Urgent and formal complaint against Pacific Western Bank 1 ) I am writing to file an urgent and formal complaint against Pacific Western Bank for a series of unfair, deceptive, and abusive practices, as well as dishonest, exploitative business practices, fraud, and misleading actions. These actions have left me and my family in a dire situation where I face the imminent threat of homelessness unless swift action is taken to prevent my eviction ( 16 days ) from a property that is free and clear of any loan obligations. 2 ) In XXXX, when we secured a 3-year mini-permanent loan for our unfinished house. The bank approved our loan and was aware of our financial disclosure. We were promised a 30-year loan once the house was completed, and the initial term ended. The bank that made the loan with us was closed down by the FDIC before we could obtain a 30-year loan. 3 ) Then we called the new bank about our loan extension as we had only 1 year left in our 3-year term. The new bank offered us a loan modification saying that they could reduce interest rate and even reduce the principal in the loan. We were filled with excitement and hope regarding the loan modification. 4 ) However, the bank required us in order to qualify for the loan modification we needed to miss three ( 3 ) mortgage monthly payments. 5 ) Up to that point, we have never missed any payments. Three ( 3 ) months later the bank sent us a letter indicating they were ready to process the loan modification. 6 ) Then 11 days later we received a letter denying our loan modification saying we didnt qualify anymore because of lack of income. 7 ) We met with the bankers at their office and went the extra mile by offering additional guarantees for the loan. We pledged our rental house, commercial land, and even my mom 's house as collateral, ( both houses were free and clear ), with a combined value exceeding XXXX ( 1 ) XXXX XXXX as the loan balance was {>= $1,000,000} but the bank rejected our offer. 8 ) We tried to refinance with other lenders because we had good credit, and we had enough income to make payments. However, the bank had already reported us as delinquent as we followed their instructions to miss and skip three ( 3 ) payments to qualify for the loan modification. That was at that point in time when we figured out the bank scam and con scheme. Indeed, the bank set us up in this situation where we were no longer able to obtain any loan from any third-party bank. 9 ) Despite the bank shenanigans, we found some private investors, ( hard money lender ) who were willing to lend us money to pay off the bank loan and terminate our relationship with the predatory, discriminatory, and deceptive practices of this bank. 10 ) However, whenever we offered to pay off the loan, the bank refused and countered that we needed to pay them more money and raised the loan amount each time. Eventually they asked us to pay an outrageous additional {$700000.00} more than the actual loan amount to almost XXXX XXXX XXXX. 11 ) We knew what they were doing was illegal, but we agreed to pay them what they wanted because we wanted them out of our lives and home, but the bank refused saying that our offer was not " workable ''. 12 ) At this point we understood the bank goal was to take our home and kick us out of the house because they knew they could make money from our loan guarantor and could also take our assets including the free and clear rental house property and the commercial land which we had at one point pledged as collateral to secure this loan. 13 ) Indeed, after foreclosing our housXXXX XXXX XXXX ) and evicting us ( XXXX ) from the house, the bank sued our loan guarantor and got XXXX XXXX XXXX dollars in relation to our loan which they had foreclosed. They filed for a Unlawful Detainer ( eviction ) claim in court and illegally claimed attorney fees as their damages ( XXXXXXXX XXXX. 14 ) In California the foreclosure law clearly says that a bank can not pursue a homeowner once the bank chose to foreclose and take the house back. The bank chose to file a non-judicial foreclosure. Once foreclosure is completed the deed of trust is terminated. But the bank, suing us in the Unlawful Detainer court ( eviction court ) manipulated the legal system and lied to the courts claiming damages for attorneys fee based on a terminated deed of trust for a property purchased at a trustees sale. Despite having no contract with purchaser ( bank ) and despite the legal statute did not provide for attorneys fee awards, The bank managed to obtain judgments awards in the amount of {$210000.00} ( on false and illegal claims ) for a 2-hour trial ( that's in addition to the {$500000.00} the loan guarantor paid them ). This was completely illegal. 