On or near XX/XX/XXXX National Collegiate Student Loan Trust ( NCSLT ) filed a civil action law suit with their chosen debt collectors of Patenaude & Felix against my mother and me for the amount of {$41000.00} alleging XXXX XXXX issued a student loan to us and later assigned it to NCSLT. My mother and I were served with a summons sometime near the end of XXXX begging of XXXX of XXXX. We then proceeded to file in Forma Pauperis along with our answer to the complaint filed by Patenaude & Felix for NCSLT. My mother and I then filed an amended answer on or near XX/XX/XXXX. Shortly thereafter, on or near XX/XX/XXXX Patenaude & Felix filed a Motion for Summary Judgement for NCSLT. The motion was heard on XX/XX/XXXX and denied by the court due to the collection law suit being moved sometime in XX/XX/XXXX to the State of Nevadas court annexed program which is a non-binding arbitration governed by statues and court rules for the State of Nevada for any civil law suit that is less than {$50000.00}. Arbitration took place on XX/XX/XXXX. On or near XX/XX/XXXX the Arbitrator filed his Decision and Award with the court. The Arbitrators Decision attached to this complaint concluded that there was no evidence that a contract was made or funded by XXXX XXXX to my mother and I. Even if a loan was made, there is absolutely no evidence that NCSLT was assigned the loan or has the right to collect it. The Arbitration Award was rightfully in favor of me and my mother. Shortly after, on XX/XX/XXXX Patenaude & Felix filed a Request for Trial De Novo on behalf of NCSLT. During our research on how to file a Motion to Strike Request for Trial De Novo my mother and I discovered that Patenaude & Felix, NCSLT, and XXXX XXXX , XXXX ( XXXX ) willfully violated several laws and court orders to pursue debt collection litigation against us! A Motion for Summary Judgement was filed by Patenaude & Felix on behalf/for NCSLT on or near XX/XX/XXXX contained an affidavit from XXXX XXXX, an employee of XXXX, an application from XXXX XXXX XXXX alleging it to be a contract, an alleged Chain of Assignment, Pool Supplement/Bill of Sale, and various accounting documents. On XX/XX/XXXX in the United States District Court for the District Delaware, the Consumer Financial Protection Bureau ( CFPB ) entered into a consent order with NCSLT and XXXX specifically prohibiting NCSLT and XXXX from pursuing debt collection and providing specific statements or documents in attempt to collect alleged debts. The judgement order in which NCSLT and XXXX are listed as Defendants in the following case : Case XXXX and can be viewed directly online at the CFPBs website at : https : XXXX. Further and more specifically the consent judgement order entered into with CFPB, NCSLT and XXXX have conduct requirements. Starting from paragraph numbered 8 of the consent judgement order, and quoting the case which is Case XXXX Document 3-1 Filed XX/XX/XXXX Page 10 of 40 PageID # : 30-33 below, states that : ( Note that Defendants are NCSLT and XXXX ) 8.Defendants must provide all Defendants Servicers that are engaged in the servicing or collection of Debts with actual notice of this Order within thirty ( 30 ) days of the Effective Date. 9.Defendants and their officers, agents, servants, employees, and attorneys who have actual notice of this Order, including but not limited to all of Defendants Servicers, whether acting directly or indirectly, may not violate sections 1031 and 1036 of the CFPA, 12 U.S.C. 5531, 5536, and must take the following affirmative actions : a.Defendants shall take all actions necessary to comply with the terms of the Order, including but not limited to ensuring that all of Defendants Servicers acting as Defendants agents comply with the terms of the Order. b.Defendants must require that any of Defendants Servicers or other agents retained by Defendants in connection with servicing or collection of student loans ( 1 ) agree to abide by the terms and conditions of the Order and ( 2 ) require any agents that Defendants Servicers hire in connection with servicing or collection of student loans to abide by the terms and conditions of the Order. c.Defendants and their officers, agents, servants, employees, and attorneys who have actual notice of this Order, including but not limited to all of Defendants Servicers, whether acting directly or indirectly, may not initiate a Collections Lawsuit to collect Debt unless they possess : i.the documentation necessary to prove that a Trust owns the loan, including but not limited to, documentation reflecting the complete chain of assignment from the Debts originator to the specific Trust claiming ownership ; and ii.a document signed by the Consumer, such as a promissory note, evidencing the agreement to pay the loan forming the basis of the Debt. d.Defendants and their officers, agents, servants, employees, and attorneys who have actual notice of this Order, including but not limited to all of Defendants Servicers, whether acting directly or indirectly, may not initiate a Collections Lawsuit to collect on a loan for which the applicable statute of limitations has expired. e.Defendants and their officers, agents, servants, employees, and attorneys who have actual notice of this Order, including but not limited to all of Defendants Servicers, whether acting directly or indirectly, may not collect any Debt through Collections Lawsuits that Defendants or their agents have any reason to believe may be unenforceable. f.Defendants, their officers, agents, servants, employees, and attorneys, and all other persons in active concert or participation with any of them, who receive actual notice of this Order, including but not limited to all of Defendants Servicers, whether acting directly or indirectly, are permanently restrained and prohibited, in connection with the collection of a Debt, from submitting any Affidavit : i.containing an inaccurate statement ; ii.in which the Affiant represents, expressly or by implication, that the Affiant is familiar with or has personal knowledge of the Consumers education loan records or the maintenance of those records when that is not the case ; iii.in which the Affiant represents, expressly or by implication, that the Affiant has personal knowledge of the Consumers Debt when that is not the case ; iv.in which the Affiant represents, expressly or by implication, that the Affiant has personal knowledge of the loans chain of assignment or ownership when that is not the case ; v.in which the Affiant represents, expressly or by implication, that the Affiant has personal knowledge of the documents relating to the loans chain of assignment or ownership when that is not the case ; vi.representing, expressly or by implication, that the Affidavit has been properly notarized if the Affidavit was not executed in the presence of a notary or if the notarization was otherwise not compliant with applicable notary laws ; or vii.in which the Affiant represents, expressly or by implication, that any documents or records concerning the Debt that forms the basis of the Collections Lawsuit have been reviewed by the Affiant when that is not the case. Patenaude & Felix, NCSLT, along with XXXX XXXX and XXXX XXXX XXXX of XXXX submitted affidavits after the CFPBs judgement order that were not only identical, but also violated all seven stipulations on or near XX/XX/XXXX in their Motion of Summary Judgement, in Arbitration held on XX/XX/XXXX, and again on or near dated XX/XX/XXXX in their trial brief attempting to collect a debt through a lawsuit willfully violating the court order issued XX/XX/XXXX in the United States District Court for the District Delaware Case XXXX blatantly committing contempt of court, fraud, and perjury. Continuing by quoting paragraph number 10 of the CFPBs judgement order for Case XXXX Document 3-1 Filed XX/XX/XXXX Page 11 of 40 PageID # : 33 states : 10.Defendants are permanently restrained and prohibited from reselling Debt that is time-barred or for which Defendants lack the necessary documentation required by Paragraph 9 ( c ) without obtaining the written agreement of the purchaser to comply with this Order. 