We are members of the XXXX XXXX XXXX and also owners of a XXXX XXXX timeshare. As owners of the resort property, we are required to pay annual maintenance fees. The maintenance fee for the year XXXX was due on XX/XX/XXXX, and the bill for it was generated on XX/XX/XXXX. However, we were unable to pay the bill by the due date, and as a result, late fees were assessed to our account three times in XX/XX/XXXX and once in XX/XX/XXXX. The billing and collection policy of the XXXX XXXX XXXX allows delinquent owners to request a payment plan before their account is referred to an outside collection agency. As such, I contacted XXXX on XX/XX/XXXX, and requested to set up a payment plan. I paid {$100.00} as the initial installment toward the payment plan during that phone call. XXXX informed me that my account would be forwarded to a third-party, their financial services provider XXXX, which would open an account for me directly with XXXX. I was informed that I would be billed monthly by XXXX until the payment plan amount was fully paid off. The payment plan consists of equal monthly charges and does not include any interest fees. To avoid missing any monthly payments, I was recommended to set up automated payments with XXXX. On XX/XX/XXXX, I received my first letter from XXXX, which was not a bill. Since I had already made the initial payment of {$100.00} over the phone on XX/XX/XXXX, there was no stated payment amount in the letter. As a result, the letter from XXXX dated XX/XX/XXXX was simply a notification that they had opened an account for me. The first bill I received from XXXX was dated XX/XX/XXXX, and was received in early XX/XX/XXXX. This invoice specified a total amount of {$200.00} and a due date of XX/XX/XXXX. On the bill, I was given the option to sign up for automatic payments on their website, which I promptly did. However, due to my busy schedule pursuing a XXXX XXXX XXXX, I do not check my bank account on a monthly basis. I did not receive any notification from AXIS or XXXX regarding a missed payment until I received a recent letter from a collection agency in early XXXX. To my surprise, the letter dated XX/XX/XXXX, was from Pinnacle Recovery Inc. 's collection agency, stating that my account had been sent to collections. The collection statement included the remaining amount of the XXXX maintenance fee, plus interest ( even though the payment plan was supposed to be interest-free ), XXXX 's late fee, and Pinnacle 's collection service charge fee, totaling {$330.00}. This amount is equivalent to 40 % (!!! ) of the balance of XXXX 's debt. It is important to note that I was not informed by XXXX or XXXX that my account would be sent to a collection agency. On XX/XX/XXXX, I contacted XXXX XXXX XXXX to inquire about what had happened with my autopay enrollment and why I had not been alerted of a past-due payment. They informed me that my XXXX account was closed immediately following a missed payment, and my account was transferred back to XXXX to resolve the overdue balance. Additionally, they told me that they were unable to retrieve any information regarding my autopay enrollment because my account had been closed. They recommended that I contact XXXX directly. When I called the billing department of XXXX, I informed the XXXX that I would be recording our phone conversations as they do. However, a XXXX staffer informed me that it is against company policy to engage in conversation with a client who is recording it and that only they are able to record phone calls. She then abruptly ended the call, which I found to be rude and unacceptable. I believe that such a policy violates my human rights. On my second call to XXXX 's billing department, the XXXX spoke to me in an irritable and impolite tone, barely letting me speak. He informed me that after 120 days of missed payments, XXXX, under its policy, is not required to notify the client that their account will be turned over to collections. However, I believe this is a violation of my rights under the Fair Debt Collection Practices Act. I enrolled in the payment plan on time, paid the first installment, and my payment plan was transferred to a third-party organization. Therefore, legally, when my account was transferred to XXXX, I was under the new payment policy of a third-party organization, XXXX, which was responsible for managing my payment plan agreements on behalf of XXXX. XXXX had never informed me about its policy on overdue payments. Additionally, it's important to note that I informed the XXXX XXXX that they had illegally turned over my account to a collection agency, which has had a negative impact on my credit history. Despite the fact that my account was subject to a different payment policy since its transfer to XXXX, XXXX 's policy itself states that they can turn over delinquent accounts to a collection agency after a 120-day balance has passed due. However, in my case, only 58 days had passed from the date of my first installment payment towards the maintenance fee on XX/XX/XXXX, to the date on the letter, XX/XX/XXXX, that I received from the collection agency, Pinnacle. Unfortunately, the XXXX XXXX refused to listen to my arguments and insisted that XXXX was unable to recall my account from the collection agency. He instructed me to contact Pinnacle Collection Service instead. After that, I called XXXX 's customer care number to file a claim regarding the illegal action taken against me as a XXXX XXXX member, and I was unreasonable denied this right. On XX/XX/XXXX, I contacted Pinncle Collection Services to inquire about the legal document that they used to accept my debt for collection. Despite only 58 days having passed since my most recent maintenance fee payment, Pinncle argued aggressively that they were complying with XXXX 's billing policy regarding 120-day-past-due payments. I formally requested that Pinncle halt collection efforts on this disputed debt, but they refused to do so, violating their own policy stated in their letter : " call or write to us by XX/XX/XXXX, to dispute all or part of the debt. ... [ and ] we must stop collection on any amount you dispute ... '' They refused to listen to my reasoning and aggressively demanded full payment of their bill, including {$330.00} in their fees. They threatened me that if I don't pay off my account with Pinncle, my monthly charges will constantly increase. I believe that Pinncle 's actions are in violation of collection service regulations and ethical standards. Pinncle failed to perform their duty to verify the legality of all required documents and evidence from the client seeking to collect debts before accepting the debt for collection. Their actions make me suspect that Pinncle is trying to unjustly enrich themselves by engaging in this wrongdoing.

