Dear Sir or Madam, 1. GRNTE XXXX XXXX Account Number:XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in 90 days late in XX/XX/XXXX and 120 days late in XX/XX/XXXX and XX/XX/XXXX as well as 150 days late in XX/XX/XXXX. I immediately disputed this information with GRNTE XXXX XXXX and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. Good Day. Regardless of the name, and or title Granite State Management & Resources ( GSM & R ) would like to proceed under. The fact is, you all inquire about alleged debts and that inquiry is to indeed collect those alleged debts which makes you all Debt Collectors and if you are perceived as Debt Collectors you fall within the provisions of the ( FDCPA ) Fair Debt Collection Practices Act and Must abide those Laws because they govern you as debt collectors or even a Student Loan Servicer. On XX/XX/20 I previously demanded Validation of these alleged student loan debts according to 15 U.S. Code 1692g - Validation of debts. Granite State Management & Resources ( GSM & R ) responded on XX/XX/20. But the response did not contain Any documentation of requires validation of the alleged debt under 15 U.S. Code 1692g - Validation of debts. I the Consumer XXXX XXXX XXXX will ask once more for the validation of the alleged debts that Granite State Management & Resources ( GSM & R ) seems to be certain they can provide as it is Federal Law that you be able to provide validation for any alleged debt you inquiry from me a Consumer according to 15 U.S. Code 1692g - Validation of debts. Dear Office Executive. My name is XXXX XXXX, and I have received multiple letters in the mail and phone calls from companies such as yourselves wanting to collect an alleged debt. I am confused about what appears to be the same alleged debt coming from multiple sources. In regard to what seems to be a Student Loan. In order to narrow my confusion, I am requesting Validation and Verification of the alleged debt in its entirety from Granite State Management & RES. I have been incorrectly charged {$490.00} of student loan origination fees, and after more than 2 months or repeated phone calls and emails the charge has not been corrected. On XX/XX/2020, I received disbursements of two loans. The first was a direct unsubsidized loan in the amount of {$19000.00}. The second was a direct XXXX XXXX loan in the amount of {$6800.00}. My loan servicer for these loans is Granite State Management and Resources. The master promissory notes for both these loans provided for the cancellation of each loan and associated fees if the amount received in the disbursement was returned within 120 days. Pursuant to the 120-day provision, on XX/XX/2020, I made a payment of {$25000.00}. I made the payment by calling the GSMR customer service phone number, and requesting that the 120 day provision be applied. I specified that in my account {$18000.00} should be applied to Group A loan 3, and {$6600.00} should be applied to Group B loan 2. The customer service representative and I determined that the {$25000.00} payment reflected the full {$25000.00} balance of the loans minus {$490.00} of loan origination fees that would be canceled pursuant to the 120-day provision. Although my account reflected the payment, the origination fees were never canceled on my account. The payment was incorrectly applied as a full payment of the {$6600.00} from Group B loan 2, and a partial payment on Group A loan 3 that left a {$490.00} balance. That remaining {$490.00} balance reflects origination fees from both loans that should have been canceled but were not. I have contacted GSMR customer service over phone approximately 10 times in the last two months with no resolution of this problem. Approximately 8 of these calls have been to a representative named XXXX ( extension # XXXX XXXX, who claims she has repeatedly tried to resolve my problem by working with other GSMR personnel with no success. In a call with XXXX on XX/XX/2020, XXXX said her manager XXXX said I should send an email describing the problem to the GSMR customer service email, and that I should expect the incorrect loan balance to be resolved in 3-5 business days. That same day, I sent the following email to XXXX : Hello, My GSMR account number is [ redacted ]. I made a payment of {$25000.00} on XX/XX/2020. Per the 120 day loan cancellation rule, I am requesting that you reapply my payment to fully pay off the principal of my Group A loan 3 loan, and my Group B loan 2 loan. Of the {$25000.00} payment I already made, {$18000.00} should be applied to Group A loan 3, and {$6600.00} should be applied to Group B loan 2. This will result in the full payment of the principal and the cancellation of the {$490.00} in origination fees that were accessed on the disbursement of those two loans. If you need any additional information from me, please let me know. Thank you, [ Signature redacted ] On XX/XX/2020 ( 8 business after my email ), I called XXXX again, who confirmed that the email had been received, that she had checked my email to confirm it had the necessary information, and that the request was being processed by the appropriate GSMR personnel. She said my account would likely be updated by XXXX XXXX. I informed her that if my incorrect loan balance was not fixed within the next week, I would send this complaint to the Consumer Financial Protection Bureau. Today is XXXX XXXX, and I am now submitting this complaint in the hope it will finally result in my problem being resolved.

