Prospect Mortgage was the mortgage company that we worked with to close on our new construction home. Throughout the build process my wife and I worked extensively with Prospect Mortgage and the home builder to expedite paperwork, timelines, and decisions so that there were no issues with the timeline. We were to close on the property XXXX XXXX, all parties ( Builder, Prospect Mortgage, wife and myself ) knew this date well in advance to that day. Around XXXX XXXX, Prospect Mortgage contacted us and stated that we would not be able to close on XXXX XXXX because the XXXX party Appraisal company that THEY hired ( and which we never had any contact with ), the appraiser made an error on the appraisal. At this time we provide this information to the builder and they stated as long as we closed before XXXX XXXX, we would not have to pay a late close fee. Prospect Mortgage, the builder, and my wife and I signed a contract to close on the property XXXX XXXX. During this period between XXXX XXXX - XXXX XXXX, we stayed in constant contact with the builder and Prospect Mortgage, due to state law we had no access to the Appraisal company. The Appraiser made multiple errors on the appraisal document, and also took vacation during the time we needed the finalized appraisal for us to close before XXXX XXXX. This delayed us into XXXX, and we were told by the builder that we had to pay a 1 % fee of the property, due to closing late. At this time the communication from Prospect Mortgage was that we were to take the appraiser or the appraisal company to court and have him legally pay the fees because it was their sole issues that caused my wife and I to close late. Within XXXX, Prospect Mortgage also had multiple people away from the office for various reasons and delayed our close even further. After we close and received the keys to the property, we contacted the appraiser. His statement was the following, " I am not at liberty to speak to you as you are not the client, please speak further to the client regarding your issue ''. We relayed this information to Prospect Mortgage and were then transferred to a person in the Compliance Resolution department. After we provided all the information to the this person over the course of a few days, their final statement was.. They represented the appraisal company and any and all communication regarding the appraisal company must be completed through Prospect Mortgage. If they felt that the appraisal company was wrong in any situation, that Prospect Mortgage would take full responsibility. Also that Prospect Mortgage is unable to provide us with any funds after the close because it was illegal, and that the party for us to battle with would be the builder, as they did not ask for the funds at closing. At this time, the builder is stating that they are able to put a lien on our property since it is stated within the contract that we my wife and I were not to close on time that we were to pay a 1 % fee. My wife and I want to file a compliant, as we worked extensively with all parties to complete all of our paperwork and deadlines well before the due dates. Prospect Mortgage who represents the XXXX party Appraisal company advised us that we were to take action again the appraisal company after the close, then after the close stated that we were on our own and that we should battle with the builder regarding the fee. Not only did they fail in completing to meet the deadline for the close, this occurred multiple times and caused plenty of stress between my wife and I. Now I am in a contract battle with the builder, that Prospect Mortgage has caused, and Prospect Mortgage conveniently stated its not their issue and stepped to the side for us to handle it on our own.

I as a consumer was not offered the opportunity to dispute because of Prospect Mortgage Company untimely response and their failure and incomplete response. The first untimely company response and end up no response are not acceptable. I 's like to reopen the CFPB Case # XXXX. Through numerous emails and discussions, we disclosed our credit history and financial situation to XXXX XXXX when we inquired about getting a mortgage on a property in XXXX, CO. He recommended looking in XXXX County. We fully disclosed and provided him with all the financial documents regarding our past bankruptcy and that we were attempting to have XXXX XXXX XXXX modify our mortgage and that we were delinquent on the mortgage. He pre-qualified us and sent numerous emails assuring us that we would get approved. XXXX XXXX stated that we would need to have an inspection and appraisal on the property in order to qualify for the mortgage. Because the property was a foreclosure property, in order to qualify for an FHA loan, XXXX XXXX told us that passing the inspection was very important. Because the property had not been maintained, he told us to hire someone to landscape the property in order to pass the FHA inspection by the tight deadline. To that end, we spent {$150.00} for landscaping on XX/XX/XXXX ; on XX/XX/XXXX we gave XXXX XXXX {$350.00} for the FHA inspection, and we provided our credit card number to XXXX XXXX to which he charged {$640.00} on XX/XX/XXXX for the appraisal of the property. We were told that the mortgage would be approved and that these costs were necessary to get the loan approved. We had also put down {$4000.00} in earnest money. On XX/XX/XXXX, XXXX XXXX sent an email stating that the mortgage did not get approved. I requested reimbursement for {$150.00} + {$350.00} + {$640.00} described above which had been spent as directed by XXXX XXXX as necessary expenses to get the loan approved. I spoke with XXXX XXXX and also sent emails. On the phone, XXXX XXXX stated he would reimburse me but that it would take some time. I also requested the return of earnest money at the same time. The earnest money was held for 120 days and finally returned XX/XX/XXXX. We were told by XXXX XXXX the realtor that the delay was due to XXXX XXXX, who was dishonest and told the seller that we had misrepresented our financial situation. XXXX XXXX was dishonest and tried to shift the blame to us. Given our bankruptcy and the financial stress, we could not afford to lose the earnest money and the costs incurred to get the loan which was ultimately denied. We were told that the sellers asked to use the appraisal and inspection reports when the sale did not go through because the loan was not approved. XXXX XXXX denied the sellers ' request to use the appraisal and inspection because it was Prospect Mortgage 's appraisal and inspection for which they had paid. However, XXXX XXXX and Prospect Mortgage never reimbursed us the costs [ {$150.00} + {$350.00} + {$640.00} ] to get the inspection and appraisal. Not surprisingly due to the stress, I suffered a XXXX on XX/XX/XXXX and was in the hospital ( XXXX, and XXXX ) until XX/XX/XXXX. My wife stayed with me every night at the hospitals until I was released. XXXX. We waited patiently for the earnest money ( which we really needed ) and received XX/XX/XXXX, but the reimbursement of the {$150.00} + {$350.00} + {$640.00} was never given to us despite assurances to us and representations to the seller by XXXX XXXX that they had paid for it.

