I previously submitted claim number XXXX which was closed upon receiving response from Oceanside mortgage XXXX I do not feel the response provided is adequate, and this is a new complaint to provide new updated information. I was contacted by XXXX about my claim and provided with a direct number. This number she did not answer when I called, but when I left a voicemail she would reach out in XXXX hours. During our initial call, I laid out exactly what had happened, how I have been damaged by their negligence, and how I expected this to be resolved in a fair and expeditious manner. XXXX has proven to be another tool Oceanside has deployed in an attempt to manipulate the situation, violate laws and steal from me as a consumer. Mortgage Payoff and Loss Draft Insurance Checks To my knowledge, the summary of the calls and information provided is accurate, albeit missing many of the calls I made. Oceanside confirmed receipt of the money in question to pay off my loan in full XX/XX/XXXX. This is the date the payoff should have been processed for. I do not dispute the fact the company has up to 30 days to provide a complete payoff statement to XXXX XXXX, per applicable law they should have stopped charging fees as of this day since this was when they received all monies for the loan along with my letter of intent to use my funds for such purpose. There is a reference to a call made XX/XX/XXXX. I was advised they would have the payoff processed by XX/XX/XXXX. XX/XX/XXXX would have been 10 business days since their receipt of funds XX/XX/XXXX. XX/XX/XXXX would have put their processing of the funds at 15 days, beyond the expectation previously set by the agents I spoke with. The applicable regulations governing these statements are found 1026.36 ( c ) ( 1 ) ( i ) https : //www.consumerfinance.gov/rules-policy/regulations/1026/36/ # c On XX/XX/XXXX, Oceanside confirms their negligence in stating the work order was not opened timely to process the pay off on the intended date. At this point, Oceanside had been in receipt of my funds for the past 26 calendar days. That is right, 26 calendar days. Per applicable law, Oceanside should have applied the funds and recorded with XXXX XXXX a form stating my loan was paid in full by 30 days, XX/XX/XXXX ( please see A.R.S. 33-707 Acknoledgement of satisfaction ; recording and A.R.S. Liability for failure to acknowledge satisfaction ). In this same paragraph, Oceanside claims to have sent me a check in the amount of {$37000.00}. This is a lie. The check I received, as evidence by the attached deposited check from Oceanside, was received in the amount of {$35000.00}, a difference of {$2000.00}. Normally, I would attribute this to some kind of typo. But this amount is listed multiple times in this paragraph. As a response to a complaint filed with a government agency, I would hope Oceanside would take great caution in ensuring all information provided is accurate and true, especially with regard to numbers they themselves are providing. However, this is just another representation of the service and lies used by Oceanside in an attempt to defraud me of money. As I write this response, XX/XX/XXXX, I have not received a new check, mentioned in the Interest reimbursed paragraph, and can not confirm the amount of the supposed XXXX check or receipt. Interest reimbursed Reading this section gave me goose bumps. I literally laughed out loud because of how asinine Oceansides justification of funds is. The investor of the loan does not allow a payoff to be backdated. I completely understand mortgages as a business transactions, but when a firm is in violation of multiple federal and state laws/regulations, I would hope the investors would want to operate legally. However, this statement is a reflection of how it is more important for Oceanside and their investors to make money than be in compliance with the applicable federal and state law. The next section will detail a conversation I had with XXXX XX/XX/XXXX. During this conversation, and subsequent email, I advised the interest payment they were willing to provide was incorrect as well. They are basing this interest payment between XX/XX/XXXX and XX/XX/XXXX, a period where interest should have stopped accruing because they already received all funds for payoff. Beyond this, I had made my XXXX payment already XX/XX/XXXX. So this interest they were so nicely providing back, was actually a double-bill that should have been refunded anyways. This is not an acceptable resolution to this mess Oceanside has made me endure. Inaccurate payoff statements During our conversation XX/XX/XXXX, I advised XXXX of the discrepancies of the payoff statements. I was going to lunch and not in front of my computer at the moment, which I told XXXX. She advised when I get back to send me an email and include the statements I received. When I returned to work, I proceeded to type out an email titled Payoff Letter discrepancy to XXXX ( the email she requested I send it to ). I expressed concerns of her receiving this email as I was previously provided it in relation to another agent assigned to my case, but she told me not to worry and that all communications would be forwarded to her. I have attached the email showing not only what I typed out, but also the attachments sent to XXXX, also attached. I also want to note, that the conversation I had with XXXX on XX/XX/XXXX was held in front of my coworker XXXX, whom I was attending lunch with, as witness. During the phone conversation XX/XX/XXXX, XXXX and I discussed my frustration with this process. In the next paragraph I will go into detail with regard to the section in Oceansides response labeled Compensation for damages. However, I want to add here that on XX/XX/XXXX, I advised that at the time I submitted the complaint, my acceptable resolution was to receive the interest payment back. However, when we spoke XX/XX/XXXX, my damages incurred are now more than just an interest payment, which I will detail in the next section. Compensation for damages I am including all applicable receipts and documentation I have to support my request for compensation for damages. At this point, I am also updated my request for compensation for applicable damage to reflect my actual damages incurred to date, along with compensatory damages for my time spent and punitive damages as a measure this will not happen to anyone else. 1. I am seeking a refund as outlined in my email sent with regard to the payoff statement in the amount of {$1000.00}. The details are outlined in the attached email, and this is the amount owed that was overcharged with relation to my payoff being processed late. 2. I request the additional amount I had to pay in closing due to your negligence and late processing ( by your own admission ) in the amount of {$2600.00}. 3. My mortgage was originally supposed to close XX/XX/XXXX. Since that did not happen, I had not choice but to remain in my current rental for at least another month. I am requesting this be reimbursed as I was forced into staying due to the negligence and late processing by Oceanside. The amount of the rent sent is {$1500.00}. 4. If the amount I should have received back from escrow was in fact the amount listed in the letter, I am requesting the {$2000.00} be sent to me as well Final thoughts In XX/XX/XXXX I lost my home. In XX/XX/XXXX, just over a year later, I have been put through tremendous mistreatment of Oceanside mortgage. They have violated laws and regulations, and have done so at the hands of numerous people in their organization. This isnt a failure by XXXX individual, this is an absolute collapse of Oceansides system that ultimately resulted in my rights and consumer protections being disregarded. I pray that if there is any good that comes from this situation, it is that I am made whole and this is a learning experience for Oceanside to prevent this from happening to anyone else. Throughout this experience, the agents of Oceanside has not provided adequate servicing of my mortgage. Their negligence and failure to provide answers and resolution have cost me time, money, energy, and ultimately caused undue emotional distress. This was not a case of an agent and I disagreeing on a simple manner, this is Oceanside putting aside the law in an attempt to defraud me. In the assignment of a case agent to resolve this manner, Oceanside has tried to paint the picture brighter by not doing thorough research, having open communication with me ( they only spoke to me twice since assigning a case agent, and XXXX of those times was in response to me calling them ). I have been a victim of Oceanside. Oceanside has stolen money from me, and has not done enough to make it right. They have violated several laws and regulations put in place to HELP PROTECT PEOPLE LIKE ME. I am insulted that Oceanside feels less than {$500.00} is enough to make me whole when I have explained specific damages incurred by them. This process has been drawn out and, to be honest, I am tired. I should not have to fight to have Oceanside follow laws to accept my payment on time. I should not have to call in many times for updates on what they are doing. I should not be told to just keep waiting and be patient because not XXXX person has answers, or the team that does have answers is unavailable by phone even to them. I should not have to wait 28 days to receive money back from escrow when the law states 20. I still do not see anything filed with XXXX XXXX saying my mortgage has been paid in full, albeit I did receive a letter saying this sent to me and me only. I should not be forced to come out of my own pocket to pay more due to the negligence of Oceanside. At this point, I pray this can be resolved once and for all in a way that makes me whole, and is fair. In the following of this document specifically I have included most of the laws and regulations Oceanside is in violation of not following for quick referencing. This is not a comprehensive list, as I only included the more major ones they violated, and not every specific one as this would make this document too large for me to type and review in a timely manner. We Refinanced our home in XXXX of XXXX with Oceanside Mortgage Company. During our Closing, We questioned our closing attorney and our Oceanside Rep about our Taxes ( XXXX County ) and Insurance ( XXXX XXXX and XXXX ) being due in XXXX and XXXX. We have an escrowed mortgage and were assured there would be no problems. Oceanside had all of our Bills in our closing documents, where and what was to be paid by what date. Right after the first of the year I realized our taxes had not been paid. After numerous contact with Oceanside, One of our two parcels taxes were paid. I had to send Oceanside proof that both parcels were on our closing documents before they would research and finally pay the second parcel tax. I then had to contact them again on several more occasions to argue the fact that the interest was their fault and should be paid by them not out of my escrow. That too was finally cleared up by XXXX of XXXX. I was told in XX/XX/XXXX that our Hazard Insurance had been paid. Only to find out in XXXX of XXXX, that Oceanside paid our Insurance 2 months late. The payment was sent back to Oceanside as an overpayment, because our policy had already lapsed. We were not notified of the payment being returned. We were not covered at all from XX/XX/XXXX until XX/XX/XXXX and were unaware. I had to search for other coverage. Due to the lapse in coverage our premium was going to be a lot higher. I was in contact with Oceanside once again numerous times to try to figure out how this was our fault when they had the information on where to send the check and how much to send out of our escrow. I did acquire a more expensive policy through XXXX XXXX. Oceanside reps continuously tried to tell me that they didn't have our insurance company on file. They also stated that XXXX never sent them a bill. It always seemed they were just looking to not take the blame. Our original Insurance premium was {$1100.00}. The XXXX XXXX XXXX is {$1900.00}. Oceanside stated time and again they did nothing wrong and would not be responsible. I paid the difference of the premium of {$680.00} in hopes to keep our mortgage payment the same. My new Insurance Agent specifically sent instructions to Oceanside to only send the {$1100.00} as I had covered the remainder. They sent the entire XXXX and caused a shortage in my escrow. So when XXXX XXXX issued me a refund of the {$680.00} I sent it straight back to my escrow. While I was at XXXX XXXX finalizing the paper work my agent, XXXX, instructed me to call Oceanside Insurance Department to get the XXXX for my policy. I did as instructed. The lady I spoke with gave me instructions on the XXXX and I wrote it down exactly as she gave it to me. We hung up and I gave it to XXXX. Then my phone rings 5 times in a row. So I finally answer, It was Oceanside Insurance Rep. She was calling me back to apologize and told me she had given me the XXXX for XXXX XXXX XXXX as they handle business for them as well. She corrected her mistake. I asked her I wonder if this is what happened with my first Insurance company. She stated probably so that it happens from time to time. With all of that I pulled my original insurance paper work with XXXX XXXX and XXXX. Sure enough the address for them to send the bill to is wrong. I called Oceanside today XX/XX/XXXX and questioned the South Carolina address they denied knowing anything about that address and said my insurance company must have came up with that address on their own. We just received a bill from Oceanside stating that they placed their own forced insurance coverage on our property from XX/XX/XXXX til XX/XX/XXXX for {$130.00} and it was taken out of our escrow. I have been in contact with the XXXX of New Jersey, but I didn't have all of my paperwork in order until now. The XXXX of NJ called me today to let me know my complaint would stay on file with them for 3 years as not settled. As a result of all of this our mortgage payment now will be increased as of XX/XX/XXXX to cover the extra that our escrow was short and the raise in our Insurance Premium. On two different occasions I have called Oceanside Mortgage Company and a Rep from XXXX XXXX XXXX has answered. The last time this happened I questioned the Rep as to why. She told me they share some sort of phone line and it happens occasionally. I had been on hold for 45 minutes when I got her and had to start all over on hold. This company has shown nothing less of poor customer relations, poor customer service and just down right unfair practices.

