XX/XX/19: XXXX XXXX to my employer and to a former partner of mine- (but no calls to me?) I was informed that this company - Pendleten Pre-Legal- left a message(s) for me to return their phone call. The female who left the message indicated that is was regarding "a legal matter"; the message was left at a employer's desk where personal phone calls are not permitted. Furthermore, said female left a voicemail with a former partner of mine. As the alleged borrower of the debt they are trying to collect on, I've never received any notification via phone or mail myself. I attempted to resolve the issue over the phone, but was threatened with court action if there was no resolution by XXXX XXXX on XX/XX/19, which is today, when I stressed that I did not receive any prior notification via mail. I was notified that multiple emails were sent, which is pish posh. I'm confident the loan this "establishment" is attempting to collect on stems from several identity theft issues that I've had in the past. Should I receive notification of the alleged debt via registered mail (wherein I must sign for the receipt of the mail), I would be more than happy to review the information and determine if I should act or not. I would like the know the alleged loan agency, the amount, when the loan was received, and any other pertinent details- again- all via registered mail. However, I've not received any communication from this company whatsoever other than some abstract details via a phone call today. I asked to speak to management many times, and was told there was no manager. I notified my employer that this was a scam as I have no verifiable information from this "establishment" at hand, and to transfer all of the proceeding phone calls to security. I believe this establishment, Pendleton Capital Management, is in violation of the FDCPA. Though I used profanity in return and probably should not have, the female(s) on the receiving end of the phone used abusive language , have spoken or implied to others about an alleged debt, have called a workplace ( they were notified during today's conversation that said employer does not allow personal phone calls as I work in healthcare ), told a co-worker I've committed a crime (or implied as much with the phone call itself). If there is a judgement against me, or a pending judgement, I would like to see the court documentation. Again, a registered letter would suffice. As I understand, a collector cannot state that a law suit will be filed nor that my wages will be garnished if that is not the intention (both of the aforementioned statements transpired during the call today- which I recorded myself, and I was told I need to fix by XXXX today). I have filed a report with the XXXX as well. Lastly, this agency should expect certified mail from me wherein my wishes to have them stop immediately contacting me, my partners (former/current) and employer(s) (former/current) or anyone that I know for that matter- via phone.

A family member called me and stated that someone called looking for me on the night of XX/XX/19. I got the phone number from the family member and immediately called. The rep that answered the phone stated my name and asked if that was me. I verified and the gentleman hung up. This was at XXXX eastern time. I then called back two more times and no one answered. This morning I called the number again. ( XX/XX/19 ) This time at XXXX. The lady who answered the phone stated my name and I again verified it is me.I asked what time they close for the evening and she stated " it depends, but XXXX ''. I explained what happend the night before and she stated she would transfer me to who I needed to speak with. She then transferred me to who I later found out was " XXXX ''. XXXX started off on an ok note. He verified my info and identified why they were calling for me. When XXXX told me what he was calling for, I set up a payment plan and gave him a card to put on file to to make my payments. After I did this I asked XXXX if they can remove the debt from my report because me making payments may reage the account. XXXX stated that it would report as a settlement. I told him then I would be better off not paying it until I can pay in full. I didn't want a settlement on my credit He asked if I still wanted to make payments monthly and I stated no. I will pay when I can pay in full. XXXX stated " well then we will report you '' and he hung up. I called back to make sure XXXX removed my card and knew not to run it. When I called back, I didn't at that time know his name so I just started talking. I assumed it was the same gentleman because I JUST got off the phone with the guy and he sounded the exact same. What I said was " I'm calling back to make sure you know to remove my card ''. He said I wasn't talking to you. I said oh ok, It sounds like you are the same guy. The gentleman on the phone said " What are you trying to say? All XXXX guys sound the same?? '' I stated, are you XXXX?? I can't tell that over the phone. He then said hold on. After maybe a minute, the SAME guy came back and started talking. He stated " We already sent your account over for processing. Make sure you have two forms of ID on you when they get you ''. I again stated Make sure you remove my card. He hung up the phone. I called one more time. This time a woman answered. When I asked for the rep 's name who's over the " account '' the woman stated " Oh Lord, you're calling back again! '' she put me on hold and sent me to the voicemail of XXXX. That's how I found his name. XXXX was very deceptive in trying to manipulate me to believe I would be arrested. He also never verified he removed my card. I also don't appreciate his usage of race in our conversation. Who does he know I am NOT XXXX?? I didn't care about his XXXX and I still don't, so I am not sure why that was mentioned.

