In XXXX of XXXX, we executed a Note and Mortgage for the refinance of our property located at XXXX XXXX XXXX XXXX, XXXX XXXX, SC XXXX. The salient terms of the loan documents are dated : XX/XX/XXXX for the principal amount of {$340000.00} at the initial rate of 4 %, with a maturity date of XX/XX/XXXX. Until the latter part of XXXX, the loan was serviced by New York Community Bank ( NYCB ). In XXXX, XXXX, we received a notice that as of XX/XX/XXXX, our loan would be serviced by XXXX XXXX XXXX ( XXXX ). ( Exhibit A ). The last paragraph of that notice stated, If you are currently in loss mitigation, your loss mitigation will remain active. Any documentation will be transferred to XXXX XXXX. I contacted NYCB concerned about the modification and they advised XXXX would stand in their shoes and there was no need for concern. Before the trial payments began, we were paying a total monthly payment in the amount of {$2000.00} which included principal, interest and escrows. In XXXX, I applied to NYCB for a loan modification. Finally, by letter dated XX/XX/XXXX, we received their offer for a loan modification ( Offer ) ( Exhibit B ). We accepted the terms in a timely manner. The letter outlined the terms of the modification in that four trial payments were to be made, each in the amounts of {$1600.00}. No changes were to be made to the original loan documents other than the adjustable rate mortgage was to be converted to a fixed rate. The Offer also stated, in part, Once your loan is modified, your interest rate and monthly principal and interest payment will be fixed for the life of your mortgage. No fees or expenses were to be charged to us. The purpose of the Modification was to lower our monthly payments. The Modification allowed us to save {$410.00} per month. The Modification Package ( Exhibit C ) had a cover letter from XXXX. The first sentence stated, If you comply with the terms of the required Trial Period Plan, we will modify your mortgage loan ( Exhibit D ) NYCB quoted the new payment amount at {$1600.00}. XXXX figure was higher - {$1600.00} ( {$1200.00} ( p & i ) plus {$410.00} ( escrows ). There was nothing in the Offer about extending the maturity date. After the closing however, I discovered the maturity date had been extended by 16 years. The mortgage payment had not been re-amortized over the now 46 year term. In fact, it appeared the only reason to extend it by the additional 16 years, was to require the Borrower to make an additional XXXX payments for a total amount of additional debt of {$390000.00}. I was extremely concerned over this unilateral change by XXXX. ( Exhibit E ). See Exhibit E-1 for the first two pages of the original Mortgage ( maturity date XXXX XXXX ). XXXX returned the pages of the Modification Agreement showing their acknowledgement for the notary. The original was recorded among the Land Records of XXXX XXXX, SC on XX/XX/XXXX in Book XXXX, Page XXXX, Instrument No. XXXX. ( Exhibit F ) On XX/XX/XXXX, I received a form letter from XXXX stating they were unable to approve our request for hardship assistance due to Delinquency Guideline Not Met for Loss Mitigation Options. ( Exhibit G ) I immediately called XXXX and spoke to a number of different people. No one could give me any information, and I kept getting passed around. I spoke to XXXX ( XXXX ) who directed me to write an email to request that the trial period be restarted, and further state that I was delinquent for 90 days. I told her that was not true and I could not write that. The last person I spoke to was XXXX XXXX XXXX ). I told her the requirement that a borrower had to be delinquent, was changed in XXXX, and that all that was necessary now was that the borrower had to be in danger of falling behind on the mortgage payments. Further, I advised that the Modification Agreement had been recorded in the Land Records. She told me she had to report this information to Underwriting, and that I would receive a call back on Tuesday ( XX/XX/XXXX ). No one has ever called me since then. I called NYCB and was told legally they could not help me at all. I was not allowed to speak to the Loss Mitigation Department, and was forced to speak to Customer Service. Under the federal Rules, NYCB is under a statutory requirement to contact XXXX and provide any information to rectify the situation. XXXX is also required by statute to have policies in place to ensure that it honors the terms of the Offer originally extended by NYCB. When it became clear no one was going to call me, I wrote three letters ( Error Resolution/Information Request ) to XXXX. One was to advise that my real estate taxes had not been paid and were now in the penalty phase. ( Exhibit H ). The second was to request a copy of the Note ( Exhibit I ) ( I had to write a second letter because XXXX sent me the Note, but it was not endorsed to them ). And finally, I wrote a long letter dated XX/XX/XXXX, detailing questions and corrections for XXXX failure to acknowledge the Modification Agreement, mis-application of payments, extended maturity date to 46 year total, fees charged without notice or explanation, failure to provide monthly statements, etc. ( Exhibit J ). I have not heard from XXXX, however, they have sent me information that is troubling to say the least. The records of XXXX and their submissions to me during the last month, show they are continuing on with the adjustable rate terms and are completely ignoring the Loan Modification, even though all the steps were accomplished to consummate the transaction. On XX/XX/XXXX, NYCB provided the disclosure for changes to the mortgage interest rate and payments on XX/XX/XXXX. They showed the new payment was {$1900.00} ( without reference to the modification ), slightly less that what we had been paying ( Exhibit K ). XXXX sent the same disclosure dated XX/XX/XXXX, showing a higher payment in the amount of {$2100.00}. ( Exhibit L ). The Modification converted the adjustable rate terms to a fixed rate. Our Loan Overview dated XX/XX/XXXX, shows, notwithstanding the fact that all loan payments have been made in a timely manner, an amount due of {$4500.00} with an interest rate of 4 % and a term of 360 months. They are completely ignoring the changes of the Modification Agreement. ( Exhibit M ) XXXX Escrow Account Disclosure Statement dated XX/XX/XXXX, shows a surplus of {$360.00} with a note stating Due to the delinquent status of your account, your surplus will be retained until the account becomes current. ( Exhibit N ) In addition, they state they are a debt collector attempting to collect a debt, however, they have not sent a 5 day notice and other required information under FDCPA. I fail to see why the Lender would make it a condition of bringing the loan current before it would refund escrow surplus. It is a violation of the Rules to condition action by the Lender on payment of the loan. It isnt their money and I suspect no interest is being paid to us, but I suspect the Lender is making money by refusing to refund it. Notwithstanding the fact that NYCB has stated our account will remain open, they have made it impossible for me to contact them. Legally they are responsible for errors up to one year after transfer of the loan. Under the Dodd-Frank Act, it is unlawful for any provider of consumer financial products or service to engage in any unfair, deceptive or abusive act or practice. In this case I submit both NYCB and XXXX are in clear violation of this Act. The outrageous actions of XXXX have caused substantial injury to us ; the injuries were not reasonably avoidable and the injuries are not outweighed by countervailing benefits to consumers or to competition. The stress created by this whole situation has been overwhelming. Just the act of secretly extending the maturity date for a total of 46 years seems to satisfy any definition for lack of fairness, deception and/or abusive practices. And we have been left with little alternative to protect ourselves. Neither NYCB or XXXX will acknowledge us as borrowers who have been taken advantage of. In addition, so may borrowers have been substantially injured in the transfer of loans in loss mitigation, there is already a presumption to use extra care. In light of the information readily available from the internet, I have to ask what in the world was NYCB thinking to even deal with XXXX. Not surprisingly, I am reminded of a XXXX case where Freedom was found guilty of violating the New Jersey Consumer Fraud Act. There, the borrower, a XXXX XXXX XXXX woman, sued XXXX after she was charged {$11000.00} to refinance her mortgage. According to the facts in the case, the {$63.00} reduction in her monthly payment would have taken more than 5 years to amortize against the additional fees she incurred to lower the interest rate. The Court, in its decision, took account of the self serving acts of the lender and recognized the transaction was effectively one sided, for the benefit of the lender. The cases by elderly borrowers are too numerous too list, so why is NYCB exposing another elderly couple to the outrageous actions of XXXX. If that isnt persuasive enough, that decision followed closely on the heels of a settlement between XXXX and the US Department of Housing and Urban Development over claims that XXXX discriminated against loan applicants with XXXX. According to the court documentation, XXXX used one set of underwriting criteria for mortgages to people with XXXX. Loan applicants without XXXX were scored according to a different and easier criteria. XXXX paid an incredible {$110.00} XXXX in settlement of their actions. And these are just two of the complaints and cases that I found, all requiring XXXX to pay exorbitant compensatory and punitive damages to compensate for their outrageous and illegal actions. I am just a consumer, but NYCB is in the mortgage business. They know or should have known how XXXX conducts its business. And the amount of cases by the elderly alone is astounding. NYCB had absolutely no right to deal with companies with such dishonorable reputations. If they made the decision to sell loans to XXXX, they should have monitored every aspect of the transaction. When I contacted them, it should have been a huge red flag for them to intervene. If XXXX written procedures dont say when a problem arises, do not call or return the call to the customer and do everything you can to work against closing the loan, then they are not correct. NYCB should work on post sale review and communication with TransfereXXXX, and apply whenever possible common sense. Raise the bar just a little ; you are working for honest people who may, only have their home to show for a lifes work. How would you feel if someone treated your grandmother with such disrespect?