Told I was eligible for a FHA loan only to be denied on the last day. I contact prospect mortgage to obtain a FHA rehab loan on a property I wanted to purchase at XXXX XXXX XXXX XXXX XXXX GA. I was assigned XXXX XXXX as my lender and he obtained a credit report sometime in or around late XXXX XXXX early XXXX XXXX. I was pre-approved and told I qualified for an FHA loan and was told the process involved, which included hiring an FHA consultant for this type of loan. The consultants fee is based on the size of the renovation project. In this case the FHA consultant XXXX XXXX XXXX XXXX was hired at a {$1000.00} fee for a project over XXXX in size. I was told that I needed to find ( and pay for the consultant ) find a general contractor, do a work write up from the contractor and then the consultant does the formal write-up. I also purchased an inspection during this process that cost {$250.00}. On XXXX XXXX I went under contract on the property and Prospect Mortgage was my lender. I was given a 30 day financing contingency by the seller, to get appraisals done and get approved for the loan. The lender XXXX XXXX XXXX XXXX held the work writeup for several weeks before submitting the appraisal causing us to have to file for last minute amendment to get get the loan approved. On the 30th day at approximately XXXX XXXX ( only a few hours left in our contigency ) XXXX calls me urgently and says " he was looking at my file finally '', I explain my concern of " finally '' considering he has had my file for several months at this point. He explains that my credit report ( that he has had since XXXX ) shows my current home is an FHA loan, which I did not know about due to purchasing it from XXXX XXXX in a neighborhood stabilization program. He explained that I was actually not eligible for an FHA loan, that I would only qualify for a conventional loan and would need to pay more down payment and closing costs. I proceeded to tell him this was unacceptable, to not only drop a " bomb '' on me of needing more money for closing and down payment but to make me go through the FHA process of hiring a consultant for {$1000.00} when I was n't eligible to begin with was ludicrous. In addition to all of this XXXX would not issue a formal denial loan denial letter so that we could immediately terminate the contract. He stopped responding to phone calls and emails and only responded sporadically ( and even now 2.5 weeks later I still have no denial letter ). I am seeking to recover my {$1000.00} FHA consultant fee that I paid, as well as the {$250.00} inspection, I also currently have not received my {$500.00} earnest money back from the seller due to XXXX lack of cooperation to give us a denial letter. I am very frustrated about the entire process, the time and energy I have invested in a project that I was never eligible for to begin with but was constantly told I was. I have paid almost XXXX out of pocket towards this loan that I was not eligible for and I would like Prospect Mortgage to re-pay me for their errors. I am seeking to recover the : {$1000.00} - FHA Consultant Fee {$250.00} - Inspection {$500.00} - Earnest Money due to cooperation for a denial letter All due to Prospect Mortgage 's ( XXXX XXXX 's ) mishandling of my loan application and mis-advertising the type of loan I am eligible for. Prospect Mortgage is responsible for me pursuing this loan over the course of the last 4 months and should be responsible for repayment.

