In XXXX XXXX, the offices of XXXX XXXX XXXX, XXXX seized my assets in XXXX XXXX XXXX on behalf of XXXX XXXX XXXX XXXX assignee of New Century Financial Services , Inc XXXX XXXX with an alleged judgment from XXXX XXXX. Multiple phone calls to validate debt was not returned with any written documentation of debt, Their office simply stated on the phone that the matter was an issue related to a judgment entered in XXXX XXXX and gave me the case file to get my own documentation. I later learned the judgment was vacated in XXXX and I had the judgment vacated again in XXXX. The plaintiff pursued the matter after the second vacated judgment even though it knew it had not provided any documentation to the validity of the debt after 2 months of legal action. They sought and were rewarded additional time by the courts to delay my proper remedy by the court which incurred XXXX trips more than necessary t defend the matter and to obtain satisfaction in regards to my counterclaim. Although I submitted all documentation necessary to prove that I had actual damages, the plaintiff lacked any meritorious defense the judge determined that the case lacked sufficient documentation to prove wrong doing. First according to FDCPA the collection agent is to submit documentation to validity of debt, I proved that the plaintiff submitted no documentation to support claim to debt, not within the original 14 days of request or the entire court case history in XXXX. Secondly, the collection agent pursued legal action without any consultation about the debt with consumer prior to seizing assets. Third, the seizure of assets was committed using FALSE information obtained from ecourts XXXX system which validated a history of a judgment but not the status of the judgment. The assignee did not validate the debt by requesting history of payments or original documentation of contractual obligation prior to seizure. Fourth, Plaintiff submitted a false document as authentic in the submission of the restraining notice to the XXXX legal offices which is a violation of New York State Criminal Law. Fifth, the plaintiff 's attorney, XXXX XXXX XXXX, XXXX, which acted as the Collection agent committed an act of fraud and a violation of professional conduct by not validating the status of the judgment since the ecourts XXXX system stated to " See File '' for status of the original judgment. It was within their purview to validate prior to proceeding with legal action. Finally, the judgment was vacated twice by the court after multiple attempts to validate the authenticity of debt. The vacated stated was granted on XXXX/XXXX/XXXX and XXXX XXXX. The plaintiff had ample time and opportunity to reduce the injury to defendant by doing proper processing of the court case 's documentation instead they requested two adjournments to prepare for the case which further injured the defendant by requiring multiple visits to an out-of-state- court to provide defense for her suit against the illegal actions of the plaintiff.

I am XXXX years old living alone on social security. I learned Judgment XXXX issued against me. I tired to make payments but unable to pay rent, buy food or cover my XXXX XXXX XXXX, medicine and had to stop. These high payments toward the Judgment made it impossible for me to pay for medication that is over {$1000.00} per pill. Without correcting the reporting of this Judgment the sale of my deceased brother 's estate is prevented. That property ; XXXX XXXX XXXX XXXX NJ. fell into disrepair and is in bank Short Sale. It must close Title so the outstanding mortgage debt will be discharged. If not - it goes to Sheriff 's Sale. Its mortgage debt will liquidate the value of my deceased brother 's home at XXXX XXXX XXXX. XXXX, NJ and there will be nothing left to help settle the judgment since this property has equity and I have nothing. I tried to ask New Century Financial Services to help correct the report but they do not answer my requests. I contacted their law firm XXXX and XXXX but found my letters were never answered since they closed business. The Estate 's real estate broker discovered the name of their new firm but they have not answered. A credit disaster can be stopped if they release only XXXX XXXX XXXX from the Judgment so its not sold at Sheriff Sale. Sheriff Sale takes away all the remaining estate 's value in XXXX XXXX XXXX. XXXX NJ. Judgment XXXX needs to be specifically placed against it alone. Credit reporting has to show its released from XXXX XXXX XXXX XXXX NJ and specifically..record Judgement XXXX on XXXX XXXX XXXX. XXXX NJ. My brother XXXX XXXX. I am the only heir and struggling to complete a short sale to avoid a deficiency judgment against what is left in the Estate. The only thing of value I have is what will come from the sale of XXXX XXXX XXXX. XXXX NJ. I won't be able to make any payments on the XXXX if the short sale fails and a deficiency judgment is placed on XXXX XXXX XXXX. XXXX the remaining value of that property will be lost. I want to settle what is owed on the judgement but without New Century Financial Services cooperation in updating the reporting with a specific property lien, I have no prospect of having any money in the future to make a settlement of payments of the judgment.

