To Whom It May Concern : I am writing this letter to inform you of the deplorable customer service and the unfair and deceptive acts and/or practices of XXXX XXXX XXXX concerning my Loan Modification application. I believe that XXXX XXXX XXXX managers are not treating my Loan Modification application fairly as well as committing due process violations because I have a bankruptcy that has been discharged. On Wednesday, XX/XX/XXXX, I applied for a Loan Modification of my second mortgage thru XXXX XXXX XXXX XXXX XXXX with XXXX XXXX, Housing Counselor Supervisor, ( XXXX XXXX ). This option was chosen because my loan with XXXX was maturing on XX/XX/XXXX. The balloon amount that was due at that time would be {$31000.00} of which I could not pay so I applied for a Loan Modification. XXXX XXXX completed the necessary paperwork and faxed it to XXXX Loss Mitigation Department on XX/XX/XXXX. XXXX received the paperwork indicating my intent to keep my home and apply for the modification on XX/XX/XXXX. On Monday, XX/XX/XXXX, I called XXXX XXXX to get a status update on my loan application and spoke with Account Representative XXXX ( XXXX ). He stated that I did not qualify for a loan modification and that a promissory note would be a better option for me, since my payments would be applied to the principal. I said ok. So he then told me what documents were needed to complete the process and that he could email or mail me a cash flow template that was needed to be completed. However, I was still expecting a letter of explanation for the denial of my loan modification application, along with other options that were available to me to be mailed. On Thursday, XX/XX/XXXX, I called to speak with XXXX to see if he could email me the cash flow template. He said that he would email it but I did not receive it. On Friday, XX/XX/XXXX, I called and spoke with Account Representative XXXX XXXX XXXX XXXX about my account because XXXX was not available. Since I did not receive the cash flow template, I asked if he could email it to me and he did. Later that evening, I faxed all the necessary paperwork back to XXXX for review. From this point on, it has now become a cat and mouse game. I would call XXXX to get an update on my application and would not be able to get through to their line, getting a recording stating that my call could not be completed as dialed and that I would have to try my call back later, or XXXX was not available, or when I did reach him, he would state that he did not get a chance to review my application. So I kept calling XXXX to get a status update on my promissory note application on several occasions. All while still waiting for my letter of explanation for the denial of my loan modification application, along with other options that were available to me in the mail. It never came. Please note that I made these calls from my cellphone that keeps record of the date and how many times I called a number. On Wednesday, XX/XX/XXXX, I called XXXX and the line was busy. On Monday, XX/XX/XXXX, I called XXXX and the line was busy. On Wednesday, XX/XX/XXXX, I called XXXX twice. On Monday, XX/XX/XXXX, I called XXXX twice. On Monday, XX/XX/XXXX, I called XXXX 14 times. I believe that I spoke with XXXX concerning the cash flow template for the Promissory Note. He stated that it was inaccurate and needed to be corrected. I corrected it and faxed it back to him later that evening. On Thursday, XX/XX/XXXX, I called XXXX and the line was busy. On Friday, XX/XX/XXXX, I called XXXX four times. On Monday, XX/XX/XXXX, I called XXXX four times. On Tuesday, XX/XX/XXXX, I called XXXX twice. On Wednesday, XX/XX/XXXX, I called XXXX twice. On Friday, XX/XX/XXXX, XXXX called me at home @ XXXX. He told me that he finally had a chance to go over my paperwork and stated that because of my income I would have to pay a down payment of {$15000.00}. I simply explained to XXXX that I could not afford that. I am finally getting back on my feet from battling XXXX XXXX and getting back into the workforce. He then asked me what down payment could I make? I told him none. At this point, I am perturbed to say the least because XXXX never told me that I had to make a down payment when I spoke with him concerning my loan modification application on XX/XX/XXXX. So then I asked him why was I denied a loan modification and he stated that it was because of my account. He also stated that I was behind in payments. I then asked him if they were trying to foreclose on my home. His answer was not encouraging. So I asked him why didnt I receive a letter explaining this denial because I know for a fact the paperwork was sent to his bank in XX/XX/XXXXand that I can surely confirm this fact. He then stated they did receive my paperwork on XX/XX/XXXX ; but that I needed to use their loan application in order of applying for a loan modification. I stated that that was ridiculous because they could have mailed me the application especially since my paperwork clearly stated my intent to keep my home and apply for a loan modification. At this point, I asked him for the name and number of his superior. He said his name was XXXX XXXX XXXX XXXX ( XXXX ) or XXXX XXXX. He stated that XXXX XXXX XXXX XXXX was fully aware of the situation. So I told XXXX that if that is the case, then I would be making a formal complaint to the CFPB. XXXX then stated that he knows that our call is being recorded and that he didnt want to say the wrong thing. He then stated that he would send his superior an email about seeing what he could do about lowering the amount of the down payment for the promissory note. He assured me that they were not foreclosing on my home and that he would work out something for my account. I told XXXX that I could not afford to pay a down payment. He stated that he was going on vacation and would be back early XXXX and would get in touch with me then. On Monday, XX/XX/XXXX, I called XXXX and the line was busy. On Wednesday, XX/XX/XXXX, I called XXXX to speak with XXXX XXXX XXXX XXXX or XXXX XXXX. XXXX informed me that they were both in a meeting. She asked if she could help me and I explained the situation to her concerning the loan modification and not receiving a letter of explanation for the denial of my loan modification application, along with other options that were available to me. She stated that if I dont qualify for the loan they do not have to send me an application or letter of explanation. Her remark was disturbing since they are not willing to explain my disqualification in a letter. So I told her that I would report them to the CFPB. On Friday, XX/XX/XXXX, XXXX XXXX called me and left a message to return her call. I called her back and explained the situation with XXXX to her. She stated that I did not qualify for a loan modification and that my home is not in foreclosure. I also told her that I could not pay a down payment. She then stated that she would reassign my case to someone else to handle. I asked her when I should expect a call from my new representative, and she said next week. I never received a call. On Wednesday, XX/XX/XXXX, I called XXXX and the line was busy. On Thursday, XX/XX/XXXX, I called XXXX while sitting in the office of my Housing Counselor, XXXX XXXX as we were trying to find out the status of my application for my second mortgage. So I called to speak with XXXX XXXX to find out why my new rep never called me back. But she wasnt available. So I told the rep that I would like a loan modification packet sent to me. He asked for my account number and stated that he had to transfer me the right department. XXXX came on the line and I again requested that a loan modification packet be sent to me. She refused. She stated that XXXX is working on a Promissory Note with a lower down payment for me. She asked if I could make a {$500.00} upfront payment, and told her maybe. However, I told her that I would prefer a loan modification, and that I felt like they are cornering me into a promissory note agreement. She then stated that XXXX would be back on Monday, but Account Representative XXXX XXXX XXXX XXXX would call me tomorrow to go over my account with me. I said fine ; but, at this point, I would be alerting the CFPB. She said fine. Account Representative XXXX XXXX XXXX XXXX never called me. Sir or Madam, this situation has caused me extreme emotional distress. I think it is only reasonable for me to expect that XXXX XXXX XXXX would act with reasonable skill, care, diligence, and in accordance with the highest standards. I also expect a good faith and fair dealing duty in connection with any transaction, practice, or course of business associated with my home mortgage loan. Although, a XXXX XXXX XXXX application was not used, XXXX was fully aware of my intent in keeping my home and applying for a loan modification. They could have sent me the application in the mail. I should have gotten a written response to my application, of which they received on XX/XX/XXXX, within a reasonable amount of time, at least within 30 days. However, I never received a letter of any kind from XXXX XXXX XXXX concerning my application status for both the loan modification and Promissory Note. XXXX XXXX XXXX is violating my due process rights in applying for a loan modification. I have even asked them outright to send me the loan modification application packet ; and they refused. Please keep in mind that all telephone calls are recorded for quality assurance. It is disheartening to report that this experience is very distressing and offensive to say the least. No one should have to endure such malfeasance in their time of need. I do hope that the corrupted and the unfair and deceptive acts and/or practices of XXXX XXXX XXXX will be thoroughly investigated so that this debauchery does not happen to someone else in the future.