During the month of XXXX, XXXX, Oceanside Mortgage Company mailed my home insurance payment to the wrong address. Subsequently, my house was it insured from XX/XX/XXXX until XX/XX/XXXX. Mind you, this money was from my escrow account. The error was not realized until Oceanside requested the insurance companies address to make the XXXX payment. Learning I had no insurance coverage, Oceanside ordered their expensive forced insurance, even though the year of no coverage had expired with NO claims being filed. Then, Oceanside ordered more of the same coverage for the next year, ALL being paid from my escrow account. In the mean time, during this moment of error discovery, I contact my insurance " go to '' person. I was told I lost my insurance for non payment and had to go into an expensive " risk pool '' for the next year. The bill went to Oceanside and my escrow account was hit again. In XXXX I was notified by Oceanside my Mortgage payment was increased from $ XXXX. to $ XXXXbecause I did not have enough money in escrow!. Of course, I did not have enough money in escrow ; Oceanside paid for two forced insurance policies in addition to my original insurer. I believe I was paying {$640.00} a month in escrow payments. I contacted Oceanside and recounted the past insurance problem because of their error. When the XXXX payment came due, I only sent the {$1400.00} payment, not the {$1600.00}, until the problem was corrected. For the XXXX payment Oceanside would not accept the {$1400.00}. They would only accept {$1600.00} plus {$140.00} not paid in XXXX. This situation continued until XXXX when the word Foreclosure was mentioned. Accordingly, I contacted XXXX at XXXX XXXX XXXX to settle the problem. I also filed paperwork Oceanside needed to start a Loss Mitigation. An agreement was reached where my monthly payment was set at $ XXXX. and owed money to be placed at the end of the Mortgage term. Every phone call to Oceanside, since, begins with a preamble : I owe so much money in the arrears, and the amount has increased from {$19000.00} to {$22000.00}. Again, XXXX at Oceanside Loss Mitigation informed me, my escrow was low and to.make up for it the new payment was increased to {$1600.00}, but my bill for XX/XX/XXXX is $ XXXX but escrow payment fell to $ XXXX. Previous, escrow was $ XXXX ( $ XXXX ), if my escrow is always short then why am I paying less /mo.???? Originally, I was told I would be part of Loss Mitigation group for a trial period, it is now running about a year and six months. I have done all Oceanside has asked, money payments, three series of notarized forms, which one was lost by Oceanside and duplicated. I do not feel Oceanside is handling my account properly, or they are out to claim my house. My wife and I are in our XXXX 's and on a lined fixed income ANF are afraid we will lose our home through the unprofessionalismalism of Oceanside. Please help. Thank you Loan number : XXXX In my experience calling Oceanside, very seldom can you speak to the same person twice in a row. When returning phone calls I was not able to speak with the original caller. All they do is re read phone notes which seem to change like the weather. I, personally find this company disingenuous, unprofessional, and stupid. The feet and legs go in opposite directions.

