Failed to give the consumer ( me ) a federal law that requires lenders to give a three day letter of estimate ... .I alerted the lender to provide a letter of estimate. The lender failed to do this until the XXXX day after the home sale contract was signed. The home mortgage lender failure to follow federal law prevented me to shop for the best home loan. Once I received the letter of estimate which was sent by email by the lender on the XXXX day after sales contract was signed by both seller and buyer ( me ) I informed by text to my realitor I was going to change lender. After sending this text to my realitor ( XXXX XXXX ) she informed me I should not do that or she would cancel the home sale contract!! Therefore I didn't change lenders. Finally I got a call from the lender indicating the USDA home loan has been approved by USDA underwriter appromately XX/XX/2021 On XX/XX/2021 received a call from XXXX XXXX from XXXX XXXX XXXX company asking me to come to their XXXX Az office to close on the home loan on XX/XX/2021. I informed her I had NOT RECEIVED the three day closing cost document which I understood is required by Federal law to protect the consumer. Ms XXXX did not care about that and demanded for me to appear at XXXX XXXX XXXX XXXX office at XXXX on XX/XX/2021 and before that she would send me a copy of the settlement letter. It was Sunday night XX/XX/2021 I sent a text to my realitor XXXX XXXX alerting her that I HAVE NOT RECEIVED THE THREE DAY CLOSING DOCUMENT FROM THE LENDER AND HAVE NOT RECEIVED THE SETTLEMENT LETTER FROM XXXX XXXX AT XXXX XXXX. I informed my realitor XXXX XXXX I had not either received the three day document from the lender and a settlement letter from the title co. the The next morning the closing of the home was set for XXXX at XXXX XXXX XXXX XXXX in XXXX Arizona XXXX I happened to look at the settlement letter more closely. Further examination of this settlement document showed the numbers were wrong. I immediately called my realitor. She informed me I needed to show up for the closing meeting. Once I sat down at XXXX XXXX I tried to explain to Mrs XXXX I didn't received the three day closing document from the lender and hee settlement letter was wrong. She informed me I was completely wrong. I knew I was correct and I walked out of the office. I immedia tely texted my realitor letting her know this was scam and I will refused to sign anything. Within minutes the lender ( MR XXXX ) called me on my cell and admitted he made mistakes. The lender XXXX XXXX... senior loan officer ... Nova home loans- XXXX Az office NMLS XXXX ADMITTED HIS MISTAKES AND WOULD MAKE IT RIGHT I was able to close on the house on XX/XX/2021 On a personal note county recorder recorded the title of the home at XXXX XXXX on XX/XX/2021. My realitor XXXX XXXX was no where in sight. She informed me in a text officially congratulating me for getting the house and the house keys were left in the electric fuse box!! I managed to head over to the house which was in the evening ... .I had a hard time opening the fuse box and finally I did. I SAW THE KEYS TO THE HOUSE AND place them in my hands... I walked into my home and I cried The reason I am filing this complaint hopefully you will take immediate action ( AT THE VERY LEAST SUSPENDED THIS LOAN OFFICER A PERIOD OF TIME TO LET MR XXXX KNOW HE CAN NOT BE IGNORING FEDERAL LAWS TO PROTECT CONSUMER. So when did I received the three day closing document. I received a dated three day closing document dated XX/XX/XXXX... .the same day I closed on the house

