My consumer rights have been violated both on a federal and state level by Perdue Brandon Fielder Collins and Mott LLP. They are in direct violation of the FCCPA and the FDCPA. On XX/XX//2021, I received a NOTICE OF COLLECTION letter by mail from Perdue Brandon Fielder Collins and Mott LLP. As defined in XXXX Statue 559.55 ( 11 ), they are a " Out-of-state consumer debt collector '' attempting to collect an alleged consumer debt by means of interstate communication originating from outside the state of XXXX and soliciting consumer debt accounts for collection from creditors who have a business presence in this state. Their principle office in located in XXXX XXXX Upon further research on the XXXX Office of Financial Regulation website, this out-of-state consumer debt collector company is not registered in XXXX, which is a direct violation of s. 559.553 ( 4 ) and shall be subject to an enforcement action by the state as specified in s. 559.565 ( 1 ) ; An out-of-state consumer debt collector who collects or attempts to collect consumer debts in this state without first registering in accordance is subject to an administrative fine up to {$10000.00} together with reasonable attorney fees and court costs. Perdue Brandon Fielder Collins and Mott LLP has also committed many prohibited practices towards me. In the letter that they sent me, threatening and abusive language was used towards me by them stating to me the consequences, If payment wasnt made immediately, As a result, either your drivers license or your driving privileges may be suspended. This is a direct violation of s. 559.72 ( 2 ) ; In collecting consumer debts, no person shall use or threaten to force or violence. This is also a direct violation of s. 559.72 ( 8 ) ; In collecting consumer debts, no person shall use profane, obscene, vulgar, or willfully abusive language in communicating with the debtor or any member of her or his family. This is also a direct violation of 15 USC 1692d ( 1 ) ; The use or threat of use of violence or other criminal means to harm the physical person, reputation, or property of any person. This is also a direct violation of 15 USC 1692d ( 2 ) ; The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader. The same letter also simulates that Perdue Brandon Fielder Collins and Mott LLP is a representative, authorized, or approved by the XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, which to my understanding is apart of the government. This is a direct violation of s. 559.72 ( 1 ) ; In collecting consumer debts, no person shall simulate in any manner a law enforcement officer or a representative or any government agency. This is also a direct violation of s. 559.72 ( 10 ) In collecting consumer debts, no person shall use a communication that simulates in any manner legal or judicial process or that gives the appearance of being authorized, issued, or approved by a government, governmental agency, or attorney at law, when it is not. This is also a direct violation of 15 USC 1692e ( 1 ) ; The false representation or implication that thedebtcollector is vouched for, bonded by, or affiliated with the UnitedStatesor anyState, including the use of any badge, uniform, or facsimile thereof. This is also a direct violation of 15 USC 1692e ( 9 ) ; The use or distribution of any writtencommunicationwhich simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the UnitedStatesor anyState, or which creates a false impression as to its source, authorization, or approval. The letter also states the Perdue Brandon Fielder Collins and Mott LLP are Attorneys at law. Their website also states that one of the oldest and largest law firms in XXXX. This is a direct violation of s. 559.72 ( 12 ) ; communication with a debtor in a manner that gives the false impression or appearance that such person is or is associated with an attorney. This also is a violation of 15 USC 1692e ( 3 ) ; The false representation or implication that any individual is an attorney or that anycommunicationis from an attorney.

Received a first notice of XXXX for a debt from Perdue Brandon on XX/XX/XXXX. On XX/XX/XXXX I sent a Certified Letter with Return Receipt notifying the firm of my dispute of the debt and request that they verify the debt as required by the FDCPA. I also let them know they they were not to contact me further until they verified the debt. On XX/XX/XXXX I received the signed Return Receipt from the XXXX which was signed by XXXX on XX/XX/XXXX. On XX/XX/XXXX I received a Third Notice of Collections from Perdue Brandon seeking payment of the same debt with no verification. The exact same letter was sent as back in XXXX of XXXX for which I had already disputed without any other notification regarding what the debt is or how they own it. On XX/XX/XXXX I entered a complaint on the CFPB website against Perdue Brandon.

