I am no longer struggling to make a payment. So, in this Complaint I report a series of events in which LendNation continued their phone calls to me, my family and friends even after I begged them to stop. Even though I paid them, they still threaten to garnish my wages. On a few occasions, I borrowed money from the LendNation on XXXX XXXX, XXXX in XXXX XXXX XXXX, Utah 3 times altogether, paying my installments on time. When COVID-19 hit, LendNation withdrew funds from my account without permission. The agreement was that I would pay in the store or over the phone as we would arrange. When I found out LendNation had run the transaction on my account without my permission, I informed my bank that they did not have authorization for the automatic payment they ran, and the bank reversed the transaction. LendNation called me 2 or 3 times a week to figure out when I would make a payment. I explained to them that I could not teach or earn as much money as I used to because of the COVID-19 travel and face-to-face restrictions in place at that time. I asked LendNation to stop calling me and promised to return to them once I had the funds to pay. I explained to them that I had applied for Unemployment and updated them at every stage of the process, including when the case went on appeal. I offered to provide them the related UI documents, but they said it wasn't necessary. Even with this information, they continued busting my phone. I was so overwhelmed with anxiety that the only way to get relief was to ignore their calls. I asked them if they could stop calling me and send me letters instead, they said, " If you stop us from calling you, we are going to sue you. '' They called my family members and friends I listed as references. I asked them to stop calling them and renewed the promise to pay them. LendNation said they would stop calling my family and friends once I paid them. I kept receiving embarrassing messages from my family and friends several times after that. My Unemployment insurance appeal case cleared, and the funds arrived on XX/XX/XXXX. About two days later, I called LendNation and informed them that I moved from Utah and currently lived in a different state, I asked the lady I spoke with how much it was, and she said {$590.00}. I asked her if it would be the same amount if I paid the amount by the XXXX of XXXX, XXXX. I wanted to pay the loan close to my new location. She said because I was in collections, the amount would stay the same and that I could not pay anywhere other than at the XXXX XXXX store. There's a LendNation office 45 miles from my new city. I already had a check for {$590.00} for LendNation that I would deliver at that store but had to wait until the next time I was in Utah. On XX/XX/XXXX, while in Utah, I received a call from XXXX XXXX XXXX, who said he had LendNation 's court papers to serve. He said he went to look for me at my previous location, but could not find me. I explained to him the same story that I have detailed above concerning my move to Idaho. I explained to him that I would come to XXXX XXXX to receive the court " paperwork " he had for me. I went to the LendNation Office on XXXX and XXXX XXXX in XXXX, Utah, and presented the {$500.00} check and XXXX cents cash. They also asked me to pay the filing fees of {$95.00} via credit card. I asked XXXX, the LandNation clerk, for guidance on the next steps after I had paid them. I explained to her that I heard there was " paperwork to be delivered to me. She said I needed to speak with XXXX about the papers and that they would " release the paperwork '' once the check cleared. I asked her what she meant by that. She said if the check cleared, there would be no hearing. I called my bank to confirm that Lendnation withdrew the funds from the account, and they indeed got the money on XX/XX/XXXX. I called Lendnation on XX/XX/XXXX, and XXXX XXXX and spoke with XXXX. I asked her what the process was on " releasing the paperwork. '' She said, " There is a hearing on XX/XX/XXXX, and we are going to garnish your bank account. '' I asked her how that is possible when the check cleared. She said she had nothing else to discuss with me. LendNation filed their claim with the court on XX/XX/XXXX. They learned in the location trace that I moved to Idaho on or before XX/XX/XXXX -US Postal Service Confirmation Code XXXX XXXX XXXX XXXX. I sense that LendNation intends to garnish my account and would like the government to intervene- I don't owe them.