I took a mortgage forbearance with XXXX that ended on XX/XX/XXXX. I made XXXX on time payments for XX/XX/XXXX, XX/XX/XXXX & XX/XX/XXXX. After making XXXX on time monthly payments at the new rate I negotiated with XXXX, instead of receiving new loan modification paperwork, I received a letter the account had been transferred to Nova Home loans in late XX/XX/XXXX and to pay my XXXX mortgage to XXXX. I sent my XXXX mortgage payment to XXXX as an electronic bank transfer which they rejected. When I called XXXX, they informed me I was in collections and could only make payments via phone through their loss mitigation dept. until again, When I called in XX/XX/XXXX to make my payment, I was informed by XXXX that my previous payments were no longer being honored at the same rate and were now being raised and that they were not accepting/refusing to accept the terms ( monthly rate & length ) of the loan modification agreement I had made months before with Loancare which I felt was totally unfair. However, I made XXXX more monthly payments on time for XXXX, XXXX and a new increased rate in XX/XX/XXXX. During this whole time, I continued to receive numerous collections letters threatening me with a foreclosure if I didn't pay all monies due before the forbearance began by close of each month. In XXXX, I called to make my house payment and ask when I would be receiving my new loan paperwork since I had now made XXXX consecutive monthly payments on time, instead of XXXX, and was informed the paperwork was on it's way. XXXX rolls around and no new loan paperwork yet and I'm still in " collections '' with XXXX and still required to make mortgage payments via phone. XXXX paid on time and yet again, paperwork is on its way. This same story continues through XXXX, XXXX and XXXX, despite me now calling every couple of weeks complaining about this egregious delay. XX/XX/XXXX ( Saturday ) Fed XXXX delivers the loan paperwork. XX/XX/XXXX, a federal holiday, shortly after XXXX, a lady rings my doorbell and announces she is a notary public sent to my house by XXXX and shows me loan paperwork she needs to witness me sign and return to XXXX XXXX There was no call beforehand nor appointment set nor notification someone was just going to show up to my house, let alone on a holiday. I sent her away as I was ill prepared to sign a 30 year mortgage contract standing outside my door ( she wasn't allowed in my house ) without a proper review of the documents. XX/XX/XXXX, I check my XXXX credit score and report and discover XXXX has reported to credit agencies ( XXXX etc. ) that I am well past 180 days delinquent on my mortgage payments and my score dropped more than XXXX points. At this point, I have made XXXX consecutive on time or before the start of the month mortgage payments and need immediate resolution to this egregiously false negative credit reporting by XXXX. They took well more than 6 months to get me the necessary loan paperwork to remove me out of loss mitigation status, created repeated hardships in making my payments, refused to honor the agreement I had with the original XXXX holder despite my making XXXX on time payments with them prior to inheriting my XXXX. I feel XXXX has engaged in multiple violations of the true intent, if not the letter of the law, regarding the CARES Act offer of post-forbearance protections for consumers.

When it was time to lock my rate with XXXX XXXX in Colorado, I was told we were going to lock at 3.5 % with 5.0 down payment assistance at XXXX am on XXXX/XXXX/2020. The next morning on XX/XX/XXXX2020 I received the following email from Nova Home Loans : ++++++++++ XXXX, I want to give you a heads-up about an potential problem that popped up this morning I checked the XXXX rates this morning in preparation for locking/reserving the DPA rate & funds, and I was shocked to see that the posted rate for the FHA 5 % DPA option had increased overnight from 4.625 % to 5.125 % ( see below ). This higher rate moves our DTI ratio above 50 %, which is the max permitted for the program. I have an email and a call into the XXXX program administrator to find out if this is correct, and if so, to see if they will honor yesterdays rate of 4.625 % especially given that the new higher rate means we no longer qualify. This makes no sense, as mortgage bond pricing has actually improved over the past 2 days. As a worst-case scenario, we would need to look at changing to the 4 % DPA option at 4.500 % interest rate. If we are forced to change to the 4 % assistance option, we may want to revisit XXXX to see if their rate would be lower, although the XXXX silent 2nd mtg is not forgivable like it is with XXXX. If we changed to XXXX, their homebuyer ed class is different, although now they are offering the online class for free given the situation with coronavirus. I will be in touch as soon as I hear back from XXXX +++++++++++ For some reason the rate lock was not requested on XX/XX/XXXX like I was told, causing me to lose the 5 % DPA assistance at 3.5 % rate. The next day the rate was locked at 4 % DPA assistance with a 4.5 % rate. Causing me to have a much higher payment and put quite a bit more cash down. I am happy with the service I received, my agent was very nice and professional but I have a bad feeling since this happened, that this was on purpose. A couple weeks after closing at this higher rate, XXXX XXXX purchased my loan before I could even make my first payment. I truly feel like I was racially discriminated against. I got the highest possible rate of the year, when the day before and the day 's after were much lower, and even lower at this time. I got a XXXX rate either because Nova either did not submit the paper work on XX/XX/XXXX like they said, or XXXX XXXX held off approving, knowing the next day it would go up. I see a lot of things about XXXX Americans getting much higher rates than others, and this seems like a perfect example. Someone who qualifies, is told they will get a certain rate, only to have the rug unfairly pulled form beneath them. I am not the type to complain but I just made a 30 year commitment, while I feel I was treated unfairly to the rest of the population who is getting historically low rates. I am not sure where my deal went wrong, but I would like to know why this happened to me. Was it intentional? Was it because Nova did not submit on XX/XX/XXXX like they said? Did XXXX hold my offer until the next day to get a higher rate and them putting less cash down? It feels wonderful to get my family in our first home after working so hard, but it feels bad knowing you got a bad deal.