We bought our first house and closed XXXX/XXXX/XXXX. We used a Loan Officer, XXXX XXXX, from Prospect Mortgage to do our loan for us. We had been in contact with this loan officer in XXXX but had put our home search on hold. A realtor friend had highly recommended her when we had started looking for a house a couple years ago. She had taught a first time homebuyers class and we were so impressed in her ability and willingness to explain and teach us that we sought her out again XX/XX/XXXX to work with her. In the beginning of our search she was great - always answering the phone, returning emails, after we lost out on a couple offers she became very difficult time getting a hold of and barely followed up on email or was willing to explain anything to us. We finally got an offer accepted and hoped it would get better rather than worse ... but it got worse. We had a very difficult time closing and had to keep filing for extensions because of the lender 's side but never really got much explanation. We were jerked around by Prospect and were left in the dark. We just found out that they never filed for our Mortgage Credit Certificate ( A program through Washington State Housing Finance Commission ) - which would have allowed us to save a lot through a tax credit ( XXXX ). The MCC application is supposed to be submitted by the Lender. We notarized the application and returned it to the Lender but it never got filed. Our biggest regret was not changing loan officers and companies once we started getting a bad feeling. But this was our first house and we did n't want to XXXX so we did everything we were told. We thought it was all behind us since we closed XX/XX/XXXX but now with taxes we wanted to follow up on the MCC since we had not received the certificate which we thought would come during tax document season. The lender 's response was to follow up with the state because she knew for sure she had filed everything and when I talked to the state they said it did n't look like they had a MCC application from us ( which we had sent to the loan officer twice which meant we had to have it notarized twice! Attached is a copy of the MCC application dated XXXX/XXXX/XXXX and a screenshot of the email in which the document was provided to the loan officer ) but would follow up with our loan officer to see where things went wrong. The next day XXXX emailed and said " Thank you for reaching out to them for clarification. I did hear from them and happy you got better clarification that I had received. I am forwarding this to my operations manager and area manager to figure out what to do and what happened. I wanted to make sure that I emailed you right away that I am working on it. '' And I responded that we had n't heard back and were still in the dark. She did n't respond so a week later I emailed her again and said that we have not heard from her or the state and she finally confessed that it was on them that they did n't turn in our certificate application. Our realtor that we worked with spoke very highly of her in the beginning and as time went on we could tell he was also confused by the lack of communication and frustrating extensions. It was nothing short of a nightmare experience for us!

We contacted Prospect Mortgage in XXXX for a renovation loan, in XXXX. We went through a significantly long process, whereby we were approved for that loan. However, the final papers revealed that Prospect wanted {$5000.00} to take out a {$20000.00} loan ( plus payments ). We opted to not take that loan, but the officer advised us that later we could get a " cash out refinance '' on the renovated home. The story is too long and convoluted to type here, but it took them 5 months to finally DENY the loan, even after we got pre-approval in the first month on the cash out refinance. The reason for Prospect 's troubles are twofold : First, they use clerks to process complicated and sensitive material - and the clerks are in over their head, do not have the proper training or resources. Some of them ca n't even spell or put together a professional email. Second, is the process, which is quite broken. Prospect uses other lending institutions and appears to just be a broker, although they claim to be " direct lenders. '' These underwriters have a very complex and detailed systematic system when looking through the papers, and will deny loans on items the clerks and " regional managers '' have no clue on. Our process was fraught with difficulty. XXXX loan officer quit. That loan officer, who was actually quite competent, quit in the middle. She did not put up our documents. We had to start over and requalify after many delays. The clerks were replaced often with people who asked for the same documents over and over, misspelled, and mishandled the documents, all being put up in email, which is not secure. Finally, in the XXXX hour the XXXX caught a mistake in their calculations and the loan was denied on our debt-to-income ratio, but we had correctly reported our debt and income months before. They wasted about XXXX hours of our time, and during this time, bills began piling up on our renovation - bills that should n't have needed to be paid if the pre-approval had gone through. If we had been DENIED in a timely manner, then we could have looked elsewhere for the funds. We also incurred " hard '' costs of survey and other items, based on their mistakes. Prospect Mortgage has very broken standard operating procedures. Most of their problems could be fixed by simply " templating '' normal requests for documents, instead of having people just send out " something '' until the underwriter gets it and denies it. Also, Prospects ' processes could remain broken for a long time, because they use different underwriters who want different things, and that is never KNOWN to the staff until it 's denied. They also have too many people touching a file. The mistake on ours was missed by several people. Prospect also does n't give their loan officers competent help. It shows careless disregard for the consumer, although they claim they care a lot. Months after it happened, I got a message that my home insurance had been cancelled. This happened because " XXXX '' had told them they were taking over the mortgage and putting the insurance in escrow! No one bothered to let them know the loan did n't go through and the consumer certainly does n't know to make that call. Very frustrating process.

