The following is a history of the complaint : I disputed a filing by Preferred Collection and Management via both XXXX and The Consumer Protection Financial Bureau ( # XXXX ) on XX/XX/XXXX. With CPFB, I requested " validation of debt '' and detailed the requests as follows : - Provide a statement which matches the balance being claimed. - Provide a list of charges that total the amount in your original letter. It was my understanding that a properly submitted Request for Debt Validation via certified return receipt mail afforded me the right to request proof of debt. Preferred Management, in turn, only verified the debt once again to CFPB and totally ignored my specific request for proof under the auspices of HIPPA. They responded as follows to XXXX : " ... as a debt collection agency, we are subject to the 'Minimum Necessary Rule ' and will not have access to greater medical details but patients are able to get additional detail from the medical records department at the facility where services were received and/or from their own insurance company. '' And as follows to CFPB : Company 's Response We received a debt to collect on in the amount of {$86.00} from the client XXXX XXXX XXXX XXXX for a date of service of XXXX. The original charge amount was {$1800.00} so this is the coinsurance owed for services rendered. A validation notice was mailed to the patient XXXX. There was no mail return for the validation so pursuant to the mailbox rule, we can presume the patient received it. The account was subsequently reported to the credit bureau on XXXX. Since that time we have changed our software. The accounts from our old system were deleted from reporting and then re-reported using a new internal agency number ( so there would not be duplicated reporting ). The consumer disputed the account through XXXX ( the bureaus reporting mechanism ) around XXXX. The debt was re-verified and a letter was sent to the debtor stating this. Although we dont actively call on such small balances, the account is reported for 7 years from the date of delinquency pursuant to the FCRA. We would consider removing the account from reporting once the rest of the amount owed our client is paid. As far as the amount difference ( {$86.00} vs. {$87.00} ) we can only assume the bureaus round up if the amount owed is greater than fifty cents. I have always had medical insurance coverage and this collection agency expects me to pay without verification of neither the debt nor whether or not they have been duly contracted by the medical provider. Instead, they made an offer to collect and would " consider removing the account from reporting once the rest of the amount owed our ( their ) client is paid '. Please note that the medical debt listed is beyond the 5 year Statute of Limitations for the State of Florida for contracted debt. They list the first date of delinquency as XX/XX/XXXXand is most likely " written off ''. In addition, I disputed another collection agency for a debt incurred in XXXX and they deleted the charges ; perhaps due to lack of verification. While, on the other hand, this agency continues to damage my credit worthiness for {$86.00}. I am requesting that CFPB require Preferred Collection and Management to adhere to The Fair Debt Collection Practices Act and provide, at a minimum, proof of debt. In short, that the account is really my responsibility and that the balance is accurate. Furthermore, that Preferred Collection and Management provide proof that it owns or has been assigned the debt by the original creditor. Preferred Collection and Management has suggested that I ask the original creditor for validation. However, it is Preferred Collection and Management and NOT the original creditor that is holding me responsible and damaging my credit with XXXX. If they refuse to provide the information, please advise what other recourse I have to obligate them to provide the proof of debt?

I would like to request an investigation into the handling by XXXX XXXX XXXX Hospital related to the turning over of my account to Preferred XXXX XXXX XXXX XXXX and that of probably thousands of other patients. On XXXX/XXXX/XXXX, I received a letter dated XXXX/XXXX/XXXX, from Preferred Collection and Management Services , Inc. ( CMS ). My reference no. is XXXX and my client account no. is XXXX.The letter states that it is a collection notice being sent on behalf of XXXX XXXX ( Hospital ) XXXX. There are XXXX invoices listed totaling {$2600.00}, services from XXXX/XXXX/XXXX through XXXX/XXXX/XXXX. The problem is that I owe no balance and my account had been paid in full in XXXX. The notice stipulates 30 days to respond or it will be considered a valid debt. On XXXX/XXXX/XXXX, I phoned XXXX XXXX billing department at XXXX XXXX XXXX XXXX. ( XXXX ) XXXX. I spoke with XXXX about the invoices. I told her that I had no balance and that my account had been paid in full in XXXX. I asked for copies of the invoices. She said that there was no way of determining if my account had been paid or delinquent because the records were under an old billing system which had been shut down and the records and invoices no longer exist. The old system had totally been dismantled. She said Management decided to bring all of the divisions under a new payment processing system and that no information had been retained. On XXXX/XXXX/XXXX, at XXXX, I phoned Preferred CMS. I ended up speaking with XXXX XXXX at extension XXXX. I requested the call be recorded. I explained I owed no balance and that my account was paid in full in XXXX. I requested copies of the invoices and charges that they have. She indicated they have no copies of invoices or records. None had been provided by XXXX XXXX. She indicated that they have received a number