NEW CENTURY FINANCIAL SERVICES, INC. tried to garnish my wages XXXX within this letter it referenced a Docket Number XXXX XXXX I researched NJ courts website and found that there was a Civil Judgment against me XXXX XXXX . I had no knowledge of this judgment, I was never served, I had left the state of NJ XXXX XXXX when I relocated to MI. I contacted several lawyers in XXXX to appeal the Judgement, and have it vacated. No lawyer would take my case " As it was n't worth it, as the alleged debt was {$460.00} and their fees would be in excess of {$2000.00} ''. I wrote a lette XXXX XXXX XXXX XXXX to the XXXX court to the presiding XXXX explaining my situation, I had this letter notarized and wrote a statement at the bottom stating that all the above was true etc. I submitted my XXXX form for XXXX from my employer in XXXX and a copy of my lease, reflecting my MI address. The courts scheduled A WAGE EXECUTION Hearing XXXX XXXX XXXX XXXX n front of XXXX XXXX XXXX XXXX . I could not attend the court hearing and phone the judges clerk who advised me to submit a fax stating the reasons. I requested if I could attend via telephone, this request was denied. I believe the ruling was that the judge denied the wage garnishment, however when I contacted the courts, I was told that I had wavered my rights to know the outcome as I did not attend. I have looked on the XXXX courts website and as far as I can understand it was " Disposed ''?? I recently contacted the court and requested the case files, which I am waiting on. Is there anything that I can do? I feel helpless, this has negativley impacted my credit score . It will continue to be reported until XXXX . I can not understand how this can go this far without my knowledge. I was never contacted regarding this debt prior to XXXX . I have spent time and money trying to rectify this situation, all to no avail. New Century Financial filed a judgment against me on XX/XX/XXXX at the XXXX. # XXXX. This judgement is now displayed on my credit reports ; XXXX, XXXX and is still causing damage to my credit. I was not served properly of this notice of judgement in XX/XX/XXXX. Second, I contacted XXXX on on XX/XX/2016 to set up a payment arrangement because XXXX Credit Bureau told me they are the owner of my account. After doing some research and finding this firm was Sued by CPFB for XXXX for making false false or empty allegations about consumer debts, Filed lawsuits based on unreliable or false information, Harassed consumers with unsubstantiated court filings which I am now a victim of. Since I filed a complaint with the CPFB ( Consumer Protection Federal Bureau, I just received a letter from them stating the they " previously advised, me that XXXX is the new owner of the judgement after being reported to CPFB. XXXX has now sold my account to another third party. XXXX is now telling me if I do n't keep my arrangement I will be responsible for addition filing and court fees. XXXX also states that they do not report judgements or law suits to credit bureau agencies which is not true.. I want this judgement removed from my credit report because I was improperly serviced, the number to the court where the judgement is filed does n't exist because I tried calling it to verify this information. Every thing about New Century and XXXX action does n't feels right. Therefore I am going to follow up with legal counsel about this matter concerning my legal right sue. Beside I am on XXXX with a fix income how would I be able to afford these outrages fees that these firm are forcing on me.