I would like the CFPB to be aware of the deceptive business conduct and illegal practice in which XXXX XXXX aka Popular Bank is engaging, and I would really appreciate that all the appropriate government agencies should take precaution and legal action into the deceptive business conduct in which they are engaging in on a daily basis. And I am also praying and asking for help that the government should help me with my current terrible situation to which I will try to describe my situation as clear and as possible. But the bottom line is that I have {$19000.00} stuck in Popular Bank and there is absolutely nobody to talk to! Since my English is not the best anyway I decided that it is better for everyone to make it as short as possible and just get right to the point and should any additional information be needed I am sure that all of these government agencies to which I am filing my complaint will have my direct cell number and email address to contact me. To the best of my knowledge, I do understand that there are some government agencies, and in particular the CFPB which are self funded, which means that they can only survive if they themselves will go and take legal action against these deceptive conduct which these banks are constantly engaging in. And the reason these banks are constantly engaging in the deceptive business conduct is because they abide by the theory that they will never be caught. But I really want that all government agencies should make my case an example, so these banks will no longer be doing this, plus they will be able to sue and make billions from giving huge fines to these banks! Let me start as I said to make it as short as possible. On or about XX/XX/XXXX I applied online to open a checking account at Popular Bank. Shortly thereafter I received an email with instructions on how to fund my account ( I will attach a copy of that email ). My account number is : XXXX The next step was that Popular Bank send you by mail a signature card which is five pages long, it was meant to have your signature on file, it was also meant to ask you if you want a debit card and checkbooks, and the last two pages were simple questions as to give them a understanding how you will be using the account. And I will be attaching this as well. I actually really never made use of this account I actually found it very useless and I was actually thinking of closing it, but I was basically procrastinating. My initial deposit was posted on XX/XX/XXXX in the amount of {$25.00} from my external account ending in XXXX. The year XXXX I basically only had two transactions that occurred on this account, the first one is the {$25.00} initial deposit, and the second transaction occurred on XX/XX/XXXX for {$14.00} and that was for the checkbook, although I called in and told them YOU NEVER TOLD ME NOR EVEN MENTIONED ANYTHING ABOUT BEING CHARGED FOR THE CHECKBOOKS I was promised a refund, BUT THAT NEVER HAPPENED!! The year XXXX only had I believe 30 transactions which most of them were a $ XXXX monthly maintenance fee and another few were a fee for CHECKS I DEPOSITED but they decided its no good and charged me a NSF fee for it. The real big issues all began on XX/XX/XXXX. XXXX, I also printed out the transactions so you can see exactly what I am referring to. The name of the XXXX that I will be attaching will show those transactions and its named Started on XX/XX/XXXX As you can clearly see from my account and from the last statement and from the XXXX that I attached and from the screenshot that I took logging in to my account via online banking, that on XX/XX/XXXX I made two mobile deposits, one in the amount of {$2000.00} and the other in the amount of {$8000.00}. Following these two mobile deposits I received a email. The first email was acknowledging that they received it, and the second email came later acknowledging that they actually accepted the mobile deposit ( I will be attaching a XXXX printout of the emails ). Then on the 9th I deposited a check for {$9600.00}. So basically 99.9 % of my balance was made up of these 3 checks, and as youll see from all my attachments ( and even now as we speak ) my CURRENT BALANCE IS : {$19000.00} However, somewhere I don't know exactly which day, but it was definitely within the next two weeks after I made these mobile deposits that Popular Bank decided to RESTRICT MY ACCOUNT! But they also decided not to tell me that they RESTRICTED THE ACCOUNT! Since I had no idea that my account is restricted ( because even now if I want to deposit money itll gladly take it. In other words they are good at taking, but thats it! ), and in fact how in the world am I supposed to know that my account is restricted if they do not call me to tell me and when I login I clearly see that the check deposits cleared and it's available for use. So basically I went ahead and on XX/XX/XXXX as you can see from my transaction history, and this was the second to the last transaction on the account, I went and I wrote out a check to a business in the amount of {$19000.00} ( I will also attach a copy, a picture of the check ). The check was made payable to XXXX XXXX XXXX and it was meant to pay rent for a full year in advance for a three-bedroom apartment. But I received a phone call from them before I even knew that the check did not go through, because I didn't even know that Popular Bank restricted my account and they began yelling at me that they are having issues with their bank because of my check, and that their bank ( which was XXXX XXXX XXXX ) imposed a lot of fees on them. I then began every single day for at least ten times a day to call Popular Bank to find out exactly what is going on with my account. So, 30 % of my phone calls just ended with the representative telling me SORRY I HAVE NO IDEA WHAT THE PROBLEM IS, EVERYTHING SEEMS TO BE OKAY. Another 30 % of my calls ended up with the representative telling me that I called in to late, and the department I need to speak with is closed, and then the representatives began changing the story and telling me that THERES ONE PARTICULAR PERSON THATS HANDLING YOUR ACCOUNT, AND YOU NEED TO GET IN TOUCH WITH HIM BECAUSE ONLY HE IS ABLE TO HELP YOU! But they had no idea on how to guide me or tell me how I am supposed to get in touch with him. So as we speak I am still calling everyday 10 times, and some reps just transfer me for hours until we get disconnected, then some reps tell me I need to call back to speak to this very special person thats handling my account, and since yesterday they began just hanging up the phone on me as they just didnt know what to do or say anymore. I will be attaching a lot of data proving my Identity & also that I opened the account & that everything worked perfectly fine until I guess after my 3 check deposits. If needed I also prepared a copy from all 3 checks that were deposited showing that they cleared, but I also got a copy from the people that gave me the check showing from their bank that it cleared and it went through. I apologize, I am very not professional in filing claims, but you should get an idea from all my attachments what they are. And remember you can always call, text and/or email me with any questions! I am requested from the CFPB to start with giving Popular Bank a HUGE fine, and it should make headlines!! Then I need {$6000.00} in damages as I lost that apartment for which I paid the {$19000.00} Then I need the CFPB help me get out from Popular Bank all my money that I have by them, which is {$19000.00} Thanks XXXX XXXX XXXX XXXX XXXX

I opened a new checking account online with XXXX XXXX XXXX on XX/XX/XXXX in response to an offer they were promoting. ( {$500.00} bonus for opening new checking account ). I logged in, started set up of two external XXXX accounts for transfers. They did 2 test deposit in both of my XXXX accounts. I followed the email link to verify the test deposits. I successfully verified the XXXX checking account. When I went to proceed with verifying the XXXX savings deposits, I received an error message stating that I could not add any more external accounts. I decided to wait and try again another day. When I went to login the next day, I was locked out. I could no longer access my account online. I called in on XX/XX/XXXX to get help accessing my account. They told me my account was locked because they could not verify my external account. I was then asked to submit a copy of a XXXX statement to verify the external account. I emailed the statement and realized that my bank, XXXX had not updated my married name on my statements. ( It still had my maiden name listed from 14 years ago ) I asked XXXX XXXX if they could accept any other form of verification since this was not something that would be immediately fixed by XXXX but decided to just remove the external account altogether thinking this would streamline the confusion and allow me access back into my account. They phone rep did this and told me I should be able to log in within 45 minutes. As of today I still can not log in. Now today is the deadline for the {$500.00} bonus and I was told that I would not qualify for either of them because : 1. I can not qualify for the {$300.00} bonus because there is no way for me to deposit the {$10000.00} by XX/XX/XXXX. Because I could not access my account I could not set up the transfer in time and there is no local branch near me. I also do n't see anywhere that the {$10000.00} deposit has to be deposited by XX/XX/XXXX, just that the promotion ends on that date. It just says that the money has to be new money and the {$10000.00} balance has to be maintained for 60 days from the date of deposit. 2. I can not qualify for the {$200.00} bonus because they are telling me that the direct deposits have to start before XX/XX/XXXX. I do n't see this written anywhere. According to the way I read the promotion, it only states that direct deposits must start within 60 days from account opening. Because I felt that the details of this offer was misrepresented and that I was having such problems accessing my account, not to mention calling in always resulted in a hold time of 10 minutes of more for a representative, I did not feel confident about doing business with this bank so I asked them to just close the accounts. At this point they told me that closing an account would result in a charge of {$25.00} for 6 months. I asked to speak to a supervisor. Same answer. I feel this bank completely misrepresented the offer to entice you to open an account, did not fairly disclose all the requirements and now refuses to work out a fair offer to address the mishandling of this issue. Details of the offer according to their website : 1.Promotion begins on XX/XX/XXXX and ends on XX/XX/XXXX. 2.To receive the promotional {$200.00} cash bonus, open a new Popular Prestige Checking or a new Popular Everyday Checking account in any XXXX XXXX XXXX branch or via XXXX, which shall be subject to our approval, and set up recurring monthly direct deposit within 60 days ; the direct deposit needs to be an electronic deposit of sources such as payroll, pension and government benefits, among others. The {$200.00} cash bonus will be deposited in the account within 90 days of account opening, if the checking account is in good standing, a direct deposit has been received in the account within 60 days and all requirements are met. 3.To receive the promotional {$300.00} cash bonus, open a new Popular Prestige Checking account or Popular Everyday Checking, in any XXXX XXXX XXXX branch or via XXXX, which shall be subject to our approval. Deposit {$10000.00} or more of new money into the Popular Prestige Checking or Popular Everyday Checking account and maintain {$10000.00} or more of new money for 60 days from the date of deposit. My loan was XXXX in a bankruptcy in XXXX and never reaffirmed. I received a notice in XXXX XXXX that I was being reported as delinquent on my credit as the original loan ( which was bought out by Banco Popular from the original mortgage company ) was matured and required a payment in full of {$27000.00}. I asked what I was supposed to do and was directed to submit for a refinance to avoid delinquency. I submitted the application in XXXX XXXX and was paraded through numerous requests for information, no status follow up, and each time I called in there was a different reason or request that was delaying my application. Once the application was approved for review on a refinance at the end of XXXX XXXX, it was another week before I was able to realize they were processing my refinance on a home that I did not own. After getting them to finally realize their error, they processed my application and denied me for a refinance on the home I do own. I asked the bankruptcy department at Banco Popluar what was I supposed to do and was then directed to a loan modification. I also asked if my financial information that was provided would be forwarded to the loan modification department, as they received pay stubs and my XXXX XXXX and was told yes, the underwriter for the loan modification would use that information from the refinance to assist with the loan modification. I submitted my loan modification application with the requested bank statements, 1 month of pay stubs, expenses, and application in the first days of XXXX XXXX. I was contacted via email from the bank on XXXX XXXX that they were requesting 2 months of pay stubs and I needed to submit that before I would be considered for a loan modification. Despite my numerous attempts to have discussions on the phone, it was my discovery that they were not logging all of my phone calls made as they stated they only had record of one phone call from me regarding the additional requested pay stubs. I informed them again on the phone at the beginning of XXXX XXXX that I did n't have the prior months pay stubs accessible and was told to send an email stating that for underwriter review. No one made any contact with me after my request was sent so I contacted the bank on the phone again for status and was told again that I needed the prior months pay stubs and they would do nothing with my account until I had the 2 full months pay stubs ( even though one full month is required for the loan modification ). I asked if I had any options as the pay stubs could not be regenerated from my company and was offering if I could get whatever report was generated from my company pay roll department and they said it should be fine. The representatives offered me no assistance with the information I could provide, I was constantly having to offer solutions to get them what they needed. The underwriter had my XXXX XXXX along with a current months paystubs but I was told that it was not enough and they were doing ME a favor by waiting this long and should have just denied this application already. I told the representative this was ridiculous and informed them that I was out of town due to the holidays and would get it to them the following week. His response to me, during that XXXX XXXX, XXXX call, was that I could think this was ridiculous all I wanted but I 'm not going to get anywhere until I provide the additional months of pay stubs. I made strong efforts to get it handled that day and was able to email over the report generated by my company payroll department. I had no contact from Banco since then and finally called them on XXXX XXXX, XXXX to which I was told that it looked like my loan modification was denied, but they were n't really sure by looking at it and would be transferred to a different representative, which at that point they hung up on me. I have had enough bullying from this company and refuse to sit by while this bank mismanages my credit and loan information. I have followed every direction and provided all the documentation that was required of the application. This loan should never have been allowed to go delinquent on my credit in the first place as it is XXXX in a bankruptcy and should have taken possession of the home. I am curious if I am being directed to go through this process as a way of Banco Popular finding a way to deceive me, put me to collections and collect a dollar amount on a property that was already released through bankruptcy.

