I also request total loan forgiveness. The existence of this loan balance is creating a hardship that makes it impossible for me to live. After several attempts, I have been unable to acquire documentation of the loan origination document. I have attempted to obtain this documentation from the US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX and from the New York State Higher Education Services Corporation. In XXXX, I obtained this loan through New York State Higher Education ( NYSHE ). Although these organizations have provided some documentation, neither one has actual records of the loan origination documents or a complete loan repayment history. I requested both organizations to provide me with copies of the loan origination documents ( that were executed by my signature in XXXX and XXXX respectively ) and a complete loan repayment history from XXXX to date, however both organizations indicated that these documents no longer exist. Unfortunately, I, myself, no longer possess my personal copies of these documents. After my divorced was finalized, I had moved out of state ( Colorado ) in XXXX, and had placed my personal possessions ( including my file cabinets ) in storage in Colorado. All were lost because of a fire at the storage unit that occurred some time in XXXX or XXXX. Also lost were cancelled checks that included my student loan payments through XXXX. In the beginning, there were XXXX loans, XXXX in the amount of {$5000.00} to pay for tuition for my first year of graduate school at the University XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and a second loan in the amount of {$6000.00} to pay for tuition for the second and final year of graduate school. The total amount borrowed was {$11000.00}. Unfortunately, not only have I lost my copies of documentation of these loan originations, it appears that New York State Higher Education ( NYSHE ) no longer has access to these records as well, ( even though this loan was originated by New York State Higher Education ( NYSHE ) ) nor does the US Department of Education ( Federal Student Loans ) have records of these early documents. I have requested and received some documentation from these organizations- each claims that they have sent all the documentation they have- but this documentation is woefully incomplete and comes nowhere close to documenting the actual loan origination history and full loan repayment history. I have scanned and attached each and every document I have received and have attached these documents to this letter. With respect to my loan repayment history, between XXXX and XXXX, I had arranged for the payroll department of my employer, XXXX XXXX ( part of which became XXXX XXXX XXXX after a spin-off that included the division in which I worked ), to withhold money from my payroll check and mail student loan payments on my behalf. They agreed, and did so as requested. At the time my employment was terminated in XX/XX/XXXX ( due to a massive reduction in force ( RIF ) ), my NDSL balance was approximately {$1000.00}. I had calculated that had I remained employed through XX/XX/XXXX, my student load balance would have been paid off in full had I maintained the loan repayment schedule that was in place during the first half of XXXX. After I left XXXX, I was unable to find suitable employment and wound up getting temporary jobs that didnt pay anywhere close to the salary I made at XXXX XXXX I could no longer afford to make student loan payments and struggled to pay my basic living expenses. My loan fell into default status. According to New York Higher Education Services Corp ( document attached ), as of XX/XX/XXXX, my loan balance amount was XXXX and as of XX/XX/XXXX, it was $ XXXX more than {$4000.00} higher. According to the US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX, I entered into a promissory note for a Federal Direct Consolidation Loan on XX/XX/XXXX ( documentation attached ) although I dont know what the alleged loan balance was at that time. US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX further indicated that there was a principal loan balance of {$53000.00}, an interest rate of 8.2 %, an interest amount of {$20000.00} and a collection charge of {$13000.00} for a total balance of {$87000.00} but its not clear to me, in the documentation provided, ( and attached to this letter ) what the effective date was for these numbers. One document the US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX provided to me indicated that my student loan balance was {$78000.00}. The US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX indicated that from XX/XX/XXXX through XX/XX/XXXX I paid XXXX ( through a garnishment of my monthly Social Security XXXX check ). XXXX years ago, I received a XXXX XXXX XXXX refund check in the amount of {$160.00} dated XX/XX/XXXX, so the total payments made from XX/XX/XXXX through XX/XX/XXXX was {$4600.00}. None of these payments were applied to principal reduction. Presently, due to the moratorium placed on student loan collection by the XXXX administration, no payments have been made since XX/XX/XXXX. It is my understanding that it is unlawful for the Department of Education to incur additional interest, fees, or penalties from XX/XX/XXXX to now. I simply dont understand how my principal balance of ~ {$1000.00} in XXXX could have ballooned to over {$78000.00} ( or {$87000.00} ) as of XXXX! And the documentation I have received to date does not show how this happened. Therefore, I dispute that {$78000.00} ( or {$87000.00}, for that matter ) is a legitimate balance. I think its reasonable to dismiss this loan balance at this time insofar as during the life of the loan I have paid significantly more than XXXX or XXXX times the original principal amount of this loan. With the exception of this loan, my credit history is excellent, however, because of the existence of this loan on my credit report, I have been unable to get a mortgage on a house ever since I quit claimed my last house to my ex-wife as part of our divorce settlement in XXXX. XXXX is enough! I have included my XXXX XXXX XXXX for XXXX XXXX to document my current income. The XXXX administration established a moratorium on student loan repayment effective around XX/XX/XXXX and required lenders to cease and desist reporting student loan status to credit bureaus. Since that time, my XXXX credit score has risen from the mid to upper XXXX to the over XXXX between XX/XX/XXXX and now. I am attempting to purchase a modest house now. I have informed my lender that I would like to pay {$15000.00} down ( 30 % ) on a total purchase amount of {$50000.00} ( the mortgage loan would be {$35000.00} ). About a month ago, my lender gave me a verified approval of {$75000.00} for a mortgage loan on a house with a purchase price of {$100000.00}. Today I was informed that because the loan amount of the house I want to buy is below {$50000.00}, I am ineligible for a conventional loan. My only option is to apply for an FHA loan. Even though my student loan no longer appears on my credit report, the record of default is visible to the FHA lender. This means I can not be approved for an FHA loan, which would give me a mortgage payment of {$200.00} ( PI ) per month, if approved. Monthly rent would