I do not have an " open account '' with the creditor they represent, XXXX XXXX, formerly XXXX XXXX. Using the common definition of an " open account '' as one not being closed and active, or the legal, banking definition of an " open account '', a revolving account, such as a loan/credit card, this agency is communicating to me false, deceptive, and misleading information. Under the FDCPA, reporting to the credit bureaus is a communication to me, the consumer. XXXX v. XXXX XXXX , XXXX, XXXX XXXX XXXX. XXXX XXXX ( XXXX. XXXX ) ( " Reporting to credit bureaus is a communication within the FDCPA ) ) Banks v. XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX XXXX. XXXX XXXX, XXXX ) ( " rejecting the argument that reporting to the credit bureau was not a communication to the consumer and was not debt collection activity '' ) ) XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX, XXXX ) ( " The court has learned through its work on countless FDCPA cases that threatening to report and reporting debts to CRAs is XXXX of the most commonly-used arrows in the debt collector 's quiver '' ) ) Professional Credit Management alleges and communicates to me, via my credit reports, that I made a " last payment '' to their client on XXXX XXXX, XXXX, although they do not state the payment amount ( see attachment ). Along with having no " open account '' with either bank, nor have I ever made the alleged payment which PCM is illegally reporting and communicating to me via my credit reports. This agency has been reporting against me for over two years, and has refused to remove their illegal reporting. I recently filed a complaint with your agency, because I owe no money to the bank which PCM alleges. PCM only respond with their own internal document that stated nothing more than I owe what they claim, yet provided no actual independent admissible, in a court of law, proof. The did not state the name of the party verifying the information. This agency is a repeat violator of the FDCPA against me, and even paid a settlement to me two years ago, for their violations against me. They claimed I owed another debt which I clearly did not owe. They could provide no proof of the debt, and even illegally disclosed to a third party that another party owed a debt. Myself and this other party were forced to retain counsel ( XXXX XXXX, XXXX ). It was only after an attorney forced them to comply with the law, did they finally comply with the law. Currently, they have violated the FCRA and FDCPA for over two years against me, with its current illegal reporting. I respectfully ask that your agency demand that PCM provide to you proof of the alleged payment made on this alleged account on the date PCM claims I made such payment. PCM 's conduct, as it did two years ago against me, violates the FDCPA, FCRA, the Arkansas Fair Debt Collection Practices Act, and the Arkansas Deceptive Trade Practices Act. Their conduct is also perilously close to civil RICO violations, as they have been put on notice numerous times their conduct is illegal, yet they continue to target me. I can only assume it 's in retaliation for bringing them to justice the last time they violated the law against me. A literally false statement violates the FDCPA as a matter of law. See, XXXX v. XXXX, XXXX XXXX XXXX, XXXX ( XXXX XXXX ). PCM 's statements on my credit reports are false, and this violates the law. PCM 's disagreement with the law does not trump the law. This is a repeat FDCPA violator, and if they dispute this, I can provide your agency with proof of their prior violations and proof they were forced to pay FDCPA damages. In approx. two weeks I am filing a private action against PCM and XXXX XXXX, which I will forward to you also. I can also provide to you contact information of others PCM was forced to pay FDCPA settlements for clear violations of the Act.

