HE HAS NO PROPERTY INTEREST. XXXX XXXX HAS A SOLE AND SEPARATE PROPERTY, WHICH ACCORDING TO NACA WORKBOOK REQUIREMENTS WOULD HAVE BEEN TRANSFERRED PRIOR TO ANY NACA -- INVOLVEMENT, CONSUMATED PURCHASE AND SALE AGREEMENT, OR " CLOSING '', AS THE CASE MIGHT BE. THE DISCRIMINATORY DENIAL WAS BASED ON A MISREPRESENTATION OF MORTGAGE CONSULTANT XXXX XXXX XXXX, AND ACCORDING TO CALIFORNIA LAW, A VIOLATION OF A CIVIL RIGHT. After reliance on first meeting statements of representatives of the HUD Certified Counseling Agency Neighborhood Assistance Corporation of America 's ( Hereinafter NACA ), and the ADVOCACY HOMEBUYING HOME SAVE HOME BUYER 'S WORKBOOK ( hereinafter, WORKBOOK ) for preparation, four phone calls, many hours preparation, obtaining and e-mailing documents ),XX/XX/XXXXtwo trips totaling XXXX plus miles -- XXXX to an original required meeting, inXX/XX/XXXX, XX/XX/XXXXCA (XX/XX/XXXX miles round trip, 5 hours ). A Second mandatory step was attending a confirmed appointment to the Housing Counselor Meeting, XX/XX/XXXX, scheduled at XXXX XXXX XXXX XXXX XXXX XXXX California. ( XXXX miles roundtrip, 5 hours total ), which we did. At or about XXXX XXXX., that date, after completing additional paperwork, for the initial Housing Counselor meeting, the Secretary/office assistant handed membership agreements and other forms which were negotiated by XXXX XXXX and this writer. Inspecting the forms, the Secretary/office assistant raised an issue we understood and believed -- on investigated information and belief -- proved quite clear in XXXX separate paragraphs in the WORKBOOK, which had been received previously attending the above XXXX XXXX, XX/XX/XXXXmeeting -- present ownership interest in property. The XXXX XXXX assistant communicated by computer to whom she described as her " manager ''. We had mentioned " double escrow '' when assistant first raised the issue, to ostensibly her puzzlement. She ostensibly tried to thwart the meeting at the its inception, after we signed the membership agreement, and other documents, and our respective drivers ' licenses scanned. XXXX XXXX XXXX XXXX finally came out to greet and see us, professionally and courteously, and knowledgeable, with whom we spent at or about 45 minutes. With an MC before the name on his card, we discussed in his office WORKBOOK parameters, and the issue the Secretary/office assistant had raised ( see infra ), and our analysis of certain clauses. ( We later presumed " MC '' stood for mortgage consultant as well. And we had no problem with him ). We pointed to XXXX applicable WORKBOOK phrases and our plan with respect to them, inculcating several analyses of customs a usages of California real estate procedures. THE WORKBOOK STATED THE PURPOSE OF HOUSING COUNSELOR MEETING AGENDA, which included analyzing e-mailed documents, budgets, and other steps yet to be gone over. We had not gotten into any ACTION PLAN and the next steps. XXXX XXXX recognized our concern of XXXX seemingly, contrary clauses which circumstance ( potentially applicable only to XXXX XXXX ) had been mentioned by the office assistant, and our plain- meaning interpretation of them being read together. He consulted a stack of papers he identified as underwriting guidelines '', indicating in passing. " 'They ' will never qualify you ''. We pointed out those initial observations were in contradistinction of that published in the WORKBOOK. Requesting a copy of those underwriting guidelines, I mentioned that for those like we applicants who rely on the WORKBOOK, such guidelines should have been included in it -- words to that effect. MC XXXX replied it was an internal document. We said we still wanted to go through the procedures, and would take up any negating issues elsewhere, should need arise. Just as XXXX XXXX was about to begin the paperwork and process, presumably steps XXXX inclusively in the WORKBOOK, he said had to consult another mortgage consultant. NACA mortgage consultant MC XXXX XXXX XXXX came to the area. She immediately precluded that commencement. [ ( Note : Memorandum of Conversation written : XXXX XXXX,XX/XX/XXXX regarding Neighborhood Assistance Corporation of America meeting XXXX XXXX XXXX XXXX CA, XXXX. ( signing of additional documents ) XXXX XXXX. until at or about XXXX. ) ] MC XXXX XXXX XXXX precluded that commencement. She ascerbically ( this writer 's opinion ) informed us that we could NOT start the process. We indicated as the principal, I had no interest in any property, attempting to list the WORKBOOK clauses countering her position, which she stopped. She that she had 4 years experience working with the program and since " XXXX had a house, " it was XXXX '', or words to that effect. Again, I referred her to the WORKBOOK. Without listening, she said, " she knew what was in the book ''. I requested her card, which she provided. To our dismay and opinion, MC XXXX XXXX XXXX demeanor and words -- without listening- was not in comport with NACA STATEMENT : TO WORK WITH HOME BUYERS TO ASSIST THEM THROUGH THE PROCESS. '' Mortgage Consultant XXXX misrepresented the information, and basis to us, the listening office Secretary/ assistant, and XXXX XXXX . We submit, she misrepresented California property law. She specifically targeted XXXX XXXX 's marriage to me, alluding to a non-existent XXXX split interest. She said we could not begin/apply, qualify, participate in and for the NACA MORTGAGE assistance. The she continued, switching gears slightly, dismissively stating we were NOT ELIGIBLE FOR THIS PROGRAM BECAUSE YOUR WIFE OWNS PROPERTY ''. Mortgage Consultant XXXX XXXX XXXX XXXX verbal act negated our participation in NACA program : negativing the no fee " the no down payment " no closing costs " possible below market rates " the post closing counseling " no perfect credit proved in direct conflict with the NACA WORKBOOK texts. Her verbalization displayed a clear inconsistency with the broad NACA intent of assistance and help. In traveling to all the meetings, we relied upon the process and published opportunity for assistance in homebuying -- an arduous task itself -- sending for, collecting, and e-mailing multitudinous documents at a cost of much time and effort. Again, we asked where such a policy she stated could be found. The query met, again with dismissive ( my opinion ) words to the effect " Ive been doing this four years ''. My wife and I felt as if she attitudinally manifested that she was the only repository property law knowledge, without really knowing how XXXX XXXX held property. So, within two minutes of meeting, mortgage counselor XXXX XXXX XXXX ' specious assessment of this writer 's non-extant property ownership interest : " it is XXXX '' proves inapposite to California law. XXXX counterfactual, NACA program precluding position of [ our ] ineligibility because marriage ineluctably confers a proportional house interest in XXXX XXXX held sole and separate property, discriminates against us on the basis of her solecism of California marital status. ( Any such position negatives we believe a California statute, and common law, methinks and forces a conclusion a married woman must share a property interest with her spouse. This is NOT the XX/XX/XXXXs ). Her excluding us from the NACA process -- without listening, or reviewing our position, on inter alia, a marital status basis -- did not comport with NACA 'S PUBLISHED STATEMENT : TO WORK WITH HOMEBUYERS TO ASSIST THEM THROUGH THE PROCESS. To our investigated information and belief, our unlawful rejection ( see infra ) was effected with either an arrant misrepresentation of NACA WORKBOOK PROCEDURES AND CONDITIONS, or a heedless misapprehension of them. SEE Grounds for Revocation or Suspension Cal Bus & Prof Code 10176. The commissioner may, upon his or her own motion, and shall, upon the verified complaint in writing of any person, investigate the actions of any person engaged in the business or acting in the capacity of a real estate licensee within this state, and he or she may temporarily suspend or permanently revoke a real estate license at any time where the licensee, while a real estate licensee, in performing or attempting to perform any of the acts within the scope of this chapter has been guilty of any of the following : ( a ) Making any substantial misrepresentation. ( b ) Making any false promises of a character likely to influence, persuade, or induce. ( c ) A continued and flagrant course of misrepresentation or making of false promises through real estate agents or salespersons. ... .. ( i ) Any other conduct, whether of the same or a different character than specified in this section, which constitutes dishonest dealing. SUBSTANTIAL INCLUDES being significant or large. Here, writers /applicants include the significance