cost me {$600.00} to {$700.00} at the least in the city where the house I want to buy is located. Over the course of history of this loan, various other companies have attempted to collect this debt. XXXX was XXXX, XXXX was another. I think there have been others but I cant remember their names nor do I have any contact information. It appears that there is no central database that contains all of this information and it appears that the entire payment history for the life of the loan is unavailable. For example, the representative with whom I spoke at US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX told me that I have not made any payments during the life of the loan. This is entirely untrue. Such a statement evidences the incompleteness of their records. I have requested ( by phone ) to negotiate an abatement of this loan amount ( essentially by reducing the amount of interest, penalties and fees owed ) to both the New York State Higher Education Services Corporation and the US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX. NYSHE Services Corp told me that the matter is out of their hands and must be handled by the US Department of Education XXXX XXXX XXXX XXXX XXXX XXXX. The representative at the XXXX Department of Education XXXX XXXX XXXX XXXX XXXX XXXX with whom I spoke told me that no abatement or special arrangements can be made. He actually told me that the loan origination date was XX/XX/XXXX! That is utter nonsense! He told me that all the charges are legitimate and can not be contested, abated, or negotiated downward. He also told me that the amount of my current income is irrelevant. The representative told me that if repayment of this loan presents a hardship, my only recourse is to apply for loan forbearance. I have applied for loan forbearance in years past, and I think this is related to the astronomical amount of interest, fees and penalties that have accrued to my account over the life of the loan. Although the interest rate of 8.2 % is extremely high, I have been told that this amount can not be lowered. Now I am concerned that to apply for loan forbearance will only exacerbate the problem. What I would like is recognition for payments made over the course of this loan ( although it appears that a complete payment history no longer exists ) and I would like loan forgiveness. To Whom It May Concern : In XX/XX/XXXX, I graduated from XXXX XXXX XXXX XXXX XXXX ) with a XXXX XXXX XXXX XXXX. Over the course of those 4 years I took out 15 loans that totaled {$83000.00} across at least three different loan servicers. It was very difficult to keep track of all those loans so shortly after I graduated I consolidated them all and dutifully began repayment. Never once late on a single payment, and scraping together whatever extra I could to lower my principal balance, by XXXXthirteen years after graduatingI had reduced my total student loan debt down to {$13000.00}. After being emancipated at the age of XXXX and putting myself through college shortly thereafter, this felt like an incredible win. However that feeling quickly dissipated on XX/XX/XXXX after answering a call from a woman named XXXX XXXX at XXXX XXXX XXXX. She told me I had a XXXXXXXX XXXX in default with XXXX. You can imagine how surprised I was to receive a call from a collections agency after how faithfully I had paid back my student loans, and that more than a decade had passed since I would have taken out said loan and this was the first I was hearing about it. Another thing that really surprised me was that I had closed on my first house just a few days before taking her call, a process that took over a year to complete as it was a short sale, and my lender ran my credit report no less than 3 times throughout the year, never once finding any loans in default. I explained to XXXX XXXX that I had consolidated all of my student loans after I graduated. I remember her saying that she hears this happen often with XXXXXXXX XXXX, that for some reason they dont get included in the consolidation. But why was this the first time I was hearing about this loan? XXXX XXXX told me that XXXX had a phone number I didnt even recognize on file. I asked if they had my XXXX email address on file as it was a main means of communication with the school while I was in undergrad, and I still actively use it to this day, plus I am actively on the XXXX alumni network e-mail list. She said they did not have my email address on file which totally shocked me. How earnestly were they trying to get a hold of me about this loan? I get calls every year from XXXX asking me to donate money, surely my phone number is on file somewhere at the school! And it clearly wasnt difficult for XXXX XXXX to find my correct phone number considering she was just issued my case and able to immediately find it. Whats more, I answered the phone on her first attempt, showing that I was not in the practice of dodging calls. Where the true misdeed comes in is that the loan was now more than double its original amount. When I first took out the loan it was {$3500.00}, but now after all the collection agency and other fees were tacked on, I was told the balance had drastically increased to {$7600.00}. ( As you will read below, the balance was in fact even higher than that by more than {$700.00}! ) My heart sunk. Just when I thought I was in my final stretch of paying off my student loans and therefore able to afford my first housea dream Ive worked towards my entire lifeanother XXXX XXXX of debt is mysteriously thrown into my lap. It felt extremely predatory. Had I known about this loan when I initially consolidated after graduation, I would have paid it off, and on time. Just as I did with every other loan I ever had. The second transgression occurred when I was told that there was only one option for settling up on the balance. I asked XXXX XXXX if I could pay off the loan in full in order to negotiate a lower balance. Ive heard plenty of stories of others blatantly ignoring their student loans for years, then once the collection agency contacts them they are able to knock off thousands of dollars in exchange for repayment. Surely there was something that could be done to lower my balance considering that the original loan amount was less than half the current balance, and I had absolutely not defaulted on purpose. I suggested I call XXXX directly to speak with them about this possibility, but XXXX XXXX told me that XXXX had passed my case on to her agency so negotiating wasnt possible and my only option was to consolidate this XXXXXXXX XXXX, at its current balance with all its fees and interest, with my one remaining student loan that I held with XXXX, and that it had to be on an Income Driven Repayment plan, and that she would walk me through the process right there on the phone. So she talked me through every step I needed to take on the studentaid.gov website to consolidate the defaulted XXXX XXXX with my XXXX loan during that first call on XX/XX/XXXX. Once we finished all the necessary steps, she told me that the consolidation shouldnt take more than a week or two to fully process. A couple weeks passed and the XXXX loan still wasnt showing in my XXXX account which worried me as I thought new late fees could be accruing with