XXXX and XXXX XXXX XXXX XXXX XXXX XXXX, TN XXXX Companies Name : Point Boosters of XXXX Address : XXXX XXXX XXXX XXXX # XXXX, XXXX, GA XXXX Account Number : Phone Number : ( XXXX ) XXXX I am writing this letter to file a complaint against XXXX XXXX and Point Booster of XXXX. In XX/XX/XXXX I reached out to XXXX XXXX ( Credit Repair ) to get help with my husband and I credit so we can purchase a house. XXXX took payment in the amount ( {$400.00} ) and proceeded to write the credit bureaus. On XX/XX/XXXX, XXXX informed us that he is going to take a new role with a new company ( Point Boosters ) which would require another fee. He stated because this is a new company, we would have to pay an upfront fee of {$240.00} ( Johnettas fee ) and {$120.00} ( XXXX fee ) which is a total of {$370.00}. We have not seen much improvement with our credit, so I brought this to the attention of a friend and she advised me to contact XXXX XXXX. We reach out to XXXX and went in for a consultation. During the consultation we briefly informed him about our case, and what we had already done to repair our credit. He then informed us that we was not supposed to be charged upfront for services, and we was supposed to sign a contract. He also informed us on what to say to the company to see if we could get our money back. On XX/XX/XXXX I sent Point Boosters and email letting them know the problem and requesting that they refund my money back. The message is as follows I am sending you this message to request that my services with Point Boosters be canceled effective immediately. It has been brought to my attention that my workings with XXXX XXXX XXXX have not been legal Under the CROA act ; First of all, No credit repair organization may charge or receive any money or other valuable consideration for the performance of any service which the credit repair organization has agreed to perform for any consumer before such service is fully performed. I was charged up front before any services were rendered. Second it is against the law to for any Credit repair company to render services without a contract. We never received or signed any contracts with Point Boosters or XXXX XXXX. The only option for your company is to fully reimburse our money in the amount of {$370.00}. I will need this refund in my account no later than XX/XX/XXXX or I will be forced to report your company to the Tennessee Attorney Generals office. Please respond to me in writing to inform me how you plan to resolve this issue. On the same day XX/XX/XXXX Point Boosters responded to me as follows Hello XXXX, Thanks for reaching out with your concern. Please let me explain how CROA works to clarify and save you some time. The Audit that you purchased and opened was {$240.00}. This was a PRODUCT. People purchase Audits as a product even without the credit repair to see where they stand. The audit is no different than getting the MRI without surgery, even when the MRI has a fee. I am actually the CEO of the company and the founder of XXXX XXXX XXXX University where I teach compliance, and I am well versed in CROA. This is the reason we complete the Credit Repair Work ( investigation requests, dispute letters, etc ) then charge for the deletions after successful deletions, which is why clients are billed only {$50.00} for each deletion which we have yet to bill you. We did the work first then you paid. You are more than welcome to reach out to the Attorney General to voice your concern. Please note, you did, in fact, sign your agreement with Point Boosters, in which we can furnish you a copy. You also agreed that you understand that you had 3 days to cancel your agreement for a full refund. You then opened the audit that you paid for that tracks the time, your IP address of At the bottom is the agreement that you signed with the IP address of XXXX with everything you agreed to. Please look at the signature and IP address that matches all signed correspondence from you. Also, we understand your " I will need this refund in my account no later than XX/XX/XXXX or I will be forced to report your company to the Tennessee Attorney Generals office. '' I tried to call you to address the problem, but the only thing you have paid for was the Audit that you opened and reviewed. Have we charged you for any Credit Repair work? If we have billed you for something not completed, then we will be more than happy to refund you. Please let me know a good time to reach out to you to address this further. I sent a follow up email stating Hello, Thank you for your response. I would like to speak with someone directly regarding matter because at the initial consultation this was not explained to me. I am sorry I could not respond to your call earlier as I WORK Monday thru Friday from XXXX to XXXX. Also if you could send me what I signed ( CONTRACT ) that would be greatly appreciated!!! I am available to speak with someone after XXXX today. If time is not a good fit, let me know what would be good so I can clear my scheduled to accommodate your schedule. Since then the company has not sent me over the contract they stated I signed or have not attempted to contact me to explain the audit that I paid for up front.

I paid {$120.00} prior to services being removed from credit, never received my detailed report. Everything on my credit was disputed even open credit cards that I have on file and this will negatively impact my credit. XX/XX/17 services was paid for and I never received my audited report. They charged a set up fee which is a violation of the CROA. They also lied to credit bureau about items on credit and did not inform me of this. an inquiry that I authorized is showing not authorized even from accounts that I currently have cards with. I am requesting a full refund of {$120.00} due to violations of this act. " One of the more important areas covered by CROA is how credit repair organizations can get paid. It is the general consensus that a credit repair company can only be paid after services have been rendered. This can be done using a monthly fee model where companies charge clients on a monthly basis after services are rendered or on the more modern pay after deletion model where clients only pay after items are deleted from the credit report. Companies that charge excess " setup '' fees or all of their fees upfront violate the provisions of CROA. ''
