I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The Better Business Bureau, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. Before XX/XX/XXXX My husband called Nicholas Financial to inform them his XX/XX/XXXX payment would be paid on XX/XX/XXXX ( which is still within the grace period of 15 days, leap year. ) We were told by the representative that that was fine because this was within our grace period. This is something we have done once or twoce in the past with no issue. On XX/XX/XXXX as promised, the XX/XX/XXXX payment was paid to Nicholas Financial and they informed us our last payment of approx XXXX was due XX/XX/XXXX. On XX/XX/XXXX We received a notification of a significant change on our credit report. Upon looking at this we saw that Nicholas financial had closed our current and 100 % timely paid account and marked it as a charge-off/loss on XX/XX/XXXX. We were never informed the account would be closed or for what reason and our account has never been delinquent for the entirety of our loan. The account still has scheduled payments with zero delinquency as our credit report reflects. I also noticed multiple dates were used on the last payment date. One says we last paid on XX/XX/XXXX, the other says XX/XX/XXXX ... One report gives no information about or payment details or total loan balance but the other does. I contacted the company hoping this was simply a " mistake '' or " error '' but they insisted they intentionally wrote the charge off. I asked them to explain why I never received any notice or a reason for the charge off, and they said they did not have to give me a notice. They informed me they charged off the account because of delinquency, to which I responded that I paid the payment within my grace period and the company was given a courtesy call to inform them they would be receiving the XX/XX/XXXXpayment on XX/XX/XXXX and they confirmed this was no issue because it fell within my grace period. After explaining this, the man then informed me that it was an insurance claims loss to which I responded how that was possible? Our car was totaled last year and the remaining balance was to be paid by us by paying our regular monthly payments until the remaining balance was paid in full, which we had been doing since last year. The man went round and round with, coming up with excuse after excuse as to how the charge off ( which is used for severe delinquency with no expectation that the borrower will repay ) was legitimate, to which I knew was not true at all. He even went as far as to say our old contract was null and void, to which I said, if that is the case, then I don't owe you anything, so he changed his mind on pursuing that spin. I then asked him why he was still accepting regular and scheduled payments with me to which he replied, because we can. I then asked him why the company was writing charge-off 's on open and current accounts knowing these charge-offs are used for tax deductions at the end of the year. I told him this sounded very much like tax fraud to me ... not to mention they had the audacity to offer us another loan whilst destroying my husbands credit, preventing him from obtaining any loan other than through them, which sounded very illegal to me. He responded very coldly to this and said ... " You shouldn't even mention the IRS and federal Reserve unless you know what your talking about Trust me, that's not a road you want to go down '' or something along those lines ... To which I replied, " That is the road I intend to walk and my right. I intend to report you if you admit you are willingly committing fraud. Not only that, you admitted several times this is " company policy '' and " standard practice '' which makes me assume you are doing this to all or at least many of your customers on a regular basis. This sounds illegal and you are refusing to correct it. '' he informed me that " His company doesn't go by Federal Reserve or the credit reporting act, we have our own policy. '' I informed him that his company policy doesn't omit them from the law to which he responded, again, that I didnt know what I was talking about. At this point I could sense he was trying to intimidate me and a shouting match pursued. He informed me he would have a compliance officer contact me and hung up the phone ... no one has contacted me. I have all of my credit report info screenshots, my contract, and my bank statements to prove my compliance with the loan terms. Which I will not provide to the company at this time as I intend to pursue this legally. I have since reported this company to the IRS and FTC as I suspect there is a massive scheme being created by intentionally destroy customers credit so they have no choice but to accept a new loan through Nicholas Financial Inc ( or another equally shady subprime lender ) once the customer is close to paying off their loan. Not to mention regular and massive tax fraud via false/misleading charge-off profit & loss reporting.