We are members of the XXXX XXXX XXXX and also hold ownership in a XXXX XXXX timeshare. As owners, we are obligated to pay annual maintenance fees. The fee for XXXX was due on XX/XX/XXXX, with the invoice issued on XX/XX/XXXX. Unfortunately, we were unable to meet the payment deadline. XXXX XXXX XXXX 's policy allows owners who are behind on payments to request a payment plan before their account is handed over to an external collection agency. Consequently, I reached out to XXXX on XX/XX/XXXX, to establish a payment plan. I made a payment of {$100.00} toward the total amount of the maintenance fee during that call. I was informed that my account would be transferred to XXXX 's XXXX XXXX XXXX XXXX XXXX, who would then bill me monthly for {$100.00}. To ensure I wouldn't miss any monthly payments, I was advised to set up automatic payments with XXXX On XX/XX/XXXX, I received my first correspondence from XXXX, which was not a bill but a notification that they had received my account from XXXX. Since I had already made a payment of {$100.00} on XX/XX/XXXX, there was no payment amount stated in the letter. My first bill from XXXX, dated XX/XX/XXXX, arrived in early XX/XX/XXXX. It specified a total amount of {$200.00}, due by XX/XX/XXXX. I promptly signed up for automatic payments on the XXXX website, as advised, with the payment day being XX/XX/XXXX. However, due to my demanding schedule as a XXXX XXXX student pursuing a XXXX XXXX XXXX, I do not have time to routinely check my bank account. XXXX or XXXX did not notify me of a missed payment in XXXX until I received a letter from Pinnacle Recovery Inc., a collection agency, in early XXXX. To my astonishment, the letter dated XX/XX/XXXX, stated that my account had been forwarded to collections. The collection statement included the remaining XXXX maintenance fee, interest ( despite the payment plan being interest-free ), XXXX 's XXXX fee, the payment toward the debt of {$100.00} ( but the date of this payment was intentionally not specified ), and Pinnacle 's collection service charge, totaling {$330.00}. This sum is equivalent to 40 % of the outstanding balance of the XXXX debt. It is crucial to note that neither XXXX nor XXXX informed me that my account would be sent to a collection agency, which was against XXXX 's policy : " 120 days after due dateDelinquent accounts are turned over to an outside collection agency.The management company, on behalf of the XXXX XXXX XXXX XXXX, may, at its discretion, take the following additional steps to collect the unpaid debt owed as well as any other remedy as permitted by the governing documents and applicable state statutes : - Send an Intent to Cancel Membership Notification.- Cancel membership in the Club therefore relinquishing the owner from any rights of ownership or usage.At any time prior to being sent to an outside collection agency, a delinquent owner may request to be placed on a payment schedule.However, you will not be allowed to make any reservations until your account is at a XXXX balance. If an installment plan or payment plan is defaulted, the account is sent to the outside collection agency without further notification. '' On XX/XX/XXXX, I reached out to Pinnacle XXXX XXXX to discuss the legal basis they used to assume my debt for collection. Despite a mere 58 days having elapsed since my last maintenance fee payment to the collection letter, Pinnacle insisted they were following XXXX 's billing policy concerning payments overdue by 120 days. OVERVIEW OF ILLEGAL ACTION : XXXX received my payment of {$100.00} towards the total maintenance fee on XX/XX/XXXX. Astonishingly, I received a letter from Pinnacle Collection on XX/XX/XXXX, a mere 58 DAYS AFTER MY MOST RECENT PAYMENT. However, the XXXX policy states that the delinquent accounts are turned over to an outside collection agency 120 days after due date. On XX/XX/XXXX, I filed a complaint with the Consumer Financial Protection Bureau ( CFPB ) about this alleged illegal collection action by both XXXX and Pinnacle. Pinnacle 's response was to propose a " monetary relief '' solution, which entailed a 50 % reduction in their fee charge. I find this proposal to be inadequate and unlawful given the circumstances and the law. Due to a demanding period of examinations and graduation from law school, I was unable to contest the proposed solution via the CFPB within the stipulated 60-day window. I anticipated receiving an updated invoice reflecting the new amount of Pinnacles fee, but no further communication from Pinnacle has been forthcoming, aside from their response on the CFPB website. Currently, XXXX is preventing me from booking any vacations or even paying the new annual maintenance fee due on XX/XX/XXXX. XXXX is unjustly obstructing me from paying the new annual maintenance fee and pressuring me to settle the debt through Pinnacle. I am now considering joining a class-action lawsuit against XXXX. In regard to Pinnacle 's unprofessional and illicit demand for fee payment, I recently discovered on the Pinnacle online account that they have astonishingly escalated their fee for me, which now exceeds the amount of my original debt to XXXX. My initial debt to XXXX was {$810.00}, and Pinnacle is now demanding a payment of {$1900.00}. Before I proceed with legal action against Pinnacle 's unlawful actions, I want to give them an opportunity to make the right decision : to waive their entire fee and return my account to XXXX. A XXXX representative approached us to purchase week long vacations, a deal not to be passed up. So we did so for our XXXX children. We were asked to return and sit in on a presentation so the representative selling us the vacations would receive credit and pick up the certifications for the week long vacations. The sales brochure and the certificates are attached. 2. The sales of the week long vacations packages were very deceptive. It was sold as use anywhere anytime. Reality is you can not use them at anytime only in off peak periods and only at low coat low usage property as stated in the attached e-mail, These packages were issued only as we were walking out the door after the 5-hour high pressure presentation. We were not given time to read and review them prior to purchase. In the event this certificate package would have been properly presented for what it actually is no purchases would have transpired. 3. Sales person XXXX XXXX, XXXX XXXX and XXXX XXXX kept us for 5 hours with offers of splendid vacations, they kept bringing more sales staff and they kept adding to the pressure. Each staffer that appeared had an add on to make the deal better. We told the NO several times and they just kept bringing more people Sweetening the deal each time. 4. XXXX and XXXX said you could use points to take cruises ; redeem points for Airline Tickets and XXXX Tickets. This was a false claim, as we do not have enough points for this. We each ( XXXX and XXXX ) own XXXX Vacations and travel the globe on exotic vacations. What they did not disclose is we do not have enough annual points to do any of this. 5. ( Rental Fee for Points ) this was disclosed to us as you could bring points forward for the next year without any extra cost. This is another false claim, as the extra points are expensive and must be purchased. We have checked into these properties and over 90 % of them we can not use due to too expensive, not prime vacation areas ( as stated ) or off peak season when our children and grandchildren can not go due to work and school. 