Your bank and contract lockbox vendor are doing a terrible job. You must know about the details, and I assert you must immediately fix the multitude of problems. GROSS INCOMPETENCE XXXX XXXX XXXX 1. I have XXXX XXXX XXXX mortgage loans I pay every month every year every time on-time without exception. 2. Something has changed with your XXXX contract vendor in the past year it appears. I pay four loans on one check with ALL payment coupons enclosed and stapled to the check. My computer printed check clearly notes the loan number and correct cash application times 4 payments = total check amount. 3. XXXX is unable, incapable, and incompetent to read the double documentation ( check amounts to be applied and the payment coupons enclosed ). Apparently XXXX simply takes the total check amount and randomly applies it to whatever coupon pops up first leaving three other loans unpaid. 4. Your failure to correctly apply cash repeated several times over the past year resulting in threats of foreclosure and credit bureau derogatory reporting has resulted in my credit score dropping from XXXX to XXXX today. I HAVE BEEN HARMED BY YOUR SLOP SERVICE. 5. Your banking staff has left unrequited their promise to remove late fees completely with a lingering late fee reported to the bureaus in addition to the notices of default and foreclosure threats. 6. I have repeatedly and constantly called your staff including an XXXX in New York offices to no avail and no results. GROSS INCOMPETNCE CUSTOMER SERVICE DEPARTMENT 1. After repeated and vociferous complaining XXXX Customer Service Department researched all XXXX loans and sent me a two inch stack of paper. 2. THE PHONE NUMBER ON ALL XXXX LETTERS IS WRONT!!! See attached : XXXX. This number is for XXXX XXXX XXXX ; has XXXX XXXX entered into a new business? 3. Are they hiding? Is there anybody doing quality control and checking at XXXX? 4. To add insult to idiocy the Customer Service Department ordered me to : The payments must be made separately for each loan with the corresponding coupon and we recommend entering the loan number on the face of the check. 5. It is a gross violation of FDIC Federal Deposit Insurance Corporation for XXXX XXXX to add and modify terms of original loan without my approval. I can not and will not be told I can not make multiple loan payments on one instrument. There are no terms or conditions in original XXXX XXXX XXXX loan terms that specify payment other than by mail of POP Point of Presence retail location or other headquarter locations where official bank business is transacted. 6. Besides, I have paid multiple items on one check for every single year of these loans since inception. XXXX XXXX has changed ; not me & not my payment practies. IMMEDIATE SOLUTION 1. For the foreseeable future I will be mailing USPS First Class Certified Registered Return Receipt Requested payment remission to the Office of XXXX to your personal attention. 2. I will have signed dated effective date of delivery for payments. 3. I assume you can find someone in XXXX XXXX knows how to apply cash from a check. 4. OR, I could just mail ONE check with one long listing of loans and their payment amount with the payment coupons thrown into the envelope for you to figure out. 5. Either way, I will not tolerate the current situation. DEMANDS for IMMEDIATE RESOLUTION 1. By return USPS first class mail confirm receipt of this letter with a wet signature. 2. Payments made to Banco Popular corporate headquarters in XXXX XXXX, Florida to the attention of the Bank President XXXX XXXX XXXX certainly constitutes a valid holder of the Note ( Banco Popular ) POP. 6. When dialed and answered this number provides no opportunity to dial any extension number and thus no access to Ms. XXXX XXXX. 8. A senior XXXX management team member named Mr. XXXX XXXX titled Sub-Servicing along with his immediate scaler supervisor Mr. XXXX XXXX titled Managing Director Client Relations and his immediate scaler supervisor Mr. XXXX XXXX titles Senior Vice President Enabling Functions have all reviewed and agreed to refuse to accept my payments. I have been a customer of Popukar bank for approximately 20 years and up until now I never had a problem or issue with service or staff. I most say this tedious experience have left me as a very displeased, overwhelmed and frustrated customer with this current situation. I made this particular visit to inquired information regarding my son being added to my account to receive his unemployment funds. He was XXXX just finish school and was doing temp XX/XX/XXXXwork at XX/XX/XXXX, due to the Pandemic he was laid off and instructed to collect employment at the current time he did not have a bank account to receive the funds due to closure of banks. I visited my bank that was opened a few hours a day to see the procedures need for his funds to enter my account. The teller and I exchange several conversations regarding this matter she informed me that I do not need to add my son if he will not be accessing the account. I reply he will not be accessing the account only I will be contiuning all transactions on my account and she replied then you dont have to add him and it shouldnt be a problem. His funds enter my account and I begin transfer the funds to his XXXX XXXX. A week he received back money unemployment owed him and that was sent to my account as well. She instructed me to bring in my son XXXX with his ID and unemployment statement so she could add him to the account and we could have access to his money as well as mines. I did just that and was informed 3 days later that restriction was still on due to investigation by the fraud department. I been to visit the branch will i reside due to working from home to recieve updates on my account. Popular Branch on XXXX XXXX was very informative and said it's a process but will be resolved real soon. After back and fourth and 16 complaints to consumer services. They reached out to the manager on XXXX, who then reached out to XXXX to discuss the situation. They instructed me to bring my son in with his documentation to be added to the account instructed by the fraud department. He stated it would take 24 hours for the restriction to be lift. I waited 72 hours and made a visit to the XXXX XXXX branch and spoke to the manager once again. He replied I thought the restriction was lifted and had me speak to the back-manager XXXX who apologize for all the back and fourth and he stated he will reach out to the Fraud department to expedite the restriction. I call back 2 days later and was informed XXXX no longer work for the company. I then called the branch on XXXX and learn XXXX is no longer working at the branch, I ten called XXXX to speak to the manager and he was on vacation. I called several other branches as was referred bank to the branch that had my account. My son contacted unemployment on several occasion regarding this matter and they are unaware of any problems or funds being returned. I was informed that the money was scheduled to return to unemployment 3 weeks ago, which makes absolutely no sense at all. My son is on the account, you have his ID and paperwork, just give me access to my funds and so I can put this experience behind me once and for all. Banco Popular is reporting inaccurate information on our credit report regarding a loan we had with them in XXXX. We have made every attempt we can to contact them report this accurately on our credit report or to give us a demand for the amount they say we do owe so that we can clear this from our credit report. Not only are they reporting that we owe them money we do not owe, we can not get a hold of anyone that can give us any information on how we can get this cleared up. We have contacted them 9 times over the last 15 days at this phone number : XXXX. After being on hold no less than 45 minutes and as long at 1 hour and 15 minutes we are told this is a banking center and we are given the number for the loan center. We have contacted the loan center 9 times over the last 15 days at this phone number XXXX. We are prompted to enter our account number, once we have done this the phone system disconnects before anyone gets on the phone and before we are prompted to enter in any other info. We also have had an independent 3rd party credit reporting agency ( XXXX XXXX attempting to verify this account for us and they too are unable to get in contact with anyone at Banco Popular to verify this account ) This Banco account was an old HELOC loan from a property located at XXXX XXXX XXXX XXXX # XXXX, XXXX, CA This property was purchased as our primary residence in XXXX. The property was foreclosed on in XXXX. When we purchased this property we obtained a first mortgage XXXX XXXX and a second HELOC mortgage from XXXX. XXXX then transferred servicing of the 2nd mortgage HELCO to Banco Popular. This Banco loan that is reporting on our credit with a balance owed was a purchase money 2nd mortgage. The property is located in California. Since California is a non-recourse state any amount due on the 2nd mortgage at the time of foreclosure would have had to be reported as 0, property foreclosed. We are requesting that Banco Report this account accurately on our credit report as 0 balance due. If they can not be reached and do not reply to requests, we request that this account be removed from our credit completely as an unverifiable account. In XXXX after a storm we had flooding in the unit. The HOA insurance and our HO6 insurance would not pay to have it fixed as it was considered and act of XXXX. We were upside down on the home. We attempted to work with XXXX XXXX and Banco to negotiate a short sale. Neither lender was able to come to an agreement for a short sale and the property was ultimately foreclosed on. Regarding the BANCO trade line on the credit report that is showing a balance due. This trade line is the HELOC 2nd Mortgage that was obtained to acquire the property located at XXXX XXXX property. The original lender was XXXX. XXXX is a subsidiary of BANCO Popular. The borrower has requested that BANCO update this account to show it is closed with no balance. They have attempted this multiple times over the course of the last 3 years. I too have requested a credit supplement asking for this account to be accurately reported as closed with zero balance. BANCO has not responded to XXXX XXXX Request for accurate reporting as of today. It appears that BANCOs inaccurate reporting of this account is also a violation of current CFPB standard. Since this account was originally acquisition funds and California is a Non-recourse state, this account would have automatically been closed with a 0 balance due, when the home was foreclosed on and sold to the new owner. I have provided the original Acquisition HELOC, Grant Deed and First Mortgage Deed of Trust, and the Subordination to the new XXXX XXXX Deed of Trust in XXXX to establish the chain of events and to support that this account is in fact acquisition money that would have been stripped off at foreclosure.