I'm a XXXX yrs old XXXX and purchased my first car from a Dealership XX/XX/XXXX. I had a XXXX credit rating due to not ever financing anything. I went to XXXX XXXX looking for a reliable vehicle to get me to appointments etc. I got a ride to the dealership which was an hour drive each way after calling them and getting a pre-approval through Nicholas Financial. I arrived had {$1000.00} cash I had been saving to put as a down payment. They showed me 4 different vehicles 1 which I liked a XXXX XXXX. I told them this is the one I like and would like to buy, after about 2 hours of waiting they said we are still working on it and would call me the next day. The next day I received a call from them saying we couldn't get you approved for the XXXX or any of the other 3 cars we showed you but they had a 2012 XXXX XXXX they could get me financed for through Nicholas Financial if I could come back up that day and see if I liked it. I got a ride again another hour to get there and looked at the XXXX which was a very nice looking car and seemed to run and drive well on the short test drive they let me take it on. So after giving them just about every piece of information about me, several references and another 2hr wait it was a go. I sat in the lobby for about another hour waiting for the Finance Manager so I could sign all the paperwork. As the Finance guy was shooting papers at me as fast as he could The Finance Manager informed me that Nicholas Financial would not finance me unless I bought a Warranty and GAP insurance. I was never shown this Warranty or whom it was with nor did they give me any options of what Warranty I could choose from. Not knowing any better and being a first time buyer I signed the paperwork and was charged {$1000.00} for the Warranty and {$790.00} for GAP insurance which I had no clue what it was because I had full coverage insurance. I got in my car drove off the lot and 20 mins into my 1 hr drive my check engine light comes on. I immediately pulled over, called the dealership and told them what was going on. My salesperson told me let me get with my manager and call you back. I never got a call back and drove straight to an Auto Repair shop in my hometown. They told me based on the codes they pulled that I needed 2 fuel injectors and an o2 sensor replaced and 1 code was permenant and the dealer probably cleared but would always come back on until the repair was made. The next day I still never got a call back from the dealer so I called them and was transferred to a Manager who told me I had a Warranty and would need to call and make a service appt. I explained I was never told who the Warranty was through or what it covered, he said thats all he could do. I called Nicholas Financial whom made me purchase a warranty and explained this whole ordeal that started just 20 mins after driving off the lot and was told well just keep on the dealership so they could get it fixed but didn't have my warranty information yet. End of story at this point was I drove it short distances until about 1-2 months later I received a warranty card in the mail and the name of the Company XXXX. I called them regarding the issues and my Warranty coverage and they advised me the Warranty I purchased didn't cover those repairs and that was an ad on for electrical and another for sensors. I was now able to look at what Nicholas Financial picked as a Warranty which was basically a drivetrain warranty. To date I have paid close to {$2000.00} dollars of money I had to borrow to have repairs done not covered by a Warranty I was forced to buy from Nicholas Financial. Being XXXX this has put a huge financial burden and unwanted stress on me. I have contacted Nicholas Financial several times asking for them to cancel my Warranty and GAP insurance because that was a backdoor tactic, illegal and I was under the impression I had to purchase which totals {$1800.00}. I have talked to the Manager XXXX XXXX via email along with other employees so I have documentation and the Corporate Compliance Officer XXXX XXXX and they have never addressed the Warranties I was tricked into purchasing just send them a copy of the repair invoices and he would see if the Warranty Company would cover it. I sent them both a copy of my Warranty and highlighted what it covers and mine does not cover the repairs needed. I even tried trading the car in for a new one 8 months later but the dealer got 3 different payoffs one being {$100.00} less than what I purchased the car for 8 months prior so they said they couldn't do it. I'm stuck with a car which has had electrical issues since 20 mins after purchasing it. I'm so stressed and frustrated I even asked to return the vehicle several times and they would just tell me to call them and they could help but I told them email was my communication so I had documentation.

This company continues to furnish to consumer reporting agencies my approval of a specific extension of credit, 30+ day late payment from 2019 to the current date and they are furnishing my nonpublic personal information to nonaffiliated third parties without my consent. U.S. Code 1681a ( d ) ( 2 ) Exclusions -- Except as provided in paragraph ( 3 ), the term consumer report does not include ( A ) subject to section 1681s3 of this title, any ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; ( B ) any authorization or approval of a specific extension ofcreditdirectly or indirectly by the issuer of acredit cardor similar device ; 15 U.S. Code 1681b - Permissible purposes of consumer reports ( a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. I was not provided opportunity to agree to opt-in or out of my nonpublic personal information be reported to any of the consumer reporting agencies. I have the right to privacy, accuracy of any information furnished to my consumer report as well as that information is furnished. Since Nicholas Financial has furnished this information from 2019 which Congress states is excluded from my consumer report pursuant to section 1681a, my creditworthiness, creditstanding, creditcapacity, character, general reputation, personal characteristics, and mode of living which is used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing themy eligibility for obtaining creditor insurance to be used primarily for personal, family, or household purposes has been harmed. On XX/XX/2018 I was in the process of buying a car. However I was not aware that the company that I was buying the car ran my credit over 15 times with multiple different companies. Consequently no company agreed to finance me due to not showing enough debt to income. With that being said, I still am stuck without a vehicle. So I took it upon myself to write to the different companies asking