XXXX XXXX XXXX XXXX XXXX who was bought out by XXXX XXXX XXXX was charged with engaging in widespread misconduct that violated state consumer protection laws and/or made widespread substantial misrepresentations about its educational programs, both of which are grounds for borrower defense to repayment under the borrower defense regulations ( 34 C.F.R. 685.206 and/or 685.222 ). The below message was just received by me on the XXXX and Granite State Management are telling me they don't abide by the same laws and regulations of the federal government. The College was charged with fraud that violated consumer protection states laws that I should be protected by. If they ( The College ) didn't make such widespread accusations I would of never took out the private loans to attend to the college. ___________________________________________________________ XX/XX/XXXX Dear XXXX XXXX : Subject : Student Loan Discharge Based on Borrower Defense Evidence The Department of Education ( " Department '' ) has determined that the loan ( XXXX ) you received to attend a school owned and operated by XXXX XXXX XXXX from XX/XX/XXXX through its closure in XX/XX/XXXX are eligible for full loan discharge. My student loans were held with Granite State Management and Resources in the State of NH. In XXXX of XXXX I had corresponded via email ( I have the emails ) regarding my loans that were about to go into default. I was unaware that had been the case as I'd been going through a very difficult divorce in all of XXXX and into XXXX as well. My understanding was my loans were at that point placed into forbearance and I didn't hear from GSMR again after that. In XXXX the pandemic hit and these loans qualified under the Pandemic relief or Pandemic forbearance. Again, i heard nothing from GSMR during all of XXXX and most of XXXX. In XXXX of XXXX, suddenly my credit report took a hit and when I looked at the details, i noticed a company called " XXXX '' had listed my loans in collection. I thought, that can't be right and proceeded to spend from early XXXX to present calling back and forth between GSMR and XXXX to understand why loans that are under the Pandemic forbearance had suddenly been placed into collection in XXXX of XXXX. I made it clear that I knew my loans qualified, even though most of the phone calls with GSMR they tried to state they didn't qualify. I let XXXX know that they legally couldn't place my loans in collection and had to remove them and to which they told me that they weren't a collection agency, even though when you call them, they have a script they read about the call is recorded and is for debt purposes. I'm literally trying to have these loans removed from collection and delinquency on my credit reports and to have Trellis NOT violate the XXXX loan moratorium and place my loans back in the forbearance that they are supposed to be in per President Biden. I'm at the end of my rope here and ready, but not wanting to call a lawyer. It's affecting my credit and so is thinking that my loans were in forbearance according to GSMR back in XXXX, but it doesn't sound like they ever placed them in forbearance. I need a lot of help to get these loans rightfully placed in the pandemic forbearance that they should be in and my credit score to improve as a result. I filed disputes with XXXX. XXXX and with XXXX and explained all of this as well and XXXX and GSMR are not complying with those credit bureaus. I contacted the NH XXXX 's office which recommended hiring a lawyer. Should i have to pay a lawyer to get my student loans in their rightful place per a federal student loan moratorium? This is utterly unfair.

We co-signed a loan agreement for our daughter for the XXXX school year for approximately XXXX with the New Hampshire higher education loan corporation XXXX The initial loan disclosure notice as well as the final loan disclosure notice clearly set forth that we selected the interest only payment option which reduced our loan rate from XXXX XXXX XXXX XXXX % with payment to begin as of XX/XX/22 for {$190.00} a month and if we set up auto deduct, it would reduce our interest rate further to XXXX XXXX. We are unable to set up the auto deduct and currently facing a higher interest rate of XXXX XXXX and not the bargained for XXXX XXXX because the lender will not make the auto deduct option available until the loan is fully disbursed. By the time this happens we will incur significant interest payments as the interest compounds on the loan. In response, lender has acknowledged that the financial disclosure form as well as he loan terms document are incorrect but that they are not going to honor the original terms. All they advise is that they are planning to fix the disclosure form moving forward but that does not help consumers like us that signed up per the original loan documents. They violated the truth in lending disclosure act by not honoring the terms and not making it clear that loan payments would not restart until full disbursement. The XXXX XXXX XXXX was specifically designed to prevent this type of bait and switch from occurring by ensuring that key loan terms are clearly laid out in simple plain XXXX. We are not seeking anything different from what was included in our financial disclosure form and that the loan servicer and originator honor the original commitment. The company has acknowledged that the form is incorrect and confusing, yet refuse to honor the agreement. As a result of the clear bait and switch, we along with other hard working families will be on the hook for significant interest payments that will compound with the principal and put us in more debt.

