Letter of Complaint : Refuse to Validate Debt- Prime Business Service For over two years, I have been disputing this debt. Validation letters have been sent to Ive disputed the debt with XXXX, XXXX XXXX, XXXX, as well as XXXX XXXX XXXX, XXXX XXXX XXXX, and Prime Business Service. I requested proof of validation. So far, none of the companies have been able to provide such proof to me. I have sent multiple follow-up letters to each of the companies, and there still is no proof. At this point, XXXX XXXX XXXX XXXX, no longer respond, or update the account. I have fully investigated my rights in this matter. Under the Fair Debt Collection Practices Act, if no proof is provided to me within 30 days, I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. I have copies of the certified letters and dates as evidence of my requests ( see enclosed ). Under the Fair Credit Reporting Act, these disputed items may not appear on my credit report if they can not be supported by any evidence. According to the Fair Credit Reporting Act, if the debt cant be verified within 30 days, then it must be removed. Telephone Communications with XXXX, XXXX and XXXX claim to have verified the debt, but this is, in fact not true under law. Simply contacting the alleged creditor, and asking them to match up numbers in their database, or or using the E Oscar System to input codes is not sufficient verification. I want the account removed from my credit report immediately. Current Federal case law states that Consumer Reporting Agencies bear grave responsibilities to ensure the accuracy of the accounts they report on and their responsibility must consist of something more than merely parroting information received from other sources. The courts have also ordered that a Reinvestigation that merely shifts the burden back to the consumer and the credit grantor can not fulfill the obligations imposed by 1681 ( a ) ( 4 ). I want the account removed immediately, or I will be forced to seek legal remedies, under the Fair Credit Report Act.

Prime business LLC located in XXXX ca, ( XXXX ) XXXXcollected a debt from a bank account that I had. I sold a car to a couple and they paid me with a bad check come to find out 6 months later as the check was returned. My account was then closed and forwarded over to a debt collecting agency. The woman at the agency did not agree to payment arrangements after I explained that I was in the process of buying a home and could not afford for anything negative on my credit file. She told me that she could not do payment arrangements and that she was going to report the balance to the credit bureaus to hurt my credit and that she did. Since she has reported to the credit bureaus she also has been adding interest fees. I do not feel I am responsible to any interest fees because I did not sign or agree to any fees nor was it told to me that interest would occur. I asked them to send me an email stating the balance and it was never sent to me. I called her to get to the bottom of this matter and see what options I had to take the negative reporting balance off of my credit and all she did was threaten me that they will do whatever it takes to get the money from me and hung up the phone. Since then she is deliberately trying to damage my credit.

This account has absolutely no merit, I have taken the proper steps to report these accounts to the Federal Trade Comission ( FTC ) and filed fraud/identity theft reports with them. Section605B ( a ) requires CRAs to block the reporting of any information that the consumer identifes as information that resulted from an alleged identity theft, within 4 business days. I have filed the necessary paperwork with the FTC, along with local. I have also been in contact with the Attorney Generals Office of California - XXXX XXXX. This is a formal legal notice to Prime Business Service, to cease and desist all collecting / reporting activities under the FDCPA 2009. I will not be harassed, this debt is uncollectible, untransferable due to the nature of fraud. This debt is the result of identity theft, the original owner of this debt has been notified. Under the FCRA 2009 and the FDCPA 2009, I am legally asking Prime Business Service LLC, to cease and desist and to stop all contact with me except with providing me any documents that I am entitled to, such as statements, and contact information. I have attached the necessary paperwork, including notice to furnisher, FTC Identity Theft Report, & FCRA.

After checking credit, and from being a victim of identity theft, I reached out to this company serval times and a lack of communication very rude and demanding for payment. I tried to explain to the company that this account isnt mine and I have no knowledge of this account, this account had to be open fraudulently under my name using my identity. This account has been inserted on my credit two times, recently after disputing with all three Credit Bureau, XXXX XXXX was able to delete the original creditor XXXX XXXX XXXX, this is a third party company trying to obtain money from me in the amount of XXXX $ thats false information from what the previous creditor XXXX claimed I owed before it was removed/ deleted from my account of XXXX I would like for this account to be removed from my credit and a letter sent of deletion

Prime Business Service is collecting on the same debt as the bank. THey are both reporting and damaging my credit. I have been fighting it and they claim it is valid. I have proof that they are duplicate reporting and collecting. They are in violation of the FCRA. This needs to be fixed or they need to be fined.

I am writing this due to non-compliance with the PRIME BUSINESS SERVICE. THEY HAVE FAILED TO REMOVE INFORMATION THAT WAS AFFILIATED WITH PERSONAL DETAILS THAT WHERE CHALLENGED IN THE PAST. I strongly believe they are in violation of the FCRA and are refusing to uphold the law.

This company, Prime Business Service, is reporting a duplicate account and debt. I have disputed with them several times and they do no respond. XXXX companies can not collect on the same debt at the same time per the FCRA.