I am being sued by XXXX XXXX XXXX XXXX XXXX for a credit card debt in the amount of {$9000.00} on XX/XX/XXXX in NY XXXX County First District Court. As of today the debt is {$12000.00} with interest. I have no knowledge of this debt. They are representing Creditor ( s ) : ( P ) XXXX XXXX XXXX XXXX New Century Financial Services Inc. I answered their complaint on XX/XX/XXXX asking for debt of ownership and proof of debt. After that, I have not heard anything from them or the court till XX/XX/XXXX then the court asked my income. When I went the court to see all the files in the case folder, I have seen they obtained default judgment against me on XX/XX/XXXX. The reason they could be able to obtain the default judgment is because I was not aware of the hearing so I never showed up to the hearing. I disputed all claims and complaints against me officially by writing an answer by filing with the court on XX/XX/XXXX. Till today I have written 3 more answers/ questions and filed with the court. In all of my responses I have asked them to provide me the debt of ownership, the credit card agreement and debt validation. They could not provide me any tangible proof regarding any of these requests. Yet this court proceeding is still ongoing. I am a XXXX XXXX XXXX resident. Received this week a lien on my account for {$1000.00} for an amount due to XXXX of {$5600.00} for a XXXX DEBT apparently. I have not had a XXXX account in over XXXX plus years yet they were able to get into my account without a legal document presented to me. This morning XXXX XXXX XXXX put a double lien on my account for {$9800.00}. I had less than {$4000.00} in my account. Now I can not use my banking account as it is blocked and overdrawn for {$9800.00}. I have asked the law firm XXXX, XXXX XXXX XXXX to provide back up documents and have not heard. They said they had to ask XXXX. They should have had this already if they put a lien on an account. They claim to have had this since XXXX. Even if there is a debt it is way beyond the XXXX XXXX XXXX Statue of Limitation and they refuse to hear this. They simply say pay the debt. I will not pay on something I do not remember. I have no records dating back XXXX plus years. I want my account restored but XXXX XXXX XXXX who says I have to resolve it with the suing law firm. The law firm refused to work with me. Please be advised that I have been a victim of a Rip-off from New Century Financial and XXXX XXXX ( the XXXX public records in the Court ) New Century Financial Services is a Collection Agency that 's committing Fraud, using XXXX XXXX XXXX They manage to get my Social Security and my information. Once your name is given, New Century Financial Teams up with XXXX and XXXX which is a law firm located in XXXX NJ and XXXX and XXXX is involved in the XXXX. XXXX & XXXX goes to the court and file factitious and fraudulent judgments against taxpayer. I find out that the person who contact my agency in XXXX works in the Court and also with XXXX and XXXX. They have a scheme where they would constantly Harass and embarrass the taxpayers to the point where they are calling taxpayer 's place of employment and in violation of Federal law. I send a report to the Consumer Affair reporting this case what they did to me, but no ones response yet. Please note that these XXXX account has been paid in full. ( I been calling the person that contact my agency and XXXX and XXXX so they can remove this from my credit ) and now nobody appear. Upon moving to XXXX XXXX recently after residing in XXXX XXXX for 7 years I have never heard of this debt that seems to be something from 2007. I divorced and was driving a twenty year old car so I was looking to purchase a used car that was more reliable so this company XXXX XXXX XXXX contacted me right after I was at dealership, so they ran my credit. The only thing they have done was one phone call to verify my employment and then a judgement to garnish my wages which seemed so harsh being I honestly new nothing about this. Its been ten years how can this happen and when I went to the court because they would n't even tell me what it was the court did n't even know what the debt was from all they said was it looks like maybe it was some kind of credit card. Can this happen so drastically this would literally put me in a terrible place financially I 'm barely surviving now. Apparently upon research this company buys old debt and just takes extreme measures to get paid I wonder myself if they keep it. I really feel helpless obviously I ca n't afford an attorney. Third party collection agency New Century Financial Services, filed a judgement against me to claim a debt from XXXX to place a wage execution order. According to the judgement this claim was from XX/XX/XXXX. I paid the judgement in XX/XX/XXXX to a collection agency. Additionally, there was no written notices prior to this regarding an opportunity to set up payment plan. Judgement creditor did not provide me notice prior to escalating it to wage garnishment and the agency never contacted me. When I called for more information regarding the wage garnishment order representative could n't provide me with my DOB and address and asked for my social security number. Additionally representative stated that I physically spoke to someone from XXXX XXXX XXXX XX/XX/XXXX to make payment arrangement. This claim is completely false, I have never spoke to anyone from New Century Financials, Inc. or any other firm pertaining to this matter in person. There was no XXXX transactions in my credit report. Creditor XXXX has never sued me in court to obtain a money judgement against me for garnishment wages. I requested in writing a demand for a bill of particulars to include the unpaid balance on the account, proof the Plaintiff owns the account and they have never sent me this information.

