XX/XX/XXXX We refinanced our home with a loan from XXXX, made payments until XX/XX/XXXX when the market crashed. See Exhibit XX/XX/XXXX XXXX sent a Notice of Default and Acceleration letter and said specifically, " If the default is not cured on or before XX/XX/XXXX, the mortgage payments will be accelerated with the full amount remaining accelerated and becoming due and payable in full, and foreclosure proceedings will be initiated at that time. '' Clearly stated, this is not a foreclosure, but foreclosure may happen in the future. See Exhibit 2 XX/XX/XXXX came and went with no additional notices or legal actions as stated in the previous notice. XX/XX/XXXX I file for BK See Exhibit XXXX XX/XX/XXXX I waived my right to a discharge for all debt, letter mailed to creditors XX/XX/XXXX. Statue of Limitations begins to run again XXXX days after the mailed letter, XX/XX/XXXX XXXX Exhibit XXXX. XX/XX/XXXX XXXX sends another XXXX stating " XXXX. intends to initiate foreclosure action on the mortgaged property. '' This another threat of a lawsuit that never came, but never the less another " Notice '' and reference a future action that that bank intends to take. See Exhibit XXXX XXXX transfers servicing to XXXX, and later to XXXX. XX/XX/XXXX XXXX sends Notice of Default and Acceleration letter, just like in XX/XX/XXXX, XX/XX/XXXX and other notices over the previous XXXX years. This is another Notice ; a foreclosure has still not commenced and no other legal action has taken place. See Exhibit 6 According to XXXX State law, the XXXX statute of limitation for lender to collect on the debt was up on : XX/XX/XXXX. RCW XXXX : Statute of Limitations requires a lender to take an actionto enforce within XXXX years of the acceleration for written contracts. Law dictionary define an action as : n. a lawsuit in which XXXX party ( or parties ) sues another. I still have not been a party to a lawsuit that would toll the statute. Exhibit XXXX XX/XX/XXXX comes and goes and no lawsuit is filed. The lender has had over 7 years to take action, still no lawsuit filed, and over XXXX years of the XXXX of Limitations running. Exhibit XXXX XXXX/XXXX/XXXX Trustee records Notice of Trustee Sale, with sale date XX/XX/XXXX. Again, a NOTICE as in the title of the document. Lender specifically is choosing not to take legal action and file a lawsuit, rather to follow a non judicial process AFTER the debt is barred from collection. Exhibit XXXX XX/XX/XXXX comes and goes, several continuances of sale are issued. Trustee is aware of XXXX issues. Phone calls and letters explain to trustee the situation and they do n't have the sale. XX/XX/XXXX ( XXXX days past sale date ) comes and goes with no sale occurring. WA foreclosure law requires lender to start the foreclosure process again. Still, no tolling has occurred yet. XX/XX/XXXX Trustee records Discontinuance acknowledging that they have to start over but the last day to have the sale was XX/XX/XXXX XXXX Exhibit XXXX Trustee also records new NOTS with new sale date of XX/XX/XXXX. They are starting over with the foreclosure process on XX/XX/XXXX. See Exhibit XXXX. Now, the lender is wrongfully trying to collect a debt that is barred from collection AGAIN! Either way, the XXXX-year SOL has passed on XX/XX/XXXX, over XXXX days past the XXXX year tolling date, and over XXXX years past the first late payment. XX/XX/XXXX Northwest Trustee Services agrees to continue the sale until XX/XX/XXXX to look into this further. See Exhibit XXXX. As of XX/XX/XXXX, I have still not been sued by the lender, Bank, " holder '' " servicer '' or any other party claiming to have standing to do so, nor has anyone commence a Judicial Foreclosure. PLEASE HELP!!!

It is too long of a story. Suffice to say that XXXX bank took 7 months processing our modification request for an non-owner mortgage modification then denied us in XXXX XXXX because the house was not owner-occupied though we applied under the rules for a non-owner occupied. We reapplied using XXXX XXXX ... cost of {$2500.00} after spending {$400.00} from a lawyer whor recommended their free service..from XXXX Washington in XXXX XXXX, who submitted a XXXX plus page modification package XXXX/XXXX/XXXX. But XXXX did not tell Northwest Trustee Services to postpone the sale that was scheduled in XXXX for Friday, XXXX XXXX. Nor did XXXX inform NWTS that they had received a modification package. XXXX then received update document XXXX/XXXX/XXXX. Yet instead of informing NWTS to postpone the sale, they transferred the loan to XXXX in late XXXX. XXXX nor XXXX sent us a letter 30 days in advance of this transfer as required. Now XXXX will not inform NWTS of the modification papers. And NWTS knows of the modification papers because they have responded to parkview services acknowledging the prior XXXX file XXXX and now the new file under XXXX XXXX. But they have not postpone the sale date, as required by law. Unless something occurs according to what NWTS and XXXX must do according to law, I will need to to file under bankruptcy protection laws to protect my asset. {$2000.00}

I represent XXXX and XXXX XXXX who own a home located at XXXX & XXXX XXXX XXXX, XXXX, WA. On XXXX/XXXX/XXXX Northwest Trustee Service [ NWTS ] issued a Notice of Trustee 's Sale set for XXXX/XXXX/XXXX. Under state law, the trustee is a duty to act impartially and in good faith to the borrower, beneficiary and grantor. I 've been in communication with NWTS attorney XXXX XXXX regarding whether or not XXXX Bank has the actual note. XXXX XXXX wrote that he had been in communication with XXXX 's attorney on the issue but refuses to identify that attorney. I believe NWTS is acting as both trustee and XXXX 's attorney. I believe that is fraudulent.

I have contacted the Northwest Trustee Service in which is my mortgage has been transferred to from XXXX. I have fees from northwest that are bogus that they want me to pay. In which I was never contacted by them or receive and documents from by mail or certified mail. I have called northwest several times and ask them to provide me with documents that I have sign or they have sent out in which they fail to do so. Anyone can get a tracking number from any postal service or XXXX or XXXX online and never deliver. I feel that Northwest are trying to make me pay for fees and work that they did not do. Which is Illegal for them to do so.
