Dear Sir/Madam, I am writing to you in response to your recent communication regarding an alleged debt owed by me. I am exercising my rights under the Fair Debt Collection Practices Act ( FDCPA ) and requesting that you provide me with the following information in order to validate the debt : 1. Verification of the Creditor : Please provide me with the name and address of the original creditor, as well as the account number associated with the alleged debt. 2. Detailed Account Information : Kindly provide a detailed breakdown of the amount claimed, including the original amount, any interest or fees applied, and an itemized list of all charges. This information will help me better understand the basis for the alleged debt. 3. Proof of Agreement : Please provide documentation demonstrating a legally binding agreement between myself and the original creditor, proving that I am responsible for this debt. 4. Chain of Ownership : If the debt has been assigned or sold to your agency, please provide documentation establishing your legal authority to collect on this debt. This includes a chain of ownership that clearly identifies each successive owner of the debt. 5. Cease and Desist Communication : I am requesting that you cease any further communication with me until the requested information is provided. According to the FDCPA, once a debtor has requested validation of a debt, collection activities must cease until the requested information is provided. I want to remind you that failure to comply with this request within the timeframe provided by law may result in violations of the FDCPA and other applicable state and federal laws. In such cases, I may be entitled to pursue legal remedies to protect my rights. Please note that any future communication from your agency should be in writing and directed to the address provided above. Any negative reporting to credit bureaus should be immediately withdrawn until the requested information is provided and verified. I expect your prompt attention to this matter. Your compliance with the FDCPA is appreciated, and I trust that you will handle this request appropriately. This problem began in the year of XX/XX/XXXX when I was not able to make payments on my account with XXXX ( XXXX Credit Card ) because of hardship. XXXX sent account to XXXX, NC XXXX in which XXXX filed a Judgement against me. Went to court and it was determined that I owed {$16000.00}, plus costs in the amount of {$190.00}, total judgement of {$16000.00}. Beginning in XX/XX/XXXX to XX/XX/XXXX I was making payments of {$20.00} to {$25.00} consecutive. I stopped making payments because I was faced with another hardship -- I had XXXX XXXX in XX/XX/XXXX -- had XXXX XX/XX/XXXX. XX/XX/XXXX I had XXXX. The big problem now is that I 'm been harassed by Parnell & Crum, PA, Attorneys at Law, XXXX XXXX XXXX XXXX, XXXX, AL XXXX who says that I owe {$18000.00} and will settle with the amount of {$9100.00}. Since XX/XX/XXXX I have asked Parnell & Crum not to contact me because I will pay XXXX directly and have sent payments directly to XXXX Processing Center. How Parnell & Crum got this account I do n't know. I want Parnell & Crum to stop contacting because the Judgement is in Court and in the Credit Bureaus. I think that Parnell & Crum is trying to get {$9100.00} and then might try to get the other half. If you need any documents -- I will send them to you. Debt is not fully paid

I am filing a complaint against Parnell & Parnell, P.A. for a debt that they are alleging is mine. I have no knowledge of this debt and requesting the following information from Parnell & Parnell, P.A.. As a third-party debt collection agency, you are required by law to send me the original contract agreement proving that this debt is in fact mine. I am also requesting that you send your chain of title and errors and omissions policy number proving that this debt is mine. As a consumer, I know my rights and that it is against the FDCPA to collect on a debt that you can not prove. Because of this, Parnell & Parnell P.A. has willfully and negligently used my non-public personal information without my consent and is therefore deemed as fraud. I am demanding that you prove the documents that have been requested or delete and dispute the following debt. I am giving you 30 days to do this per the law.

After calling several offices regarding the charge-off of a 13 year old loan. XXXX XXXX has handed the collection attempts to XXXX, XXXX, XXXX XXXX XXXX and which they sent to their partner law office Parnell & Parnell. I have never heard or seen a letter from Parnell & Parnell in regards to this time-barred loan. XXXX, XXXX, XXXX XXXX XXXX XXXX hasn't contacted me in years regarding the Loan. I recieved a call from XXXX XXXX official on XX/XX/30 which was threatening and she did not mention that other Law offices had the loan. I contacted XXXX XXXX. on XXXX and they passed it off to Parnell & Parnell in which are the ones to file to sue against me. XXXX stated they were more local. This situation is very manipulative and unethical way to sue a me without prior knowledge. XXXX refused to give any information and I am not able to reach the Parnell group.

Creditor was XXXX. Account was closed around 2021. While Account was on a forbearance during Covid Lock down XXXX reported negatively to credit bureaus, attempted collections while in forbearance before payments were due. Balance reported was much higher than actual balance and could not provide accounting for alleged balance. Almost 3 years after Account was closed I recieved a lawsuite without any notification to question validity of debt and accounting. Lawsuite was dismissed in my favor. Then XXXX began to play games reporting false balance owed, and reporting late payments of 40 months and more, as if Account was open. I filed a dispute. They changed status to charge off, but continue to file every month on this closed and lawfully dismissed Account. I am wanting all late payments reported removed from time of account closure.

On Sunday XX/XX/2023 around XXXX A lady identified herself as attorney XXXX XXXX XXXX GA XXXX # XXXX working for XXXX XXXX XXXX XXXX XXXX went to my parent 's house, knocked on their door. My dad answered the door but he doesn't speak English so my XXXX XXXX XXXX who was there at the time came to the door. The lady handed him a stack of court paper over 60pages and pointed out the information on the first page and explained to him that I owed XXXX XXXX about {$10000.00}. She told him that I need to call her within 30days to resolve. She also asked him to translate that to my Dad who wasn't at the door anymore but my son said it's ok and then she drove off. He was shocked and traumatized by the information so he called me. I have to rush over to the house to get the paper and calm him down.

I received a letter from the law firm of Parnell Parnell, XXXX XXXX XXXX XXXX XXXX, Al XXXX ( XXXX ) XXXX. In this letter, they state that this is in reference to XXXX XXXX, XXXX XXXX XXXX XXXX Case No. XXXX There File No. XXXX. First, they state that they are once again writing to me, but this is the first letter I have EVER gotten from them. Second, they say that I stopped paying on this so-called debt back in XXXX of 2011, now. Now, this debt collector is out of Alabama where the Statue of Limitations for that state is 4 years. I live in the State of Texas where the Statue of Limitations is 6 years.

Opened an XXXX XXXX account so that we could use on vacations so that we would not have to carry cash with us. After coming back from vacation we received a bill saying that it must be paid in full. They would not accept payments and turned it over to a debt collector with which we settled with out of court. They told us that as long as we did not miss a payment then there would not be a judgment. XXXX is still reporting our account delinquent and the judgment has not been resolved.
