I am so glad I found out about you. Hopefully you can help me with a problem I am having. Recently I have been doing my best to clean up my credit so I can buy a home which my family deserves. I have been doing whatever I can to try and pay off any creditors or collectors who I owed money to from when I fell into hard times. For the most part, I have succeeded. I am proud to say that by the grace of God, I have worked out several deals with the people I owe money to with the assistance of XXXX XXXX XXXX. Several of them have been paid as well. I have gone as far as to borrow money so I can finally be debt free at least as my creditors are concerned. The one company that hasn't been paid is XXXX XXXX XXXX. They haven't been paid not because of my negligence, but because they are comporting themselves in a fashion which shows me they are untrustworthy. For a full disclosure, I am letting you know that I have been shown and listened to all the recordings of all the calls made as well as all the conversations with XXXX XXXX XXXX, and I am very upset. Back on the XXXX XXXX XXXX XXXX XXXX XXXX submitted representation to XXXX XXXX on my behalf along with many other companies. They began the process of settling or negotiating with many creditors and collectors for me. On the XXXX XXXX XXXX they requested a settlement in the amount of XXXX XXXX of what I owed. The amount owed was {$5100.00}. In that call they spoke with a XXXX who said he would contact his client to see if they would settle this debt in the spirit of good negotiations. XXXX said he would get back to them in 72 hours. Over the next few days, XXXX XXXX XXXX would check back with XXXX XXXX XXXX, but XXXX was not available. Finally, on XX/XX/XXXX, they were able to reach XXXX. In that call, they renegotiated for {$2200.00} as the 40 % was a bit too low. XXXX asked XXXX XXXX XXXX if he gets the {$2200.00} deal how would I pay them. XXXX was informed I would pay him on the spot with card even though there was a {$66.00} processing fee. After some more detailing of the negotiation, XXXX said he would have a settlement offer sent out the next day so we can pay them off. I do want to point out that it was this conversation which first raised my suspicion that something funny was going on. What happened was that in this conversation, XXXX was asking if we needed a settlement letter before we paid the amount to which ultimately XXXX XXXX XXXX confirmed. I am sad to say this letter never came. When the letter which was promised never arrived, XXXX XXXX XXXX called XXXX XXXX XXXX multiple times on XX/XX/XXXX as they still hadn't received the settlement letter. Again, they couldn't get a hold of XXXX. After multiple phone calls, they were able to get a hold of a supervisor named XXXX XXXX. To make this story short, XXXX was informed there was a settlement in play for {$2200.00} which was approved by XXXX. XXXX said he didn't care as his client 's parameters were XXXX XXXX of some convoluted formula I didn't quite understand. It ended up being {$2600.00}. XXXX also said there weren't any notes on the file stating as such. There were only notes saying I was offered {$2600.00}. We informed him to listen to the recording and he would see there was in fact an offer for {$2200.00} made by XXXX. XXXX again said there wasn't any notes on that conversation, and it was irrelevant. His client parameters were XXXX XXXX and that's what he's going to go with. That was the end of that call. To many others who read this it might seem like I am crying over not getting what I want. Please rest assured this complaint goes far beyond that. At first, I didn't realize how severe the ramifications or the implications of what had just transpired really were. I just knew it was wrong. With the assistance of the recordings and looking up the Fair Debt Collection Practices Act with the guidance of XXXX XXXX XXXX, I now know how bad this whole scenario has become. This is why I am writing this complaint to you now. Earlier today, the operating manager from XXXX XXXX XXXX was informed of the situation so he decided to call XXXX XXXX XXXX on my behalf to see if he can smooth things out. The first phone call he was placed on hold for nearly 9 minutes, and no one ever answered. He called again immediately and was able to get a hold of a XXXX XXXX. XXXX XXXX refused to give his full name even as he was demanding full names of XXXX XXXX XXXX representatives. To once again make this long story short, XXXX XXXX was informed we were trying to get a hold of XXXX and XXXX. XXXX XXXX decided to intervene and attempt to address this himself. He was told the call was regarding the negation of the settlement offer of {$2200.00} by XXXX after it was approved by XXXX. Somewhere along the conversation he was told that all the recordings were listened to and there was in fact an acceptance of {$2200.00} by XXXX and a promised settlement letter. Instead of attempting to assist, or address the issue, or transfer this to a supervisor or management, he started getting belligerent and argumentative and was asking if we had obtained permission to have the phone call recorded. XXXX XXXX went on and on about the recording permission and was acting in a matter-of-fact way. He was told in the phone call that their own company states the call is being recorded, but XXXX XXXX kept perseverating about obtaining permission and if we were following laws. Finally, the operating manager at XXXX XXXX XXXX got fed up and retorted to XXXX XXXX that if he was speaking about adhering to laws, then what was his company 's excuse for breaking the Fair Debt Collection Practices Act specifically the false or misleading representations or the unfair or deceptive means in collecting a debt. XXXX XXXX said he acknowledged that fact, but again he became very combative and again was demanding things such as full names even though he refused to give his own when being asked multiple times. That showed his cowardice and his intent to deceive as well as prove he was being anything but helpful as he refused to transfer the call to someone with authority to resolve this matter. This complaint is for the fact that we were being misled about a settlement in the amount of {$2200.00} being in play which was either a lie by XXXX in an attempt to get us to pay an amount which was never really in play, or by his supervisor XXXX trying to collect more money than what was agreed to. The fact that we were questioned about needing a settlement letter before payment was made only further proves there was intent. The fact that a supervisor or someone pretending to be a supervisor claims there was no notes of a settlement offer being extended to us when there is a recording and him refusing to even listen to it just keeps adding to the proof that there was a real intent to deceive by XXXX for misrepresenting the conversation and omitting crucial facts. Either that, or XXXX was trying to deceive me because there really was a {$2200.00} offer, but he refused to acknowledge it and just wanted more money out of me. This is no small matter. What if we had paid the settlement amount of {$2200.00} only to find out later that it didn't exist? The situation would have been far worse, and I would be, forgive my language, screwed. I now want to file this complaint against XXXX XXXX XXXX for breaking the F.D.C.P.A. and lying to me. Even if I wanted to pay them now, how can I trust that this next settlement they are claiming is good really is? How do I know they won't change their mind another time or claim that the notes on the conversation for {$2600.00} is even a good one? Or that they will say there are no notes on that conversation even though those recordings also exist? Or that those recordings are once again irrelevant? I'm sure you can understand my dilemma or my trepidation in dealing with XXXX XXXX XXXX any further. That in itself also leaves me in a very bad bind. If I don't resolve this account, then I won't be able to proceed in trying to buy a house because this will stand in my way. That is very unfair and wrong. Just because I fell into hard times in the past does not mean that I should have to be treated this way. I now am asking for your help in resolving this because I believe XXXX XXXX XXXX is untrustworthy and a bad collection agency which will say or do anything to collect from people regardless of any rules or regulations. I would like for XXXX XXXX XXXX to no longer be involved or in charge of this account as they are not comporting themselves in a way a collection agency is obligated to by law. They are more worried about being recorded than actually addressing their faults or empty promises. If I'm going to deal with anybody about this debt, then I would like to deal with Premier Auto Credit directly. I want XXXX XXXX XXXX to cancel this collection, stop reporting the collection on my credit report, and send the account back to Premier Auto Credit for me to resolve the debt with them.