I believe we are being targeted for filing a complaint with the Consumer Financial Protection Bureau. We 've been lied to by NYCB representatives, our loan payoff submitted electronically from our bank has been placed on a 10 day hold, and when contacting NYCB representatives, we 've been given the run around, lied to, and told to 'stop recording ' when informing them we were recording telephone calls. Yet in every call we made there is a notification that they are recording our calls and they have never asked consent just a notification. We have a discharged HELOC with New York Community Bank. We are at the end of our rope financially and emotionally dealing with this situation. NYCB illegally sent us a letter in XX/XX/XXXX saying they were calling our loan and the full amount was due in XX/XX/XXXX. They then changed their minds and sent us a letter that the loan was due in XX/XX/XXXX. We were denied any home retention options on the discharged HELOC/Lien and denied our two attempts at a payoff request. NYCB stated they will only accept full payment. The only way my family can stay in our home is to pay in full? They offered no home retention options or alternatives. They refused our offers for a settlement of the discharged HELOC that they 'charged off ' years ago. Big financial banks getting to double-dip and profit and get tax kickbacks on the backs of families and struggling taxpayers. We were able to scrape together the funds to pay the discharged HELOC in full. We spoke with NYCB representatives several times on XX/XX/XXXX.We requested a payoff letter last week and still had n't and to date still have not received it. We wanted to resolve this as quickly as possible. NYCB representatives told us we could send in payment by EFT directly through our bank and it would be ok. They quoted us a final payoff amount over the phone on XX/XX/XXXX they also gave us the address to input to our bank. They never explained any difference between bill pay and other secure forms of payment. NYCB representatives gave us the payment address for the bill pay, which was a totally different payment address than we 'd been using for our monthly payments. ( Why would they use a different payment address than what people are used to? To confuse us the consumers, to hope we make mistakes in entering it, to delay the process? ) We submitted and sent payment by EFT through our bank for the entire payoff amount on XX/XX/XXXX. We called NYCB on XX/XX/XXXX and a representative confirmed they received the payment and that it was placed on 'hold '. We called another time on XX/XX/XXXX to clarify why the payment was on 'hold ' and were told it 's just a formality and that " it 's just a waiting game now. '' We were told it would be 30-45 days to process the payoff. Today, XX/XX/XXXX, we called NYCB again to get the status of our payoff payment. We were told that the payoff was on a '10 day hold '. This seemed wrong. How can a bank put a bill payment through EFT on hold for 10 days? We called our bank where the payment came from and they confirmed the payment was submitted eletronically, not by 'check ' and that the money was in NYCB accounts. Our bank said they were 'surprised ' that NYCB had put the payment on hold and said they would do whatever needed to assist. NYCB 's own documents state that they only put payments on hold that are by personal check. ( See Attachment NYCB Release Letter ) We callled NYCB supervisor today, XX/XX/XXXX, after hearing this from our bank. We wanted to record the call to be sure we were hearing accurate information. One call to NYCB attached below shows how unfriendly and unsupportive they are. I only wanted to be transferred to the supervisor and the NYCB representative told me to 'stop recording '. He was so rude! Completely unsupportive. ( Attached XXXX XXXX ... ) We 're just trying to payoff a discharged HELOC and we get nearly yelled at, rudely talked to by the bank? This is n't right. So, now we come to the fact that NYCB put our payoff payment of $ 41k+ on a 10 day hold from an EFT that went through in 24 hours. How can this be legal? We tried calling the NYCB supervisor today, XX/XX/XXXX and were given the run around. ( Attached XXXX XXXX ... ) We were told the supervisor 's supervisor spoke with the manager that put the hold on the payment and they need 'proof ' that the funds were out of our account. This is what 's crazy to me ... the money is already in their account. Nothing more to say. Why would the consumer need to take all of these extra steps to 'verify ' and show 'proof ' that the payment is legit ... it 's in their accounts! This policy needs to be changed immediately. Consumers do not need to be treated like this. Bullying by big banks is bullying and it does a diservice to all customers. We were told that all the supervisors were not in, yet the supervisor we spoke with was clearly getting advise from someone that knew what they were doing. Throughout the call, she would place me on hold and return with some new information like she had spoken with her supervisor. Then, I ask to speak with her supervisor and she says 'she 's not in her office '. Of course she is n't, she was right behind her giving her instructions and refusing to speak with me. Lies!!! The icing on the cake was when I asked if I was president of the bank could I get the hold removed and I said I know I know I am low on the totem pole, and she, XXXX, agreed with me. Not right on any level. So, my complaint is : 1. NYCB illegally sent a letter on XX/XX/XXXX requesting the discharged HELOC be paid in full. 2. NYCB has taken punitive steps to punish us because we filed a complaint with the Consumer Protection Board. All pressure to payoff the discharged HELOC, misinformation, payoff put on 'hold ', and lies happened after we filed our first complaint. 3. NYCB has an illegal policy to place 'all payments received by EFT ' on a 10 day hold ( clearly stated by NYCB supervisor in the attached XXXX XXXX ... ) 4. NYCB representatives are rude and mean to customers ( attached XXXX XXXX ... )

NYCB and XXXX gave conflicting information about my balance during the transfer process and thwarted RESPA Mortgage Guidelines. As a result, I suffered damages, distress and my good credit and peace-of-mind was damaged. -- -- - See letter to NYCB and XXXX below I am writing to pay my balance and to express my continuing dissatisfaction in your handling of my HELOC during the transfer process. Frankly, I am amazed by the seeming intent to destroy my good credit. Acting on the advice of counsel, a copy of this letter along with a complaint will be forwarded to the Consumer Financial Protection Bureau ( CFPB ) and Florida Office of Financial Regulations and all the credit agencies. Here is another attempt to ( a ) pay my loan balance and ( b ) to request that all derogatory information reported by your institutions be removed from my credit reports. Payoff Loan Balance Here is a check for {$9500.00} sent to XXXX to apply to my balance. Because of the conflicting, misleading and false information presented by your institutions expressed in the background below, I have lost confidence in your ability and desire to follow state and federal guidelines. At the end of XXXX, my loan balance was {$10000.00}. The historical minimum payment was {$50.00} before NYCB decided to close the HELOC. Since then, I have made several electronic payments. Two were rejected by NYCB with a request for me to pay the full amount. Subsequently, four payments, including attempts to pay the full balance were made to XXXX totaling {$11000.00}. Two were rejected and two accepted. While that is happening, I received two default letters to pay a minimum due of {$75.00} or face foreclosure. Despite over 10 calls, I am no closer to understanding why over {$1200.00} of my payment remained unapplied while I am asked to pay {$75.00} to avoid foreclosure. Because, I had the audacity to demand to speak with a supervisor, I was told to shut up or my call would be terminated. No supervisor returned my call despite multiple promises that one would. In addition, I was told that I had called to express relief for financial hardship. I never did. When I suggested that the representative may be confusing my file with someone else, the representative was adamant that she could prove it since my calls were recorded. All my calls to your institutions were made from XXXX. Please preserve those records for possible discovery. Remove Derogatory Information The below background will illustrate why any derogatory information on my credit report were caused by NYCB and XXXX confusion during the Loan transfer process. Background XXXX : XXXX XXXXXXXX XXXX opened HELOC XXXX : XXXX XXXX closed line of credit. I subequely paid off the balance a year later with no adverse effect to my credit. XXXX : I refinanced my fist mortgage loan ( not related to this issue ). That loan was sold to NYCB. ( NYCB acquired XXXX XXXX XXXX ). XXXX : NYCB underwrote new HELOC. It is unclear to me why NYCB instead reopened the XXXX HELOC previously closed in XXXX by XXXXXXXX XXXX. XXXX : NYCB closed HELOC while all payments were current. Relying on the precedent set in XXXX, I increased payments to payoff balance ( {$500.00} instead of {$50.00} minimum ). XX/XX/XXXX : NYCB transferred both mortgages HELOC and my first mortgage. First mortgage was to XXXX XXXX ( not an issue in this case ) and HELOC to XXXX XXXX XXXX ( XXXX ). [ XX/XX/XXXX : NYCB accepted payments and forwarded payment to XXXX XXXX ] XX/XX/XXXX : NYCB rejected two payments for {$500.00} to pay down my HELOC. XX/XX/XXXX : NYCB provided XXXX loan document as evidence of HELOC opened in XXXX. XX/XX/XXXX : I made provision to pay off the HELOC. XX/XX/XXXX : NYCB wrote to say the HELOC was transferred to XXXX. XX/XX/XXXX : Several calls made to XXXX. Account not viewable online. XX/XX/XXXX : two payments made to XXXX ( XXXX and XXXX {$630.00} and {$630.00} ). XX/XX/XXXX : XXXX wrote to confirm transfer from NYCB. XX/XX/XXXX : XXXX wrote to indicate that credit line was frozen and no additional draw was possible. XX/XX/XXXX : XXXX wrote notice of default and intent to foreclosure for minimum due of {$75.00}. XX/XX/XXXX : Multiple calls to XXXX. Obtained confirmation payments received and applied and loan current. XX/XX/XXXX : XXXX received and rejected online payment of {$630.00}. XX/XX/XXXX : XXXX received and rejected online payment imputed to pay off Balance of {$9200.00}.

I had a checking account with New York Community Bank ( NYCB ) with a small balance of {$0.00}. On XXXX/XXXX/2016 I made XXXX transfers into my NYCB from another financial institution for {$50.00} and {$3000.00}, bring my balance to {$3000.00}. This was for XXXX checks for {$25.00} each as well as a {$3000.00} payment to a credit card. The funds arrived in my XXXX checking account on XXXX/XXXX/2016, and I scheduled an EFT to my credit card company for XXXX/XXXX/2016 in the amount of {$3000.00} using NYCB 's online banking service. The EFT went through on XXXX/XXXX/2016 as requested, bringing my account balance down to {$50.00}. For some reason, NYCB then proceed to make another {$3000.00} EFT payment to my credit card on XXXX/XXXX/2016, causing my account to have a negative balance of - {$2900.00}. This second EFT payment was not authorized, requested or transacted by me ( I can only speculate that this was caused by a transient fault in NYCB 's computer systems ). XXXX called my home on Saturday XXXX/XXXX/2016 and left a message on my answering machine as I was not at home. When I attempted to call back Saturday afternoon the branch had already closed. At this point I had no indication that there was any problem. I logged onto the NYCB online banking website, saw the unauthorized second transaction, and immediately called NYCB 's XXXX Customer Contact Center and spoke to a NYCB representative. The representative insisted the transaction was legitimate, NYCB could not reverse it, and I would need to contact my credit card company to recover the funds. I then called my credit card company and was informed that they issue refunds by paper check only. I asked them to send me a check refund. The following Monday, XXXX/XXXX/2016, XXXX reversed the transaction, despite the representative 's insistence that they could not, bringing my account balance back up to {$50.00}. However, NYCB also charged me a {$36.00} insufficient funds fee, bringing my balance down to {$14.00}. At this point, XXXX of my XXXX checks for {$25.00} was presented to NYCB, which was denied as I now had insufficient funds due to the first insufficient funds fee. This incurred an additional {$36.00} insufficient funds fee to me, as well as a fee to my payee from their financial institution for the returned check. My balance was now negative again, - {$21.00}. Despite my calls to XXXX informing them I did not initiate or authorize the second transaction, NYCB then proceeded to attempt payment to my credit card company a SECOND time, resulting in a third insufficient funds fee of {$36.00}, taking my account down to - {$57.00}. My attempts to deal with NYCB and get this matter corrected have been a comedy of errors on NYCB 's part. On Saturday, XXXX/XXXX/2016, I visited NYCB 's branch located at XXXX XXXX XXXX in XXXX, NY. After speaking briefly with a customer service representative, I worked with XXXX, the Assistant Branch Manager to get this resolved. XXXX collected all the pertinent information, including my description of events as communicated above. He promised to call me during the week XXXX/XXXX/2016 to XXXX/XXXX/2016 to update me on the status. I did not hear back from XXXX and subsequent phone calls to the branch resulted in notice that XXXX was unavailable or not in. During this time I had been receiving daily letters in the mail ( sometimes multiple letters in a day ) from NYCB demanding I rectify the situation. I visited the branch a second time Saturday, XXXX/XXXX/2016, after receiving a letter from a collection agency. Upon visiting a second time, I was informed that XXXX is no longer employed with NYCB, and no one was aware of my situation. I spoke with the Branch Manager, XXXX, repeated the description of events again, and was assured by XXXX that this would be rectified and he would call me on Monday, XXXX/XXXX/2016. It is now XXXX/XXXX/2016, and i have not heard from XXXX. As before, I am told XXXX is not available when I call the bank branch.