I sold my house to a buyer using Prospect Mortgage in XXXX as their lender. Prospect Mortgage 's XXXX, XXXX, is the person responsible for handling the loan. My buyer was also planning to use an XXXX down payment assistance program to help pay the down payment. My buyer gave her offer on XX/XX/XXXX, and I accepted the same day. We scheduled close for XX/XX/XXXX ; on XX/XX/XXXX, we found out the buyer had something pop up on her credit report that would cause a delay in close because it would prevent her from using the down payment assistance. After a couple of weeks of trying to get what we were told was an erroneous charge off her credit record, they decided to instead forgo using the down payment assistance and she was going to use her IRA to get funds to close. Prospect Mortgage, her lender, scheduled close for XX/XX/XXXX. By Wednesday XX/XX/XXXX we still did not have clear to close and were told by the mortgage company that they were working on conditions with the underwriters but would try to have clear to close by XX/XX/XXXX. On XX/XX/XXXX, we didn ; t have clear to close yet, but somehow the lender had given the buyer the required disclosures and had her sign off them as a " workaround '' even though they were still working through conditions. On Monday, XX/XX/XXXX, the lender ( XXXX ) emailed myself and my agent and my buyers agent asking if the repairs requested on the appraisal had been completed so they could get a rush re-appraisal. No one had ever told me ( the seller ) that I had to have repairs done, no one ever told my agent either. Less than XXXX hours before we were scheduled to close, we find this out ... I scramble to get a XXXX out to my house, and have now paid {$300.00} to have the repairs made. Today is XX/XX/XXXX. The lender had close scheduled for XXXX, and did n't bother to cancel it or tell anyone it was n't happening. Fortunately my realtor had the foresight to do so ; we moved it to XX/XX/XXXX. XXXX did n't respond to any emails this morning to tell anyone what was happening. Around XXXX this afternoon we received an email from XXXX at XXXX stating that the re-appraisal could n't be ordered because he did n't have the FHA case information transferred from a previous buyer I had lost. I would love to know how he did n't know until the day we are supposed to close that he is missing critical information! This was XXXX of the first things he should have done when my buyer made her offer and I accepted - how it is possible that both did n't happen AND then they did n't notice until the close date blows my mind. I have no idea now if we can close on Friday, and I do n't think XXXX has any idea either. This transaction has been a disaster and I am about to lose the new home I purchased because the people at XXXX do not know how to run their business appropriately. XXXX families are adversely affected by the absolutely terrible handling of this process - it 's a domino transaction and all the people affected will not be spending XXXX in the new homes they had planned to.

I purchased a home in XXXX XXXX XXXXXXXX4.25 % 30 year through a lender that uses XXXX to sub-service their loans. In XXXX XXXX the XXXX reduced MIP by XXXX basis points. I did a FHA Streamline Refi in XXXX XXXX through the same lender ( MIP reduction plus new interest@3.25 % 30 year ) and Cenlar remained the sub-servicer. Later in XXXX I noticed something was weird with my loan breakdown screen in XXXX. Someone determined that the MIP was being incorrectly collected, issued me a refund check and for the past year, each month they collect too much from escrow and refund some back. Then, this month ( XXXX XXXX ) I receive a statement from XXXX saying that I now have a shortage amount in my Escrow account and that I owe them money ( over {$5000.00} ) within 30 days and my mortgage payment is going up staring XXXX XXXX. I have been calling Cenlar trying to work with them to figure it out, they transfer me to Lakeview Loan Sevicing 's Refi Department ( I have never heard of them but apparently they bought the loan from the original lender ) and Lakeview tells me they do n't know why XXXX transferred me to them as they only originate loans ( they also use XXXX to sub-service just like the original lender does ). Because I can see my old, paid off FHA purchase through my XXXX account as well as the newer refi through my cenlar account, I noticed that besides the MIP error they made, it looks like what they collected for escrow/taxes is much less on the refi than it is on the original purchase. XXXX has admitted on calls with me that there were errors at closing, but says its not their issue. I do n't believe that I should have to pay for errors that the lender/escrow company made. I believe that the loan amount should go up a small amount monthly ( from what I estimate, around {$200.00} to make the tax withholding the same as it was on the original purchase ( as taxes generally do n't change in a 6 month period ) ) to make sure there are enough funds in the escrow account to cover taxes, etc. But with errors by the lender/escrow company and my fully executed loan docs showing what I am currently paying as correct, I should n't have to pay the deficient balance, the lender or escrow that made the error should. Also, my original purchase loan amount was {$3200.00} ( never late ) - since the refi it was {$2400.00} ( never late ) now they are saying that it will go up to $ {$3200.00} staring in XXXX XXXX? How can that be correct? I reduced MIP and interest rate on the same ( if not less ) loan amount and now my payments are the same again? Someone needs to fix this. NOW. I have timelines, names, etc. of who I spoke to at XXXX. What is also interesting is that they say the last notes on the account are from a man, but I only spoke to XXXX women, so I am suspect that they are also changing things on their end because I have been on top of this and trying to get the responsible party for the numerous errors in disclosure/escorw/closing, etc to cover this and make it right.

CFPB Complaint - Prospect Mortgage XX/XX/XXXX Suspicion of double-selling and fraud I believe I closed a loan with Prospect Mortgage on XX/XX/XXXX because my note and Deed of Trust state Prospect Mortgage as the lender. I received a Notification of Transfer of Servicing from Prospect Mortgage in XX/XX/XXXX saying servicing was released from Prospect Mortgage on XX/XX/XXXX and that XXXX XXXX XXXX XXXX was the new servicer as of XX/XX/XXXX.