11.Defendants, their officers, agents, servants, employees, and attorneys, and all other persons in active concert or participation with any of them, who receive actual notice of this Order, including but not limited to all of Defendants Servicers, whether acting directly or indirectly, are permanently restrained and prohibited from, in connection with the collection of a Debt, providing any testimony in a Collections Lawsuit that contains any misrepresentations, including false statements that the witness : a.is familiar with or has personal knowledge of the Consumers education loan records or the maintenance of those records ; b.has personal knowledge of the Consumers Debt ; c.has personal knowledge of the loans chain of assignment or ownership ; or d.has personal knowledge of the documents relating to the loans chain of assignment or ownership. 12.If Defendants determine that any of their agents, including but not limited to all of Defendants Servicers, are on behalf of Defendants engaging in any conduct prohibited by this Order, including but not limited to Paragraphs 9 and 11 of this Order, Defendants promptly will take the necessary steps to ensure that their agents cease any and all practices that violate this Order. The documentation is abundantly clear of the numerous and deliberate violations that Patenaude & Felix, NCSLT, and XXXX have committed against my mother and I including section 9 ( c ) ( i ) and ( ii ), all section 11 of the judgement order, FDCPA 15 USC 1692e, 15 USC 1692e ( 3 ), 15 USC 1692e ( 10 ), 15 USC 1692f, 15 USC 1692g, and sections 1031 and 1036 of the CFPA, 12 U.S.C. 5531, 5536. Rather than withdrawing their affidavit and or collection law suit, Patenaude & Felix, NCSLT, and XXXX refuse to remove their affidavit from any pleadings or cease collection efforts in accordance with paragraph XXXX of the judgement order for Case XXXX Document 3-1 Filed XX/XX/XXXX Page 12 of 40 PageID # : 34 - 35 14. With regard to pending Collections Lawsuits in which Defendants, through actions taken by Defendants Servicers acting on behalf of Defendants, have filed an Affidavit that contains any misrepresentationsincluding but not limited to false statements that the Affiant ( 1 ) is familiar with or has personal knowledge of the Consumers education loan records or the maintenance of those records, ( 2 ) has personal knowledge of the Consumers indebtedness, ( 3 ) has personal knowledge of the loans chain of assignment or ownership, ( 4 ) has personal knowledge about the maintenance of documents relating to the loans chain of assignment or ownership, or ( 5 ) has attached as an exhibit a true and correct copy of a documentDefendants must either withdraw the pending Collections Lawsuit or ensure that the Affidavit is withdrawn. Defendants must instruct their attorneys, Defendants Servicers, and their agents to either withdraw the pending Collections Lawsuit or notify the court of the following in writing while simultaneously providing the court with a copy of the Order entered into between the Bureau and Defendants : Plaintiff withdraws the affidavit of [ insert name of affiant ] pursuant to an Order entered into by the Consumer Financial Protection Bureau and the National Collegiate Student Loan Trusts. My mother and I included a copy of the CFPBs judgement order in its entirety as an exhibit and requested the court to take judicial notice of the judgement order in our Motion to Strike Request for Trial De Novo filed on or near XX/XX/XXXX. The matter was argued in court on XX/XX/XXXX and the court denied our motion to strike. The presiding judge commented in regards to the CFPBs judgement order we attached to our motion was along the lines of that the findings where highly disturbing and was positive they would be argued and presented to the short trial judge. Lastly, the collection law suit was moved to the State of Nevadas Short Trial Program set to take place on XX/XX/XXXX. Pre-Trial conference was held on or near XX/XX/XXXX. We confirmed our addresses with the court on or near XX/XX/XXXX and again during the pre-trial conference that was held on or near XX/XX/XXXX verbally confirming where to send documents however, Patenaude & Felix deliberately sent pre-trail discovery, interrogatories, and admission documents to our previous address in hopes they would not be caught abusing the discovery process and cause delay successfully stonewalling us from properly defending ourselves and submitting documentation in a timely manner to the court against the fraudulent collection law suit they continue to pursue. Further, this deliberate and scrupulous action of sending pre-trial discovery, interrogatories, and admissions to our previous address caused us to receive the documentation on or near XX/XX/XXXX when the court required all the paper work due on XX/XX/XXXX as ordered by the Pro-Tempore Judge in his notice we received on or near XX/XX/XXXX. The pre-trail documents contained the same false statements, documents, and affidavits that are the source of this complaint. On XX/XX/XXXX and XX/XX/XXXX Patenaude & Felix yet again continues with unfair and deceptive collection efforts by avoiding or failing to contact my mother and I for pre-trial conferences that was to be initiated by them. In all due fairness and to no fault of my own, my cell phone does not receive the best reception at times and is damaged causing it to not always work or run properly. However, this does not excuse the fact my mother who is the co-defendant in this fraudulent debt collection law suit was never contacted. Had a conference line been provided or issued to call by the Pro-Tempore Judge, an issue of not being contacted or potentially missing a phone call due to technical errors to attend pre-trial conferences would have never been an issue and easily prevent underhanded or abusive legal tactics. Regardless, Patenaude & Felix has all the contact information required to contact me and my mother including phone numbers and deliberately abused initiating the pre-trial conference calls by only contacting my telephone leaving a message and not contacting my mother by phone whom is a co-defendant and I was with during both scheduled times for conferences in this fraudulent debt collection law suit making it appear as if we were ignoring and willfully un-attending pre-trial conferences. We were informed via letter received by the Pro-Tempore Judge on XX/XX/XXXX that we may now face court sanctions due to the abuse and blatant deception of Patenaude & Felix not contacting my mother/co-defendant on XX/XX/XXXX. Patenaude & Felix, NCSLT, and XXXX continue to submitting affidavits with false and misleading statements and pursue debt collection lawsuits without having the full chain of assignment! They have been informed of the CFPBs judgement order and have all the documentation we have filed with the courts including all the information regarding this matter. Unless the CFPB immediately enforces court orders and the laws against these companies, they will continue this disgusting predatory behavior by filing false statements, misrepresentations, filing debt collection law suits when they do not have the right to collect, and committing fraud against consumers like my mother and I.

I am filing a new complaint against XXXX XXXX XXXX XXXX XXXX/XXXX XXXX XXXX XXXX XXXX ( XXXX ). InXX/XX/XXXX they have filed a garnishment of my salary at the Levying Office in XXXX XXXX, California. In response I filed an exemption with the Levying Officer of XXXX XXXX, and I was granted an exemption because of financial hardship that I could hardly support my family, due to my low salary. XXXX XXXX XXXX XXXX XXXX receive and accept our monthly payment of {$150.00}, the latest payment was in XX/XX/XXXX. I am submitting this complaint because Patenaude has resurrected and actively renewed their garnishment, now against my sister who is my co-signer. Since, I was exempted for garnishment, in XXXX XXXX, California, Superior Court, this time they filed it in XXXX XXXX, Central Sheriff, XXXX XXXX XXXX, XXXX XXXX, CA XXXX, Phone ( XXXX ) XXXX. Our family was stricken again by this notice, because we were given 15 days to file an exemption with XXXX XXXX Sheriff Office. My sister is having a financial difficulty because she is unable to work full time due to a successive vehicular accident that she suffered, she is physically unable to work full time, due to her XXXX problem which caused her to work for light duty only. She is most of the time absent from work. Also, she has four ( 4 ) student loans on her own to pay. This default judgment was filed in XX/XX/XXXX, by XXXX XXXX XXXX XXXX XXXX with XXXX XXXX Superior Court, California without our knowledge. XXXX XXXX XXXX ( XXXX ) who was servicing XXXX XXXX XXXX XXXX XXXX did not inform us. We were stunned and dismayed when