On XX/XX/XXXX I pull my credit report and found out that PROFESSIONAL CREDIT MANAGEMENT/ ORIGINAL CREDITOR : XXXX XXXX / ACCOUNT # XXXX & XXXX they said I owed them. I am filing this complaint against them for non-compliance violations. I wrote them a letter of validation on XX/XX/XXXX certified mail with return receipt ( I have attach of copy of that letter ). The PROFESSIONAL CREDIT MANAGEMENT has the following non-compliance violations : 1 ) They have no copy of a signed contract where I allegedly agreed to pay the charges. 2 ) The medical bill reveals personal medical information about me. ( This is violation HIPAA- HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF XX/XX/XXXX ), rules prohibit disclosing my individual 's protected health information unless you specifically authorized them to. 3 ) Creditor is reporting history inaccurately such as last date reported and last activity dates are all wrong : The case US Court of Appeals, XXXX XXXX, No. XXXX, XXXX XXXX XXXX XXXX. This defamation and causing me financial injury. The fine extent of damages incurred by the wronged party as deemed by the court. 4 ) Collection agencies " Re-Age '' by reporting the date of last activity instead of the date of the first delinquency. 5 ) Collection Agency, has not validated my debt and they are still continue to report to the credit bureaus. When I retrieved a copy of my credit report I noticed this inaccuracy and immediately sent a letter to the credit bureaus. The bureaus advised that Professional Credit had verified the account. To that end, I communicated in writing to Professional Credit. Professional Credit had indeed inserted a derogatory entry on my credit report without providing a dunning letter or any correspondence on the alleged debt that would have informed me that they were attempting to collect on the alleged debt. My credit reports reflect Professional Credit opened the account in XX/XX/XXXX and began reporting in XX/XX/XXXX. This is illegal p er Affordable Care Act ( ACA ). Per ACA, medical bills are not to be reported before six months. ( See credit reports attached where they blatantly violated this law. Additionally, I received no correspondence from them advising me that they were attempting to collect a debt thus granting me my consumer right to dispute the validity of their claim -- -- another blatant violation. In my first letter to Professional Credit, I specifically requested that they provide : An agreement that states your authority to collect on this alleged debt ; Agreement with signature of the alleged debtor wherein he/she agreed to pay the creditor Alleged account number Date this alleged debt became payable Original delinquency date Verification that this debt was assigned or sold to collector Complete accounting of alleged debt Name and address of the bonding agent for collection agency in case legal action becomes necessary. Professional Credit provided a response ( see attached ), that in no form, validated the inaccurate information they continue to report. This letter is a mere stall tactic. In response to this stall tactic letter, I responded in writing ( see attached ), requesting Professional Credit to provide the financial responsibility page for this alleged debt. To date, I have not received a response. Professional Credit has yet to respond. If they are indeed alleging I owe this debt, then they should have a copy of the financial responsibility page. Both of my disputes to Professional Credit have been very specific. I challenged aspects of the FCRA and FDCPA. I sought validation and not verification. Additionally, the law provides that when I first disputed this entry with the credit bureaus and the bureaus made contact with them, the account was technically supposed to be updated to disputed at that time and not when I followed up to direct dispute with them. As you can see XXXX does not reflect the account being in dispute. Another violation. Professional Credit did not provide any documents that bore my signature nor did they provide the original delinquency date nor a complete accounting of the alleged debt. Professional Credit must immediately delete this erroneous entry from all of my credit reports. If they indeed are alleging that I owe them for an alleged medical bill, why did they not provide a copy of the ledger to reflect any payments on this alleged account? Why did they not provide copies of correspondence they have sent? Why did they not provide any documentation to substantiate the alleged amount? This entry lacks veracity. Delete this entry immediately and provide me a copy of the correspondence sent to the bureaus to direct them to remove this erroneous entry.

Professional Credit Management continues to blatantly report inaccurate, unverifiable entry ( s ) on my credit reports ( see attached ). The alleged entries reflect the original creditor is XXXX XXXX XXXX XXXX. The entry on my reports reflect that Professional Credit reported this entry in XX/XX/2020 on my credit report, yet they did not provide any communication to me. No dunning letter was received from this company. I have never did any business with this company, nor have I ever heard of the company. I have attempted on numerous occasions to gain clarity and insight on these erroneous entries. My first disputes were with each of the credit bureaus and the responses provided from each bureau reflected that the entry was verified by Professional Credit ( see attached ). To that end, I sent a certified letter to this company. The tracking of this receipt reflects that they did indeed receive the dispute nor was the mail returned. To date, this company has not responded to my dispute of the validity of the entries they are continuing to negligently report. This company has had over 6 months to respond to me, yet they have not. In my first dispute letter to them, I requested : An agreement that states their authority to collect on this alleged debt ; Agreement with signature of the alleged debtor wherein he/she agreed to pay the creditor, Alleged account number, Date this alleged debt became payable Original delinquency date, Verification that this debt was assigned or sold to collector Complete accounting of alleged debt, and Name and address of the bonding agent for collection agency in case legal action becomes necessary. THEY DID NOT RESPOND. In my second request, given I never received any notification from them with regard to the first dispute, I requested they provide a copy of the financial responsibility page, provide a copy of my signature with the alleged provider of service to release my medical information to them and cease any credit bureau reporting until the debt had been validated by me. They DID NOT. Consumer law provides that the creditor is expected to respond to your claim within 30 to 45 days and to inform you of the results of its investigation within five business days. Prior to reporting any alleged medical entry the XXXX provides a collection company must wait 6 months. Professional Credit Management did not and to date has not provided a copy of any documentation to support they provided the allotted amount of time to pass per law prior to inserting this derogatory, inaccurate entry on my credit reports. It is obvious that Professional Credit Management has no intent to honor the law nor respond to my previous disputes ; therefore, in the absence of them not responding with any documentation to validate the alleged debt, they must cease collections, return this debt to the original owner since they are attempting to collect on behalf of another company, and remove this entry from my credit report immediately. Lastly, why are they continuing to report a paid account? This is misleading and yet another inaccuracy of this company. If the debt is paid, why are they continuing to report this information as if they are collecting on it? This is further diminishing my creditworthiness.

