On or about XX/XX/XXXX I was approved for a Auto loan with Quality Acceptance. Loan amount was {$8900.00} for a XXXX XXXX. On that day I paid a down payment of {$1500.00} with an agreement to return in two weeks with another {$500.00} totalling {$2000.00} for the down payment.. I also signed up for auto pay which was to come directly from my bank account scheduled for every 3rd of the month.. During the month on of XX/XX/XXXX I invested {$6100.00} on major repairs that car needed which I was not aware of. I have invoices and bank statements for proof. The first few months my account was automatically ( autopay ) debited {$340.00} as planned, which was perfect because I had direct deposit to this current day. In XXXX I received a frighting phone call from Quality Acceptance explaining that they were trying to locate the vehicle for repossession, their reasons was for failure to provide car Insurance. I told him that I had faxed Quality Acceptance a copy the same day I switched companys. After claiming that Quality Acceptance never received my faxed, I told him that I had confirmation that it was faxed, then I tried to explain to the representative that I did have insurance and asked if he could give me a moment to retrieved the policy so I could provide information that he was requesting, which took about a minutes, but when I returned to the phone he was no longer on the line. I called back and gave them the policy number and the number to XXXX XXXX Insurance, who also was on auto pay. At the beginning of the following month I checked my bank account to confirm that my Insurance ( auto-pay ) was debited and noticed it wasn't. I called XXXX XXXX to find out why didn't they debit the account and the representative tried to reassure me that they did get the payment. After checking my account again. I called and email the representative at XXXX XXXX and yet again he tried telling me that it was paid ( weird ). My response to him was I needed him to email me the invoice for proof of payment. The next morning I received an email for the representative explaining that my bank account had just been debited the payment. I'm still not sure why he tried to convince me that the monthly payment for my policy was paid when it was not. I am sure that I didn't have any problems with them ( auto-pay ) debiting my account leading up to me providing my Insurance information to Quality Acceptance.. I'm happy I checked.. And my Insurance policy was never cancelled until two months afterQuality Acceptance took my car which was on or about XX/XX/XXXX. On XX/XX/XXXX while checking my account I noticed that my account hadn't not been debited {$340.00} the monthly payment for my car. That day on my way to school I called Quality Acceptance and made a payment for {$340.00} plus they were trying charged late fees. On or about XX/XX/XXXX while getting ready for school I noticed that the vehicle was gone. For two days I called different Cities and tow companies and police stations in the surrounding area but wasn't given any information about what happened to the vehicle.. So the next morning I called Quality Acceptance to report it missing and was told that they picked up.. When I asked why did they have the car, the representative first response/reasons was because I had abandoned the few vehicle. After stating that I did no such thing and asking about their policy and procedures on just how one would determined or come to the conclusione that the vehicle had been a abandoned. She stated that she wasn't sure and told me to hold for a manager. After about twenty minutes on hold another representative answered, and told me that my payment that was due on XXXX for {$340.00}. had not been paid.. He stated that if I wanted my vehicle back that I needed to wire them {$1300.00} cash through XXXX XXXX which included repossession fees. I was also told if I wanted my property returned that was inside the vehicle at the time of repossession which where in two garbage now, I would have to pay an additional {$380.00} cash for storage/holding fees. Two days later I called Quality Acceptance with the {$1300.00} that they were now demanding but I was told by one of their representative 's that the car had been sold in an auction for XXXX.. So I never seen my property or the car again.. At the time I was enrolled in night classes at XXXX for XXXX XXXX located in XXXX but I lived in XXXX XXXX California XXXX I had two weeks left to complete, and on the honor roll, but I still had to complete the required 120 hours of internship at a dental office before I could get my certificate and graduate. Unfortunate I was unable to get there due to no transportation.. I'm going to be XXXX years old. Thats the first program I signed up for and didn't complete, that thought a lone cause pain in my stomach like I need vomit every time I