I was granted a Covid relief program from XX/XX/XXXX until XX/XX/XXXX with Oceanside mortgage service. During this time, Oceanside has changed service providers. I began getting notices saying my account was past due, and they would pursue legal action if the mortgage is not brought current immediately. I called and was told to disregard the notices and don't worry. Then in XX/XX/XXXX prior to me having to make my 1st mortgage payment in XX/XX/XXXX, I was sent modification paperwork to change the terms of my mortgage and roll over the forbearance months payments into the mortgage creating a new payment increase of over {$100.00}. I was ok even though I was initially told that the payments would be moved to the back of the mortgage and the payments would stay the same initially. So, I submitted the paperwork through XXXX mail in that was sent to me, and expected to make my 1st new payment in XX/XX/XXXX XXXX. Every time I go to the new servicing website, it says I have to call because my account is so far past due from XX/XX/XXXX. When I call, the new servicer states don't worry, we are still waiting on the documents and account information from the old servicer, disregard all past due mail correspondence and it won't go against me. Then this week, I was reported more than 120 days past due to the credit agencies and my credit score has gone down over 40 points. I really keep trying to pay everything on time and communicate with XXXXceanside, and 2 years prior to this, Oceanside gave me a forbearance for 3 months and stated it wouldn't count against me because we were in a bad car accident, then it went on my credit as a negative mark anyway. I filed a XX/XX/XXXX dispute and the CFO of Oceanside supposedly said they would never say it wouldn't go against me and they wouldn't agree to this during that time of my car accident. I gave up because I just wanted to get away from this mortgage company. This time I have the paperwork that states what they agreed to with this Covid relief plan they offered me. I am trying to get away from this company and find a new one and they keep putting negative marks on my credit so I am stuck with them. Can someone please help me, I am a healthcare worker with a XXXX wife and daughter that is fighting for my credit to be accurate and nobody is helping me.