This complaint is regarding an account that was added to my credit report ( all 3 bureaus ) on or about XX/XX/XXXX. Company name XXXX XXXX. As a victim of identify theft, I followed the procedures by promptly filing a dispute with all three credit bureaus, as well as sending a debt validation letter directly to XXXX XXXX requesting validation of the debt. I received no response. On or about XX/XX/XXXX, the collection was deleted from my credit reports. On today, XX/XX/XXXX, I received an alert from XXXX that my credit score had dropped XXXX points. To my dismay, the collection account XXXX XXXX had been re-added to my credit report. I thought that once removed, debt could not be re-added. I immediately contacted XXXX to inquire about this, and was told that they only report what the company tells them to, but that I could dispute the item again with them, and also directly to the company. I filed another dispute. I have in my possession a police report & identity theft report. I also added a fraud alert and credit freeze to my credit file, when I realized my identity had been used fraudulently. XXXX has copies of these reports. This collection does not belong to me. I have no knowledge of this company nor the company from which they purchased the debt. ( I was told today by XXXX the debt was originally from XXXX XXXX XXXX XXXX ). I have never had an account or affiliation with XXXX XXXX. I am requesting that this company be investigated, and that the collection be promptly removed from my credit report ( XXXX ), and this company permanently blocked from future reporting as this has been a complete nightmare for me and my family, and has taken a tremendous toll on me XXXX, and also taken a lot of time and effort to attempt to resolve. It has also caused me stress and frustration. I am filing this complaint for assistance with this matter, as I am at my wits end. My next step is to contact my Attorney General to report the matter, with the hope that it can end and my credit report be restored to reflect accurate information. Additionally, there is another inaccurate collection reporting to my XXXX credit file. Professional Credit Management. I have disputed this account multiple times since XXXX as a result of identity theft. I was successful at getting the item removed from both XXXX and XXXX, but not XXXX. Recently, I attempted to dispute it again ( XX/XX/XXXX ) with XXXX, but was told that since it has been disputed numerous times, I could not file a dispute with the credit bureau, only the debt collector directly. I contacted Professional Credit Management by mail in XX/XX/XXXX, requesting validation of the debt, but received a letter stating that they have sent me information regarding the debt in the past, and that they will no longer send further information. I have never received a phone call or any correspondence from this company, and have no knowledge of this debt. As a consumer, I feel that all XXXX credit reports should reflect both accurate and consistent information. With this collection on my XXXX report, that is not the case.

