkbook register along with bank statement and copy of fraudulently cashed check which had arrived with statement in the morning of XX/XX/XXXX. XXXX XXXX at bank said this was second such event at the XXXX Branch of Rabobank in the past week. She said the crooks use utensils to grab mail from mailbox and chemically wash all but signature. She said she had closed my checking account ( # XXXX ) in order to limit risk on bank and me in case crooks had other checks of mine. " Declaration of Forged or Altered Check '' was filled out following multiple visits to bank including meeting with Senior Banking Services Representative XXXX XXXX and later Vice President Branch Manager XXXX XXXX who also consulted via phone regional Manager " XXXX ''. I originally told Rabobank had decided not to investigate since it took more money to research. XXXX also told me money would be restored to my account within 10 days. When money was not returned by XX/XX/XXXX I called XXXX XXXX ( XXXX was on vacation ). She called Rabobank central office and was told they had 90 days to return. A week later I received general mailing letter stating Rabobank was merging with Mechanics bank effective XXXX. XXXX assured me as did representative at number on announcement letter that nothing would change. Money still not returned and it is now 90+ days since complaint. Call made to " concerns '' number. That representative went off phone call ( placed me on hold ) and then came back to say Mechanics bank would start the clock again AFTER the 90 days had expired and now would have another 120 days return money. After XX/XX/XXXX Rabo bank ceases to be a legal entity. I fear I will have no recourse since Mechanics bank may have no financial liability. What law is there in California that says a bank MUST return money when check has been fraudulently cashed? Also I called the Sheriff who deals with check fraud in our area ( XXXX XXXX ( XXXX ) XXXX on XX/XX/XXXX because I was concerned that XXXX at Rabobank said Rabo would not investigate. XXXX told me his hands are tied because banks do not generally cooperate ( i.e. they will not show him who cashed the check - later I learned Rabowould also not tell me at what vendor the check had been cashed. XXXX said it is suspected there are some liquor stores in XXXX XXXX, CA which cashed checks without I.D . but he is stimied by banks who will not share info. Therefore, no case was initiated. He did tell me bank must refund money to me. I feel I was defrauded by the crooks but the more significant defrauding came not at the hand of the crooks but rather at the hand of Rabobank who refused to return to me original check ( I have copy only ) and refused to tell me what vendor cashed the check. They must have this information. The fact they will no longer be a legal entity was known to them and I think these temporizing measures ( " we have 90 days before we have to return the money '' ) was intentional to avoid repayment at all. On XX/XX/XXXX 2017, I went to the Rabobank branch on XXXX XXXX XXXX XXXX, XXXX, CA and XXXX was my teller. I asked her to deposit my check, which was {$3000.00} into my Savings account. She confirmed that the funds would go into Savings then began trying to sell additional products/services that the bank offered, which may have distracted her from my request. When I received my receipt I noticed that the amount in my checking account had increased by {$3000.00} and that my Savings account balance had not changed. I once again asked XXXX the teller if the funds had been deposited into my Checking or Savings account and she confirmed it had gone into Savings, which did not align with the receipt. Later that day I checked my balance online and as I suspected the funds had not been moved into my Savings account. Therefore, I completed a balance transfer online in the amount of {$3000.00} and figured I would just do it myself, as I could see my newly deposited funds in my Checking Account. The following day on XX/XX/XXXX 2017 I received notification that my Checking account balance was overdrawn and I was being charged fees, adding up to {$280.00}. Upon further investigation I found out the bank had moved money from my Checking account into my Savings account without my knowledge. This caused my Checking account to be overdrawn as {$6000.00} total was moved out of my Checking account, the {$3000.00} I moved, as well as {$3000.00} the bank moved well after the point in time that I completed the transaction. I would not have moved {$3000.00} out of my checking account had the funds been deposited correctly into savings at the time I visited the branch. The negligence from this bank branch has caused me to pay unnecessary fees and should be illegal. Once I noticed this I discussed it with XXXX in person, he took down my information and said that a manager would give me a call. Two days later, when I discussed this with the bank manager ( I do not recall her name ) she offered to split the difference of the fees with me, by dropping them by {$140.00} to {$140.00}. I explained that this was not good enough as I had money available and it was only due to the way they transferred money in my account which caused me to be overdrawn. Please investigate this, I do not even want to deal with this branch anymore and may move my accounts to another institution as this was a fairly simple request, which led to unnecessary fees. I believe I should be refunded the full amount of the fees or an additional {$140.00} as I should not be required to pay fees which only occurred due to their mistake.