I am receiving aggressive collections notices from Purdue, Brandon, Fielder, Collins, and Mott, LLP XXXX, TX XXXX. This company claims to be representing a XXXXXXXX XXXX XXXX XXXX In XXXX XXXX for a debt that I owe. I do not owe this debt and I have to them and called them to explain that any fine must be fraudulent. I have never lived in that county or town. I have received letters from them for years claiming that I owe a traffic fine, but when I disputed that they claimed that it is hot checks. I am tired of there harassment. Their office has threatened repeatedly to have me arrested. I have never received one notice from the county 's government offices about what I owe, but still this law office claims that I owe something that I could not possibly owe.

Received letter from Perdue Brandon Fielder Collins & Mott LLP on unsubstantiated & false traffic ticket debt with threat of court action leading to arrest. No option to verify debt and they didnt properly disclose themselves as a debt collector. Also Texas Statue of Limitations on traffic tickets is 2 years and any tickets since I last was in the town they claimed would have been nearly 20 years ago so the debt is also invalid due to this. They didnt mention any details about debt owed other than a case number and the city. They are impersonating a government Mandated official. Possibly impersonating as the court or as my lawyer by making me enter a Guilty/Not Guilty Plea.

On XX/XX/2022 I received XXXX letters from this business demanding I pay a debt that I felt I did not owe. I used XXXX XXXX XXXX on XXXX to ask them to stop contacting me so I'd have proof of my request and they responded on XXXX and told me they will continue to contact me anyway. Today, XXXX I received XXXX letters from them at the same time. XXXX duplicate letters demanding I pay the debts I feel I do not owe. Instead of seizing contact like I requested, they doubled down and contacted me twice per " debt '' at once. I am attaching proof of this.

Company shares debt information to our bank for properties in which the bank had no interest, in effort to defame and or attack our character. We had attempted to set up payment agreement, with tax office which did not or was unwilling to make arrangements. We had paid XXXX on our debts. The bank was given personal debt and business debt information that was not related to them in any shape or form. The letter that was received by the bank also had a cc remark as to deceive the bank into thinking we received a copy of their letter, which was not.

Called Perdue Brandon Fielder Collins & Mott LLP and tried to change my address so that they stop mailing letters to my old address and annoying those tenants. They can't find me in their system and they refuse to help me. I couldn't even pay the debt if I wanted to because they can't look me up. They've been mailing me letters for 20 years now for a trumped-up ticket in XXXX XXXX that I've tried unsuccessfully to settle multiple times. Stop harassing me!!

I received a demand letter from Perdue Brandon Fielder Collins & Mott LLP dated XX/XX/XXXX. In XXXX I had an arrest with a restitution. Since that time I have been paying XXXX XXXX XXXX XXXX directly. The letter the " law firm '' threatened my arrest and or license suspension. Neither of which, according to the courthouse and my used to be probation officer, can happen. Not only claiming I owe them, they are also claiming I owe {$420.00} more than I owe.

Call company today. Tried to explain that I have previously stated cease and desist.I contacted the municipal court, they stated no action will be taken, these are from 2008. I did receive a letter yesterday stating that your drivers maybe suspended and a may be an active warrant for your arrest. I have asked again to cease and desist and was told today that they will not do that and call and letters will continue.this I harassment and I wan it stopped!

This law firm is a debt collector who has been filing lawsuits and collecting on taxes during this pandemic. They are using tactics that are unethical. I paid my bill in XXXX and have the right to work out a payment plan with the water district for current year taxes. They filed a lawsuit on my mother 's property taxes for over {$9000.00} dollars. Greed and desperate for money against people who have lost jobs in a down economy.

PerdueBrandonFielderCollins & Mott, LLP sent a collection big red post card with 2 Docket # s and a dollar amount of {$810.00} all visible for anyone to see as well as stating I would be subject to an arrest roundup if I didnt pay by XX/XX/2019. Besides putting this information out for everyone to see causing humiliation the amount owed was incorrect.

This company ( Perdue Brandon Fielder Collins and Mott, LLP ) which I have " NO Contract '' with is in violation of the FCRA. They have no legal right to collect the debt per the contract with the original company. Reporting of the debt is a violation of the FCRA.