each day, so I decided to call the XXXX XXXX XXXX directly on XX/XX/XXXX to try and get to the bottom of everything ( despite XXXX XXXX telling me it would be useless ). I left a voicemail explaining my situation and asked for a call back. I called again on XX/XX/XXXX and spoke with a very helpful woman named XXXX XXXX ( XXXX ). She told me that my balance was in fact {$8300.00}, not the {$7600.00} amount XXXX XXXX had told me over the phone. I later also received a physical letter from the collection agency XXXX XXXX XXXX with the {$8300.00} balance. I couldnt believe another {$600.00} was somehow added to the balance! XXXX XXXX said she could at least remove a late fee of {$100.00} from my balance ( though that doesnt seem to be reflected in my current balance ), and told me about a rehab option for my XXXX XXXX which XXXX XXXX XXXX neglected to mention. Although the initial payments for the rehab offer were significantly higher, it had the benefit of removing any past due reporting from my credit report once I had completed 10 months of on-time payments, which I wanted to take advantage of. However I first needed to figure out where things were in the consolidation process so that I could cancel it and instead elect for the rehab offer. After speaking with XXXX XXXX on XX/XX/XXXX, I called XXXX XXXX that same afternoon at the collections agency to ask why the XXXX loan amount was suddenly higher than the amount she originally told me it was, and if I could cancel the loan consolidation so that I could move forward with the rehab option I had just learned about. XXXX XXXX told me that there are often discrepancies with her system and the schools system which is why the numbers were off. She then started a conference call for the two of us with XXXX who was processing the consolidation to check on its status as it had already been more than three weeks since I submitted the consolidation request. The XXXX rep told us that the consolidation should be completed by the next day so it was too late to cancel it. I really wasnt surprised that just fell in line perfectly with the whole saga. In summary, here are the unscrupulous and predatory issues I would like to address : First and foremost, it does not seem that XXXX made an XXXX effort to contact me about this loan before it went to default. When the consolidation went through my student loan balance increased from {$13000.00} to {$22000.00}. This reflects a {$8300.00} increase which is higher than both amounts I was previously quoted by both the collection agency and the XXXX XXXX XXXX. Of that {$8300.00} increase, {$4800.00} is fees. This might not seem like a lot to some, but it is to me. Thats {$4800.00} that I need to fill my oil and propane tanks, replace the dangerously frayed electrical service wires on my house, repair my stove, pay for my health care, etc. There is no shortage of immediate bills and this is a lot of money to divert from them for fabricated fees on a loan I didnt even know I had. The {$100.00} late fee XXXX XXXX from XXXX XXXX XXXX said she removed from my balance was never actually removed, or at least it seems that way I never received an itemized breakdown of the XXXXXXXX XXXX balance so I have no way of knowing. I was not given all my options for repayment during that initial call with the credit agency, specifically the rehab option, and was led to believe my only option was to consolidate right then and there over the phone. It wasnt until I took it upon myself to call XXXX XXXX XXXX directly, which the collections agency rep strongly discouraged me from doing, that I found out about the rehab option. But at that point it was already too far along in the consolidation process to switch to the rehab option. I would appreciate a reduction on my loan balance considering the exceptionally predatory practices I was subjected to. Thank you for your time and consideration.

Around XX/XX/XXXX, I found a NYS Higher Education student loan on my XXXX & XXXX credit report that does not belong to me. I disputed this inaccurate information to both credit agencies. XXXX has this inaccurate information pending and as of today, I have received a letter from XXXX, dated XX/XX/XXXX, due to additional information the investigation in regards to this student loan will be completed on or before XX/XX/XXXX. However, with XXXX it has been a totally different experience. In addition to calling them, I had filed disputes with them three different times online : XX/XX/XXXX - Report # XXXX XX/XX/XXXX - Report # XXXX XX/XX/XXXX - Report # XXXX With the results for the disputes on XX/XX/XXXX & XX/XX/XXXX I was given this explanation : The information you disputed has been verified as accurate ; however, information unrelated to your dispute has been updated. Please review your report for details. With the dispute on XX/XX/XXXX, it appears to be deleted ; however, this inaccurate information remains on my credit report. In regards to HESC : They have been less than helpful in regards to my situation. This student loan is not listed on my account on XXXX website. This student loan cant be found in the National Student Loan Database under the Federal Student Aid web-site. There are a total of 16 federal student loans in which five were paid in full and the remaining 11 are being serviced by three different servicers. This mysterious loan does not appear in this group. Nor can this loan be found with the two private student loans on my account on XXXX website. I got in touch with XXXX XXXX at HESC on Wednesday, XX/XX/XXXX. He seemed helpful at first. He even gave me his direct number. He mentioned that he had gotten access to my loans in the NSL database and verified that this mysterious loan was not among my federal student loans. He suggested that I send him a copy of this loan on my XXXX credit report. His direct faxed number didnt work so I was glad I asked for his direct email address. However, even as I provided these documents via email, he claimed he could not remove the inaccurate information on my report. He said the loan was put on my credit report by XXXX XXXX XXXX. This isnt true! On Monday, XX/XX/XXXX, I called HESC again. This time I spoke with XXXX. She claimed this account on my report was accurate. She also claimed that this student loan account was in collections with XXXX XXXX XXXX. In regards to XXXX XXXX XXXX/XXXX XXXX XXXX : There are four defaulted federal student loans that were sent to them by either the NYSHEC or XXXX. I am very aware of them because I was enrolled at XXXX College at the time. The loan in question does not provide this information. The four loans are currently in a Loan Rehabilitation Program with XXXX and my final payment to restore these loans is on XX/XX/XXXX. I spoke with two different representatives and both said that the loan with the account number beginning with # XXXX is not a loan listed on my account with them or under my social security number. The first representative also mentioned that XXXX was once called XXXX XXXX XXXX around XXXX or XXXX. The second representative, XXXX XXXX, could not recall when the name change occurred. I spoke with her on Wednesday, XX/XX/XXXX at around XXXX XXXX. She suggested I send a copy of these documents via email, which I did. This