Starting XXXX XXXX, 2016 I started incurring overdraft fees due to insufficient funds available in my checking account. Between the dates of XXXX XXXX and XXXX XXXX, I incurred a total of XXXX overdraft charges at $ XXXX/piece for a total of {$310.00}. My banking institution, Rabobank N.A. was processing transactions even though my checking account was " overdrawn ''. Rabobank has taken 2 positions on this 1 : ) They claim I authorized an " opt in '' process that allows the processing of debit transactions regardless of available funds. 2 : ) I previously signed up for " Savings-Checking Overdraft Protection '' where funds are automatically transferred from my savings account to my checking account should the latter have the potential of being overdrawn. On XXXX XXXX, 2016 I met with XXXX XXXX, a representative with Rabobank at the XXXX XXXX, CA branch. I asked that she provide me with all the documents I signed or initialed associated with the account ( s ) in question. She could NOT provide me with any documentation where I signed or initialed authorizing Rabobank to process transactions resulting in my account being overdrawn resulting in fees assessed. XXXX XXXX could not provide me documentation where I signed or initialed any kind of " Opt In '' process. In fact, her only response was that " I must have told someone I wanted the " Opt In '' process. '' That is a completely unacceptable answer in my opinion. During my visit with XXXX XXXX, I asked that she change the " Opt-in '' process to " Opt-Out '' as I do not want to incur any more overdraft fees and do not have any reservations with debit transactions being denied at the merchant terminal should funds not be available. XXXX XXXX assured me that she did make the appropriate changes as requested. On XXXX XXXX, 2016 I incurred another overdraft charge of {$35.00} as a result of the aforementioned " issue ''. The changes I requested were obviously not made. At this point I have incurred a total of XXXX overdraft fees at $ XXXX/ea. for a total of {$350.00}. I am requesting that all XXXX of these fees be returned, or credited, to my account as I did not authorize Rabobank to process debit transactions when funds are not available or what they call the " Opt-In '' process.

My fathers neighbor house burned dow n ( thei r fault ) on fathers day XXXX . The fire destroyed my dads sunroom and burned down the fence and power poles between the XXXX houses. Shortly after, my dads XXXX XXXX XXXX d and he XXXX XXXX in XXXX XXXX . I finally got around to getting a contractor to estimate rebuilding the fence and all the yard damage at the end of XXXX . I am the trustee of his trust, and the executor of his will. When I finally received the fire insurance check, the bank said they could not deposit it because it was made out to my XXXX and Rabobank since they hold a XXXX dollar note on it. I took the check to b ank, they said it had to be written to " The estate of ( my dad ). So I returned the check to XXXX insurance and told them the issue. They reissued and check to " The estate of my dad '', and I took this check to the bank and they still would not deposit the check. They said I was only the trustee of his trust and not the executor of a will, or estate. They said I would have to have go through the courts to establish whether I was the executor. I found the paperwork that states I am the executor and took this to the bank and they still would not deposit the check. The branch manager told me that that I needed to have the insurance company reissue the check again, to " The trust of my dad ''. I had already spoken to the insurance co. and they can not change the entity to which they write the check, it must be the name on the policy at time of loss. I just had another conversation with the manager of branch, she says she would like to contact the insurance co and see if they can change the name, I told her I aready spoke to them, but be my guest, I also told her that I was currently sending a complaint to you. The check is for a meesly XXXX dollars, I am baffled and so distraught over not only the XXXX of my dad, but the issue of this check. This has been going on since XXXX now. Please help.