6. There many documents singed without our knowledge by XXXX XXXX using the Docu-Sign application. Due to they had kept us there for 4-hours he forged our names onto this Docu-Sign and went through about 50 pages of documents electronically signing them without our knowledge or an explanation that would have given us more time to reject this contract. We have highlighted them throughout the contract. We were kept in this environment 4-1/2 hours longer than the consumer protection agency allows under high pressure the entire time. 7. A XXXX XXXX Credit Card was issued to us and explained IF we use it, we could accumulate points and use them toward a maintenance fee. The maintenance fee was not disclosed to us until after we asked about it several times. The fee quoted us at the time is far less than the actual fee. XXXX added a 10 % down payment onto the card instantly in which we have never received points but have received several invoices for the full amount of the maintenance fee. Then charges started showing up on the CC at 17.9 % interest. We confronted the XXXX XXXX Company and they removed the unauthorized charges. Now XXXX is sending these charges through collection agencies now in an attempt to intimidate us by destroying our credit rating. 8. XXXX did not disclose a 10day grace period to decline this purchase. When we approached XXXX it was told to us You should have read the fine print and would you like to purchase a higher point package. We have never seen a disclosure statement. We did not receive a disclosure statement. 9. We reached out to XXXX. XXXX claims they internally investigated the incident. However over the course of 4 months their investigators XXXX XXXX and XXXX XXXX talked to us on the phone 2 times in mid XXXX and early XX/XX/2019. We did not communicate with them again for 2-months as we tried to follow up with the investigation. After 2-months Palak wanted to conduct an initial interview as if we had never spoke on XX/XX/XXXX. We found this very unusual. All communications are attached. 1. XXXX will not discuss this issue in writing. We have repeatedly asked them to write us any and all concerns and they refuse. We did receive e-mail from XXXX XXXX wanting to offer us something, she would not say what it was on e-mail and only could say it on the phone as per XXXX policy. 2. We finally received a non-cancelation letter from XXXX XXXX XXXX on XX/XX/XXXX. This letter is attached and mainly reads like a standard issue letter. 3. We reached out to the Attorney Generals Office in Florida and Louisiana seeking help with this issue with no results. XXXX had someone within their Consumer affairs deny all of our issues and concerns. 4. We have received many harassing phone calls from XXXX XXXX, XXXX, ( Pinnacle & XXXX ) ( collection agencies used by XXXX XXXX XXXX to intimidate us ) mainly these people have been rude when we will not speak on a recorded line and ask them to send e-mails. We only seek for XXXX to honor the 10-day cancelation period and cancel this contract, as per Florida state law. We feel we were lied to, taken advantage of, misled by high-pressure sales staff and fraudulently coerced into accepting something we did not want and had said NO to, many, many times in the 5-hour long sales marathon.

My complaint is about XXXX XXXX XXXX and their debt collection company, " Pinnacle. '' On XX/XX/2018, I contacted XXXX because after checking my home phone, which we almost never use, and discovered some automated messages from XXXX ( no reason for the message was stated ). I tried to log into my XXXX account and discovered I was locked out of it making it impossible for me to figure out what the problem was. I the called and was told I was sent to collections. I was shocked and asked the lady on the phone what the problem was. She wouldn't really explain and just said she would have to transfer me to Pinnacle. Before I would let her transfer me I explained I was shocked because, I had received no written communication from XXXX about a problem with my account and, in fact, I couldn't remember receiving statements for quite a few months. She then said, " Oh, that's weird, it does say 'error ' next to your statement. I am not sure why, maybe it was returned to us. That is weird. '' So it was confirmed that I have not gotten a statement indicating a problem with payments. We also confirmed that the secondary phone number on my account was a phone number we haven't used in over 2 years! So after not sending me written statements or correspondence, XXXX sent a longstanding customer with no history of failing to make payments to collections. I was then transferred to Pinnacle who could find no record of me in their system. The lady I spoke to told me to call XXXX back because she thought it was a mistake. I called XXXX back and was told that I had just been transferred to collections that day. I told the man that I just wanted to know what the problem with my account was and make any necessary payment. He said I would have to talk to Pinnacle and he couldn't help me and he transferred me back to Pinnacle. The man I talked to me at Pinnacle this time told me that actually hadn't completed transferring my file yet and he wouldn't be able to tell me what was going on until the file had finished transferring. I am still shocked that even though my file hadn't actually transferred to collections and I was reaching out to XXXX to resolve whatever issue there was they were refusing to not only tell me what the problem was, but to let me fix it at that point. Later that night, the man from Pinnacle called me back and I was shocked to be told that I owe over {$1400.00}! Part of that amount was {$300.00} in " debt collection fees '' that Pinnacle charges. After being told that I have to pay off this shocking debt before the end of the year or I would be charged another debt collection fee, I agreed to make a payment. I was honestly so shocked by all of this, I wasn't processing information properly. I was also given minimal information about the debt and was told I would have to talk to XXXX, but I had already tried that and was told I had to talk to Pinnacle ( and I am still locked out of my XXXX account ). The man did tell me that he could see that I had been making payments up through XXXX, but my XXXX payment wasn't received so I was transferred to collections. After hanging up, the whole thing didn't sit right. After hanging up, I did minimal research and discovered that it is completely illegal to charge a " debt collection fee ''. I am also shocked that I was sent to collections when it was confirmed that I had been making payments and had only missed one payment ( I am unsure why that payment was missed and I will have to contact my bank, but, again, I was unaware of the issue since I wasn't receiving statements from XXXX ). I am entirely appalled at how shady and unethically XXXX has handled this entire issue. I still do not understand what is wrong with my account, I was forced to make a payment to a shady debt collector, and all of this based on incredibly poor communication about the status of my account by XXXX. It is my understanding that is it illegal for a debt collector to 1 ) refuse to provide an accounting of a debt ( XXXX and Pinnacle have both refused to give me any sort of accounting and XXXX still has me frozen out of my account ) and 2 ) for Pinnacle to force me to pay a " debt collection fee '' that is 33 % of the actual debt owe ( it is my understanding that I owe XXXX {$900.00} as the balance of my yearly maintenance fees, which I am permitted to pay over the course of a year so this amount is not even fully due until the end of the year ).