15 ) Then the bank proceeded to file judgments liens on our rental property. 16 ) In XXXX, we transferred our rental house ownership to an LLC, free from any outstanding debts. Shockingly, 4 years later Pacific Western Bank falsely accused us of fraudulent property transfers, aiming to unjustly seize our LLC-owned property. Their false claims, made under oath, constitute a criminal act of intentional deceit to rob us of our home. This intentional deception demands a criminal investigation. We firmly believe the bank 's motives have been nefarious from the start. 17 ) In XXXX we received a letter, a notice of debtor examination, saying we owed the bank {$480000.00}. 18 ) We met an attorney in XX/XX/XXXXXXXX XXXX who told us the debt might go away or in the worst case it won't be more than {$300000.00} if we file bankruptcy. Most people think, as we did, when you file bk it is to manage your debt down or even wipe out the debt to get a fresh start. That is why we trusted our attorneys advice. 19 ) Unfortunately, in the bankruptcy proceedings, the bank and our attorney together delayed and delayed the bk proceedings and raised the debt from {$480000.00} to {$970000.00}. Our own attorney manipulated us through the court system. When we hired him, he said his fee was {$24000.00}. Although we paid him {$120000.00} which was unexpected, he demanded {$50000.00} dollars more when we discovered that the bank would pay him {$100000.00} once after the bank seized our house, we couldnt pay him. So, he left our case and quit. We don't know how the bank is able to increase whatever amount they demand ; the court just goes along with whatever the bank demands without any questions. 20 ) We filed initially for XXXX XXXX bk. When we figured out our attorney couldn't ' wipe out the debt. During our consultation for the problem, he confidently stated, " I know the judge very well, he might dismiss the case. '' However, we suspect that he didn't even attempt to pursue this avenue, as it seemed he was solely interested in extracting money from us. Although we don't owe this bank anything the illegal bank attorney 's fees claim and judgments, we were willing to pay them {$300000.00} to make them go away. But the bank refused. Then we offered {$400000.00} and the bank refused. Finally, we offered {$550000.00} and the bank refused. Eventually the bank tremendous amount of power and resources to influence the court system demanded to the court to convert our XXXX XXXX XXXX XXXX XXXX XXXX bk and succeeded with the conversion from a XXXX XXXX to a XXXX XXXX. 21 ) The XXXX XXXX trustee colluded with the bank and the trustee, and the bank agreed to guarantee {$170000.00} to the trustee to sell our current home which is free and clear of any loan. The trustee knew it is very difficult to sell our home being homeowner occupied where XXXX XXXX homeless people live too. 22 ) The trustee manipulated us and got an order to use the Marshall service to evict us. The trustee knows the bank scam and he know of their illegitimate bogus attorney fees claim and extortion scheme, but he doesn't care because his only goal is to kick us out of our home, force us into homelessness, sell our home regardless how many people become homeless. 23 ) How can we lose two houses after one house being wrongfully being foreclosed in XXXX, and now another house, our current home, in XXXX being seized and sold for bank attorney 's fees? 24 ) We are just 16 days away from being evicted by that same bank, Pacific Western Bank. It is disheartening to witness that when targeted by a bank, escape seems impossible. The bank wields significant power with its financial resources, and it appears that even our own attorney, who we paid, was working more in the bank 's interest than ours. We feel betrayed and violated because we realize that existing laws seem to favor the wealthy ( bank ) rather than the less fortunate ( us ). The legal system ( the courts ) allows itself to be manipulated and deceived by predators like Pacific Western Bank, ensuring that the powerful prevails. We urgently implore the Consumer Financial Protection Bureau to swiftly investigate Pacific Western Bank 's actions.