I also received a letter from XXXX XXXX stating that Prospect Mortgage sold my mortgage loan to XXXX XXXX XXXX on XX/XX/XXXX.

I contacted XXXX XXXX via telephone and asked who was the owner of my mortgage, and they stated XXXX XXXX was the owner of my mortgage.

I contacted XXXX XXXX via telephone and e-mail and requested the dates when they owned my loan, and to provide who they purchased my loan from.XX/XX/XXXX via e-mail, XXXX XXXX confirmed that the mortgage loan was transferred to them effective as of XX/XX/XXXX. I requested from XXXX XXXX multiple times via email, phone and written mail who transferred the mortgage loan to them in XXXX. They have concealed the name of the transferring or selling party.

I have contacted Prospect Mortgage multiple times requesting when did they sell the Principle and Interest of the mortgage loan. They have constantly referred to the date of XX/XX/XXXX as the date servicing and Principle and Interest were sold, and that they were sold to XXXX XXXX. However XXXX XXXX XXXX states the loan was sold on XX/XX/XXXX to XXXX XXXX XXXX, XXXX.

According to XXXX XXXX, the loan was sold to them ( they became the owner of the loan ) on XX/XX/XXXX, but according to XXXX XXXX they became the owner of the mortgage loan on XX/XX/XXXX.

My credit reports do not indicate any loan history at all with Prospect Mortgage. My credit report indicates a mortgage loan was opened with XXXX XXXX on XX/XX/XXXX Additionally, my credit report shows insufficient information which is hurting my credit score regarding the mortgage loan being reported to my credit file.

Based on the information that has been provided by XXXX XXXX, XXXX XXXX and Prospect Mortgage, it has lead me to the suspicion that my mortgage may have been double-sold, or Prospect Mortgage was never really my true lender. For example, XXXX XXXX claiming they acquired my mortgage loan on XX/XX/XXXX, and XXXX XXXX XXXX claiming that Prospect Mortgage sold the loan to XXXX XXXX XXXX on XX/XX/XXXX.

ADDITIONALLY, my account has never been credited for the Interest I paid from XX/XX/XXXX throughXX/XX/XXXX. Prospect Mortgage has stated that will just be on my HUD-1 Statement and will not appear on my billing statement, however the interest amount ( {$140.00} ) DOES appear on my first billing statement.

I demand Prospect Mortgage explain how the same mortgage loan can be owned by two separate parties at the same time?

My experience all started back in XXXX when I reached out to Prospect Mortgage to assist in a refinance. To make everything short, I was told to wait until XXXX to submit a refi as the particular lender they would use required a 1 year lapse since our purchase date. We went with their recommendations even though it usually only requires 6 months. We submitted everything in XXXX, and at that point were told that the 30 day close is now closer to 45-60 days to close. Again, we trusted them and went with it. Well come the 50th+ day I get a call saying that the lender will not approve the loan, even though I was told there would be NO issues what so ever. To say I was upset is being modest. So we changed a few things and resubmitted again to the same underwriter. I was told it would take about 30 days since they already had everything in our file, it was just a new loan #. Well here we are 50+ days out again and still have NOT closed! I have had no response from my loan officers for 3 + days. We received our initial closing disclosure on XXXX, which I have recently been informed that once you get those its 3 days until you can sign. Well its XXXX and I never heard anything on that closing statement, yet I received an updated one yesterday. Which now I have to wait another 3 days from this before we can sign and then another 3 days until it can fund. At this point I am hesitant that we will even sign anything this week. I was promised early last week that we would FOR SURE sign last week and fund this week ... clearly that has n't happened. I have had no communication from our loan officers in the recent days, and the communication in general is some of the worst. They have no regard to whats best for their consumer and no respect. From start to finish with this mortgage company it has been 8 months, and over 4 months since we submitted the refi!! My mom used them too recently with a horrible experience. I am questioning whether this is a legitimate refinance in my best interested and frankly need some answers on who dropped the ball and how many times it has happened now. I have reached out to the XXXX California rep recently but this does n't change what has happened in the past. I also feel they are hesitant to answer my questions on what went wrong and why, but I will do all my efforts to get to the bottom of this. I do n't think we will end up closing with them after all because I do n't trust it. They need to do something in best interest at this point and I will be going after them for monies spent on this loan. Also worth mentioning, the XXXX/XXXX/16 closing disclosure and the XXXX/XXXX/16 closing disclosure are EXACTLY the same, just different pro-rated dates because it didnt close the first time. Prospect did n't do their job clearly.