of being precluded from a no fee, no downpayment, and post counseling NACA participation which wokuld indeed prove substantial ifad to seek other loans and pay for these. ( See XXXX XXXX XXXX last visited XX/XX/XXXX ). It goes without saying the savings of participation would be Substantial " Of real worth and importance ; of considerable value '' ( See : XXXX XXXX XXXX last visited XX/XX/XXXX). PARTICIPATION IN SUCH A NO FEE, NO CLOSING COSTS, NO DOWN PAYMENT PROGRAM IS OF REAL WORTH AND CONSIDERABLE VALUE. DENIAL FROM SUCH PARTICIPATION DENIES SUCH REAL WORTH AND VALUE. MISREPRESENTATION : Mortgage consultant XXXX misrepresentations of INELIGIBILITY TO THE NACA PROGRAM could have been easily rectified. The accuracy of them quickly verified had she just reviewed the citations to which we alluded ( and which we had spent at least 45 minutes consulting with Mortgage Consultant XXXX ). Neighborhood Assistance Corporation of Americas own published documents differed from her conclusion and averments. ( see pages XXXX infra, and others to which we refer in the exhibits ). Further, Real Estate Licensees must pursue an amount certain of continuing education ( by way of example and not limitation ) : For subsequent renewals, all real estate brokers and salespersons with an expiration date on or afterXX/XX/XXXX or who are renewing on a late basis on or afterXX/XX/XXXX must complete 45 clock hours of XXXX-approved continuing education consisting of : XXXX eight-hour survey course covering the XXXX mandatory subjects ( Ethics, Agency, Fair Housing, Trust Fund Handling, Risk Management, and Management and Supervision ) OR licensees can choose to take each of the mandatory subjects separately ; and A minimum of 18 clock hours of consumer protection courses ; and The remaining clock hours required to complete the 45 hours of continuing education may be related to either consumer service or consumer protection courses. ( See California Dept of Consumer Affairs, Bureau of Real Estate XXXX XXXX XXXX last visited XX/XX/XXXX ). And yet MC XXXX adamantly insisted on our INELIGIBILITY. As we again attempted to point out the citations in the NACA WORKBOOK, she exclaimed : I know what is in there. I have working here for four years. YOU ARE INELIGIBLE. ( or similar words to the effect ). Even a negligent or innocent misrepresentation of fact of INELIGIBILITY and preclusion from NACA PARTICIPATION proves injurious to we old applicants who reliedattending two meetings, four phone calls, et al., obtaining, sending off, collecting numerous documents -- in light of NACA WORKBOOKS allowance in contradistinction to mortgage consultant XXXX dismissal of us. ( See XXXX XXXX XXXX last visited XX/XX/XXXX ; and the action or offense of giving a false or misleading account of the nature of something. ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX last visited XX/XX/XXXX) Our exclusion proved most XXXX to us both. XXXX XXXX XXXX XXXX XXXX XXXX. We attempted to pay our dues, but were stopped. I received mortgage consultant XXXX XXXX XXXX XXXX card, noting immediately on the back her stated basis for our exclusion. We thanked everyone for their help, and dejectedly caned our way out of the building. Hours wasted. ( Backgrounder : Both applicants are retired professional people, interested in the NACA program. XXXX XXXX presented cases working in XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. XXXX XXXX is a XXXX XXXX survivor, retired from the XXXX XXXX ). We both adeptly know how to studiously read rules and procedures, dissecting the NACA Home Buying WORKBOOK prior to our start of the required document collection process. We did not find -- and can still not find any WORKBOOK PUBLISHED explicit, nor implicit rules of ineligibility of the kind to which mortgage consultant XXXX alluded. Thus, by effect she unlawfully used marital status ... as a rationale for barring participation in a mortgage application process program -- and by extension -- again -- barred to counseling, post purchase counseling, no fee, no down payment, no closing costs, and under market rate mortgage products. Thus, cut off was the ability to go to " promised '' home purchase seminar, find a potential dwelling, qualify get inspections, make offer, get underwriting verifications, acceptance -- none of it ( not necessarily in that order ). Mortgage consultant XXXX PLACED EXTRANEOUS, UNPUBLISHED CONDITIONS CONTRARY TO THE NACA WORKBOOK, albeit we relied on the original texts. Nevertheless, we were proscribed by her verbal act to begin the NACA MORTGAGE process to " qualify '', and barred us from even beginning the MORTGAGE APPLICATION PROCESS HOUSING COUNSELOR MEETING AGENDA, as listed in the NACA WORKBOOK ( See Sections XXXX NACA WORKBOOK ). All Exhibits NACA and other exhibits below listed are attached or sent with this missive, are incorporated by reference as though fully set forth herein ). AGAIN -- our averments to XXXX XXXX were that any transfer of wife 's interest would precede NACA " closing ''. ( Per NACA WORKBOOK ). Through e-mail form and document submissions -- participations, budget expenses and form signings in the office -- we showed we were ready for the counseling which never came. We exhibited willingness to abide by -- and did so, to the extent allowable -- by NACA 's terms of membership, participation, and eligibility. We both are registered voters. We attempted to for membership fees ( and credit report ). Such was denied and refused. It was stated to us that " did n't want to take our money ''. ANCILLARY ISSUE " WHETHER AN APPLICANT WITH NO PROPERTY INTEREST CAN BE SUMMARILY DISCRIMINATED AGAINST ( AND BY EXTENSION, HIS WIFE ) AND PRECLUDED FROM NACA MORTGAGE APPLICATION PROCESS PARTICIPATION BASED ON A SPOUSE CO-APPLICANT ( PLANNING TO AND ) HAVING DIVESTED ANY INTEREST IN PROPERTY AT THE TIME OF PURCHASE AND SALE AGREEMENT/ OR THE TIME OF " CLOSING '' AS PER NACA PUBLISHED PROCEDURES IN ITS ADVOCACY HOMEBUYING HOME SAVE HOMEBUYER 'S WORKBOOK. '' ARGUMENT Besides the Discrimination and Civil Rights violation/allegations ( infra ), the precis gravamen of these claims is exclusion from a valuable mortgage product and counseling based on the non- ownership of property of the principle applicant ( but property interest inaccurately imputed to him ) ; and the intended transfer of any property interest of Mrs. Smith 's sole and separate property, per the NACA WORKBOOK at or before Purchase and Sale Agreement, or " closing '', as the case might be. And yet an appurtenance to the/those claim ( s ) listed above looms the discrimination and civil rights outcroppings. CALIFORNIA legislation indicates " [ T ] he opportunity to seek, obtain, and hold housing without unlawful discrimination is a civil right ''. ( Cal Gov. Code, Sec. 12921 ( b ) : The opportunity to seek, obtain, and hold housing without discrimination because of .... marital status ... ... ... or any other basis prohibited by Sec. XXXX of the Civ. Code is hereby recognized as and declared to be a civil right ''. ( XXXX XXXX XXXX last visited XX/XX/XXXX ) ( See again, page XXXX under eligibility. ( as attachment ). Thus subsumed slightly hidden is that NACA EMPLOYEES discriminatory statement of INELIGIBILITY is not only stepping on a privilege, but a fundamental right as well. Fundamental rights are a group of rights that have been recognized by the Supreme Court as requiring a high degree of protection from government encroachment. These rights are specifically identified in the Constitution ( especially in the Bill of Rights ), or have been found under Due Process. It is well-established and crystal clear that the right to marry is a central aspect of the right to liberty, privacy, association, and identity. Fourteen times sinceXX/XX/XXXX, the United States Supreme Court has stated that marriage is a fundamental right of all individuals. XXXX search, last visited XX/XX/XXXXBUT SEE- XXXX Supreme Court Cases : Marriage is a Fundamental RightXX/XX/XXXX hXXXX XXXX XXXX ( last visited XX/XX/XXXX ). Thus here, NACA employees NACA participation preclusion proves at least a denial of a benefit of that privilege, or more a fundamental right due to employees faulty cursory analysis of INELIGIBILITY IN THE NACA PROGRAM by way of example ( and not limitation ) BECAUSE YOU ( XXXX XXXX ) ARE MARRIED, AND EVEN THOUGH YOU DONT OWN PROPERTY, BUT SHE ( XXXX XXXX ) YOUR WIFES OWNS ( SOLE AND SEPARATE ) PROPERTY? WERE GOING TO IMPUTE A PROPERTY INTEREST TO YOU. AND THEREFORE, YOU CANT PARTICIPATE. YOURE INELIGIBLE. AND SHE IS INELIGIBLE AS WELL. We submit that INFRINGEMENT ON A FUNDAMENTAL RIGHT is the consequence of a careless and inconsiderate analysis of Mortgage Consultant XXXX with referencing the NACA WORKBOOK CITATIONS