think about. Plus now I have schools loans that would have taken care of themselves a pond my completion.. Quality Acceptance continues to reporting my information to all three Credit Bureau 's . They also started calling me and asking me when did I plan on taking care of the balance. During the month of XX/XX/XXXX they called twice and both times I requested that they validate the debt with records and both times I was told that they mail it, but I hav n't received any thing so On or about XX/XX/XXXX I mailed a certified letter to Quality Acceptance stating that I am requesting/demanding that the debt be validated, but all requests has went unanswered. I tried to dispute the loan on XXXX. But the only change on my credit report dealing with this account was that close it, but they continue to report it.. It their actions that cause me to default on my loans with school amoug other things. Every two weeks I was paying on my students loans at school fath fully while attending school and was current leading up to incident.. Around the time I was approved for the loans to current my credit score has drop from about XXXX. I also talked to a representative from XXXX XXXX bank about my account. I asked what are the procedures for removing auto-pay once its been established? I told her I would have thought that not only would my premission be required but maybe my signature as well because that to was a contract I signed. . But this was cancel/removed without my knowledge. She stated that because Qaulity Acceptance were the one 's who set it up, and without a request from me to my bank for them to cancel auto-pay only Qaulity Acceptance could have discontinued/cancelled auto-pay. She also said to have auto-pay removed usually takes somewhat of a lengthy process and don't usually happen over night. Only Quality Acceptance can can explain their motives behind removing auto-pay which I don't believe a bank has ever done without a request or consent. Please help if nothing else to expose them for their very bad practices that their involved in. I believe they unlawfully stole the car and my personal proprety then demanded for me to pay them a total of {$1600.00} in order for me to be whole again it's frund and it's criminal on a very high scale and scary cause its federal. They are the same ones who approved me for the loan. Well I signed the contract but not but never knew who was the holder in due course ... And also disregarded the amount I invested as well. I Quality Acceptance # XXXX I will attach everything I consider evidence including bank statements and a copy of the certified letter requesting that the debt be validated.. I am hopeful that they will feel more obligated to respond and speak with your office more then they spoke with me. .. I'm far from perfect and so is my credit, but I really tried to not only improve credit but also stay in honor of the contract by by having a safe gard there like auto-pay, direct deposit, also checking my account just for confirmation and piece of mind for Qauliy Acceptance and myself. I'm really not sure what else I could have done to prevent this. I don't think anyone should have been treated in such a way no matter what class or status a person is classified as. In XXXX XXXX after a car accident that had left our car totaled, and we were patiently waiting to hear from XXXX XXXX about a new car they were offering for us as replacement. Nearly a year went by without hearing from XXXX XXXX so traveled from XXXX, XXXX to XXXX XXXX XXXX, where we bought the car that was totaled at XXXX, and financed through XXXX. 2 years of payments up to date, only a few times was it a week late. But our relationship was good with XXXX and we had 4 % interest. As other letters stated we were severely identity theft and there was a lot of false creditors on our credit report that we were trying to resolve. We supplied XXXX with police documents and other proof of identity theft as well XXXX the sales lady made it very clear that on her computer she saw a person named XXXX was illegally using my credit. Now at time we sat down she said they be no issues getting a car due to our great credit history with lender of last car we got from them and we paid 4 % interest. We also were told {$1000.00} down would originally be plenty. We were told that 12 % was our interest rate. And paperwork had started on a XXXX MUSTANG for XXXX. XXXX sales lady came back and said that interest rate had changed to 17 % and that we would need now an additional {$1000.00} = {$2000.00} down. We reluctantly agreed but were assured that in one year if we were up to date with payments, the interest rate would fall extremely low for remainder of the 36 payments. But after that, we were yet told one more time that interest rate now rose to 19.95 %. Or if we paid car off early we would naturally