I have attempted to pay off my mortgage since the beginning of XXXX. I have been working with the loss draft/property claims center due to my house being burned down in XXXX of 2021. I sent the remaining insurance checks, endorsed, to property claims on XX/XX/XXXX, which were XX/XX/XXXX, and acknowledged XX/XX/XXXX. The check was processed/deposited XX/XX/XXXX. I submitted a letter of intent to use the funds in the escrow account to pay off the mortgage. At the time the checks were processed, there was just over $ XXXX in the restricted escrow account, and my mortgage balance was approximately $ XXXX. I have continuously called into loss draft and customer service with no answers. I was advised the payoff was scheduled to occur XX/XX/XXXX. That did not happen. XX/XX/XXXX, I was told I actually needed a payoff statement ( which when I previously asked was told I did NOT and my letter of intent was enough to allocate the funds appropriately ). They generated the payoff statement with a payoff date of XX/XX/XXXX, the agents told me XX/XX/XXXX the payoff would be completed. On this day, XX/XX/XXXX, I also submitted a demand letter requesting my mortgage be paid off immediately. They not only did not acknowledge my letter, but that did not happen. XX/XX/XXXX I was told the date had moved to XX/XX/XXXX for no reason in the notes. Yesterday, XX/XX/XXXX, I called in and spoke to various agents again, this time with my realtor as a witness. My realtor and I were advised everything was in that was needed and for sure my loan would be reflected as paid off by midnight XX/XX/XXXX. Today is XX/XX/XXXX and my loan still does not show as paid off. I show I have payments due. The treatment by your company has been deplorable! I already lost my entire home in XXXX of 2021, and now I am being victimized and held hostage by your firm! I keep calling in and speaking with agents, supervisors, different departments, and anyone else who will listen, but my complaints have fallen on deaf ears. My demand letter has not been acknowledged, and the errors by your company have not been corrected. I have tried to be understanding, but at this time I am losing patience. I can not move forward with new housing until this loan is paid off. I am seeking help to resolve this in an expeditious manner.