Mon night XXXX We received a bill in the mail from Pinnacle Recovery Inc. for maintenance fees {$760.00}, collection costs of {$250.00} for a total balance of {$1000.00} plus additional charges that may vary from day to day until this is paid. Even after pd. they may send another bill and notify the Credit Report Agency. This collection agency is working for XXXX XXXX XXXX XXXX timeshare. We never received a bill. Had no idea. Tues XXXX I called XXXX XXXX XXXX ; which I found out that morning they were bought out by XXXX vacation ownership, XXXX XXXX then opt XXXX m-f XXXX , and t alked to XXXX . I verified who I was, including my current address, which they had right, & phone #. I asked when the bills are sent since it is once a year. I told her we never received a bill why would n't they try again, " can I settle it with her? '' She said no call the collection agent. I told her she has the right address. She said they got it from the post office. Then I said again why would n't they send us a bill again knowing we did n't get one? She said because it is n't up to them to change our address it is up to us. That is neglect on their part and a way to get more money. That is what they do. We paid it the year before ( and 17 years past ) and p ut in a change of address twice. Someone dropped the ball. We never had a problem before. " Call the collection agent. '' Asked her if we could combine this and anot her timeshare we have that was also bought out by strong arm by XXXX & she said call customer care, but our delinquent debt had to be paid before they would talk to me. " Of course ''. I asked her about them buying back our timeshares and she told me to call ovation team by XXXX @ XXXX , but they wo n't talk to me until we pay our delinquent bill. Call the collection agent. " Of course. '' I asked what was the original bill- {$690.00} due by XXXX ea. yr., even though we can only use the condo once every 2 yrs. We have never used it. Ever. XXXX once a year give us a break. All these yrs. & never a problem before. How delinquent are we it is this year and we ca n't even use it. XXXX made it sound like we were dead beats. Obviously I faced it right way head on. XXXX I then called Pinnacle XXXX and asked for a supervisor. XXXX XXXX . Told him I needed some help here. we did n't get a bill & knew nothing about this.Would he knock these fees down. He said no he could n't. It is what it is. I said it is n't fair or right. I then told him it was against the law for them to charge these fees. He got mad & asked are you calling us, something to the affect, that they are thieves. I said no this is just not right, {$330.00} added to orig. bill for innocence is a lot. I responded immediately. No efforts to collect. We would n't have top credit if we did n't pay our bills. I felt they all wanted to ruin our credit. I told him I was starting to get a XXXX & I was not supposed to be under this pressure because of my illness. So, he said just a minute & came right back & said he would take it down to {$930.00} if I paid it right then. I said so I should mail a check right now & he said no a credit card now. " My husband has a phone credit card & he is working. Told me to call by XXXX . My husband got home @ XXXX . Could n't reach him. In the mean time I called Or XXXX XXXX XXXX for info about Pinnacle. XXXX XXXX XXXX XXXX XXXX XXXX XXXX, MD XXXX XXXX, XXXX, and XXXX XX/XX/2023 Subject : Dispute of Inaccurate Information on Credit Report - Account XXXX XXXXXXXX ( XXXX XXXX XXXX ) To Whom It May Concern, I am writing to formally dispute the presence of an alleged debt on my credit report, specifically Account XXXX XXXXXXXX, which is attributed to XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I, XXXX XXXX, residing at XXXX XXXX XXXX XXXX, XXXX, MD XXXX, assert that I have never engaged in any transaction, let alone purchased a timeshare, from XXXX XXXX XXXX or any other business entity. This matter has been a source of frustration for over XXXX years, and despite repeated attempts to resolve it, I continue to face unwarranted and baseless claims from XXXX XXXX XXXX and their collection agent, XXXX XXXX. As a seasoned realtor with over 15 years of experience in the real estate industry, I possess a comprehensive understanding of real estate transactions, including timeshares. To be explicitly clear, any real estate transaction, including timeshares, requires a signed contract to be legally valid. I can confirm unequivocally that no such contract exists in relation to this alleged debt. Upon requesting documentation to substantiate the debt, XXXX XXXX provided me with what can only be described as meaningless and suspicious paperwork. The attached documents including a warranty deed, which erroneously lists an outdated street address with an inaccurate house number, that I have not resided in since my high school years, includes two grantors whom I have never had any dealings with. What is most telling is the complete absence of my signature on this so-called " deed, '' which is a fundamental requirement for any real estate transaction. Furthermore, the lack of a copy of my picture ID, which is standard procedure in real estate transactions, further underscores the fraudulent nature of these documents. Moreover, the ledger purportedly containing " card transactions '' fails to reference any credit card belonging to me, and it does not indicate any legitimate transactions related to my name or accounts. This is undeniable evidence that this supposed debt is entirely unfounded, and it seems more likely that it is a result of identity confusion or, worse yet, a deliberate act of fraud and misrepresentation on the part of XXXX XXXX XXXX and their collection agent. I vehemently protest against these deceptive practices and respectfully demand that any reference to XXXX XXXX XXXX