I bought my truck in XXXX of XXXX. I provided the insurance to the dealership as you always have to to be able to drive off the lot. My truck stayed for a week to get some repairs. I am being charged with LDW fee for that month. I was being charged an LDW fee for 26 other months but have shown all my declarations to get them finally taken off after I have been reaching out since XXXX of XXXX vis email and no one who respond. I got a statement in the mail on XX/XX/XXXX for my last payments. It said I owed XXXX. That was with the 26 months of LDW fees at XXXX each. I paid on the XXXX of XXXX XXXX because according to my credit report that's what I owed. I sent more emails and got nothing from them. Well I got a call on the XXXX of XX/XX/XXXX and she was telling me I owed XXXX I asked her why I was recieving the LDW fee when I have had insurance on my vehicle the whole time I have owned it. She told me to prove it. So i did on all but the first month I had the vehicle. She the said I still owe money from when they repoed my vehicle on XX/XX/XXXX. I then told her that my contract stated that my I had to be 15 days late to put a repo order out and I was only 2 days late when they repoed it. That the manager at the time told me that the repo fee was waived as they took it with no rights too. It was paid in full by XX/XX/XXXX. My bill was due on XX/XX/XXXX. I have screenshots showing that I was only 4 days late when I paid the bill. I was left without a vehicle for 4 days because they took it. They have now called me today to tell me that I owe XXXX and I need to pay that to get my title. According to my statement on XX/XX/XXXX I owed XXXX. I paid XXXX to them on XX/XX/XXXX and now paid them XXXX today XX/XX/XXXX. From my statement I have overpaid. They seem to keep adding more fees and not willing to send me a statement and nothing is available to see on my online account with them. They send me emails but wont respond to me at all. Most of the time they wont let me record the phone calls so I can have proof of things. If I tell them I wont let them record me because they dont save anything they tell me they won't talk to me. They send me one thing in writing and another thing on the phone. I have spoken with XXXX XXXX on XX/XX/XXXX and XXXX. Today I spoke with XXXX XXXX who would not transfer me to her supervisor. She told me to text him or email him my stuff and I have. His name is Mr. XXXX. I have emailed both of them all the breakdowns and showing proof that they repoed my vehicle being 2 days late. I am at a stand still with them because they seem to add more money to my account and I keep paying what they say and then they wont send my title. They wont out anything in writing and I just cant trust them.