On XX/XX/XXXX XXXX, FL was hit by Hurricane Irma. My home and yard sustained minor damage, but enough to need money to fix. Oceanside Mortgage sent an email offering Forbearance on my mortgage, a government program designed to help alleviate financial burden to those in need. The language in the email includes : " Q : How will a forbearance plan impact my loan? A : A forbearance plan is a temporary suspension of your monthly mortgage payment. During the forbearance period, payments are not required. In addition, negative credit reporting will be suppressed and late charges will be waived for the duration of the plan. '' Believing this would help I decided to take advantage and use the money to make some needed repairs and I could repay the loan when it was due or do a payment plan that oceanside would later offer. The 3 month term on the suspended payments goes by and I receive a phone call from Oceanside Mortgage asking how I would like to pay. I originally was going to do payments but due to all of the overtime I received from being a XXXX/XXXX during a natural disaster I ended up being able to pay the balance IN FULL before the due date. I was never later and i complied with all terms. A year later, during the first week of XXXX, I received a credit alert that my score had dropped 55+ points. Suspecting fraud, I immediately starting checking my accounts. I pulled an XXXX credit report, only to find this languange " Between XX/XX/XXXX and XX/XX/XXXX the following remark wad removed from this account : AFFECTED BY NATURAL DISASTER. '' I immediately contacted Oceanside Mortgage and was advised that there was nothing they could do. I explained to them it was forbearance and I wasn't truly late but they repeated there's nothing they could do. The next step I took was to file a dispute with XXXX. Nothing was done. Here I am 17 months post-Irma and this issue has affected me once again. I applied for a loan on a home and was informed I was denied due to " 60 days late payment from oceanside mortgage '' I am being held hostage by my incorrect credit report. I wish for my credit report to be reflected accurately with NO LATE PAYMENTS. I adhered to the terms offered for forbearance and should not be punished for utilizing a government program.