and all associated parties be immediately removed from my credit report. I have presented a compelling case backed by evidence that I am not responsible for this alleged debt and have never attempted to purchase a timeshare. I urge your agency to conduct a thorough investigation into this matter, and I expect a prompt resolution. {$2000.00} is the amount Pinnacle Recovery ( XXXX ) is claiming which include the XXXX maintenance fees of {$710.00} which as not due until XX/XX/XXXX. I was told by both XXXX XXXX XXXX XXXX and Pinnacle Recovery that {$1800.00} was turned over to Pinnacle Collections in XX/XX/XXXX. Pinnacle Collections then tacked on {$200.00} bring the total collection to {$2000.00}. This amount of {$2000.00} includes XXXX XXXX maintenance charge of {$710.00}. Additionally, they are tacking on hefty fees for XXXX maintenance fees of {$680.00}. I have proof that the XXXX money for {$680.00} was purchased and they received by certified mail on XX/XX/XXXX. We went back and forth and mistruths was told i.e. we applied it elsewhere but they couldn't tell me where or we just don't have it. XXXX XXXX at XXXX XXXX XXXX XX/XX/XXXX ) on a recorded call who initially told me that they did not have the {$680.00} then recanted and stated it went toward other fees but will send me a breakdown and my balance is {$990.00} XXXX difference of {$300.00} XXXX. I had spoken by phone, chat or email and about XX/XX/XXXX XXXX XXXX, XXXX Owner Svcs acknowledged I only owe {$300.00} to Pinnacle Recovery AND she did not indicate I owe XXXX vacations. I can only surmise that they had the payment but what happened to it I don't know BUT it appear that she, others, want to collect for Pinnacle Recovery. My XXXX Account was unlocked in XX/XX/XXXX and I was allowed to pay XXXX maintenance only after I agreed to drop my attorney representation. Fast forward to XX/XX/XXXX when I tried to pay {$710.00} maintenance fees in a timely on XX/XX/XXXX. That was the first time I was told the account was turned over to Pinnacle Recovery. I also had the XXXX tracked the {$680.00} to see who cashed it but no XXXX who I sent it to had not nor anyone else. I just received the replacement money order on XX/XX/XXXX and I have the {$710.00} to pay but I should not be paying for collection fees or finance charges on a payment I sent in XXXX. Year XXXX maintenance fees have been paid and I want to pay XXXX maintenance fees without penalty. Pinnacle Recovery recovery states they do not have to talk to me and XXXX Vacations won't talk to me. I have requested XXXX to resolve and they refuse. The mortgage is not and never had been a problem. I got behind on maintenance fees began catching them up in XX/XX/XXXX and thought resolved in XXXX BUT I feel they are trying to intimidate senior citizens to letting go their time share particularly this one since I got it soo cheap and it's almost paid. I don't think it's a coincidence that oftentimes when I speak with XXXX or Pinnacle Recovery that I get a timeshare resale call. See complaint XXXX. XXXX XXXX and Pinnacle Recovery are working lockstep together. Pinnacle Recovery ( XXXX XXXX ) swears that she do not get my emails after several verifications requesting an account.

I received a bill from Pinnacle Recovery in XX/XX/2018 for XXXX. The debt was from timeshare maintenance dues for XXXX XXXX that I had not paid. When I received the bill, I logged into the account per the instructions on the Pinnacle bill. I set up a payment plan and the debt was paid in full within 3 months. At the end of XXXX I received a call ( about a day or so after the debt had been paid in full ) from a Pinnacle representative. He said that I still owed " around {$150.00} or {$160.00} something '' and that if I didn't pay right then over the phone, I would remain in collections. I asked to speak with a supervisor who sounded like the same person. He told me to pay it now over the phone and then hung up on me when I asked him to please explain why I still owed them money. I called XXXX to get help from them and the representative told me that Pinnacle had the account and until it was paid in full, they would not be able to get the account back. I have to work it out with them. I explained to the representative at XXXX that no one was able to tell me the exact amount I owed or why and she told me she was sorry, she was unable to help me. I received another bill from Pinnacle for {$130.00} on XX/XX/2018. I logged into the account and paid it in full that day. I received a call from Pinnacle right after it was paid. They did not leave a message but I recognized the number as I now have it saved in my phone. Every day since I have paid the debt in full I have attempted to log into my Pinnacle account to see if there is anything else I owe. Since XX/XX/2018 when I enter my account number it now says the account number is invalid. I received an email from Pinnacle on XX/XX/2018 stating that the account was paid in full. XXXX XXXX XX/XX/2018 ) I received another message from Pinnacle that they are attempting to collect a debt from me. I attempted to log into my account on the Pinnacle website to see if the account had been reopened with another amount and it still tells me the account is invalid. I imagine I will get another bill months later for some other amount. I refuse to pay over the phone because of the many scams out there and every representative I speak with gives me a different approximate amount. I am unable to get out of collections with this company because they keep asking me for more money every time I pay the bill in full. I am unable to pay anything to XXXX because Pinnacle holds the account. Please let me know how I can get this bill out of collections. My parents are also now getting harassing phone calls from Pinnacle. I am not even sure how they got their phone number.