In XX/XX/XXXX contacted Granite State Management spoke with XXXX a service agent due to an error on my part was calling to fix payment schedule. We were able to adjust using the Covid19 payment relief available. While looking at my loans She mentioned consolidating my loans as I had two or three that were not part of my already consolidated balance. She mentioned something about consolidating will make my loans eligible for the possible relief programs that was being discussed by the government. What was not mentioned was that if I consolidate my loans all of the Income Base payments I have made over these years will reset to zero! I am waiting for the data to show how many years into the IBR repayments I am on my loans I don't have the exact number. I've been trying to pay my loans for 21 years. Based on Studentaid.gov website my loan servicer is suppose to track my qualifying monthly payments and years of repayment and notify me when I am getting close to the point when I could qualify for forgiveness 20 years or 25 years of any remaining loan balance. I may still be a few years away from this but I was NOT told I would loose my payment history if I consolidated. I was not able to to stop the consolidation with XXXX XXXX, I called on XX/XX/XXXX and spoke with XXXX a supervisor in the loan disbursement area ; and they were not able to stop the consolidation. Which means my loan payment count starts over at 0. At XXXX XXXX XXXX I've lost what little momentum I had. There was no warning from the loan servicers or from the Studentaid.gov that I would loose all payment history on my loans when I consolidated my loans. Also I do not understand why my loan balance has not gone down under the IBR plan. In the 22 years I have been with Granite State Management. I have been making payments but have not seen any movement in my loan balances. I don't understand how the government can set us up for failure in repaying these loans. Please help. XXXX XXXX

In XXXX, my husband and I consolidated our student loans, otherwise known as spousal consolidation. At that time our combined loan balance was {$110000.00} with an 8 % interest rate. Today, despite paying a total of {$130000.00}, our balance is {$220000.00} and growing. Although we both have the required amount of payments as educators, we are excluded from the Public Servant Loan Forgiveness program, because of the spousal consolidation. Additionally, our balance continues to grow because of outrageous capitalized interest rules under the income based repayment plan which is intended to support borrowers with manageable payments. When we are in our XXXXs and set to retire, that inflated balance driven up by predatory interest will become taxable income under the XXXX plan. At that time we will have likely paid our loans back twice over, but the balance will be close to {$300000.00}. In no other industry would it be ethical to collect five times what was borrowed. We have spoken to our loan servicer many times and have been encouraged over the phone and via written communication to apply for PSLF, however we continue to not qualify because our loans are in spousal consolidation. We have attempted to convert them to a direct loan, but that is impossible under the law. In XXXX we were led to believe that we were being financially responsible by consolidating our loans, but it has turned out to be a discriminatory and predatory step that was allowed by the government for a short time. Spousal consolidations were ended in XXXX with no way to detangle and with no inclusion for loan forgiveness options offered to others.

Granite State Management and Resources spontaneously stopped processing electronic payments for approximately a 4 mo period between XXXX XXXX and XXXX XXXX ( after 13+ years of not missing a payment ). They then spontaneously started working again. During this timeperiod I made multiple attempts to pay my loans ( above the minimum payment, an adjustment that started the issue ), received confirmation that the payments when through ( there were sufficient funds during this timeperiod ) and then 10-15 days later they failed to process them, didn't communicate directly with me ( as they had when they worked ). They used 3 different electronic communication methods during this time, one of which was a secured notice via an email notification that expired and was deleted from the history page on line within 4 days of being sent. GSMR failed to respond to my queries and then reported my account to the credit agencies as 90 days late. This came in as a duplicated delinquency as it was a consolidated loan, noting here there was no way to separately pay these accounts through GSMR. GSMR has been unwilling to address the issue and customer service has led to the same individual who is incredulous and rejected my request for review before receiving any of the supportive information where I had detailed this issue chronologically. If you had similar issues during this timeperiod please report it to your state attorney general and on this forum. Prior to this issue I had a perfect payment history and a credit score in the mid 800s.

I've been disputing fraud accounts on my credit report since XX/XX/2021. I keep sending multiple sets of letters to the bureaus and the creditors so the excuse of " we didn't get it '' doesn't happen. Furthermore, each letter is certified mail with tracking and each letter shows signed and delivered and yet the bureaus are still not taking any actions. The accounts are not showing in dispute nor are they removed from my report. The accounts always show up with different name variations and different account number variations and yet the bureaus seem to ignore the trend and let these fraud accounts affect my credit score. I have requested the investigation to be initiated and also verifiable proof to be submitted should the account claim to be mine. Not only have I not received any mail showing the verifiable proofs needed to justify the accounts to be on my report, I haven't even received any letters at all stating the investigations have begun. Per the FCRA and federal law, the process is supposed to be 30 days. 60 days later, I'm still here shelling out money for certified mail with no end in sight and no results to show. This is my last option before I take this up with my lawyers and sue for full compensations and damages incurred. Finally, it seems that when these complaints are submitted, the bureaus are using the excuse that they " can't confirm my identity '' to get away with taking no actions on my credit report. From XXXX I have struggled and struggled with this company. Used to be granite state- they constantly were telling me on the phone to put loan into forbearance and said interest wouldnt matter. I listened and did as directed. That interest sure crept up after every forbearance ended and another one started. I struggled making payments. customer service was only about forbearance. I had to consolidate since granite wasnt going to be a company much longer from word of mouth. Now I have huge monthly payment, cant afford it. I sent a dispute straight to Granite ( XXXX XXXX XXXX ) about late payments they were reporting on XXXX. I sent multiple disputes to the bureaus XXXX, XX/XX/21. I can not get a response from Granite via mail. i can not access their online account. i get notice that they sent me an account message that says they will complete my dispute within 24 hours then nothing.