He had to call me in the US ( XXXX XXXX ) an d have me conference in Banco Popular who g ave him the run around, before hanging up on him several times, because they were frustrated that he ( at XXXX years old and with an education level of XXXX XXXX , was unable to answer the questions they were asking him. When we finally got through to a representative who was willing to assist him, she ordered the new card for him, but told him she was unable to send to his address in XXXX and he would have to travel to XXXX to pick-up ... He asked if he could change his mailing address to his sister 's house, so she would be able to send via XXXX upon receipt. The rep advised him that she would have to transfer him again to the queue, so they can assist him. He was on the phone for over an hour and the issue was not resolved. I called last week and explained the situation to a rep and she advise d me ( hi s son ) that a manager would call him back ... it is now one w eek later, no call back, so he called again this morning and verified all his personal/pertinent information, but because he was unable to answer questions pertaining to a XXXX XXXX and " XXXX '', they told him he was unable to update the address. When he asked who is XXXX and XXXX , he was advised that the ban k security system u ses random questions, about individuals tha t may or may n ot be associated with him .... Issue # 2 ... this totally confused him, he verified name, SSN, DOB, Address in XXXX , amoun t being deposited into his account and they were unable to address his concern. They told him he would have to travel to XXXX to speak to a rep at the branch .... this is a XXXX year old retired man, who lives on a fixed income and depends on these funds for his survival ... he is unable to afford a plane ticket to th e US, jus t to speak to someone in person and the next time he is scheduled to visit, is when he has a doctor 's appointment in XXXX / XXXX . There should be an easier way for retired individuals, who spend their whole life working in th e US and saving their small paychecks to be able to retire in peace, to be able to communicat e and resolve simple administrative issues with their financial institutions.

To my surprise, on XXXX XXXX, XXXX, I received a credit score alert stating that my account with Popular Community Bank was delinquent and that my payment was 90 days late. I have never made a late payment on my account with Popular Community Bank, actually, I usually pay off the balance on my account at the end of each billing statement. I have endorsed checks as proof that my payment was received by Popular Community Bank and processed by them on time. As a matter of fact, I sent 2 separate checks during the month of XXXX for my XXXX payment- the above account is in reference to this payment. I sent the first check in the amount {$3200.00} to pay the balance in full and the second check was a {$10.00} payment to avoid any additional fees. Although my first check was received on time, Popular Community Bank did not post it until weeks later and this mistake has drastically affected my credit score. I have spent more than 5 hours on the phone with Popular Community Bank trying to correct their mistake. I have been given the run around, and then told I need to speak with a bank supervisor, who is conveniently not available at the moment. I also emailed 2 different representatives during the months of XXXX and XXXX, and after speaking with them- with a copy of an endorsed check, nothing was done until XXXX XXXX, when in my XXXX Credit stated that the payment was received, but this check was endorsed by Popular Community Bank on XXXX XXXX, XXXX, ( please see attachment from bank ). This mistake has not been reversed with the credit bureau and is presently affecting my score, which I have always striven to keep impeccable. Every time I have called customer service I am spoken to in XXXX ; although, I have continually asked to be addressed in XXXX, the bank representatives still speak to me as if I am an ignorant immigrant. I believe if they address me in this matter, they are also taking advantage of other XXXX customers that may not have the same understanding/education as I have. I am fluent in XXXX and XXXX and I 'm perfectly able to understand the difference between customer service and plain disregard for important information. On XX/XX/XXXX we, XXXX Title Agency notified Popular Mortgage XXXX XXXX of an unreleased lien affecting the title of a home that is for sale. Unfortunately the seller did not get us the information until XX/XX/XXXX. Because the loan dept was already closed that day and inquiry was put in but not " accepted '' until XX/XX/XXXX. We were told on XX/XX/XXXX that we would have a response within 5 business days. I called on XX/XX/XXXX, believing that to be the third business day, but was told that they were n't counting Friday the XXXX. I was told at that time we should have something between 3 to 5 business days. I called back on the XXXX whcih would be the fourth business day based on their calculations. I was again told that nothing has been done, but XXXX whom I was speaking to, was nice enough to put an email out to the specialist assigned to the inquiry number. During this call, I was disconnected, called back and was able to speak directly to XXXX again. Today, XX/XX/XXXX, I have called 8 times. I have been hung up on 7 of those 8 times. I have only been lucky enough to get someone on the phone 3 of those times. The first time, I was n't even able to get the girl 's name before she hung up on me. Then I was hung up on by XXXX ( I am not sure of that spelling ) and now I am currently talking to XXXX XXXX also not sure of spelling ). I have asked XXXX to put me through to a supervisor several times and she has refused. She has also refused to give me her supervisors name. She is however telling me that the inquiry was not put in correctly and that I have to start all over and that it takes a minimum of 10 business days to get a response. This is contradictory to everything both my assistant and I have been told for the past week every time we have called. The owner of this home closed their line 7 years ago and even has the line of credit closure authorization from XX/XX/XXXX, which I have a copy of. MERS shows this loan as inactive. Yet Popular has never bothered to record a lien release and is now causing XXXX monetary and mental anguish both for the seller 's ( their customer ) and the new buyers who have a moving van set and have no place to live as of Sunday the XXXX. This is to close escrow today! Yet instead of helping me fix THEIR mistake I just keep getting hung up on. I have a recurring automated debit to my account that had insufficient funds for an error at another financial institution, however my issue is with Banco Popular Community Bank notification communications and fee policy. My sole monthly automated transaction in this account is in the amount of {$110.00} which then overdraw my account and was returned on XXXX/XXXX/XXXX The bank has since charged me a total {$98.00} in fees since, and I am receiving my first notification via direct mail today ( XXXX ) and it is dated XXXX. This seems abusive and excessive especially since the bank has both my email and mobile number. I can understand one fee of {$34.00} for being overdrawn once! But the daily {$5.00} fee when they are sending direct mail and additional {$34.00} of the company 's second attempt totally {$98.00} is abusive, especially given that I am only receiving notification of this on XXXX. I would have rectified this situation immediately if I were properly notified of the issue, as I will be doing today. I only have an account with this bank as my XXXX speaking parents find it easy to bank with them. As such, I am aware that this bank target customer is XXXX speaking customer, and I find their practices and policy to be malicious and ill intentions as they are expecting their customers to not be aware that there are agency set in place to protect them such practice. This is not the first time I have issues with their practices but its the first time I am filing a formal compliant. The fees in total are nominal to me but this bank has unfair practices and policy and are taking advantage of their customers base. There are technologies available to allow the bank ( or any company ) to communicate to their customers for required notifications. This should be a use case ( along with many others ) of what would quantify as a required notification with a customer 's available contact information ( email and direct snail mail ). Its XXXX, not XXXX where email and internet were brand new. I believe an audit is more then warranted and Banco Popular Community must be held responsible to step up, as many banks have done with proper notification of required information. I used Popular Bank XXXX XXXX which is an app to send funds to people directly on XXXX for {XXXX}. I sent the same person for the same amount 2 months prior with no problem. The second time I sent money to the same person in the same manner it went to a person I have no idea who it is. A few days went by and once I realized the person I intended to send the money to did not receive it I called the bank on XX/XX/10. That is when i realized the info of the recipient 's phone number was one digit off. This was really strange because I used the contact in the app to send money before. I didn't input the number manually the second time. They informed me they couldn't do anything that day and to call back the next day. I asked if they could request the transfer back and they said I would have to wait for someone to get back to me. I informed them I believe this was a timely and to see if they could do something! They informed me the fraud department would call me with in 24 to 48 hours. In the mean while the money cleared through a XXXX account. After the second day I called again and they had no addition info. I asked if they could request the transfer back and they said I would have to wait for someone to get back to me. Two days passed with no call back back from anyone. They advised him to deal with XXXX directly. It took several days and many phone calls before I could even get an answer on what the possible outcomes could be. Eventually they told me sorry user error. I was appalled on how the situation was handled from the begging. I found the lack of contact and willingness to attempt to help there customer suspicious. No one could give me any information at all. I asked how this happened, where I went wrong, why wasn't i notified, I sent this person money before what happened and other questions with no attempt to answer them.