to which we so pleadingly alluded. " Naca 's eligibility requirements reflect our mission of promoting .... economic justice for ... moderate income people and communities ). Further " under California law, it is unlawful for a ... real estate broker, or salesperson, to discriminate against a person ... because of a person 's marital status ... ... ... ''. Cal Gov. Code Sections 12926 ( p ), 12927 ( e ), 12955 ( a ), ( d ), Cal Government publication citing : See Fair Employment and Housing Act, Gov. Code Section 12900 and following. The Cal Gov publication also indicates unlawful housing discrimination under California 's Fair Employment and Housing Act, and Unruh Civil Rights Act : " it is unlawful for a real estate broker or salesperson to discriminate against any person because of ... marital status ... ... ... in any of the following ways : Refusing to negotiate for a sale ... '' Citing again, Cal. Gov. Code Sections 12927 ( c ) ( 1 ), 12955 ( d ), 12955 ( e ) ; Cal. Civ. Code Sections 51. ( Note : plain meaning of accomodation includes- " a convenient arrangement ; a settlement or compromise ... synonyms : arrangement, understanding, settlement, accord, deal, bargain, compromise " an accommodation between the XXXX parties was reached '' '' ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX last visited, XX/XX/XXXX ) " synonyms : arrangement, understanding, settlement, accord, deal, bargain, compromise " an accommodation between the XXXX parties was reached '' California law also prohibits discrimination based on .... '' A perception of a person 's marital status, ... ( see infra ), or a perception that a person is associated with another person who may have any of these chracteristics. ( See Cal Gov. Code 12955 ( m ), and the discussion below ). ( Marital Status is defined a ( s ) an individual 's state of marriage ... or other marital state. '' [ ( See 2 Cal C. Regs, Sec. 7292.1 ( a ) ] Contrary to NACA 's published HOME BUYERS WORKBOOK, mortgage counselor XXXX misrepresented NACA prohibitions based on marital status -- ( this writer 's alleged property interest in which he does n't have any ) -- in her less than 2 minutes of meeting us. She presumed. Yet discrimination based on marital status ( differential treatment, here based on her presumption not in accord with NACA WORKBOOK is forbidden ). " Marital status means ... whether a person is married ... included is protection against discrimination based on identity, situation actions of a spouse ''. California is among the states prohibiting discrimination since marital status. Further, any perceived impediment ( such as property ownership if I had any ) -according to XXXX argument -- would dissipate at a time certain many months in the future, at the successful negotiated conclusion of Purchase and Sale Agreement, or " closing '' according to the NACA WORKBOOK. ( With a close reading, such program proscription grounds prove non-extant in the published materials of the Neighborhood Assistance Corporation of America-upon which these prospective applicants relied and spent many hours in preparation ). While only one linchpin of our claim ( the other just as coterminous being violation of NACA agency published materials ) " marital status means whether a person is married ... and includes discrimination based on " actions '' or status of a spouse. It remains axiomatic that it is illegal for such as " mortgage bankers '' real estate brokers, to treat people differently because of marital status. We submit an agency can not refuse equal opportunity to a Mortgage application process because of marital status [ and a future terminating event ]. Examples : a HUD CERTIFIED housing agency employee taking the adverse action of denying equal opportunity to a Mortgage application process because of a marital status ( albeit any perceived property interest dissipates at a time certain -- successfully negotiated Purchase and Sale Agreement, and/or " closing '', according to NACA published rules ). Taking adverse action without cause, or on a mistaken basis constitutes a discriminating condition of privileges of NACA mortgage process and by extension, the HUD certified home buying agency. NACA ostensibly administers its own funds for underwriting and approval. One of the reasons going to them was the : no fees, no mortgage insurance, no down payment, no closing cost -all privileges, which was summarily denied, without reinstatement. " California Legislature passed laws that prohibit discrimination in any aspect of transferring or financing of residential accommodations. Discrimination based on any prohibited classification is outlawed ''. ( See XXXX XXXX XXXX last visited, XX/XX/XXXX XXXX XXXX ). See also Cal Civ. Code Sec. 51 ( Unruh Act ). Marital status is a prohibited classification. See XXXX statement : You 're not eligible because YOUR WIFE OWNS PROPERTY. SO, YOU OWN PROPERTY 50/50. " ( words to that effect ) .... Part 2. Personal Rights. ( a ) this Section shall be known, and may be cited as the Unruh Civil Rights Act. ( b ) All persons within the jurisdiction of this state are free and equal, and no matter what their ... marital status ... are entitled to the full and equal ...., advantages, facilities, privileges, or services in all business establishments of any kind whatsoever. ... ( 6 ) '' .... [ M ] arital status ... includes a perception that the person has any characteristic or characteristics within the listed categories or THAT THE PERSON IS ASSOCIATED WITH A PERSON WHO HAS OR IS PERCEIVE TO HAVE ANY characteristic or characteristics with the listed categories. Here, I am presumed to have the characteristics of my wife. And we submit, " home interest '' of which this writer has none, such interest presently being sole and separate property, allowable in California. But ostensibly an impediment to ( NACA PROGRAM privileges ), even though the conditions subsequent " Purchase and sale agreement '' nor " CLOSING '' have not been reached. Imputation of an ownership interest not extant because of marriage, and subsequent preclusion from a NACA program because of marriage ( marital status ) is denial of the full and equal advantages ( here of NACA PARTICIPATION ). Accord : 42 U.S.C. Sec. 3604 United States Code ) " As made applicable by Section 3603 of this title and except as exempted by Section 3603 ( b ) and 3607 of this title, it shall be unlawful -- ( a ) To refuse to negotiate for the sale ... a dwelling to any person because of ... ... ... ( We submit, " marital status '', ). ( b ) To discriminate against any person in the terms, conditions, or privileges of sale ... or in the provision of services ... in connection therewith, because of ... ... ... I am contacting you regarding an ongoing challenge that I have been experiencing in the NACA XXXX office. When I decided to buy a house I was advised that NACA was a wonderful organization that would assist me in pursuing the American Dream of buying a home. I excitedly contacted them and started the process and now 2 years later I am still in the process. Please find below the chronological order of my experiences with NACA and an explanation as to why I'm contacting you today. My NACA Home Buying Process Timeline : - XXXX : went to interest meeting and signed up for mortgage counselor meeting. -XX/XX/XXXX : I met with my assigned NACA counselor XXXX XXXX who automatically decided that since I was living with my parents ( although I'd lived on my own many times ) that I need to wait at least 6 months to show a savings pattern and get comfortable paying bills. Our next meting was scheduled XX/XX/XXXX. During the 6 month waiting period I reached out to Mrs. XXXX multiple times as well as submitted documentation proving that I'd exceeded my savings requirement for my minimum required funds and to asked that she reconsider her 6 month waiting period decision to no avail. - XX/XX/XXXX : I canceled my meeting with Mrs. XXXX and attended a NACA pre-approval event where I'd hoped to become NACA qualified as I'd paid off all of my credit cards and exceeded my savings requirement however, I'd claimed a business expense on my taxes and unfortunately was denied. I was given the option to amend my taxes or wait and try again after I'd filed my XXXX taxes. I elected to wait, file my taxes and schedule a meeting with my then counselor XXXX XXXX. - XX/XX/XXXX : My mother and I met with Mrs. XXXX who was extremely condescending and during the meeting after stating a lower mortgage amount than was originally quoted she flippantly said that she was new and had done the math wrong with the implication that there was nothing I could do about it. I immediately stated that I wanted another counselor to which she quickly escorted my mother and