My received my first phone call on XX/XX/2019, a voicemail, which I called back to. A customer service rep named XXXX ( possible misspelling ) with Pendleton Capital pre-legal department. She explained I had a XXXX dollar debt with XXXX, to which I asked for a validation of the debt, meaning a copy of a credit card statement, etc. She refused to give me any more information of regarding the debt and immediately hung up on me. I never received any correspondence via email or physical mail from Pendleton Capital regarding the debt. I received another phone call on XX/XX/2019 from a XXXX from Pendleton Capital. I, again, asked for the debt to validated to which he became verbally abusive, threatened to take me to court and pay XXXX verse the XXXX hes attempting to collect. I kept repeating for the debt to validated, he said it was against the law to send me anything and the debt was already validated to the company. He refused to send me any information or invoices of the receipts. I asked for it to be emailed to sent via my physical address. He became irate and hung up with me. He called back a few minutes later saying we got disconnected ( we didnt, I was downtown with full bars and I can tell when Im hung up on and when I hit a dead spot ). He again started threatening with my wages being garnished and I would have to pay thousands over the XXXX debt. I repeated constantly for my debt to be validated. He refused to send me anything, but said he would send a demand letter via email. I never received anything. On XX/XX/2019, I received another phone call from the same gentleman, XXXX. He again started with the same tactics and said I sent him a bad email address ( I didnt ). I told him all information needs to be mailed to me including information in my request to validate the debt. He said I was not cooperating and hung up. I do not believe they can validate the debt, or else they would have easily just sent me the information to look over. This gentleman was very abrasive, threatening, and he would not let me speak. Again, he refused to send me anything about this debt and when I started to say, you can not call me at this number. He spoke over me and hung up. Please look into this, its ridiculous and I believe a scam.

Pendleton Capital Management called my sister, XXXX XXXX, on Friday after repeatedly calling her back to back. After about the firth call, she answered and a lady asked her was she my sister. Out of concern, she said yes. The debt collected said that she was trying to get in touch with me. She never asked for any contact information but started telling her that I owed a debt and that they were a XXXX company. She stated that they were in the process of taking legal civil actions against me and was taking me to court. The debt collector told her that I had put a stop payment on the account and that I need to call her at XXXX XXXX ext. XXXX. When my sister called me about what had been said on Friday, XX/XX/2019, I became very angry about this company divulging my person and financial information. On Monday, XX/XX/2019 I, XXXX XXXX, called the number that was given to my sister and spoke to the lady that talked to my sister. ( XXXX or XXXX ) I told her who I was and she stated that the call may be recorded. I told her that the call was being recorded on my end. She said that it was fine. First, I asked her did she divulge personal and private financial information about me to my sister? She denied some but began to become very defensive. She would not let me talk and we got into a heated discussion. I did not say anything inappropriate to her but she started to threaten me. She said that I was in violation of the Disability act, I told her that I was XXXX. She said that she knew that I had two vehicles and named them. She stated that she would tell the finance companies that I was in the habit of writing bad checks and that I stole money. Very little was said about the debt except I owed over a thousand dollars and that I refused to pay. I stated no such. I asked her to send me all the paper work that she had about the debt and she said she could not. She hung up on me and call me back 15 minutes later. She has been calling me since but I will not answer. Everything I have stated is backed up with a recording.

On Thursday, XX/XX/2018 at XXXX - I received a phone call from XXXX apparently XXXX XXXX . I answered the call, and it was a message that at first sounded like maybe it was trying to say " this message is for ... '' but it was really fast, and I could not actually hear any name, or distinguish words really. Then it switched to male-sounding automated voice that said " this is an urgent matter, we have been trying to reach you, please press XXXX [ or XXXX ] now, and we will connect you with someone who can help. Again, this is an urgent matter. '' Then it starts to repeat the message. I hung up. Then I called the number back within a few minutes, and it is answered by an automated system. It is a womanly voice, saying " Thank you for calling XXXX XXXX. Helping one consumer at a time. If you received paperwork from our office, and know your party 's extension, dial it now or dial zero and a representative will be with you shortly. Please be advised that this is a debt collection company and this is an attempt to collect a debt ... This call will be monitored and recorded for quality assurance. It repeats this message two additional times, and then it will hang up on you. But no one ever answers. So, my problems are 1 ) this number has never previously reached out to me, 2 ) I have received no notifications anytime recently regarding any past due amounts or debt collections from this company or others, 3 ) the only bills I have are all set up for autopay, and doctor bills are paid within a timely manner, so there is no reason for a debt collector to call me, 4 ) If they never answer their phone, then I will never talk to anyone, because I REFUSE to press XXXX or XXXX or any number to talk to someone, if you are calling me then you should be on the phone, or don't call. I strongly feel that this is an attempt to scam people out of money that they do not owe to anyone. I tried to report it to the FTC, and they directed me to this website.