this XXXX XXXX XXXX XXXX XXXX sent us a copy of default judgment from the mail. We did not expect our private student loan to become delinquent and eventually charged off by XXXX, because we were paying XXXX every month, but XXXX failed to record the payment accurately to each and individual owner/lender of the student loan. Although, we were using our food money already to pay our student loan, we tried our best to pay in spite of our financial difficulties. We investigated XXXX XXXX XXXX, why our 3 student loans became delinquent and eventually discharged off. I was told that, it did not matter wherever we record your payment, because you have a loan, this was the answer given to me over the phone by XXXX XXXX XXXX, employee. Only 1 active student loan was left with XXXX, that became overpaid, the 2nd XXXX loan, disbursed in XX/XX/XXXX, the rest of the 3 student loan charged off from XXXX : XXXX XXXX XXXX XXXX XXXX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and XXXX XXXX XXXX XXXX XXXX by XXXX XXXX XXXX XXXX XXXX. Of the 3 charged off student loan, only for 1st XXXX loan disbursed in XX/XX/XXXX, XXXX XXXX XXXX XXXX XXXX filed a lawsuit and eventually filed a default judgment. We found out that XXXX was submitting all our payment to the 2nd XXXX student loan only, the same owner/lender with 1st XXXX loan disbursed in XX/XX/XXXX. All the monies we paid, were paid to XXXX, loan No. 2 only, and no payment was recorded to the other 3 student loans. XXXX recorded and posted all the payment to this 2nd XXXX loan, even if there were specific instruction and notation on the check that each was for payment to individual loan owner. Upon charged off of this 3 student loan, the other 2 student loans from XXXX XXXX XXXX and XXXX XXXX XXXX accepted our pleading to let us pay {$150.00} every month, respectively. These 2 charged off student loan, were large amount, as compared to student loan, acquired by XXXX XXXX XXXX XXXX XXXX. But, Patenaude did not want to accept our payment of {$150.00} every month, but as of this writing receives and is accepting our payment, even if Patenaude filed the Court Case in XX/XX/XXXX. Patenaude should not have filed a Court case, because we paid 1st XXXX loan, disbursed in XX/XX/XXXX combined with the 2nd Student XXXX loan, to the same owner/lender, XXXX XXXX XXXX XXXX XXXX loan disbursed inXX/XX/XXXX, sequence # XXXX. XXXX XXXX XXXX XXXX XXXX received both our payment to this ( 2 XXXX private student loans ), since XX/XX/XXXX up to the time, 1st XXXX student loan was charged off, because XXXX thought there were no payment made to this 1st XXXX loan, but due to inefficiency, and improper recording of XXXX it did not show any record of payment to 1st XXXX loan. We were dismayed and stunned, and my mother almost XXXX of XXXX XXXX, when we received copy of the default judgment sent through the mail. We know nothing about the default judgment because we have continuously sent our payment through XXXX XXXX XXXX, Bill Pay. We did not expect this case would happen, because no communication has been sent to us by XXXX. Religiously we have been paying all four ( 4 ) student loan serviced by XXXX XXXX XXXX. To date, only one ( 1 ) is active current student loan remained with XXXX, because it became overpaid. We were not informed and were not aware that XXXX, was remitting all our payment including payment to other bank ( XXXX XXXX XXXX XXXX, to XXXX XXXX XXXX XXXX ), only to XXXX XXXX XXXX XXXX XXXX. XXXX was remitting the payment to Loan Sequence # XXXX, disbursed inXX/XX/XXXX As a result there were no payment recorded/posted to the rest of our private student loan, with XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, and to the 1st XXXX Student loan. In reality there were payment made to 1st XXXX student loan, because it went to the same Lender/Owner, XXXX XXXX XXXX XXXX XXXX, even if it does not show in the record of 1st XXXX student loan. Because XXXX accumulated all the money and paid it all to XXXX XXXX XXXX XXXX XXXX, every month, even if the other payment is for XXXX XXXX XXXX and XXXX XXXX XXXX XXXX. We have maintained and kept copies of all of our receipt of payment from XXXX XXXX XXXX

Date : XXXX XXXX I'm filling a complaint in accordance with XXXX XXXX and Third-party debt collector on behalf of XXXX XXXX Patenaude & Felix XXXX On XX/XX/2021, I received a summons from Patenaude & Felix. My spouse signed these papers. As soon as I became aware that I was being sued for debt collection, I filed a response with the Court on XX/XX/2021 While awaiting for the court to approve my fee waived application, I faxed over the letter and mail a certified letter ( XXXX XXXX ) to Attorney Office requested a debt validation and forensic audit as I disputed the amount that was claimed by XXXX XXXX and attorney 's office that file lawsuit. I have also tried to resolve this problem and have made it clear to them that I would rather avoid a long court process and the high costs associated with it. On XX/XX/2021, I called Patenaude & Felix and spoke with my case manager ( XXXX XXXX. XXXX, XXXX ) .I explained to her my financial site that I am unemployed, raising XXXX small children, XXXX income with multiple debts owed to other creditors and that I am considering chapter XXXX if we can't come to an agreement with a settlement offer. I then again reminded her that I sent the letter requesting a debt validation and forensic accounting as I denied the amount {$17000.00}. She confirmed to receive the letter and will request it from XXXX XXXX. On XXXX XXXX I called the office again as I am now upset that I did not receive debt validation, but only a generic cover letter from XXXX XXXX stating thank for getting hold of them and another letter ( 1 page ) dated XXXX XXXX from Patenaude & Felix stating that " the client has made a good faith determination that the information does not establish that a valid dispute exists. I recited the case manager that the information I receive is not debt validation and I am entitled to the document and not just cover letter stating that I should accept and believe that it's valid and take their word and there are discrepancies of {$3500.00}. She was rude and upset that I demand the debt validation. And twisted my words stated I should of requested the document which I did via certified mail and phone call on XXXX XXXX. I told her it's her job to know the terms of debt validation. I made another attempt to resolve this issue and ask for settlement and avoid this stressful process. She went on to say that she could not even begin to negotiate or make an offer unless I admitted and accepted that I owed {$17000.00}. And now I have to wait for the documentation. I responded NO its wrong amount to my best knowledge and stated its strange how she now refused to even get an offer when she did previously on the phone for {$11000.00}. Nor did she give me a proper document. She told me I had to wait and refused to talk about it. On XX/XX/2021, the Court appointed the arbitrator, the Recusal was on XX/XX/2021, and the alternate arbitrator was appointed on XX/XX/2021. XXXX XXXX, I called XXXX XXXX informing them that I can't get through the law office that collecting the debt and they refused to negotiate or settle this issue. I told them about the arbitrator and the gentleman said that they could not make an offer because it would be a double settlement. I then asked a question about the arbitration process. He is not aware of this and is not familiar. Right afterward, I contacted case manager and again asked her about the arbitration court and ask if we can settle or she can't because now court move forward with arbitration. She acted as if the office had not received the same 3 letters that I received from the court with regard to this. She then put me on hold and the call was disconnected before I even had a chance to ask questions about the debt validation document again. She never calls back. I have made numerous attempts to address this issue and I feel that the plaintiff ( Patenaude & Felix ) is breaching the duty of good faith and fair dealing as well as manipulation.I have attempted to take care of this debt in a fair way, but they have not been fair or honest with the process and with me. I too feel that the plaintiff intentionally drags this issue longer to where we are not unable to solve this prior arbitration and will cost more money. I have not received anything I requested or able to go over it with them and XXXX XXXX.