Hello I did a forbearance from XX/XX/XXXX XXXX XXXX for Covid-related matters All dates of communication are listed below. Oceanside Mortgage Loan XXXX. XXXX Nearing the end of my forbearance. Oceanside reach out to me because I was then just starting a new job. I advised that I would go into my IRA and bring my mortgage current. The person I spoke with was adamant that no dont do that we will work with you on Loss mitigation and I told them I dont want youll try to take my house, I advised this server Al times and was promised no that is not what we will do. About a month later I received a letter from an attorney stating there was a foreclosure started on my home. I called Oceanside again and advised I ask them specifically because I did not want a foreclosure to lose my home. I asked why several times why would youll tell me no we will not do that and did it anyway costing me an additional XXXX XXXXXXXX in attorneys fees. I feel wronged in so many ways that I tried to avoid unnecessary fees and they went behind my back to file the foreclosure again which I tried to avoid. I had a XXXX in XXXX and I can not complete complicated paperwork and I told that lady that also. I have a delinquent tax account with my township. I emailed the mortgage company initially and got a response that did n't even address my tax situation, they simply replied by telling me of my most recent tax payment ( from escrow ) and told me to email again with further questions. After a few days, I called the servicing department and got someone on the phone. There was nothing she could do, but gave me an email address for the " delinquent tax '' department. I emailed them and got an auto response that said I should receive a reply within 24 hours. That was XXXX XXXX. As of today, XXXX XXXX, I have n't gotten a response. I have been in contact with the person who processed my loan ( loan officer ) and she has been very nice, but still nothing has been done. A few days ago, I emailed servicing department again and got another generic reply but this time it said the status of my issue was " solved '' even though nothing has changed. There is plenty of funds in escrow to pay my delinquent tax. It is nearly {$1900.00} including almost {$40.00} in interest. A portion of this past due amount is from the XXXX of 2016 and will soon go into tax sale, at which point a lien will be put on my property. I have been trying to get this resolved for several weeks now. I have requested to speak with a manager on several occasions to get it straightened out but that does n't seem to be an option. The last thing I was told was that they would get back to me within 4 business days ( that was Wednesday evening ) and I have n't heard from them as of XXXX today XXXX XXXX. All I 'm asking is for my taxes to be paid by my escrow account and paid accurately.

I purchased the subject property as a single person. When I refinanced the subject property with the current loan servicer I was married. Since it was our primary residence when I refinanced the property, the lender required my spouse to sign the security instrument ( Deed of Trust ) as a non-borrowing spouse. As of today I have never signed a Warranty Deed giving him any ownership interest in the subject property nor has he been an on any promissory notes associated with the subject property. Hence, the subject property remains my sole and separate property. Around XXXX of 2019, my husband filed for Bankruptcy. The subject property was not included in his Bankruptcy since he is not on the note or deed. Around XX/XX/2019 went online to make a payment, but this feature was disabled. The online system advised me to call to make a payment. When I called I was directed to the Bankruptcy Division. I advised them that I am not in Bankruptcy and my spouse has not financial or ownership interest in the subject property as he is not a borrower, on title, and purchased prior to our marriage. Since my y mortgage is not subject to my spouses Bankruptcy, the representative escalated the issue. However on XX/XX/2019 they retained an attorney to object to my husbands plan confirmation and falsely stated he was a debtor and on the deed. Despite several escalations, they continue to service my account as if I was in Bankruptcy including incurring legal fees, disabling payment features, and placing payments in a suspense account.

My loan payoff was requested on XX/XX/XXXX, per the customer service rep with Oceanside Mortgage Company -- XXXX XXXX XXXX I spoke with on XX/XX/XXXX there was a 10 day hold placed on the account so no payments would be sent out. Only XX/XX/XXXX an insurance premium payment was sent out for {$470.00}. This does not align with the 10 day " hold '' that my account was placed on. I sold my home, closing date on XX/XX/XXXX and received the profit the same day via check. The customer service rep stated that my account was closed on XX/XX/XXXX. On XX/XX/XXXX another payment was made for {$410.00} to pay my MIP insurance to XXXX XXXX, per the same customer service rep XX/XX/XXXX. I requested a copy of the MIP statement to see proof that payment was in fact necessary and owed and was refused a copy, stating it was electronic and not something they received or could look at to reference. The balance of my escrow account belongs to me and the insurance payment should not have been made as the account was on " hold '' from the payoff request. After requesting the refund of the escrow balance I was also refused a copy of the bill they received in XX/XX/XXXX and were required by law to pay to XXXX XXXX for the MIP. The only thing they would provide me was a copy of the Underwriting paperwork that was created when I bought the home in XX/XX/XXXX