The Complainant engaged a lender, Prospect Mortgage, XXXX ( " Prospect '' ), to obtain financing on the purchase of a residence. The purpose of this complaint is to notify the CFPB that Prospect has refused to timely fund the Complainant 's loan pursuant to a Letter of Commitment. As a result, and as detailed below, Complainant is likely to incur significant financial damage. Complainant has reason to believe that Prospect does not have sufficient funds available to fund its loan commitments and/or engages in a practice of issuing more loan commitments than it is able to process. The Complainant engaged Prospect Mortgage, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, NMLS ID # XXXX, upon entering into a purchase agreement for a residence on or about XXXX XXXX, 2015. The Complainant hired Prospect based on their representations that they are XXXX of the nation 's leading residential lenders and are backed by {$5.00} XXXX in assets. At Prospect, the Complaint was assigned to loan officer XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX. ( XXXX ) XXXX, XXXX ( XXXX ) XXXX, Fax ( XXXX ) XXXX, Email : XXXXXXXXXXXX. On XXXX XXXX, 2015, Prospect Mortgage issued a Letter of Commitment that it would provide certain financing on or before XXXX XXXX, 2015. The Letter of Commitment is executed by XXXX XXXX. Despite the Complainant meeting all conditions under the Letter of Commitment, Prospect Mortgage is refusing to fund the loan by XXXX XXXX, 2015, because, according to XXXX XXXX, they are too " bogged down. '' Prospect informed the Complainant that they are unlikely to be able to fund the loan until XXXX XXXX, 2015. The purchase contract for the property has a closing date of on or before XXXX XXXX, 2015. Pursuant to the terms of the contract, the Complainant is obligated to close once he obtains a loan commitment. The contract further provides that the Complainant will lose his deposit funds of {$20000.00} in the event that he is unable to close by XXXX XXXX. Complainant will also incur the cost and inconvenience of having to locate and move into a rental property. As of the date of this complaint, the sellers have not agreed to extend the closing date. Complainant has informed Prospect of their legal obligation to provide funding pursuant to the terms of their loan commitment. Prospect has refused to acknowledge that their loan commitment obligates them to provide funding. More specifically, Prospect seems to be misinformed that they are permitted to delay funding of loans based on their own underwriting and investor delays. Prospect has admitted that they are not always able to timely fund their loans.

I used Prospect Mortgage in XXXX Alabama on a residential home purchase. I had a contract on a home contingent on sale of mine. I had to close on my house by the XXXX of XXXX, in order to accept contract for sale. Me and my real estate agent both told the loan officer at Prospect what our deadline was, they said they could meet it, and we sent them information to begin the process on XXXX XXXX. The closing date comes, and Prospect has n't funded my loan. This is after they confirmed to us we were good to close. Then they come back and say the closing attorney is n't approved. So the attorney fills out paperwork and submits it. Then they say that can take up to several days. The XXXX, still no closing. The XXXX, no closing, so I emailed their consumer advocate. This seemed to get the ball rolling, although I never sensed any sort of urgency on their part. We closed on tuesday, the XXXX. Because of the missed closing date, I had to rent XXXX storage units and move XXXX, once to storage and from storage to my new house. I had to stay in a motel for XXXX nights. I had to throw away food I had no way to keep since storage units do n't have electricity for refrigeration. I lost time away from work. The loan officer said to keep a record and submit my expenses for reimbursement. I did submit almost XXXX dollars worth. Never during the process did the branch manager call me to apologize, or give me any indication that he was even concerned or involved. The processor that did my loan was fired, and the loan officer resigned, because they ca n't seem to meet closing dates. The branch manager, XXXX, refuses to reimburse me. He did n't even apologize except through email after his manager brought it to his attention. He has lied to me in every dealing with him, and there is an almost identical complaint about XXXX and the local branch on the consumer affairs page. My agent says her mortgage guy could have closed me in 3 weeks, I went 40 days with prospect. I have done XXXX mortgages, never ever had XXXX this bad.We were told multiple times we were good to close through this process, only to be delayed again and again.

I obtained a loan thru XXXX XXXX of Prospect Mortgage XX/XX/XXXX. I was referred to XXXX XXXX from a loan officer at Prospect Mortgage in XXXX that I was preapproved with. The loan officer in XXXX was helping me to obtain Down payment assistance and other assistance with the government. I was referred to XXXX XXXX because I switched from XXXX to XXXX and she was supposed to be a loan officer that could help me to obtain all the assistance that the government had to help with the loan. When speaking to XXXX XXXX on the initial call she told me that she was able to offer help thru XXXX Housing and also forwarded me information to help with this. Throughout the loan process she told me multiple times that everything was in place with Indiana housing and the MCC. I was informed 2 weeks prior to closing and assured that everything was in place to get the MCC credit and my loan wa being delayed because of the process for the MCC. I called XXXX Housing to verify that what XXXX told me was true. When speaking to XXXX Housing they informed me that nothing was submittted. I informed XXXX via email. I was informed 1 week prior to closing that the MCC with XXXX Housing that I was told that was setup was not able to be obtained thru Prospect Mortgage because of the company not being approved for this. Because of this XXXX XXXX gave me XXXX options only a couple of days before closing. The first option was to pull out of the loan and not move forward with the house. The second option was to move forward with the loan without the MCC ( Mortgage Credit Certificate ). I chose the second option because Because there were multiple people involved but because I was n't informed until the end that they were n't approved to do t I lost out on a {$2000.00} credit for 30 years which totals {$60000.00}. If I had been informed by XXXX in a timely fashion that Prospect was n't approved for it, I would have went with a company that was.