XX/XX/XXXX I was contacted at my workplace by a co-worker stating that she received a call from this company stating she was going to be faced with a civil suit in XXXX XXXX XXXX on a legal matter that involved me. She gave them my work number. The company identified themselves as a service that needed to advise me that there was a pending civil suit against me and the male voice then transferred me to a company that announced themselves as XXXX - her name was XXXX. she stated QC Holdings were going to file a civil suit in XXXX XXXX for breach of a contract back on XX/XX/XXXX. I advised I have never heard of QC Holdings Company. I asked that they please not contact me at work and told them that this must be a spam. She then talked over me stating this was the number that was listed on my contract and said other things that I did not catch all of the conversation as I was caught off guard, at work, upset with someone threatening a civil suit for a breach. I verified with her my cell number. I asked what this company was? she then sent me to a gentleman named XXXX. I ended call before he came on. I then received a call on my mobile XXXX. He identified himself. I again asked questions of who they were and why were they calling me. He was very pushy and I asked to please send me proof of the contract that they stated I breached. He said he did not have that info. I finally got out of him it was a check cashing loan place that was stating I had not paid an amount of {$280.00} and the statute of limitations for his client would be running out soon and they needed to collect this. He stated it occurred on XX/XX/XXXX. He identified my last 4 of SS # and my bank name but account number last XXXX was not correct. He also stated the address of the pay day loan company here in XXXX. I had settled with a check cashing company that I used back in XXXX with the address that he stated this took place in XX/XX/XXXX. I settled this debt through the assistance of a credit advisement company that is in here in XXXX Called XXXX XXXX I told the gentleman this, but he again stated I would be subjected to a civil lawsuit including filing and attorney fees. He stated he would send me a settlement contract via email. Which he did. But the amount of the breach was {$280.00}. the fees and fines made the total to be {$780.00} but he could settle this today for {$440.00}. I advised that I need to see the amount of the contract he kept referring to. He stated he did not have that, but he was sure it was correct as his client would not have sent it to him. I have not signed the agreement and I am seeking help. This company has not provided me anything in writing of the contract they state I breached.

On Monday XXXX XXXX, 2015 around XXXX, someone called my sister n law 's phone looking for me and she told them that they have the wrong number. I called them back and spoke to a man who said that I was being accused of fraud for writing multiple bad checks and that I owed around {$5400.00} in fees. He said that I probably just made a mistake and that could settle this for about {$1000.00}. I told him that I needed him to send me something in writing to verify this and he told me that he did not have to because it was past the point of collections. I told him that the conversation would be over if he could not provide this information to me and he began yelling at me and hung up on me. When I came home i also received a voicemail from this same number just stating that there was a claim in their office and I needed to contact them back. On Tuesday, XXXX XXXX, 2015 at XXXX, I received another call from this number. I called this number back and spoke to a woman who identified this company as XXXX XXXX and stated that she was not a debt collection agency, but a mediation agency. She stated that I was being accused of fraud for writing bad checks as well and I explained to her that I would need something in writing stating what I was being accused of and how much I owed. She said that if I did n't resolve this issue that I would be referred to the county for fraud. She told me that they had me on camera walking into a loan store and writing a bad check and that is considered fraud. I then told her that I did have a payday that I took out in the past that defaulted and that I tried to make a payment arrangement with that company and the company did not want to accept my arrangement. She told me that I could settle this for about {$1000.00} and I told her that I needed to see what I was being accused of in writing first. She kept insisting that I make a arrangements with her and I kept insisting she give me something in writing. After going back and forth she said that she was just going to send this in and that I needed to get an attorney and that I would be liable for about {$4000.00} and hung up on me. I have this conversation recorded on my phone and can email it to any party that needs this or I can replay it. I tried XXXX this company and found no results. This woman did have some information about this debt but was not accurate. I believe that this company has violated The Fair Debt Collection Act for accusing me of a crime for owing a debt and accusing me of writing multiple bad checks because I took out a payday loan that defaulted. They also are not representing themselves as debt collectors which is also fraud.

On XX/XX/21 I went into Lendnation in XXXX to pay off a {$350.00} loan I had just made on XX/XX/21. I was told I could loan again, but I wanted to keep my payments around $ XXXX {$200.00}. I asked about what the terms of the loan would be, the employee seemed surprised to being asked such a question but rattled off a bunch of figures ... if you loan this much for this long your payments will be .... it was a lot of info not easily digestible so I asked if she could show me what she was talking about. She couldn't twist the monitor so I could see, didn't try, didn't print anything at all. It was the very end of the day,, they were closing ... So, I picked one of the options ( I think ). I know she funded {$650.00} to my debit card. I know my due date is the XXXX. I did not receive any documents to take home at all. I signed three papers, one of which said APR and the finance charge and total payments after all paid according to schedule. I commented on the number I briefly saw, and went to point to it but the employee quickly interrupted me and turned the page where she indicated for me to sign. ( Since I had just paid off my previous loan at pretty reasonable rates [ it seemed, retrospect shows it was because I paid it off a few weeks after getting it ] ) Afterwards, I looked at the paperwork from the previous loan, as I remember insisting they print that one for me. The previous loan was for {$350.00}. I was in shock to see the finance charge on {$350.00} for 11 months was {$820.00}! If I had gone to full term I would have paid {$1100.00}! This seems as they say, UNCONSCIONABLE. When XXXX came around,, I did not have time to call Lendnation before closing to see what my payment due that day was supposed to be. - no paperwork.. So I decided to put debit card controls on my bank card that day with plans to call or go in the next morning. When I woke up the am of the XXXX, my bank had alerted me to the fact the night before there was 2 denied attempts of withdrawal, which I expected, but in addition they had just got around my debit card control options ( which was to block any charge over {$100.00} ) by making 4 consecutive and equal charges of $ XXXX. This was at XXXX. I was mad. THE ATTACHED IS THE PREVIOUS LOAN