My complaint is with NYCB.Com aka XXXX XXXX XXXX aka New York Community Bank. This is the MOST ABUSIVE, DECEPTIVE, WORST online bank. The problems include, but are NOT limited to the following : 1 ). The bank FALSELY advertised 1.14 % interest on money market accounts. 2 ). The bank FALSELY advertised an " easy application process. '' 3 ). The bank used deceptive advertising and bail and switch tactics to lure prospective customers. 4 ). Once the application Process begins, it is extremely lengthy, difficult, and demands days and days of sending in more and more proof of identification via regular physical mail, which is dangerous to the consumer, and many other documents for the approval process. 5 ). Once the consumer is approved and deposits money, the bank REFUSES TO ACTUALLY GIVE THE FULL 1.14 % ADVERTISED AND FALSELY " PROMISED '' INTEREST. External transfers take FAR longer than seven busine ss days and cause problems with money reaching its destination promptly and thus causes residual trouble with other situations for the consumer. 6 ). Online bill pay is an exercize in futility, as any customer with XXXX separate accounts and who correctly specifies and signs up for Bill Pay of specific bills to COME FROM ONE SPECIFIC ACCOUNT, WILL SUFFER THE CONSEQUENCES OF INCOMPETENT STAFF AND TRULY XXXX BANKING SYSTEM THAT WILL, AT ITS OWN DESIRES, PAY THE BILL FROM THE OTHER ACCOUNT AND CAUSE MANY PROBLEMS BY TAKING MONEY FROM THE OTHER UNAUTHORIZED ACCOUNT ( INSTEAD OF THE SPECIFIED ACCOUNT ) TO PAY THAT BILL ( THUS CAUSING THAT ACCOUNT TO RUN LOWER THAN EXPECTED ON FUNDS AND CAUSE YET MORE PRO BLEMS ) 7 ). For the consumer who has erroneously trusted the advertisement and FALSE " promises '' of this bank and thus fallen victim, with this troublesome bank and its incompetent, dishonest employees and management staff, any of the above problems that the customer DARES to question ( WHICH MUST ONLY BE QUESTIONED VIA THE MESSAGING SYSTEM, AS THE STAFF ARE TOO INCOMPETENT AND DISHONEST TO REPLY VIA PHONE CALL ), THAT UNFORTUNATE CONSUMER WILL THEN BE OUSTED FROM THE BANK, WITHOUT WARNING, AND BE SUBJECTED TO HAVING HER MONEY HELP HOSTAGE, A ND MEANWHILE BE DENIED ALL ACCESS TO HER ACCOUNTS, AND THEN BE FORCED TO WAIT FOR A SO-CALLED CHECK VIA OLD FASHIONED PHYSICAL MAIL!

All of this happened to me.

I dared to question these repeated problems that this corrupt bank caused me. Then, just this morning, without warning, I received a telephonic message form " XXXX '' ( st aff refuse to disclose their last names due to the nature of their corrupt tactics against customers ) that my accounts had been shut down, closed, and that this bank had ended its " relationship '' with me. I was denied access to my accounts and my money had been virtually stolen from me, held hostage, and I was told to go XXXX myself -- ALL WITHOUT A SHRED OF EXPLANATION. When I called her back, she refused to give me any reason.

My XXXX XXXX aka New York Community Bank aka NYCB.COM and its s taf,, including but not limited to XXXX XXXX and XXXX and the others, is the MOST CROOKED, DECEPTIVE, REPULSIVE bank to ever do any business with and fall victim to for any reason. Do NOT ever do ANY business, for ANY reason, with this bank.HIS B ANK FINDS VICTIMS, NOT CUSTOMERS. Today, there are so many more and more credit unions and other online banks that are honest and hard-working and willing to treat customers at least decently. I have an existing home equity loan XXXX that originated and was serviced by NYCB up until XX/XX/XXXX. NYCB had taken action to call the Note and I submitted a loss mitigation application dated XX/XX/XXXX and was in constant communication with, and provided prompt responses to every request for every additional information necessary for the loss mitigation evaluation. I continued submitting timely monthly payments as was my pattern as my loan had never missed a payment during my loan history and continued until NYCB returned my payment made on XX/XX/XXXX, which the modification person I was in communication with ( XXXX XXXX, NYCB ) at the time, had advised me would happen because such are the terms of calling the Note, and nothing but the full balance would be accepted ( as also stated in NYCB letter dated XX/XX/XXXX ). I continued to remain in constant contact and requested weekly updates and from the submission of my loss mitigation application and was told there would be no credit reporting on my loan until the bank had reached a loss mitigation decision and then the loan would report as modified and other such relevant credit status. XXXX XXXX. ( @ NYCB, Tel # XXXX ) was made my single point of contact and in a phone call on XX/XX/XXXX at approx XXXX she advised that NYCB is developing a specific loss mitigation option for heloc loss mitt applications which would include converting the loan to a fixed term with the interest rate that was in effect as of the date of the loss mitt application. The loan we subsequently served transferred to XXXX XXXX XXXX ( XXXX ) XXXX/XXXX/XXXX, loan XXXX. They reported the loan as 166 days delinquent in XX/XX/XXXX and have said they have no information forwarded from NYCB that stated that as a condition of the loss mitigation that they would not report the loan as delinquent, pending the approval and acceptance of a loss mitigation option. I have contacted both NYCB and XXXX to have the credit reporting rectified as XXXX says they will honor the terms of the NYCB loss mitigation as they were disclosed to me, namely that that the loan would not be reported delinquent following approval and acceptance of the the loss mitt option. XXXX has approved me for a loss mitigation option with the terms that acceptance is dependent on making timely payments starting XX/XX/XXXX. I made my first payment onXX/XX/XXXXXXXX but XXXX had already proceeded to report my loan delinquent which was contrary to the loss mitigation condition that was disclosed by NYCB. I had reached out to both organizations and in doing so was told by XXXX that the loan set to again service transferred and the name of new servicer will be disclosed shortly in a letter. I find that this is both unfair and deceptive to me and as a consumer caught in the ferris wheel of servicing transfers where I start loss mitigation action with one lender and those terms and conditions are either not disclosed to or honored by the other lender as concluded from NYCB notice of servicing transfer letter dated XX/XX/XXXX, that states that other than a new servicer nothing else about your mortgage loan will change which I understand to include my loss mitt conditions. I look to the CFPB for help is correcting this issue because as a sole consumer my request to both NYCB and XXXX, and possibility more subsequent servicers to follow will not be attended to and corrected.

hello, my problem is with NYCBank, and the issue is last year in changing insurers, XXXX picked me up, but days to weeks later dropped my policy because of a asphalt driveway patching problem i could n't get too, due to cold weather and not finding a asphalt company to have it repaired by fast enough for them, or use patch materials on the ground, during that process the bank over zealously hit me with a court foreclosure, but, it was not long after rescinded due to the bank modifying the loan, i agreed to the Mod, now thinking that at the time of the Mod-agreement the bank has insurance taken care of. i received no notice of not having insurance until XX/XX/XXXX, i write this XX/XX/XXXX. They want to charge me with -forced placed insurance- for the dates of ( get this ) XX/XX/XXXX to XX/XX/XXXX. Back when i received the letter i immediately sought out insurance which took days to find, and purchased a policy for the dates starting XX/XX/XXXX for the year in full and sent that XX/XX/XXXX page to them, as you ca n't go back further to buy insurance, so i 'm told by all the insurance company 's i contacted.

( how can they order it, and i ca n't ) The notice must inform the homeowner that : there is an obligation to maintain hazard insurance that the servicer does not have proof of insurance coverage the procedures for providing evidence of existing coverage, and if the borrower does not prove coverage, the servicer may force place the insurance.

The loan servicer must also send a second written notice to the homeowner at least 30 days after mailing the first notice. If the homeowner does not provide proof of insurance coverage within 15 days after the second notice, the servicer can force-place the insurance coverage. -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- -- again i bought, paid in full for the year, ( proved coverage from the moment of discovering i did n't have it. ) my insurance agent provided XX/XX/XXXX pages to NYCBank, 1. how can they go back in time to force coverage on days gone by due to there incompetent servicing??? 2. i am filing complaints for predatory practices against NYCBank starting at the Ohio Attorney General 's office, they gave me your contact info for my next complaint, which is this one. I have received another letter from the bank stating they are getting insurance from " XXXX XXXX XXXX XXXX '' a XXXX company that 's probably not registered in the USA, and does n't even look like they do business in the USA. this stinks to high XXXX. this looks very fraudulent, and I 'm hoping to get someone that can put NYCBank 's feet in the fire.

I made a conventional loan with NYCB for my home in XXXX 2012 ( # XXXX ) Since that time I have unfortunately had damage to my home. Because of this NYCB had to endorse the insurance payments. NYCB 's Loss draft Department is a 3rd party company that is so difficult to work with and unfairly holds your check and refused sign them. I have done everything required of me according to my loan documents. I notified them of my loss at the end of XXXX and requested them to come inspect so they could start to distribute my funds and it took 6 months of fighting them just to get the first inspection. The first check I sent them was for XXXX. This was an advance and was supposed to help me get temporary shelter since I was homeless. they had no right to hold this check but they did anyway. This left me with no money to do anything and I was left with nothing to help me live. I have muiltiple other properties and I have had no other issues with their loss departments. After complaining over and over about not receiving my funds I was finally told NYCB changed the company that handles that and my check was still at the other company so they had to get it from them. because of this I faced a rough few weeks after the floods. Because of their history of mishandling peoples checks I asked them to come inspect my property but they refused and requested a bunch of documents that was not my responsibility to send. They also started making demands on who can or can not fix my home. They stated they had that right by law and I had to use who they said. I contacted an attorney and was advised that there was no such law. Then they said the state requires me to be licence and insured and that I could not fix my home myself. I argued that there is no such state mandate. In my state you only have to have those credentials if you are hired be someone else. It does not apply to fixing your own home. I owe just over $ 68k and the house is valued at over $ 200k. They are now holding on to a $ XXXX check and refusing to endorse it. They offered to send the amount over what I owe and 30 % because that is what the inspector said I had already fixed. I asked them how am I supposed to continue to work on my home with out any more funds and they told me I need to just hire a contractor that is willing to work with no money down and just get paid after the work is complete. Well this is not XXXX. I live in XXXX. Contractors here are very expensive. much higher than most places in the country. and they all want money up front..They dont care. I would incourage no one to ever do any buisness with this company who does not follow the rules and terms of the loan and always has an excuse on why they have the right to hold your money. Im all for them experssing their right to protect their interest but they are taking it to far. They are causing more damage than helping ... As of today I have had enough. I am going to Wire the money to pay off the loan in full. So they will have no reason to hold that check anymore. Lets see how long it takes to get it back to me.