I was dealing with a loan officer thru Prospect Mortgage. My loan officer left in the middle of loan process to go to another mortgage company. We had the inspections and appraisal completed. We were waiting on the sellers engineer report and either my work transfer paperwork or a job proposal letter. Once the engineers report came back XX/XX/XXXX, I was told that I had until XXXX XXXX to get either transfer paperwork or job proposal letter. The new loan officer called the sellers agent and told her he was denying my loan because I did not have either transfer or job proposal letter on XXXX XXXX or XXXX. He then calls me and gets all XXXX with me and informs me that he had a responsibility to sellers agent to let them know that I did not have what I needed so he was going to deny the loan. I begged him not to yet as I did not think it was being fair that he had given me until XXXX XXXX to produce one. I had a good possibility at that time on a job offer but did n't want to mislead anyone. He was aware though that I had had a few phone interviews and I was hoping to have an off before XXXX XXXX. Come to find out while he was threatening me to call the sellers agent, he had already called her prior to talking to me and she had relisted the home, they got another offer on it and accepted it. They never cancelled the contract in which I had with them. I immediately called my agent. I did in fact get a job proposal letter by Monday XXXX XXXX, 2016 I had the job offer and sent it immediately to the loan officer. He said it was too late and that he was denying my loan. That was totally wrong since he had specifically given me until XXXX XXXX to get the info to him! He and my agent had a conversation concerning the fact that I was never given a denial letter, nor did I get a cancellation notice from the sellers agent. When she asked him if he was giving me a denial letter he did not respond.

This loan was a disaster from start to finish. The goal was to refinance in order to lower the rate on my first mortgage and increase the line on my HELOC. I made this very clear from the start of the process. The process was started on XXXX XXXX, 2015 with a closing date near the end of XXXX. The first thing to go wrong was that the closing date was repeatedly pushed back until XXXX XXXX, 2015. The delay in closing cost me roughly {$150.00}, which is the decrease in the payment which would have occurred in XXXX but since we closed late, wo n't occur until XXXX. After closing the loan funded several days late resulting in an additional {$190.00} in interest and fees paid on the original mortgages as well as a late payment on my HELOC. A revised HUD was drawn up and executed without my knowledge or consent, and the HUD that I had signed was disregarded. I 'm not sure of the legality of this maneuver, but it is definitely not good practice. Throughout the loan process, I was assured by the loan officer that if I refinanced my second mortgage, I would be able to increase the line on the HELOC with little to no fees if I refinanced the second as opposed to subordinating it. The cost of refinancing the second mortgage was XXXX. Once we closed, I was told that the fees to increase my HELOC would be {$1000.00} to XXXX. The only other option that was presented to me was to transfer my HELOC from XXXX to XXXX XXXX XXXX XXXX. I was not told what the fees would be on this, but the terms would increase my monthly payment by over 150 % from about {$200.00} a month to over XXXX. When it was all said and done, this refinance cost approximately {$960.00} more than it should have and did not accomplish half of what it should have. In order to accomplish all of the necessary goals, the loan will cost {$2400.00} more than it should have.

I obtained a XXXX Mortgage from Prospect Mortgage in XXXX thatincluded 3 months of mortgage payments. Prospect transferred my loanto XXXX who did not apply those payments so that when I made mypayment in XX/XX/XXXX they returned the payment saying I wasin default for not paying the first 3 months. I called Prospect and was toldthey no longer service my loan and referred me back to XXXX. As the loan was a gut rehab XXXX loan with $ XXXX towardsthe work to be completed I could not live in the home until the house wasat least habitable ( with working toilet, kitchen and bedroom ). Prospectdue to XXXX 's negligence in handling my payments was informed ofthe forced delinquency and then refused to pay my contractors. So Ithen had to come out of pocket to pay them for the work they had done. XXXX stated they could n't give me a Modification because they didn'tfind evidence of my first 4 contractual payments which would have beenthe case had they appropriately applied my 3 month mortgage escrowand my XX/XX/XXXX payment which they returned. When evidence of thenegligence on XXXX 's part was presented their next argument wasthat I did n't live in the home. Which did not have any working plumbingnor was habitable due to their incorrect classification of me as a delinquentborrower. Prospect Mortgage has not released any money since XX/XX/XXXXfor work repairs. I need to have my home complete before the end of yearas I need to put in my boiler for the winter.