XXXX XXXX credit card is breaking the Fair Debt Collection Practices Act and consumer rights protection laws. They sold my debt to Patenaude & Felix a collection agency who has continued to break these consumer rights through misrepresentation, harassment, communication with 3rd parties, deceptive forms, and unfair practices. In XX/XX/XXXX I paid {$350.00} on a credit card to XXXX XXXX. XX/XX/XXXX I paid {$110.00}, XX/XX/XXXX {$240.00}, XX/XX/XXXX paid {$95.00}, XX/XX/XXXX paid {$95.00}. The minimum due was {$92.00} at this time which was not even covering the interest. Although I was trying to pay more than the min due for many months I began to fall into the revolving interest trap. XXXX XXXX uses unfair practices including exorbitant interest rates and fees. XXXX of XXXX I missed a payment and the minimum due jumps from {$92.00} to {$220.00}. XX/XX/XXXX min due jumps to {$260.00} and I am able to make a payment of {$92.00}. Then in XX/XX/XXXX I missed a payment again due to a loss of wages and the min due jumps up to {$390.00}. XX/XX/XXXX min due is {$490.00}. XX/XX/XXXX {$590.00}. XX/XX/XXXX {$690.00}. Now it became impossible for me to catch back up with the payments which I was only paying interest on to begin with. Then XXXX XXXX sold the debt to the debt collection agency Patenaude & Felix. Breaking communication with 3rd parties act P & F sent a man to my door where my underage daughter answered. He tricked her into opening the door telling her he had an important package for her mother. Then he proceeded to throw the papers at her telling her she was " served ''. She was mortified when I got home. Then Patenaude and Felix began the harassing phone calls, They continued harassing with daily and weekly calls through out the National Pandemic of Covid 19 where I explained to them that I no longer had a job and had been given a notice to vacate from my house. The times I had tried to work out a payment plan with them they refused to take anything less than what they deemed as " substantial '' in the amount of {$350.00} which I explained that I could not afford. I continually asked P & F for a validation letter which I never received until I was sent the paper filings from the courts. I only received letters stating they are from " the attorney '' threatening " If I wish to avoid further collections activity. '' When I called P & F they claimed that they were not attorneys and they did not work for XXXX XXXX. Yet the court documents were misrepresented by stating I was being sued by " XXXX XXXX '' and not the collection agency Patenaude & Felix. All paperwork of correspondence state that they are from P & F attorneys. Court Papers were by " XXXX XXXX '' and employees that I spoke with were the from a collection agency named Patenaude & Felix. I never spoke to the attorney until I was at court where he agreed to call me after the judge deemed them to " work things out '' with me. When I spoke to the attorney and explained that I did not have a job or house, he explained that they would only take an amount that was " substantial '' and wanted {$150.00} a month. I stated that what is substantial to a XXXX dollar company such and XXXX XXXX was not the same as what is substantial to an individual without a job and house. Interesting note that XXXX XXXX had been " bailed out '' when they were in debt. He explained that if I did not agree they would just take more $ from me when he got the judgement from the courts. He finally agreed to {$75.00} a month which he explained if I missed or was late on any payments then they would take me back to court and get the max amount of money. Through this intimidation I agreed and was given no other choice. Another thing I found strange is the flag on the P & F website is from the XXXX XXXX. Am I being sued from a company that's from the United States? Is P & F a law firm, collection agency, or are they XXXX XXXX?? Good Morning, I am XXXX XXXX, consumer. I am filing a formal complaint against PATENAUDE & FELIX, A.P.C. for their transgressions and breach against my personal information. This contract that was created with XXXX XXXX is null and void because I entered into this contract and was not given full disclosure of all the credit terms. Pursuant to 15 U.S. Code 1631 ( a ) a creditor or lessor shall disclose to the person who is obligated on a consumer lease or a consumer credit transaction the information required under this subchapter. Pursuant to 15 U.S. Code 1635 Except as otherwise provided in this section, in the case of any consumer credit transaction ( including opening or increasing the credit limit for an open end credit plan ) in which a security interest, including any such interest arising by operation of law, is or will be retained, the obligor shall have the right to rescind the transaction until midnight of the third business day following the consummation of the transaction or the delivery of the information and rescission forms required under this section together with a statement containing the material disclosures required under this subchapter, whichever is later, by notifying the creditor, in accordance with regulations of the Bureau, of his intention to do so. The creditor shall clearly and conspicuously disclose, in accordance with regulations of the Bureau, to any obligor in a transaction subject to this section the rights of the obligor under this section. The creditor shall also provide, in accordance with regulations of the Bureau, appropriate forms for the obligor to exercise his right to rescind any transaction subject to this section. The disclosure of my right to rescind the contract was never given to me and was removed from the terms and conditions of the contract. The Law Office of Patenaude & Felix has been engaging in some unfair practices of illegally charging and trying to collect on interest and fees that are not entitled to them. The original creditor, XXXX XXXX, closed the consumer credit account ending XXXX in XX/XX/XXXX with the balance of {$3200.00}. Patenaude & Felix issued a judgement to collect {$3400.00} on XX/XX/XXXX. In account of the court fees of {$180.00} XXXX documentation can be provided XXXX, that total should equal {$3300.00} and NOT {$3400.00}. In status quo, the account is now at {$3600.00} XXXX {$230.00} more than what is originally stated including court fees ). Also, because the judgement is reaching its 4-year mark, according to Nevada law ( NRS 11.190 ( 2 ) ), the statute of limitations ceases Patenaude & Felix to continue to try to collect on this debt. And, due to me no longer living in the state of Nevada, Patenaude & Felix is considered to be outside of their jurisdiction to try to continue to collect on this debt. This company refuses to close my account and send it back to the original creditor so that I can take care of this account accordingly. All I ask is that the firm legally abides by state law and releases the collection account back to the original creditor. National Collegiate Student Loan Trusts XXXX and XXXX sued me on two debts that XXXX allegedly came to own. XXXX packages debts into trusts based on the years in which the original debt was incurred, therefore I will be referring to them as the XXXX and XXXX matters. Based on the amounts and because I live in XXXX, they sued me in the Supreme Court of the State of New York XXXX XXXX of New York. I was served papers for these lawsuits in XXXX of XXXX ( for the XXXX matter ) and XXXX of XXXX ( for the XXXX matter ). I had my attorneys draft a response to both lawsuits, as I am under the belief that National Collegiate Student Loan Trusts does not own these debts. When we entered into discovery, I received some documentation for the XXXX matter, though not enough to satisfy me as to XXXX 's claim to the original debt. As to the XXXX matter, I received no discovery at all. I found that odd, since I do not recall with certainty the original debtor in that instance. On XX/XX/XXXX, I received a Stipulation Discontinuing Action from XXXXXXXX XXXX XXXXXXXX on the XXXX matter. They dropped the suit. Curious as to why, I found that New York 's Department of Financial Services filed suit against XXXXXXXX XXXX XXXXXXXX a mere 8 days prior ( XX/XX/XXXX ) for " not [ honoring ] requests by consumers for substantiation of debt, that is, requests for information proving the validity of the debt and XXXXXXXX XXXX XXXXXXXX right to collect the debt. '' They had sued me and failed to uphold even the appearance of their duties as officers of the court to provide discovery, and attested to having reviewed documentation that they did not even provide me in the most high-stakes possible environment - a lawsuit that they themselves had initiated. And they engaged in this behavior knowingly. It was my understanding that as of XXXX of XXXX, this body ( CFPB ) had enjoined National Collegiate Student Loan Trusts from entering into any lawsuit absent an audit that was to determine whether or not XXXX had sufficient paper-trail for Chain of Assignment to substantiate a lawsuit. It was also my understanding that under that agreement, XXXX was to communicate and make clear to counsel representing them that they were not to enter into any lawsuit from that date henceforth until that audit was complete. Either XXXX did comply and its counsel did not heed this order ( there was an internal lapse in communication that led to an extreme collections action such as a lawsuit - a seemingly convenient mistake that would have led to collecting on a bad debt had I not been as diligent as I am ), or XXXX did not comply and its counsel was derelict in providing discovery to me, or the discovery doesn't exist because there was no documentation into the XXXX matter ( the likeliest scenario ). I am an XXXX XXXX XXXXXXXX by profession, whose career has taken him through the process of remediating many shortcomings as a result of consent orders by federal and state regulatory authorities. I have been audited, and in my career I have created many procedures in anticipation of audits. I have wanted to look at this XXXX audit