In an attempt to refinance my current home loan, I discovered that Popular Bank failed to file the lien release from a pre-existing second mortgage loan we had with them from XXXX for {$75000.00}. Since XX/XX/XXXX, I have contacted Popular Bank many times to resolve this issue. I have filed a Release/Satisfaction Requirements/Mortgage Release form with them. I have provided all of the necessary documents they are requesting. I have emailed and called to speak with representatives countless times. I have offered to pay {$1500.00} to help with the cost of filing the paperwork they failed to file in the first place. They have sent me two letters saying that I need to wait 30 days while they continue to investigate. It has been well beyond the 30 days and I still have not received any information from them. They have not provided me with any documents that prove that I still owe on this loan or that they have ever made any attempt to contact me or collect on this loan. They don't even have a pre-existing account number to reference. This loan was sold to several different entities and then was paid off in XXXX when we went through a loan modification/consolidation process. Because we have never received any notification that this loan was in default, nor has anything appeared on our credit, nor does it currently appear on any of the Title records filed with the county, we had absolutely no knowledge or reason to think that this loan was not paid in full and the lien was released, until now, 10 years later, when we are trying to refinance our current mortgage. Now, because so much time has passed, this is costing me money not being able to move forward with the refinance of the current mortgage on my home. Popular Bank has failed to contact me within the time frame they established. They have failed to provide any proof of default on my part. They need to file the lien release now, as they should have done years ago, as it is their responsibility to do so in a timely manner.

Moreover, the account I opened is called online Checking with online Banking, online Bill Payment and Mobile Banking. At the end, I was told that the bank is unwilling to change its decision to close my account. The bank has made a promise to credit a {$120.00} bonus upon opening of checking account to residents of Florida, New York and New Jersey. I live in Florida and I accepted bank 's offer by opening a required account and making a required opening deposit. XXXX of bank 's offer or a binding promise of bonus represents an unilateral contract for breach of which law provides a remedy. I was unable to complete the transactions necessary to receive a {$120.00} bonus because Popular Community Bank breached the contract by terminating my account without lawful justification or excuse. In XXXX of XXXX, my wife and I opened an online savings account with XXXX bank XXXX an internet based bank ) and based on verbal representations and documentation were led to believe that our account 's interest rate would fluctuate based on prevailing rates. We deposited a large amount of money and our decision was based on what we had been told, that XXXX would increase ( or decrease XXXX our interest rate of return based on prevailing interest rate conditions. Instead, as interest rates went up to 1.45 % APY, the bank kept our interest rate earnings at the original 1.15 % APY. In late XXXX XXXX I discovered that XXXX had created XXXX renamed XXXX their savings account product and that for weeks or months they had been opening new savings accounts at a rate much higher than the 1.15 % they were paying us. In early XXXX I phoned them and stated that I was upset that they had neither raised our interest rate as had been promised, or at least notified us that they had created a higher interest rate savings product that we could have switched our money into. I requested that they make it up to us by computing how much we should have earned at the higher rate and adding it to our existing account. After waiting 5 days for an answer, I was finally refused. We have since moved our savings out of XXXX. I honestly believe that XXXX bank defrauded us out of the earnings we would have and should have earned if they had stuck to their promise of raising ( or lowering XXXX our interest rate based on prevailing rates. Instead, to cheat us out of what we were entitled too, they renamed their savings account product in order to avoid paying us a higher interest rate, then told me I should have switched into the new account. We suffered lower earnings and income as a result of their fraudulent misrepresentation. XXXX is playing a cheaters game by lying to customers that they will raise the interest rates they pay their savings account holders and then failing to do so.

My father died in XXXX, 2015 leaving his assets in a trust. As successor trustee I am liquidating all of the assets and distributing the proceeds to the beneficiaries of the trust. I have had trouble doing so with XXXX asset, a certificate of deposit with e-loan bank. I first sent the required information to what turned out to be the wrong address for the bank on XXXX XXXX, 2015. I resent all of the information ( death certificates, trust information, instructions ) to the correct address on XXXX XXXX. When I had not heard anything, I called e-loan bank around XXXX/XXXX/2015. I was told that the letter of instruction had to be notarized. In my previous conversations, I was not told this requirement and none of the other banks I worked with required this. I sent the notarized letter of instruction to E-Loan bank on XXXX/XXXX/2015. On approximately XXXX/XXXX/2015 I called e-loan bank and was told that my letter of instructions had not been received. It turns out that all of the offices of e-loan bank are located in XXXX XXXX, XXXX XXXX even though their mailing address is in XXXX XXXX, XXXX. The representative told me they were having trouble getting mail from the XXXX XXXX office. I had another letter notarized and tried sending it directly to the XXXX XXXX office at the address I was given but it was return undeliverable. On approximately XXXX/XXXX/2015 I again called e-loan bank and was told that my letter had been received and had been sent to the legal department for research. When no check had been received on XXXX/XXXX/2015, I called once again and was told the check had been mailed on XXXX/XXXX/2015. It is now XXXX/XXXX/2015 and the check has not arrived. It is not possible to speak with anyone at e-loan bank who has any authority. There is apparently no one in the United States I can communicate with. When the account was opened, there was no indication that this bank was anything but a bank operated totally within the United States.