morning, I called to verify the receipt of these documents. XXXX tried to back track for a minute about the validity of this loan. However, I reminded her that I spoke with lawyers online who had responded to my question about my situation and told me what I needed to do. I also reminded her that I was in the process of filing a complaint with government agencies that specialize with unfair credit reporting practices. I also let her know that the XXXX Department of Ed received the same documents and are in the process of mailing me a fraud packet with forms for me to fill out. Why would they go through all that trouble if they thought this loan belonged to me? She then proceeded to tell me that the documents were received and were sent to their compliance department to be reviewed. XXXX also mentioned that XXXX XXXX , XXXX does not report to the credit bureaus. XXXX XXXX , XXXX & XXXX Department of Education I first called XXXX XXXX in regards to this student loan on Monday, XX/XX/XXXX in which my calI was transferred to the XXXX Department of Ed. I spoke with a representative about my situation. She verified that she did not see that student loan listed with the student loans on my account. She suggested that I faxed over a copy of the loan in question. I was able to fax over copies on Friday, XX/XX/XXXX. I followed up with a call onTuesday, XX/XX/XXXX. I spoke with Mr. XXXX XXXX. He confirmed the receipt of this student loan. He, once again, verified my email and home address before mailing out a fraud packet. I called the following day, XX/XX/XXXX, to reconfirm if this packet had been mailed. It has and it will take at least 7 to 10 days before I receive these forms. XXXX XXXX By Monday, XX/XX/XXXX, I came across XXXX XXXX thanks to a representative at a law office in which I am a party to their class action settlement. I sent my questions and got more than the information that Ive needed. They also advised me not to call XXXX anymore as they felt that more disputes with that agency will not resolve anything. They suggested that I submit my complaint to CFPB and FTC. I also faxed them a copy of the faxed document that I sent to XXXX XXXX, XXXX. The response : The more evidence that you have that YOU DO NOT OWE THIS LOAN, the better is your case against the credit bureaus. Attached are all the documents I feel are relevant to this case.

In XX/XX/XXXX I graduated XXXX XXXX XXXX University with approximately XXXX dollars of student loan debt. None of this debt is private all is both Federal and State ( California ) loans. I had done Forbearance and Deferments while I was in between employment an not making substantial enough money to pay back my loans and the cost of living. In XX/XX/XXXX/XX/XX/XXXX I consolidated the loans and began paying my student loans back ( I have tax documentation supporting this ). In XX/XX/XXXX I became pregnant and lost my employment ; However, my loans payments were paid through XX/XX/XXXX. In XX/XX/XXXX the California housing market and coupled with my husbands loss of bonuses this left us very little money for expenses. Then in XX/XX/XXXX my husband lost his employment. My husband was on unemployment, we had Californias XX/XX/XXXX Insurance, were on XXXX, and were on forbearance for our home loan. I had exhausted all Deferments and Forbearance options and was told there was nothing I could do, absolutely nothing and my loan would go to default. In late XX/XX/XXXX I began getting phone calls from New York Higher Education Services Corporation ( HESC ) both myself and my husband received these calls. In XX/XX/XXXX we attempted to work with HESC they would not send any documentation. HESC would only speak to you on the phone. When you called HESC or attempted to return a call you could never get ahold of them and speak to the same person. HESC expected me to agree only by phone call ( not signed legal documentation ) to have access to me and my husbands social security to have all access to the IRS. HESC would further not let me set up a payment plan I could afford ( we are still paying off bills from my husbands loss of employment never declaring bankruptcy ). HESC only gave me two options pay over XXXX dollars a month or XXXX dollars a month, I had no other options HESC only gave me two. If I chose the XXXX dollar a month choice ( which I did ) HESC guaranteed me with in one year I would be in good standing and they would contact me to renegotiate my loan. HESC did all of this via phone calls NEVER sending or giving me legal and formal documentation. HESC took my joint bank account information and charged my bank account XXXX dollars a month which was paid from XX/XX/XXXX through XX/XX/XXXX. HESC never contacted me as they stated ( why would they there was no legal binding documentation ). In XX/XX/XXXX they contacted me stating they sold my loan and I never paid on, so it was back HESC in default. Again, I was never contacted by another loan company and nor did I ever receive any documentation. No one ever sent me lender change notification, I receive absolutely nothing. Again, both my husband and I demanded they send legal documentation with loan information, principle owed information, interest information and interest owed, etc. We also requested HESC send us formal paperwork justifying their legitimacy, and loan and loan options from them in writing. That is, it and Im am not sure what interest rate my loan has, but its preposterously outrageous. The Attorney agreed that the way some Federal Student Loan lenders are set up they take advantage of people and the US Department of Education does nothing or does not know there is foul play. XX/XX/XXXX - XXXX XXXX XXXX has just acquired my defaulted federal student loan debt from the previous company, XXXX, and on behalf of the New York State Higher Education Service Corporation. XXXX sends a letter, stating that my total current balance is {$6800.00}. This has been broken down on the back of the letter as follows : {$5600.00} Principal Balance, {$1.00} Interest ( which is the daily amount of interest that accrues on my principal balance ), and {$1200.00} in Collection charges. The collection charges are astronomical. Added all together, we get a total of {$6800.00}. So far, so good. XX/XX/XXXX - I receive another letter from XXXX XXXX XXXX, informing me that an " adjustment '' of {$1300.00} has been made to my account ( this is my garnished XX/XX/XXXX New York State tax refund ). However, in this letter, my " Previous Balance '' is stated as {$8200.00}. This is a difference of {$1300.00}. My interest accrues at a rate of {$1.00} a day. The difference in time between the first letter and the second letter is 26 days, meaning that the interest accrued should have amounted to {$27.00}, making my balance at that time {$6800.00}, which would still include the ridiculous collection charge. No where on the letter is there an explanation of where this {$8200.00} number comes from. They claim on this letter that I now owe {$6900.00}, after the garnished tax refund is applied to my account. This balance is higher than it was a month ago, before they took {$1300.00} from my New York State tax refund. Clearly this is wrong. I called and submitted a dispute on or about XX/XX/XXXX regarding this