I out of her office in an uproar. I explained what occurred during the meeting and was assigned a new counselor XXXX XXXX. XXXX XXXX, XXXX ( continued ) : My initial meeting with Mrs. XXXX was a little bumpy at first as she elected to proclaim how Mrs. XXXX had followed protocol and did what she was supposed to do. To which I stated that I understood they were friends I'm just trying to matriculate my file. She quickly walked back her statement, looked at my file and submitted it to be NACA qualified without requesting any additional documentation. XXXX XXXX, XXXX : Mrs. XXXX stated that I was denied and need to provide a litany of documents of which had never been requested of me. I provided all requested documentation however, the process of getting my employment verification took longer than expected and the submission of my file was pushed back. -XX/XX/XXXX : My employment verification and all other needed documents were submitted and I was told that my file would again put up for review for NACA qualification. -XXXX XXXX : After continuously getting the run around from my counselor I called NACA 's Headquarters and spoke to a wonderful woman Mrs. XXXX who worked hard on my behalf and finally after days of phone calls found away to get my file submitted. Mrs. XXXX was out of the office from XXXX XXXX XX/XX/XXXX, during which time my file laid ideal. XXXX XXXX, XXXX : I met with Mrs. XXXX who stated that I'd been declined again citing that my bank statements and letters lacked sufficient detail and requested that I write more detailed bank activity letters. I emailed all requested revised letters and statements on or by XX/XX/XXXX. XXXX XXXX, XXXX : Met with Mrs. XXXX again who asked for the revised and updated bank letters. I resubmitted the same documents that I'd originally submitted on XX/XX/XXXX and she submitted my file. -XXXX XXXX, XXXX : I am finally NACA qualified for {$370.00} far below the {$420.00} I'd been required to save. I original began my home search with a non- NACA realtor as I was told by the NACA Red operator after I called, for the 2nd time in a 2 day span, to request to be assigned a NACA realtor to " not call back they will call me ''. To date I am still waiting for that phone call. -Late XX/XX/XXXX : After reaching out to XXXX XXXX , the XXXX regional manager, who put me in touch with Ms. XXXX XXXX , a NACA realtor, who was willing to advise me and couch me through the City of XXXX grant even though at the time I'd signed with a none NACA realtor. Needless to say my outside realtor wasn't prepared for NACA 's systems so we parted ways and I selected Ms. XXXX as my realtor. SHE'S A GIFT FROM GOD!!! She deserves to get paid for all her work! -XX/XX/XXXX : Ms. XXXX finds the PERFECT home for me. -Still Early XXXX : Ms. XXXX worked with XXXX to increase my payment, we put in an offer the offer is accepted and I begin requesting a meeting with Mrs. XXXX for my Credit Access meeting. XXXX XXXX, XXXX : Contracts are signed all inspections have been schedule, completed and submitted by XX/XX/XXXX. XXXX XXXX, XXXX : Credit Access meeting, I submit all requested documentation via email as well as printed hard copies and by XX/XX/XXXX all notarized documents as well as stamped back activity and paycheck stubs were submitted to Mrs. XXXX . XXXX XXXX : Sent a follow up email to Mrs. XXXX inquiring about my Credit Access approval. Mrs. XXXX never responded to the email. XXXX XXXX : Called to inquire about the status of my Credit Access and was told that the Underwriter was on vacation and would return the following week. In addition, I emailed my Mrs. XXXX asking if there was any addition documents needed. XXXX XXXX, XXXX : Mrs. XXXX send and email stating that she's waiting for her regional manager to help her with my file however, she neglected to state the reason for the denial. XXXX XXXX, XXXX : Called to make an appointment with Mrs. XXXX per my NACA web-file and was told she a on vacation and would return until Monday XX/XX/XXXX. XXXX XXXX, XXXX : Mrs. XXXX emails me requesting my XXXX paycheck stubs, the very same stubs I'd emailed prior to our Credit Access meeting and brought physical copies to the meeting which were scanned into to system by Mrs. XXXX . I emailed scans of the check stubs. XXXX XXXX, XXXX : Mrs. XXXX emails me once again in reference to the check stubs stating that the email sent on the XXXX wasn't legible. I sent her the check stubs again as well as reiterated when I'd begin working in XXXX, a topic thoroughly covered during our meeting XX/XX/XXXX and subsequent email on XX/XX/XXXX. XXXX XXXX XXXX : I begin a phone campaign to speak to anyone in the power to assist me with file. While on the phone with the XXXX office Mrs. XXXX emails me now requesting XXXX paycheck stubs and further prof of my employment. I respond and send a letter from my direct supervisor and stated that I'd email a copy of my check the subsequent day. Mrs. XXXX stated the letter would suffice. XXXX XXXX, XXXX : I email Mrs. XXXX a copy of my XXXX paycheck. She replies that the image is blurry and request that I bring the documents in to the offices. Wanting to resolve this matter as quickly as possible, I brought the requested documents to NACA office. During the meeting Mrs. XXXX stated that she couldn't except the copy of my XXXX paycheck from the bank ATM, a document she willingly excepted in our XXXX XXXX meeting, and instead had me print out the a copy of my XXXX paycheck and uploaded the copy again ( upload # 2 ) Additionally, she stated a new condition I'd need to meet to qualify for the loan, I'd need to contribute {$5000.00}. I agreed and we closed the meeting with Mrs. XXXX stating that we should hear something Friday no later than Monday. XXXX XXXX, XXXX : XX/XX/XXXX I called the NACA XXXX office and was informed by XXXX at the front desk that as a practice the counselors frequently tell the members a misleading wait time for approvals to pacify the members and that I'd likely be waiting for weeks. I email Mrs. XXXX about the status of my file she replies there are no updates. XXXX XXXX, XXXX : I email Mrs. XXXX about the status of my file, she doesn't respond XXXX XXXX, XXXX : I begin a phone campaign to speak to anyone in the power to assist me with file. I speak to a number of people in the company who instruct me to call and email various higher-ups as well as my closing counselor. I dutifully follow the instructions as well as email my Mrs. XXXX. My email wasn't returned. XXXX XXXX, XXXX : I begin a phone campaign to speak to anyone in the power to assist me with file this time I am directed to contact Member Services. I call Member Services and begin to go through the litany of issues I've encountered with my Mortgage Counselor, Mrs. XXXX, who calls during my conversation with Member Services to confront me about my statements. She goes on to state that my file had again been denied without an explanation as to why. She went on to state that Mr. XXXX was involved and the issue might be " escalated ''. XXXX XXXX XXXX co n't : XXXX XXXX. : I reached out via email concerning my {$5000.00} agreed upon contribution as there was no mention of it in my file. I thought perhaps this might be the reason my file was denied. XXXX XXXX. : Mr. XXXX emails me and states the notation is in the file and " the file will be approved once they have documentation to demonstrate my income will continue after the summer break. " XXXX XXXX : I respond to the Mr. XXXX 's email stating my excitement as well as attaching the letter from my supervisor, submitted XX/XX/XXXX. XXXX XXXX. : Mrs. XXXX emails me now requesting " 1. Living with family letter ( resubmitted during XX/XX/XXXX Credit Access meeting ) 2. We need a legible copy of the XX/XX/XXXX statement and the account activity from the last day 3. There is a payment for human benefits I will need a letter of explanation. '' Adding that I'd need to bring these documents to her on XX/XX/XXXX at XXXX XXXX. The most current directives are vague at best and impossible. How am I to get the requested documents, once I'm clear as to what those are, from the bank which opens at XXXX XXXX. and meet Mrs. XXXX at XXXX XXXX.? Despite my best efforts to comply Mrs. XXXX 's ever evolving requests she continues to be a hindrance, and an obstructionist who's unwilling to advocate on my behalf. Mrs. XXXX 's tactic appears to continuously request already submitted documents, provide the least amount of information possible, all while feigning to be my champion. There appears to be a culture of disservice, dishonesty and indifference in the NACA XXXX office.It 's becoming more and more apparent that although NACA was designed to assist priority members that is the last thing we are afforded.