XXXX have searched their data by my name and social security number to see if someone opened an account there and found no accounts in my name. I opened a Popular Bank checking account online over a month ago. I received a packet of information in the mail, including a questionnaire and a signature card along with a return envelope. I filled out the required paperwork in full and sent the envelope back. I waited a week and called Popular Bank to see if the paperwork had been received. On the call Popular Bank transferred me to the online account department. The person I spoke to in the online account department initially told me that she had received the paperwork and started reading information off of the paperwork, only to find that she was reading me private information from a third party and not information from my account. She then told me that she had not received my paperwork yet. I called three more times over the course of two weeks and each time I was put on hold for an extended period of time and was not able to reach an agent who can help me. On XX/XX/2018 I made a mobile deposit for a cashier 's check. I received an email from Popular Bank saying the deposit had been approved. I tried to login to my Popular Bank online banking and was locked out. I called the customer service number and was told that I needed to speak to the online account department. I was put on hold and nobody picked up, after 45 minutes I hung up. I called a branch and spoke with a supervisor who called the online department. The online department told him that my account was restricted for suspicious activity. They told him I would need to go into a branch. He then said " why did you open your account online? Loan orginated in XX/XX/XXXX. It was a heloc with {$65000.00} line of credit/balance. I was told when applying the loan matured in 10 years and if a balance, it automatically converted to a 10 year amortized note. I was notified by Bank Popular in XX/XX/XXXX via letter from their XXXX XXXX Headquarters that the balance was due in full XX/XX/XXXX and there was no conversion clause. I asked why I had not been notified and was told it was my responsibility to honor the terms of the note. I made payments through XX/XX/XXXX ( I have all cancelled checks ) and paid the balance in full the end of XX/XX/XXXX. They are reporting to the credit bureaus that Foreclosure was started. I live in XXXX. It was a Mortgage Note. In order to start foreclosure a legal notice must be filed with the Clerk of the Court ( XXXX XXXX ). I verified that no filing ever occurred. I filed a claim with XXXX and the result was the Bank claimed it was accurate. I called the Bank and discussed this with them and requested any copies of any Foreclosure filings or documentation. They claimed the account was paid in full and closed and there was nothing that could be done. Spoke with XXXX again and they said that as long as the Bank reports this they can not remove it. I have no problem with them reporting the payment history as past due because of the balloon payment. I should have read the complete note at closing. That was my error. The reporting of Foreclosure on the credit report is making it impossible to refinance my home to replace the {$60000.00} I took from my retirement to pay them as soon as I was aware of the problem. Issue is : fact - they Never Started Foreclosure and the reporting that they did is false.

I initiated an account opening with Popular XXXX for an Ultimate Savings on XX/XX/2019. Today, XX/XX/2019, an account closing was initiated by said company. I noticed what was done when checking my account online. I then called Popular XXXX to find out what was going on. According to a customer service representative spoken to on the phone, the account was closed due to suspicious activity. No further details or explanations could be given on the case because not enough information was available to the representative. The company failed to inform me of their actions and completely disregarded me as a customer. Also, Popular XXXX failed to contact me to report the suspicious activity. The company then charged a whopping 25 dollar closing fee. This company is clearly using shady business practices to open accounts for new customers, promising them high-interest rates, to then close them days later for their benefit, and charge heinous fees in the process. These actions are completely unfair and should really be taken into account when trying to provide good customer service. I did not commence the account closing and should not have to pay or be charged a fee for actions on behalf of the company. It is completely ludicrous and shows a level of high disregard for customers hard-earned money. I am now 25 dollars short for something I had nothing to do with, and the company is 25 dollars richer. What is the fairness in this? Just another financial institution making false promises to fatten up their wallets. I am completely appalled by their actions and others trying to open accounts should be very wary when trying to do business with Popular XXXX.

I received a combination letter/form fromPopular Community Bank. The letter indicated that I had an inactive account ( the account number was on the letter ) that would be turned over to the XXXX if I did not take some steps to activate the account by a date in XXXX. I called the number on the form ( I checked on line and the number on the form was the number listed for the bank ). I spoke with a representative to confirm the contents of the letter and asked how to just withdraw the funds. I was told that the account needed to be reactivated first before the withdrawal could be made. I asked if the request for withdrawal could be made at the same time as the activation request. I was told yes and returned the form with my request for the withdrawal of funds. On XXXX XXXX, 2015, I received a call from E-Loan where the original account had been opened. I was told that if I wanted the funds withdrawn, I would need to do so on the e-loan site not in writing as previously told. I took the number and called back ( the number listed on the e-loan website was the same number I had been given ), talked with someone else who gave me the same information. I spoke with XXXX representatives of e-loan and XXXX representatives of Popular bank. Each said I needed to follow the e-loan process. I went on line to make the request yesterday. When I entered my information to set sign into the account ( I was really setting up and account because I could not find the original account information ), I received an error message. I also sent an e-mail to Popular Band customer service but have received no response. I am worried that I have been the victim of a scam.

Had 2 Home Equity Loans through E-Loan, one XX/XX/XXXX ( Liber 3075 Page 904 ) and one XX/XX/XXXX ( Liber 3151 Page 336 and Liber 3428 Page 169 ). Both loans were paid off but only the XX/XX/XXXX loan that was transferred to MERS and XXXX XXXX shows a certificate of discharge and was recorded with the Register of Deeds. It appears that XX/XX/XXXX loan was transferred to XXXX, from the statements I have showing I paid it off with a check number XXXX. I contacted both XXXX and E-Loan, beginning in XX/XX/XXXX and in XX/XX/XXXX and XX/XX/XXXX to resolve the XX/XX/XXXX and XX/XX/XXXX loans still showing outstanding on my title so they could be recorded as paid off with the Register of Deeds. In XX/XX/XXXX, MERS and XXXX XXXX sent certificates of release for the loan dated XX/XX/XXXX to the Register of Deeds for recording. The XX/XX/XXXX loan continues to show on the title in Liber 3075 Page 904 even though it was paid off XX/XX/XXXX by me. When I send them copies of the payoff information, they still reference the XX/XX/XXXX loan that was released in XX/XX/XXXX. It's like they don't read the documents I have submitted showing the two different loan numbers under the different Liber and Page numbers. I have been trying to refinance my house since XX/XX/XXXX and have been unable to because of the XX/XX/XXXX loan still showing outstanding on my title when it was paid off. They both have received all of the attachments I will be forwarding with this complaint but I still have not been able to get a resolution to this. XXXX XXXX froze my savings account without notifying me. I only discovered it after the ACH transfer for my rent was rejected, which caused me to incur a fee from my landlord. This is a widespread problem. Several customer service representatives said that XXXX XXXX is doing this to many accounts -- not just mine. The Fraud Department is unreachable. XXXX XXXX will not allow us to call the Fraud Department, and the Fraud Department does not respond to emails. They give several different explanations for the account freezes, including : ( 1 ) One representative claimed that they have a policy that all new accounts are frozen in the first 60 days, even though their account opening documents say no such thing. The opening documents only say that we can not CHANGE our one linked external account in the first 60 days -- they do not say that we can not withdraw money from our savings account, nor that we can not do ACH pulls from our account. ( 2 ) Another representative said that my linking of external accounts to the XXXX XXXX Savings account was the cause for the freeze, but XXXX XXXX didn't seem to mind that I used those linked accounts to DEPOSIT tens of thousands of dollars into my XXXX XXXX Savings account. They only flagged it for fraud when I later tried to access MY money by WITHDRAWING my rent payment. It is INEXCUSABLE that XXXX XXXX would freeze my account WITHOUT NOTIFYING ME. XXXX XXXX has my phone number, email address, and mailing address, but they never contacted me to tell me that my account was frozen. XXXX XXXX has seized our money, without justification, and will not release it.

I made a request to Banco popular XXXX times-one by phone, XXXX in person and XXXX by fax to change my ACH debit account number. Nothing was done. They continued to take the monthly payment from the account that I no longer wanted them to use. Last month, They took my payment XXXX {$120.00} XXXX from the old account and a week later they took an additional {$48.00} from the new account. I called customer service on XXXX/XXXX/16 and I was instructed by an employee named XXXX to fax statement screenshots to start an investigation. After I faxed the documents that day, an auto email was sent acknowledging receipt. but I have not heard anything from " XXXX '' nor have I received any resolution or even a timeframe of when the issue would be resolved. In addition to the unauthorized amount of {$48.00}, my financial institution ( also my employer ) charged me an insufficient funds fee of {$35.00} ... Changing the ACH account number has been such an execise in futility, that I no longer want the change. I am in the process of closing the new account for fear of Banco Popular is using my number to pay another client 's loan. I usually receive a monthly notice of the payment for the regular amount but did not receive XXXX for the mysterious {$48.00}. I can only assume that my account information went to the wrong person. i opened a 1 year CD with Eloan XXXX 2016 in the amount of {$200000.00} usd. i started receiving unknown deposits to my checking account from Banco Popluar-after researching, discovered Eloan /Banco popular same company. 1. They hid the automatic deposit Externally transferring interest monthly to my personal checking, in " my profile '' section at very bottom -- that no one told me about. I know it was successful because i did 2 steps to confirm & site said change was now confirmed in red type. 3. On XXXX/XXXX/16 another deposit came into my personal account. ELoan undid the 2 steps i did online to confirm the change to the interest deposit to be " Add to Principal ''. 4. I am disgusted with Eloans fraudulent business practices. I demand they add ALL my interest to my principal from XXXX 2016. To pay me the full compounded interest -- that they are trying to short change me. I never, willingly or knowingly authorized the external transfer of interest of my money.