amount, but have received no communication from XXXX except receiving another statement in the mail a week later with the incorrect balance owed. In a letter dated XX/XX/XXXX, they claim that I owe {$7100.00}. I am trying my best to settle my debt, but after faxing over 40 pages of requested statements, detailed letters of explanation, and itemized expense documentation to XXXX and also scanning and emailing all requested information both to HESC and XXXX XXXX XXXX, I have no word from either of them as to whether or not I can settle my debt. I went to great pains to get a bank loan ( a friend with good credit agreed to co-sign to help me get out of debt ), and am ready and willing to pay WHAT I OWE. NOT what I DO NOT OWE!!! Ironically, I have recently settled a debt with the US Dept of Education ( another defaulted student loan ), who referred my account to XXXX XXXX. The settlement process took one phone call and an hour of waiting before XXXX accepted my offer and processed my payment over the phone. XXXX XXXX is a collection company that I can actually trust. XXXX XXXX XXXX, however, is clearly run by criminals. I get no straight answers from them, their accounting is totally opaque ( they have yet to provide me with any explanation as to why I was overcharged, though I have asked them repeatedly to send me a detailed accounting history ), and they continue to insist that I owe more than I do, despite my informing them by phone, email, and fax that they have overcharged me, and demanding that they agree to my very fair and reasonable settlement offer of principal balance plus accrued interest, minus the {$1300.00} I have already paid toward my debt. It boggles my mind how difficult and exhausting this process has proven to be. In addition, XXXX XXXX XXXX has made a habit out of calling me multiple times a day, from numerous phone numbers, as well as calling my friends and family, to harass and intimidate me. The phone calls are especially disruptive during work and late at night. Their criminal activity has caused me undue emotional distress, and cost me countless hours of precious time as I struggle to fight their unjust practices and demand a fair settlement to get this debt taken care of once and for all.

The consolidated loan I 'm being ask to pay is predatory. Under duress, I agreed to consolidated XXXX loans when XXXX misapplied my payments ; put my financial credibility in jeopardy ; misrepresented material facts ; and then failed to properly disclose the terms of the consolidated loan. The Trap In XX/XX/XXXX, XXXX jeopardized my XXXX FICO score by misapplying my monthly payments. XXXX claimed they had the right to apply the payment for my XXXX Parent PLUS loans however they chose. When I sought a resolution, I was led to believe that consolidating my XXXX loans was the ONLY way to ensure that my payment would be applied appropriately. Questions : Please note : In all your responses please provide evidence to support your response. For example, if you say that you disclosed all the terms of this consolidated loan, I want to see indisputable evidence of precisely how you disclosed that information specifically to me. Also refer to the specific regulation that empowered all actions taken. 1. Did XXXX have the right to apply payments as they wished even when I enclosed XXXX issued payment coupons with each payment? 2. Did XXXX have the right to jeopardize my credit with their arbitrary application of payment? 3. Was XXXX telling me the truth when they said that loan consolidation was the only way to insure proper application of payments? 4. Did XXXX have the legal right to create a threatening environment so coerce me into flipping my XXXX loans into a consolidated loan? Note : I did not consolidate these loans because I could not make the payments, I did it to protect my financial credibility. Loan Disclosures At that time of consolidation, I had already made 18 payments on the XXXX loan ; 6 payments on the XXXX loan ; and 2, possibly 3 payments on the XXXX loan. I was unhappy that XXXX was proposing resetting the payment count to zero, and that the interest rate would become fixed. As compensation for what I was giving up, I was told that the first 24 payments would be interest only. XXXX FAILED to disclose that the number of payments on the consolidated loan would be 240 payments - double that of the loans being consolidated. I was shocked to discover this change in terms when I tried to reconcile my payment history in XX/XX/XXXX. That is when I recognized that I had been coerced into a predatory loan. Doubling the number of payments increased my cost of the money I borrowed by approximate 45 % - roughly {$17000.00}. I would not have agreed to such an outrageous increase in cost to protect my credit worthiness. I would have sought a more equitable and reasonable solution. Loan disclosure questions : 1. What are the loan disclosures XXXX was required to make and how precisely did they do that in the case of this loan? 2. You claim that I was properly informed of the change in the number of payments. Please provide indisputable evidence that I knowingly and without duress agreed to the increased number of payments. Telling me I selected MAX-2 Option does not answer my question. Other possible violations of my rights : 1. Contract of Adhesion - When attempting to resolve the conflict regarding this loan. I 've repeatedly been told that it 's impossible to change the terms of this loan, under any circumstances, for any reason, and that such changes NEVER happen. Please provide regulatory evidence that confirms this statement. 2. XXXX bullied me into deferments and forbearances even when I believed such action to be the wrong thing for me to do. 3. Full disclosure of fees, and interest rates. Payment history does not provide line items for fees. Terms of the XXXX Parent PLUS loans : total amt. borrowed {$26000.00} ; 120 payments ; stated interest rate ( s ) per phone conversation with XXXX XXXX per phone conversation in XX/XX/XXXX or XX/XX/XXXX is 3.13 %. In XX/XX/XXXX, I took out the first of XXXX Parent PLUS loans. After the third loan was funded and coupon books issued, I wrote one monthly checkfor all XXXX loans and included the three monthly payment coupons with the check. This procedure worked when paying for XXXX loans. With the third loan payment, XXXX XXXX began applying the payment to XXXX or XXXX loan ( s ) in spite of the three payment coupons. Their explanation : they had no way of knowing which loan I was paying and claimed the right to apply payments however they saw fit. To avoid late fees and the threatened misinformation to the credit bureaus, thereby adversely affecting my XXXX FICO score, I sought a better solution. Their recommendation : consolidation of my XXXX Parent PLUS loans. This was predatory and probably fraudulent for the following reasons : a lender/servicer fabricated need for loan consolidation ; undisclosed terms and conditions of loans e.g. doubling the # of payments from XXXX to XXXX ; incorrect beginning balance for the consolidated loan ; ambiguity as to interest rates on the Parent PLUS loans thereby allowing XXXX XXXX to covertly convert an interest rate of 3.13 % to 8.25 %. I would not have knowingly agreed to a loan that