Check Fraud Statement XX/XX/2018 Pg. 1 I am XXXX years old and my property management company of 40 years was recently the victim of check fraud resulting in {$39000.00} being stolen from a trust account containing my clients funds. My bank of 37 years, Pacific Western Bank ( previously XXXX XXXX XXXX and XXXX XXXX XXXX ) erroneously honored the fraudulent checks, which were deposited into the account of XXXX XXXX, an individual unknown to me, at a XXXX XXXX Bank branch in XXXX, CA. Despite many clear forgery indications, Pacific Western Bank electronically paid 31 fraudulent checks dated between XX/XX/2018 and XX/XX/2018 and ranging from {$400.00} to {$3200.00}. Pacific Western Bank should have readily identified the fraudulent checks based on many obvious aberrations, including the following examples ( a listing with relevant comments and photocopies of the fraudulent checks are attached ) : Unauthorized and varying signers and signatures Incorrect property management company name. Altered check numbers. Unsigned check. Undated check. A check signed on the memo line. Two unendorsed checks ( i.e., XXXX and XXXX ) ( note that all subsequent fraudulent checks would have been prevented if the first ( XXXX ) had been stopped by Pacific Western Bank ). The first twenty-eight of 31 fraudulent checks have the wrong bank name ( i.e., XXXX XXXX XXXX which is the previous bank name before being acquired by Pacific Western ). Two fraudulent checks are numbered XXXX and were paid within two months of each other. Multiple check numbers and dates are out of sequence. Unusual check values and frequencies for the 30-year account duration. Inconsistent security feature statements on the fronts and backs of checks. Inconsistent typeface, font, word placement, and check number placements. During the past 3 months, I have contacted Pacific Western Bank on multiple occasions about recovering the stolen funds. Rather than assisting me with reasonable resolution attempts, Pacific Western Bank is obfuscating their standards-of-care accountability by citing a previously uncommunicated XX/XX/2018 Deposit Account Agreement and Disclosure ( Account Agreement ) and California law. To seek assistance with remedying this situation, I am filing this statement describing the thefts sequence-of-events and Pacific Western Banks unwillingness to acknowledge and resolve their errors. Sequence-of-Events - I moved the business office in XX/XX/2018 from XXXX, CA to XXXX, CA and at that time requested that Pacific Western Bank forward bank statements to the new mailing address. However, access to banking records was not received until XX/XX/2018, despite multiple additional attempts to coordinate statement forwarding with Pacific Western Bank. Complicating matters, I was traveling extensively during this period and my bookkeeper was coping with her fathers XXXX diagnosis and treatments. Because of the delayed statements, we did not detect the fraudulent checks until XX/XX/2018. That same day, I reported the fraudulent checks to XXXX XXXX at the XXXX branch of Pacific Western Bank. Ms. XXXX assured that she would promptly review the situation and notify me of her findings. Because Pacific Western Bank had not yet contacted me, my bookkeeper visited Ms. XXXX again on XX/XX/2018, but no update was provided other than stating Pacific Western Bank would not file a police report for the thefts. Check Fraud Statement XX/XX/2018 Pg. 2 Therefore, my bookkeeper next visited the XXXX County Sheriffs office in XXXX, CA on XX/XX/2018 and reported the theft to Officer XXXX XXXX ( ID # XXXX ), who opened Case No. XXXX ( see attached police report ). The case was then forwarded to Detective XXXX XXXX at the XXXX Police Department ( Case No. XXXX ). The criminal case is still under investigation. In addition to the 31 fraudulent checks resulting in the {$39000.00} stolen funds, Pacific Western Bank carelessly paid 4 more fraudulent checks in XX/XX/2018 to XXXX XXXX totaling {$9500.00}, despite already being notified of the active fraud case. Pacific Western Bank reimbursed the 4 fraudulent checks per the attached account adjustment statements, but additionally made accounting errors on the XX/XX/2018 and XX/XX/2018 statements by reporting the same check number and dollar amount. Rather than contacting me to address the remaining 31 unresolved fraudulent checks, Pacific Western Bank issued a XX/XX/2018 letter stating that the {$39000.00} stolen funds would not be refunded based on an XX/XX/2018 Account Agreement, which contains a 21-day reporting stipulation for unauthorized transactions ( see attached letter ). Allegedly issued in the midst of paying the obviously fraudulent checks, Pacific Western Bank never notified me of the Account Agreement prior to the XX/XX/2018 letter. Irrespective, the Account Agreement should not apply to 27 of the 31 thefts perpetrated prior to the XX/XX/2018 effective date. Further, the thefts were reported within 21-days of the Account Agreements effective date. Pacific Western Bank appears to be using the questionably timed Account Agreement in an attempt to confuse and obscure their accountability for first failing to recognize and then paying the fraudulent checks. Conclusion - I trusted Pacific Western Bank to protect my account per understood standards-of-care, particularly from such blatantly fraudulent checks. However, Pacific Western Bank failed my trust in the following ways which has inflicted significant financial hardship : Did not diligently forward bank statements despite multiple requests. Did not contact me to confirm a clearly unusual check issuing