of similar complaints. She assured me she would cancel the debt, close out the invoices and clearing the balance to XXXX. I asked for some type of official notice in writing that this was going to be done. XXXX XXXX said she could not but that I had her words she would take care of it. I expressed concern that this would pop up years from now as an uncollected debt on my Credit Report and that was unsatisfactory. I mailed a letter on XXXX/XXXX/XXXX to XXXX refuting the charges. I also completed an online complaint through the Florida Department of Consumer Protection on XXXX/XXXX/XXXX against the Debt Collection Company. Initially, I did not want to file a complaint against the Hospital because I am still a patient there so I submitted my complaint online against Preferred CMS as they are acting as their agent and should have been given the records. I attached supporting documents I had received and the letter I mailed to Preferred CMS. The letter I received in response from XXXX XXXX at the OFR on XXXX/XXXX/XXXX did not seem to grasp the fact that neither the Hospital nor Debt Collector could provide any information or documentation to permit me to refute these charges. I called and spoke with XXXX XXXX on XXXX XXXX, XXXX to explain that the issue is the fact that the Hospital had dismantled the prior billing system and kept no records. They turned over no documentation to CMS and that the CMS representative XXXX XXXX indicated she would remove the debt but said she could not send any letter to that effect. XXXX XXXX indicated that she would reopen the complaint and asked me to email her the supporting documents again and the letter I mailed to the Debt Collector on XXXX/XXXX/XXXX. I sent her the email on XXXX/XXXX/XXXX. Someone suggested that I should also probably file a complaint against XXXX XXXX XXXX for failing to provide the information to their debt collector.

A company called and claims to be XXXX ( XXXX ). Saying I have taken out a loan for XXXX dollars from an online company called always XXXX XXXX. The loan they said was direct deposited to the bank of XXXX in wv. The loan was made on XX/XX/XXXX under my name account number they gave me was XXXX. They also said I worked for a company called XXXX and that they gave the Lender my information to the loan company. I have not worked since XXXX. They have all my information including my social security number, phone number and address they read it to me, i didn't tell them yes or no if that was correct. Preferred Collection & Management continues to blatantly report an inaccurate, unverifiable entry on my credit reports. The alleged entry has an account number as XXXX and the original creditor is XXXX XXXX XXXX XXXX. The entry on my reports reflect that Preferred Collection & Management reported this entry in XX/XX/XXXX on my credit report, yet they did not provide any communication to me. No dunning letter was received from this company. I have never did any business with this company, nor have I ever heard of the company. I have attempted on numerous occasions to gain clarity and insight on this erroneous entry. My first disputes were with each of the credit bureaus and the responses provided from each bureau reflected that the entry was verified by Preferred Collection & Management. To that end, in XX/XX/XXXX, I sent a certified letter to this company. The tracking of this receipt reflects that they did indeed receive the dispute. To date, this company has not responded to my dispute of the validity of the entry they are continuing to negligently report. This company has had over 8 months to respond to me, yet they have not. I submitted two letters to this company as well as to the credit bureaus. In my first dispute letter to them in XX/XX/XXXX, I requested : An agreement that states their authority to collect on this alleged debt ; Agreement with signature of the alleged debtor wherein he/she agreed to pay the creditor, Alleged account number, Date this alleged debt became payable Original delinquency date, Verification that this debt was assigned or sold to collector Complete accounting of alleged debt, and Name and address of the bonding agent for collection agency in case legal action becomes necessary. THEY DID NOT RESPOND. In my second request, given I never received any notification from them with regard to the first dispute, I requested they provide a copy of the financial responsibility page, provide a copy of my signature with the provider of service to release my medical information to them and cease any credit bureau reporting until the debt had been validated by me. They DID NOT. Even more specific is the reporting they are doing among the bureaus. The bureaus reflect different information for this same account. Again, further proves the inaccuracies and their negligence. The payment history for this account lacks veracity. If they are indeed a third party collection company, how is there alleged payment history reporting? This is inaccurate. Prior to reporting any alleged medical entry to consumer 's credit report, the ACA provides a collection company must wait 6 months. This company violated this as well. Their reporting again began in XX/XX/XXXX, a mere one month after they allegedly opened the account. The date opened reflects XXXX XXXX. Consumer law provides that the creditor is expected to respond to your claim within 30 to 45 days and to inform you of the results of its investigation within five business days. It is obvious that Preferred Collection & Management has no intent to honor the law nor respond to my previous disputes ; therefore, in the absence of them not responding with any documentation to validate the alleged debt, this entry must be removed from my credit report immediately.