increased the interest rate from 3.13 % or even 6.54 % ( another amount referenced in a communication with XXXX XXXX ) to 8.25 %, nor would I have knowingly agreed to doubling the number of payments. Such behavior would have been inconsistent with my financial and business skills. Between XX/XX/XXXX and XX/XX/XXXX, I paid XXXX XXXX {$32000.00}, without missing a single scheduled payment. As you can see, I repaid all the money borrowed plus {$6200.00} in interest. XX/XX/XXXX, I refused to give XXXX XXXX more money. XX/XX/XXXX, on the advise of a bankruptcy attorney, I made one payment to XXXX XXXX and agreed to a deferment so that I could file for bankruptcy on other debt. Apparently, whoever looked at my Request for Administrative Review failed to even attempt to understand my Request by reading the XXXX pages of documentation I submitted. When I asked to speak to the person who had Reviewed my case, I was told that that would not be possible. My mother was diagnosed with XXXX XXXX and placed into a care facility in XXXX. My uncle and myself were designated as POAs in charge of her financial and health care. In XX/XX/XXXX, we received a notice in the mail that my mother had an outstanding student loan of a little over {$24000.00} from New York Higher Education Services Corporation that had gone into collections and that beginning XX/XX/XXXX, they would be taking out {$190.00} from her $ XXXX/month Social Security to pay the collections. Please note this is her only income. We immediately filed a XXXX and XXXX XXXX ( XXXX ) Discharge with the Federal Student Aid ( an Office of the Department of Education aka XXXX ) on XX/XX/XXXX, per instructions. The application was filled out completely and stated that while a decision was pending, no money would be collected from my mother 's Social Security and that a decision could take up to 120 days. That has not been the case, however, as money has been taken out every month since then and we are now going on almost 120 days with the application still " pending. '' At the end of XXXX we spoke with XXXX representatives asking why money was still being taken out of my mother 's Social Security while her application was being considered and they referred us back to New York Higher Education Services Corporation, stating they had sent two letters to stop collections on the account while the application was being processed. When I called New York Higher Education Services Corporation, it took me over 4 hours to get in touch with a live person who informed me that they could no longer see any paperwork sent to them because the account was in collections and that I would have to speak with the collections agency. They were extremely rude and unhelpful. When I then spoke to the collections agency, they informed me that all stop on collections must come from the originating loan provider, or the New York Higher Education Services Corporation. XXXX would also not provide a copy of the letter sent to the New York Higher Education Services Corporation or proof that it was sent at all. In the meantime, at the beginning of XX/XX/XXXX, my mother 's doctor received a request from XXXX for additional information regarding her XXXX XXXX diagnosis. Information that was already submitted with the initial XXXX discharge paperwork from her doctor, asking the same questions and for the same information that was previously submitted by her doctor in XX/XX/XXXX. This additional information request was under the guise that her application could not be processed without that information, but it was already included from her doctor with the initial paperwork provided in the original application. Now that this " additional paperwork '' has been provided ... for the second time ... the discharge paperwork has been send to the Department of Education for consideration in another 45-60 days. According to XXXX, this does not count against the original 120 day timeline because they " needed additional paperwork. '' While all this is happening. Money is still being withheld from my mother 's Social Security Benefits, her only source of income, and the primary source that pays for her XXXX XXXX care facility. Dear Sir or Madam ; This is a letter that I am writing to several parties as a means to bring clarity to my situation as well as dispute and resolve this. Which brings me to the most perplexing matter ; If my loans were with XXXX XXXX, paid off with XXXX XXXX in XX/XX/XXXX, and all records transferred to XXXX and they have no record of an outstanding debt then how did Higher Education, XXXX XXXX, and XXXX XXXX become a matter of concern? I asked for validation and verification. I was sent a typed document with mark 5 integrity token in the signature line. I was not sent my original documents as stated is required. How is it possible for me to be responsible for these monies? This is unfair and simply criminal. This debt is not mine. Please, please help me. My entire life is a stand still for matters that are not mine. This should be removed from my credit report and my name cleared. Please reach out to me with any questions. It took almost 10 years to be able to enter the rehabilitation program since NYS Higher Education Services would not agree to a reasonable monthly " good faith '' payment in addition to the 15 % of my salary they were already garnishing even after the rule were changed a couple of years ago. They would also periodically sell my loan to other companies such as XXXX who also would n't offer a reasonable payment. When I offered a affordable figure they denied it again even after providing my financials AGAIN so I threatened legal action as it benefits them to keep a loan in garnishment. They make THOUSANDS in fees and not one penny is paid toward the principal. I have been paying this loan for 20 years ... yes 20 years and most of what I have paid has not been applied to the garnishment. ( The loan is now MUCH MORE than it was when it began 20 yrs ago ) This finally made them agree to the monthly amount I suggested and they advised in 5 months of payments they would end the garnishment. So 5 payments were made and on XX/XX/XXXX I was told papers would be sent to my employer advising them to stop the garnishment. 4 phone calls,3 customer service people and a supervisor and it took 6 weeks to actually get that letter faxed. The letter was then dated on the day it was sent ( XX/XX/XXXX ) instead of dated XX/XX/XXXX like it should have been. The garnishment was never stopped and now I ca n't get an answer to when they will repay the {$800.00} or so dollars that was garnished and should n't have been. They are not in compliance with the program. NYS HESC is possibly the worst lender to deal with. I 'm not sure how any of this is legal and why the government allows students to be XXXX this way. This loan will indeed outlive me. I am currently waiting to see exactly how long the reimbursement will take. It 's a bad joke really ... how many NYS HESC employees does it take to fax a letter??? ... answer:4. Yes, 4 people needed to be involved in printing and faxing a letter. We are expected to jump through all their hoops and comply with the program or we get kicked out and continue to live with decimated credit scores while they sit back and collect fees.

