My mortgage is serviced by Pinnacle Capital Mortgage XXXX. Approximately three months ago we submitted a hazard insurance claim on our home to XXXX XXXX Insurance to allow for repairs to the roof, siding, windows, and fence which occurred in XXXX 2014. The claim was quickly processed by XXXX XXXX and we received a check for the damages in the amount of approximately {$12000.00} ( depreciated value ) of a total claim of XXXX. We were required to have Pinnacle Mortgage endorse the check. We contacted Pinnacle for instructions on how to obtain their endorsement and proceed with ordering/paying for repairs. We were instructed in writing that we would need to endorse the check over to Pinnacle and submit proof of 100 % completion of repairs to receive distribution of funds. We called to inquire as we could not complete or start repairs without funds from the claim. We were told that even though the written requirements indicate a need for a certificate of completion, that in fact that was not true and we could simply endorse the check over to them and upon receipt they would initially re-issue us XXXX of the funds with the XXXX XXXX issued with proof that the work was 50 % complete, and the final XXXX upon proof that the work was 100 % complete. We were told however, that we could submit a formal request to have 100 % of the funds distributed immediately, which we deemed necessary due to the requirements for up-front payments in excess of the XXXX offered to us to our contractors. We submitted the formal written request for full disbursement in early XXXX. We provided all requested information, including the TIN for our contractor. After three weeks of no additional correspondence from Pinnacle we called and were told for the XXXX time that the request was not processed because we failed to provide our contractor 's TIN. At this time, we were told we would need to re-submit the request, but we asked if we could simply provide the TIN over the phone to expedite the process and were told we could. We provided the TIN over the phone and were told the request would be processed and we would receive our check for the {$12000.00} claim within XXXX5 business days. A few more weeks went by with no check and no additional correspondence from Pinnacle so we called to inquire as to the status. At this time we were told that our claim had been rejected. We asked what our options were because at this point we needed to pay our contractor for materials to allow work to begin. Pinnacle told us we could take XXXX of the distribution or we could re-submit a request for the entire {$12000.00}. So we requested a slightly smaller distribution of {$10000.00} be distributed to cover expected near term costs. Within one week of submitting this request Pinnacle called and said the request had been approved and we would receive a check in XXXX to 5 business days. After this, we waited 7 days and then we received a letter requesting that we call them because their records showed no work had been completed on the property and asking us to explain why. We called and again told them we had not started work as we had not yet received any of the money. Upon calling they indicated we could disregard the letter and we would get our check in XXXX5 days. It has now been 7 days and we have not received the check. We understand Pinnacle 's responsibility to protect the security of their mortgage and their need for controls to ensure insurance claims are used to make necessary repairs, but we also believe their delays and mismanagement in processing the claim are unfair and abusive under UDAAP. We, and I am sure most borrowers can not afford to initiate repairs without distribution of funds and the delays to this point result in loss of scheduling priority with contractors and loss of value in our home.

So my GF and I purchased a condominium in XXXX ca on XX/XX/XXXX. Originally she was the one who qualified for the loan because her credit score was significantly higher than mine. But she only qualified for XXXX total purchase price with 20 % down. We purchased our condo for XXXX with {$65000.00} as a down payment and financing XXXX. We started looking originally in XX/XX/XXXX and they told us that they would be preforming soft inquiries on our credit reports for the pre approval while making a hard inquiry while the home is in escrow. This was not the case as they ran XXXX of our credit reports XXXX times between XX/XX/XXXX and XX/XX/XXXX ( my name was never on any of the pre approval documents until XXXX when my credit score was satisfactory i had signed up for credit monitoring as i was trying to rebuild my credit so i could possibly attach my name to the loan ) This had a trickle down affect on my credit because on XXXX XXXX my credit score was around XXXX ( as per email attached from XXXX XXXX ) between than and XXXX XXXX my credit was ran again XXXX and was processed as a hard inquiry ( only XXXX of them was going to be a hard inquiry as that was needed to close escrow ) this lowered my credit score to the point that Pinnacle ( who XXXX now works for directly ) needed me to pay a {$5800.00} because of my credit being at risk and titled it Loan Discount Fee for percentage chosen. The person who helped us handle our mortgage was named XXXX XXXX from XXXX and XXXX XXXX # XXXX and he represented and now works for Pinnacle Capital Mortgage. He pretty much told us while we were in escrow literally 2 weeks before we get our key to our condo that if we do n't pay this fee that we would not get this loan. At that time i asked him why my credit score lowered to the point of needing to pay this additional points he told me because i have too many inquiries ( because my credit score was lower. ( XXXX and XXXX ran my credit XXXX times ) At this point we could n't go with another mortgage company because of timing constraints and because i could n't afford any more inquires because i would not be able to attach my name to any loans. Also would have lost security deposit on house which would have been {$3000.00}, so we begrudgingly gave them the money. This is also this has had a negative impact on my credit score again overall because the negative number has been hurting my overall ability to get credit card and re establish myself as a credit worthy individual. Also i purchased a car a few months later in XX/XX/XXXX because of necessity but i may have been able to get a better rate than what i am currently paying but i could n't because of the amount of inquires once again. Overall if we would have known that XXXX and Pinnacle would have tried this type of stuff we would have been weary and in all likely hood have gone with another bank/lender ( XXXX has a great relationship with XXXX XXXX XXXX ). We feel that the mortgage officer and mortgage company took advantage against us because we trusted our person who recommended them to us while she was trying to help us find our XXXX house and we were naive into thinking what they did was typical of all lenders