I was taking my sister and niece to the XXXX XXXX Bank of XXXX branch open saving and checking account on XXXX/XXXX/2016. We have present XXXX documents, the passport with resident visa and the SSN card to the representative of the bank. The representative reviewed passport and response that the passport visa was expired which she was wrongly defined visa expiring time with the last required entry date. After I showed her what mistake she made with visa type and date, She responded that she was not immigration officer, which I do n't blame her, so She asked to show the documents to her assistant manager - XXXX XXXX, so she can have his approval. After a few minutes, she came back tell me that because the visa was expired that she ca n't open an account for my sister and niece. Which again, I told her, she made a mistake again with the resident visa, otherwise, my sister and niece will be illegal immigration which they are not. So I request to speak with the assistant manager. After wait for a few minutes, the assistant manager walks over, whom has met me at the representative 's office 's door, who without greeting and identify himself. Only he was doing was staring at me, I was very surprised by his way to unprofessional and asked him if he is the manager. And he answered " Yes '', so I have invited him to seat which he suppose to invite me to seat. He starts to explain to me the reason that the bank ca n't open an account for my sister and niece. In his words, his reason was the bank needs XXXX IDs in order to open an account, and that is bank 's policy. Since his reason was different compare to his representative, I start suspicious that his reason was beyond bank 's policy. So I was very polite tell him that I was full understand and respect the requirement if that requirement is the policy of the bank. However, in order to not have future misunderstanding the requirement, I would like to have the requirement in writing, either from him or from a printed bank policy document. The assistant manager- XXXX XXXX XXXX refused provide such requirement either in writing or he told us, that bank has no such document printed for the customer. So I told assistant manager what I concern that without such bank policy in writing, I ca n't trust his word, because he may change his words once we had XXXX ID documents which he and his staff already change they requirements in 10 minutes. He refuses to give me any answer. So I was direct ask him if the requirement his ask was because we are XXXX, he was refuse to answer again but staring at me. When I continuously ask him if I can record his word, he also refused. Since his word and act was extremely stronger to me, and refuse to left any trace of evidence that the bank actually need XXXX IDs to open an account. As customer, I believe, I have been mistreated because my background as XXXX XXXX. New York Community Bank - Avoid them if you can. In XXXX, I had a water leak in my home which ruined flooring and cabinets in my kitchen and leaked into the room below XXXX my kitchen is on the second floor ). My insurance company dealt very satisfactorily with the claim and agreed to all the repairs that were needed. They sent me a two-party check for over $ 16K, made out to me and New York Community Bank XXXX my mortgage company ). I mailed the check plus other documentation to New York Community Bank on XXXX XXXX - and have yet to receive any release of funds. I had to pay 90 % of the cost of new kitchen cabinets in advance ( they took XXXX weeks from time of ordering ), which is standard practice. All the kitchen cabinet places I got estimates from said they expected 90 % of the cost upfront. My cabinets have been installed and I 've paid for them in full. I 've also paid for repair to my downstairs room, plus some repair in my kitchen. I 've sent receipts, waiver of lien, contractor taxpayer ID to New York Community Bank. New York Community Bank sent an Inspector to my home to report on the repairs. It took the inspecting company XXXX days to submit the report to New York Community Bank, which states that 70 % of the work has been completed. Every time I call to request a status on payment back to me, there is some excuse not to send me a check for the money I 've already paid. There is either missing paperwork, or an exception has to be put in since I 've already paid for the repairs, and their check to me needs to be made out to me only ( not to me and my contractor ). I 'm at my wits end dealing with New York Community Bank. I 'm trying to find out the email address of their CEO, XXXX XXXX XXXX XXXX XXXX XXXX XXXX to tell him of my disastrous experience. I have a legitimate insurance claim, fully approved, and New York Community Bank expects me to pay for my repairs without sending me any funding. I now have interest owing on my credit card all due to New York Community Bank 's refusal to release my own funds to me. I 'm unable to get my floors repaired and sink replaced as I 've run out of my own money and need my funds in order to complete the work. It 's as if New York Community Bank expect me to personally fund all the repairs, no matter what hardship this causes me - and then they 'll reimburse me, at some stage, when 100 % of the work is completed. MY understanding is that the insurance approved the claim and provided the money to FUND the repairs - it should not be a REFUND. New York Community Bank shows no concern over the fact that I can not use my kitchen, and the huge inconvenience I and my family have to go through each day. I am current on my mortgage payments ( never been late with a payment ). Yet New York Community Bank have been holding my funds for over XXXX days, with no status as to when they 'll release even a portion of them. I would not recommend New York Community Bank to anyone based on my experience.

We were notified by New York Community Bank inXX/XX/XXXX that our HELOC was going to " expire '' in XX/XX/XXXX and the entire amount would be due at that time. Our original loan documents state the loan terms would end in XXXX. I called and was told this was not true and the letter had been sent in error and that nothing is due. We had filed for bankruptcy and the loan was discharged in XXXX and not re-affirmed. They said all a payments were voluntary. We called many times and were told by New York Community Bank that they were no longer doing any of their HELOC loans and we had better find another lender. We were then sent a new letter stating that our loan would expire in XX/XX/XXXX and this letter referenced our Bankruptcy. We contacted our bankruptcy attorney and she stated the bank violated the Bankruptcy stay by sending us the first letter. But to sue them we would have to pay to do so. We are struggling financially and have missed some payments. She suggested we offer them money to try and buy the lien. We have made offers and now they wo n't even return our calls. They sent an appraiser to our house and when we received a copy of the appraisal they compared our home to homes in a different city with views of the ocean and another home that was one bedroom larger than ours. I spoke with the appraiser when he came in Mid XXXX. Then when we asked for assistance the single point of contact sent us a letter stating they may do an appraisal and requested we pay for it. The appraisal had already been completed at that time. Our HELOC was an interest only loan which was/is predatory in nature. When I tried to get assistance from them back in XXXX they informed me the Obama program did not pertain to HELOCs. I then found an article stating that New York Community Bank was selling all of its HELOCs that it had acquired from AmTrust to XXXX XXXX this article was dated XX/XX/XXXX the banks deal will go through in the third quarter. So it looks like NYCB is trying to call all HELOCs due and not sell them to XXXX XXXX. Ours was one of those as were many others. But they called all of the HELOCs due and gave consumers three months to pay these amounts and if they do n't they can foreclose. What are families going to do? I do n't have XXXX XXXX dollars to give them and how does one of the largest ( wealthiest ) banks in the US not work with families. They wo n't even return my calls. History : After our bankruptcy discharge they refused to send us statements and they punished us by refusing to credit my payments which were paid in full on our account which I was able to access on-line they broke up our payments into small amounts and said they were short payments. When I called no one I talked to could explain it and they said they would look into it and call me back ... they never did. I have attached a copy of what I was able to print out. I am not able to access my " account '' at all for the last year.

New York Community Bank started to escrow my mortgage payment after almost 20 years of service and not ever one late payment because they claim my property taxes were not being paid. I am disputing their claim because my property tax balance was paid twice. The township had to send NYCB their check back to them as an over payment check because they already received a check from me. I received a letter from NYCB XX/XX/XXXX telli ng me they never received my mortgage payment. I have record they received on XXXX XXXX XXXX . I had every agent a t NYCB te ll if I were to send the amount of the escrow to them they would stop the escrow. I was sure this was a scam because I know I was making my payments and they changed the rules of the contract to be able to charge more and make more. I believe they want the house to go into foreclosure because I only ow e 4 mor e years on the mortgage and there is alot of equity they can take. If someone was experiencing even the slightest of financial difficulty they double your payment and add fees. I believe my privacy was breached from this bank and I believe they have broken they debt collection law. They never gave me notification, itemized stamp escrow and Contract of duty. I believe the cause unneeded XXXX and XXXX in my life. I cant XXXX anymore. I am pursuing legal actions for them being responsible for trying to ruin my credit my life and my .character. I listed some used furniture on XXXX for sale. a buyer contacted by the name of XXXX. he stated he was in a transition process, he send me a check to pay for the items ( copy included ). I deposited the check into my account on XXXX/XXXX/16 with Amtrust Bank ( account # XXXX ) here in XXXX. I waited the two days the bank said it would take for the funds to be availible to take the funds out, withdrew {$1100.00} and wired the money to the movers who would pick up the furniture as per XXXX instructions to the name of XXXX XXXX through XXXX this I did on XXXX/XXXX/16 only after the funds were credited to my account. on today XXXX/XXXX/16 I got a call from the fraud department of Amtrust telling me that the check came back as no good. Really? I when to the bank and asked why they released the funds in the first place I would never have taken the money and wired it otherwise. I wanted to be sure that this buyer was legit before I proceeded I never would have taken the money and wired it to the movers if the bank was holding the money. I asked the bank to refund me the money because I trusted them when they put the money in my account that told me that the buyer was real, that 's is why I waited to take the money to try to avoid being taken by a thief. so how can the bank call me and tell me now that the check was not good and I am out {$1100.00} that is why the regulation exist for the bank to hold the money until they have verify that the check was good and now I am left to pay for their negligence they release the funds I did not asked them to release the funds early eventhough I have enough money in the account to cover the funds I waited for the bank to do their job to verify the validity of the check. I feel the bank should returned the money I lost it was their error in releasing the funds that prompted me to believe this buyer was real no the scammer he turned out to be. the bank allow this scam when the told my the check was good and now they do not want to accept this. maybe they think I am trying to take their money but that is not the case and now I stand to loose my money because the bank did not do the due diligence they are supposed to. My rental home on XXXX XXXX has been financed with NYCB Mortgage for the past 3.5 years. My credit is excellent, approaches XXXX, and I have never missed a payment. I am trying to refinance this same exact home with NYCB that has been financed with NYCB for the past 3.5 years, to get a lower interest rate, from 4.375 to 4.0. Absolutely nothing has changed in the home since NYCB readily and easily financed this home 3.5 years ago, without any questions or reservations whatsoever. Currently, they refuse to refinance the same exact home, as they say this is a multiple dwelling home. I rent the home to XXXX person. She apparently has a XXXX of roommates. I do not have any problem with her having roommates, as I have nothing to do with them. I only have a rental agreement with my tenant, and receive rent from said tenant, that has lived there for 2 years. If she has a couple of roommates that help her pay the rent, that is usual and customary, and quite the norm in XXXX, where rent are high. According to the XXXX city code, to be considered an accessory dwelling, another stove must be present. There is XXXX, and only XXXX stove at XXXX XXXX XXXX. In the absence of said stove, the XXXX areas of the home in question can be considered wet bars, recreational rooms, bedrooms, etc. However, they are not accessory units. According to the city code, an accessory unit is defined as follows : What is an ADU? An ADU is a complete independent residential living space that can be created within, attached to or detached from a single-family home. An ADU include provisions for living, sleeping, eating, cooking and sanitation. An ADU can provide supplementary housing that can be integrated into existing single-family neighborhoods to provide a typically lower priced housing alternative. XXXX XXXX of these XXXX areas of the home that NYCB is calling " accessory units '' have cooking facilities. NYCB did the exact same thing almost 2 years ago to the date with the home that I live in.. After months of wrangling, heartache, and many pounds of flesh, it was kicked to XXXX XXXX , the XXXX vice president of underwriting, who realized immediately NYCBs absurd argument, and funding happened shortly afterward. Perhaps NYCB also realized I would not give up. I do n't know exactly, but do know interests rates have gone up since I locked in at my present rate of 4.0. Perhaps this has something to do with it. Please finance the loan, and let 's not repeat the fiasco of 2 years ago. I am a great customer and have never, ever missed a payment, although I am getting weary of NYCB 's way of doing business.