XX/XX/XXXX the debt collection agency Century Financial Services through their law firm XXXX XXXX XXXX obtained a judgment against me for credit card debt I defaulted on. Since then and at least on four occasion they offered me settlements that I never answered to. On XXXX XXXX, XXXX then sent me an information subpoena that I answered to because they were saying that I might be arrested if I did not reply. Later on after they got my answer they called me on my cell telling me that they did not have XXXX but XXXX judgments for a total of more than XXXX. To avoid to get myself in trouble I told them that I did not know what they were talking about and ask them to send me all information by mail. Rather than sending me the requested information on XXXX/XXXX/XXXX they notified me that they were applying for a wage execution order at the XXXX, XXXX County Court. The reason of my complaint is that I know Century Financial Services buys defaulted accounts from credit card companies in bulk for pennies to the dollar, then inflates the debts with various service charges before attempting collection from people like me. I do not understand why Century Financial and XXXX XXXX XXXX engage in such activities while your organization has ordered them to stop on XX/XX/XXXX.

Today I received a notification from my HR department that they received a Creditor Garnishment to garnish my wages. They included that it was their legal obligation and enclosed a copy of the withholding order for my records. I was mortified that my employer was involved in something like this but also completely confused as I read over and over the court order. My current credit situation is under control so to receive this notice I was surprised. The court order held no information at all to what this was regarding. I did not recognize the amount, the company or dates. There were even errors listed i.e. Total Due XXXX/XXXX/2015, Date Issued : XXXX/XXXX/2015. Immediately I called the lawyer that is representing the plaintiff and they told me to contact the Court Officer for the account details. It is all unsettling and confusing. This is the first time I am being notified legally, and through my employer. After feeling lost, I went to the internet for answers on who New Century Financial Services and XXXX XXXX XXXX are and discovered even more unsettling details. I am writing to you in hopes to rectify what is being done to me. These payments are being taken out of my check next payroll and there is nothing I can do to stop it. Please assist.

The debt {$17000.00} was collected and satisfied through bank levy. On XX/XX/XXXX I received an empty certified mail ( not return receipt ) envelope from XXXX, XXXX, XXXX XXXX. XX/XX/XXXX I received a certified mail package From New Century Financial, XXXX, and Superior Court of New Jersey, XXXX XXXX containing Motion to Revive Judgement for {$17000.00}, plus XXXX costs, and {$7600.00} in interest. New Century Financial remained Plaintiff, despite disclosing in the filing that the debt had been transferred to XXXX XXXX XXXX. Therefore, we respectfully submit that XXXX ) this debt was paid by bank levy, 2 XXXX XXXX and New Century have fraudulently transferred the 'debt ' to a third entity. 3 ) despite this they have defrauded me and the court by representing that I was served according to the rules of the court, making false statements to the court ; claiming they had standing in the matter, and unconscionably adding costs and interests to a debt they had previously collected.

I received a letter from the payroll department last week at work that they had received an order to garnish a percentage of my wages due to an alleged debt that I owed. This communication allegedly came to them from from XXXX XXXX XXXX XXXX on behalf of New Century Financial Services. This was the first I heard about this alleged judgement of Wage Execution and had received no prior communication about it. When I called New Century I was told that the {$11.00}, XXXX. XXXX debt now belonged to the law offices of XXXX, XXXX XXXX XXXX. I called that office and was told that the debt was from XX/XX/1994 and attached to a XXXX XXXX and that the judgment was against my ex-husband and me. I did not take out this credit card and was unaware of any debt attached to it. They have now started garnishing my wages, effective XX/XX/2018 because I am employed and my ex-husband -- who I have been divorced from for nine years -- is not. This is not my debt and I was never notified about this debt from anyone. I want the wage garnishment to be stopped immediately. I tried resolving this with XXXX, XXXX XXXX XXXX and they told me because my ex-husband has no assets to garnish they are coming after me.

