We had our bank return a series of multiple fraudulent checks that we did not issue. Subsequently, we received letters from XXXX XXXX XXXX XXXX XXXX requesting that we pay them for the fraudulent checks they cashed. We contacted XXXX XXXX XXXX twice to let them know that the checks were fraudulent and were not issued by us. We then received a letter from Nelson, Cooper & Ortiz demanding payment for these fraudulent checks. Initially we thought Nelson, Cooper & Ortiz was a law firm based on the look and tone of the letter. The letter demanded payment in full for the checks and stated that failure to pay creates a presumption of committing an offense and this matter may be referred for criminal prosecution, that they checks will be submitted to the Justice of Peace for processing criminal charges and a warrant will be issued for your arrest. The letter also incorrectly stated that the checks were returned due to insufficient funds. Upon receipt of this letter, we sent an email to XXXX XXXX, the contact provided on the letter, informing that the checks were returned as they were not issued by us and that we were not responsible for the fraudulent checks cashed by their client. We received a short email response back stating they will update the case and will reach out if they have further questions. We then received a second letter from Nelson, Cooper & Ortiz labeled Notice of Investigation that threatened to make an onsite visit, record images of the facilities, contact banking institutions, creditors and vendors. It also threatened to seek reimbursement for all costs incurred, file liens on any property associated with the debt, file Writs of Execution upon judgement through the XXXX. Upon receiving this second letter, we looked up the company and found that they are actually a debt collection company as opposed to a XXXX XXXX.