The original financing was, between XXXX XXXX and XXXX XXXX my husband at the time of the divorce, in XX/XX/2015.The judge awarded the Real property, including vacation property, all insurance, tax and all cost incurred with said properties to XXXX XXXX and declared that, My ex-husband was responsible for the mortgage ( s ) and he had full ownership of all properties and all debts, incurred. The original note for the time share, has been paid off before our divorce and any incurred maintenance /expenses are those of my ex husband, for the usage of the property and his personal enjoyment. I have not requested or visited any of the properties and/or services, that are provided by the original sales agreement. After the judge awarded the timeshare to my ex husband. These cost are that of the owner and the usage and upkeep. I am no longer the owner of the timeshare and I have no knowledge of whom Pinnacle Recovery. They were not involved in the original agreement and have no working knowledge of the transaction. The debt is not valid, nor is the debt, my debt. The credit bureaus are required to have the original contract/agreement in their care and retain that information, during the entire reporting term and thereafter. They have never had any documentation, prior to any ability to report, this debt/information and as protection provided by the fair credit reporting act. The collection agency, has stated that the debt will be reported to the credit bureaus and placed on my credit file, causing a hardship, for me and my family. I have spoken with XXXX XXXX and notified them countless times, that ownership of the timeshare, had been taken from me by the courts and awarded to XXXX XXXX, in whole. XXXX, has still tried to collect fees from me and has stated that, they have no respect for the court system and the judge has no authority over them and their property. These cost are the cost for the ownership of said, timeshare, which is not me, as of XX/XX/2015. I have tried to work with them, including but not limited to, asking XXXX XXXX, to allow XXXX, to sale the timeshare. XXXX XXXX agreed and XXXX was unable to sell, the timeshare, even at a discounted rate, because the timeshare market is all but gone. This is a strong arm approach, to try and secure a profit from, me on a investment, that I do not own and a market that has all but, died and this activity by all parties are illegal and I request a cease and desist of all collection attempts from me by all parties involved and that any attempt to place such debt. I was behind on my timeshare maintenance dues payments. I owed about {$1200.00} and I paid the past due amount plus the next months payment in full on Friday XXXX/XXXX/2015 on my original creditors website and they accepted as payment in full. The following Monday XXXX/XXXX/2015 I got a call from Pinnacle Recovery Inc. and talked to someone names XXXX. She said I owed about {$1500.00} for the account dues that had been handed over to them. I had not heard from Pinnacle prior to this ever and had already paid my original creditor in full. I explained to her that I had already made payment in full to satisfy the debt and there was nothing more I was obligated to pay. She continued to push the issue and stated I owe them ( Pinnacle ) {$300.00} additional because the account had been assigned to them. I had never heard anything from them or had any contact whatsoever before I made my payment to my original creditor. XXXX called me back about a week later and said that I still owed them the {$300.00} and I said no because the timeline does n't support their statements and I got my payment into my timeshare before ever hearing from them. This company is a joke!!! What do n't they understand about me already paying my debt. I sent certified letters disputing my case and sent emails with the payment confirmation I made on XXXX/XXXX/2015 to show as proof ( see attached documents ). I am really tired of these bottom feeder tactics and have notified my attorney just in case they continue to pursue this. Please see the attached documents showing the timeline of this. Also please note on the Pinnacle Document XXXX attachment the sentence that says " Please do not contact XXXX, The Club regarding this debt until the amount has been satisfied through our office '' I would have gladly followed the correct procedure and paid the debt through Pinnacle but I had already made payment in full to XXXX as seen in my supporting documentation and payment confirmation letter from Worldmark. I am not one to skirt the issue or find ways to be deceptive. I believe in following correct policies and procedures. What I do dispute and have objection too is companies like Pinnacle who try and take advantage of people and not look at the facts. I will not stand for this and and demand this be taken care of now!

XX/XX/XXXX - My husband and I bought a deeded time share at XXXX XXXX XXXX in XXXX XXXX XXXX. We paid in full for timeshare -- {$12000.00}. We paid taxes and maintenance fee annually as billed. XX/XX/XXXX - My husband and I divorced. He got XXXX XXXX XXXX in settlement. He ( alone ) paid taxes and maintenance fee annually. XX/XX/XXXX - My ex-husband XXXX and our daughter, as executrix, contacted XXXX several times trying to get deed changed to her name. Several calls and faxes with no response from XXXX. We were informed by XXXX that we had to work through XXXX to get this done. XX/XX/XXXX - My daughter continued to contact XXXX about transfering deed. No statements or any information regarding taxes or fees were received. XX/XX/XXXX -- A $ 20,000+ collection action appears on my XXXX credit report from Pinnacle Recovery. Upon inquiry, I find that because the deed to the timeshare was never changed, my former name still appears on the deed and I am liable for back taxes and fees. They tell me that even though my divorce releases me of liability, their civil claim supersedes that. I have never received any annual statements or bills from the current owner of XXXX, XXXX XXXX. Pinnacle offers to terminate the action for {$310.00}, however, they can not guarantee that my credit report will be repaired. They tell me I have to follow up with their client, XXXX XXXX and wait for their release letter. The rep advised me to be persistent in asking for the letter because XXXX is not timely with this action. He said it could take months to get the release. He said I should continue to call, asking for supervisors, etc. While I believe the whole transaction is a scam, I am willing to pay the {$3100.00} to get this matter resolved, but I am concerned that once I pay, they have no motivation to give me a release letter or remove the derogatory from my credit report. I also believe that since Pinnacle is the company that put the negative information on my credit report, they should remove it as soon as I pay the money they request. I would appreciate your advice on how I can assure that my credit report will reflect the resolution of this matter as Pinnacle has promised. I have attached all relevant documents for your review. I am a flight attendant living out of state in base. My XXXX has been doing the bills. This week we received a notice from the collection agency Pinnacle Recovery. Prior to this, we received no notification that our automatic payment is no longer attached to the new XXXX credit card. Therefore, we haven't been paying the bill since XXXX. The collection agency is the first notice we received. I called XXXX today, XXXX and spoke with XXXX. He said that someone attempted to call, yet we have no voicemail or notification to prove it. He then transferred me to XXXX who is in collections through XXXX. She said that there were XXXX letters sent. We said that we never received those notices even though the correct address was verified. I asked if she could email them to me. She said it would take a bit but she would do it. It is now XXXX as I have waited over