I never received a single bill from this company ( Professional Credit Management ), nor did I receive a voicemail message from this company that identified themselves, made a claim upon the debt, and asked for a return phone call in accordance with 15 U.S.C. $ {$1600.00}, or to otherwise notify me that I had a debt with this company and/or to make or set up payment arrangements. Then, i received a summons and complaint in the district court, to sue me for the balance owed from their attorney XXXX XXXX XXXX. This was the first communication I received from this company, which is also a violation of FDCPA 15 USC $ {$1600.00}. I filed a response in the district court, including objections and a brief citing Arkansas Supreme Court ruling on the matter, interest and attorneys fees, in which this company filed arguments that directly contradicted the FDCPA, in which under $ section XXXX, a debt collector under FDCPA is not entitled to attorneys fees or interest other than provided from in the original contract, to which this company was seeking above both allowed by Arkansas and federal law.. This company and/or their lawyer cited Arkansas law regarding " prejudgment interest and fees '', however, it neglected to accept that the original contract and debt provided for " no interest '' and " no fees '', which the company suing me was in violation of the Federal Debt and Collections Practices Act. I filed motion to produce documents and interrogatory response regarding this matter, in which legal counsel of this company refused to provide, and in which this is also a debt collection agency, which is also owned by the attorney, which is also a violation of the due process clause of the Constitution and the view of a judicial hearing in which when a claim is made, a defendant is entitled to " through due process '' adverse evidence and/or interrogatory response and production of documents, to which the plaintiff ( in this case XXXX and XXXX XXXX XXXX ) are required to provide. All of these are direct violations of the FDCPA, in which : a. ) I never received a bill or communication from the company, in which the first thing I received was a complaint to sue me, b. ) the company ( PCM ) and their attorney was seeking attorneys fees in violation of the FDCPA. c. ) The company PCM and their attorney was seeking interest above the contract and state law and federal law under 15 U.S.C. $ {$1600.00}, which is another violation of the federal debt and collection practices act. In which this matter needs to be investigated as unethical and violations of the FDCPA have occurred in this matter, then there is no telling how many other violations of citizens rights, that this company and their lawyer have committed. Whereas if it has happened once, then it is probably a regular occuring violation, which takes advantage of the consumer.

First, I am a XXXX Veteran. While in the care of the XXXX XXXXXXXX XXXX in XXXX TN for XXXX XXXX, they required me to perform XXXX on XXXX XXXX XXXX at XXXX XXXX in XXXX TN. The imaging was approved by the XXXX XXXX XXXX XXXX for payment thru the XXXX. The XXXX XXXX would not have performed the test without prior authorization from the XXXX as I had several other tests performed there and was refused treatment because they did not have prior authorization. I would also add that this XXXX approved test was during the heightened time of the COVID pandemic, when businesses were struggling with employee staffing. Also during this time the XXXX was transitioning from XXXX to the XXXX XXXX XXXX to process their billing. When I received a medical bill from XXXX XXXX for {$390.00}, I contacted the the XXXX XXXXXXXX XXXX in XXXX to take care of the bill. The XXXX XXXXXXXX XXXX XXXX representative said they would contact XXXX XXXX to get it paid. 5 or 6months went by until I received a notice that the bill would be sent to collection. I immediately contacted the XXXX again and was placed on a conference call between the XXXX representative and the Professional Credit Management agent. Again, the XXXX representative approved the bill for payment. However, It was not paid again because the XXXX claimed that XXXX XXXX failed to submit the bill to the correct XXXX billing agency, then XXXX, and because the bill was now over six months old and that this is the XXXX 's internal policy. In addition, the XXXX representative told me that XXXX XXXX would " write off '' the bill due to their error. This medical bill is the direct result of negligence on the part of XXXX XXXX, XXXX, XXXX, and the XXXX for failure to work together, communicate, process, and close out a medical bill the XXXX originally approved to pay, and by no means failure on my part by my many attempts to get each agency involved to work together and handle this medical bill professionally. In this case, the consumer has been wrongfully held responsible and other agencies have neglected to function together on the behalf of the customer.