pattern. Failed to identify and then paid 31 obviously fraudulent checks. Paid 4 more fraudulent checks even after notification funds were later reimbursed. Did not report the thefts to police. Refuses to accept any accountability or discuss remedies. In a final effort to come to a resolution with Pacific Western Bank, we ( the signers on the account ) sat down in a meeting with XXXX XXXX, XXXX branch manager, on XX/XX/2018. We requested that they reconsider reimbursement of the stolen funds based on the multiple, glaring aberrations. We asked the purpose of check security features and signature cards if they were not used to prevent forgeries. We were told that they are only useful in the hands of an actual person and that all checks are passed through an electronic system that reads only routing and account numbers. We were informed that they are trying to dissuade customers from using paper checks, and to transition to electronic funds transfers, and that the system they use is limited to the verification of routing and account numbers. We were not aware that there were any changes or limitations to our banks security measures. We are led to believe that our money is safe with the bank, when in fact they are loosening their security measures considerably without any accountability and leaving us open to loss. Since the losses were due entirely to the failure of the bank to recognize blatant signs of fraud and either refuse payment on checks, which on their face were more than suspicious, or contact me to inquire about them, I believe the bank should reimburse the full amount of {$39000.00} stolen from the account

But XXXX XXXX come up with some other excuses that as elections are announced so let the new Board take some action not the existing Board. Elections were going to happen for next 5 weeks so that's a bad excuse. After the elections, I wrote to XXXX XXXX about what is happening now - has our funds moved out of Pacific Western or not? No response even after 2 weeks. We want our HOA funds to be covered by PacWest under XXXX. Pacwest is a member of XXXX ( XXXX XXXX XXXX ) for sure and any XXXX member bank has to show tranche in statements. hope this helps. there is no secrecy, as pacwest must be charging monthly fee to hoa account for this service. Also we would need only our operating account to be with PacWest for them to seamlessly and {$250.00} XXXX is abundant and the operation account can be supplemented incrementally. We should be able to see the detail placements of funds in the monthly statement. XXXX ( XXXX XXXX ) must have signed DPA ( deposit participant agreement ) for our account to be on XXXX, we need that DPA. XXXX XXXX giving us anything in writing holds no substance to mitigate default risk on our account. As a resident of XXXX- I want full transparency by Pacific Western to provide detailed accounts of our more than $ XXXX into these 4 accounts to each and every residents. Moreover only $ XXXX is FDIC insured, would like funds are safe guarded so that in case of Pacific Western 's failure- we may not be able to access our funds for around 60-90 days. Pacific Western Bank is in full breech of a Federal Law named 12 CFR 1005.6 Liability of consumer for unauthorized transfers. This is also known as Regulation E. I informed XXXX XXXX, manager of the bank 's XXXX branch at XXXX XXXX XXXX, 2016. 12 CFR 1005.6 : Liability of consumer for unauthorized transfers. 12 CFR 1005.6 ( B ). Limitations on amount of liability. A consumer 's liability for an unauthorized electronic fund transfer or a series of related unauthorized transfers shall be determined as follows : 12 CFR 1005.6 ( B ) ( 3 ). A consumer must report an unauthorized electronic fund transfer that appears on a periodic statement within 60 days of the financial institution 's transmittal of the statement to avoid liability for subsequent transfers. If the consumer fails to do so, the consumer 's liability shall not exceed the amount of the unauthorized transfers that occur after the close of the 60 days and before notice to the institution, and that the institution establishes would not have occurred had the consumer notified the institution within the 60-day period. Official Interpretation to 6 ( b ) ( 3 ) : Transfers not involving access device. ( Actual Debt Card ) The first XXXX tiers of liability do not apply to unauthorized transfers from a consumer 's account made without an access device. If, however, the consumer fails to report such unauthorized transfers within XXXX calendar days of the financial institution 's transmittal of the periodic statement ( Pacific Western Bank statement mailed XXXX XXXX, 2016 = XXXX XXXX, 2016. I reported it to Pacific Western Bank on XXXX XXXX, 2016 ), the consumer may be liable for any transfers occurring after the close of the 60 days and before notice is given to the institution. The unauthorized transactions did not use a loss or theft of a device ( debt card ) -- or a pin number assigned to the debt card number as defined in 12 CFR 1005.6. The transactions were over the internet to XXXX and used my debt card NUMBER only. Thus after the close of 2 business days my liability will not be {$500.00} as when the device ( debt card ) is lost or taken by physical theft per 12 CFR 1005.6. Pacific Western Bank by law must have provided by XXXX XXXX, 2016 a full provisional credit for the unauthorized charges I detailed to the bank from XXXX XXXX, 2016. Pacific Western Bank still refuses to do so and refuses to communicate with me. As I reported the unauthorized transfers on Thursday XXXX XXXX, 2016, the bank is liable for all unauthorized tranfers I reported from XXXX XXXX, 2016. ( 60 days ) per 12 CFR 1005.6 The bank has 10 days to provide a provisional credit for the unauthorized transactions from XXXX/XXXX/2016. That day was XXXX XXXX, 2016. I received a provisional credit for just {$560.00} on XXXX/XXXX/16 when the amount from XXXX/XXXX/16 is {$1700.00}. Thus, since the bank owes me an additional {$1200.00} since XXXX XXXX, 2016 to comply with Federal Law 12 CFR 1005.6 Bottom Line : Pacific Western Bank is : ( A ) Breeching Federal Law 12 CFR 1005.6 as shown above ( B ) Owes me {$1200.00} ( C ) Refuses to comply with Federal Law even after I informed the bank of the exact breech and the Federal Law supporting my position