report myself, its methodologies ( whether or not the standards were lax or stringent ), and its determinations with respect to both the XXXX and the XXXX matters. I had a joint account orginally with XXXX then XXXX XXXX ( name change ) that was open in XXXX XXXX. The terms of the purchase was a promotion that ended a year later. Monthly, most times Bimonthly payments were made directly from my bank account to XXXX bank. I did complete the payments in XXXX. I got a letter from the Magistrate 's Court I believe in XXXX XXXX. I was being sued in a civil matter by XXXX XXXX Collection Attorney, XXXX XXXX of Patenaude & Felix citing non payment of the TOTAL amount of the credit! We appeared in court on XXXX/XXXX/XXXX. I presented over XXXXpage of bank statements showing the dates and amounts of the payments that were made to XXXX. The Plaintiff 's attorney had no proof of non payment. The Judge taliied the payments and found it to be paid off and found in my favor. In XXXX XXXX I got notice that a default judgement was ordered against me for the amount that I had proven already paid plus court costs. I had gotten Notice of XXXX or XXXX date ... ONLY the judgement. I went to PA and immediately filed a petition to srike the judgement ( i becane an attorney in 4 hours )! A few days later I got the notice of the judge granting my petition & a new trial date was set for XXXX/XXXX/XXXX. The following day I got XXXX XXXX acknowledgement. On XXXX/XXXX/XXXX I took the bus to PA and the plaintiff 's attorney never showed so the judge ruled in my favor. An appeal was never submitted as I did not receive any notice as clarification was noted as to which address they should send any information to. So stand. my original finding & judgement from XXXX/XXXX/XXXX that the credit was paid off. I submitted the dispositions to XXXX, once in XXXX and again in XXXX. They removed the entry from my credit file. I was unaware that I had to individually submit documents to all XXXX bureaus. Recently I had my credit run as I am trying to obtain a VA home loan. The agent informed me that my XXXX was XXXX, they could n't get my XXXX and XXXX was XXXX. He informed me that XXXX XXXX was listing a charge off for over {$5000.00}! I uploaded and mailed all three bureaus the court documents and waited a month and XXXX and XXXX remained unchanged. I called both. I was told XXXX review was on going BUT XXXX stated they could not remove the listing because there is no link between XXXX and the court documents! I then proceded to send them XXXX pages of court files clearly depecting the link between XXXX XXXX, the amount they were pursuing, their collection agent XXXX XXXX of Patenaude and Felix and the XXXX Court Rulings in my favor. After many hours of frustrating phone calls I do not know what else they need to remove this negative from my file. I have paid Synchrony, proven that in a US court, paid additional money to file petitions, won that, travel to PA, fax and mail several pges of documents on more that one occassion and they STILL do not have enough evidence! XXXX handed the case to a debt collector. Contacting them INSTEAD of the debt collector will keep me in the same place since my court documents are not enough for these credit bureaus. I would like to file a complaint against XXXX XXXX, XXXX XXXX XXXX XXXX XXXX, as this company has violated the Fair Debt Collection Practices Act ( FDCPA ), Section 807 ( 2 ) ( a ) " The false representation of - the character, amount, or legal status of any debt. '' The last written affirmation of this debt and attempt to collect payment was made on XX/XX/XXXX by representative XXXX XXXX via USPS mail. The company also attempted to contact via phone multiple times during all hours of the day, including calling my familys landline phone without mine or their consent, with the most recent verbal contact via voicemail on XX/XX/XXXX. Communication was written form, as well as verbal communication via phone at all hours of the day and night. I was repeatedly contacted and left threatening voicemails on my cell phone advising that I owed this debt and needed to make payment arrangements with Patenaude & Felix to pay the balance of {$3200.00}. I was also threatened by one of their representatives via an anonymous number on my cell phone at XXXX PST on XX/XX/XXXX stating I needed to be at my residence within an hour so that they could serve me paperwork to which I needed to show two forms of ID and sign. If I was not present at the address, they would view it as being non compliant and seek law enforcement officials or go to my familys house or personal contacts on file in an attempt to locate me. However, upon consulting with a credit monitoring company, I was provided with a copy of my XXXX Credit report, which reflects that XXXX XXXX reported that this debt was charged off and taken off my credit report in XX/XX/XXXX. According to the California State Attorney General, the statute of limitations to collect upon a debt in the state of California ( to which I reside in ) is 4 years. Upon further review of this same credit report, Experian reports that Patenaude & Felix, A.P.C unlawfully accessed my XXXX credit report in XX/XX/XXXX and in XX/XX/XXXX without my consent, making it evident that Patenaude & Felix, A.P.C was aware that this debt had been reported by XXXX XXXX as being charged off and taken off of my credit report after the 7 year limit. Patenaude & Felix is fraudulently misrepresenting the status of the debt, in an effort to obtain payment and collect further personal and financial information. In using the internet to research this company, I found many incidents of complaints, due to unethical collection tactics, fraudulent misrepresentation, and harassing customers. I have continually rejected all of their attempts at communications with me. I have provided evidence that they have violated my consumer rights and I will consider all further communications from them and further attempts to access my credit report a form of harassment.

I had a collection agency Patenaude & Felix call at work. When I picked up I was surprised to even hear them state they are a collection agency trying to collect a debt. I interrupted them and stated that this is a work phone and to not call back. I hung up. After that I have received several more calls and voicemail from them. I received a garnishment letter from my employer stating that Patendaude & Felix is garnishing my check. I called the company and they verified that the phone number they have on file which is my work number and that the second number to call which is my actual number. They than said that they have a mailing address of XXXX XXXX for me which was just updated. and stated XXXX previous addresses. I said that I have lived in the same house for over 5 years and the XXXX XXXX address is my work address and i just started working here 2 years ago. so it was weird they had that address but not my current address that I have had for 5 years. They said the only way is to pay {$1000.00} down then they would stop the garnishment and refund my {$550.00}. I said that I do n't have that kind of money. I said can they just keep the {$550.00} that was taken out of my paycheck as the down payemnt and then start a monthly plan. They refused. The debt first became delinquent in XX/XX/XXXX. They filed suit against me in a county I didn't live in, in XX/XX/XXXX, which was more than a year after the statute of limitations had passed. I never received notice of the suit so that I could respond or was aware in any way of the suit. They then, last month, got a hold of my address and mailed a writ of garnishment to my apartment complex without my apartment number on it so that I couldn't receive it or respond and followed through with garnishing my wages. I am a single mother and rent in my area is very high. I pay over $ 1500/month for a 2 bedroom apartment for my XXXX children and I and I also have bad XXXX and am in need of XXXX XXXX for a XXXX on my XXXX that I recently found out about, but have not been able to schedule because I'm barely scraping by and can't afford the time off of work right now. I emailed the company with a dispute as soon as I was notified by my employer and advised them that I was disputing several things about the garnishment, of my medical and financial situation, and that I needed it stopped and for someone to contact me but nobody did. That was over the weekend, and my paycheck on Friday was garnished for {$300.00}. I called Thursday afternoon and got their voicemail so I left a very detailed message about everything begging them to do something and they called me back the next day while I was at work. I called back on my break and got voicemail again and told them when I would take lunch and asked if they could answer then or leave me a message with the time they would be available or for someone else to talk to and still got voicemail when I called on my lunch. I left another voicemail and indicated I would be on lunch for a specified period of time if they could please try to get back to me and they called back an hour and a half after I had said I would be available. This was very important so I answered and left my desk to go to the patio and tried to talk to the guy and told him I couldn't go into a bunch of details because I was at work now but based on my long very detailed voicemail which he acknowledged receiving, could he please tell me if there was anything they could do but he refused to discuss it with me because I wouldn't go over all of the details again at work although he admitted having heard them all on the voicemail. Not only have they been unhelpful, but they have, what feels like intentionally, sent things to me in a way that I couldn't respond, their attitude was negative and not respecting of my privacy when I couldn't go into details at work, although I had already given them to them, and tried quite a bit to reach them outside of work to discuss it, but most of all, they filed suit against me well after the statute of limitations in my state was up.