not owe the 19.95 interest rate of the lower one for those months paid early on the back end. In following year we either made our payments before hand and in one occasion it was one week late. But QUALITY ACCEPTANCE LLC would call for no reason, harassing about payments even when we were up to date, check phone records. And sometimes more than once a day to me and to XXXX separately even after we explained the payment went out on time or for one time one week late. So in XXXX XXXX after one too many harassing phone calls, I called and spoke to a XXXX at QUALITY ACCEPTANCE, due to all the prank phone calls from our identity theft and so many unresolved issues, I contacted FTC to see what the laws or regulations were. I found out that it is against regulation for them to call so many times, and if I let them know that they need to stop, that they have to be law. As well that with my proven identity theft and loss, and unresolved fraud on my credit report and that I not only proved it to them, but also they let me know they were aware as they saw it for themselves, that we deserved a much fairer interest rate than given at time of purchase. I also discussed my one year of loan payments on time to QUALITY ACCEPTANCE, that I wanted talk about the lower of interest rate as promised, and XXXX said that payment status was very good that they were not gon na lower the interest rate as promised. So I asked XXXX if it would be ok if I was one payment behind and put it in back. She said yes, that my payment history was good enough that they could extend that to me. That call was in XXXX XXXX. And not only but a few days later from calling XXXX and her confirming that I could be late and that not to have people calling me, I got several calls about the payment even though I confirmed XXXX said it was ok and after asking customer service to stop calling me, that I made a complaint, they still continued call. And after doing a little research and finding out that QUALITY ACCEPTANCE, not only took advantage of our identity theft situation charging a much higher interest rate than we deserved, and charging us twice as much down as first said, and the fact they had no integrity in honoring the lowering

XXXX company response Thank you for your inquire with Quality Acceptance ... Unfortunately Quality Acceptance has responded with information and alleged dates, and times, that are very inconsistent with my document/records. Also in this response Quality Acceptance has again fail to mention or validate this claim with any records that I requested XX/XX/XXXX. Without the proper paperwork I am unable to confirm Quality Acceptance own this debt, nor can I confirm that I am obligated in any way. It's inappropriate and unethical to make a claim without the original note.. Due to the facts that Quality Acceptance has not been very forth coming with any truthful Information about this loan, nor any truthful information surrounding the repossession of vehicle. After the confused and mis-information I received, It was out of good faith that I requested records over the phone twice, I was reassured both times, that it would be in the mail. I've never attempted to reinstate this this loan in any way after XX/XX/XXXX. I only requested records, because I started questioning the legitimacy of Quality Acceptance in its entirety. XX/XX/XXXX is when they repossessed the vehicle stating several different reasons. I was told {$1300.00} was needed in order for them to return vehicle, an extra {$350.00} for the return of property. Three days later I called to pay a ransom, that was being demanded. I was told that it was sold at an auction that morning for {$17000.00} and there was nothing I could do about it. After that day I had know other reason to call Quality Acceptance except to give the a current address so they could mail the requested records.. I have submitted records from My XXXX XXXX XXXX account for the records to reflect that Quality Acceptance withdraw payments automatically starting XX/XX/XXXX due to the facts, that I completed the form for auto pay at the dealership before I ever received keys XX/XX/XXXX. After speaking with my banker I was told that Quality Acceptance was the only one who could have cancel it.. I don't know why Quality Acceptance was unscrupulous in their dealings and continue to carry on like this isn't damaging my name. Quality Acceptance continues to unscrupulously report my information to the credit bureau, they also in the response letter claims that I made statement that I never made. I was never mailed any records and I can not satisfy any debt without claim that I can't verify.. please send me the information please.. Conclusion on XX/XX/XXXX I sent Quality Acceptance a certified letter # XXXX XXXX XXXX XXXX XXXX validate the debt 15 U.S sec 1692g. 1. Furthermore, Quality Acceptance continues to conduct itself in dishonor and in bad faith by submitting false information on the record but has fail to submit anything valid for for records.. . 