This is very confusing and difficult for me to understand ; as well as very confusing to my husband. How can his VA benefits not be a bona fide source of income and not be considered? This strikes me as some form of discrimination since my husband is a veteran and his only sources of income are that which the VA provides. We are reaching out to the Consumer Financial Protection Bureau ( CFPB ) because we are having a difficult time, wrapping our brain around what NYCB is doing, which is non-sensicall. We explained the following to the CFPB : Our current loan ( mentioned above ) which we are seeking to refinance from NYCB recently adjusted to a Fixed rate of 4.0 %, to include P & I, for a monthly mortgage payment of {$2200.00} approximately. We were seeking to refinance to a 20 year loan ( we have only 20 years left on our current loan and did not want to extend the term ) at 3.25 % for a monthly mortgage payment of {$2000.00}. In the close to eleven ( 11 ) years that we have carried XXXX ( XXXX ) loans with you, we have never been late on the loan, we have always paid extra to principal, we have maintained exemplary XXXX scores ; in other words, we have had a PERFECT relationship with NYCB and have met our financial obligations for over a decade. Now that we need to refinance because the cost of the mortgage as well as the interest rate has increased considerably, you, NYCB indicated that, 1 ) the appraisal came in low, which we agree it did since our home should have appraised close to $ XXXX to $ XXXX, rather than the $ XXXX. However, even if the appraisal is flawed, even at the $ XXXX, we are seeking only 80 % Loan to Value, which NYCB should be able to accommodate, and 2 ) NYCB is " throwing out '' close to XXXX/month in VA Benefits which serve to pay our mortgage, car payment, meals, utilities, etcetera. Why in the world this is not " income '' which you can consider is beyond us. Keep in mind that we also paid off considerable amount of debt as requested by NYCB in order to consider our refinance. Even after we paid off the debt which NYCB asked us to pay off, we still received an unsatisfactory decision. In a nutshell, we are going to convey to the CFPB that : NYCB concluded that we can manage paying $ XXXX at 4.0 % interest rate, but somehow, we can not manage paying $ XXXX at 3.25 %. In an alternate world, this would make sense.

My home suffered a loss due to flooding on XX/XX/2016. My home is covered under a flood insurance policy from FEMA. NYCB is the secondary lien holder on the property and the total loan as approximately {$38000.00}. The claim for structural damage alone is in excess of {$61000.00}. On XX/XX/XXXX, a check was issued by FEMA as an advance payment to assist with paying contractors for demolition, dry out and repairs. The Check was made out to myself, my wife, XXXX XXXX as the primary lien holder and AMTrust Bank as the secondary lien holder. On XX/XX/XXXX, my wife and I went to a local branch of XXXX XXXX and the bank manager endorsed the check immediately. After that we immediately went to a local branch of AMTrust Bank of which NYCB is a subsidiary. We were informed that this would have to go their loss department by 1st class mail. A follow-up phone call was made on XX/XX/XXXX and at first it was explained that their loss department would have to review the claim and send out inspectors for the work before they would issue a check. I explained to the customer service representative that NYCB was n't issuing a check and that the claim is not with their bank, it is with FEMA who I am dealing with directly. After about 15 minutes of explaining that all I needed was their endorsement of the check, I was told that as the secondary lien holder, NYCB did not need to go through the lengthy process and would simply endorse it and send it back. The check has not arrived as of XXXX, and I am looking at liens being placed on my property from the cleanup company this week. A phone call to NYCB went to a voice mail system. My concern is that this lender is unreasonably holding onto a check that they are the forth signator on. I am especially concerned when the balance of the funds from FEMA arrive. My house is a complete wreck and hardly livable, yet this financial institution seems unwilling and uninterested in addresses these real concerns. I have had to slow down the course of work significantly due to the delay from this lender. They should simply be able to endorse the check as XXXX XXXX did and send it back to me without unreasonable delay. I am hoping to work through this claim as quickly as possible to get back a home after my loss from XX/XX/XXXX. FEMA 's adjuster is handling the claim and responsible for inspections.

The New York Community Bank office in XXXX XXXX [ XXXX XXXX ] ran a background check on my Social Security number thru XXXX XXXX after I had opened a CD and checking account on XX/XX/XXXX and determined that I had to bring my SS card to the office for identification purposes. I went to the bank to ask why I was asked to bring the SS card since I was an existing customer of NYCB for several years. They claimed that someone else had been heavily using my social security for several years. I immediately initiated the investigation by contacting the credit bureaus, Social Security Administration and XXXX XXXX to obtain the reports. Every report came up clean. The only name associated with my SSN was mine. I went back to the bank in XX/XX/XXXX and spoke to Management regarding the results of my investigation. They told me to contact XXXX XXXX again and ask them run the report by using my SSN only. I contacted XXXX XXXX several times to review the info linked to my SSN and no errors were found. Since the bank is the only institution seeing the other individual linked to my SSN, I asked them several times to provide me with a general letter indicating the issue without disclosure of the other individuals identity so I could initiate a proper investigation. Management has denied my request multiple times in the most unprofessional manner. On my last visit to the bank [ XX/XX/XXXX ] I was informed that the individual linked to my SSN had died in XX/XX/XXXX. Where is the bank getting this info from? Why none of the agencies I contacted has this info? They told me to ignore the whole issue with my SSN, to let it go. They further said that they did a background check on my SSN because everyday people open bogus, suspicious accounts. Were my accounts bogus and suspicious? That comment alone was extremely offensive. My parents, loyal customers of NYCB for over 20 years, are taking their business elsewhere. The rude, dismissive, impolite, unprofessional behavior and negative comments made during my recent interactions with management are a clear indication that the bank is discriminating against me. Providing me with a letter I have requested so I can initiate an investigation to ensure that I am not a victim of identity theft is the least the bank should do besides the apology for their discriminatory behavior.

It is incorrect to approximately {$160000.00} over stated. We purchased our home in XXXX XXXX for {$160000.00}. We put {$27000.00} down payment. We have been paying on the mortgage for over 26 years. The principal balance on XXXX XXXX, XXXX was {$110000.00}. The current statement as of XXXX XXXX, XXXX shows our principal balance is {$250000.00}. The problem starts in XXXX XXXX, our mortgage was transferred to Ohio Savings in XXXX without our knowledge or approval. On the first mortgage statement that we received from Ohio savings on XXXX XXXX, XXXX the principal balance was {$280000.00} exactly. There is no honest reason the principle balance went from {$110000.00} in XXXX XXXX to exactly {$280000.00} in XXXX XXXX. We are aware of the mortgage scandal during these years and believe we are victims of this scandal. This is residue from that scandal and could be a rising class action problem to emerge. XXXX XXXX XXXX sold our mortgage to Ohio Savings for {$280000.00} or the person handling our transfer entered the wrong principal balance when setting up our account. On XXXX XXXX, XXXX I alerted a customer service rep at CitiMortgage by phone about this issue. They recommended that I to fax the paperwork to XXXX Research Department. I followed their instructions of faxing the paperwork that I have to XXXX Research department on XXXX XXXX, XXXX. I have not heard back from them regarding this issue. I am aware of the law that states the loan servicer is required to acknowledge my request within 20 days and XXXX has violated those rules. On XXXX XXXX, XXXX ( one week later ) I received an email from XXXX stating that our account is being transferred to another lender. The lender is XXXX XXXX XXXX. We have been overcharged and have been paying overcharges on our mortgage for over 12 years. According to my calculations our mortgage principal should be approximately {$54000.00}. And we have overpaid {$90000.00} in interest over the past 12 years. I am requesting your assistance in settling our mortgage overcharges/overpayments.

I was trying to log into my account with New York Community Bank via XXXX and when I entered my user ID was told my account was disabled. I called customer care and was told because I had not used my account recently ( note they did not give a specific time window for this policy on account closures even on the customer care call ), they had disabled my account. This was without any advance notification to my email address linked to my online account. They refused to unlock the account even when I provided my SSN, account number and my online banking details. They claimed this was pursuant to their policy in the agreement I signed opening the account. However this seems disproportionate and not clearly articulated. I know for a fact I downloaded my tax documents in XX/XX/2016 for the previous year from their website, yet by XX/XX/XXXX they had closed my account and sent all my money to the local government, where I must now file an Unclaimed Property Request and deal with all the challenges that entails to get the money that is mine returned to me. It was also only when I requested to speak to a supervisor that I even found out they had sent my money to the government, as the first customer care contact mentioned nothing of the sort to me, just that I should send a letter and copy of my driver 's license to request my account be reopened, even though in fact the account and the money is gone for good from NYCB and I must search it out with the local government. This seems unreasonable for not having logged in perhaps during six months to an account, and I would request the CFPB review the terms of service of this Bank to its customers, require they adjust their policies on closing accounts and unilaterally sending consumers ' assets to the government, as well as send email notifications warning of such actions before they are taken. I have many accounts with financial institutions and have never had close to this awful a customer experience and am now faced with the uncertainty of ever seeing a very large sum of money again. Are n't banks supposed to be safe places to store your money? It seems NYCB does not take this core responsibility seriously.