On XXXX XXXX, I came to a settlement agreement with XXXX XXXX XXXX, a representative of the collection firm Pateneaude and Felix A.P.C. concerning the listed file number. I was forced to reach an agreement with this representative due to XXXX XXXX refusal to work with me. My contact through XXXX XXXX was XXXX XXXX and it was difficult to reach him and get responses or answers in a timely manner. While his letter referred me to Pateneaude and Felix to resolve the account, I had on more than 1 previous occasion rescinded any rights to transfer my information or account outside of XXXX XXXX. As a result of forcing my hand, per the attached settlement letter, the amount of {$4100.00} was paid in 2 installments of {$250.00} on XXXX XXXX and {$3800.00} on XXXX XXXX as the enclosed copies of the payment receipts show. On my initial contact with XXXX, I expressed my complaint at the way the summons was served and that my wife and I felt threatened at the scare tactics used. His response to me was Im a lawyer so I know the law and I dont care what you do and his language was very confrontational and his statement about the aggressive tactics were to get my attention. I am requesting a completion of payment and paid in full letter in accordance with my request to XXXX and in accordance to the total in the agreement letter to be mailed within 24 hours of your receipt of this certified return receipt letter. I was never notified by Patenaude & Felix or by my bank about this levy. The company I work for makes a direct deposit to my bank account. XXXX went to withdraw the money to pay the rent but was told by the cashier that the account was levy two days ago. She told the cashier Mr. XXXX that this debt does not belong to XXXX XXXX and this is his account. He said that there was nothing that can be done. XXXX contacted Patenaude & Felix XX/XX/XXXX and spoke to lawyer XXXX XXXX explaining to him that the bank account belongs to XXXX XXXX and the debt belongs to XXXX. On XX/XX/XXXX XXXX went to the bank branch manager Miss XXXX XXXX and discussed the problem with her but she said there was nothing that she can do. So XXXX wrote the Bank cooperate office. Miss XXXX XXXX said she can not do anything but I can contact the sheriff. We spoke to Miss XXXX at the Sherriff department in XXXX XXXX and she explains to us that when the sheriff came to the bank, the bank associates are supposed to notify him that there is another person on this account and in that case this other person must be notified first before the account can be levy. Patenaude and Felix ( P & E ) reached out to me about settling an old judgement, originally filed in XXXX. I have received countless letters from them in XXXX, offering {$2200.00} to settle a {$11000.00} debt with XXXX XXXX. Unfortunately, at the time ( XXXX ) I was unaware of, and never served, the judgement, so it went unanswered. Since XXXX, the debt has been transferred to different collection agencies. However, I received no formal notice or court doc stating that P & E had taken over for XXXX. In fact, when I called XXXX in early XX/XX/XXXX, the rep explained that XXXX held the judgement. Then, XXXX confirmed it was transferred to Patenaude and Felix. Recently, my financial bank brought it to my attention that a active lien is on my property, which prevented any financial transactions, until it was cleared. I called P & F to discuss the account and they sent letterhead on XX/XX/XXXX requesting a settlement amount of {$2200.00}, to be paid by XX/XX/XXXX. A cashier check for that amount was XXXX XXXX received and signed by someone in the P & E office by XXXX on XX/XX/XXXX. On that same day, after XXXX, I received an email from them stating that they can not accept the payment and insist that I call to discuss. I am requesting the assistance of CFPB for this ongoing matter with Patenaude & Felix ( P & F ). I have sent them emails requesting a clear understanding of the offer terms. To recap, I received an offer letter for a final and one-time payment of {$2200.00} with a deadline of XX/XX/XXXX. However, the terms of the offer were not clear. P & F has refused to reply to my emails or phone calls and did not send any other notifications to me, all though they claim they did. The office manager at the escrow company ( who was to fund the offer money ) has confirmed that she, too, received no notification or return calls, in regards to requesting an extension of time past XX/XX/XXXX. Later, PF produced and submitted a copy of the letter of extension to XX/XX/XXXX to CFPB that they claimed to have sent to everyone involved, yet no one received it. and they sent pages of correspondence to CFPBthat no one seems to have, with no proof of delivery to me or the escrow company. Nevertheless, I sent a cashier check of {$2200.00} prior to the first deadline ( XX/XX/XXXX ) since they refused to answer and demonstrated unethical practices that could not be trusted. . The issue of their terms still remains. The offer letter to escrow, dated XX/XX/XXXX, said the satisfaction of judgment would be sent once the " total balance '' is received. The " amount due and owing '' is {$2200.00} as stated in that letter. But, in another letter to me, dated XX/XX/XXXX it says the satisfaction of judgment would be sent, upon receipt of the " balance owed ''. According to the letter, the balance owed showed {$11000.00} and the " settlement amount was {$2200.00}. '' This left me to believe that {$11000.00} must be paid in order to qualify as a Satisfaction of Judgement. Since I could not get clarity from P & F, and the deadline of XX/XX/XXXX was fast approaching, a cashier check for {$2200.00} with " paid in full '' in the memo line was delivered to them on XX/XX/XXXX. Later, the check was returned to me due to the memo line message. Hence, we are back to the beginning with no direction.

I would like to file a complaint against Collection Agency, Patenaude & Felix , A.P.C., as this company has violated the Fair Debt Collection Practices Act ( FDCPA ), Section 807 ( 2 ) ( a ) " The false representation of - the character, amount, or legal status of any debt. '' The last verbal affirmation of this debt and attempt to collect payment was made XX/XX/XXXX at approximately XXXX ( PST ) by a Patenaude & Felix , A.P.C representative via phone. In XX/XX/XXXX, I was contacted by Patenaude & Felix , A.P.C., regarding a debt with XXXX XXXX Credit Card Company, Communication was written form, as well as verbal communication via phone. Upon further review of this same credit report, XXXX reports that Patenaude & Felix, A.P.C accessed my XXXX credit report on XX/XX/XXXX and two different times on XX/XX/XXXX, making it evident that Patenaude & Felix, A.P.C was aware that this debt had been reported by XXXX XXXX as " discharged in bankruptcy '', yet the company continuously violated Section 807 ( 2 ) ( a ) of the Fair Debt Collection Practices Act by fraudulently misrepresenting the status of the debt, in an effort to obtain payment. In using the internet to research this company, I found many incidents of complaints, due to racial profiling and unethical collection tactics toward individuals XXXX XXXX, which also leads me to believe that these continuous effort to collect a debt, reported by the original creditor as " discharged in bankruptcy '' may have also been racially motivated.