2. Furthermore, I have provided my XXXX XXXX XXXX statements showing all auto pay Electronic transactions by Quality Acceptance starting XXXX rebuttal to 3. Quality Acceptance statements of false occurrences and dates allegedly communicate with me. 4. Further more, on XX/XX/XXXX Quality Acceptance received a certified letter requesting for validation of debt and as of XX/XX/XXXX my request has went unanswered. Quality Acceptance is the true creditor, or holder in due course. In violation of the Fair Debt Collection Practice Act Sec. 1692g-Validation of debt. ( a ) NOTICED OF DEBT I XXXX XXXX has requested records that are necessary for in a attempt to satisfy this claim, and is unable due to a willful acts of Quality Acceptance, and I am demanding that they correct the record on any mis-infor-mation dealing with my person immediately. Our interest rate was 4 %. for the XXXX purchased in XXXX, then it was totaled in a car accident in XXXX XXXX. XXXX XXXX XXXX XXXX and XXXX XXXX go into XXXX to fiance a XXXX XXXX. I do believe the BLUE BOOK VALUE was around XXXX, but the modestly had it priced at XXXX. The first thing out the the car dealers mouth was asking XXXX XXXX " DO YOU KNOW A XXXX? '' In which XXXX XXXX replied NO. The dealer then said that XXXX WAS USING XXXX XXXX CREDIT without his authoriztion, inwhich we supplied DEALER with info on severe identity theft issues we had happen in the prior few years. We were told we would only have to put {$1000.00} down. During the paperwork process we were then notified that we would need to put an additional {$1000.00} down {$2000.00} down. So we did. We were then notified that we would be paying 13 % interest, then short time later we were told 15 %, and this went on for hour til we were finally told 19.95 interest. We found this to be highly irregular. I thought there as a cap on how much interest you could exploit someone for, knowing they been idenity theft and had a 100 % clean track record. So by the time the whole thing finished, we were told we be going with XXXX XXXX XXXX again, but no we later found out QUALITY ACCEPTANCE. During the next year we made good on all XXXX next payments of {$370.00}, however we were both getting an on slot of calls from QUALITY that were unneeded, I was told after a year we could get our finance charge lowered, but no even cared to help us. I contacted the FTC commission for THREE reasons in XXXX XXXX #! QUALITY ACCEPTANCE was off its rocker with unneeded harassing phone calls. # 2 We were promised lower interest, we were also told this interest rate was alot higher than it should have been. # 3 The sales slip is attached here. The over charged us about {$3000.00} in interest. As you see all way to left a column starts ANNUAL PERCENTAGE RATE 19.95 FINANCE CHARGE XXXX AMOUNT FINANCED XXXX TOTAL OF PAYMENTS XXXX If you look at it quickly you can see the mistake clear as day, if amount FIANCED is XXXX and interest is 19.95 ( though way higher than allowed ) you can see that fiance charge XXXX is almost at 43 % not XXXX. The correct price is XXXX plus XXXX ( XXXX ) that is {$14.00} NOT XXXX DIFFERENCE of XXXX As well I told FTC I was surrendering the car for these three reasons, on may way to do so, someone backed into me and caused damage to the rear end of the car. I called the insurance company and I left the info with the plates for XXXX, and then come a huge amount of phone calls and huge amount of threatening letters from QUAILTY ACCEPTANCE. The sold the car for {$4000.00} without even bothering getting it fixed with my info which is neither here nor there, cause like I said, we paid XXXX payments XXXX the XXXX payments we made XXXX how much QUALITY got for the car at auction XXXX the amount XXXX XXXX paid in XXXX XXXX Thats XXXX NOT INCLUDING BLUE BOOK which QUALITY nor RELAIBLE bothered to count in It is true we did not call QUALITY back right away, all the harrassing phone calls and letters started early XXXX XXXX and went on til XXXX XXXX with a very serious threatening letter from them. So, its our money, yet, look all that happened, look, this is not a joke, look at this. So finally things calmed down, XXXX overpaid hoping it would help get QUALITY off our credit, after think about it, how were we late with a payment, we are being charged 19.95 interest, a rate suppose go lower, we paid XXXX payments in a row, we turned the car in and they got {$4000.00} to put toward the balance, so no we were no late, so when XXXX overpaid be