I bought my 3-unit house back on XX/XX/XXXXwith XXXX through NACA program for {$500000.00}. I also got {$52000.00} to renovate some items on my house at that time, but I could not spend all of that money on my house due to NACA hand departments uncooperative with my contractors and a part of that money was returned back to my mortgage bank after two years. I needed money to do the rest of the renovation and some more items on my house and I decided to apply for the Line of credit through XXXX XXXX XXXX and after submitting all of the documents I was approved on XX/XX/XXXX for the amount of {$64000.00}. Then XXXX XXXX XXXX contacted me that they can not give me the Line of Credit because NACA has a lien on my property. First I was shocked that NACA has a lien on my property and then I found out that I signed a letter at the closing to give them that power. Then XXXX XXXX XXXX let me know if NACA accept to be the next lien ( third position ) after them, they will give me the Line of credit. I contacted NACA ( XXXX XXXX ) on XX/XX/XXXX. He responded me the following : We do entertain requests to subordinate our position to equity lenders, however, we treat the request the way we would treat a loan request with the attendant documentation. XXXX XXXX XXXX ( above ) will assign staff to collect and organize the paperwork. This process generally runs about 30 days once the paperwork is completed. After some emails back and forth I got the following from XXXX XXXX XXXX a NACA supervisor on XX/XX/XXXX: What will you be obtaining the equity line of credit for? NACA will review for three reasons 1. Medical 2. Student Loans and 3. Home improvements. In order to have the counseling session conducted you will need to provide the following : *30 days of paystubs *2 years of tax returns ( XX/XX/XXXXand XX/XX/XXXX ) *2 years of XXXX ( XX/XX/XXXX-XX/XX/XXXX) *90 days of bank statements *Information in regards to the loan ( terms of the loan : the amount, the i/r, the term, amount of the payment on a monthly basis, bank on which the loan will be drawn on ) If you are retrieving the equity line for home repairs, you will need to provide estimates of your project. If you are retrieving the loan for medical or student loans, you will need to provide all bills. Once that information is received into your NACA file, please let me know and I will have one of my advocates to contact you to conduct the counseling session. I responded to her on XX/XX/XXXX as the following : Well that Home Equity Line of Credit is for all the following items that I am going to use. I will use it and then return back and then use again. 1 ) I paid around {$110000.00} using my credit card for my wife recent XXXX. 2 ) Need to renovate the following at my property at XXXX XXXX XXXX in XXXX a ) Bathroom b ) Removing rocks and ledges on the driveway and backyard c ) Removing driveway asphalt and make it to have the right slope 3 ) I need to renovate the following at my property at XXXX XXXX XXXX in XXXX a ) Add a new bathroom for the second unit and an extra closet b ) Removing driveway asphalt and make it to have the right slope 4 ) I need to help my daughter to pay a part of her loan. She needs my help. She got her XXXX in XXXX and owes lots of money and needs our help. I sent all of the documents she needed on XX/XX/XXXX through the NACA system and her email. After several emails and communicating with her, I made sure she got all documents on XX/XX/XXXX She responded on XX/XX/XXXX the following : Do you have any estimates for the work you are getting done? I sent her my daughter bill for her education and responded to her the following on XX/XX/XXXX. As I explained, I would like to help my daughter first to pay a part of her loan. She responded on XX/XX/XXXX. I got that, but thought it was for home repairs as well. I responded on XX/XX/XXXX. Let 's stick with that one for now. Then on XX/XX/XXXX I sent an email to XXXX XXXX XXXX as the following : I talked to NACA Advocate ( XXXX XXXX ) yesterday and she told me that she is going to send the documents to you for approval. Please let me know when you are going to approve that so I could follow up my line of credit with my bank. XXXX XXXX XXXX contacted me on the phone on XX/XX/XXXX to ask me a couple of questions in regard to the documents. He asked me to send him my daughter loan document then I sent him on the same day on XX/XX/XXXX as the following : This is the statement I submitted for this file for my daughter loan that she owes for her education. XXXX XXXX XXXX responded to my inquiry on XX/XX/XXXX. The subordination request will be decided this week. We have not had a request before where the equity loan funds will be used to pay education expenses retroactively. We will be expanding our acceptable uses in your case. That needs discussion with the governance of our company. Please note also, you were going to email me the XX/XX/XXXX pay stub : Then I sent him my pay=stub that he requested on XX/XX/XXXX. Then XXXX XXXX XXXX contacted me on XX/XX/XXXX to let me know that NACA decided to deny my request that NACA go to the third place to be able to get my Line of credit base on the following reason : Hello Mr XXXX : I am leaving work unexpectantly today but did not want you to wait over the weekend for news. I am sorry but your subordination request has been denied for reasons described below. It has been determined that we will not grant subordination when the new loan funds are to be used for retro-active education expenses. I will be back in the office on Tuesday for any questions you may have. I did not hear anything from XXXX XXXX XXXX and I decided to send him the following email on XX/XX/XXXX : You have all of the contractor estimations that I wanted to do some renovation earlier on my house when I had money with XXXX and could not finish them because of NACA to be unorganized and wasting the contractors time. Those all are more that {$70000.00}. You could consider those for another reason to get this Line of Credit. If you do not have those estimations, I am happy to provide them to you again with a condition you do it fast within a week to approve my Line of Credit. My bank approved me in two weeks for Line of Credit and you guys is more than 1.5 months and still having fun with my papers and documents! I have also another reason for this Line of Credit that my wife had a XXXX and I paid more than XXXX with my credit cards ( I am sure you guys may say that is also considered to be retro-active health condition XXXX! ) Would you let me know when you are calling me today? The CRA ACT was violated by the company, as they engaged in deceptive and misleading practices. On XX/XX/XXXX, I attended a seminar where I was informed that NACA guarantees the lowest interest rates in the country. To my surprise, the XXXX XXXX XXXX attempted to influence us to vote for a specific political party, which seemed out of place as I had come to learn about the mortgage company and its offerings for the middle class. Despite being qualified, I received a defective government tablet for prequalifying, which required me to provide pay stubs and tax statements. The next step was to schedule an appointment with a mortgage counselor, which I did for late XX/XX/XXXX. However, the counselor failed to join the scheduled XXXX call. After contacting the office, I discovered that he was not present as he was on his lunch break. Patiently, I waited for 45 minutes before calling again. XXXX XXXX, the counselor, then sent another XXXX email stating that he had taken an extended lunch and forgotten about the call, even though it was supposed to be in his calendar. I was extremely disappointed when he quickly reviewed some of my documents and abruptly stated that he had to go as he had another client. Shocked, I didn't say anything and he abruptly ended the XXXX call. I reached out to his manager, XXXX XXXX, expressing my desire to change counselors due to the negative experience and language barrier. However, XXXX referred me to the customer service number, stating that only he had the authority to switch managers. Despite cc'ing XXXX in all my emails, he never responded to me. Moving forward, I included XXXX and XXXX XXXX in all correspondence with XXXX, which seemed to upset him and make him dismissive of my case. He questioned why I included his boss and others in the emails. I explained that he hadn't been responding or providing me with status updates, despite me providing all the necessary information. XXXX 's attitude became rude and dismissive, and he appeared unwilling to assist me. I sent all the requested information to the underwriter, including the details of the house I wanted to purchase. After writing several letters, I finally received approval, but the amount was significantly lower than what I had expected and couldn't cover my expenses. XXXX, told me I need to have my sister send the money back I lend her for medical expenses and tell the title company to send back earnest money to my account because i can only use their title company. XXXX is aware that i have four investment accounts and three savings account with more than XXXX however, he said he doesnt care if i had XXXX dollar in the bank i wont qualify until i have the money sent back. I arrange to have my sister send the money back. I also called the title company and my realtor and they reached out to NACA title company XXXX XXXX who informed them that they dont have to send the money back to my account. They said they will call XXXX to resolve, to my dismay XXXX yelled at the woman and told her no matter if you send the money back, XXXX WONT BE ABLE TO BUY THAT HOME, SHE CANT AFFORD IT. the woman called my realtor and I was on the phone she was like XXXX was very disrespectful and rude and made it clear that I do not qualify for the home now or in the future. This is different from what he told me which is have the money sent back and i would qualify for the home. XXXX have been slapdash, deceptive, and rude during the entire process. In dismay and sadness, I called XXXX XXXX XXXX who approved their mortgage and got qualified for a mortgage right away. Im now a homeowner with a different lender, had I listen to XXXX remarks to another individual stating that I can not afford the home, I would be XXXX. XXXX has caused me stress, confusion, sleepless nights and upset. Who needs a mortgage counselor who uses retailatory deceptive practices to hurt a consumer. Another practice they do is before you get qualified you must placed a positive review on XXXX, which to me is deceptive especially the process isnt complete and the experience isnt accurate. To Whom It May Concern, In XX/XX/2017 I closed on my first home with the assistance of a program called NACA ( The Neighborhood Assistance Corporation of America ). Their program is designed to make home ownership more attainable for more people, especially people with limited funds. NACAs mission statement is stabilizing communities through affordable homeownership and advocating for economic justice. They have a separate department that specifically handles any necessary repairs after closing known as the Home and Neighborhood Development ( HAND ) department. I purchased the home knowing of the many repairs that were needed and expected them to be addressed in a reasonable amount of time. After almost two years of several setbacks and disappointments I found that not to be so. The HAND department not only controls the stipulations of the repairs they also control the money that is set aside for the project, and no one gets paid unless they approve it. This company is holding over {$30000.00} of my money that I pay on every month because its included in my monthly mortgage payment. My loan is financed through XXXX XXXX. Any time that Ive tried to contact the bank concerning this portion of the loan they pass me around on the phone