I understand that debt collectors buy and sell 'alleged ' debts frequentlyHowever, in the state of New Jersey `` The statute of limitations runs out inXXXX XXXXafter six years for mostdebts. Even after that period, a creditor has the right totry to collectadebt '' I understand that you have a job to do Officer XXXX XXXX XXXX XXXX XXXX NJ OfficeOfXXXX ( but what I would like to say is this : My wages being garnished are not the issue, the issue is attempting to strong arm my employer that has nothing to do with this, The re-selling of old debts is very antiquated. Also viewing your documents with the plethora of stamps which seem to me as a " non- legalize individual '' are just notaries of which anyone can obtain. Since your firm was able to find me do a little further research and view the amount the times I've attempted to dispute this but to no avail. I enroll at XXXX XXXX XXXX XXXX in XX/XX/XXXX for a program starting XX/XX/XXXX ending XX/XX/XXXX. During my enrolling and attending classes at XXXX XXXX, I went out on a approve medical leave of absence from XX/XX/XXXX to XX/XX/XXXX. I went to school for about a week and a half before going out on leave of absence. I never establish a grade point average because I was out on leave of absence. I receive a letter from the college inquiring if I was planning to re enroll, I call my student XXXX and told him I was n't planning to re enroll because I was still in physical therapy and I was unable continue school in the future. Counselor said he would take care of the matter. I never receive any forms to state that I was withdrawing from XXXX XXXX.I did n't hear anything from the counselor, I receive a letter from XXXX XXXX XXXX representing New Century Financial Services , INC . I am being sue for {$6600.00} and I strongly disagree on this debt because the college never followup on their own Cancellation and Refund Policy. My job received a letter from XXXX County NJ courts to garnish XXXX from my wages. My employer funrnished me a copy, this was the first I heard of this alleged debt. I called New Century Financial who supposedly purchased the debt, from another collection agency. As far as they could tell the original debt is from XX/XX/2003. I told her the practice to collect on such an old debt is at best unethical and at works illegal. I was informed that XXXX XXXX on credit card debt for 20 years which is a lie and illegal. Since she refused to help, I called the court house and they confirmed the original debt was from XXXX in XX/XX/2003. The Statute of Limitations is for 6 years on a credit card debt. This is 15 yrs old. Furthermore I do not recognize the debt, I do not remember having a credit card from XXXX ever. Therefore here has been no payment on the account that could possibly renew the 15 yr old fraudulent debt. The law firm of XXXX, XXXX XXXX XXXX XXXX XXXX is buying Zombie Debts and using unlawful practices to obtain money from people. Also the XXXX County Courthouse should have known better!

The actions are from XXXX XXXX XXXX, representing New Century Financial Services. XXXX XXXX XXXX sent a summons in XX/XX/XXXX to an address to which I had a furnished room in XX/XX/XXXX. I moved out of this furnished room approximately in early XX/XX/XXXX. I had no knowledge of this summons. The certified letter returned to court unclaimed XX/XX/XXXX. XXXX XXXX XXXX used regular mail as well. In XX/XX/XXXX, XXXX XXXX XXXX obtained a default judgment for the amount of XXXX - XXXX added interest and fees. They claim their client owns a debt from XXXX in my name. Sometime between, approximately, XX/XX/XXXX I received a letter from XXXX XXXX XXXX demanding I answer a questionnaire about my assets, bank accounts, and etc. at my current address. I was surprised, and I did not answer because I regarded their actions hostile, invasive, and questionable. About a year ago I was paying off old debts and XXXX XXXX XXXX had 1 of my debts. I called them to pay off one of the debts which I had known about. While talking to them they notified me of another debt that they had of mine. I told them I never opened that account and I never made any purchases with said account. They asked me if i wanted to dispute it and I said I did. Then they told me I would need an affidavit of fraud and a police report in order to do so. In the last year i havent gotten around to doing the affidavit of fraud or police report. 2 Weeks ago I had a levy of {$830.00} placed on my savings account. It was done so by XXXX XXXX XXXX for New Century Financial. The address they provided to the court was XXXX XXXX XXXX XXXX, NJ. I havent lived at this address in over 12 years and they had my current correct address on file bc I paid a debt just a year ago for XXXX XXXX for {$320.00}. Since I wasnt recieving any letters from the courts or law offices I wasnt able to answer them so they were able to get a judgment on me.