In XXXX XXXX myself and XXXX XXXX went to reliable auto in XXXX to get a a new car after waiting for XXXX XXXX to assist us with a car from their AUTO CIRCLE program after a car accident under the policy which after ten months of waiting they did not do. Quality Acceptance LLC is disgusting. We were told that 12 % was our interest rate. And paperwork had started on a XXXX MUSTANG for XXXX. XXXX sales lady came back and said that interest rate had changed to 17 % and that we would need now an additional {$1000.00} = {$2000.00} down. We reluctantly agreed but were assured that in one year if we were up to date with payments, the interest rate would fall extremely low for remainder of the 36 payments. But after that, we were yet told one more time that interest rate now rose to 19.95 %. Or if we paid car off early we would naturally not owe the 19.95 interest rate of the lower one for those months paid early on the back end. In following year we either made our payments before hand and in one occasion it was one week late. But QUALITY ACCEPTANCE LLC would call for no reason, harassing about payments even when we were up to date, check phone records. And sometimes more than once a day to me and to XXXX separately even after we explained the payment went out on time or for one time one week late. So in XXXX XXXX after one too many harassing phone calls, I called and spoke to a XXXX at QUALITY ACCEPTANCE, due to all the prank phone calls from our identity theft and so many unresolved issues, I contacted FTC to see what the laws or regulations were. I found out that it is against regulation for them to call so many times, and if I let them know that they need to stop, that they have to be law. As well that with my proven identity theft and loss, and unresolved fraud on my credit report and that I not only proved it to them, but also they let me know they were aware as they saw it for themselves, that we deserved a much fairer interest rate than given at time of purchase. I also discussed my one year of loan payments on time to QUALITY ACCEPTANCE, that I wanted talk about the lower of interest rate as promised, and XXXX said that payment status was very good that they were not gon na lower the interest rate as promised. So I asked XXXX if it would be ok if I was one payment behind and put it in back. She said yes, that my payment history was good enough that they could extend that to me. That call was in XXXX XXXX. And not only but a few days later from calling XXXX and her confirming that I could be late and that not to have people calling me, I got several calls about the payment even though I confirmed XXXX said it was ok and after asking customer service to stop calling me, that I made a complaint, they still continued call. And after doing a little research and finding out that QUALITY ACCEPTANCE, not only took advantage of our identity theft situation charging a much higher interest rate than we deserved, and charging us twice as much down as first said, and the fact they had no integrity in honoring the lowering of interest rate, and not only all the annoying phone calls, but to make them after I asked them not to ; I found out that they had violated regulations and had cheated us.

I did not give Quality Acceptance the permission to furnish information on my consumer report. 15 USC 6802 prohibits disclosure of nonpublic personal information without the knowing and expressed consent of the consumer. As a financial institution they are not to disclose non public personal information to a third party unless such financial institution clearly & conspicuously discloses to the consumer in writing or electronic form or other form permitted by the regulation prescribed under section 6804 of this title that such information may be disclosed. I did not receive any of the 3 disclosures I just mentioned, which Ive discovered is against consumer law and a direct violation. Quality Acceptance is also reporting inaccurate information on my consumer report which is a another violation under the FCRA 15 USC 1681. TILA 15 USC 1601 protects me as a consumer against inaccurate & unfair credit billing. As a consumer, I signed an agreement to enter into a credit transaction with Quality Acceptance ( on an unknown date because my consumer report is showing two different dates ) but had no say, legally it takes two consenting parties to create and agree. I was not informed, the agreement was not conspicuous and clear of basic facts and I made a uniformed decision. There is no evidence of indebtedness, the only evidence of the debt was the agreement I signed but because of the uniformed decision that agreement is null and void. I 've been making payments to this company for almost 2 years, and everytime I 'm a little late on my payments, the company would call my cell phone and my job to harass me. It never once failed for them to call my job and embarrass me. The bad part about is they would discuss my personal information with my coworker which is very unprofessional against the law. I have provided