I was in forbearance through the CARES act back in XXXX. I entered a loan modification process with Nova XXXX XXXX / Nova XXXX back in XX/XX/XXXX. Made my XXXX trial payments XX/XX/XXXX, XXXX, XXXX and XX/XX/XXXX. I submitted my notarized loan modification paperwork in XX/XX/XXXX. Monthly payments have been each month since XX/XX/XXXX- XX/XX/XXXX. I received " delinquency '' credit reporting from the 3 main credit bureaus - my credit report stated " XXXX days late '' - This information was inaccurate. I started investigating directly with my mortgage company the reasons this information was reported if it was not accurate. I was never later before or after entering the forbearance program. After several months from XX/XX/XXXX through XX/XX/XXXX attempting to fix this wrongful information reported to my credit. I had to contact XXXX XXXX in XX/XX/XXXX, the investor to for my loan. Fannie Mae contacted Nova Serving regarding this issue. It was until then that Nova Servicing started acting to try and assist. I ended my forbearance with Nova Servicing since back in XX/XX/XXXX ( after completing my 3 trial payments, submitting the final loan modification paperwork, and continue making my monthly payments up until XX/XX/XXXX ). I came to find out recently about 2-weeks ago that Nova Servicing had sent me the incorrect loan modification paperwork back in XXXX XXXX and that was the reason my loan modification process was on hold. I have been back and forth with the Nova Servicing center - because they originally made a mistake and 1st - reported 120+ day delinquency to the credit bureaus- and 2nd about 1 week ago reported my account as being in " forbearance '' - these 2 scenarios are not correct. I was reading about mortgage forbearance - in my situation my mortgage loan should not be reported as " account under forbearance '' since I have been making monthly payments since XX/XX/XXXX - Nova Servicing made mistake in their process, therefore, I do not think is reasonable that this servicing center made a mistake in their end, but yet they are affecting me tremendously by noting comments in my credit report that are not accurate. As of today XX/XX/XXXX - Nova Servicing is noting my credit report as " mortgage loan '' being on " forbearance '' - however, I have made several attempts to get this remove from my credit reporting as it is preventing me from refinancing and obtaining a new loan. Nova Servicing has admitted that they made a mistake by, reporting wrongful credit information and for sending me the incorrect loan modification paperwork. I have made several attempts by email and phone message and have not received an answer as of today. Please help with this situation as it is affecting my quality of life.

I refinanced my home with Nova in XXXX of 2021. The process was seemingly smooth throughout the transaction. We were told the loan closed and funded and it was a done deal. Within a week, title asked for an additional $ XXXX dollars due to an error with final pay off and taxes. We would get this money back in a refund eventually. Two and a half weeks go by and our old loan carrier still shows our old loan as active, and now late on a payment. This was found through my own research, nothing from Nova. Finally, on the XXXX and XXXX of XXXX, XXXX XXXX addresses the issue and gets everyone scrambling to fix it. By now, the old loan had accrued {$500.00} is interest as it was not paid off by NOVA. I was 1 day away from a 30 day late on my mortgage that NOVA was hired to handle. The same loan that was supposedly funded and closed on XX/XX/XXXX. I then had to pay an additional {$500.00} on the last day of the month so the pay off would go through. By this time I had paid over {$1200.00} that was not listed on any closing cost or final closing docs that I signed. I contacted the old loan carrier, XXXX, who provided me with information that the payoff wire that Nova sent was short on funds and immediately rejected. There is email documentation that XXXX sent back to Nova with the urgent matter. This matter and email were never addressed or responded to. I then contacted XXXX XXXX of Nova looking for answers and perhaps some accountability. All I got was everyone blaming everyone else and no one owning up to the mistake. I have tried to resolve this issue with Nova and XXXX since XXXX of 2021 and I am still getting brushed off as of XXXX of 2021.

