XXXX medical collections are posted on my credit report from Focus Financial Services/ Palm Beach Credit Adjustment . The debt is not mine. Account # XXXX reports a balance of {$82.00} & account # XXXX reports a balance of {$200.00}. I have never received any correspondence from them prior to disputing with the credit reporting agency 's. I never received a bill from the original creditors, nor did I ever receive any communication from FFS. My address is listed on my credit report yet they never sent me a " debt validation notice '' prior to or after reporting these accounts to the CRA 's like they are required to by law. They are supposed to provide one within five days of its initial communication with the consumer in connection with the collection of a debt. FFS 's failure to send the Debt Validation Notices to me prevented me from exercising my legal right to request debt validation of the alleged debt at the outset. Since I have never received one they are in violation of Section 809 ( a ) the FDCPA, 15 U.S.C. 1692g ( a ). I disputed these accounts with the CRA 's and it was verified with XXXX & XXXX. On XXXX/XXXX/15 I sent FFS a debt validation letter via certified mail that was delivered on XXXX/XXXX/15. I requested to be provided with proof that this debt belongs to me, as any accounts I might have had are obsolete. They did not provide me with evidence that this debt is mine. Under HIPAA privacy laws FFS should not have any of my personal medical information, unless they have a " written '' agreement with the original creditor to collect debt on their behalf. They did not properly validate the debt nor provide any of the documents I requested. Their response has not proven that this debt belongs to me, and FFS did n't provide any documents such as an agreement with their " client '' that grants them the authority to collect on this alleged debt, or proof of acquisition by purchase or assignment, and authorization under subtitle D of the ARRA, SEC. 13401. They also did n't provide an agreement that bears the signature of the alleged debtor wherein he or she agreed to pay the creditor and as this is a medical account a copy of any HIPAA authorization. On XXXX/XXXX/15 I mailed another debt validation letter via certified mail that was delivered on XXXX/XXXX/15. In response they sent me an ID theft affidavit. FFS still did not validate nor send the requested documents. Per FDCPA, they must ( a ) provide the requested information before continuing collection activity, or ( b ) stop all collection activity. However, FFS continues to illegally verify this information whenever I dispute it with the CRA 's without validating it with me. On XXXX/XXXX/2015 I sent via certified mail a direct dispute, It was delivered on XXXX/XXXX/15. It has been 45 days since they received it and I have not received a response. FCRA Section 623 ( a ) ( 8 ) and the Furnisher Rule require that Furnishers, like FFS, respond to Direct Disputes within 30 days of receiving notice of the dispute. 15 U.S.C. 1681s-2 ( a ) ( 8 ) ( E ) ( i ) - ( iv ) and 1681i ( a ) ( 1 ) ( A ) ; 12 C.F.R. 1022-43 ( e ) ( 1 ) - ( 4 ) Section 623 ( a ) ( 8 ) ( E ) of the FCRA makes it unlawful for such a furnisher like FFS not to conduct a reasonable investigation of a Consumer dispute received directly from the Consumer, in the circumstances specified by Regulation V. 15 U.S.C. 1681s-2 ( a ) ( 8 ) ( E ) ; 12 C.F.R. 1022-43. Also, FFS/Palm Beach Credit Adjustment did not acknowledge on their correspondence with me that they are no longer able to sue me on a debt this old and I believe according to the Section 5 ( a ) of the FTC Act 15 U.S.C. Section 45 ( a ) they are obligated to do that. They are reporting incorrect information on my credit reports, and now I have to worry about them suing me on a time barred debt. These are really unfair and deceptive acts. Attached are copies of the documents I have mailed to FFS & proof of delivery confirmation.