XX/XX/2016, I began the process to refinance my personal home 's mortgage with Rabobank. Currently serviced by Rabobank, I started dealing with XXXX XXXX XXXX XXXX at the XXXX, CA branch. I completed my application, provided all supporting documents, and completed the credit check. The bank approved my application and I signed a rate lock at 2.875 % for a 15 year fixed loan locking the rate on XX/XX/2016. Weeks later in trying to correspond with the bank to get the refinance on pace for completion prior to the lock expiring, the loan officer explains to me the the bank no longer wants to offer a 15 year fixed loan to me and the only product I could use was a 10 year ARM amortized over 30 years. Although I did not want an ARM, I said I would go to the ARM if they honored the rate we locked. Later, I was advised that the regional manager in XXXX XXXX 's supervisory chain, XXXX XXXX XXXX did not wish to honor the bank 's rate lock. I believe that Rabobanks efforts in not servicing an approved loan, with a signed locked rate, while interest rates are on the rise - is an unethical banking practice. If rates were on the decline, I am sure they would make sure I honored the lock on my side. I respectfully request the CFPB investigate this situation with Rabobank and unethical lending practices so it does not happen to others. While honoring what I believed to be a commitment with their bank, I sacrificed precious time when I could have been using another institution to refinance my loan prior to rates going up. I have been asking the manager to help find a resolution, extend me a loan at the agreed upon rate, but without success. After a week of no response, I emailed him requesting an answer and was still promised that he was working it " internally ''. Please help.

In XX/XX/XXXX I started to file bankruptcy. Before I finalize the discharge I talked with a bank manager at my branch about my personal credit line over draft of XXXX attached to my checking acct, I was told that anything or over draft that at the time was not going to have any effect with filing BK and will remain open as I continue paying my monthly payment I will have access the use of this acct. So my BK was discharged XX/XX/XXXX. I was notified by letter two years later XX/XX/XXXX after BK Chapter XXXX discharged that they noticed I filed BK Chapter XXXX and they were closing the use of my overdraft personal credit line protection due to BK filing discharged if knew that they were going to close my acct anyways I would have continue making payment to it for the next two years after bankruptcy never late and always making a payment, at the time so since I was told one thing by bank manager in XXXX XXXX XXXX XXXX handling my acct and two years after discharge a totally different scenerio With letters attached. Im not going to pay off and should be not a open negative acct since I could have added to my BK. This is not fair and I want to be compensated for bad open neg acct by how it is reported taken off My credit report and discharge on my BK or just forgive debt, or reopen acct for use and I will pay it off if they reopen it these are the options and as fair consumer finance operation and integrity of Rabobank and our Government It should be resolved, without it stressing me out or my credit report. On XXXX/XXXX/15, I mailed my regular fixed rate mortgage payment of {$3100.00} to Rabobank NA at XXXX XXXX in XXXX XXXX, California XXXX via personal check number XXXX. Rabobank did not deposit the check until XXXX/XXXX/15. It appears that Rabobank recently changed its mailing address to XXXX XXXX XXXX in XXXX XXXX, California XXXX and the delay in depositing was likely due to that change. Rabobank charged me a late fee of {$150.00} because it says that I supposedly did not make the payment until after the payment was late. That is not true, though, because I made the payment on XXXX/XXXX/15 and the payment was due on XXXX/XXXX/15 and was late after XXXX/XXXX/15. When I call Rabobank 's customer service department, they tell me there is nobody who can discuss this matter with me because their policy is to NEVER waive late fees under any circumstance whatsoever. I do not understand how or why Rabobank can charge me a late fee merely because of their unilateral decision to delay depositing my check. I am further frustrated by the fact nobody has authority to waive the late fee that they wrongly charged under these circumstances.