I had switched to this mortgage company a few months prior to the incident. We switched to Oceanside mortgage company after they kept contacting us to let us know we could save money on our mortgage. When XXXX came, we were in a bad car accident and had hospital bills as well as loss of a brand new vehicle. We called Oceanside and asked if we could make a larger payment, then pay the rest the next month or even 2 weeks later. Oceanside said they could do even better and have us make 1 payment in XXXX, then spread out whatever we owed over the next 3 payments. We were happy and said thanks, and we were told that we would be counted as late in oceansides system, but once we made all payments we would be fine. So once XXXX came and we were great financially, I got an alert from XXXX XXXX saying my payment history was late on my mortgage. I called Oceanside and said I can't have this because we were trying to get a pool loan and do some renovations and were never told about this, I was told that it has to be that way and they were going to do nothing. I stated I was never informed my credit would be blemished or I wouldn't have done it, I was told it would not change. I have 4 months of late payments now and can't get my home renovated or pool because of this, nor will Oceanside add a comment of payment arrangement or anything.

In XX/XX/2017 Oceanside changed it's processor. I sent a manual payment using their software for XX/XX/2017 and attempted to set the the ACH transaction for further payments. As far as I could determine, the payment was set up correctly. It appears that it was not for XX/XX/2017. Unfortunately, I was not able to monitor this failure to process a payment since my wife had undergone a second XXXX to XXXX a XXXX XXXX XXXX in the space of three weeks. Additionally, we were still dealing with the aftermath of a XXXX XXXX of a XXXX XXXX earlier in the year, with wound XXXX complications. Also, I had XXXX with XXXX to respond to both Hurricanes Irma and Maria spending over 37 days in the field. With my wife recovering from surgeries and my being gone it was difficult to keep any control over what was going on. I realized that an issue occurred reviewing XX/XX/XXXX banking transactions. I had a conversation with Oceanside and set up a workout program to make things whole. Unfortunately, not trusting the software that Oceanside had set up, I sent manual payments through my bank. It appears that these payments got lost at Oceanside and did not post appropriately. Thus Oceanside is marking these as delinquent even though payments were made. Multiple attempts to contact them have not resulted in any resolution of this.

we internally refinanced with Oceanside Mortgage Company on XX/XX/XXXX. XXXX XXXX told us that the check we wrote for {$770.00} on the closing date would be for our XX/XX/XXXX mortgage payment. On XX/XX/XXXX I received a mitigation email saying that we had missed our XX/XX/XXXX mortgage payment. After calling XXXX back they said that it would be taken care of and they would apply the funds to our mortgage payment. That was not completed. Today I have spoken to XXXX in customer service, XXXX XXXX, and a man by XXXX XXXX. XXXX and XXXX XXXX could not figure out what happened or where our money went. XXXX XXXX told us that our escrow account was short, and that they had take n the check we wrote for {$770.00} to our escrow account and that we 'should have known ' that were going to owe for XX/XX/XXXX, when XXXX XXXX told us that was what we were paying at closing. They have now said that they will " try '' to remove any bad marks from our credit report. and " try '' to remove any late fees. They were not helpful, and basically told me I needed to Pay XX/XX/XXXX, and did not take any repsonsibility for what their loan officer, XXXX XXXX, told us. I feel taken advantage of, like I was liked to just so he could close a deal. I have spent over an hour and 15 minutes on the phone with this company today, and was transferred 3x.

In XXXX of 2020, I refinanced at a 3.25 % interested rate and my mortgage payment was XXXX. Due to COVID, I was unable to pay my mortgage and took out a COVID loan for the month of XXXX through XXXX. I resumed my normal mortgage payment in XXXX. On XX/XX/XXXX, an escrow analysis was done and my mortgage jumped to XXXX due to a shortage in my escrow. Oceanside Mortgage agreed to spread the escrow shortage over 60 months on XX/XX/XXXX and I was told to pay {$2300.00} for XXXX mortgage per their notes and which I paid and in XXXX my mortgage payment would rise to {$2300.00} for the next 60 months which I have already paid. Oceanside continues to harass me about a shortage in payment in the amount of {$270.00} which i do not owe them. They continue to say they will fix the issue but it never happens and because of this, they refuse to take my XXXX payment, which can put me in a delinquent status. I need help now and will file a complaint with the FHA