This is a complaint involving the Amtrust Bank, XXXX XXXX XXXX, XXXX XXXX, Florida XXXX. My brother XXXX XXXX passed away in XXXX XX/XX/2016. He left a small bank account without a beneficiary. The account was left in Queens Counry Bank which is affiliated with the Amtrust Bank. I am his sister XXXX XXXX, his closest relative. When I spoke to XXXX XXXX in the bank regarding withdrawing XXXX remaining savings account I was told that I did not have the proper documentation. I presented XXXX death certificate and my ID. XXXX was XXXX before the age of XXXX and was receiving benefits under my fathers Social Security number. My fathers SS number appears on my brothers death certificate because he is considered a child under federal law. I went to the social security office and got a signed document stated XXXX own SS number and presented it to the bank. This number was the number that XXXX used to open the account but it is not the number that the Federal Government has as his official identification number which is why his death certificate uses his fathers number as XXXX 's ID. I presented my fathers SS card and death certificate which shows the link between my father and brother but the banks legal department still will not allow me to withdraw the account. Even with the SS official letter and all the above ID the bank still insists that I change XXXX SS number on his death certificate to his personal number. When XXXX took out his SS number at the age of XXXX he used his nickname of XXXX XXXX which his not his legal name therefore his SS number is not even legal. When I went to the SS office they could not pull up his number and had to manually type it in to the letter. When they have put my brothers information into the computer my fathers number comes up under his name. Being the Federal Government recognizes this number as my brothers because he is a XXXX under my fathers number and because the bank has allowed XXXX benefits to be deposited into his account every month for many years using my fathers SS number, I believe they should release his bank account. Dear Consumer Financial Protection Bureau, I am writing this complain to inform you about a situation with my mortgage payment, which I am unable to solve. I have purchased a townhouse in XXXX for the amount of {$450000.00} as a first time buyer. Since I did n't have any down-payment, I was offered XXXX loans, an 80 % fixed 30 year loan for {$360000.00} with XXXX, and a 20 % home equity line of credit adjustable rate for {$93000.00} with New York Community Bank. I lived in the townhouse for 2 years, but had to move out to a different location due to job change and distant to work. Since the price of the home went down significantly during the housing crisis, I was not able to sell the home, and had to rent it out. The rent amount has constantly been lower then the mortgage ( {$1500.00} a month lower until XXXX, and after refinancing the first mortgage, {$750.00} a month lower since then ). So I have constantly been losing money every month, but have continued paying my XXXX mortgages on time every month since the first day of purchase. I believe it has been and will be my responsibility to pay the amount regardless of the market situation. On XXXX XXXX, XXXX I received a letter from New York Community Bank ( XXXX ), my 20 % mortgage lender, stating that as of XXXX XXXX, XXXX, the bank has decided not to extend my mortgage, since the agreement was drafted in a way that the bank could decide if the want to extend the mortgage or not every year up to 14 years. They expect me to pay them the whole amount of {$93000.00} at or before that date! The only other options that I have are to sell the home or refinance. Unfortunately the price of my home is around {$420000.00} and I do n't have the {$35000.00} cash to pay for the difference and closing fees. I have tried both through XXXX and NYCB to refinance, but I have been told since the home does n't have equity they ca n't help me refinance. I have paid my bills every month in the past 9 years, and do n't deserve to be in this situation. I do n't have the money and do n't know what else to do. I am a customer of NYCB, using the physical branch of theirs ( XXXX XXXX ) at XXXX XXXX XXXX, XXXX XXXX as regarding this complaint. On XX/XX/18, I scheduled an ACH payment of {$870.00} to XXXX for a Credit Card account held there. In so doing, I transferred the necessary funds from my E Money market account to facilitate the transaction. And, the request was therefore confirmed by XXXX. On XX/XX/18, an employee of XXXX XXXX, XXXX XXXX XXXX posted a check for {$300.00} that belonged to another customer of their bank to my account in error. On perusing my account on the night of XX/XX/18, I saw that there was an unauthorized debit posted to my account in the amount of {$300.00}, and immediately contacted their Customer Service via my online account-telling them of the problem. And, I cc'ed same email to the bank personnel at the XXXX XXXX branch XXXX The unauthorized debit to my account, negligently facilitated by the bank employee rendered an overdraft on my checking account as the ACH was still paid despite the balance being {$300.00} short due to the bank 's error. I received a call from the XXXX XXXX bank employee on XX/XX/18, and she apologized and promised to resolve the matter as soon as possible. She assured me that visiting the branch was unnecessary. On XX/XX/18, I decided to check my account, and was quite dismayed to see that there was an Overdraft Fee assessed to my account, which again put the account in overdraft. There should be no Overdraft and no Overdraft Fee assessed to me for a fault that was engendered by an incompetent employee who took money from my account in error. I visited the branch to see the employee and have her reverse the Overdraft Fee, and rightfully put my account back in the black. To date, I have not received any response from NYCB Customer Service. My email to them was not acknowledged, and neither was there a response to my email account regarding their internal snafu. People intent on doing business with NYCB and XXXX XXXX should remember caveat emptor, as their staff is ill-equipped for their fiduciary responsibilities.

To summarize, I have an 18-month liquid CD with New York Community Bank with a " DO NOT RENEW AFTER MATURITY '' when CD was opened with the branch manager. This is also noted on the Notes section of the CD contract agreement. This was a liquid CD type to make sure I can withdraw the funds when needed for funding my kids college costs. The CD had matured earlier this year but NYCB bank automatically rolled it into a regular 18-month CD with a very low rate, since according to the bank, I did not notify them during the grace period. Note that the original CD was a LIQUID type with a " no renewal after maturity '' terms. I was told that I would be penalized ( $ XXXX+ ) if I withdraw the money. So now, my funds are locked into this low 18-month rate with a penalty if I take my money out. I am also an " Elite '' program customer supposed to be given higher rates ( CD, Savings, etc. ), more benefits, at this bank. According to the bank, because of this " Elite '' customer status, there is a benefit to auto renew the CD when it matures and this overrides the CD contract agreement!!! When this Elite program was offered to me, all that was disclosed to me were better rates, avoidance of fees, personal service, overdraft protection, etc. There was not a mention of any overriding the contract agreement. I have spoken to the branch manager and several bank employees of the bank and I was even told that the bank do not normally follow these notes/terms on the CD contract. The NYCB bank breached the terms of the CD contract agreement by reinvesting my funds automatically into a REGULAR CD. To add insult to injury, I was told that as an added benefit going forward, they will revised their policies to make it clearer to customers going forward. I have mailed a copy of the complaint to the CEO/President as well as the COO. I am still waiting for a reply. Since these operational procedures are not followed at this bank, it is causing customers like me to suffer and pay for their violations. I want to raise all these points to the regulators so it should prevent others to suffer like me.

I have been having problems with this bank, and decided to close me account. I contacted them to get explicit directions on how to close it. I had numerous problems with this bank before and wanted to make sure I could l so without incurring any fees. It is an interest baring account. I called to find out to close the account, but get the remaining interest due. I was told in that situation to leave {$1.00} t {$2.00} in the account and the remaining interest would be deposed after the next cycle closed ; after that happened, I could with withdraw out any penalties. Instead I got numerous letters that my account was overdrawn, because the bank charged me fees for not meeting a minimum balance. I got multiple letters threatening they were going to report to the credit reports and that this was a default that was going to show up on my credit report. They were claiming my account was overdrawn {$8.00} ; they had charged me {$10.00}, directly contradicting their directions that said that they would not do that. When I first contacted them, I got the complete run around. First they told me they could not legally reverse the fees. When I threatened to sue them, they said they would reverse the charges. I insisted they send me a letter verifying my account was not overdrawn and that they would not contact the credit agency. They have refused even to address the issue after months of my asking them to : this is wholly illegal. All their responses say is that my account now has no balance due, which I know. I contacted them XXXX times and they refuse to address whether they sent this information to a credit agency or took or will take any adverse action. I believe their refusal to respond is also directly retaliatory, because of the documented issues I had with this before. I think that they violated multiple laws. They Illegally sent or threatened to send misinformation to credit agencies, and then have refused to address those threats and whether they have done so. The only amount that was over drawn on the account was the amount they illegally charged me.

I am filing this complaint because I was in a accident while I was atleast XXXX XXXX or XXXX years old. Which a lawsuit was won against New York XXXX XXXX XXXX to be held in a ( CD ) Certificate of deposit account. Which this account was to be guarded by the New York Community bank upon the age I reach XXXX for {$8300.00} dollars that should have matured several times and also accumulated interest and I demand all the matured funds and at the highest amount of interest should be placed back in this account upon me recieving my funds. Well I turned XXXX and it was time to go and retrieve the money that is rightfully mines so I went about getting all of my legal documents to retrieve the money from the bank. I live with my Uncle who assists me with this matter and I give him all legal permission to communicate with all parties involved. Which who I took the trip with to Queens County Savings Bank to retrieve the money which was awarded to me. Now upon the arrival of me reaching the bank and speaking with a Financial Service Associate XXXX XXXX and XXXX XXXX the bank manager of the bank which informed us that the money was put in a Abandoned Property Account in 2011. Now according to the stipulations of the court official order which was handed down by the Judge who handled my case. I have been following and going by the right actions to get this matter handled as quickly as possible because for the simple fact I should not be punished from retrieving this money that is rightfully mines for this banks XXXX mistake while breaking the law and i am truly fed up with this matter. They are also very unprofessional at New York Community bank for not returning phone calls and was put on hold for no-one to return to the phone. I was also informed to call XXXX XXXX from the Abandoned Property Division of New York Community Bank which also never answered my phone calls and never returned my phone calls either. Just take note that I will also be filing a complaint to the Better Business Bureau and I also demand that this matter be resolved as soon as possible.

I opened a bank account at Garden State Community Bank in XXXX, NJ, a branch of New York Community Bank. I explained to the manager XXXX that I would be making cash deposits on a XXXX basis of approximately $ 3,500- {$4000.00} per XXXX based on my XXXX take home pay from where I work. I receive a paycheck from XXXX XXXX Bank each XXXX and then take the check to a XXXX XXXX Bank branch up the block to be cashed. After taking some money for myself and giving my wife some money, I deposit the rest into my checking account in cash to pay bills. She assured me this would not be a problem. A few months later, a new manager, XXXX, informed me that she had heard from the back office that there was a problem. I explained to her what I had explained to XXXX, and she told me everything would be fine with the explanation. A few months later, a new manager, XXXX, said she had been contacted by the back office as well. I explained to her as I had explained to XXXX and XXXX previously, and offered to give her a copy of my pay stubs to show where the cash was coming from. She agreed to review the pay stubs and send copies to the back office. She then assured me there would be no more problems. I then received a letter from the VP of the Bank, XXXX XXXX, informing me that there was suspicious activity in my account and that the bank would be closing my account effective XXXX XXXX of this year. I called and spoke to XXXX and when I explained everything to her, she assured me that everything would be fine and I would be able to continue my banking. I then spoke to XXXX XXXX who told me that he would review it and yes it was the cash deposits i was making, but that it is highly unlikely that the bank will reverse its decision. He informed me that they were under the scrutiny of Homeland Security. I told him that I had a problem with this decision because I was doing nothing illegal. He confirmed I was doing nothing illegal, however he again said it is very unlikely that the bank will overturn its decision.

Filed an insurance claim on Homeowners for a plumbing leak on pool equipment which failed my pool deck. begin bid process XXXX 2014, submited to insurance which paid immediatly. Portion of funds went to NYCB, submitted all necessary documentation to NYCB, scheduled work to begin after a month of phone calls NYCB finally sent XXXX draw of 3k on 26k project, minimum XXXX draw requested by contractor is 30 %, weeks went by along with several phone calls and letters. contractor showed up to schedule and recieve XXXX draw, and rejected amount submitted by NYCB and declaired thier company wishes to not do business with me in fear of payment delays by my mortgage co, NYCB! Here we are in XXXX, XXXX months later and work is still not in progress, NYCB still controlling and dictating disbursement amounts for work to be completed. every call made, all you recieve is a different story, a request for different needs and or request of missing documentation. In speeking with my insurance company, they also have never had dealings with such a poor managed institution. We are not in risk of missing the window of oppertunity in the sale of our home, all due to the neglect an unethical business practices within NYCB. 32k project today as opposed to the 26k a few months back, is expected to take 4 days from start to finish, NYCB request multiple inspections throughout process which i welcome, the 16k in which NYCB now holds in only half of what is required for this project, i am unable to submit supliment to insurance untill NYCB pays out the XXXX, this being said my family will end up paying more Out of pocket for an extendended amount of time all due to NYCB practices. Loss draft dept, is well trained at apoligizing and under trained in processes. why do i say this, because everyone you speak to tell you something different. NYCB is so behind time, they do not offer byweekly payments allow customers to pay down there note. choose wisely before considering NYCB

My account is es crowed with NYCB and I see a significant delay in paying my home owner insurance payment. Two months back I have opted for new home owner insurance policy, informed bank about it and I made couple of call to inform them about my new insurance premium payment. Insurance agent sent them invoice but bank never paid them. I have received a cancellation notice from insurance company, I called bank on XXXX XXXX 2017 to inquire about the payment and they admitted they never paid it ( my online account says they paid premium but it was not the case ) but there a confusion from their side ( not sure what it is ). When I asked them did they get cancellation notice from insurance company, they said yes as they got it on XXXX XXXX 2017 then why did n't they act immediately? why are they waiting until I call and let them know about missing payment? Today is the last day insurance company would cancel my policy if they do n't receive payment, I called bank, CSR says we need allow 7 days to deliver the check, and CSR assumes it will be delivered and insurance would reinstate the policy, who is responsible if payment is not made by end of today? what if damage happens over the weekend? Bank put me corner and I was in scary mode now, surprisingly second time happening this to me like this as Title company never paid premium amount to insurance for which I lived in home for 7 months without home insurance and no one took responsibility about it. Always CSR speaks something not sure it is recorded they assume a lot but they do n't take responsibility, they give robot type answers, not allowed me to speak to their manager when needed. But CSR gave random answers, different CSR 's give different answers. I 'm worried and I see negligence from bank.

