Hello, my name is XXXX XXXX and I had a judgement filed against me back on XX/XX/XXXX for the XXXX XXXX case # XXXX. I was garnished in XX/XX/XXXX from The Collection Company/Judgement Recovery my employer at that time was XXXX stating I owed {$3300.00} garnishment # XXXX. The garnishment took place right away without me being served or even notified by mail from my employer or the collection company. I filed an exemption to have only 10 % come out of my paycheck after the first 25 % was taken out as a surprise when I received my paycheck. The 10 % was granted right away. This company collected {$800.00} in total and then the garnishment just stopped. Even though I was still working with the same company for some odd reason they just stop collecting all together. My thoughts were maybe they were satisfied with the amount I paid and that was it. Well in XX/XX/XXXX I moved to XXXX XXXX and I attempted to get an apartment in XXXX but the XXXX XXXX appeared on my credit report as not satisfied or paid. I attempted to reach out to Judgement Recovery to see what options I had to have this show paid and get it removed from my credit however I was never able to reach anyone and I never received return calls after leaving several messages. I proceeded to just move into a house where they overlooked that eviction since I had good rental history since then. I later in XX/XX/XXXX/XX/XX/XXXX started looking more into my credit and XXXX XXXX XXXX was completely removed from my credit. As of the end of XX/XX/XXXX around XX/XX/XXXX I received a letter in the mail dated XX/XX/XXXX from Judgement Recovery ( which I have attached ) stating I owe {$4000.00} and to contact them within 30 days to make arrangements. On XX/XX/XXXX ( not yet 30 days from the date I received the letter ) I woke up to a check in the amount of {$700.00} something odd dollars which I knew could not be correct as my checks are normally at minimum {$1100.00}. I went to work ( XXXX ) and immediately contacted my supervisor who adv that is not correct ( as he approved me for 80 hours at the rate of {$14.00} ) and to contact my payroll department. I did so and they advised I had a garnishment and provided me with a phone number of ( XXXX ) XXXX. I immediately reached out and got a voicemail stating that I reached Judgement Recovery. I left a voicemail asking to receive a call back this is at about XXXX Eastern Standard Time . ( I have also attached records of my outgoing calls to Judgement Recovery ). Seeing that this was a XXXX phone number I immediately thought to go to XXXX and see if I can find any info there while waiting for a return phone call. On XXXX I found there were 3 garnishment # 'S under this same exact case #. The 1st garnishment # XXXX dated XX/XX/XXXX stating the starting balance was {$3300.00} and the ending balance was {$2500.00}. The second garnishment # XXXX dated XX/XX/XXXX stated I had a balance of {$2700.00} and showed the exact same ending balance. The current garnishment # XXXX stating balance {$4000.00}. At this point I was very confused on ( 1 ) why this collection agency stopped collecting the first time back in XX/XX/XXXX. ( 2 ) Why the amounts keep changing on what I owed. ( 3 ) Where did the {$800.00} I already paid back in XX/XX/XXXX go? ( 4 ) Why are they attempting to collect on a debt that was removed from my credit? ( 5 ) Why did they wait 5 years to pick this back up when I 've been working the entire time I 've been in XXXX. I continued to call Judgement Recovery throughout my work day and just like back in XX/XX/XXXX I kept getting the voicemail with no return calls. I decided to call the attorneys office that shows on the case XXXX XXXX to see if they were able to assist me with anything and I 1st spoke to XXXX who advised to let her try to reach Judgement Recovery maybe they will answer if they see it 's her. She placed me on a hold and came back to state she received a voicemail as well. She stated she had XXXX 's cell number ( the owner of this collection company ) she could n't give it to me but she can call her to let her know I was reaching out. She placed me on another hold and came back stating XXXX is on vacation but her husband XXXX should be in the office and if I leave a message he should call back. She also advised I would need to be kinda stern in the message. I tried contacting them again and got the voicemail. At that time I remembered getting the exemption back in XXXX XXXX for the 10 % rule and decided to contact the clerks office to figure out how to go about doing that again. I spoke to a clerk who advised me to go to XXXX and print the form off and fax it in and they will send it to my employer. The only thing is when I printed the form it said I had to reside in XXXX which I do not. I can not apply for an exemption in XXXX because this was not filed in XXXX. So after so much stress and needing to find records of what