I recieved a letter regarding an alleged debt from PCM mangement ( XXXX XXXX XXXX XXXX, XXXX, AR XXXX ). I sent them a certified letter on XX/XX/2020 regarding them having unauthorized access to my medical information. Specifically i attached this language in the letter : " Additionally, I am allowed under the Health Insurance Portability and Accountability Act ( HIPAA ) to protect my privacy and medical records from third parties. I do not recall giving permission to XXXX XXXX for them to release my medical information to a third party. I am aware that the HIPAA does allow for limited information about me but anything more is to only be revealed with the patients authorization. Therefore, my request is twofoldvalidation of debt and HIPAA authorization. Please provide breakdown of fees including any collection costs and medical charges. Provide a copy of my signature with the provider of service to release my medical information to you. Cease any credit bureau reporting until the debt has been validated by me. Your data furnisher or metro 2 verification system only uses general information in formats of codes ( name, social, date of birth, address ) meaning any individual with access to that information would be able to pretend that they are me and easily commit identity fraud. As a third-party intervener this company has negatively impacted me as a consumer. Pursuant to federal law They have committed fraud and several violations of the FDCPA and XXXX. They are now threatening me for an alleged debt that they claim I owe. I never received a Material Disclosure of any of the information that was supposed to be provided to me. they have taken an unfair advantage of me as a consumer, and they should be held accountable for deceiving me and not validating the debt. They have not validated anything ; they have ruined my character and general reputation by reporting erroneous information on my consumer report and included a symbol on the contents of the envelope for the mail courier or any person affiliated with the postal service or comes in contact with the envelope that alleges I owe a debt. Theyve act as if they are unaware of what I am requesting or that the law does not apply to them and I've included evidence and proof, pursuant to federal law with facts that prove that the law does apply to them and that they must adhere to them. They have not provided me with any original documents, and they have disregarded the law by saying, they do not have to provide me with anything except billing statements or applications, which is not proof of validation or proof that I owe anything. I received a credit report in XX/XX/XXXX while trying to do a refi on a home. A collection is reported from Professional Credit Management for {$170.00} with XXXX and XXXX says date of report was XXXX. I called the company and inquired PCM said it was for a XXXX bill with XXXX XXXX in XXXX XXXX. I informed PCM I had never been a client there, and all my medical was done through XXXX PCM said I would have to file a police report for identity theft if it wasn't mine. I called XXXX XXXX XXXX XXXX XXXX XXXX XXXX and spoke to the receptionist and then billing. She searched my name, my social, my birth date and married and maiden name and I was no where in there system, she searched back to XXXX. She even called old XXXX that use to work in that office and no one had heard of me. XXXX XXXX then called PCM and informed them the data they had was not correct, and PCM couldn't provide enough information for a claim to be valid anyhow. PCM representative stated she wasn't for sure what to do since claim came from them allegedly, and XXXX XXXX informed PCM they should drop it due to lack of data and they were corroborating I did not owe them a debt. I contacted PCM again after my conversation with XXXX XXXX. And they said I would have to file a police report, yet they didn't have sufficient data and was informed by their client PCM data was obviously incorrect. PCM representative confirmed I had disputed it in XXXX yet it didn't go anywhere and was still on my credit. I received notifications of bill from the hospital and they agreed to accept monthly payments. Then the hospital turned my account over to Professional Credit Management. I contacted them and they agreed I could make monthly payments. I was told I would not receive any billing statements or phone calls to attempt the debt owed. I tried to call the hospital and they had no information on the company to contact. So I patiently waited for some kind of contact or post from them. I didn't know who to pay much less where to send it. My account has a guarantor on it and at first the bill was in his name and then they put it in mine.I am covered by my parent 's insurance although I am of legal age. Initially they spoke with the guarantor, but then refused shortly there after. On or around XX/XX/XXXX and again on or around XX/XX/XXXX, and other multiple dates, attempts were made to contact them. I actually received a post in the mail of a facsimile copy of their bill marked in red " Collection '' .Even the envelope could be mistaken for " junk mail ''. Immediately I paid the account balance in full in XX/XX/XXXX. This collection marked my credit reports and I honestly believe, in good faith I was attempting to pay the debt. I understand collection agencies have policies and procedures they must follow, however my credit up to this point was impeccable. I had about 7 medical bills all with the same company for testing. After disputing some of the charges they were sent to a company called Professional Credit Management which a debt collector out of XXXX, Arkansas. I contacted this creditor on numerous occasions. I was told by several representatives that my paid accounts would be removed from my credit report but they would not remove them until they were all paid in full. Well I have paid ever single account. When I noticed the accounts were not being removed from my credit reports I contacted PCM via phone and mail. I was told that by a female representative that they would not be removing my paid accounts. When I advised her that I was told they would be removed she said the person was new and did not understand how PCM does business. The representative refused to provide me her name or reference number. She then called me a " XXXX '' and told me to " pay my XXXX bills on time next time. '' When I tried to call back to speak with a manager, PCM blocked my phone number and will not accept a call from me. When I call from another number and I tell them who I am, they place me on hold without ever picking back up. I am asking for help. I am a consumer that has been taken advantage of and treated poorly. I can provide proof of payment on all accounts and also a copy of the letter that I received from PCM in reference to deleting paid accounts.

