A payoff statement was requested in XXXX and XX/XX/XXXXXXXX Remittance was submitted to pivot rock solutions. A form 1099c was filed for XXXX tax year without prejudice and accepted by the IRS. A 1099-C was sent to Pivot Rock Solutions at the beginning of XXXX. Per the IRS, consumers are not required to report both the income and pay of the debt after it is canceled or discharged. In re Reed, XXXX PTC 105 ( Bankr. E.D. TennXXXX XXXX ). Pivot rock ceased communication on Friday XX/XX/XXXX. I woke up to leave for work and my truck was missing. Per most recent email communication they closed the file and transferred the account back to The XXXX XXXX on XX/XX/XXXX. I was told to direct all communication to The XXXX XXXX. Pivot Rock Solutions is the lender for the buy here pay here program with The XXXX XXXX. They also have breached the contract with numbers not adding up correctly, and city taxes not being stated on the Department of Revenue Standard Sales Tax Receipt, but they are on the Buying order. I believe the calculations are incorrect. On Friday XX/XX/XXXX XXXX XXXX XXXX, illegally repossessed the XXXX XXXX XXXX. Creating disruption of the quiet enjoyment. Appointments were missed, and emotional distress was caused to the trustee XXXX XXXX XXXX. I spoke with the Finance manager XXXX XXXX at the XXXX XXXX, and she transferred me to General Manager XXXX XXXX. He laughed at my pain, he said the 1099c form was not filed, he told me i should pay my bills and kept laughing at me. I asked if we could solve this and he told me to get my lawyer. I have left several messages and emails to the XXXX XXXX, with no response from them. XXXX XXXX XXXX filed taxes and paid taxes on the income notated on the 1099c ( attached ). A UCC 1 financing statement is on file with the Colorado Secretary of State ( see attached ).

On XX/XX/XXXX I was sent a letter stating Pivot Rock solutions, ( my debt handler ) was requesting insurance and be labeled as loss payee on my insurance. Claiming if they didnt they would buy insurance for me at XXXX XXXX a month. As I listed Pivot Rock solutions as a loss XXXX, my first payment on XX/XX/2023 did not have a program fee cost. On XX/XX/2023 I made a payment of XXXX $ had a charge of XXXX $ listed as program fee when asked at the time the attendant could not give me a valid description of the charge. The next month XX/XX/2023 a charge of XXXXXXXX XXXX on a XXXXXXXX XXXX payment. The latest payment of XXXXXXXX XXXX has a XXXXXXXX XXXX program fee that. when asked i was referred to a phone number and my deductible needed to be lower than XXXXXXXX XXXX and that I would have to figure that out with my insurance company. A debt collection agency should not have dictation of my insurance premiums as they are separate entities, much less pay themselves off of my money that is not going to the principal of the car.