Im am writing this complaint in regards to Premier Auto Credit. On XX/XX/2023 through the middle of XXXX. Me and XXXX XXXX received threaten aggressive calls from premier auto credit. The company threaten to sue us, hire private investigators to follow us and ruin our credit if we didnt pay the loan amount. They also followed me from XXXX XXXX house to my place of residence, Thats when premier auto credit hired and unmarked repossession company to repo our vehicle. We were followed in unmarked cars, to and from work. We received aggressive phone calls from premier auto Credit. The agents would us profanity and foul language, in attempt to recover the vehicle. This became very stressful and upsetting for me and XXXX XXXX.We were not made aware of, by phone, letter or email that this company was going to repo our vehicle. Our personal information was giving to this company, in which we did not have an agreement with the repo company but, with XXXX and premier auto credit. We feel that our personal information was compromised by premier auto credit and our personal credit has been breached. Weve also notified premier auto credit of our financial difficulties, hoping to refinance our vehicle or work out a payment plane, but the company refuse to work with us. As I look at the contract weve noticed that our signature are computer generated, and not our hand written, in which, at the time of signing the contract we only hand written our signatures. At the time of our contract signing, XXXX / premier didnt explain our rights as a consumer buyers, which is a violation to our right as purchased of any form of credit transaction.. Ive also noticed per our contract that we where approved for a loan of XXXX. I, neither XXXX XXXX didnt receive cash, check or money deposited into our account as a consumer transaction. On the retail sales contract, our signatures are computer generated as noticed We where not made aware of any taxes or fees until the signing of the contract. We where forced to pay these fees, or we could not drive the car off the lot. We gave {$8000.00} cash for the down payment, was financed XXXX which totaled {$24000.00}. We paid XXXX for sales taxes. XXXX for vehicle license fees and {$50.00} for registration fee, which is against the law to use this amount as part of the down payment. Weve contacted premier auto credit about the merchant that was in and on the vehicle at the time of repossession, and asked if we can recover our property, but was denied access to our belongings. This company is very rude, unprofessional and intimidating. This company has lead us under fraudulent transactions and bad faith agreement entrapment.

On XX/XX/2021 i called the loan company because i had been charged an additional {$35.00} with my monthly auto loan. I spoke to the representative " XXXX '' who informed me that the charge was a " late fee ''. There is no indication within the contract that that was a late fee. XXXX emailed me the page of the contract that indicated late fee charges, however, the document contained a signature that was forged with my name and no valid signature from the dealer. I asked to be provided a copy of the full contract so I could review the document and ensure it was identical to the original, and that i was not being scammed by this loan company who claimed they bought my loan from the original dealer ( XXXX XXXX ). XXXX stated he would send me the contract via USPS mail. When i did not receive it I called back on and emailed the supervisor, customer service, and XXXX on XX/XX/2021. I was then told that reps did not have access to the contract and that the funding department processed my request and would mail it out. yet again, Premier auto Credit failed to send me a copy so i emailed and called them again on XX/XX/2021. I was told by XXXX and another representative that my request had to go through the supervisor and i was transferred over to supervisor XXXX XXXX extension where i left a message and followed up with my 2nd email to him. I called again on XX/XX/2021 I was then told by representative XXXX that the " funding department provided the contract to XXXX, who would be mailing it ''. To date this company continues to provide me with inaccurate information regarding my auto loan, they refuse to provide me with information requested, and has not fulfilled my request to obtain a copy of the contract they received when they purchased my auto loan. Most of the representative refuse to identify themselves by name ( when you ask their name they hang up in the callers face ), employees are extremely rude, short tempered, and make threats, and/or hang up the phone when individuals call in. I have made a total of 8 payments to this company and i now have reason to believe I am being scammed or that this company is acting in an illegitimate ( fraudulent ) manner.