In XXXX, Nova Financial & Investment, my mortgage holder, applied my ON TIME PAYMENT of {$1000.00} to miscellaneous NEW subaccounts, including 1 called 'unapplied balance '. They then 1- reported me LATE to the credit bureaus and 2- began an escrow account that I never requested nor agreed to. I contacted the company in mid XXXX and was informed that I had a 'late balance due ' of {$270.00}. This was a strange number to me. Later on XX/XX/XXXX, XXXX informed me via tele that MY LOAN PMT INCREASED IN XXXX. I was then informed that only {$950.00} was received. This could not be. As I had just sent my XXXX payment for the same, agreed to at signing, amount of {$1000.00}. This was when I discovered their 'creative " accounting practices. And learned that monies were sent to XXXX XXXX for my property taxes. I had paid these same taxes in late XXXX, and sent Nova PROOF just as they had requested. Its clear to me now they did this to create and collect on UNJUST LATE FEES. and in the process, they wrecked my credit. Banks recently were fined for the exact same fraudulent FEE practices on checking accounts. On XX/XX/XXXX I emailed a complaint directly to XXXX and received a 'verification email ' that it was received and ACTION would be taken. Also, I would be contacted by XXXX XXXX within 2 days. She later said that she would 'submit to credit for a review today ' and immediately get back to me. It is now XX/XX/XXXX, and I have heard nothing. My good credit, and record of ON TIME payments, is now wrecked thanks to Nova. And their creative bookkeeping practices continue. Will you please help?

The buyers of our home applied with Nova Home Loans and were approved for $ XXXX with low down payment. We entered into contract with them on XX/XX/2022, closing on XX/XX/2022. On Saturday, XX/XX/XXXX, we had to sign an extension as Nova had " trouble with their loan and their debt-to-income ratio '', nothing had been mentioned in the days leading up to this, as the loan process was " on schedule '' according to the documents we received from the agent. On XX/XX/XXXX early in the day, we were told the loan was " on hold '' due to the debt-to-income ratio of the borrowers, and they are trying another company which assured approval in a short time. On XX/XX/2022 at XXXX pm we received a letter of withdrawal from Nova Home Loans for the above mentioned debt to income issue that the borrowers had, but was only brought to light that morning. The CD should have been submitted to the parties 48 hours prior to the letter of withdrawal. Rules are rules. I attempted to speak with the Originating Loan officer three times during the process, and he only returned my call, on Friday, XX/XX/XXXX, after they withdrew. This process was abhorrent, as the buyers were ready to move in, their lease had been cancelled and we had moved out of the residence to facilitate their move-in. I believe XXXX XXXX had made egregious errors in giving them the " preapproval letter '' and ultimately denying their loan 60+ days post issuance of the preapproval. I am attaching the chain of emails from XXXX XXXX to the buyers and both agents during the process to show there was NO MENTION OF THIS ISSUE, ever.

Description of Complaint : I want to file an unethical and unprofessional harassment complaint against an employee of Nova Home loans. His name is XXXX XXXX and he is a loan officer. I was treated rudely and XXXX XXXX would speak to me and lecture me as if I was an ignorant person. He would not speak to my husband that way but because I am a woman, and my personal opinion is he was discriminatory towards me. My last conversation with him via text on XX/XX/23. He was rude, pushy mean and nasty and very unprofessional. I have all the texts to prove his unruly behavior. He needs more training in his field of work especially when dealing with women. There is no excuse for His behavior and I believe it should be brought to his attention with reprimand.