XXXX hours and still nothing is in my inbox. I find it a bit suspicious that she said she had these documents yet they can not be forward in a timely manner making me think that they actually don't exist. Then my husband XXXX XXXX called Pinnacle today. He spoke to XXXX in account release. Pinnacle stated that XXXX doesn't have to notify us of missed payments and then lectured him about paying bills. If you check our credit score, I was XXXX points away from a perfect score. We are not delinquints. We had an issue with XXXX with this new card. A payment of {$1600.00} was sent in XXXX but went to the old account and not the new one. I called every XXXX weeks to try and resolve this issue in which they could not find this payment. Not once did anyone say my account was disconnected. I finally resolved it last month using my bank. I am very dissapointed with XXXX to say the least. I do not mind paying what I owe and would pay it immediately since this is the first time I have been made aware. What I do mind is the {$360.00} fee charges when we didn't even know we were delinquent and given the chance to rectify. This is very poor business and seems like a scam to make money. In XX/XX/XXXX I made payment arrangements online for a balance owing. A week later I was contacted by XXXX stating that no arrangements were made and he was not seeing it and that he will be calling me every two weeks. I had to explain to him what was done and that arrangements were done within his company website. He then asked me to fax a " resolution confirmation ''. I faxed him the information right away thinking that I was no longer going to be harassed. Today I receive another call regarding the same issue. I checked my account to make sure payment was taken out, which it was, but 3 days earlier than the agreed date. He sent me over to his supervisor, which was incredibly rude with no customer service. I have a timeshare with XXXX XXXX XXXX and I constantly don't get the bill for the dues owed annually. They are due by XX/XX/XXXX. On XX/XX/XXXX the company sent it to Pinnacle collection agency without a initial bill nor any late notices. After recieving notice from Pinnacle I checked on XXXX XXXX and they have my correct address, email and phone number. The invoice said I owed XXXX plus XXXX in interest. I immediatley paid the XXXX on the Pinnacle website stating that I would only pay XXXX XXXX dues and that if they wanted to send me an invoice for a law abiding amount of collection fee I would send it to pinnacle. They keep changing the amount and I have repeatedly asked for ; 1. an original bill from XXXX XXXX 2. any notices XXXX XXXX sent me 3. what basis they have a XXXX fee for collection I just get nasty responses from XXXX and " we can't talk to you '' from XXXX XXXX. from what I gather NY has a 22 % maximum collection fee ( where I live ). XXXX XXXX has a posted 0.0493 % interest late fee. For XXXX days after XX/XX/XXXX today would give me a balance of original dues owed XXXX plus XXXX interest and XXXX monthly late fee equals XXXX. Today I will pay the difference of XXXX for {$260.00} to XXXX XXXX XXXX and want to get rid of this timeshare as they constantly do this!! I have copies of last years bill, the XXXX invoices from pinnacle and proof of payemnt of the XXXX. A 40 % collection fee is far beyond normal to charge and Pinnacle already took it out of the payment I made for XXXX XXXX stating I only paid them XXXX or so dollars so far. Please advise as I do not not pay my bills when I know about them but I will not pay for ransom!

XXXX XXXX 2017, I made a settlement offer against my timeshare. Here is the email receipt that I received after the payment was made. " This letter will confirm that Pinnacle Recovery , Inc. and XXXX XXXX , XXXX .- XXXX XXXX have accepted a payment of {$1600.00} on your outstanding balance of {$8900.00} on your contract # XXXX on XXXX -17. T his obligation will be considered a full compromised settlement to terminate all rights and interests in the contract originally signed. You are not responsible for the additional contract balance or any outstanding fees regarding your maintenance fees '' Today, XXXX XXXX , 2017, I received a letter dated X/XX/ 2017 t hat stated I owed {$8700.00 } ( with new late fees and collections costs assessed. When I called the collection agency, I attempted to ask multiple times why this debt was not cleared. I could not even finish one sentence or question. The phone rep would not give me a straight answer. I was able to glean that there is a " Note '' on my account that it was paid directly to the collection agency, but no record that they have received anything back from the actual timeshare company. In her contradictory information, it appears they ( Pinnacle ) did not notify the timeshare company, even though I received this information above, that the account was paid. I would like the collection agency to take this payment and resolve immediately with the timeshare company as this was considered paid in full. Otherwise, it appears to me that this is simply grand larceny by the collection agency.

XX/XX/scrub>XXXX XXXX Pinnacle placed a collection account on my credit file. I disputed the account with the credit bureau. I replied to Pinnacle for debt verification documents as I have never dealt with or had any legal obligations with Pinnacle Recovery INC. They sent me documents. I again disputed the information with XXXX for inaccurate information per the FCRA. After XXXX disputes and contact with the company, I am filing a complaint for violation of the FCRA. Pinnacle Recovery verified inaccurate and false information on my credit file. XXXX continues to not hold data providers to the standard of the FCRA. I do not have any legal obligation with Pinnacle Recovery INC and I have never had any legal dealing with XXXX XXXX XXXX as they continue to report on my credit file. They also have reported incorrect balances and other pertinent information that should have triggered XXXX to remove from my file. All the inaccurate information is a direct violation of the FCRA but furthermore verifying false information goes to blatantly damaging my credit history and rating. XXXX allowed this after I submitted documents showing inaccurate information being reported showing their gross disregard for only reporting accurate data as required by the FCRA. By participating in reporting inaccurate data XXXX is culpable because they must delete false accounts when presenting documents even if the company verifies them as accurate.

We contacted Pinnacle Recover in XX/XX/2020 regarding an email with an amount due. Pinnacle Recovery stated there was non an amount due, they had no record of an amount due and stated the email was sent in error and ignore it. XX/XX/XXXX we were contacted again by Pinnacle through email. We again called and inquired about the info sent. Pinnacle stated nothing was due and they had no record of us or an account being past due. XX/XX/XXXX, we were sent another email, now with a higher total. We called and the person from Pinnacle stated there was no account, but wanted to check some other info. After a discussion for 15 minutes, the Pinnacle person stated there was an account noted as past due but there were multiple computer accounts in their system which they incorrectly created ( in their system ). We discussed that we also contacted XXXX in XXXX and we were told the account was current. The person at Pinnacle stated there was a small fee due, then combining all of the accounts, it was much higher. In order to keep our credit clear, and at the time of payment, there was no derogatory remake on our credit report. Pinnacle added a derogatory remake AFTER the payment was made. This is a collection tactic to abuse their power and harm paying customers. The remake needs to be taken off of my credit report, effective immediately. The remake is an attack to show dominance and is a hate crime.

