On Tuesday, XX/XX/XXXX, XXXX XXXX of Nobilis Credit Management, on behalf of XXXX XXXX XXXX, called every single personal phone line of a third party, my father as well as his business lines. My father is not my guardian and I do not enter into loan arrangements with him named. He is a third party. According to my father, a phone line was contacted that is for internal employees and is not publicly available. Two voicemails were left for my father where XXXX named me as a party to legal action and threatened " final legal action '' and suggested that current proceedings " may have been initiated. '' XXXX did not name that he was attempting to collect a debt nor did he name his affiliation with any company, let about Nobilis or that he was called on behalf of XXXX XXXX. The phone numbers that he contacted are clearly listed as those of my father in public records or are official phone lines of his company. I have these two voicemails saved. XXXX attempted to call me but did not leave a voicemail. He only left a voicemail with my father and his business. I called XXXX and asked him if he was aware that it was improper to contact third parties to collect a debt, not only one time but several times. When I asked for information regarding the dates that the debt was charged off and ultimately sold, he told me that I was not being cooperative, and he spoke over me and stated that his client is strict and unless I said that I wanted a settlement that he was going to communicate with the client ( XXXX ) that I had stated that I did not want to cooperate on settling the debt. XXXX would not even disclose to me the name of the collections agency he worked for. He stated that it was called " NCM '' and that the acronym was something I didn't need to know and it " didn't stand for anything. '' He threatened me with false statements to a creditor. He hung up on me when I insisted on collecting further information and stated that he's telling the client that I didn't want to cooperate. I called him back, he further spoke over me because he wanted me to agree to the settlement of a debt that I didn't have enough information about. I ultimately was transferred to Nobilis ' director where he gave me the requested information and agreed that XXXX 's behavior was a violation of federal and state ( Texas ) debt collection laws. Not once did XXXX ever use a disclaimer that he was calling in an attempt to collect a debt when he was initially in contact with me. After I asked - well into the phone calls- I was assured that all of the calls referenced above were recorded. I informed the director that I'd be filing federal and state claims under consumer protection laws. The voicemails left for my father and his company as well as my conversations with XXXX and Nobilis ' director all took place on XX/XX/2021.

The company called my sons cell phone asking for me and was told that was not my number the guy XXXX told my son that his number was the only number they had. I called XXXX and the agent I got XXXX XXXX told me that they had my number on file. I told Ms XXXX to remove my sons phone number from the account. I ask the company name she gave me Nobilis XXXX. I told her I have no idea who that company was and told her to send me something by mail and to remove my phone number. I told her not to contact me by phone only by mail. She told he they had the right to call me weekly. After I told her that was not true she got angry and told me not to call the company back and hung up on me. I wanted to make sure they had removed my phone number and my sons so I called back and go a case manage named XXXX. I told him the same thing that I had told XXXX and told him I have never heard of this company and to send me something by mail. When I refused to give him more info I had already verified my DOB he told me he would mark it as a refusal and the company would sue me for 3 times the amount owed. I hung up on him. The threat to sue me for 3 times the amount due was why I hung up.

On XXXX XXXX, XXXX i receive a call from that number and a person name XXXX start telling me about an account and i explain to him that for him talk to me with respect and i will talk to him, but he was calling me theft i tells him i am a disable person due to an accident i have on XXXX but he continue with bad actittude. I hang out the phone and he call back as soon i answer he said you beleive this was gon na stop here, now you will have a lesson because i am a thief that i use an excuse of XXXX to stole from people. I try to talk to him and give me the name of the company but he dont wants to give it to me, instead he continue calling me thief and hang out the phone. I try to call the primary company and they said that Nobilis Credit Management LLC have this account. I ask him if he wants my documents from my accident on XXXX to this days and he can see i lost my job due to 3 major surgeries on my lower back. And that i finish with 10 screws due to this accident. This is not a corrwct way to talk to people, yes we have a responsability to make the payments but not in this conditions of threat and making false allegations on a person.

I received a voicemail on XX/XX/2020 at XXXX XXXX ( I was at work so, I stepped outside at XXXX XXXX on XX/XX/2020 XXXX. I spoke with XXXX XXXX at Nobilis Credit Management LLC. I set up and paid the first installment of a 10 month payment plan. Once I got home after XXXX XXXX, my brother handed me a written message that XXXX XXXX had called and stated that he was attempting to get ahold of me in regards to 2 clients that had claims against. When I spoke to XXXX XXXX, he had mentioned only 1 client and that's the one I made arrangements to pay. The claim number I was given by XXXX and the one my brother had written down were the same, but the phone numbers were different. The phone number I was given is XXXX ext XXXX, the number my brother was given XXXX ext XXXX. There never has been any authorization for anybody to speak about debt but me and I do not know how XXXX XXXX had gotten my brother 's phone number. I am very upset with the way this was handled with XXXX XXXX and I am thinking of getting an attorney involved, that was a full violation to my privacy.

I received several recordings from a different numbers indicating that this company was trying to locate me. Number from different states the last number was XXXX. These people also contact my aunt with the same recording. When I called the number back they indicated at first they were from NCM I looked up that company and could not find it then they said they were from Noblis Credit Management. I asked if it was a collection company and they said no. They said that they represented their client and I was being contacted because of criminal breech of contract and falsification and he was there to let his client know if he should proceed with legal action. Or if I wanted to settle the debt. I again asked if he was the debt collector and he said no.

XX/XX/XXXX I received a message from XXXX with Nobilis Credit Management LLC stating this is an opportunity for me to make a statement before my file is forwarded for legal action. XXXX XXXX is their client as I returned the call on XXXX and spoke with XXXX. He went on to say that I attempted to defraud banking institution regarding a payday loan from XXXX. I had never taken a payday loan, I was a XXXX at that time and closed out my account due to fraud transactions. I asked for written documentation in the past when I was contacted by XXXX XXXX, which was not provided. I do not intend on paying this debt as I did not incur it.