In XX/XX/XXXX, my private loan held with XXXX XXXX XXXX was passed off to a debt collection agency due to me not being able to afford the expensive amount XXXX XXXX XXXX wanted all at once. Patenaude and Felix is the company in which I would file this complaint with ; I was in communication with them before they were ever in communication with me in regards to my loan. I the consumer received an illegal communication from PATENAUDE & FELIX A.P.C. on behalf of XXXX XXXX XXXX ( XXXX ), XXXX. In written form of a court complaint case # XXXX, about a consumer credit transaction in regards to an alleged credit card debt on XXXX for alleged sum of {$8200.00}, account # XXXX. In which I filed my answer to the complaint with the court on XXXX, and I also certified mailed with green return slip to PATENAUDE & FELIX A.P.C., in which they received my court answer on XXXX. In which I have proof of delivery by green return slip signed. The court date was moved from XXXX to XXXX, for PATENAUDE & FELIX A.P.C. claimed they did not receive my motion and vacated for later date, but I have proof they did receive my motion. I also received a communication from them on XXXX saying this alleged obligation is my responsibility after they conducted an investigation, but how can they investigate themselves if they are the ones conducting the fraud? If they conducted an investigation why cant they provide me with proof that this alleged obligation is my responsibility? That is a violation of 15 USC 1692b ( 2 ) not state that such consumer owes any debt. I responded in written communication back notifying them of a few of their multiple violations pursuant to 15 USC 1692, The FDCPA, which they received by notarized certified mail on XXXX. Which also included, request pursuant to 15 USC 1692g to validation of debt and pursuant to 15 USC 1692c ( c ) ( 2 ) as I am the consumer, and original creditor, invoked specified remedy for injuries incurred by both corporations. I received a voicemail from Patenaude & Felix XX/XX/XXXX regarding a delinquent XXXX credit card. I called back and the rep who answered the phone advised me of a payment plan of {$66.00} beginning later that month. I advised him that I was interested in the plan but that I needed to call back on the exact date I wanted to make a payment. He said that was fine and the call ended. I am still trying to get myself financially back on track and by XX/XX/XXXX I still was not able to make the payment. During the one call I had with the attorney 's office, I never advised of any bank account I wanted to use and never set up a payment. My surprise when I checked my bank account yesterday and noticed a {$66.00} check had been submitted to my XXXX XXXX XXXX account. That checking account was already overdrawn so that {$66.00} payment was returned and I was charged a {$35.00} nsf fee. I do n't believe it 's right that this 'attorney ' office and/or XXXX can just automatically take money from my account WITHOUT my authorization. I never set up a payment with Patenaude. I never even went on XXXX 's website and set up a payment. I was never given any plan details in the mail nor any sort of confirmation number since I never set up a payment. I find it interesting that the payment they tried to draft was the exact {$66.00}. I feel that the rep from the attorney 's office took it upon himself to contact XXXX and they took whatever checking account they had on file and tried to charge my account. I want to make good on my account but this is ridiculous. With the issues XXXX has had in the past this certainly does n't make them look any better in my eyes and this attorney should know what they have done is unlawful. Also, when I spoke with the rep I asked if I would get payment plan details in the mail first before I wanted that before setting up some payment. I was served papers that I was being sued by XXXX XXXX XXXX XXXX on XX/XX/XXXX. The only papers that I received was that I was being sued. I had no idea who the original creditor was. On XX/XX/XXXX I went to court in XXXX, PA at the Magisterial level. I was confused and not sure of why I was being sued. I stated that I was positive that the debt was paid and was not sure the reason why I was being sued for the debt. The debt that the attorney showed me, {$2800.00}, was different than the highest amount of debt ever on my credit report for XXXX {$2700.00}, I was not able to prove that the debt was paid off already because I did not know what I was being sued for, before going into the courtroom. The XXXX found me guilty because I could not prove my case. I then went home and looked at and printed out my credit report. My credit report shows that my XXXX XXXX was reported stolen in XXXX, that the card was closed, and that there is no missed payments on that card. I filed an appeal as soon as I got all of that information together. I have been trying to contact someone in either XXXX XXXX XXXX XXXX or Patenaude and Felix to take the false information off of my PA docket information, willing to show proof of the card being paid and closed on my credit report, but they will not give me any information or papers to prove that the account was bought fraudulently on their end and that my account has been satisfied since XXXX. I filed a police report, then a restraining order as I quickly realized that this was a man I dated for a few months. It wouldnt have lasted more than a couple dates, but he was not easy to break it off with. I knew was using it because he paid his cell phone bill with my card. When I confronted him, he threatened harm to me and my daughter. He said he had connections with gang members and as I continued to pursue action against him, I started living in fear from the threats he made, he had hacked my computer, made constant drive-bys or waiting outside until police were were called. My credit card was replaced at least 6 times, but that didnt stop his ability to use it. Finally, the credit card company agreed to reverse the charges. But upon receiving my statement in XX/XX/XXXX, they only reversed the charges beginning inXX/XX/XXXX totaling {$2400.00}! My credit card was maxed from XX/XX/XXXX to XX/XX/XXXX leaving a balance of {$9300.00}. I only continued making payments in good faith that they would resolve this issue. Originally, they were asked to validate a debt in XX/XX/XXXX. They were unable to do so. In fact, I never heard from them after that. In XXXX they filed in XXXX XXXX, XXXX and had my wages garnished. I was never served papers at my current and legal home of residence. My wages were garnished for 60 days. The only way I found out about this was through the XXXX notifying me of the garnishment. In XXXX, I received another letter from the XXXX of intent to garnish my wages again. I contacted XXXX XXXX of Patenaude and Felix and came to an agreement for payment. We came to an agreement and I was sent a copy of that. I promptly made a payment of more than 66 % of the agreed upon amount. They also sent a copy of the Release of Writ of Garnishment ( dated XX/XX/XXXX ) with an attorney 's ( XXXX XXXX ) signature from the state of XXXX. XXXX XXXX claims that they sent the release the very same day to the XXXX. As of XX/XX/XXXX, My Leave and Earnings statement confirms that my pay has once again been garnished. XXXX XXXX confirms that his office has never received any notice from the debt collection attorney 's office and that they have made no attempts to contact him or his office by phone. I have received collections attempts from 5 different companies in the past year. I have been unemployed or underemployed since XXXX and this latest company has increased the loan by almost $ XXXX in the last 6 months. This was for a 6 month, 2 night a week XXXX XXXX that promised job placement, ongoing use of facilities and equipment and ongoing education. Not only did XXXX XXXX XXXX XXXX not fulfill their part of the agreement, they closed without notice 3 years after I attended the course. When I attended the school they had 44 locations, a very big selling point. They currently operate in only 6 cities. Additionally, I accepted this loan with the understanding it was a student loan to an accredited school. It was XXXX-certified to operate in Virginia from XX/XX/XXXX to XX/XX/XXXX. The school had an admissions set up just like a XXXX college and I was very young/naive to believe it was legitimate. In late XXXX, XXXX XXXX took me to court and quickly got a default judgment order on me because they never sent me any notice of being sued. When I found out in late XXXX, I got the order reversed and counter-sued them. This went on for about a year and a half. During the settlement conference in late XX/XX/XXXX, the judge and two lawyers threatened me that if I did not accept the terms, I will owe more because I can not win in court to the tune of {$65000.00}. The debt was never mine. XXXX XXXX used fake documents and checks to say it was mine. They owned my home loan and of course they had copied of checks I sent them. I was promised copies of every document before I made one payment plus a signature from a some high authority from XXXX XXXX of documents. Nothing was sent to me except a threat. The signatory was a legal analyst from their office. Hardly anyone of authority. Why didn't the lawyer present sign that document? This was a scam from the beginning. They knew they were going to get the FULL amount from the start by offering to reduce the amount. They scammed me and scared me. I was on medication at the time of the settlement. I was emotional and could not think straight. I would have agreed to anything that day. $ XXXX was agreed upon, Now, it is the full amount of {$32000.00} and growing. This is so unfair. On Tuesday XX/XX/XXXX I contacted the law office of Patenaude and Felix APC, and spoke with a representative. I found this was regarding my former business with a target account. I explained to the account representative that I wished to settle the account, because I was expecting my income tax refund on the XXXX. We agreed to settle for {$350.00} and dated a post dated check for XX/XX/2019. I wasn't sure if my tax refund would hit my account immediately, so I explained to the rep that if it hits my account sooner I will call and make immediate payment if the payment for the XXXX is deleted. The next day XX/XX/2019, my income tax was deposited into my account with no issues. During my lunch break at work I called Patenaude and Felix APC. I spoke with the same rep. I advised payment was good to run immediate, so I gave him a debit card. I asked about deleting the payment for the XXXX because now my debt was satisfied. The rep assured me he did in fact delete the XXXX check, and my balance was settled in full. I asked for a terms letter to be emailed to me for my records, and gave my email address. The rep read an email disclosure and said I would have it over to my email on the XXXX. I never received that letter. Patenaude and Felix APC charged my account twice. Once via debit card and once via check. I called to resolve it and I was told there were no managers in that could help me. I was placed on a long hold and eventually hung up on. I called Patenaude and Felix APC maybe 10 times to try and get a resolution, and the phone just kept ringing. I eventually contacted my bank to dispute the charges.

Creditor has called my office number multiple times, each time I answered the phone with the company name and they hang up. They would not advise the nature but requested I verify whom i was with Social Security number and home address. As this was a cold call, i refused. After a couple minutes of arguing I gave my city and zip followed by my the month and year of birth. The law firm still would not advise what the call was in regards to and continued to push me for further personnel information. I refused and after three minutes of back and forth, the law firm advised it was in regards to a company, that I do not own, under someone with a similar name. They then proceeded to push me for personnel information on another person. I refused, and continued to refuse each request. I am appalled by the predatory practices utilized by this law firm, the fact that they continued to call my office, and that they try to request additional personnel information even after my zip code and year of birth did not match whom they were looking for. How can this be a legal practice as it is predatory collections if not phishing scam. The reason the number is listed is that I work sales and if you google my name it comes up as a work number.