I have been with Pacific Western Bank, or the banks it acquired, for 24 years. I have both my personal and business accounts in the XXXX XXXX branch in XXXX XXXX. My company also uses the XXXX branch for our deposits from our XXXX office. With few exceptions the relationship with PWB has been symbiotic and professional until recently. As it stands now, a PWB manager is engaging in practices that are putting my business at risk and causing vendors and employees to go unpaid. Roughly a month and a half ago, XXXX XXXX, manager of the XXXX XXXX XXXX, began placing holds on our deposits. In some instances she would place a hold on only one of several checks deposited. In other instances she would place a hold on all checks deposited. The holds would be placed without her having reviewed the checks in person and without any personal knowledge of who the check issuers were or the amounts of specific checks. In two instances, at least, she placed 7-10 day holds on cashier 's checks from known depositors with whom we bank with weekly. As far as I can recollect, this year there has only been one instance where a check was returned to PWB from one of our client 's issuing banks for NSF. There was also only one instance of a check being returned due to a stop payment being issued. Those two instances were apparently the trigger for the scrutiny that XXXX XXXX is now indiscriminately wielding on all deposits. When I have inquired as to why she is doing this, her responses, the few times she answers my calls or emails, can be summarized as she must protect the interest of the bank and it's employees. How can that be done when she is single-handedly putting one of it's longest standing business clients out of business? As it stands today, she has over $ XXXX of my deposits on hold. As a result none of my employees were paid last week and remain unpaid, our primary vendor also remains unpaid, and I am spending more time and energy responding to her decisions to hold our money than I do responding to the needs of my employees during this difficult time. It is unconscionable that a company that is continually making deposits and capable of paying it's employees, albeit difficult, is unable to do so because it's bank manager has chosen to hold all it's deposits while the federal government is giving away billions to avoid this very issue. I am requesting all holds be removed from my deposits and that my accounts be transferred to a different branch with a different manager,

I opened an account with a bank ( XXXX XXXX ) in XXXX XXXX, CA in XXXX. Since it has become two different banks, and is now Pacific Western Bank. I keep this account as a " rainy day fund '' to cover expenses in the event of an emergency. Due to the age of the account, I have never had access to online banking, and since I do not live in the area to go into the branch, can not set this up. It is not possible to set up remotely, and I now live out of California. I only have my monthly statements and checks. Two years ago I received a statement which indicated that my funds were about {$2500.00} lower than they should have been, and below their " free account '' setting, so that I was now accruing monthly charges. When I called the bank, they said their system had erroneously mistaken my account with one that was one digit away from mine, and withdrawn the funds from mine instead. While it automatically caught it on the part of the check writer, it did not automatically correct on my end. It was a total hassle, and they did not ever refund the fees assessed to my account for the months of a low balance. They told me it happens all the time, and it was my job to monitor my account. In XXXX of XXXX, this happened again. I moved, and while my mail was updated, somehow these statements were not forwarded and I went months without receiving a statement. When I finally got one, I was shocked and called the bank. They said that once again my account had been erroneously charged instead of the one that was one digit off due to a check. When I finally reached a person I was told there were no notes and in fact they do not record individual notes on accounts. I was told this was my fault for not checking my account, that this happens all the time, and that it was not their fault. They now tell me that the other account is closed, and they have to reach this other account holder to retrieve the funds prior to putting back in my account. I have spoken to XXXX and XXXX, branch managers. Every time I speak with them, they remind me of how this was my responsibility and not their error. They remind me how they are " making an exception '' to even work on this account. They are not sure when the missing funds will be returned, and have no other option than to file this complaint. The check was written for {$2500.00}, and I am assessed monthly fees of {$6.00} for my account being under their critical free account determination.