For months this company has been reporting inaccurate, unverifiable erroneous things on my credit report and ruining my credit score and I am sick of it. This company has ruined my credit score so bad I got denied a loan for my house!! Now I can not provide for my family because of these derogatory marks. These medical bills and other derogatory collection accounts listed on my credit report, are incorrect and NOT mine. Simply verifying that someone used my name, social security number and/or address is insufficient to confirm that I am the person in question and owe this debt. The court has ruled that in Hinkle v. Midland Credit Management , Inc., that during a dispute and subsequent investigation with the original creditor, collector or a credit bureau, that the original creditor or collector, must provide account-level documentation that would hold up when presented to a jury. That means an original contract or similar proof. To this end, I am demanding an itemized bill to include but not limited to : The diagnosis and procedure performed that I am being billed for, Dates of said procedure, Cost of any medication you may have provided, Cost of any medical devices you may have provided, Office Visits, Consultations, Hospital Visits, Misc. As I am not the person who owes this bill, I am aware that providing the information requested may lead to third party disclosure : a HIPAA violation. That would be your problem and not mines, as a consumer. And per the FCRA and FCPA, I am not required to complete a police report since the burden to prove the debt is on you. In addition, a provision of the FACTA regulations is the Notice of Negative Information provision, covered in section 623 ( A ) ( 7 ). I have never received notification that this had been or was going to be listed with a credit reporting agency. FACTA ( Fair and Accurate Credit Transactions Act ) requires creditors, including doctors and hospitals, to give the consumer a warning notice, so the matter can be addressed before a negative item such as this is reported in error. I am also requesting a copy of your in-house procedures that enable you to avoid the problems that lead to improper identification of consumers and the subsequent misreporting to the credit bureaus. In lieu of supplying the information Im demanding, you can simply stop all collection activity, including but not limited to removing this item from all credit bureaus to which it has been reported. If this is not done within 30 days of receipt of this letter, I will proceed to exercise all my legal rights, including litigation, to protect my good name. I have disputed these account entries with the credit bureaus and The XXXX XXXX alike. Per my credit report, these entries were opened with The XXXX XXXX in XX/XX/XXXX. They began reporting these entries on my credit report in XX/XX/XXXX ; however, I never received any communication from this company that they were attempting to collect this alleged debt. I have never heard of this company nor have I ever did any business with them whereby a contract was signed. By not receiving a dunning letter, this is a direct violation of my rights. How am I to dispute the validity of an account if I am never notified. Had I not retrieved a copy of my credit report recently and noticed these inaccurate, unverifiable account entries, I would not have known they existed. Upon retrieving my report, I sent a certified letter with return receipt to The XXXX XXXX requesting that they validate this debt. I received correspondence from the XXXX XXXX dated XX/XX/XXXX and XX/XX/XXXX whereby they attempted to respond to my dispute. Preferred Collection and Management provided copies of documents that are in violation of HIPAA as well as only reflecting a balance of XXXX which is contradictory to what they are reflecting on my credit reports. The balance for the 2 account entries are {$210.00} each ( Total {$420.00} ). How then are they saying they are verifying the account entries. THIS IS A LIE AND DECEITFUL!! Further, if XXXX XXXX XXXX XXXX XXXX has access to private information regarding the nature of the visit and exams and the facility ; where is the financial responsibility page that they should have whereby I granted permission/consent for XXXX XXXX XXXX XXXX to disclose this information? I requested a copy of all paperwork that was sent to me regarding this alleged account as well as a copy of any documents that bore my original signature. To date, to no avail. How then is this company reporting that these account entries are valid? I am aware that HIPAA allows for certain information to be shared with 3rd party collection agencies for the purpose of collecting a debt but NEVER does it allow them to disclose confidential information without written consent. Preferred Collection does not have this information and were negligent in their reporting this entry as well as in the information they sent. This company continues to blatantly violate my rights. I am requesting that this erroneous, inaccurate, unverifiable entry be DELETED from my credit reports IMMEDIATELY!