Called Popular Bank on XX/XX/XXXX regarding maturing {$250000.00} 24 month CD due date XX/XX/XXXX ( originally tried calling in 7 days prior but unlike with other banks I have had CDs with was told their [ 'sticky fingers ' ] policy was to only allow redemption orders to be placed 0-9 days after maturity date - denying me interest on the float ). Popular Bank representative took my request to transfer entire account balance including any unpaid accrued interest via ACH to my previously linked XXXX checking account. Verified all related account and routing numbers with the representative during this call. Was told the transfer would occur 2-3 busi ness days from then ( another 'sticky fingers ' policy intended to create an unpaid float ). Called Popular Bank back on XX/XX/XXXX to complain that funds were not received. Was told that transfer had occurred XX/XX/XXXX and that I should check with XXXX. Asked the representative to start a trace. Called my personal rep at local XXXX account. Asked him to start a trace from receiving end. XXXX has since confirmed that there has been nothing sent or pending to any of my accounts matching this transaction. Note : this CD account was configured to sweep each month 's interest into the linked XXXX account, which was successfully done 24 times. There is no room for ambiguity about whether the correct information is in Popular Bank 's records for delivering these funds.

I was inherited a home from my grandmother, for she was getting to old and unable to care for herself, bills and living alone. So, me and my family took care of everything for her as grandma requested. A Heloc mortgage loan was one of her bills from E-loans transferred to Popular XXXX then transferred to XXXX XXXX Mortgage. One day the Mortgage Company called and wanted to speak with my grandma so we had to report that grandma had past and we had been paying her loan for years of only $ XXXX. The mortgage company expressed to me that they would not be able to talk to me since I wasn't on the loan nor could they accept payment from me until they received a death certificate. I sent the death certificate as requested by XXXX and they have not talked to me until we had to go to foreclosure court with their Attorneys. I have written letters and have made many phone calls as to where to make the payments so we would not fall into default on this loan with no results. I had been paying on grandma 's loan for over 10 years with not one late payment. This company has lied to the courts and said that the loan was in default but this is not the truth they would not accept my payments and they just want my house. I opened a savings account with XX/XX/XXXX and made several transfers from my outside bank totaling {$500000.00} dollars. The purpose of this account was to fund Two Popular direct CD accounts that I opened at close to the same time. Popular Bank put a Fraud Hold on my acct. and would not let me move my money from the savings account to the higher interest rate CD accounts. I called several times trying to verify my identity and have the fraud alert removed from my account and finally they told me to send a copy of a voided check to their fraud dept and wait 4 days and this would fix the problem. I sent a copy of the voided check and waited the 4 days. I again called Popular Bank to inquire why my acct was still on Fraud hold. they claimed they could not read the document I sent them. I opened the email I sent and it is perfectly clear. I finally requested they close my accts and return the money to the outside acct that I sent the funds from that is also linked to the acct. They agreed to do so and said it would take 2-3 days. It has now been 3 days so I contacted them again today. The customer service agent from Popular Bank said my acct is still on fraud hold. This is a very difficult situation and Popular bank fraud dept will not release my fund nor contact me directly to resolve this situation. They are holding all my money and will not return it.

On XX/XX/XXXX, I opened an account with XXXX XXXX which is part of Popular Bank, member FDIC. Between early XX/XX/XXXX and mid XX/XX/XXXX, I kept adding funds from other bank accounts. As of today, the account contains close to {$500000.00}. On XX/XX/XXXX, I went online and tried to withdraw {$2000.00} from the account. The system gave me an error message, asking me to call the bank 's customer service. I called customer service and was told that the account was blocked pending " original funds verification ''. Popular Bank never told me that they had blocked my account and that they needed additional information from me. According to the phone representative, they just wait until customers try to withdraw funds before they tell their customers that there's an issue. After three weeks XXXX XXXX informed me that she had not received the check. The undersigned complainant, and thousands of other depositors, are the victims of an ongoing fraud perpetrated by Banco Popular North America, an FDIC insured internet bank. I opened a savings account in XX/XX/2016 when Banco Popular offered/advertised an interest rate of 1.15 % apy which was competitve at the time. Some months later Banco raised its adverised rate to 1.30 % apy, then 1.40 % and now currently 1.50 % apy. Banco Popular misled it's depositors including me to believe we were earning the higher rate of interest on our savings. In fact, my account and those of many others continued to earn the original 1.15 %. Banco Popular advertises only the higher rate ( currently 1.50 % ). It never disclosed that it paid various rates on savings accounts or offered various savings accounts. Banco Popular never disclosed to this and other depositors that to earn the higher rates it would be necessary to open other accounts. Banco Popular made very subtle changes in its savings account products to mislead their depositors. My 'Popular Direct Savings ' was replaced by 'Popular Plus Savings ' and currently 'Popular Direct Exclusive Savings ' in a fraudulent scheme to cheat depositors of interest we were misled earned.

I was contacted by ELoan.They would give me a loan for any amount.All I had to do was get a XXXX card for {$170.00}. Then they would deposit the money into my account within 30 minutes. That was 3weeks ago. They called back and said they trouble putting the money in my account. My bank would not except the amount. After my loan was paid in full. XXXX additional automatic bill payments were made to the servicing company. I 've requested they send those payments back to me, but I was told they have no record of the payments. I faxed them proof of the checks being cashed by my bank, and they said their research department never received them. I asked if I could email them the copies, and they said no. I would be required to fax in my request. It 's been more than 2 months and I still have not received my payments refunded to me. I know the servicer has a fiduciary responsibility to apply payments, or refund over payments in a timely manner. I also experienced the same kind of issues when requesting the payoff amount in the first place. They will only accept payoff requests via fax, and there appears to be very little accountability for employees to ensure they are received and worked on in a timely manner. Before finally receiving my payoff quote, it was almost a month in time from the initial request. I do n't want other customers to have to experience this kind of servicing. Ultimately the consumers are hurt by a lack of care on the part of these type of servicers.

I applied for loan modification to XXXX XXXX XXXX at XXXX Box XXXX, XXXX XXXX, FL XXXX. The bank denied my application for not responding although I had called many times and I sent application documents XX/XX/2018 after receipt of the application documents via email XX/XX/2018. XXXX XXXX XXXX mailed a letter dated XX/XX/2018 for denial of loan modification application, of which envelop was stamped XX/XX/2018, and reached me XX/XX/2018. The letter states they do not accept appeal after XX/XX/2018 when the letter was mailed one day before the due date for appeal from Florida which takes at least 3 days to reach me. Since they did not accept my one month payment when two month delay and said they mailed the application document on the same day they sent email but the documents did not come via land mail, it seems the letter was intentionally mailed to reach me after expiration date for appeal. This is so unfair business conduct as a bank, operating in the U.S.A. It seems they are trying to foreclose when there is a good chance to correct the situation instead of actually help stating in an inserted a letter to help.

I said, " No I do n't '' and they said " Yes you do. '' I said, " Is this going to be back like the past? I 'm going to call the bank and ask them to show you proof that I paid in XX/XX/XXXX. I paid on XXXX XXXX and Banco Popular withdrew it on XXXX XXXX. '' I got the statement and faxed it to them, and they said they did n't get the fax, although I had received a verification receipt. I said, " So you 're lying '' and he asked me to send it to him again. I sent another one right then. When he got it, I called and he says to me, " Yes, I 'm looking at it but we 're not going to accept it. We want your whole statement because we want to see how much money you have in your account. '' I said, " No, I 'm sorry, that 's my personal business. '' I called the Attorney General 's Office and they told me that I was right to do what I did and they can not force me to send them the documents like that. , Big problem here. Went bankrupt in XXXX, discharged, home not reaffirmed. My Uncle lived in it until his death in XXXX. I have been trying to negotiate with bank ; it is a Home equity loan only, no first mortgage. They first accepted a offer and I was ready to go but my attorney never got back to me in time, then the person I was working with left the bank for another job. I had an equity line of credit with Banco Popular. In XX/XX/2011 I was granted a discharge of debt the equity line of credit was not part of the BK. For the past 9 months I have been working on the credit so that I could re finance the house. Banco Popular had to be paid off in order for me to have any hope of getting a loan. Over the course of several months I was able to negotiate a payoff and a promissory note. I gave them $ XXXX and agreed to a no interest payback for a fixed amount over 36 months. The balance after making XXXX more payments was {$10000.00}. My refinance lender told me that we could go ahead with the refinance, however he could not get BP to send a payoff amount. After several weeks XXXX sent a letter asking for a few XXXX dollars more that I agreed to pay in the promissory note. When I challenged them on it, they revised the amount of the payoff but told me that they were going to issue a XXXX for the difference. During my escrow period I received a statement from XXXX reflecting my payments and the amount due almost $ XXXX dollars more than the amount we agreed to in the note.

