Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer. ( b ) Notification. A consumer reporting agency shall promptly notify the furnisher of information identified by the consumer under subsection ( a ) of this section ( 1 ) that the information may be a result of identity theft ; ( 2 ) that an identity theft report has been filed ; ( 3 ) that a block has been requested under this section; and ( 4 ) of the effective dates of the block. ( c ) Authority to decline or rescind. ( 1 ) In general. A consumer reporting agency may decline to block, or may rescind any block, of information relating to a consumer under this section, if the consumer reporting agency reasonably determines that ( A ) the information was blocked in error or a block was requested by the consumer in error ; ( B ) the information was blocked, or a block was requested by the consumer, on the basis of a material misrepresentation of fact by the consumer relevant to the request to block ; or ( C ) the consumer obtained possession of goods, services, or money as a result of the blocked transaction or transactions. ( 2 ) Notification to consumer. If a block of information is declined or rescinded under this subsection, the affected consumer shall be notified promptly, in the same manner as consumers are notified of the reinsertion of information under section 1681i ( a ) ( 5 ) ( B ) of this title. ( 3 ) Significance of block. For purposes of this subsection, if a consumer reporting agency rescinds a block, the presence of information in the file of a consumer prior to the blocking of such information is not evidence of whether the consumer knew or should have known that the consumer obtained possession of any goods, services, or money as a result of the block. ( d ) Exception for resellers. ( 1 ) No reseller file. This section shall not apply to a consumer reporting agency, if the consumer reporting agency ( A ) is a reseller ; ( B ) is not, at the time of the request of the consumer under subsection ( a ) of this section, otherwise furnishing or reselling a consumer report concerning the information identified by the consumer ; and ( C ) informs the consumer, by any means, that the consumer may report the identity theft to the Bureau to obtain consumer information regarding identity theft. ( 2 ) Reseller with file. The sole obligation of the consumer reporting agency under this section, with regard to any request of a consumer under this section, shall be to block the consumer report maintained by the consumer reporting agency from any subsequent use, if ( A ) the consumer, in accordance with the provisions of subsection ( a ) of this section, identifies, to a consumer reporting agency, information in the file of the consumer that resulted from identity theft ; and ( B ) the consumer reporting agency is a reseller of the identified information. ( 3 ) Notice. In carrying out its obligation under paragraph ( 2 ), the reseller shall promptly provide a notice to the consumer of the decision to block the file. Such notice shall contain the name, address, and telephone number of each consumer reporting agency from which the consumer information was obtained for resale. ( e ) Exception for verification companies. The provisions of this section do not apply to a check services company, acting as such, which issues authorizations for the purpose of approving or processing negotiable instruments, electronic fund transfers, or similar methods of payments, except that, beginning 4 business days after receipt of information described in paragraphs ( 1 ) through ( 3 ) of subsection ( a ) of this section, a check services company shall not report to a national consumer reporting agency described in section 1681a ( p ) of this title, any information identified in the subject identity theft report as resulting from identity theft. ( f ) Access to blocked information by law enforcement agencies. No provision of this section shall be construed as requiring a consumer reporting agency to prevent a Federal, State, or local law enforcement agency from accessing blocked information in a consumer file to which the agency could otherwise obtain access under this subchapter. 1. I am who I am ( the original creditor ) of all things on my consumer file, I am not a credit repair agent nor paid attorney, I am sending this as myself the original creditor of all " alleged '' debts on my consumer file. I have been violated under multiple incidents by these consumer reporting agencies and will be seeking litigation if problem are not rectified immediately. The following rights of mine I believe have been violated and are causing punitive damages to my life as the consumer of the united states. ( Offenses number 1 ) 15 usc 1681 ( a ) ( 3 ) Consumer reporting agencies have " assumed '' a vital role in assembling and evaluating consumer credit and other information on consumers. I never gave XXXX XXXX or XXXX ( WRITTEN PERMISSION ) to have this information pertaining to my consumer transactions. Because I never gave this permission I believe this offense also falls under 18 usc 1028 aggravated identity theft ( A ) ( 1 ) ( offense number 2 ) Whoever, during and in relation to any felony violation enumerated in subsection ( c ), knowingly transfers, ( possesses, or uses, without lawful authority ), a means of identification of another person shall, in addition to the punishment provided for such felony, be sentenced to a term of imprisonment of 2 years. ( Offense number 3 ) 15 usc 1681 ( Exclusions ) any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device. The credit " alleged '' " inquiries " are a private matter and if they are or were factual they are not supposed to be on my consumer file and report. ( offense number 4 ) 15 usc 1692g I also believe is a section regarding validation of debts. Numorius accounts have be disputed and have come back as validated when I ( THE ORIGINAL CREDITOR ) haven't received any type of notice within five days to verify or validate these " alleged debts '' ( I DO NOT VALIDATE NOR VERIFY ANY DEBTS ON MY CONSUMER FILE ). Furthermore under 15 usc 1692g ( c ) The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. All debts on the public and consumers are already paid for by the united states according to what I believe is 31 us code 3123 The Secretary of the Treasury shall pay interest due or accrued on the public debt. Now im not making threats but under 15 us code 1679g ( civil liablity ) Any person who fails to comply with any provision of this subchapter with respect to any other person shall be liable to such person in an amount equal to the sum of the amounts determined under each of the following paragraphs : actual damages, punitive damages and class action. LAstly under 15 usc 6802Obligations with respect to disclosures of personal information I have the legal right to tell you what is considered private to me and what I demand be removed from my file for the sack of my privacy.