New York community bank aka Ohio savings bank called the heloc XXXX XXXX years early due to no longer writing heloc and requested full payment of the balance. I attempted in XXXX and XXXX to make a payment over the phone to keep current so I could refinance with another bank and offered to mail a pmt. All payment requests were refused by the lender and the phone representatives only concern she asked me was if the calls to pay was on a recorded line. They have reported me as delinquent and I am unable to refinance because of their reporting. The lender originally lied and stated the loan has reached its maturity date which I was able to quickly prove the maturity date of 2012. Furthermore I was billed approximately XXXX per month throughout the term both by mail and on the automated system. I paid XXXX per month when billed for the lesser amount. Just last week In speaking with a customer service rep at the bank was advised the payments were approximately 450.00+ per month. I was never advised of this previously at any point nor was I in default prior for the supposed short payments.When first notified of their decision I was advised by a representative at the bank that i was not able to sit down with anyone t the bank to discuss their " offer to help '' paperwork nor was there anyone at the bank who I could call to discuss. The lender has been very deceitful, provided incorrect information and lied during this entire process besides refusing to take payment then reporting me as late to the credit bureau. I attempted to refinance and now can not. I did not want to do business with this lender any longer but was forced to go back to them due to the situation to try and rectify the issue. customer service representative at the bank assisted me with the loan application paperwork but is not a licensed loan officer. I had an a passbook savings account with my father XXXX XXXX at XXXX XXXX XXXX XXXX ( a subsidiary of New York Community Bank ). My father died on XX/XX/2018. On XX/XX/2018 I went to the bank to withdraw the funds from my account. I was told that I could not access my account because I had neither a passbook nor a death certificate. The manager told me that the account would be flagged with the information that a joint account holder was deceased and that I would be able to access my account when I returned. She then printed a list of all the accounts bearing my name with the bank. On XX/XX/2018 I obtained a copy of my father 's death certificate via mail and I returned to XXXX XXXX XXXX XXXX located at XXXX XXXX XXXX, XXXX XXXX, NY XXXX. On that day I discovered that {$14000.00} was missing from my account. The bank manager ( XXXX XXXX ) refused to tell me who withdrew the funds. All she would disclose was that a money order had been made out to XXXX XXXX XXXX on XX/XX/2018. I did not authorize this withdrawal. XXXX XXXX told me that she would have the bank perform an investigation and I would hear back within 14 business days. The next morning I received a call from XXXX XXXX that the funds had been returned to my account. I asked her to give me a copy of the withdrawal slip to find out who had stolen the {$14000.00} from my account. XXXX XXXX refused to do so. She has been asked several times to give me a complete documentation of this fraudulent transaction, but she has refused. Her position is that my account was made whole and there is no reason to disclose any further information. My position is that a theft of {$14000.00} occurred and I have a right to know who committed this crime. What further steps can I take to receive the information which I am requesting?

NYCB clearly believes it 's mortgage servicing " policies '' are above Federal Laws. In the case of a Decedent - NYCB literally, put in WRITING, in a reply back to my first complaint filed with the CFPB : They " had told me already that they do not accept delegations '' from a United States Court Appointed Personal Representative regarding loan information. So sorry, but - what?? The Legal, court appointed, stand in for a XXXX person has no delegation rights over a mortgage loan with NYCB? On what planet would this be considered legal? Let alone Humanly Decent? To make this stance even more deplorable, it is a FALSE statement. They did NOT tell me that they did not accept a Personal Representative 's delegations, AND I WAS able to speak to an NYCB representative regarding this loan account with the Personal Representative 's permission and transfer over the phone. So which is it? They DO accept delegations, or they DO N'T? Was the phone transfer not a delegation? I 'm confused, are you? NYCB blatantly made these statements, back to a CFPB complaint, in writing! . Additionally, NYCB has already very clearly violated at least 5 Federal Laws, and then had the audacity to completely skirt their violations, and make additional irrelevant, as well as more false and misleading statements in their reply back to my first CFPB Complaint. Do not trust this Mortgage Servicer to provide information that is anywhere in the vicinity of the truth. New York Community Bank transferred my loan to another servicer XXXX XXXX Mortgage XXXX without providing me adequate notice ( less than 15 days XXXX. When I called XXXX to request more time to access and retrieve my records about Escrow Payments, Insurance Payments, and Annual Interest paid, they were unwilling to help me in any way. They reiterated that in 10 days I will lose all access to their system. The new servicer does not have any of my records yet, and could not promise that they would be in place by XXXX when my XXXX account will become inactive. I asked if they could mail me documentation or allow me to extract my records in PDF format, and XXXX said that they would do nothing for me, and were completely uninterested in speaking with me - eventually, the person on the other end of the phone just went silent and stopped speaking to me. I expressed my concern that this was creating a lot of stress and extra work for me in a very short window, and that I had concerns about my ability to pay my taxes without records to support or dispute a XXXX from the bank - again, complete silence on the other end of the phone. New York Community Bank should not be allowed to treat customer this way - presumably they are transferring my loan because of some benefit to the Bank, so I am suffering for their benefit. I was a model customer, I never made a payment late, or caused any additional costs or concerns for the bank during the life of the loan, and now they are violating the guidelines for a transfer and incurring me additional costs, so they can benefit.

I have asked NYCB several times to report the correct mortgage account information to the credit agencies for myself and my wife to no avail. Our mortgage account has been opened and paid on time since XXXX and they report it as closed. I called them in XXXX XXXX to make the request and they told me I had to send a LETTER via usps. I un derstand that they need a record of all correspondence, but in this day and age, that is ridiculous! Even the IRS and FDIC has online request submissions. I digress. I sent a letter on XX/XX/XXXX and received a letter from them a month later saying that it will be updated. Several months go by and no update on our credit reports. I sent another letter on XX/XX/XXXX and received a letter from them a month later saying that it will be updated. Waited a few more months and one of the credit agencies show the account as open for my wife but only shows the last few months of payment history - still no update on my credit report. I sent another letter on XXXX and received a letter from them a month later saying that it will be updated. Today, still no update on the credit reports! I must say, again, this method of communication is 100 % ineffective. If I could talk to someone on the phone there is at least a remote possibility that I could speak to somebody that could at least explain the problem or maybe even fix it. I sent another letter today, but am also filing an official complaint as this issue is negatively affecting our credit scores.

In XXXX of 2018 I called my bank requesting a cancellation of my debit card due to unauthorized charges by a merchant i cancelled services with. The bank, in their response, asked me to go into my nearest branch and cancel the card and request a new card ( which would take about 7 days ). I went into my local branch to make the change and was told the card was cancelled and that a new card would be sent. In XXXX I was again received unauthorized charges to my card by the same merchant ; I then contacted my bank and alerted them to the problem and they claimed the teller never cancelled the old card and that it was still opened, even at that moment. The bank then told me that they were cancelling the card and that they would open an investigation on the merchant. I explained that at this point the issue was not with the merchant, but with them for not executing the cancellation, and that i wanted my money back. They complied and reversed the charges, then sent a letter confirming their actions. I just went into my account and saw, that again, they reversed the money originally taken out of my account, siding with the merchant, even though it was their error of not cancelling the card. I requested to speak to a manager or someone with higher authority to deal with this issue, yet they are sending me in circles without any resolve.

Had a water loss at our home XX/XX/2016. XXXX XXXX immediately mailed a check based on the estimate for repairs, {$18000.00} XX/XX/XXXX. Had to send check to NYCB to get an endorsement. Work was completed in early XXXX 2016. Sent final bill and other requested paperwork to NYCB. They released {$5000.00} of the funds and stated they needed an inspection to make sure the work was done satisfactorily. Inspection ordered XXXX XXXX. After weeks of not hearing from anyone regarding the inspection and numerous phone calls to NYCB, an inspection was finally performed XXXX XXXX, six weeks after the request. Meanwhile, the contractor needs to be paid and we need to pay for rugs and carpet that was ordered. No, NYCB continues to hold our money hostage now claiming that the inspection was incomplete and they need to schedule another one. I do not have another six weeks to have an inspection done. Granted, this is a {$350000.00} mortgage on a $ XXXX house so it is not like they are not going to ever recoup their money if something were to happen to the house. It is a scam NYCB is running by pooling insurance claim funds, earning interest on these funds while holding their mortgagee funds hostage claiming that they need more paperwork, inspections etc ... At my wits end. Please help and beware of NYCB.

NYCB had an appraisal done on my home by an incompetent appraiser on XX/XX/XXXX, who claimed there are XXXX kitchens in my house. On this basis, they refuse to refund the loan, at a lower rate. On XX/XX/XXXX, I complained to the State of Arizona Board of Appraisal ( ABOA ), who agreed on XXXX/XXXX/2015 that there is only XXXX kitchen. NYCB insists that their flawed and incompetent appraisal report, which states there are XXXX kitchens, and therefore more than XXXX accessory unit, is correct. The State of Arizona, the highest authority in Arizona, disagrees, and claims there is XXXX functional kitchen. With XXXX kitchen, there can not possibly be more than XXXX accessory dwelling. The fair and equitable thing to do at this time is to order a new appraisal, to see who is correct. I know with 100 % certainty that the State of Arizona is correct, as was NYCB 's own appraiser 4 years ago, when they funded the home in question. NYCB also knows that I am correct. This home has not changed at all in 4 years, except that it is a little older. They tried to do the same thing XX/XX/XXXX, with another home, and they eventually admitted the appraisal was faulty, ordered a new appraisal, and funded the loan. NYCB just wants to keep me paying a higher interest rate, so that they make more money.

