While trying to close on our VA refinance loan the loan process was taking what seemed like an inordinate amount of time. After reaching out to both our loan processor and loan officer we were assured that we were close to a closing date. However, after some additional weeks had passed with no communication from the lended I became concerned. I had gone through my emails at that time and found a communication from the lender stating that they would close in 21 days of less. With that said, we had signed our loan estimate documents and intent to proceed document two months prior. 60 days had passed since document to process the loan were signed yet we had still not received closing disclosure or final lending documents. I then contacted the lender to inform them of what I believed to be inaccurate and false statements in regards to their closing timelines and that I intended to proceed with filling formal complaints if this issue was not immediately rectified. A phone conversation with our loan officer followed in which they stated they had never stated a closing date of 21 days or less. I informed the lending officer of the email in which he had stated a 21 day or less closing time line, to which he stated that he did not sent the email and that an automated system had. I did inform the lender that his name was on the email and that it had come from the lending company. We had further discussion about if I wanted to close the loan application, which I did not. The subject of closing the application seamed to be a threat of retaliation, if you file a claim against us then I will close your loan. I informed the lender a second time that I did not intend to close the loan process and that if the process was closed I would look at filing a retaliation claim. The lender then stated that I had been the one that was making threats. When asked what threat that was the lender stated the treat of filing a complaint. I did tell the lending officer that this was a threat to preform the action the lender had already committed to. The phone call ended at that time. In addition, I wanted to state that the lender had also made previous claims that we would be able to " skip '' two month payment on our mortgage when we refinanced. I'm not sure of this claim is legal or not but wanted to add that information incase it was a deceptive lending practice.

We are filing a complaint against prime choice funding Inc. because we did a refinance with through their company in XX/XX/XXXX, at the time of the refinancing we were told that we would did not have to make a payment for exactly 2 months. We did not get the two full months without payments. Also we were never asked did we want an escrow account in our refinance. If we had of been asked, we would have definitely said no. We were charged up front in the refinance for an amount of escrow for homeowners insurance for 9 months of {$100.00} for a total amount of {$940.00}. Then we were charged for property taxes of {$620.00} for 4 months for a total amount of {$2500.00}. All this is in the Closing cost details. We were also charged an additional monthly amount in an escrow account for both the homeowners insurance and property taxes in the amount of {$730.00}, starting XXXX. When this was very unnecessary. We never wanted an escrow impound account, we were never asked did we want it or not. It was just placed there for the companies to make money. We do not need any company whatsoever to pay our bills that we can pay ourselves without any interest added. Paying the company directly is fine with us because there is no interest attached. and paying our property taxes when they are due is fine. This company prime choice funding Inc. knew exactly what illegal things they were doing and why they were doing it. They lied to us and told us our loan would be through them. And then they transferred it to freedom mortgage to continue their fraud acts of collecting money in an escrow account for homeowners insurance and property taxes. We are also filing a complaint against that company also, who refuses to close this impounded escrow account when we have asked for it to be done in writing and the homeowners insurance is fully paid through XX/XX/XXXX. So we do not need to give the mortgage company another penny. They also have the more than enough in our escrow account to pay our property taxes due in XX/XX/XXXX. We have already informed that company to make that payment and refund whatever is left and close that account, because we do not need it or want it.

Predatory Lending and an absolutely horrendous company to deal with. " Senior Loan Officer '' XXXX XXXX misled us with bait and switch tactics to get us to refinance with them ; he was given all our information for taxes and insurance and quoted us a payment based on the actual numbers. A few months into our refinance, our Escrow was over drafted. When we inquired about it they claimed its because our taxes and insurance changed which they did not ; this led to them increasing our monthly payment by over {$800.00}. It took an act of God to get it straightened out and multiple managers not to mention countless hours of my time on hold waiting to talk to someone who was competant. The best part is, this was only the first of 4 times they've done this to us in the 4 years since we refinanced. Multiple follow up messages to XXXX were either ignored, or he passed the buck to the servicing company to which the loan was sold. This loan was never right from the beginning and has never recovered.

On XX/XX/XXXX, a representative from Prime Choice Funding sent an email asking for " documents '' to obtain mortgage rates in order to refinance my current loan. I forwarded documents such as Pay stubs, W-2 's, and current mortgage statement, however, I did not sign or send an authorization or consent to run mine or my wife 's credit report. On XX/XX/XXXX, this representative sent an email with both my wife and my credit scores, which he obtained from the credit bureau. I was outraged and furious that my credit was obtained without the express written consent of myself, or my wife. This was a blatant disregard for my personal information, and illegal as I did NOT give consent. This representative stated in an email that since I gave my DOB, that was the same as consent.

I got a letter in mail from Www.primechoicefunding.com NMLS XXXX advertising that I was preselected for a very attractive mortgage refiningnancing rate. Upon my contact with the company I was assigned a mortgage officer XXXX XXXX to whom I submitted all required info. I mentioned to him that I work with another lender and already locked in at a certain rate and submitted their official loan estimate. XXXX run my credit history without notifying me first and then started making assumptions and giving me go around without giving me loan estimate or rejection even though I submitted all documentation and it satisfied all requirements. I have a full record of our email correspondence upon request.

I have signed the refinance paperwork with PrimeChoiceFunding Mortgage on XX/XX/XXXX for a XXXX days lock based on the advertisement flyer that came in the mail in XXXX of XXXX. As of today XX/XX/XXXX XXXX 3 months later ) I have not received any updates on my closing date and have not been able to receive any updates on the status of my file. It is misleading to keep the consumer on hold for such a long period of time with no updates and no end date after offering a XXXX days lock in. It is a desperate situation. Please assist.

I received a Prescreened offer of credit dated XX/XX/2020 from PrimeChoice Funding ( NMLS # XXXX ) stating I had been pre-approved for a new mortgage in the amount of {>= $1,000,000}. When I spoke with the representative XXXX XXXX ( ID XXXX ) on XX/XX/2020, she stated that they no longer offered a jumbo loan program. This offer was deceptive, as the firm advertised a program they do not offer, enticing me to divulge my non-public personal information ( NPI ) without offering a bona fide product or service.