for about an hour in which not one representative has any knowledge of the {$30000.00} of funds that has been mysteriously added to the price of my home. Ive been recently informed by a NACA representative that this is done intentionally because XXXX XXXX wants nothing to do with this portion of the loan. This was very disturbing because I then realized how helpless I was and how messy of a situation I had entered in. It has been almost 2 years now and not one single repair has been made to my home. They have sent me a list of contractors that supposedly works with them but not one contractor from their own list was willing to take on the job because of the poor reputation that NACA has managed to build for themselves. The very first contractor I contacted, once I mentioned the name NACA, literally cussed me out and continued on a ten minute rant telling me all the reasons he would never work with NACA again. Over this course of time Ive exhausted their list of contractors twice. Personal searches has been, for the most part, unsuccessful as well. On a couple of occasions Ive even had repeat contractors come to my home for an estimate but upon arrival and recognition, they tell me what they told me the first time they came out, they can not help me. At one point I was able to get a company XXXX XXXX XXXX to finally submit a bid. We signed contracts and even set a start date but NACA refused to use any of the money set aside as a down payment. So the company refused to take on the job. Many contractors are afraid to take on such a large project without some type of financial security confirming our agreement for the same reason NACA is reluctant to give a down payment ; no one wants to take a loss. Meanwhile the only one suffering in the situation is the homeowner. It is now Winter and the highest temperature in my home is about 55 degrees. This is due to several broken windows, an open chimney, and a damaged roof, which are all on the list of repairs. It is impossible for the house to hold heat. My brand new furnace is running nonstop trying to maintain the temperature but to no avail. Its working so hard that I've had to have it repaired, out of pocket, to keep it up. The worst part of it all is that It's so cold that my son was hospitalized for 7 days. He has XXXX XXXX XXXX and one of the main triggers for a XXXX XXXX XXXX is cold temperatures. This has gone on so long Ive run out of contractor to contact and began making repairs out of pocket. I'm already starting to fall behind on my monthly mortgage payment due to the out of pocket expenses incurred. Even though Maryland law states through the XXXX that contractors are entitled to 1/3 down payment to start the work, NACA refuses to use any of the money set aside for these repairs as down payment. Which means that Ill be forced to come up with thousands of dollars that I dont have to get a contractor to take me serious and start on this project. As if that isnt bad enough, the chances of getting repaid the down payment from the funds thats already set aside for this project are slim to none, because that has to be approved by the lender, XXXX XXXX, who has absolutely zero knowledge of this {$30000.00} that I speak of when I call. Im wondering how an anti-predatory company feels like the biggest predator in this whole situation. Its almost laughable how the lack of assistance from the Neighborhood Assistance Corporation of America could be the very ones that may cause me to lose my home while protecting me from the predator. Below is my complaint about discrimination submitted to NACA on XX/XX/XXXX. I never received a call back or follow-up. On XX/XX/XXXX I contacted member services and spoke with XXXX XXXX who acknowledged that the complaint was received but stated the complaint was sent to the Office Director, XXXX XXXX the person I complained about and it should have been routed to Regional Manager, XXXX but was unsure why it was not ( is anyone surprised this woman did not forward the complaint about herself to her manager? ). XXXX XXXX assured me she would reach out to XXXX and XXXX about my complaint and call me back. At this time, I also requested a national counselor to continue the program outside of the National Office. On XX/XX/XXXX I called back and I received the same member services represetnative, XXXX XXXX again. I asked her again to set up an appointment with a national counselor and she took down my requested times and told me to look for an email with an appointment. Half hour later after this call, XXXX XXXX calls me back and states that the Office Director, XXXX XXXX would not release my file citing program incompatibility ( I have a recording of this conversation ). I informed her I met all criteria and had paid membership dues and that the woman I filed a complaint about should not have authority over my credit worthiness. XXXX XXXX went on to inform me that this decision was not just from XXXX but Regional Manager, XXXX due to the fact that I had filed a complaint with the Colorado Division for Civil Rights. This does not support NACAs workshop information 5 ) She inquires about the NSFs in my account from XXXX I brought to her attention in XXXX and I told her the reversals were in my XXXX statement as it was a bank error. She never looked and told me to go and get a letter. My bank had already told me this would be sufficient for any lender and declined my initial request. I asked her if she had ever seen such a letter and she told me no that it was necessary and refused to look at the statements 4 ) She insisted that I have to put down a dollar amount for medical expenses in my budget despite telling her that my employer funds a FSA and HSA out of our payroll so I never incur these expenses. She insisted that I put down something, I told her {$1.00} and she insisted on {$10.00} so i told her I am done with this process and left promptly and told her I would not be back. I felt a prejudice from her during our appointment in XXXX in which she required that I go through a 3rd Intake process after learning my wages and where I reside. I have been through intake 3 times! I brought everything she asked and she still insists that I do not have my MRF but I am currently sitting on {$5900.00}! I wonder how many people have walked away from their dream when they really did not have to? Please review my file, I would love to be a NACA member but am considering the traditional route now.

Unfair & deceptive trade practices ; unauthorized bank account withdrawal ; and " bait & switch '' interest rates. The NACA handbook provided at the workshop on XXXX/XXXX/16, as well as the handbook currently available on the website, states that the seller 's interest rate buy-down contribution is limited to 10 % of the property 's contracted sales price. Neither book states that there is a buyer limit nor indicates that the purchase price combined with the total buy down amount can not exceed the regional purchase price limit. Per the handbook currently posted to the website, " Seller contributions for the NACA Buy-Down is limited to 10 % of the property 's contracted sales price. The NACA Buy-Down can not be financed with an increased purchase price. A seller contribution greater than six percent may initiate a risk review by the participating lender to verify that the NACA Buy-Down was not financed as part of a higher sales price. '' It also states, " Maximum Acquisition Cost : The Acquisition Cost consists of the purchase price and the amount escrowed for repairs whether financed or paid out of pocket ( " Acquisition Cost '' ). There may be a maximum Acquisition Cost depending on your income and the area where you purchase. '' There is nothing in either handbook to indicate that the buy down must be included in this calculation. After receiving my NACA qualification letter on XXXX/XXXX/16 and preparing to submit an offer on a home, I was subsequently advised on XXXX/XXXX/16 by the NACA Realtor, Office Manager and Mortgage Counselor that buyers are limited to a 4 % or XXXX point maximum buy-down contribution, with a 0.25 % interest rate reduction per point. Then, after multiple urgent requests for clarification, I was advised by the NACA Home and Neighborhood Development Director on XXXX/XXXX/16 that I was given incorrect information. The director advised me that the buyer limit is actually XXXX points ( a 1.625 % reduction ) based on HOEPA restrictions, and that additional training for the Mortgage Counselors was required. She also called back later that day after realizing she had failed to disclose that the maximum acquisition cost includes any buy-down amount from the buyer and the seller contributions combined. When the Mortgage Counselor contacted me on XXXX/XXXX/16 to request the final information to lock my interest rate, my intention to buy-down the full XXXX points in addition to XXXX points from the seller was communicated to her in writing. However, after coming to an inspection repair agreement with the seller and receiving the Loan Estimate from NACA, I again asked for clarification in writing on XXXX/XXXX/16 because the Loan Estimate did not include any interest rate buy-down points and was extremely lacking when estimating what my monthly payments would look like. Only at that point, after my XXXX request on XXXX/XXXX/16, did the Mortgage Counselor respond and advised me for the first time that I was limited to a XXXX point buyer contribution based on income restrictions due to being over the median income for the area. Additionally, NACA made an UNAUTHORIZED WITHDRAWAL from my checking account on XXXX/XXXX/16. I assume this was for a XXXX credit check, but I can not be sure because the amount withdrawn did not match either of the XXXX amounts the Mortgage Counselor advised the credit check would cost, and I received no type of receipt or notification that money had been withdrawn from my account. A request for written clarification of all buy-down terms, limitations, restrictions and anything else NACA has failed to disclose thus far was sent to the Mortgage Counselor, Home and Neighborhood Development Director, Mortgage Production Trainer, Regional Director, two National Directors and the CEO on XXXX/XXXX/16 and again on XXXX/XXXX/16. Participated in the NACA program for a mortgage Summer of XX/XX/XXXX. We wanted to purchase a condo in an up and coming area ( XXXX, CA ) because my wife and at that time were 5 months pregnant and were looking for additional space to prepare for the arrival of our XXXX child. This specific property was classified as an " Own Your Own '' property and not a " Condo '' because the specific property did not have its duly executed condo conversion certification filed with the county. Myself, my wife, and my Agent understood the classification of the property and therefore ultimately understood the risk of traditional lender financing of the property type. As a prudent due diligence question before signing a Purchase Agreement, my Agent asked my assigned NACA Closing Coordinator if this is a property the lender & NACA are comfortable financing. XX/XX/18 - My Agent XXXX XXXX, who is a NACA employee, first asked, via text, my assigned NACA Closing Coordinator, XXXX XXXX, the following ( Please note that I have the text message saved on my phone of the text conversation described below ) : XXXX XXXX : " XXXX have you head of own your own condos. Will they qualify for NACA financing? Agent said they are separated condos but they did not get their condo certification certificate. Says condo on tax sheet Universal land use. Please let me know. Thx. '' XXXX XXXX : " Yes you can go NACA. '' XXXX XXXX : " Ok thanks. '' XX/XX/18 - Final Purchase and Sale Agreement Duly Executed ( w/ counter offer signed ) XX/XX/18 - {$220.00} Pest Inspection Check Clears ( see cancelled check attached ) XX/XX/18 - {$3000.00} Sent to Escrow Account for Earnest