In XXXX I defaulted on my student loan due to financial difficulties. In XXXX of XXXX, my paycheck was garnisheed. I continued to have payment deducted from check consistenly until XX/XX/XXXX. During these 8 years, I contacted the representative from New York State Higher Education Services on many occasions to see how I could rectify my situation, he was always XXXX XXXX XXXX and did not provide any assistance, his only response was always : " you will have to pay the balance of the loan in full '', I was not in a financial position to do so. In XXXX of XXXX I called him to let him know that I was changing employers and did not want to transition with a garnishment with my new employer. We made arrangements for me to send payments directly, I did so from XX/XX/XXXX- XX/XX/XXXX when the student loan moratorium was in effect. At no time was I told that my loan was in a default status for over 10 years. In XXXX I found out about the PSLF loan forgiveness program and submitted an application. It is at this time I was told that my loan was in default and would have to " consolidate '' to submit a PSLF application. I followed the instructions, consolidated and submitted the PSLF application. I received notification that my request was denied because they would not approve the payments made for over 10 years since the loan was in " default. '' I don't think it is fair to be penalized because the lender did not provide information or assist in having the loan reclassified since I made regular payment every month for over XXXX. This is not the way to treat people who are trying to do the right thing. I have filed a reconsideration that these payments be counted. I met all the other requirements for PSLF, working for a non-profit and currently for a public entity. I believe the NY State Higher Educsation Corp representitive 's name was " XXXX. For the past ten years, I've made the biggest mistake of ever attending XXXX due to a suggestion of going there to finish my XXXX and get an XXXX XXXX degree. I attended one semester, and realized that the school wasn't true to it's mission when I was forced to take out student loan after student loan, while taking classes that had nothing to do with what I wanted to major. I left XXXX one semester after, and transferred to a XXXX college. XXXX had other plans to damage me unfortunately. I couldn't get any credits transferred to a XXXX XXXX college I went to, so I started from the beginning. No sweat, only one semester of work but still was some good core classes. The loan providers of XXXX wanted to start taking money out of me, threatening me with all sorts of actions. This forced me to take a break from school to work and make some money to repay that. The final coffin was transferring to a four year, because after I submit my application, I was left in limbo with no words or anything. Was told to re-apply a year later, a ton of fake excuses, and all this while still XXXX 's many loans wanted to linger and damage me even more. HESC ( where my loan currently is ) has tried plenty of times to garnish my wages, to have me pay MUCH more than what I can even currently budget for. Refuses to ever work with me, and pretty much has destroyed every aspect of my life credit/money wise. All this while I just heard that XXXX closed it's doors, yet I'm stuck paying so much money cause the school claims I was there for a full year which is a huge lie. I really don't know what to expect from this, I've pretty much given up. But it still leaves a huge bad taste in my mouth knowing I never had a traditionally college experience due to my mis-education while trying to receive an education.

NYSHESC has not provided me with a detailed accounting history of my account, which I demanded in my previous complaint, as well as in my letter to the Governor, which I copied to NYSHESC. NYSHESC is also continuing to deny that they have illegally overcharged my account in XXXX of XXXX, adding over {$1300.00} to my balance, above and beyond the principal, interest, and $ 1,200+ collection fees, which they did as they concurrenty applied a payment to my account from my garnished XXXX New York State taxes. NYSHESC is continuing to refuse my very reasonable settlement offer, which is to pay the full principal balance, plus interest accrued, minus the adjustment of payment applied from my XXXX New York State tax refund. I sent NYSHESC and XXXX two 20 pages faxes detailing my offer, and my financial hardship. Rather than work with me after I have so carefully compiled and supplied them with extensive documentation for my case, they choose to blow me off and continue gouging me, adding insult to injury. This is the first year I have been in any way shape or form able to begin settling my debts, and I am fighting for my life to get on my feet financially. What I do not appreciate from this predatory and dishonest company is a kick in the face while I'm down. I fear that NYSHESC will only continue to illegally add money to my account that I do not owe indefinitely. And so at this point, I am consulting with a lawyer, and spending the money I hoped to save for my daughter 's XXXX presents, to avoid a lifetime of indebtedness to a company that exhibits no care or concern to help me settle my debt.