Hello, My complaint is for the Pendleton Capital Management Inc. My first issue with this company was about two years ago. I originally had set up a payment plan and was intending to get the debt taken care of. I then had an emergency which caused me to not have enough to make my payment, I then reached out to the company to let them know that I was unable to make the payment as discussed. I spoke with a representative named XXXX XXXX extension XXXX. XXXX demeaned me, called me a bum, swore at me, told me I need to grow up and get my XXXX together. I chose to disconnect the call at this point and she proceeded to call my mother who was a reference on the initial loan, left her a message stating that she has been unable to get in touch with me. I was quite upset, my mother ended up calling back and speaking with XXXX supervisor. She then reached back out to me and apologized on XXXX behalf and said that they would delete my mothers information and that XXXX would be reprimanded. I then did not receive any more calls for about the last two years. Today I get a voicemail from a gentleman named XXXX XXXX, I returned his call to his extension and left a voicemail. I then called back to speak with someone who was there so that I could figure out what this was in reference to. XXXX XXXX answered the phone, of course I disconnected the call immediately. I then called back and smoke with another supervisor, to whom I explained the previous situation and requested that they do not contact me again. I told them that they are not allowed to harass me as it is in violation of the FDCPA and that I would be filing a claim against them.

A man named XXXX has been from a Pendleton Capital collection agency & has been calling my place of employment about an alleged debt I owe from a pay day loan company. Not only have I asked the man to stop calling my place of employment but I don't owe any money. I told him its not legal or OK to contact me on my work phone number and he said it is and he will continue to do so. I contacted the company he claims I owe money to because I figured if I owe this payday loan company, I can settle the debt with them personally- not with a random stranger who keeps asking for a credit card #. I have written confirmation/proof that a ) I don't owe this payday loan company any money and b ) they are not associated with " Pendleton Capital '' as thats not the debt collection company they use when something goes into collection. They provided me with the debt collection company they DO use and its not Pendleton Capital at all. I have repeatedly asked the man who calls to stop calling me at work and to take this number off the calling list ( my work line ). I told him if for any reason he insists on calling - to call my cell phone. He says I didn't answer when he called. I explained to him its because I am at work and am not allowed to take personal calls. He said he will continue to call my work to reach me. I need this to stop, please! I have been getting private calls from this company for about a month.They leave prerecorded messages stating a file has been placed on there desk if I dont call back by close of business they are going to take legal action. The 1st call today XX/XX/20 was around XXXX or XXXX, the 2nd call was around XXXX. I auto dialed them back advised the rep that I spoke to a rep last week told them to stop calling my cell number contact me by mail. The lady stated they have not called me I advised her you call everyday and leave messages dont call me again. I asked for her name and number she said XXXX at ext XXXX. XXXX. She gave me her last name I was too heated to write it down. I advised her I was going to report the company. She said you owe a debt, she called me a name, I hung up. She called right back at XXXX I answered what, she said you are stupid. I said it takes one too know one and hung up. The name from the number she called back on says XXXX XXXX That was unnecessary and harrassment, not to mention very unprofessional. I know there are laws against this, ( 3 ) calls from the same company less than an hour, threathening messages, and harrassment. She needs to lose her job and the company needs to be fined.

This collection agency has had several different people call me, my family, my friends and my manager at my place of employment which I can not have personal calls at work. The first person XXXX XXXX called my work number from, when she was told I could not received personal calls at work she demanded to speak with my HR department because she wanted to serve me with papers at my place of employment. She was told she could leave a message but keep insisting to speak with HR. After the call was disconnected she called back from another number and again demanded to speak with the HR department. Again was told no personal calls at work and her message would be given and to cease and desist from calling. She then called my manager and told him she needed to speak with me about a personal matter. One week later I get a call from XXXX on my cell phone, I specifically said please stop calling. Two weeks later I get 3 calls the last one leaves a message XXXX XXXX telling me he was going to forward my paper work for legal action, he also once again called my manager at work tell him a claim is being filed against me.

On XXXX XXXX XXXX, agent XXXX of Pendleton Capital made contact with consumer. XXXX did not notify consumer that the communication was an attempt to collect a debt. XXXX did not disclose to the consumer, his rights under the law to dispute debt and/or his right to validate the debt. XXXX did make a false and misleading statement, specifically that there was a 'pending judgment ' for an outstanding debt - verifiably false. XXXX could not name the plaintiff and/or which court/state the action was taken. Pendleton Capital did not and has never provide written notification to the consumer of the existence of the alleged debt. Phone call 1 was an incoming call from agent XXXX. Phone call 2 was an outgoing call to agent XXXX by consumer in an attempt to gain disclosure. Agent XXXX verified there was no judgment pending against consumer, verifying agent XXXX did in fact make false and misleading statement in an attempt to coerce consumer into a payment.