While coming into this location today I entered trying to pick up a XXXX XXXX. The representative was immediately rude " XXXX '' I believe was her name. She told me I needed two forms of ID in which I informed her I was just at that location and helped two days ago by the representative sitting right next to her. She immediately started to have an attitude putting her hands up as if to tell me to XXXX XXXX then literally telling me it doesn't take all that. I told her she was being rude and she continued a banter back and forth which led to a full argument. She began to tell me that she was going to look into the records to find out where I lived. As I left I told her she was rude and that she walked in the store through the door like everyone else to emphasize we are all human beings and she then to go back and forth calling me a " XXXX '' word repeatedly and saying she was going to find out where I lived. I perceived that as an immediate threat and breach of consumer records and I told them I was calling the police which I did. The manager did nothing to tell the worker to stop cursing me out and threatening me and she then told me to leave the store even as her employee was cursing me out in which she sounded as if she was on drugs or drunk. I found this even more frustrating as I called the customer service line and had the operators bounce me around to random voicemails and claimed no supervisors or managers were available. I have never been spoken to in such a way. I informed the manager that I would be reaching out to have the corporate offices pull the audio and video. When I asked the manager if the cameras also record audio the manager refused to answer the question and allowed the worker to continue to rant at me and call me a " XXXX ''. I can not believe I had my life threatened and a worker flat out say in front of her manager that she was going to go into the records to find out where I lived.

your company has repeatedly contacted me/ us, claiming that I owe a debt under Lend Nation. I was never told I had the right to rescind according to 15 US Code 1635 I was entitled to this. This is a violation of TILA. 15 US Code 1605 The finance charge is the sum of ALL charges. I do not believe that I owe this alleged debt that you say I owe. Such conduct from your company has caused me to suffer severe humiliation and embarrassment, emotional distress, and physical discomfort. You have violated 15 U.S.C. 1692 ( c ) of the Fair Debt Collections Practices Act by harassing me regarding this debt. I'm requesting you send me this alleged bill XXXX out with no balance per I have no written contract with this company. I demand that you cease and desist of this activity as soon as possible within fifteen ( 15 ) days from your receipt of this Notice. This includes eliminating our account from your records, discontinuing and retracting reports to any and all credit reporting bureaus, and ceasing any and all communications to us by mail and otherwise. I also demand that you do not sell/give anyone else any information regarding this alleged debt. If action is not taken by you to cease and desist within the given time frame, I will have no choice but to take appropriate legal action against your firm. I may still choose to prosecute for commercial copyright infringement for which your company is hereby liable. The ONLY information I want to receive from this company will be the XXXX out invoice that I am requesting. I initially took out a loan with XXXX XXXX ( QC Financial Services Inc. ) for {$400.00} on XX/XX/2019. On XX/XX/19, I called the business to request a payoff amount, as I wanted to pay off the loan. The person on the phone quoted to me the amount of {$340.00}. I then made arrangements to pay that amount by phone. As they had stated to me that they do not mail out receipts, I considered our business done. On XX/XX/2019, I received a phone call from XXXX XXXX requesting a payment. I was shocked, and stated so, because I had been given the impression that my loan was paid off. I informed the caller that I had paid the loan off in XX/XX/XXXX. I asked them why I would have paid the amount that I had paid if I did not intend to pay the loan off. They constantly repeated that there is no way of knowing why I paid the amount of {$340.00}. During the course of my phone calls with staff and the manager, no one with the company admitted to any mistake or took any responsibility. The attitude of staff and the manager was not helpful at all. After several phone calls, I was told that I still owed {$130.00}, and that the amount would increase if I did not pay the amount THAT DAY, which I did. So in essence, my payoff amount was initially misquoted by a company employee ( which is bad enough ), but that employee 's mistake has also cost me an additional {$57.00} in interest and fees.