My name is XXXX XXXX XXXX am writing this complaint against FOCUS FINANCIAL SERVICES : ACCOUNT : XXXX, the original creditor was XXXX XXXX XXXX XXXX XXXX The collection company of Focus Financial Services have violated my HIPPA rights and as consumer I am afforded protection. There in non-compliance of FCRA SEC 605 ( c ) and the FDCPA SEC 809 ( b ) major violations. I wrote a certified letter on XX/XX/XXXX and the received the letter on XX/XX/XXXX but no response. They still have this negative item showing on my credit report. I have reported them to the Attorney General 's Office here in the state of Florida. Who told me they have receive many complaints against this collection company harassing and threating residents of Florida. So, they told me as resident to file this complaint if they do not delete this item of my credit report in the next 15 days to call back to there office. For months this company has been reporting inaccurate, unverifiable erroneous things on my credit report and ruining my credit score and I am sick of it. This company has ruined my credit score so bad I got denied a loan for my house!! Now I can not provide for my family because of these derogatory marks. These medical bills and other derogatory collection accounts listed on my credit report, are incorrect and NOT mine. Simply verifying that someone used my name, social security number and/or address is insufficient to confirm that I am the person in question and owe this debt. The court has ruled that in Hinkle v. Midland Credit Management , Inc., that during a dispute and subsequent investigation with the original creditor, collector or a credit bureau, that the original creditor or collector, must provide account-level documentation that would hold up when presented to a jury. That means an original contract or similar proof. To this end, I am demanding an itemized bill to include but not limited to : The diagnosis and procedure performed that I am being billed for, Dates of said procedure, Cost of any medication you may have provided, Cost of any medical devices you may have provided, Office Visits, Consultations, Hospital Visits, Misc. As I am not the person who owes this bill, I am aware that providing the information requested may lead to third party disclosure : a HIPAA violation. That would be your problem and not mines, as a consumer. And per the FCRA and FCPA, I am not required to complete a police report since the burden to prove the debt is on you. In addition, a provision of the FACTA regulations is the Notice of Negative Information provision, covered in section 623 ( A ) ( 7 ). I have never received notification that this had been or was going to be listed with a credit reporting agency. FACTA ( Fair and Accurate Credit Transactions Act ) requires creditors, including doctors and hospitals, to give the consumer a warning notice, so the matter can be addressed before a negative item such as this is reported in error. Then I check my bank account a few days later and I see Focus Financial Services took out another payment in the same amount taken out on XX/XX/XXXX. My wife called and spoke with a representive named XXXX he threatened her about her accounts and said nothing can be done even though she called regarding a payment made on my account. So she told him we will just stop the payments and report them for trying to collect a debt that was already paid for in full. He then told me that his supervisor would get back to me or her but he didn't. She called again and spoke with XXXX, he stated that since its an overpayment their supervisor XXXX XXXX would just have to okay it and the money should be refunded. She thanked him and then I had to call to confirm that they were the ones that made the mistake. I got in touch with the supervisor XXXX XXXX who lied to me and told me that he sees a payment made on XX/XX/XXXX. I proved he lied because our chase bank statement showed they took it out on XX/XX/XXXX. The story they were giving us was not adding up. I called back to get clarification from his statement and he still repeated the same thing and then tried to say that we must have made a payment days later. I told him that we have proof that we confirmed the first payment on XX/XX/XXXX because we have a confirmation number however when I asked about the confirmation number for the " supposed '' second payment he couldn't provide it to me. He said he does not have access to the Online system yet his phone number is listed as the primary number to call if anyone has any problems and concerns. He refused to work with us and threaten us. We called our bank to put a stop payment since he said there is nothing he can do. Worse customer service. I answered that having a website and information on XXXX does not allow him to do business in Florida without active registration with the Department of the State of Florida or license to collect the debt. From my first question about his inquiry 's legitimacy, he yelled at me excessively and was overly aggressive, which I believe is a coercive tactic. A collection agency named " Focus Financial Service '' also known as or or reporting under the name of " Palm Beach Credit Adjustment '' ( which they use BOTH names to report the same account with different agencies ) had reported to the XXXX credit bureaus an account that I had with " XXXX Hospital, XXXX XXXX '' since XXXX XXXX, XXXX. I found out through my credit report that there is a collection from XXXX XXXX XXXX for a medical collection from XXXX hospital. This bill was for my son who is XXXX years old and is XXXX. I contacted the collection agency because I had started a payment arrangement with the hospital itself immediately after receiving the 1st bill. The hospital stopped ticking the funds from my bank account for no reason. I call the collection agency in explain this I even offered to borrow funds from a family member to settle the account but I only hide half of the balance at my disposal. They refused to do any settlement on the account and they said they would continue to report the account of the collection to my credit report. They also said that even if I started on a repayment plan as I originally had with the hospital it would still report me negatively to my credit report. Having a special needs child on the XXXX XXXX it's very difficult especially because insurance doesn't cover the majority of any emergency expenses such as his. We were a charge over {$13000.00} just for a one and a 1/2 day stay at the hospital and the insurance covered a portion of it and we were responsible to still pay {$3600.00}. On a letter dated XX/XX/XXXX I was contacted by Focus Financial Services for a bogus medical debt by a doctor that I had seen and paid in full at the time of service. On XX/XX/XXXX, I responded to Focus Financial Services by divulging that the debt was bogus and erroneous and asked them proof of its validity. I sent Focus Financial Services my letter via fax and certified which I received confirmation receipts from Focus Financial Services on. This company continues to report a copay as past due. They know that my insurance was 100 percent responsible and that I was too late to file a complaint against my insurance. I had met my deductible 100 % XXXX should have paid this debt at 100 percent and this company was advised of the situation. In reviewing a 3 in 1 credit report in early XX/XX/XXXX, I noticed that there were two collection items being reported by all three credit bureaus. This debt is false. Firstly, I do not live in the US. While in America, I had to go to the ER to have something checked out, I have FULL insurance coverage for everything. I provided ALL of my insurance details to everyone I had contact with at the hospital, and afterwards when contacted. I have written to Focus Financial ( on two occasions ), a collection company, asking them to properly validate the debt as required by the Fair Debt Collection Practices Act. All they can send is a single page billing statement. That is not proof, they must produce a document with my signature showing that I am financially responsible for this alleged debt.