Consumer reporting agencies furnishing inaccuracies on my consumer file. On XX/XX/XXXX I sent a letter to US Bankruptcy asking if they furnished or was asked to furnish an alleged bankruptcy on my consumer report by the big 3 consumer reporting agencies? ( XXXX, XXXX, and XXXX ) I Received a letter dated XX/XX/XXXX from US Bankruptcy Court XXXX XXXXXXXX XXXX XXXX stating that they are not associated with any consumer reporting agencies. What is included or expunged is from a consumer report is determined by the credit reporting agencies. Since XXXX did not get this information from the court, I need to see a copy of the documentation you have in my consumer file as to where they did receive this information. Federal Privacy Act of 1974 - 5 U.S. Code section 552a. This law applies to the access to, and disclosure of, records of individuals held by federal executive and regulatory agencies. It requires such agencies, with some exemptions, to limit disclosure, provide access to the individual, and to apply basic Fair Information Practice Principles to such records containing the personal information of individual U.S. citizens and legal alien residents. According to 15 USC 1681 ( a ) ( 4 ) There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. XXXX and XXXX are reporting date filed on XX/XX/XXXX, while XXXX is reporting the date filed as XX/XX/XXXX. Thus, making my consumer file inaccurate. The second inaccuracy in my consumer file would be the fact that the reference numbers do no match. XXXX reports the reference number as XXXX, XXXX reports XXXX, and XXXX reports XXXX. Another inaccuracy. The closing dates and the courts are also inaccurate. My rights protected under the FDCPA and FCRA have been violated. I never gave any person permission to furnish any information on my consumer report and my privacy as a consumer has been infringed upon as well.

To Whom It May Concern, It is a crime to threaten lawsuit with no intention of doing so, therefore you can take heed that I am very serious about filing suit against your company. I have sent 3 previous letters to you, all by certified mail ( receipts enclosed ) requesting that you remove inaccurate information from my file and you have failed to do so. Accordingly, I can show a judge that these accounts are inaccurate and that you violated the Fair Credit Reporting Act by ignoring my requests to investigate the items. My previous letters stated my reasons for an investigation and these reasons were not frivolous in any way. If this final request does not prompt you to conduct a proper investigation of these accounts in question, and send proof to me of said investigation, I will file a civil suit in my county for damages and you can travel to defend yourself. I take my credit very serious and your lack of professionalism and assistance disappoints me. I am well aware of my rights under the Fair Credit Reporting Act and I intend to pursue them to the maximum. I await your response.

I have been disputing this issue with all three credit agencies to get them to agree to remove the negative items from my credit report. This have been going on for years now and I have reached out to credit repair companies with little or nothing with no resolution. Right now I have two bankruptcy on my credit report. A XXXX XXXX and XXXX, but they are the same case and this type of reporting is not right. I have also sent them documents showing this with no response. So if you are trying your best to better yourself and get your credit back right why wouldnt they try and help. Also I believe that statutory timeline as defined by the Fair Credit Reporting Act ( FCRA ) for at least the XXXX XXXX bankruptcy because thats been on my credit report since 2016. So if you guys can help in any way that would be greatly appreciated. Thanks and if you need me to send in any documentation please let me know.

So i was forced to file Bankruptcy do to the fact that my father information was attach to my credit. His name and mine is very close. but on the credit report it had his creditors his date of birth and his address. I did dispute but my credit has not got pass XXXX and each time it get to the point that maybe i can buy a house or purchase a vehicle that im in need of it drops. I've been trying to get it off my credit because if i was told the only way i could get his items off was to file. It showed that they weren't mine. i tried to fight it. i called the lawyer but he never reply. i think it isnt right do to the fact that i had a trach it made me handicap..this bankruptcy with XXXX balance from the beginning because the accounts wasnt my creditors

Hello, I hope this message finds you well. A couple of months I reviewed my credit profile and seen inaccurate information regarding an alleged collection XXXX XXXX Bankruptcy. The status is reporting late. I find that strange since I don't recall being late at all. Prior to submitting this complaint, I have sent over 3 letters to the Bureau to have them send the proper validation of this alleged late payment. I have even requested bank statements to be provided to prove that the payments were indeed late. However, all bureaus have avoided me. This makes me angry my consumer rights are being violated! I have the right to dispute any misleading information. I saw a ton of inaccuracies. Doesn't this go against the FCRA Laws?