Received a Collection letter indicating I have a debt to XXXX XXXX XXXX of {$95.00} and {$26.00} to Pinnacle Recovery Inc for Collections Fees, I called XXXX XXXX XXXX and I was confirm I was current on my maintenance dues so I called Pinnacle Recovery to informed them that I was current with XXXX and they stared with different stories The {$95.00} was for upcoming dues so I asked why there is a collections for upcoming dues? later it was a balance from previous payments which I remaindered that I just called XXXX and I was current then they said it was all collections fees so I told them that is not what the bill said the answered was that is not relevant that is the balance and I have to paid it. I offered to paid {$26.00} which the bill shows as Collection Fees and they did not accepted they want me to paid {$100.00} to resolved the matter. My wife and I purchased a timeshare condo on XXXX XXXX XXXX in XXXX. We made this purchase while on vacation, we have never returned to this timeshare. We did join XXXX and used some of the weeks for exchange to other timeshares. XXXX XXXX XXXX have always been difficult to communicate with, and I was tired of dealing with them. I did not remember how long the timeshare membership was for, but I was done with their business practices. The annual dues went up sharply, there were special assessments every time a storm went through the island. I thought the timeshare purchase was for 20 years so I wrote a letter to XXXX XXXX XXXX after the 20 year anniversary and informed them I was done. They just kept sending me bills. I called them several times and asked them what they needed to terminate this relationship, never got a firm answer just more bills coming in for quite a while. I haven't seen any bills from them for a few years. There is a large group of disgruntled timeshare owners who are working on a class action suit against the ownership group, they have changed their business name a few times. I receive letter in the mail from XXXXXXXX XXXX On behalf A XXXX timeshare. XXXX has maintained action of collecting mortgage payment and cleaning fees monthly. I've owned a time share for over 20 years and always been on time on my payments, due to hardship I've fallen a bit behind on my payments ( 3 payments ) so my debt of {$470.00} was transferred to debt collector " Pinnacle Recovery, IncXXXX '' on XX/XX/2020. I called them to settle my account and they now tell me {$750.00} because they charge monthly collection fees of {$140.00}, so they charged me for XXXX and XXXX and they will continue to charge me every month till my debt is paid. XXXX separate companies : XXXX. XXXX - A company saying they could sell my time-share condo got me to give them my credit card number saying they would not charge it until I gave permission. They did charge it and I got suspicious so I did more in-depth searching on this company and found they had so many scams. I filed a dispute with Discovercard BEFORE THEY PAID THE COMPANY, but XXXX paid the company anyway against my wishes. We bought a Timeshare at the XXXX XXXX XXXX, XXXX XXXX XXXX, thru a Timeshare Resale company. The property was paid in full. Used it once, not what we thought it would be. We offered the company to take back the property totally free, we just could not keep paying the Maintenance & Taxes. They refused. We stopped paying the M & T and eventually they sent it to Pinnacle Recovery , Inc for collection. This happened so long ago that I do not have exact dates. However this debt is way past the Statute of Limitations and should not be pursued anymore, much less putting it in our credit report. This could not be happening at a worst time since we were just approved for a mortgage and there should not be any significant changes in our credit scores.The daily calls and frequent letters also became very annoying. Please help us resolve this as quickly as possible for we do n't want this to interfere in our new home purchase. Thanks.

This complaint is for Pinnalce Debt Collection in XXXX. I have tried to explain to them that I sold my timeshare to XXXX XXXX XXXX, a realtor in XXXX XXXX California. license # XXXX. After purchasing my XXXX XXXX timeshare, he has failed to make the maintenance fees. Because of his not paying the monthly payments, this debt collector is contacting me for payment. I own timeshare at XXXX. I contacted them and asked to turn my timeshare in and I was told that I can start the process in XXXX. When I tried to do this in XXXX they said that I had to pay my next year 's maintenance dues first. I said they never told me that before XXXX that is the requirement. I am not going to give them a payment for not using my timeshare. I told them I would not pay and they said they will put me into collections and charge me interest and penalties that were more than my {$1500.00} yearly maintenance. They also said that they would put it on my credit report and then get a judgement against me, seize my bank accounts and garnish my wages. These timeshare companies use tactics that are very scary and this needs to be addressed. If these timeshares are so valuable why don't they take them back and resell them?

I own a fully paid for timeshare unit at XXXX XXXX XXXX in XXXX XXXX XXXX. I was late paying the annual maintenance fee for 2016 ( the last day for payment was XXXX/XXXX/2016 ). I paid the timeshare management company ( original creditor ) the 2016 maintenance fee plus interest and the original creditor 's late fee in XXXX 2016 directly by check. The check was cashed. Pinnacle Recovery is continuing to call and send me letters for an additional $ XXXX dollars ( which appears to be their service fee above and beyond the original debt ). I have paid my account in full ( less than 30 days since receiving notice ), and I am still receiving multiple calls per day. Today I received a call from Pinnacle debt collection and told the person that I wanted to speak with the representative of the company that holds my maintenance dues in order to sort out why they are saying I owe more money than was paid. He refused to hang up and blocked my line from being used for outgoing calls. I would hang up and wait 30 seconds and pick up the line to call out and he was still there. This happened for over 20 minutes and I found it extremely uncomfortable and intimidating. I also realized that I was unable to call out if there was an emergency in my home.

Pinnacle Recovery, a collection agency called my place of business and left a detailed message regarding my debt. When I returned the call and complained that it was a violation of federal law to call one 's place of business, the gentleman denied it. A past due balance with my vacation company was submitted to Pinnacle Recovery after 30+ days of non-payment. I never received any written notice of what was owed and I was never given the opportunity to dispute their claim. The individual assigned to my " case '' was not helpful.