I've received several phone calls from a lady whom identified herself as XXXX XXXX. She said that she is a courier for someone that is serving me with court papers. She wouldn't tell who the people were that was trying to serve the papers. She gave me a phone number to call XXXX and a case # XXXX, to get more information. When I called the number the first time ... it said the number is not available. I called the next day and a lady answered. She told me that she was collecting for a loan from Quik Cash from 2014. She said that there was a loan for {$300.00} and if i set up payment today. She will check with the attorney to see if they have already filed a court order and if not they will stop it. She put me in hold, came back and said ... .they have not filed, so if you want to pay only the original balance..you will need to set payments on a credit or debit card today and if not, you will have to pay over {$1900.00} total. I asked if I could be sent some paperwork in writing to let me know more information about this debt. She said they don't have anything to send. I can only get a letter from them after payments are made to satisfy the debt. I had payday loans in the past, several years ago. I recall paying my loans off. If this is truly my debt, I should be able to request this information in writing, so I can confirm if this is something that I owe or not.

I took out a payday loan in 2010 from a company called quik cash in XXXX Kansas. When I began to struggle I could not pay it myself and filed chapter XXXX bankruptcy with an attorney. Since I filed they have called my references and told them they were going to send me to jail, that I had court documents that I needed to pick up at the courthouse, had outside agencies call and demand payment and today they tried to collect by pretending to be my local police department. I called the number on my caller I 'd back and got my local pd and asked for officer XXXX after the initial call was disconnected where this " officer XXXX '' said I was being brought up on Criminal charges for writing a bad check for a payday loan. The pd said there was no officer XXXX employeed through them and they did n't have a legal department cuz officer XXXX kept having me talk to the pd legal department. Nice lady at pd said it had to be a scam cuz this just is not how the pd does things and this officer did not exist.

I went to quik cash to get a pay day loan. They claim to have contacted me via mail. However I do not recall receiving any letters or emails. Before I know it I am being told by a family member that I am being summoned to court. The person who was serving me disclosed the information about the summons to the third party ( a family member ). A few days later the same person left the summons on the family members door step. The person who was trying to serve me apparently tried to give the summons to said family member. The family member refused to take the summons. This in itself is not the proper way to serve someone. So apparently quik cash will take you to court, and have you pay the court cost over a $ 300- {$400.00} payday loan. They will not try to settle with you, or ensure that you received previous letters, or report it to your credit. Quik cash will immediately summons you to court over a small lian and have you pay for it.

On XX/XX/XXXX I received a voicemail from XXXX XXXX saying that they ( XXXX XXXX ) would becoming to serve me notice with a uniformed officer. She stated that a company called QC Holdings was trying to collect {$2000.00} from me for a loan I didnt receive, I called the company and left a message for them to call me. I honestly do not know of this loan that this person said I got in XXXX. She called again today and said I better be home to receive the notice. She also called my daughter while she was at work and this is totally uncalled for being that they had already gotten ahold of me. I have spoken to someone at this office twice already. Then my ex-husband informs me that he was notified of all this. Please let me know what to do. I believe the number for the company is XXXX. I left a message. Have never done business with lendnation or QCholdings.Also the number left on the voicemail was XXXX.

A debt collector called and said that they are collecting from a pay day loan company that we owe money to. We informed them that it was paid off years ago and they said it was not. They said that if we give them our debt card number that they would only charge us for a smaller amount rather then the whole thing. We said no and that is when all XXXX broke loose. He told us that he was going to take our car, license, bank account, house, everything. He also gave names and phone numbers of everyone in my family and said that he was going to call all of them. He did and used different names and different debt reasons. He also said that he has had people fallow us and has surveillance of everything we have done over the last 4 years. At this time we hung up and as soon as we did he call my father, mother and sister. At that point I called FTC and they had me talk to the FDCPA