Our servicer Oceanside Mortgage migrated to a new payment system. I set up the XX/XX/XXXX payment manually due to the migration change. I additionally set up the bank information for automatic debit. For some reason, Oceanside did not process the auto payment information and did not take the XX/XX/XXXX and XX/XX/XXXX payment. When I discovered this in XX/XX/XXXX, I contacted Oceanside and discussed ways to make up the shortcoming. We agreed upon three payments in XXXX XXXX XXXX and XXXX to rectify the balance issue then resume our regular payment. Payments are being made as scheduled. Oceanside is however continually contacting us and sending letters starting account is heading to foreclosure. We contacted them several times, they have acknowledged the payment arrangement but continue the mail email and phone calls. We want the harassment to stop and for them to honor their agreement

Every single year since the mortgage originated ( XX/XX/XXXX ) my escrow has increased by {$200.00} because the mortgage company isnt calculating escrow properly, or is not paying taxes properly. The first year my mortgage increased by ~200 in XX/XX/XXXX, then I got a refund for overpayment in XX/XX/XXXX of about {$900.00}. Then my mortgage jumped back up by about ~200 a few months ago, and once again I am getting a letter reflecting a shortage in escrow. My taxes have increased, but its insignificant compared to the increase in monthly payment. When I asked them, they said they paid the taxes incorrectly. This is a costly mistake for me, as the mortgage keeps increasing by {$200.00}! Is there any action I can take against them, as the unpredictability is not good financially for their customers, and feels unethical.

Hello I have been working with XXXX XXXX to get a COVID forbearance under the CARES ACT. I was advised that " company policy '' dictates they do forbearance in 90 day increments and to call in at a later date to request an additional extension. I received an offer for coid 19 mortgage forbearance agreement dated XX/XX/2021 stating that my plan will begin on XXXX and will terminate on XXXX. I'm outraged that this company is deliberatly trying to offer me a forbearance in direct conflict with the guidelines set forth in the CARES ACT as well as put my request for an extension outside the XX/XX/2021 window. I sent them my hardship letter on XX/XX/2021 specifically requesting 180 days of forbearance. I also had my credit report negatively affected due to company reporting my mortgage as a late payment for XX/XX/2021.

In addition to my complaint I'd # XXXX, which Oceanside mortgage has not answered, I was informed by a loan specialist a XXXX XXXX that Oceanside had told the credit department that my monthly payments are always late. This is not true! Ever since I set up a loss mitigation agreement, all my statements have been on time and generally paid on the due date ( 1st of the month. This bank has made numerous mistakes on my account, but stonewalled me with conflicting information. I am trying to refinance with a different company, but Oceanside is holding me back because they distribute the wrong info. Please help me settle this mess. At the rate Oceanside increases my monthly payment, I will not be able to afford my house any longer.

Received an unsolicited marketing letter from Oceanside Mortgage Company to help me refinance my mortgage. While I am normally am fine with marketing materials, this was a deceptive letter. It came in an unmarked, windowed, envelope, with the words " final notice - Immediate action required '' with a file number. This is an obvious attempt to make it look like it is from a collection agency and a deceptive practice to try and obtain business. As a smart consumer, I am well aware that this is a heavy handed marketing ploy. However, some consumers may not be as observant or aware that this is a deceptive letter. I believe this is targeted at these people.

I have contacted Oceanside Servicing on numerous accounts simply requesting a payoff amount valid through XX/XX/XXXX. I initially attempted this via email ( as outlined in their faq ). Several days went by and we still received nothing. I have called a couple times being assured it will arrive in 3-5 business days. Still nothing. I called today XX/XX/XXXX and was assured it would be emailed to me by end of business day. I have still not received the payoff and they are closed. I have a mortgage with Oceanside Mortgage Company. I have been making my payments all this time for years. suddenly without any notice, I learned that my payments changed. Oceanside stated that they are now paying my taxes and insurance. I was never given a notice or an option or anything. I informed them that I want to pay my own taxes and insurance. The issue is that my XXXX mortgage payment of {$2500.00} was incorrect and does not reflect the agreement to spread escrow over 69 months. This caused my mortgage to be behind by {$260.00}.