XX/XX/18 or XX/XX/18 Called company advised that car has been in a flood. Gave company claim number info. Stated will most likely be a total loss due to the water level it was over the vehicle. XX/XX/18 PAC called after the vehicle was deemed total loss in regards to past due payment. Told them they are receiving payment in full from the insurance company and that vehicle is a total loss. Rep had little concern over the vehicle ( Asset ) being a total loss and was more interested in securing a single payment to bring account current. I had already given claim info with insurance info. Informed them it was a total loss at this point and insurance would be making a payment. Told me I still need to make a payment. Told them no, rep replied will see and hung up. XX/XX/18 Called company to give updated info was referred to claims department with contact info. Hours later I received a collection text message stating to avoid additional procedures such a collection then I need to pay by XX/XX/XXXX. The date is XX/XX/XXXX so this is clearly over eleven months away. Called company back to speak to claims department to give additional info in regards to the insurance claim on the vehicle. The receptionist transfered me to collections instead, Collections asked how can I help you. I stated is this claims they stated no. Stated they were busy. Proceeded to tell me to make a payment. Advised rep again vehicle is a total loss and they will be receiving insurance payment soon. Rep was not interested in receiving information in regards to Vehicle ( asset ) or info in regards to an insurance payment to the loan. Rep was hyper-focused on a monthly payment for the asset. Told rep I was done talking to him since conversation was repetitive and non productive. Company has been harassing in regard to a vehicle that is already deemed a total loss. intentional lack of communication between collections and claims department at company.

My balance has reflected an incorrect amount owed for quite awhile, among other issues/communication problems since the inception of this loan being transferred to this company. I spoke with the supervisor XXXX XXXX, XXXX XXXX, and some other ladies on the phone about this MULTIPLE times throughout XXXX. XXXX XXXX told me I was missing XXXX, XXXX, XX/XX/XXXX payments ( even though I wasnt even financed through them at the time ) and I sent bank statements and cancelled check copies proving they were paid. I also asked why was I never informed of missing payments when they bought my loan in XX/XX/XXXX and was told they just put my loan up to date. What? That makes no sense. Then she told me I was missing XXXX, XXXX, XX/XX/XXXX payments once I sent proof of the XXXX payments. Ive never missed any payments and sent all bank statements she requested to prove this. After proving I made all payments, she said she would " forward to upper management. '' This was XX/XX/XXXX. I have not heard anything since, and she refuses my calls, always in a meeting, lunch, on the other line, or just transferred to her voicemail. I have left countless voicemails and emails ( that XXXX XXXX confirmed she received ) and was told she would call back and email back however she has not. On XX/XX/XXXX, XXXX stated that this would be resolved by the end of the business day and XXXX would send me an email for my records and give me a call. That did not happen and I've called again since, and she is still not taking my calls. I just want my balance to reflect what I owe, so that I can pay off the vehicle and receive my title. The maturity date of the loan is XX/XX/XXXX, and I only have two payments left on this loan however my balance shows + {$1000.00} more ( because they claimed I missed 3 months payments, which was proven to be false ).

XX/XX/XXXX received a text message from a non identified number. Also there was not identification in text as well. Only after I called number attached was I able to find out who it was. Text stated I needed to make a payment by XX/XX/XXXX which is 344 days away. This is the only conclusion because you can not make a pa yment in the past. Company violated FDCPA Code section 807. They didn't disclose. I have screen shots and am perusing considering all options in regard to this blatant disregard for law. In addition this violation of FDCPA there are additional violations that I am seeking counsel in regard to at this time. I have screen shots that I will provide if necessary confirming this matter. 807. False or misleading representation ( 11 ) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the con sumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action. According to Section 807 ( 11 ) of the FDCPA, the initial communication between a collector and a consumer must disclose that its from a debt collector attempting to collect a debt and that any information obtained will be used for that purpose.

premier auto credit trying to repo my car for fees although I have paid the primary loan off they refuse to work with me on fees owed and all of a sudden my primary balance states I owe {$11.00} I'm thinking they are putting this to have reason to repo cause although I paid XXXX dollars two weeks ago the 11 magically appeared again I told them can I make arrangement for the fees they said no they also were very rude saying that they are not the cause of the pandemic and they didn't cause my XXXX XXXX. The also have sent text messages saying they hacked phones etc ... They are very rude when you're asking them for help to work out something. They call several times a day and when I answer no one says anything and when I call I get hung up on I owe a lil over XXXX in fees and I can get my title all I ask is if they can work with me and I continue to pay monthly until it's paid because right now I am on medical XXXX and I am not working due to health but I do get enough monthly to make the payments XXXX don't think I can return to work until XXXX. Instead I get rude people on the phone when I do talk to someone. It's not like I'm trying to run from my debt I have paid every month for three years. I need my car my XXXX XXXX are all out of this area I have children. They seem heartless I paid my principal off and more just keeps popping up.