In XX/XX/XXXX, I initially reached out to Preffered Collection & Management regarding a {$100.00} medical collection that is not mine and was the result of identity theft. I sent them the official FTC report verifying that my Identity had been stolen and that the debt they were attempting to collect was not mine due to this theft of my Identity. They responded by saying that I needed to submit a police report that detailed the identity theft in order to have the debt removed. I work a very busy schedule with very long hours and was unable to immediately get to the the police department to get this report. This is why I was unable to provide the report when they initially requested it. I truly dont understand why this was necessary when an FTC report was submitted. However, on XX/XX/XXXX, I filed a complaint against Preferred Collection & Management. The complaint included the police report ( that they requested in XX/XX/XXXX ) and the FTC report. As a result, the removed the debt, but it then reappeared in my credit report without any type of prior notification, which is illegal according to the FCRA. I really dont understand why this erroneous debt, that obviously is not mine, is still appearing on my credit report. I have provided all the documentation that they requested and it is still there, even after deleting and illegally re-inserting. I just want this account removed once and for all. I have already lodged a complaint but apparently i did n't word this correctly. According to the law Within five days of contacting you, a debt collector must send you this written notice with the amount of money you owe and the name of the creditor. This notice also must explain what actions to take if you believe you do not owe money. I watch my credit and everything owed very very well. I have management services and monitor my credit weekly as my soft inquiries will show you. I was NEVER contacted about this debt until it was reported on my credit. At that time, i disputed because some other Medical Bills happened to come thru as well that i started a payment plan on with the same Medical Facility. Once the dispute came thru i received my first piece of mail from this company. They obviously had my address, and when i called to have them correct the issue properly they knew who i was by my telephone number. This is " parking '' debt and its not fair to the consumer which the cfpb seems to hold strong ground on. Again, as stated before. I know this is my debt and i know its something my insurance should have paid. I will in righting here agree to settle, start a payment plan until the insurance pays what they should, but thats only when this company does this correctly. The day they remove this from my report and do this legally is the day you we start a payment plan to settle this. Parking a debt is illegal and damaging to the consumer. Ive spoken with Preferred Collections on 5 different occasions and have asked them to please verify who went in for service because it wasnt me. Each time they told me that they spoke to their supervisor XXXX and that she was going to escalate it and request information from the original creditor. Its been over 7 months and still no word or verification letter. On the 4th and 5th call it was disclosed to me that the person was treated at an unknown medical facility for a head fracture. Thankfully me and no one in my household has ever experienced a head fracture. On each call, no one ever disclosed to me the name of the medical facility. The last girl I spoke with, XXXX, suggested it was XXXX XXXX hospital because she had a doctors name and she did a XXXX search. I wouldnt take it as concrete information being that this medical visit took place in 2016. It bewilders me that this company is reluctant to delete this bill off of my credit being that they cant even verify that its mine and do not even know the name of the medical facility it came from. I have contacted this company and disputed these charges prior to doing this. I have set up a payment plan wit the Original Debtor XXXX XXXX to pay payments on all debts in their system in exchange for these being taken off of my credit, its close to {$5000.00} plus dollars. On XX/XX/19 I set up payments with Preferred Collection and Management Services. I made one payment online and was sent a statement for the three payments post initial payment. I was looking into why I owed $XXXX in the first place since I had not been billed. When the second payment was due on XX/XX/19 I called and payed the balance to avoid any future payments after agreeing I did owe the balance. On XX/XX/19 my bank was drafted a payment of $XXXX. On XX/XX/18 I contacted Preferred Collections Management regarding an open delinquent account of {$100.00} that showed on my credit report. I have never received notice of this debt via written notice OR phone calls from the creditor. Preferred Collections Management indicated that 2 weeks prior to my call on XX/XX/18, they had returned the debt to the original source and could not accept my payment. I went to the hospital and was discharged on the same day, XX/XX/2023. Preferred Collection Management Services , Inc. contacted me via mail on XX/XX/2023. This is well after the five days they should have reached out, which means they are in violation. I received mail from Preferred Collection and Management Services , Inc., stating they were collecting my debt. I called the original creditor, XXXX XXXX XXXX, and filled out documents requesting financial assistance. I qualified for assistance and got my debt reduced by 90 %. I noticed this collection agency on XXXX XXXX yet they never supplied me with a dunning letter or sent me any communication prior to placing collection on my credit report.