Was contacted by XXXX, a representative of Pendleton Capital Management ( also doing business as XXXX XXXX XXXX ). XXXX stated that there was a bill that was past due, and I asked him to explain what it was for. XXXX stated that it did not matter and that if I did not pay him by XXXX XXXX that he would contact the Florida State Attorneys Office and have criminal charges filed for prosecution. XXXX also stated that fines could be in upwards of {$3500.00}. I was very upset, and hesitantly I agreed to make the payment of {$160.00} to resolve the debt. I received 2 emails from their company. After the bill was paid there was an email sent stating the debt is satisfied and that I am to release XXXX XXXX XXXX of any liability. I do not agree with this statement. I feel this was handled completely unprofessionally and that atleast two debt collection practice laws had been violated.

XX/XX/2019 XXXX received the same call XX/XX/2019 XXXX again received the same call I decided to look up the number that was continuously calling me threating legal action, taking I have never seen this number before or have never been contacted by this number and most of the claims are harassing claims. The XXXX reports within this company are horrible and several people claiming false legal action among them. I found 90 claims that most have said they have no debt and this company is calling harassing people. XXXX was the number I was contacted on and afraid of pressing 0 as they tell you to. I didnt want any of my personal information or personal things within my phone being obtained from a scam.

I have had XXXX XXXX from Pendleton Capital Management contact me Monday, XX/XX/XXXX before XXXX XXXX. One call was at XXXX XXXX then again at XXXX XXXX eastern standard time. When I didn't answer he then called my parents which would have been before XXXX XXXX central time as they are in Texas. Not only did he call them before XXXX XXXX he also released my debt information to them. I know this from the details relayed to me in a text message. When setting up payment arrangements on a previous call to these calls, Mr. XXXX failed to mention to me a {$10.00} processing fee for each payment, which I am still being charged and it is not being applied to my debt as it should be since on a recorded line I was not informed of it. When speaking with Mr. XXXX on XX/XX/XXXX I mentioned this to him and his response was " oh Yeah ''.

On XX/XX/2021 I received a phone call from my brother stating, that XXXX calling from number XXXX, had called and was trying to find me. He said XXXX also stated that I owed a lot of debt and that I needed to be reached. He stated that XXXX got his number after he ran a background check on me. I also received a call from my mother stating the same thing. XXXX then called me a left me a voicemail that stated " this is the last attempt to contact you. After today, I will run a background check and look at your assets. '' I never gave my brothers or my mothers name on any application I submit. When I spoke to XXXX after I called him back, he stated that he already ran a background check and could tell me any asset I had. when I told him not to call back without written proof of the debt, he said he could call me at any time.

XXXX XXXX left a voicemail with information on my phone at work. I returned his phone call & told him I was not allowed to receive personal calls at work. He assured me that my work # was erased from the system. The following week he called my work again after telling me he would no longer contact me at work. He initially told me that the settlement about was {$320.00} & then {$290.00} and when I asked for some kind of documentation he would not mail it to my physical address but would only send it to my email. When I received the email it didnt have the new amount on it. I will lose my job if I continue to receive calls at work & id really appreciate it if that would stop.

YOUR COMPLAINT I have previously filed a complaint against this company approximately 2 months ago regarding a processing fee that I was not told about. The complaint was responded to by stating I would not have to pay this fee per transaction. This was true for about 2 payments. My payment as of XX/XX/XXXX was charged the fee again. When calling the company I was told they would have never made this statement to me about not charging the fee and I was told a manager would call me back. I called a second time hoping to speak with someone that would look into the file and once again a manager would call me back immediately. No one has called to resolve this issue.

Last calls received XXXX XX/XX/2019 at XXXX and XXXX. ( XXXX ) XXXX I had asked on two previous occasions to remove my number from their call list. My daughter owes the debt, so the business ( Pendleton Capital ) and I do not have any business connection. They have failed to cease and desist with calling my phone number and it is harassment at this point. I have continually blocked their numbers even after requesting to have my number removed from their database. The customer service representatives have a tendency to try to bully me when I've requested removing my number from their listing.

I am gettin repeatedly harassing and abusive and threatening calls and voice messages by XXXX from Pedleton Capital. XXXX is also harassing and leaving abusive calls to my sister, who doesn't even reside with me. He is claiming they helped onto may asets ( I don't even have any ) and the ratting eagle action and jail. This can't go on and these people should be prosecuted for un-ethical behavior. Real collection agencies by law have to send a letter explaining the debt and not collect money over the phone. The phone is XXXX and they are applying harassing and threatening techniques.

I settled my credit account through a third party company Pendleton Capital Management and the main creditor XXXX XXXX XXXX.