I requested a loan fro Pacific Western Bank for the purpose of getting a loan. XXXX XXXX the underwriter asked me to send her a list of documents. I submitted the documents and didn't hear back from XXXX for over a month. I sent emails for an update and I called a few times to confirm she got everything she needed and to see why she never responded back if she needs anything else for the loan or if we can move forward. However, we are taking care of all complaints and this has nothing to do with the loan since I am being the guarantor. At this point XXXX was defending his co worker and he just kept attacking me. Before the bank opened the account, they investigated the company to make sure it is in a good standing and their will be no issue to open the account. If Pacific bank felt that there is something wrong with the business standing, they wouldn't have opened an account for my business. The loan for our properties is in default and the lender raised the interest rate to 18 % without proper notice in XXXX. The lender Civic Financial Services via rep XXXX XXXX indicated on XX/XX/XXXX that they would entertain a short sale and that the challenge was the amount of the XXXX loan. A owner occupied buyer was buying the property for $ XXXX which was less than the amount owed. The house appraised for XXXX XXXX on XX/XX/XXXX, XXXX XXXX that they are not able to get a short sale approved with the XXXX lender payoff being large. He indicated to our attorney that we would have to reduce the XXXX loan payoff to $ XXXX. After a couple days the XXXX lender agreed to reduce the payoff to $ XXXX. Subsequently on XX/XX/2023 XXXX indicated they would not approve the short sale with no reasons indicated. The XXXX lenders actions have put the buyer in a homeless position and also was a bad faith effort. We believe that the lender is trying to sell these loans to another lender in the middle of the transaction and is not acting in good faith to complete the transaction and mitigate their losses. All parties are ready to close. We have escalated this with Civic Financial services which is owned by Pacific Western Bank to no avail. We request immediate help to encourage the bank and its subsidiary to act in good faith to complete the short sale. Moreover the lender charged the past due interest on XXXX homes on just the XXXX home ( in addition to accelerating the interest rate without proper formal notice )

I am the Trustee of the XXXX XXXX XXXX Revocable Trust. XXXX XXXX is XXXX. She opened her CD in XXXX XXXX XXXX Pacific Western Bank a year ago. I was informed PWB could not transfer the money. I offered to come into the branch but it was now closed and the accounts moved to XXXX. I was advised the check had to be mailed. I did not receive the check. I made several calls and was advised to just wait. After many weeks I was asked to send a deposit slip and voided check so they could walk the check to XXXX XXXX XXXX bank ( XXXX XXXX ) for deposit. I was then contacted by : XXXX XXXX Assistant Vice President Branch Operations Manager Pacific Western Bank XXXX XXXX XXXX XXXX XXXX, CA XXXX Phone XXXX XXXX XXXX XXXX XXXX told me all previous bank associates were not giving me the correct information. They could not reissue the check because it was a cashier 's check. I would now have to complete a stop payment and declaration of loss and indemnity form before they could start the process, then wait 90 DAYS before reissuing. The form was ambiguous. I had my client 's attorney review. There are protections for the bank but not for the client. I do not want to sign this form.

Back in XX/XX/2022, I contact Loan Officer XXXX XXXX at Civic Financial and told him that I wanted to refinance and cash out of XXXX XXXX XXXX XXXX in XXXX Texas. When I spoke to XXXX XXXX in XXXX, he indicated that there was a backlog in the under writing and indicated my special rate of 5.25 % would be honored by Civic Financial. I was informed yesterday that the CEO of Civic Financial is not willing to honor the rate of 5.25 % and has told that all loans stuck in under writing would now be on 6.75 %. This is very unfair to me as a client of Civic Financial, since I have acted in good faith and Civic should have taken steps to manage the backlog of loans in under writing.

Attempted to verbally inform Pacificwesternbank on XX/XX/21 they are not authorized to receive automatic payments from an account I no longer use. Pacificwesternbank, formerly XXXX XXXX is refusing to cancel unauthorized payments from my financial institution. I spoke to one customer service representative and two supervisors who all refused to assist or refer me to their legal department or resolve in accordance with federal law. Moreover, when I tried multiple times to have the appropriate person within their legal department or supervisory role be made aware they are in violation of federal law they told me to have a nice day and disconnected. Pacific Western Bank foreclosed our home in XX/XX/2014 and sold it for more than the loan amount that the money we owed them. We lost our home because they refused to extend the loan so they could take it and make more money. Then the bank said that we owed them {$210000.00} in attorneys fees and other fees for {$90000.00}, that's a total of {$300000.00}. Our attorney said that the bank can ask for interests which makes the amount now {$400000.00}. The bank didn't lose money when they took over our home and sold it.