for favor, second chances and good faith. If they could not find any of the 3 then would they please remove this inquiry so that I will have the opportunity to purchase a vehicle. So what is the purpose of pulling someones credit report when you know that it will hinder their chances in the future. I started a loan on XXXX for {$14000.00} for a Term of 66 months., with Nicholas Financial, Inc . I have been paid $ 392.oo monthly since then until Today 's date. I am current on payments. I just got behind on payments up to 120 days on XXXX because I was unemployed. But as soon as I got a new job, I paid all the fees imposed by the Company to avoid loss the auto as I was treated it for and the condition was to put the account current at that moment. Since then, any payment I have missed. But is unbelievable and unacceptable that even that the XXXX XXXX XXXX still have and report is almost the same when I started ... and is not getting down : {$10.00}, XXXX. More than half of the payment goes to Interest, which is something several times I have complain about ; but not one fix or adjust it, care or respond me as should do. I have been charge several times by expense insurance premiums, without notified me previously and even the Ins. company reported for me that I have coverage. That supposed is one of the additional charges, Company said I have, plus a lot of fees that are not right. I have never received any formal statement with the complete history of payments as per I requested several times. Actually, I have nor received bills since more than 2 yrs, when I asked them for... I purchased a XXXX XXXX XXXX through Nicholas Financial in XXXX of XXXX. The term of the loan was 48 months. At the end of the 48 months, actually 52 months, I was told that I still owed over {$4200.00} for the vehicle. After several unanswered question, multiple complaints, and heated discussions Nicholas Financial repossessed the vehicle in XXXX of XXXX. They reported to the credit bureaus that I defaulted on the loan and still owed {$4200.00}. I attempted to contact them several times, with no success. I later found out that their XXXX office had permanently closed, and that they couldnt give me any answers because the office and paperwork was left in a mess. I then contacted the headquarters in Florida to discuss the charges at the end of the loan. The representative explained that it was for company forced insurance that they placed on the vehicle. I explained to her that I didnt need that because I had my own insurance on my car. Her response was that if my insurance company didnt continuously update them during renewal time then they would automatically force place the insurance, even though nothing about the policy had changed and there was no lapse in coverage. I asked her why wouldnt they just reach out to me to verify coverage, she didnt have an answer. I then asked for information about the insurance company and what kind of coverage it provided. She told me that it was an in house insurance company and that her computer couldnt give her any information about the actual insurance or policy itself. As I kept questioning her about the price, frequency, and decision to start the insurance without notifying me she became increasingly agitated and aggressive. She eventually hung up on me. I paid for 52 months on a 48 month loan, and they still repossessed the car. How are their actions legal? What can I do to get this removed from my credit report, other than pay them more money?

On XX/XX/XXXX I paid my vehicle loan in full to Nicholas Financial, for some time this account has had multiple reporting errors. Upon dispute of these errors in JXX/XX/XXXX, the XXXX XXXX obviously provided validation, and XXXX and or Nicholas Financial updated the account in addition in the results provided to me to state that the account status is 30 days past due. THIS is not correct, there is no balance on this paid account, and the current status of this account should obviously be reporting as PAID not 30 days past due. This is inadvertently dramatically affecting my reports and scores to appear as though I have a recent 30 day late payment. I have reached out to Nicholas Financial who claims that XXXX is the culprit in the matter, and to XXXX that claims that Nicolas Financial is the culprit.Additionally: They say in the prior complaint that they could not locate this paid and closed account, upon calling they were easily able to locate the account and discuss this with the credit reporting department in their organization who still has not corrected this erroneous entry into my XXXX report and does not seem to have a clear understanding/comprehension that marking a paid account 30 days past due as the current status is not just inaccurate but false, the Status of this account is paid/current further this account has not been marked as disputed by me as inaccurate and is directly and negatively affecting me. This is a 3 year old problem!!! Once again this account reporting is in violation of the FCRA section 609. for further reference the account number on the file is reporting as #XXXX, My maiden name if it helps them locate it in their records is XXXX. There were faults done by both the Dealership I purchased this vehicle from XXXX XXXX as well the Creditor Nicholas Financial. First off thank god the dealership was caught red handed and the government shut them down and a class action was filed. But the dealer offered a warranty that they did not back, I had multiple issues with this vehicle and they refused to fix with the purchased warranty, so I had to return it. And that 's not the creditor 's fault I blame them zero for that so I never approached it. My problem with the creditor is they improperly handled my case. By law they have to notify me that my car was being sold so I have the option to buy. Then it was sold and and any money owed to me or owed to the creditor has never been updated. In their system the original price was roughly {$9000.00} and I owe them {$13000.00} on a XXXX loan. They show no credit for my car being sold taken off of the balance. So they have double dipped on my automobile. They got the car back and did n't credit me for the sale price. Well I searched the vin and contacted the purchaser, he purchased it as is from an auction in north Carolina for {$10000.00}. My question is where is the credit for the sold amount? Please take a look at my file for yourself and see nothing has been updated and I owe {$13000.00} on a {$9000.00} vehicle with NO CREDIT from the sale of the vehicle. The question further in this is did they claim the full {$13000.00} tax loss when they received money from the sale of my vehicle? If this proceeds a further in depth look will be done.