I paid to this company previously I had to leave work early to go home. I contacted the attorneys office 1 more time and they stated there is nothing they could do and after pouring my heart out to the attorneys office I surprisingly got a call back from XXXX at Judgement Recovery around XXXX. I advised XXXX I had been calling since XXXX and he asked in a very nasty tone if I had been leaving messages which told me he did n't check the machine at all but maybe someone from XXXX XXXX got in contact with him. XXXX advised me that in XX/XX/XXXX that the principle amount owed was {$3300.00} and that I paid {$800.00} on garnishment # XXXX. He also advised that it was closed ( never gave me a reason why it was closed ) and that a new garnishment was opened and nothing was collected on it ( garnishment # XXXX ). I asked XXXX what happened to the money I paid in XX/XX/XXXX and he replied that was for garnishment # XXXX and this is a new garnishment. I proceeded to ask if there were any other arrangements I could make or how I can get a exemption as I can not afford 25 % living in XXXX as a single mom of XXXX kids. XXXX advised he would contact someone and give me a call back on XX/XX/XXXX in which he never did. This company keeps going back, stopping garnishments, creating new garnishments and then disregarding the money that I 'm paying. This has been going on since XX/XX/XXXX and I 'm not understanding how this is legal to keep doing this. I 'm not for sure if the attorneys office and the collection agency are doing something fraudulent to keep getting these different judgements on the same case but I need some help investigating what my rights are as a consumer. I feel once they started the 1st garnishment in XX/XX/XXXX they should have finished it. At this point I 'll be paying on a {$3000.00} debt for the rest of my life. on XX/XX/XXXX, and XX/XX/XXXX, I sent certified letters to XXXX XXXX to the mailing address listed on my credit report, in an attempt to pay a debt that was listed on my credit report in exchange for validation of the debt in the form of a signed contract or the original instrument of debt. I received no response from the company. The company did not inform me the alleged debt had been sold or transferred. I submitted a dispute with the credit bureaus, which did not result in a change of reporting. Although XXXX XXXX did not respond to me, the company continued to verify with the XXXX major credit bureaus. I was dissatisfied with the investigation of the credit bureaus, therefore, on XX/XX/XXXX, I submitted a complaint with cfpb ( Complaint numbers XXXX : XXXX, XXXX : XXXX ), regarding the reporting of the unverified debt for XXXX XXXX. After submitting a complaint with cfpb the following happened. XXXX. XX/XX/XXXX XXXX XXXX XXXX XXXX filed suit against me in the Circuit XXXX XXXX XXXX XXXX XXXX XXXX for the unverified debt for which I have requested a copy of the contract. XXXX. I reached out to the company, and they did not inform me the alleged debt had been sold/transferred. XXXX. The new owners of the alleged debt did not contact me to inform me they were in possession of the debt to allow an opportunity for payment. XXXX. XX/XX/XXXX - Upon investigation by XXXX, XXXX XXXX was unable to verify the debt, and was removed from my XXXX credit report. XXXX. XXXX XXXX continues to report unverified account information to XXXX and XXXX. XXXX. XX/XX/XXXX - I learned the alleged debt had been transferred/sold to XXXX. XXXX XXXX ( XXXX XXXX XXXX ) because a process server left the court documents between the bars of my storm door. The documents were not covered, publicly revealing my personal information to the public ; violating XXXX XXXX XXXX XXXXXXXX XXXX ( The video of the processor leaving documents in the door has been attached ), in addition to XXXX rules regarding debt collection. After further research on the company, I have found that the company routinely purchases junk debt, and sues consumers without verify any information about the debt. In addition, the company seems to attach a general contract document as proof of the debt without endorsements or signatures of the person for which they are suing. XXXX. XXXX. -I has not attempted to contact me regarding the unverified debt. They are not listed on my credit report. I have not received a debt validation letter via mail or any other process of notification. I haven't received any phone calls from the company. There is no way to get into contact with them, yet the company has filed a suit against me the very same day that I submitted a cfpb complaint for the reporting of the unverified debt to credit bureaus. That seems extremely suspicious. This is not the first time for which XXXX-I has violated the Federal Debt Collection Practices Act. They were sued for doing so in XXXX XXXX XXXX XXXX XXXX in the XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX.