I asked XXXX to investigate my dispute with XXXX. The only thing XXXX does is to send my information to XXXX to investigate. XXXX does not investigate. The only thing XXXX does is to seat on the investigation until the last days and say the report is accurate. XXXX basically sends the same letter with an updated date. XXXX or XXXX has not or will not look at the information I supplied to them. I even asked XXXX to supply me with the time the funds arrived, the time the funds were processed, and the time the funds were accepted for each month. I even asked XXXX to ask XXXX, but I only received some of the months. I have sent more than enough information to prove my payments were on time. As long as XXXX knows they can get away with it they will continue to do it until I will stop filling my complaint towards them. I really believe it is the responsibility of Bureau of Consumer Financial Protection ( BCFP ) and Experian to do a complete and thorough investigation, and not only take the words of one person or company. I have the legal right for this to happen under the Fair Credit Reporting Act ( FCRA ) and the Fair Trade Credit Act ( FTCA ). Check/Ref. I reached out to XXXX XXXX at XXXX Mortgage Planning in XXXX XXXX, CA inquiring about a mortgage loan. He was referred by a co-worker and has familiarity with my positions pay structure. I had yet to file my XX/XX/XXXX taxes and asked if he could look over my financial information to let me know what was possible for a mortgage. I specifically told him I was not applying yet but as he was referred, wanted to have a discussion about my numbers so I could decide if I wanted to increase/decrease my XXXX deductions. We specifically discussed that my SSN was not needed at this time as I did not want my credit run. I uploaded my financials including XX/XX/XXXX filed tax returns and XX/XX/XXXX draft tax returns into their 'cloud ' for his review. The next morning XXXX called me letting me know that I looked good for 'X ' dollar amount of a loan and had a great score at XXXX. I asked why he knew my score as we had talked the evening before about NOT pulling my credit. He apologized strongly and said the good side was that we would not need to run my credit again. He apologized again saying his staff automatically pulled the information and ran it. I told him as manager of his office he is responsible for managing his staff and that he had assured me we would n't run my credit yet. Of course I had not blacked out my SSN on my taxes, so he secured my information from there. Bottomline : XXXX did NOT secure my permission to pull my credit. In fact he was specifically instructed NOT to pull my credit. I want the record cleaned up from my credit score with all XXXX agencies.

I setup a payment online as I made previous payments on time with no problem. This was on XXXX I recently changed my Checking account number due to a car theft ( check book was inside car ). Went online and made ( so I thought ) payment scheduled for XX/XX/XXXX. one week later I noticed nothing was deducted out of my checking account, so I called back and they said it would take 10 - 12 business days even though I made them before and it took about 48 hours to process. The Customer service representative insisted nothing was wrong. Only to find out when I returned from vacation to find a late payment notice and an additional {$34.00} plus a {$25.00} submitting fee would be added to my account. I called back and the agent said they could not reverse the late charge due to not having a 12 month reporting history on my payments! THEY JUST BOUGHT MY LOAN, THIS WOULD NOT BE POSSIBLE!! I would like this removed from my account because I even followed up with them before the payment Due date and they did not want me to make a payment since one was processing.

I purchased a condominium in XXXX 2015. I have excellent credit with a score of XXXX at that time. I sought out, and got preapproved for fixed interest rate 20 year and 30 year loan terms for 3.75 %. when I made my offer I was told the condo units needed XXXX approved financing and that I would have to use their mortgage company : pinnacle Capital Mortgage XXXX. So I talked to my preapproved banks and they agreed I had to go with such a bank, and they were not approved for it. I went through pinnacle and I am upset that their interest rate was 4.25 %. So, I feel I had no choice but to pay the higher interest rate. All the terms were the same and the only reason the loan officer would state was that " it was a condo '' so I had to pay a higher rate. I just feel this was unfair and should be reported to the proper agency to investigate. They have sold many condo units and was told they provided 90 % of the financing on them. Incidentally, my loan was sold from Pinnacle to XXXX mortgage 1 month after I closed the transaction.

Pinnacle Capital Mortgage Corp - Servicing On XX/XX/XXXX I submitted a request in writing via certified mail to exercise my federal right to have my PMI removed. I called on the following dates to follow up and on the last call I was told that someone would contact me by the end of XX/XX/2019 and no one has done so to date : Call in dates : XX/XX/2019 ( twice ) call was disconnected XX/XX/2019 XX/XX/2019 It is now XX/XX/2019 with no contact from the servicing company. Federal law allows for me to make this request and for them to have the correct information in my file - which remains in error despite my repeated attempts to correct this and my escrow balance. Please help

I am being improperly charged PMI after multiple requests for cancellation by Pinnacle Capital Mortage Corp ( XXXX ). My loan-to-value ratio is now at XXXX % and I am still being charged PMI despite multiple written and oral requests for cancellation. I have held my loan for more than 2 years and have had no missed or late payments. My lender has engaged in systematic obfuscation, including providing multiple mailing addresses to send written requests for cancellation, failing to acknowledge receipt of written requests, and misquoting Homeowner 's Protection Act laws to dissuade me from pursuing PMI cancellation.

The lender I was going through pulled my credit to start the process. Then again 3 months later due to them dragging their feet on closing, then again 2 days later only to deny my loan due to me being a contract worker. That fact was disclosed to them in the application. I had to supply them with letters of good standing in my company. Sign and send numerous copies of full disclosure, bank account records, payoff statements, taxes for 4 years. All of which they asked for over and over again.

I was notified first part of XXXX that my mortgage service did not receive payment for XXXX. i supplied them with proof, check image front and back, that it had indeed been processed by them. 20 some phone conversation with them and i has not been resolved. XXXX XXXX should be looked into for miss-management, incompetent handling of peoples money, and possibly fraud or money laundering. i don't know what's going on there but i have no way out and am XXXX.