I have two collection accounts on my XXXX Credit Report that is being reported by a collection agency names Professional Credit Management in XXXX Arkansas that is reporting negatively on my credit report. I have attempted to clarify to the agency that I have never signed a contract with them to pay them any money in reference to this medical debt. Sometime in 2016, I was involved in a vehicular accident. Professional Credit Management continues to report a debt on my credit profile after I have disputed the account asking them to validate it is my account. They failed to validate the account with my social and my signature. They sent me an itemization showing what procedures were done at XXXX ( HIPAA violation ). I have no knowledge of the account so I asked for these pieces of information ( social and my signature ) to validate that it is actually my debt. The first letter was sentXX/XX/XXXX and the second one in XX/XX/XXXX. I have even offered to pay the amount they say I owe if they would remove it from my credit profile inXX/XX/XXXX. That request was denied. I 've included an attachment to show when this account was opened. You will also see the remarks that shows I have disputed this. The opened date of XX/XX/XXXX also puts them outside of Arkansas Statue of Limitations for Medical Collection : Debts incurred for medical services have a statute of limitations of 2 years from the date the service ( s ) was rendered or from the date in which the most partial payment was made ( A.C.A. 16-56-106 ). I have not paid anything towards this debt and continue to go back and forth with them over an account that is being reported outside of my state 's statue of limitations.

According to Professional Credit Management XXXX XXXX an account was opened in my name for non payment of medical debt on XXXX XXXX XXXX. Upon first contact with Professional Credit Management I informed them that I was making payment to XXXX XXXX XXXX XXXX XXXX XXXX XXXX and that no further correspondence should be made over phone. Please refer to Complaint XXXX I repeatedly disputed a medical bill that I was not familiar with. The amount is {$940.00} for a XXXX XXXX. During the time of the procedure I was pregnant and covered by state healthcare. I should not have had any medical expenses. XXXX XXXX are not typically performed on XXXX XXXX. I have no reason to have had a XXXX XXXX I contacted the original creditor in which they informed me the bill belong to another patient with my same name but a different DOB. Contacted the collection agency again and was given the run around. I asked that they verify the debt. They refused. Filed CFPB complaint XXXX to help get this resolved. It came back validated once again. I then called the original creditor to get additional details. My assumption was that if the medical bill was, in fact, mine then I should be able to get my test results and medical records. I could not. It was determined again, that the bill belonged to another patient. The original creditor emailed the collection agency her findings. On XX/XX/21, I noticed a collection on credit karma from Professional Credit Management Collection agency in which I did not recognize the collection company. I immediately mailed a certified letter requesting validation of the debt. In turn, Professional Credit Management collection agency sent me records detailing sensitive information about my health in which my family did not have prior knowledge violating my HIPPA rights. Last year on XX/XX/XXXX I noticed my credit score decreased by XXXX point. I researched the issue and found it to be because of a {$310.00} medical bill that had gone to collections. I contacted the collection agency immediately and it was discovered they were sending notices to an old address so I never received the notices. They didn't care. I pulled my credit report and noticed XXXX XXXX from Professional Credit Management. I was unfamiliar with the debt so I reached out to them to get more information. They noted some medical bills. XXXX was very old from XXXX that I don't recall. XXXX others were from during the pandemic in XXXX. I asked for an itemized statement and they sent me a collection letter with XXXX line items noting only the original creditor and amount due. I then contacted the original creditor to get additional details. The agent there said that one of the bills in question did not match my identity information she had on file. She was unable to provide much more information. I called the collection agency back and informed them that I was questioning the validity of the bill. During the time in question, I was pregnant and on state provided XXXX. I should not have been responsible for any medical bills at all. However, in talking to both the original creditor and the collection agency, neither can prove that the debt does in fact belong to me. I disputed this account with Professional Credit Management on 2 occasions and on each occasion, they were unable to provide copies of documents sent to me regarding my account and any papers that bear my original signature that reflect that I agreed to pay what they say I owe. Debt was due to a Doctor visit in XXXX. Debt was believed to have been paid in the full amount and we never received any other information regarding payment. That is, until summer XXXX we received a letter informing us we were now in debt collections and needed to pay this amount. We were very surprised but it was an insignificant amount so we paid to clear our debt history. Another year has passed, now in early XXXX and we decided to refinance our home. As we go through the process it is found that we are again in debt collection, this time for {$50.00}. Again, I have paid to clear this debt. All of this is still stemming back to the original XXXX doctor visit. Notice, we have received no information about this debt whatsoever, by phone or mail to our address. Before receiving a certified letter of a filing made on behalf of Professional Credit Management, I did not receive any correspondence is mail or phone regarding the alleged debt listed in said filing. I have made numerous attempts via phone ( phone records available ) to show that I called Professional Credit Management to address the matter immediately after receiving the certified letter ( first tactic of communication ).