my invoices as documentation and evidence of the type of practices I have experienced with the company, Quallity Acceptance. The explanations given about the practices did not make practical sense and I've had several attorneys and car dealerships to review the invoices to see if they could surmise what the company was doing with the extra payments that I was making on the loan ; none of them come explain or follow the process. If you look closely at the Account Activity - Overage/Shortage ( in the center of the invoice ) and the Due Dates ( at the top right ) ; this was alarming to me and I called three to four times for an explanation ; again their responses did not make practical sense in terms of how they applied my second payment each month. You will notice a change in the " contracted '' amount of {$470.00} ; it changed to {$540.00} and their explanation was that it is how they will " catch me up '' on the payments being applied to the account. I called and asked for an amortization schedule approximately 5 months ago and to date I have not received one ; this would have been the second I would have received. Also, how does a company automatically change the contracted amount on an installment loan without redoing a contract? My latest statement has a due date of XXXX, 2022 and the Overage/Shortage is now {$23.00} or so when it was showing as a negative amount upwards of {$300.00} or more which reflects the additional amounts I made monthly. As a consumer, I am quite upset with the answers and processes that I see occurring. I printed out all the documents and attached them to the complaint.. I opened an auto loan with Quality Acceptance. In XX/XX/XXXX. The car was repossessed XXXX of XXXX. I never recieved any proper communication before repo. The car was dragged out of my driveway with no communication of their intent to do so. They would eventually send the car to auction.Without giving me the option to recover. I am unsure of the auction price because they refuse to give me any information. A few months later the pandemic would hit. The amount owed after the car was sold was never updated to credit bural. When it did. It updated as a charge off of XXXX. I would later recieve an update of the account being " Closed and Charged Off '', I tried calling to figure out what I actually owe, but Quality Acceptance keeps changing the amount. They won't give me a straight forward answer and are very aggressive on the phone. I have no idea why I owe this new XXXX amount, and I haven't recieved an invoices since XXXX for ANY of these new amounts chaged to the this closed and discharged account on my credit file. I believe this company is using unlawful practices to force people into paying significantly more then what they originally owed. My balance was a little over XXXX in XXXX. Without notice, now the balance is XXXX. They have charged over XXXX since the account closed in XXXX. Keep in mind this account is closed, and I haven't received a single invoice, phone call, or email communication for ANY charges accuring on my report. As of today XX/XX/XXXX. This incident occurred in XX/XX/2018 where the company Quality Acceptance repeatedly called my place of employment. They asked to speak to me but not before disclosing my past due payments with my employer. They were told to not call the office, once by my direct manager and once by myself. However they continued to call twice more disregarding our request. I understand it is consumer protection law that states they are not call a place of employment especially when told not to do so! The atmosphere at work had recently become stressful due to poor business at the time. Their refusal to leave my place of employment out of the process added to the hostile work environment. To explain briefly this attributed to my employer treating me with an added disrespect. Along with my mother being diagnosed with XXXX at the time I had fell behind on my financial obligations. I co signed for my wife 's vehicle that we purchased in XX/XX/XXXX. It was a a XXXX XXXX XXXX. We purchased it for a total cost of XXXX and we put XXXX down. Our payments were still 300+ a month which was out of our budget. We tried returning the vechile the following week we purchased and were denied. The dealership stated that the finance company ( quality acceptance ) would not let us out of our loan agreement. We struggled for 3 months to make the payment before they repossessed the vehicle in XX/XX/XXXX. They then notified that we were still expected to make the monthly payment even after they notified us that the car was sold at auction for XXXX XXXX Which is more than the original purchase price. In XX/XX/2017 my vehicle was reprocessed after only 30 days of delinquency. However my chief complaint is that I was never notified when the vehicle was auctioned or sold.