Money Deposit ( + {$35.00} wire fee ) ( see EMD Receipt attached ) Throughout this entire time my 6 month pregnant wife and I began going through the closing process ( i.e. opening escrow & providing any additional information requested at the time ). In addition to having to constantly leave work to be at the new property for inspections and paying for additional costs and services that were asked of us in a timely manner per the Purchase Agreement. We continued with Earnest Money Deposit ( ~ {$3000.00} + {$35.00} wiring fee ) and Property & Pest Inspections ( ~ {$500.00} ) which cost my wife and I up at the very least {$3500.00} total not including transportation to and from to the property several times during work hours. XX/XX/18 : Removed final contingency - which was the Loan Contingency As we continued to go through the closing process, we removed the final contingency, which was the loan contingency per the Purchase Agreement. Our ultimate decision as to why we removed the loan contingency was primarily based on the reassurance received, via text, from my assigned NACA Closing Coordinator XXXX XXXX up above. The understanding, and what is specifically stated in NACA 's Workbook - " NACA 's process is designed to close loans within 28 days from receipt of the executed Purchase & Sale Agreement. The NACA Underwriter will address any lender conditions with your Closing Coordinator being your point of contact in processing and closing your loan. Virtually all NACA mortgage applications are approved. '' This is why we removed the Loan Contingency, we were misled, misguided, and ultimately provided false information & reassurances that were simply not true. Had XXXX XXXX taken the time out to ask his supervisor if NACA + Lender finances " Own Your Own '' property types, it is clear based on the timeline above that my wife and I would have never signed the Purchase Agreement in the first place. On Tuesday XXXX XXXX 2015 at XXXX I went into a XXXX, Fl Naca Office and worked with XXXX XXXX. I asked XXXX does Naca pull credit as a hard or soft inquiry. She responded that it would be a soft. I told her I only agree to a credit pull if it was a soft pull, NOT A HARD. She then assured me it was a soft pull that NACA is not a bank they are a nonprofit organization that helps you get approved for a mortgage loan from an actual bank. I signed any and all paperwork under false pretenses from her indication this company was going to do a soft pull and they would not be able to do a hard pull on my credit. I filed a dispute with XXXX on XXXX/XXXX/2015. I continued to follow up with XXXX for 30 days they then stated NACA 's response to my dispute was " this pull was an authorized inquiry '', which indeed it was NOT. I 've been contacting this company about this issue since XXXX/XXXX/15 exactly one day after this incident occurred. I spoke with XXXX in the XXXX Carolina office on XXXX/XXXX/15 she stated their regional office will contact me via email. I never heard from the company. I then called Naca again on XXXX/XXXX/15 and spoke with XXXX in the North Carolina office and she stated she will file another complaint with their regional office and someone should give me a call back. I received a call back that same day ( XXXX/XXXX/15 ) from XXXX. XXXX stated XXXX told me the wrong information and there is nothing they can do about it. I 've ask the company to review their cameras in XXXX 's XXXX, Fl office on XXXX/XXXX/15. Therefore they can see the footage where clearly you will see me ask XXXX was this a hard or soft inquiry and her advising me it was a soft inquiry. I called XXXX multiple times on XXXX/XXXX/15 because NACA reflected as a hard inquiry on my credit not a soft like she stated to me. I told XXXX I did n't authorize this hard pull, she agreed that I indeed asked was it hard or soft pull and that the company should not reflect as a hard inquiry only as a soft. After asking for her assistance to remove the hard inquiry she then stated " well I 've been working here for years and you 're the only person to say we show up as a hard inquiry on their credit. There is nothing we can do about it and this is n't the company for you. '' I told her to cancel my membership with this program because I do not want to be a part of it. The documents I signed were under false pretenses therefore this company needs to remove this hard inquiry off of my credit. After speaking with XXXX manager XXXX and researching similar cases I decided to contact Naca 's legal department. I called their legal department on XXXX/XXXX/2015 and spoke with XXXX. He explained to me he never handled something like this so he would have someone call me back. I received a call back from XXXX in the executive office on XXXX/XXXX/15 he stated he would have to see if there is anything he could do and he would give me a call back within XXXX hours. I never received a call back from him. I called XXXX and left a voice mail on XXXX/XXXX/15. XXXX never contacted me. I then called him again on XXXX/XXXX/15 and left a voice mail and called me back that same day ( XXXX/XXXX/2015 ). XXXX stated " Naca is not willing to admit they are at fault ( in which it is the manager gave me the wrong information ). I would have to pursue a lawsuit and or do a complaint with the credit bureaus. However if I decided to do those things Naca will not admit to any wrong doing. '' He also stated I did n't call Naca back until two days later to ask if it was a hard or soft pull, which indeed is a lie! ( I have my phone records to prove I called XXXX at the XXXX, Fl office on XXXX/XXXX/15 several times to get this off of my credit report because she told me in her office on XXXX/XXXX/15 they only do soft pulls. )

NACA organization is not what is claim to be if you read to their website or going to XXXX of their meeting and meet with their counselor you get one story at the end you get hit with a lots surprises and false promises and you are on your own, also you get different paper work that contradicts all their counselor section and I was even on the Meeting where The CEO was given a speech about how NACA is all about helping homeowners from start to the end, what a lie I wonder if you can sleep good at night or if you have conscience. DO N'T WASTE YOUR TIME WITH THESE LAIRS. I purchased my house through them I 'm sick, sad and depressed of everything they put me through and I 'm still going through, It 's suppose to be a program that helps you with the start to finish and even costing you NOTHING, they took a lots of money from me which I will tell you later, and the seller have paid XXXX towards my closing cost also XXXX have paid some kind of credit almost XXXX not to mention the money they took on top of my loan to do the work in the house, which they did n't do a good job, and they decide who 's the contractor going to be and what is the work needed. The complaint is so much that I would need 8 years, to tell America what NACA together with XXXX XXXX XXXX being doing to me for the past 8 years until present. They tried to foreclose me in XX/XX/XXXX, and I put up a fight they gave me another bad loan and now they are trying to foreclosed me again. I worked for the past 8 years for this house, I spent all my money to fix this house to get it in shape so I can get some income to help me raised my kids finish my college, so I can give my girls a better life and be able to put some money on the side for college or even rainy day. even they website says it suppose to cost you XXXX ( XXXX ) money, I being paying XXXX every month for 8 years, and it 's supposed to help me in case I followed behind, or I need it any help with the house, another lie, I have Proof that I being trying to get some assistance from them since XX/XX/XXXX when I get my payment coupon which the monthly payment was higher than what I was told. Be Aware, if you already purchased your home good luck I hope you had your lawyer, and I wish you had better experiences than me. I was told the lawyer was to represent me and I believed them, since I being having problems I being learning how bad they this program and it 's Peoples are. Please guys do n't make the same mistake that I did, please read the complaints and research before, please ; please do n't sign any papers if you do n't have a lawyer. Those of you that bought a house through NACA Check your paper work go to your town Deeds Office and ask for all the paper work from your property and matched to what they gave you at your closing. XX/XX/XXXX I began the process of applying for a loan via the NACA program. In my very first meeting things went well until I provided my income. I have worked my way out of poverty to the place that I am now, at no point has it been an easy road. Because my income was more than what they liked to see, the rep immediately began to brush me off. I provided all required/requested documents same day or within 24 hours of the request. Despite my responsiveness, weeks ( 2 -4 ) would go by without an update or progress on my file. Every 2 -3 weeks I have been asked to send the same documents, but updated based on the new month. Still I would not receive a response for 2 or so weeks to confirm receipt or progress. Each and every time I have to escalate things just to get a response. I have asked to change mortgage officers but that has not happened. I've reached out to management ( ceo & regional manager ) none of which responded. The branch manager does respond but only to ask me to send the same items that I provided to the mp. The entire time the mortgage professional discouraged me from using the program, repeatedly telling me its for " low income '' individuals. 4 months later, I was still not approved, still being asked to send the same documents ( once again ), and still escalating to get a response/update on my loan. The mortgage professional finally responds to tell me that the guidelines have changed and higher income individuals will be limited to where they can live and lower to moderate income individuals can live anywhere they choose. He advise this was the CEO 's decision due to the default of higher income home owners. The mortgage professional provided me with the email the CEO sent to staff. I was appalled as it refers to higher income individuals as " non-priority members. '' It also states how we are to be handled ( dismissively ), as well as the limits that are going to be placed on us due to our income ( which is discriminatory ). Now we are 6 months in and I have still not received an approval. I was told last week I would have it by Tuesday, but as of today nothing. I have emailed and called but still no response. I finally received a reply and the rep told me that he has not had the opportunity to review my file ( its been 1.5 weeks ). Now we are at the end of another month and I am no closer today than I was in XX/XX/XXXX. I was also told that I would have to buy down the rate by 2 points to be approved due to lack of assets. I have over {$130000.00} which I provided to verify assets. Not to mention I have saved approximately {$1600.00} per month thus far this year. The mortgage professional did not give this information to the Underwriter which delayed this process 2 more months. So far they have done everything in their power to discourage me from purchasing my first home via the NACA program, all because I worked hard to have a decent paying job. Please advise if you would like a copy of the email sent by the CEO to staffers talking about disparaging treatment to higher income house holds. This program is supposed to help minorities and immigrants who are discriminated against, as well as low to moderate income wage earners. However if you fall into what they consider a " high income '' household, they do not try to help you, they actually discourage you from using the program. This has been an absolutely horrible experience.