Please visit this link for a detailed report : https : XXXX I have paperwork from Bank Manager XXXX XXXX that overdraft attempts will not be permitted on my checking account, yet they try to ram them through anyway. Please make them stop their illegal activity. XXXX is trying to charge without consent ( they are only allowed to use debt card, & only when I request the transaction, not 'automated ach ' or 'recurring scheduled payment ' things ), and Rabobank keeps letting them try to overcharge, which violates the 'Overdraft Protection Act Of 2013 ( H.R. 1261 ) & various other laws. XXXX is essentially trying to steal about {$380.00} from me this way, & Rabobank about {$170.00} in fake 'overdraft fees ', total about {$550.00}. Unfortunately your complaint form deletes return spaces between paragraphs, making things into 'annoyingly unreadable monoliths ', which makes them harder to read & understand, so I have posted the complaint online with additional details ( which will be updated as new information is available ) at this web address. XXXX XXXX, XXXX Consumer Financial Protection Bureau XXXX IA XXXX To Whom It May Concern This letter is to request help ; we have just learned that our XXXX on our home with Rabobank has entered into foreclosure. We had a line of credit that we have been paying on without issue, it matured in XXXX XXXX which we did not realize and never received notice from bank. Around XXXX XXXX when payments were not being credited out our account correctly I went into the local bank in XXXX and learned our credit line was due and we need to refinance which I obtained the paperwork and began the process. Around XXXX of XXXX I learned that the bank had started the foreclose process and all paperwork which was turned into local bank was relocated to the foreclosure division. I worked with a XXXX XXXX whom turns things over to someone else about month ago. I have completed all items that I 'm aware of and not word or understanding on where we are in process. Her Manger Steped in XXXX XXXX And Said If I Move Forward With The Transaction They Will Credit Me The {$730.00} I Said Ok. I am waiting this letter in regards to questioning Rabobank standards and procedures when dealing with a claim I made on XXXX XXXX 2017 that I was a victim of check fraud in the amount of {$1100.00} dollars. I spoke to Bank Manager XXXX face to face, without any proof or solid evidence she made a claim in quote " that should have been more responsible with my account, and not deposit fraudulent checks. '' I have been a loyal customer to Rabobank for ove r three years and as a Veteran I was extremely offended that my Integrity would be the first thing in question. Not only do I have copies of the fraudulent checks but I have the email I sent out to Rabobank when this crime was taking place and the transaction was still pending I was able to contact the online banking department to cancel my debt card and close my online account. the result 's of the incident caused with to close my account with Rabobank and landed me on bad terms with companies that I had direct payments from my account.

Rabobank NA is hassling me when I call in for help with online banking. Today is called my local branch to reset my password was told some very simplistic thing then called the other numbers. Despite trying to reset online and asking for online support I went back home and tried calling again. I just get attitude from them. They wo n't help. The girl at me local branch snapped at me. This is some who has been helpful in the past and is suddenly aggressive, not listening, seems very passive aggressive, she is telling me to not raise my voice and they refuse to help me. She even said I would n't be able to resolve it at my local branch in XXXX XXXX, CA either. I feel like I wasted my entire morning on these people who are just rude from the get go. They do n't appreciate people and seem to be waiting to set you up with lots of inappropriate questions. The are apprised of account activity and yet I 'm waiting for some help. This is very unprofessional and I want to file official complaint.

hi I have a mortgage on a dairy farm The dairy portion has been shut down and the buildings that were used to have the dairy have been decommissioned I have lost their permits have lost their status to be a dairy ever again and yet my Bank is requiring excessive insurance on buildings that have no purpose other than just being a shed I have asked them numerous times to send me original copies of the loan documents showing the insurance requirements and they are not willing to produce those I guess an example of this would be if you see an old gas station structure on a lot there are no pumps anymore there 's no tanks anymore there 's no permits anymore The land around it is being used for other purposes but yet the bank still wants to have levels of insurance as if it is a gas station

On XXXX I deposited my husbands check in the mail box of Rabo Bank in XXXX Ca at XXXX XXXX . I then went to work. I checked my balance through bank texting and the amount of husbands check had been deposited in to our checking. On XXXX I checked our account and check deposit was nowhere to be found. On X/X/2017 at XXXX I went to bank to find out what happened to my deposit because I had numerous bank charges for insufficient funds. They said it was a electronic error and that I would not be responsible for any of the insufficient funds. Which is good but I 'm thinking that fraud was being committed on my acct by the bank to see if I would still pay for the insufficient charges. Rabo Bank is notorious for charging extra fees.

This bank opened an account for probate ( trust acct. ) without proper probate members ( family members ) listed by name on the trust paperwork. They weren't listed on the bank acct. Then distributed monies for anything requested by 2 or more parties upon request from said Trustee. This started shortly after my Mom deceased in XXXX. The executor of the acct. has WAIVED all HER rites to manage my parents legacy, according to all the lawyers retired and active, I have been seeking help with this 5 long years and counting ... ... I made a mortgage payment to Rabobank for loan XXXX on XX/XX/2016 via postal mail but received notice from Rabobank on XX/XX/2016 ( dated XX/XX/2016 ) stating that the loan payment was past due. Upon researching the matter, Rabobank had not cashed the check ( number XXXX in the amount of {$1600.00} ). Therefore, I re-issued the check and walked payment into the nearest branch. I requested a late fee waiver and they refused the waiver saying that they had made no mistake. However, losing my check is a mistake and I should not owe a late fee for their mistake.