I have already filed a complaint against National Collegiate Student Loan Trust ( NCSLT ) # XXXX-XXXX. I was encouraged by my " for profit '' XXXX school to take out predatory private student loans while I attended their school for almost 10 years at the rate of approximately {$5000.00} per semester. I never graduated, and am now a XXXX XXXX XXXX XXXX rated as individually unemployable. I have a very limited income, and can barely pay my rent since my ex-husband left and stuck me in a lease of $ XXXX/month ( which takes up 99 % of my XXXX check ). Although all of my federal loans have been forgiven due to my military XXXX status, NCSLT insists that I owe approximately {$120000.00} with ever increasing interest. After the last dispute/ investigation, NCSLT told investigators that they didn't know who I was, and so the investigation was passed onto their collection agency, XXXX , XXXX . Since then, however, I received mail from XXXX XXXX stating that NCSLT intended to sell my financial information to others unless I returned their form with the appropriate checked boxes. I explained that since I have records of only XXXX loan being signed I had requested from XXXX XXXX, the representative at their law firm, proof of the second loan. XXXX XXXX proceeded then to threaten that they would enact the judgement against me, even though I 've repeatedly tried to get proof of this second loan that they insist I owe them. He harassed me by belittling everything I said and when I told him I could pay about {$100.00} a month he said, " Ha, you want me to do all the leg work for $ XXXX/mo that will take you 18 years to pay ''. I explained over and over again that I wanted to work with them but I 'm in a financially bad situation. Over and over again he made me feel scared about what they could do to me. I told him that I did n't want to speak to him any further and that I wanted to speak either to XXXX XXXX or the lawyer on my case, XXXX XXXX. He then said, " do n't you hang up on me ''. My husband and mom who were listening to the whole entire conversation were shocked and my husband kept saying hang up, but I did n't, even when I was physically shaking and crying. On XXXX XXXX XXXX I found out that the above company issued writ of execution on behave of my name for bank garnishment. This writ was issued on XXXX XXXX, XXXX in XXXX Supreme Court in XXXX XXXX XXXX. I was never served a copy of this writ or any other docket entries as of the case was initially filed with the court. Moreover, I contacted the legal department of XXXX XXXX XXXX ( the writ was issue to withdraw all my bank funds in that Bank ), they provided me with the docket number so I can research the issue. My wife and I received a Debt Collection Notice from the Law office of Patenaude & Felix on XX/XX/2018. I responded to this notice within 30 days ( Confirmed via Certified mail Receipts and I Confirmed by an associate who works there ) requesting Verification of the debt. Since they received my dispute verification on XX/XX/2018 they have yet to verify this debt however they have continued to attempt to contact myself and the my wife. This week I received a notice from Law Offices of Patenaude & Felix, A.P.C. in an attempt to collect a debt that was settled in a short sale of a property in XX/XX/XXXX. This is the second such collection attempt from another deb collection firm, clearly the debt was resold to another firm. The XXXX firm, XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX attempted to collect the debt in XX/XX/XXXX. I retained a local attorney ( XXXX XXXX XXXX ) to contact the debt collection firm and force them to cease their attempts. My attorney cited the fact that their attempts appeared to violate the Fair Debt Collection Act and demanded that they produce " copies of all correspondence and any settlement agreements '' relative to this debt. No response was ever received and nothing was ever produced. XXXX, XXXX, XXXX XXXX XXXX immediately ceased attempting to collect the debt and no further contact was received. Now two years later another debt collection firm, Patenaude & Felix, A.P.C. is again attempting to collect a debt that was settled in a short sale and I know longer owe. I paid my account to less that XXXX $ by XXXX of 2006. I am currently in XXXX of the first XXXX employments that I have had since, and am only several months into such employment after a severe assault. As a crime victim, I believe I have victim rights to protect me against unfair garnishments and levies. Additionally, the collection agency did not submit due process in writing. The collection agency also has previously harrassed me by telephone. I believe that the collection agencies has conducted illegal searches to find my current financial information. In XX/XX/XXXX 2021, Patenaude Felix A.P.C., sent me a letter of {$390.00} with a offer to settle with my debt paid in full, a response needed by the end of XXXX. I just received a civil summons for a court date with the National Collegiate Student Loan Trust for the full amount of loans they apparently, serviced at one time. Those loans went into default in XXXX, then in XXXX, I began working with a debt collection service on a XXXX XXXX XXXX, after my XXXX Income Tax Return was garnished. I successfully completed all requirements of the XXXX XXXX XXXX as was then transferred to a new Loan Servicer and began making monthly payments there on time. That's when I last week, I was served by the county sheriffs with civil papers by the National Collegiate Student Loan Trust for the full amount of said loans plus accrued interest. I called my current Loan Servicer and they informed that I am up-to-date and in good standing. As my current servicer, no one else should be seeking settlement or have legal standing to do so. I was taken to court by a law firm representing XXXX XXXX credit card Patenaube and Fe! ix. They switched my court date three times and I was there every time but on the third time the baliff said they won a XXXX judgement on a card with a XXXX limit. I did not hear from them again for about six years. They never communicated with us on settling this debt. Then last week they levied my savings, my cd and our safe deposit box. I requested verification of debt from another collection company in XXXX. I answered a summons and plead not guilty, as they would not provide me with verification of the debt. Regardless, my wages were garnished by this agency. I was not aware of another judgment attempt. I contacted them in XX/XX/XXXX requesting verification of the debt, but they told me that they had a legal garnishment and were not sure that they would be able to find verification of the debt. This company has continued to call after being sent written cease of communication notice. They have also not responded to my request to validate the debt and provide proof that this debt belongs to me and that they have the authority to collect and that the statue of limitations has not expired. I have had two conversations with representatives of this law office regarding a possible settlement of this debt over the past year or so. Neither went far at the time because we lacked the means to make payments. This law office had someone who identified themselves as a process server deliver 5 documents that appear to be legal summonses related to some old student loans my wife took out going to school. I was left with the distinct impression that the company was taking legal action against us. However, when I contacted superior court in my county, I found that no suit had been filed and no paperwork submitted. Upon examination, the summonses all lacked specific court case numbers, but otherwise appear to be legal documents. They just say " pending '' where the normal court assigned numbers would be.

I have received 2 judgments along with garnishments against my paycheck on both of them. These were both XXXX Bank credit Cards that went into collection XX/XX/2006. The Collection Agency - Patenaude and Felix - put a lien on my bank account and without warning extracted funds ( {$12.00} ) from my checking account. I subsequently called them and spoke to a representative offering to arrange a payment plan. He declined my offer insisting the only way to avoid having funds withdrawn from my bank account in the future would be to pay the entire balance in full immediately. My bank account was levied without notice or legal service. The bank representative gave me the phone number from the levy documents, which led to the XXXX XXXX Sheriff Dept. When I contacted them, they gave me the court case number for a legal action of which I was completely unaware. My bank account was frozen by Patenaude & Felix, two days later I receive paperwork from this company letting me know that they received a judgement back in 2010. They went back to court last month and were able to levy my accounts to collect the money. My problem is I never heard anything about this lawsuit until now. I moved 7 years ago, this company filed the lawsuit in my old city after I moved. I know they knew where I lived because they were calling me at my new address and sending out letters. After the garnishment was complete and the judgement balance paid, I received another letter stating that the judgement balance for the same case number was now {$1700.00}. A settlement was made with this collection agency and a payment plan was agreed upon, payments were made according to schedule based on letters and phone calls made by the agency. Letters and calls stop arriving and the agency takes out a legal order to collect on an inflated balance. When contacting the bank, the bank states that the deal must be worked out with P & F, who then bully and lie stating they made calls and sent letters, none of which were registered mail.

I have been receiving several phone calls from Patenaude and Felix. I get them all day everyday. I have inform that I am not allow personal calls at work. Even after telling them this they still keep on. This is a form of harassment and it needs to stop NOW. There are laws against this kind of thing and I don't see why they can get away with.