In XX/XX/XXXX of 2015, I received a preapproval from Prospect Mortgage as I hoped to purchase a single family home to live in. I complied with everything asked of me and provided all necessary documentation as requested. I was ready to close on the house when the loan officer I had been working on sent me additional questions to answer. One of these questions was- would my boyfriend be moving into the home with me? I found that question to be rude, disrespectful, and even a form of XXXX profiling. As a XXXX XXXX XXXX XXXX woman who is a professional, why would they assume that my moral standards were such that I would be shacking up with a boyfriend in my home? Furthermore, why would it even matter if I was pre-approved based on my income and credit. Ultimately, the loan was denied and even my loan officer indicated that he could not understand why since I met all of the criteria. He indicated that the individual in charge of making that final decision, XXXX XXXX would n't let the loan go through although there was no good reason. I lost money in this after having paid for attorney fees and inspections and even some minor reparations to the property so that it would pass the fha inspection. Asking if my boyfriend is going to move in with me when I had never discussed or made mention of a boyfriend seems demeaning and should be considered an illegal question in the mortgage lending industry.

I applied for a IRRRL loan through CapWest Mortgage ( - A division of Prospect Mortgage located on XXXX XXXX XXXX XXXX XXXX, CA XXXX, Branch XXXX # : XXXX ) on XX/XX/2016. The loan officer convinced me that I would benefit from a Cash out Refinance to cover some of my debts instead of the IRRRL or streamline loan for which I had been approved on the spot based on my credit score. An appraisal was ordered for which i paid. I was told the appraisal amount and advised to sign the Acknowledgment of Receipt of Appraisal Report quickly so that they loan can be locked. This is not only strong arm tactics but I think the company owes me a copy of the appraisal report. Secondly, the company dragged my application from XX/XX/XXXX when I first contacted them till XXXX when my application was first submitted to their underwriters. In today 's market I can no longer get the kind of interest rates for which I was qualified ( 2.9 % ) XX/XX/2016. If my application was processed efficiently and denied accordingly, I could have had enough time to apply for a better rate with some other company before the rates went up. Thirdly, only XXXX credit agency was consulted before the underwriters rejected my application for a high debt to income ratio.

In XXXX 2015 I was shopping for my XXXX mortgage. I was negotiating with several lenders. XXXX XXXX, then with Prospect Mortgage, matched an offer from another lender - 20 % down and 3.125 % rate. When I started reviewing the initial paperwork, the numbers looked incorrect. I mentioned to XXXX that I did n't expect to have to bring as much cash to close as the paperwork suggested. XXXX reiterated over and over that lenders are required to overestimate, that the actual amount at closing was going to be significantly less. I continued to express concern with the numbers, but she was incessant that I sign - I would see later, she said, that the amounts went down. Being a first time mortgage client, I ultimately gave in and signed. I later discovered that XXXX was quoting me numbers with 25 % down rather than 20 %. By this point, I had no choice but to stick with this lender ( otherwise I would have lost the contract on the property ). In order to receive a loan with only 20 % down, I was forced into a loan with a higher rate.

The in-house counsel member XXXX XXXX XXXX committed perjury in her email by stating that my mortgage loan was not sold to the secondary market. XXXX XXXX is the counselor for XXXX who is a subservicer for my original lender Prospect Mortgage, LLC. Moreover, the manager for Prospect Mortgage, LLC refuses to send me a letter stating that my mortgage loan was sold to the secondary market via XXXX XXXX. When mortgages are bundled up in contracts and transferred to XXXX XXXX, the mortgages are sold to other investors as stock certificates to the secondary market. The borrower promissory note is converted over to stock certificates when there pooled together with other schedule loans. I was able to obtain this information from the Securities Exchange Commissions. In closing, I am currently seeking legal counsel because I have a lawful right to know who actually owns my mortgage.

As a XXXX XXXX combat veteran ( XXXX ), I am informed by VA that the terms of my VA mortgage entitle me to a refund of the funding fee the mortgage provider received when I took out the loan. Prospect Mortgage was that provider, even though without my knowledge they sold my mortgage to XXXX XXXX six months after I signed it, resulting in other issues with XXXX XXXX Home Mortgage. Now, Prospect Mortgage, despite numerous phone calls and requests for update, as well as an in-person meeting and referrals to VA contacts, has not returned this funding fee to me. This issue is separate from my issue with XXXX XXXX Home Mortgage, about which I have also complained to CFPB as a final resort. Poor service they have told me 3 times when I was going to close, right before I close they call and tell me to send documents that I have already sent or tell me something additional I need to send. The ladies who work there are rude and disorganized. My loan was cleared to close and my mortgage company sent me mydisclosuress. I looked everything over, signed them and returned them. 3 days later I get an email with another set of disclosures with about $ XXXX more in loan fees. They claimed I changed the loan terms to cash out and raised ltv. Nothing changed on our end from the original disclosures I signed numerically to the second set they sent with the fees doubled. I was finally told someone made a mistake on the rate lock and I 'm paying for it. I was forced to close the loan as it was for permanent financing and I absolutely had to close.