I had previous mortgage loan with Newyork Community Bank ( NYCB ). Loan # XXXX I recently refinanced with same lender in XX/XX/XXXX, loan # XXXX, and escrow was signed onXX/XX/XXXX. Therefore final principal payoff amount was {$420000.00} ( not {$420000.00} ) and new funded loan was for principal amount {$420000.00}. I waited till 3rd week of XX/XX/XXXX to received difference between previous pay-off and new loan amount {$680.00}. After that I called NYCB and they opened inquiry within and promised to give me call back within 48 hours. Never received call or voicemail. After that I sent email through secure messaging system in my login account on XX/XX/XXXX. Followed up 3 times after that but no response so far. I did receive check for {$2200.00} from NYCB that was for balance in escrow account which was there for property tax payments at the time of closing. I still need to receive {$680.00}, which is difference between previous payoff and new loan amount which NYCB is reluctant to give me. I called title company as well and they said I need to deal with lender for that.

Problem with New York Community Bank bill pay. Checking account opened XX/XX/XXXX to use online bill pay for bimonthly donations to my XXXX. I made 11 on line payments of {$140.00} ; the first 8 payment checks were mailed to and received by my XXXX on the designated dates. The XX/XX/XXXX check was never received by the XXXX & my bank indicated check was issued & mailed. I assumed there was a mail problem. 3 subsequent payment ( XX/XX/XXXX thru XX/XX/XXXX ) were mailed & received. However payment # 12 for {$290.00} due XX/XX/XXXX was never received by the XXXX. I inquired about check with the bank as my account listed the payment as an " ACH '' not the normal " Check Paid ''. I was told this payment was not in the form of the normal check but issued as " corporate check '' because the amount was larger. The check has not been received by the XXXX even though money was withdrawn from my account. Bank can not tell me why check was not received on designated date, or what dollar amount threshold required a " corporate '' check. That's a 15 % error rate on payments. The XXXX regularly receives checks from other banking institutions without a problem.This is not a mail issue.. Today is XX/XX/XXXX the bank is still holding my money and unable to give me adequate explanations.

On XX/XX/2016 My home was burglarized. I usually make my mortgage payment with NYCB by phone on this day. However when I came home at lunch time about XXXX my house looked like a tornado had gone through. My tax papers, photos every drawer, box, closet everything was strewn about. It took me 2 days to put it back together. Needless to say the last thing on my mind was the mortgage payment. However, I did make the payment the next day and asked that they please take the late charge off because of my circumstances. I wrote a letter and have never heard a response. Since this time my house was hit by XXXX and it is not live able. We have had to move out to rental house and it has been difficult to get the money released from our mortgage company after our insurance company sends them the money to repair our home. It has been since XX/XX/2016 repairs have just started. They did n't release the money in a timely manner which has now caused more damage and more delay for us to get back in. They are drawing interest on our money for repairs. We are now having to move from our rental home because it sold and we do n't know how long the repairs will take. All this to say please ask them to take any late charges off because of these catastrophic events that have occurred to us.

Ohio Savings Bank, a division of New York Community Bank ( NYCB ), is getting out of the loan business because of their own financial problems. They just announced the sale of their mortgage business to XXXX XXXX, and they are laying off 200+ mortgage employees in XXXX . However, long before that, they started calling in loans last year. Even though our HELOC was in good standing, they called in the loan -- forcing us to refinance -- which in turn will cost us closing costs and hours and hours of time. We started refinancing in XX/XX/XXXX. However, for a variety of reasons beyond our control, the refinance did not close by their XX/XX/XXXX deadline. Now they are threatening collection activity, foreclosure, negative reporting to credit bureaus -- all for a problem they created. We are basically waiting for one document -- a XX/XX/XXXX tax transcript from the IRS -- to finish the refinance. I have talked to the tax advocate office, but they say they ca n't speed up the process. We 're probably talking about 6 weeks at most, but NYCB is unwilling to give us that time. Instead they are requesting reams of more documentation so they can provide " mortgage assistance '' that we do n't even want. All we need is time to finish the refinance process.

My mortgage is with New York Community Bank ( XXXX, NY. ) My homeowners insurance and property taxes are paid through escrow annually. For the second year in a row, I have had to pay my homeowners insurance premium to XXXX XXXX because the mortgage company has not paid it before the lapse date. The bill was sent by the insurance company to NYCB in XX/XX/XXXX and XX/XX/XXXX, with reminder notices going out in XX/XX/XXXX and XX/XX/XXXX. The policy renews on XX/XX/XXXX annually. In XX/XX/XXXX, the payment was not made by NYCB until XX/XX/XXXX, so I had to pay on XX/XX/XXXX to avoid a lapse. In XX/XX/XXXX, payment was not sent until XX/XX/XXXX, and I again had to pay on XX/XX/XXXX ( XX/XX/XXXX was a Sunday ) to avoid a lapse. I have spoken to the escrow department at NYCB several times and have never received a satisfactory explanation as to why they are not paying on time, even though the money is fully available in my escrow account. I even tried to have the escrow discontinued so I could pay the bills myself and they would not allow me to do this without charging me an exorbitant fee. I think I should be able to discontinue my escrow without penalty or fee since they have demonstrated that they can not pay the bills on time.

I applied for a mortgage refinance with New York Community bank XX/XX/XXXX with a 60 day rate lockin. No one from the mortgage department communicated me the status on the loan after repeated attempts. Finally after speaking to management my loan was approved and closing was confirmed for XX/XX/2016, however, even after confirming the closing time, date and place the bank representative did not show up at closing and never bothered to communicate to us that closing would have to be postponed. ( UNPROFESSIONAL on the part of bank and Title company ). NYCB mortgage company points a finger at the Title company ; maybe it was the title company but NYCB mortgage still failed to communicate to me the customer that the closing would have to be postponed. I went to the bank branch for a closing with the appropriate documents and closing money and no one at the bank had any idea about a closing to be done at that branch, ( again NYCB mortgage department failed to communicate with the NYCB bank branch ). NYCB Mortgage Company operates in a very unprofessional, unethical and incompetent manner. I ended up cancelling my mortgage application and went with a mortgage broker and got better service.

I secured a XXXX XXXX home equity loa n XX/XX/XXXX fr om AmTrust Bank in XXXX XXXX , Fl. The loan was to be paid off within 15 years from the date of the loan. There was never a discussion or agreement or notification that the loan provided the bank the right to call for full payment anytime after the first year. M y Father passed, and I took over a Real Estate prop erty he owned in Arizona. For the last 8 months, I have been dealing with two Mortgage Service Companies, who have violated Federal Successor In Interest laws on Several Counts. The property had two mortgages. I have been told by the bank that I can not do so on-line but, rather, must travel to my old branch in XXXX XXXX, XXXX in order for them to allow me to move the money to my checking account. Until I do so, the {$15000.00} effectively is frozen, and I can not access it. I believe this travel requirement imposed by my bank to be an unfair and illogical requirement ( the bank can easily verify my identity over the phone ), and an extreme hardship for me. It will take me all day to get to the branch and back home, and the long car will be difficult and in fact painful for me. I ask that you assist me in this regard by requiring the bank to allow me to transfer my own money to my checking account.

I am unable to access my account information with customer service. They indicate that I do n't have security questions/answers on file, therefore they ca n't verify my. Never have I been presented with the ability to complete said security questions/answers. The account was originally created with AmTrust who was then acquired by New York Community Bank. Since then, I 've been locked out of my account via their website and can not get assistance on the phone due to the lack of said security questions/answers. I do n't receive paper statements, they are online only so I have no visibility to what is going on with the account. I was n't too concerned about this since I have n't used the account in several years. Yesterday I received a overdraft notice in the mail on the account for {$8.00} and customer service ca n't assist me in determining why/how, again due to the lack of said security questions/answers. My XX/XX/XXXX mortgage payment is being reported as past 30 days due on my credits history even though I have proof of payment delivery on Saturday, XX/XX/XXXX. The mortgage company, New York Community Bank ( " NYCB '' ) has responded to my written inquiries that although the payment was delivered to the payment address of record on XX/XX/XXXX it was not received on a business day and therefore it is posted on the next business day which was XX/XX/XXXX. It is my assertion that the payment receipt date should drive the credit reporting date to determine late payments not an arbitrary payment posting date determined by the financial institution. The fact that the financial institution arbitrarily posts a payment in their system based on business day does NOT change the fact that my payment was received on a XX/XX/XXXX and should be reported as 30 days past due on my credit report. I made a mobile check depost on XX/XX/2017 at approx. XXXX in the amount of {$150.00}. The following day I received an email from my bank that stated " The funds will be held for an extended amount of time because you did not write NYCB Mobil Depost below the signature line. Money Market Account with Ny Community Savings - withdrew remaining balance and brought account to XXXX. Requested account closure via telephone 6 times, to no avail. Bank then charges series of minimum balance fees on a XXXX balance account. Bank credits {$1.00} in interest earned on prior balance. Instead of crediting my checking account with the interest and closing money market the bank waives one of the fees, charges more fees putting the account into overdraft for {$28.00} and conducts an unauthorized EFT from my checking account for the {$28.00} to pay their fees. This is an unfair practice that aims to increase fee revenue at the expense of the consumer. The account was at a XXXX balance and the bank posted {$1.00} interest. There is no clear justification to begin billing low balance fees on a XXXX or residual interest balance. Stop this practice.

New York Community Bank has our house mortgage. We sustained damage from hurricane XXXX and had to move out of the house. The insurance company required us to send the repair checks from them to the bank. This was to insure that the money was spent to fix the house. We finally signed a contract two weeks ago to start repairs, but the bank has been dragging their feet. We have sent everything they asked for- the contractor 's license, tax form, a copy of the estimate and contract. But, every time I ask them where the money is to get started they say they still need information that I 've already sent. I 've read where they do this to make interest on the repair money. In XXXX 2009, my wife and I declared Chapter XXXX bankruptcy. To my recollection, we did not include the mortgage in our filing, as we wished to remain in the residence. Dear CFPB : When I went to check my Credit Report and FICO Score I noticed that I had over 13 late payments for my mortgage. I have an automatic payment plan with my bank that pays this mortgage payment on time every month for the past 10 or so years.

I sent a RESPA Letter to New York Community Bank and when I received their response it was incomplete but showed that when then took over XXXX XXXX XXXX Account 's ... New York Community Bank was receiving payments but NOT posting them timely to my mortgage account. In addition, New York Community Bank withdrew every penny I had in escrow to cover fees that they said I occurred for the 'late payments '.

I asked them to correct this information over a year ago and refund the escrow monies. I have not heard a word.

I requested elimination of the PMI imposed on my property since 2004. The property was bought for XXXX and the lender, New York Community Bank based in XXXX has been denying the removal of the PMI. New York community Bank which took over Ohio savings bank has pushed their Elite banking every time I go to a different teller or re-up a CD. Recently I received a mailer asking that I join the Elite plan and get the better results in interest. You have to keep your balance at over XXXX and the increase in interest only affords you a payout of XXXX dollars a year. In the Mailer it explains in very fine print that the accounts are transferred to XXXX. That was never mentioned before and the cover letter is on Bank Stationary which mentions FDIC.