Lend Nation XXXX XXXX XXXX XXXX, XXXX XXXX, OK XXXX ( XXXX ) XXXX Account # XXXX The loan was refinanced on XX/XX/2022, in the approximate amount of {$920.00}. The loan should have been due in thirty days, but I was told it was due instead on my next pay day on the 3rd of the month. I was not given a copy of the loan agreement and there is none posted under my user profile on-line. I am unable to log in and make loan payments prior to the due date or on due date because the creditor manipulates on-line user account access. The creditor telephones me right after my failed attempts at logging on. I am told they prefer me to call in to make a payment. I often inquire about the change of monthly payment amounts, no on-line statements, and the balance isn't decreasing. 9 hundred and change unsure on the amount I have set up arrangements on for today did not go through since payday is today or tonight. Anyway I was called by structure settlement company first to my job telling me they spoke to my employer but willing to give me a chance to settle I asked not to call place of employment today i was working and unable to answer my phone I review voice mails 2 actually stating they reviewed reciting and payment came pack nsf well not true because I set up on my card. They he tells me they take those nsf payments very seriously in a very loud and threatening tone. I will pay my debt but I do not appreciate the threatening voicemails or leaving my personal info on a voicemail. Or calling my employer. If the want to garnish go ahead I will pride fax information for them to send in the right way! This is un acceptable

I have a {$700.00} loan from XXXX XXXX XXXX owned by QC Holdings. I took out the loan back in XXXX and have been paying {$220.00} a month due on the XXXX of every month. Last month they went into my bank account by electronic check. I called this month to make payment arrangements to pay full amount on XXXX/XXXX/17. I spoke with regional manager XXXX XXXX at # XXXX. I told him I was revoking authorization of the company going into my account. I was told that I could not do this as it was a requirement to get the " line of credit '' and I could not make arrangements and if I did not pay by XXXX/XXXX/17 on XXXX/XXXX/17 the company would send an electronic check to my bank. I contacted by bank who informed me that because it was not posted as ACH it may be hard for them to stop electronic check.

I called up the collection attorney that has my file asked them to let me set up a payment plan. they told me I have to send over my pay stub that they will take 20 % of my wages I told them I am a single mother of XXXX I can not afford to do that I can pay them XXXX on XX/XX/XXXX and XX/XX/XXXX. they said that is not acceptable they just will get a judgment against me and see how I like it when they garn my paycheck. I really do n't believe this is fair the debt turn form owing XXXX to XXXX. I was told that they do not care how many kids I have of who I have to pay in bills. they just need there money. Hello my name is XXXX XXXX and I wanted to file a complaint on national quick cash in XXXX Oklahoma. Because they sent my check over to my bank and it took the money out so then I waited today for it to go through and it did. So I call the loan company asked them if I bring in a bank statement and show them it went through so they said we 'll we ca n't take bank statements anymore. But last time it was n't a problem until now so now I have to wait a week to reborrow from them and they were just so rude about it over the phone. So I need some kind of exvice or something because this does n't seem right all other loan companys take bank statements but this one suspobly do n't do it now so this is making me so mad and stressed out.. THIS COMPANY IS PREDATORY! THE INTEREST RATE IS OVER 300 %! I SUBMITTED AN APPLICATION THAT WAS APPROVED PENDING VERIFICATION. I CALLED AND SPOKE WITH A REP AFTER SUBMITTING A PAYSTUB AND WAS ADVISED TO SEND ANOTHER XXXX. I PROVIDED ANOTHER REFERENCE ALSO. I SENT ANOTHER PAYSTUB AND CALLED BACK. THIS NEW REP ADVISED ME THEY HAVE MY DOCUMENTS BUT THE APPLICATION WAS CANCELED. THEY TRIED TO CONVINCE ME TO SUBMIT AN IN STORE APPLICATION. I DECIDED TO CALL THE STORE AND WAS TOLD THEY HAVE NOTHING TO DO WITH THE ONLINE APPLICATIONS. I ASKED TO BE REMOVED FROM THE MAILING LIST. SHORTLY AFTER THAT, I RECEIVED A DENIAL EMAIL. On XX/XX/2023 I got a loan for XXXX at QC Financial services, Inc d/b/a LendNation XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Mo XXXX XXXX XXXX XXXX XXXX I had a XXXX loan amount of XXXX that was added to the loan making it a total of XXXX on XX/XX/2023 I returned XXXX of the XXXX instead of refiguring the loan to the proper amount they held the XXXX in limbo until XX/XX/2023 then counted it as XXXX payment. I did not realize they did this until XX/XX/2023 when making my next payment I tryed to get them to correct it they would not so I payed off the loan on XX/XX/2023 my complaint is they charged me 326.99 % interest on XXXX for 30 days that I had given back to them

I am with XXXX. We are closing down the bank account to stop them from damaging us further. The name of the company is Quik Cash in XXXX Kansas. I made payment arrangements with them and was late on that arrangement.