This is my second complaint regarding E-Loan ( previous case # XXXX ). That issue was resolved by my giving up requestion the cd I opened and funded be made a trust account. Presently since the account has been funded I have received the incorrect amount of interest ( below the percentage I signed up for and have poof of ). After getting no satisfaction by dealing with e-loan I called XXXX XXXX XXXX XXXX a branch manager of XXXX Popular. She intervened and called Eloan in XXXX after which I received a secure message from eloan that the correct amount of interest would be transferred to my linked ( outside ) bank account with 24 to 48 hours. That was on XXXX XXXX. The interest has not been transferred and in fact when I log on to their website I get a message that I do n't have any accounts there. I have spent numerous hours on the phone and sending emails to this bank. At this point I want to close this account, have my entire opening deposit of {$250000.00}. transferred back to my linked account with no penalty as well as the interest I am entitled to.

Popular Community Bank 's mobile application lists completely surcharge free atms on a map around you. I went to a listed surcharge free atm and was charged an atm fee and a bank fee. When I called Popular Community Bank customer support they said the atm was no longer in their network. Upon further questioning I was told the atm list has n't been updated since XXXX ( 7 days ). They said they 'd only give me a credit for the bank fee and not the atm fee because their system was wrong but it makes me wonder how many other consumers got stiffed with bank fees when unknowingly using atms that had not been removed from the app. I was not able to find out how often this happens. In their 2015 annual report to investors, Popular Community Bank claimed to serve XXXX clients with access to more than XXXX atms. If Popular was incorrectly charging bank fees for XXXX out of the XXXX atms in my community, then how many other communities and clients were affected and how much money in bank fees does Popular make during the time when their atm list is " outdated ''?

A guy from Eloans sent me and email and said that I got approved for a {$5000.00}. I called him and talked about the loan the payments, ect. He said that they did n't need any collateral only thing I had to do was send {$140.00} to put insurance on my loan just in case something happened to me. I sent the money and he told me that someone would called me from XXXX XXXX with an activation code. So the guy called me and gave me the code but it was a lot of breakish in the phone. Then another guy called me from XXXX XXXX XXXX to get the code so he could deposit the money into my account. When I gave him the code it was wrong so he called XXXX XXXX and told them the code was invalid so the guy from XXXX said that I would have to pay {$200.00} just to get another code I told him I did n't have it. I told that sounded crazy. I recently opened the online savings account with XXXX XXXX. They were not allowing me to move my money out of the savings account, holding my fund hostage. I then spoke to the representative, who said that it is the customary protocol and the 60 days hold will be lifted when I submit the bank statement verifying the source of the fund is mine. After sending over the paperwork for more than 4 days, I did not get an automatic call back. I then called the company again and the representative mentioned that the company 's fraud department determined that there is red flags exist in my account, and yet no mentioning of what the red flag is, and I have no phone number to appeal and no supervisor is willing to explain to me the problem. Placing a 60 days restrictive hold is unreasonable and unheard of and basically for me to lend the company free money for the 60 days. We had a water damage at our home. XXXX XXXX issued us XXXX check and a XXXX check to rebuild the home but put the bank name on the checks. The bank took the check for XXXX because that is the total amount that we owe on the house ( the loan amount is XXXX ) so they held that entire amount of the loan and refused to issue any draws off the total loan amount. The bank would not release the checks to us until the house was XXXX % complete. We put our own money into rebuilding the house, the bank came out and inspected the property and said the house is XXXX % complete. Then the bank would not release the XXXX check and is telling us that we need to endorse the new XXXX check and they need to put that new check also in an escrow account. Popular Mortgage Service of XXXX Ohio is currently holding over XXXX of my insurance funds, of which all repairs are complete, and then the XXXX which I asked them to sign over to us, they also will not allow us to have it and they want to hold that in an escrow account too. I had a HELOC with Popular Bank. The bank sent me a letter explaining that I could no longer draw from the account and the balance must be paid within a given time period. I paid off the account, leaving a balance of {$0.00}. I did this years before the determined end date. Popular Bank recently started sending account maintenance bills. I called the bank and explained that the account is paid in full and no additional monies could be borrowed. Therefore, Popular Bank was providing NO SERVICE to me. I asked that the account be closed. The account should have automatically closed under the conditions that the balance was paid in full AND no additional transactions could take place. Earlier this week I got notice from XXXX that my credit has taken a near 100 point hit due to delinquency! I owe Popular Bank NOTHING. I paid them in full more than a year ago. After XXXX months they failed to credit my account for {$100.00} bonus. I visited the branch of XXXX since they have taken over all branches from Popular, they refused to honor the bonus. After researching online for best CD rates - I chose to open an account with E-Loan - an online business. As an online business - account holders are to have 24 hour online access to all accounts. On XX/XX/2019 I received a letter dated XX/XX/2019 from XXXX XXXX, Senior Product Manager at XXXX XXXX. This letter was in reference to complaint # XXXX to the CFPB ( Consumer Financial Protection Bureau ) for an account closed by said bank. In the letter it was confirmed that the account was closed by XXXX XXXX and an early closure fee was assessed. Also, it states that since the account closing was initiated by the bank, XXXX XXXX would refund the closing fee ( minus any incurring interest the funds gained while in the possession of said bank ) by check in the amount of {$25.00} USD. On XX/XX/21, I received a phone call from Popular Bank employee XXXX XXXX that my external account could not be processed because I needed additional documents to prove my identity. Ms. XXXX requested that I email the documents to Popular Bank employee XXXX XXXX which I did. I tried several times to change my loan 's direct payment from the Popular Community Bank account that I could no longer deposit money to because I moved out of the state of XXXX where they are located, to a new bank account I opened in XXXX Bank. This is my third complaint since I opened an account with ELoan ( three months ago ). The issue is with the interest that is compounded incorrectly each month and then transferred into my outside account. The interest for XX/XX/XXXX and XX/XX/XXXX was corrected in XX/XX/XXXX and documented in a letter to me from XXXX XXXX ( Customer Care Popular Community Bank ( no phone number or address on the letter ). The current issue is the XX/XX/XXXX interest which is short. Here are the small print rules : http : XXXX Retirees get once a month direct deposit checks. Since it takes the Treasury /Social Security 10-12 days to set up a new electronic bridge to the bank ... it is simply impossible for retirees to have XXXX checks deposited into the new account within a strict 90 day window as specified by the bank. The third direct deposit would always exceed the 90 day window-so the customer would forfeit their $ XXXX. The bank might as well have advertised people who do n't work ( earn weekly or bi-monthly paychecks ) need not apply. The XXXX checks within 90 days rule blatantly discriminates against the elderly, the XXXX and others who receive once a month income.

XXXX XXXX, with no warning, unilaterally decided to block all customers accounts from transferring even minimal amounts out. Because of that, I nearly bounced a check elsewhere. In trying to resolve it, they requested a proof of the account where the money came from which I provided. They said I should have transfer availability within 24 hours. Its been 3 times that, they refuse to let me transfer a miniscule amount, they refuse to let me talk to their fraud department and they refuse to let me talk to a supervisor. I am all for fraud prevention. But there is no fraud, there was no warning. This is just shoddy business practices. I recently opened an account at populardirect.com, a division of Banco Popular North America. After requesting twice they delete the external account I had linked for transfers and were unsuccessful, I decided to close my account. I 've requested the account be closed and all funds returned to me over a month ago. I 've contacted them approximately 5 times and each time there is some problem why they ca n't close the account. I 've been told conflicting things each time I contact them. For example, I was told they could ACH the funds to another account once the account closure is initiated. I opened a savings account with XXXX XXXXXXXX XXXX on XX/XX/XXXX. The bank started to deny all forms of withdrawals from this account since XX/XX/XXXX. I called their customer service line, only to be told that they put in place a retroactive 60 day account hold on all new accounts. There was no email notification of this new policy, just a popup if you happened to try and log in to your account. Customer service told me I needed to email them a copy of statement or voided check to prove ownership of the recipient account for the transfer. You will note on the highlighted sentences from Banco Popular 's response that they said my interest is compounded daily. But they pay the SAME interest of {$120.00} plus some cents monthly. Is that COMPOUNDED INTEREST? I have called numerous times to no avail. People say they 'll check into the issue and call me back, but I do n't hear from them. When I suggested they then return my money I was told the charge to do so would be {$1000.00}. Although a return of my money would be my first preference I suggested since they are paying no compounded interest they could send me what interest already has accrued and then monthly ach the interest since they are not compounding it.

However, only XXXX external account can be linked to the popular direct account and it can not be removed by the customer. I have been making my monthly payments though automatic payment though my bank 10 days before the due date every month. Last year I discovered that my credit report was stating that my payments were late every month for over a year. I contact Popular Bank and they were missing 2 payments. I have spoke with them many times and each time they tell me I have to submit a report to have them fix their issue. Bank put a retroactive 60 day freeze on account. The bank will not allow me to withdraw any money in my account. They say it is there policy to not allow any withdrawals for sixty days from the day an account is opened.