This company has infringed on my right to privacy, I have never given this company any right to have my personal information. This company is trying to collect on an alleged debt. This company reported unverified inaccurate information to the consumer reporting agencies, which has greatly harmed my ability to offer or extend my credit to other financial institutions. This is against federal laws. This account is not mine and was opened using my personal identification without my consent. When any furnisher of information is notified pursuant to the procedures set forth in Section 605B that a debt has resulted from identity theft, the furnisher may not sell, transfer, or place for collection the debt except in certain limited circumstances. Section 615 ( f ). Ive also never given this company permission to contact me which according to the FCRA is also against federal laws. I have asked numerous times for this company to stop furnishing false information to the CRAs and also for them to stop contacting me. My next step will be to file suit. This is my last time asking to please remove this account, its not mine.

XXXX XXXX XXXX a third party debt collector posted a balance of {$7600.00} on XX/XX/XXXX and which had been updated to {$8100.00}! I was not informed that I owed them and that I was obligated to pay them money or that my potential debt was taken over by them, I asked them for an accurate check of the debt and balance to make sure that it was mine and that the correct balance was mine and never got either! They reaged this supposed debt so that it can effect my credit without even given me notice or a chance to go over it with them and possibly pay. Numerous of my dispute letters have not been answered back and I feel its attempt to show that Im not compliant and to get me to pay a outrageous debt by default hoping that I dont perform the steps necessary in order to settle this matter. I called the original debtor to confirm balance owed in which they wrote it off and charged it off, before this debt collector baught it and the balance when it was wrote off was not near but the third party is trying to allege.

I have contacted primere auto credit on several occasions.. I purchased my vehicle in XX/XX/2018 and I had to get car repairs done in XX/XX/2018 that totaled an amount of over {$700.00}. When I asked if I could defer a payment I was first told to send in documentation to support my request. When I finally had my documents I was than told no I could not do a deferment and I did not need to send in any documents and in order to defer I would have to make a total of 10 payments. This was in XX/XX/2018. I have recently contacted them and requested the same thing and was told to send in paper work again. I declined and advised I was told something different in XX/XX/2018. I have tried speaking with a supervisor and the customer service reps I get the refuse to transfer me and say they are transferring me to a voicemail which I get hung up on. I am at the point I can no longer sit on the phone with rude unprofessional people trying to get correct answers to my questions regarding my loan.

I financed a vehicle through Premier Auto Credit and paid off the full loan. After requesting information regarding the title, I was informed by XXXX, the customer service agent, that I would be reimbursed. However, despite waiting XXXX weeks, I did not receive anything in the mail. When I called again, XXXX suggested I pick up the check but notify them in advance. I complied and provided all the requested documentation, even overpaying on the loan. However, they now refuse to reimburse me, citing a lack of proof of insurance. I submitted the required documentation to the indicated email address, but XXXX, the supervisor/manager, informed me that the email was no longer valid as it wasn't entered into their system, and the person associated with that email is no longer with the company. This should not be my responsibility as a customer, as they should have this information on file. Unfortunately, XXXX terminated the call abruptly, stating she couldn't assist me.

In XX/XX/2019, I opened a car loan with Premier Auto. Recently I discovered that they have been charging me an {$85.00} LDW fee every month since XX/XX/2019, despite having continuous insurance coverage on the vehicle. I emailed proof of continuous coverage and received no response. I then emailed several times and called and left messages after in an attempt to get a response and reversal of these fees. Still, no response. My latest statement for XXXX just posted online and there is another LDW fee attached. I have been charged 19 LDW fees totaling {$1600.00}. There also have been several " Other Fee '' charges as well totaling {$140.00}. I already pay a {$7.00} online payment fee with my normal payment of {$410.00}, making the total I pay each month {$420.00}. I would like to know what these " Other Fee '' charges are for and if they are erroneous, I would like them reversed. I also would like a reversal of the {$1600.00} LDW fees.

I have called Premier Auto Credit in order to request an extension of payment of the car loan and they told me that a document that I need to fill out would be mailed to my address. After 2 weeks I called back because I didn't receive any mail and they told me it was already sent and I have to wait. Alleged 90 days late was a clerical error from the insurance company on total payment amount for total car payoff, total amount was wrong. Then total payment amount was corrected and the car was paid off in full. Premier Auto Credit agreed to remove alleged 90 days because of the insurance payment error, but never did.