Professional Credit Management of XXXX, AR ( PCM ) intentionally and illegally reported and continues to report false information to Equifax. I had a procedure in XXXX of XXXX. They originally reported the date of first delinquency as XXXX of XXXX, three months prior to the date of service. Pursuant to the Fair Credit Reporting Act ( FCRA ) they must report accurate to the credit bureaus. I have their manager, XXXX XXXX, on a recorded call stating that they do indeed report false information so the information will come off sooner. Reporting false information is still illegal. Since then, PCM has reported the debt as unpaid when it has been paid and now they 've changed it again. In the last 2 months PCM has reported several different false reports, defamed my character, and jeopardized my ability to get sound interest rates. PCM should be shut down immediately and required to cease operations. I am also asking the CFPB to do a full audit of PCM.

I have received several phone calls from a debt collector mentioned above. They state that a payday loan was taken out in XX/XX/XXXX and that the balance of this loan has not been paid off and has been sent to them for collection. I have no records of taking out any pay day loans at that time and no documentation of a due or past due loan. The representative informed me that they are trying to collect this debt and that if I do not pay the settlement through them, I be summoned to appear in court and be responsible for the full amount of the debt plus legal fees. I explained to them that since I have no recollection of taking out this payday loan, that I would require documentation specifically stating the exact loan and its current status before moving any further on this matter. It has been several months and Professional Credit Management continues to violate the Fair Debt Collection Practice Act and Fair Credit Reporting Act by continuing to report a fraudulent debt to my credit file that was never opened by me. This account was previously deleted from my file and re-sold which is clearly a FCRA violation. Even after being notified this debt was a result of identity fraud Professional Credit Management continues to report this account to the major consumer reporting agencies. In addition in the state of Arkansas, Debts incurred for medical services have a statute of limitations of 2 years from the date the service ( s ) was rendered or from the date in which the most partial payment was made ( A.C.A. 16-56-106 ). The company states the I owe a debt with 4 different accounts. The accounts need to be verified. I don't want a statement. Upon return from Military XXXX, I was made aware of an outstanding debt with XXXX XXXX, a cable service provider I had service with, in XXXX TN. I contacted them and made payment in full on XXXX XX/XX/2021. Receipt provided showing the correct date. The following month I noticed Professional Credit Management ( PCM ), a collection agency for XXXX XXXX, was erroneously reporting incorrect information to my personal credit file. I have disputed this account multiple times with all three credit bureaus and PCM has failed in correcting the erroneous information. I visited XXXX XXXX XXXX in XX/XX/2022 for a XXXX ultrasound. I was referred there by a XXXX because I was XXXX XXXX XXXX. After the appointment I began receiving bills for XXXXXXXX XXXX XXXX ultrasounds instead of the XXXX ultrasound that I was supposed to receive. Hello, I paid my medical bill with the hospital and it is on my credit report. I called the agency and asked them to contact the hospital because the debt was precociously paid. They refused. I contacted the credit agency. XXXX to explain the bill was paid and I have the receipt. I attempted to upload the receipt to the online portal would Not allow me to Attach the receipt of proof. It appeared to be an issue with the system. I was contacted by Professional Credit Management regarding a collections account in the amount of {$110.00} ( in XX/XX/XXXX ). Upon this communication, I was told that paying this account would result in it being deleted from my credit report. On XX/XX/XXXX, I paid the account and received confirmation of the payment to my email account. After a few months ( XX/XX/XXXX ), my credit report was reviewed my credit report and found that this account, while showing paid, was still there. I contacted the company to inquire about this. After waiting over 180 days for a response, they send a template response back that I should wait LONGER. This is unacceptable. The FCRA gives them 30 DAYS. They have taken over 90 ; this is a violation and they are required to remove all of the accounts that they have failed to investigate.