they claimed i defaulted on my XXXX XXXX loan last year. The defaulted loan was transferred over to the guarantor, the New York State Higher Education Services Corporation. They agreed to put me in a payment program, at the conclusion of which, the loan would be taken out of default status, and they would give the loan over to another private financial institution for me to begin paying again. The acknowledgement of debt agreement i signed in XX/XX/2018, has a total current principal and interest with collection cost of {$63000.00}. My total balance as of XX/XX/2018, is {$79000.00}. XXXX. I will try and include documents to this effect. I have made all of my payments as prescribed under the agreement by the due dates specified. For an agency or institution to charge collection fees or interest in excess of {$15000.00} is ridiculous, if not criminal. My collections representative at NYSHESC and her manager say this ( marking up the amount of the loan so dramatically ) is something they have to do anytime they take over a defaulted loan but this sounds very suspect to say the least. I should not be subject to an outrageous financial practice such as this. Please help me stop this by having NYSHESC bill me based off the correct and original loan amount of XXXX, instead of the random, way-overblown amount that they used, which currently results in a balance of {$79000.00}, after just 7 months of being on the payment program. I took out two loans from New York State Higher Education Services Corporation ( HESC ), one for the school year XXXX, one for the school year XXXX. I was allowed a forbearance for both loans for several years. When the loans came due, I contacted an HESC representative to arrange monthly payments. At no point did this loan servicer inform me that I had any alternative other than a payment that was close to half of my entire monthly income. I felt as if I was being pressured by a debt collector, not a loan servicer, and it scared me. There was absolutely no mention of any income driven plans to stay out of default. At that time I didn't know that an income-driven payment plan was an option at all. I could not afford the payment so I went into default. HESC moved quickly to get whatever money they could. They employed a debt collector ( Performant ) and pursued every legal angle. They took several tax returns. They took several partial payments from me from XXXX to XXXX with no accounting of them. Then they started to garnish my paycheck. At no point in my dealings with HESC was I offered an income-driven plan. I have since learned how to move my loans away from them, and am relieved to never have to deal with them again, but I argue that much of this debt would be paid off, and, quite frankly, I would have never gone into default in the first place, if HESC had informed me of my repayment options.

I have recently bellied up in a business endeavor over the summer which is leading me to have to proceed in filing for bankrucy. Both business and personal. I have lost everything this summer and barely can stand on my own two feet right now. My federal school loan collectors have called me as much as 27 times one day. I have spoken to them numerous times that I am unable to afford and pay my school loan debt at this particular time. Unfortunately, the harassment and calls have gotten even worse. I have applied for FAFSA as I am reapplying for college to finish my degree. I am o the cusp of filing for bankruptcy and I need these people to please leave me alone til I can get back on my feet. I have spoken with an attorney that has advised me to record and collect the daily harrassment, as well as recording calls ( when I do answer ) and emails that deem in an almost threatening kind of manner. My credit has been absolutely destroyed by defaulting on my school loans. I feel taking a federal loan for the prospect in obtaining a degree was a burden that has completely destroyed the next decade ( 7 years ) of trying to get a mortgage, or even to attempt to get a car loan in the near future. I received a letter from NYS higher education services corporation that a loan was submitted to the collection company XXXX for a loan taken out on XX/XX/XXXX that was {$3000.00} which I already paid along with 2 others amounting in {$19000.00} and {$27000.00}. I XXXX XXXX XXXX filing a complaint with the Consumer Financial Protection Bureau against a state agency that is operation outside the legal requirements of the Fair Debt Collection Practices Act. In XX/XX/XXXX, I attempted to correct the last status of a student loan that was consolidated and paid off as of XX/XX/XXXX. XXXX conducted their " investigation '' and updated my credit report incorrectly ... stating that I missed a payment as of XX/XX/XXXX. They are trying to collect on a loan that they do not own. Private student loans can not directly garnish wages without a judgment. So, for a private student loan servicer or collection agency to garnish your wages, that entity must first sue you and obtain a judgment. Guaranteed student loans ( e.g. federal, state, or non-profit guaranteed loans ) can directly garnish your wages without a judgment. there are no Judgment against me.

I have provided ny state higher education with proof that XXXX XXXX in XXXX NY went bankrupt. Hundred of former students of XXXX XXXX XXXX NY are eligible for part of a XXXX XXXX settlement regarding their student loan. The settlement was reached between a coalition of 13 attorney general, federal agencies and XXXX XXXX XXXX the firm handling loans for the former XXXX college which own XXXX XXXX. As part of the settlement anyone who borrowed and we're attending XXXX XXXX when it closed or defaulted will receive a discharge or 55 percent discharged. I fell under that. I contacted Borrowers defense they had me put in a application to apply for discharge until they make a decision on the application they put my loan which is in default status in forbearance status on XX/XX/2019. I'm trying to get them to change my status from delinquent to current status on my credit report since I'm in forbearance until Borrowers defense make a decision. I don't think I should be paying on a loan to a school that went bankrupt and made students promise of getting a good paying job. I couldn't even use there credit at other schools.

On XX/XX/XXXX, I received information that I still have 80 payments left before I am eligible for 20 year loan forgiveness. That time frame did not seem correct to me. I tracked my student loan journey to the New York State Higher Education Services ( HESC ) and was informed by them that a payment was not posted to my account in XXXX, when at that time they were the loan servicer and they were also garnishing my wages from XXXX. Please see complaint XXXX for background. The credit company listed in previous complaint would not answer my attempts to resolve debt. When contacting the company, the representatives were aggressive, rude, hostile and argumentative. They do not give you an opportunity to speak and strong arm you throughout the entire conversation. Specifically the representative who goes by the name of Ms. XXXX. They dictate the payment amounts and dates and are not flexible to your financial situation. They constantly threaten me with garnishments and vulgar language.