this is a charged off account for an automobile of mine that was repossessed a few years ago. I was trying to fix my credit so I had my credit report on my computer looking at it so I called the lender that I bought the vehicle from to inquire about the amount the vehicle was sold for at the auction and how much they claim that was charged off so while going over the file he the rep told me that he could mail a copy. then he proceeded to say that he seen an old complaint that I made to them about items that I did not receive out of the vehicle when it was repossessed. so I said no one never contacted me back so I just left it alone. so then he proceeded to get smart with me saying do you think we suppose to deliver them to you. so as to not engage in an argument with him I hung up. he kept calling back so I blocked his number. then 10 minutes later I received a notification to my email that someone just pulled my credit .I pulled up XXXX XXXX to see who it was and it was him the rep. The company will call me multiple times a day and send multiple emails. Sometimes they will call me back to back within an hour. One representative named XXXX has been repeatedly rude, aggressive and one time denied a payment I offered to make to work towards reconciling my account. I have asked repeatedly that he no longer contact or communicate with me regarding my account, verbally and in writing and he continues to contact me. I have even told management that I do not want him to contact me and they assured me that he would no longer contact me or handle my account. I have made them aware of my financial situation several times and that I will make payments as much as I can monthly. They did not offer to lower my payments, give me a lower interest rate, or anything so I am doing the best I can to make as close to {$400.00} a month payments monthly to them. They have also contacted me for payment during the grace period of 10 days. In XXXX of XXXX Nicholas Financial refused to process my payment, thus pushing my loan into default and showing a late payment on my credit. It ' ; s important to know that, I had restricted from making payments online, even after I asked that the problem be corrected, so I was forced to email a representative when I wanted my payments withdrawn. In XXXX XXXX and XX/XX/2020 I have submitted disputes with the XXXX credit reporting bureau regarding inaccurate and false information listed on my credit report. One of the accounts that I disputed had late payments that were not late I've requested this information to be updated from both the creditor and the credit reporting bureau. They continually say that they have investigated the item and have opened and closed the case within hours. Typically an investigation takes up to 30 days. They have not investigated or verified any information to be accurate because if they did they would have updated it to show that the payment history is never late. In XX/XX/2020 due to COVID-19 being laid off from job, I made a request for a Hardship. I was told I had to pay the interest. I was sent a deferment form to complete. I refused to sign it because I had asked for a Hardship and was told it was the same thing. I later contact other companies and lenders and was told a deferment and hardship is two different things. I the contacted the corporate office and spoke with XXXX who stated his supervisor informed him that they would do a hardship only if I pay a full month. I have a used car loan with Nicholas Financial , Inc., XXXX XXXX XXXX XXXX, XXXX 's XXXX, MO XXXX. I did not choose this company - the car dealership arranged the credit with a different company, but a few months later the debt was evidently purchased by Nicholas and I had no control over it. Since the car dealership propagated another scam on me related to inferior car insurance, perhaps this change in loan companies was a similar bait and switch. Because of the exorbitant interest rate, and because I improved my credit rating drastically since I purchased the vehicle, I contacted my bank to request refinancing. The remaining loan was beneath their threshold for auto loans, but they offered a XXXX interest credit card instead. I contacted Nicholas to pay off the loan, but they refused to accept a credit card payment. My bank insists I should be able to make a payment with the card, but Nicholas refuses. I made a large payment via my checking account in the meantime, but I believe this is an unfair practice designed to continue to collect ridiculous interest, while I lose out on 0 % interest and bonus points on my credit card.

I have a great track of payment record and this was an unfair act that hurt me. I want us to take action and justice and seek damages regarding this company illegal act. This has caused me pain, stress and sorrows. This fraudulent act by this company caused damage to my credit FICO and has dropped my FICO score over - 100 pts causing me to lose the opportunity to purchase a home for my family and kids and also hurt my chances of me closing on the personal loan to help my family. I opened a car loan XX/XX/2009 with Nicholas Financial for a XXXX XXXX. The loan was for 54 months at the payment was {$330.00}. I fell behind due to my grandmother getting ill and I had to travel back and forth to Florida to take care of her until she became so ill that I had to relocate. I tried to contact them on several occasions to discuss the situation but to no avail. My car was repoed and during the I was dealing with my grandmother I couldn't give it as much attention as I wanted to. However, I did call several times as well as sent a letter. I financed an use vehicle on XX/XX/XXXX.which turns out to be a lemon. Within the 1st week I had to return to the dealer 4 times because of engines problems. In 2006 my identity was stolen when my vehicle was broken into and wallet was stolen with my social security card, drivers license and bank cards. Ive pulled my credit report & noticed an unauthorized inquiries, I then contacted the original creditor, they werent able to identify me nor did they have any of my information on file or in their system. Nicholas Financial added a {$1000.00} fee to the buy/sell agreed upon price as a lender fee, but never disclosed as a finance charge or lender fee.