XXXX my bank account was seized by XXXX XXXX XXXX who are representing New Century Financial for a debt that I dont believe is mine. I got the courts to release the money on the XXXX asset rule and the debt was taken off of my XXXX report and marked satisfied on XXXX. At the time I thought it might be XXXX as the original creditor. A year later they have seized my bank account again and now they say the creditor is actually XXXX XXXX XXXX. I do not owe XXXX I dont even know who they are. In the meantime I can not get XXXX XXXX XXXX to prove validity of the debt. they claim it has to be mine because they were awarded a judgement that I knew nothing about. Original papers were sent to outdated address. How can I get these people to Validate this debt or at least leave my bank account alone. They have refused to help me get any information at all.

The company has sent multiple threatening letters indicating various grave consequences and presenting information in misleading ways. A previous letter they sent said failure to address a debt could lead to imprisonment. In their most recent letter, they state that they have no obligation to validate the debt as I requested in a letter to their office. I also informed the debt collector that the debt was most likely already out of the statute of limitations since the original judgement was made in 2004. They responded that debts can be valid for up to twenty years without confirming or denying whether the debt was ( 1 ) valid and ( 2 ) not outside the statute of limitations. They also claimed they have collected nearly 2k in a previous wage execution but I have no record in my bank accounts of any such action or event taking place.

I got a letter from a company new century financial services inc saying was sending a subpoena duces tectum without deposition to my credit union for a credit card that was fraudulently open in my name in XX/XX/2007. Learning this from the letter I put in a motion to vacate and set a hearing describing this is fraud. I never had a credit card, still DONT unless I can just put money on it to spend. The company New Century Financial Services have been calling myself multiple times daily for the past 6+ months. As well as having lawyers contact me on their behalf. They have also called family members phone numbers and contacted former addresses. Recently, they have threatened to take me to court. They have also sent a letter saying they put in an application for wage execution. I have been receiving false letters with a false docket number. Some letters going back to 2010, which is proof this is past the statue of limitations in the state of NJ. NEW CENTURY FINANCIAL has been garnishing wages from my check with the name listed as XXXX XXXX XXXX that is not my name nor have I ever done business with that company. I was a child the debt comes from 1999. It shouldn't legally even be listed beyond 7 years if it was. Its ruining my quality of life garnishing my wages for debt I didn't create. I received a letter from New Century Financial Services a debt collecting agency saying I owed a bill for XXXX in the original amount of XXXX. Then I was sent court papers sayin I owe {$1600.00}. I went to court to rectify the situation it was clarified that the debt was not mines it was settled on XXXX/XXXX/XXXX the motion was withdrawn by the plaintiff. It was a case of identity theft. Receive a garnish at work. Never had a court date to challenge the debts. This company had been taking money out of my bank account many time for debts I know nothing about. I filed a complaint with you against XXXX & XXXX and sent documentation of the paid debt to you. They were still allowed to take money out of my bank account and place holds on my motor vehicle registration until I paid the amount they listed. I received a notice of application for wage execution from this law firm through the courts but the notice did not say who the original debtor was, how much was owed, did n't even mention an account number so I could verify.