XXXX XX/XX/2020 My wife and I attended a NACA workshop over a year ago. We were assigned to a counselor to begin our journey to homeownership. We spent months submitting all required paperwork to our NACA file, paying for membership dues twice, and paying for credit reports on several occasions. We were expecting to get qualified by XX/XX/2020, as indicated by our assigned counselor, XXXX XXXX, in XXXX, Georgia. We had an original counselor, XXXX XXXX, who was supposed to establish our qualification process XX/XX/2020, but due to unforeseen circumstances the day of ( weeks later it was made known ) she was terminated, and our file was pushed to XXXX. In which, her earliest appointment to go over our file and initiate qualification was late XX/XX/2020. Earlier in the week, XXXX submitted our file to underwriting, and a decision was made at the end of the week that Not Qualified-Conditions for a conditional review for a file in our paperwork. The questioned file, according to NACA standards met the prerequisite conditions with an attached letter of explanation. We uploaded proof from a copy of my credit report, and another letter of explanation to our web file and emailed our counselor as well. The following Monday, we met again with XXXX and she resubmitted our file with the attached documents we sent. Again, the following Friday we received the same status that we didnt qualify, but in this situation, we didnt have anything listed under Conditions for Qualification. We repeated again the same step and contacted XXXX, her response she was in a conference call with the underwriter and regional director, and she will keep us informed before the end of business day. We didnt hear from her that day nor throughout the weekend. Monday afternoon after not knowing where we stood, I emailed her and our status went back to Qualification-Pending and she responded to my email that the underwriter told her to resubmit our file but would not disclose what is needed to approve our file. We attempted to approach other avenues in getting our paperwork approved by signing up to NACAs virtual Achieved the Dream events that same week. We were able to speak with another counselor remotely and they resubmitted our file to underwriter and was told we would receive a call back within 24 hours. That weekend we didnt received a call back. I once again contacted the local NACA office in XXXX and was told someone would contact us back. We eventually just received an update to our file, and again it listed us as Not Qualified-Conditions but with no conditions, nor explanations. I sent numerous emails to member services, NACAs official XXXX account, and emails to our counselor complaining about lack of communication, and no one performing the duties of being an advocate to our need. No one taking any initiative to relay to us why we are not moving forward. The lack of communication, incompetency, and numerous delays have caused many hours of frustrations for us, as well as taking money from us and not producing their acclaimed results of obtaining homeownership for us. We would like more oversight and advocates who are willing and ready to assist members obtain homeownership in a timely manner and knows how to demonstrate excellent customer service.

I used Neighborhood Assistance Corporation of America ( NACA ) to obtain a fixed rate mortgage from XXXX XXXX XXXX. I begin working with NACA in XXXX XXXX. I signed a contract on a home ( new construction ) XX/XX/XXXX. I received my loan estimate from XXXX on XXXX/XXXX/XXXX ( Copy of email Attached ). I was fully approved and met all of my conditions for my mortgage in XXXX XXXX. I also locked in my rate at 3.75 %. I was assigned the loan number # XXXX. I received an email from a NACA employee on XX/XX/XXXX stating that once the home is complete I will be clear to close ( copy of email attached ). I touched bases with XXXX in XXXX XXXX. He responded on XX/XX/XXXX that I needed to update him when the home was completed to prepare for the closing process ( copy of email attached ). XXXX provided me with a closing date of XX/XX/XXXX on XX/XX/XXXX ( copy of email attached. ) I received an email from another department of NACA telling me that I had no bank application on file at all ( copy of email attached ). I emailed XXXX on XXXX/XXXX/XXXX to ask him why I did n't have a bank application on file XXXX weeks before my scheduled closing ( copy of email attached ). He never responded. I left numerous voicemails, called NACA 's main office and never received a response. I took off of work on XXXX/XXXX/XXXX to go to the NACA office to find out what was going on. I was told by XXXX that there was a " glitch '' in the system and I had to do my entire loan approval process again and there was no way that I would close on XXXX/XXXX/XXXX, my credit has taken a nose dive as an effect. However, in my NACA webfile, it says that my loan was cancelled out but no one will tell me why ( screen shots of NACA webfile attached ). Also, no one from NACA ever picked up the phone to call me or email me to tell me what was going on with my file. No one responded when I inquired. I spoke with several NACA national directors and no one would tell me what happened to my original loan approval. I cc 'd the CEO XXXX XXXX on several emails and he never chimed in. XXXX national XXXX, XXXX XXXX, told me that he does n't have the time to look into what happened with my file. XXXX also told me on 2 occasions to let the home go and back out of the contract. I closed on my home on XXXX/XXXX/XXXX. The builder was going to impose a XXXX % late fee, but out of generosity to me, they waived it. My ordeal with NACA and XXXX XXXX XXXX was a consumer nightmare. According to NACA 's reviews, this is typical and unfair to consumers. The lack of customer service and mortgage knowledge is unacceptable. I need to know what happened to my original fully approved loan ( # XXXX ) and I need a letter written to all XXXX credit bureaus to explain that the additional hard inquiries were no fault of my own. During my entire time dealing with NACA, I never once had access to my loan processor at XXXX XXXX XXXX. This process is not fair. When NACA was mishandling my application, I could not even speak to a representative at XXXX XXXX XXXX for assistance. Their process is to refer consumers back to NACA. I plan on taking as much legal action against NACA, NACA individual employees, and XXXX XXXX XXXX as I can lawfully do.

NACA have/had been advertising that getting Mortgage through them, Members would not have to pay closing cost, down payments and other benefits, which proved to be false also. XXXX XXXX XXXX was already offering many benefits to their members like me as I have Accounts with them for many years.. I am attaching their promotion flyer to me. Neighborhood Assistance Corporation of America has been adding $ XXXXmonth in to my mortgage payment since the closing of mortgage on XXXX XXXX, 2009. At the time of closing, They did not explain anything about that adding $ 50XXXX to my mortgage payment and had me sign a contract between them and myself before closing of Mortgage, without explaining it or letting me read it saying it 's just formality. I did not receive the copies of contracts at time of signing it, which they sent me quite recently after I had filed a dispute with them and second Contract I received was even later. Also on XXXX contract, my wife is not included and added in XXXX contract and in that contract it 's not her hand writing and signature or mine. I am Unemployed for several months, actively looking for work so I contacted NACA as I was facing severe Financial Hardship and talked to several people from NACA through several telephone calls and emails, including their managers and provided lots of documents to them on their request but I was not getting any help what so ever, getting false promises and runaround and later they were not even replying to my phone calls or emails. I recently received that copy of contract between NACA and myself, which states that they will be making payments to my mortgage lender and other clauses of contracts are very one sided and deceptive, till I get back on my feet. Later they were not letting me cancel the contract and keep adding $ XXXX/month and XXXX XXXX XXXX would let me do it as They have Contract with XXXX also.. We began the process of requesting a subordination back in XXXX and our subordination was finally approved in XXXX. Now that our subordination has been finalized we are in a position in which we feel deceived by NACA by limiting the amount of money we can withdraw from our HELOC to {$11000.00}. We have bent over backwards again and again to provide anything and everything NACA has asked for. We have provided quotes, estimates, bank statements, utility bills, taxes, property tax bills, HOA documents, mortgage statements and multiple letters explaining why we were requesting the subordination. I spent hour upon hour on the phone with their MAP department to prepare our file and go through your " extensive counseling session '' prior to be sent to underwriting. We were told from the get go the requirements were to not exceed a DTI of XXXX XXXX and go through the counseling subordination process. We are well within this requirement even after the HELOC approval showing that we have over {$100000.00} in equity in our home. We also had to pay for the appraisal and application for the HELOC before NACA would continue with consideration for the subordination. Our current DTI is somewhere around XXXX XXXX which we pride ourselves on and therefore meet the requirements provided to be approved. I am very disappointed in the lack of response from most everyone I have encountered at NACA. My lender and I have left numerous voicemails and emails and have received XXXX response. I spoke to someone in the MAP department 2 days ago and she received a confirmation from a manager directly that he would call me back later that day. Here we are today and still no call back. We were provided terms for qualification and a list of documents needed for the process. We compiled XXXX XXXX and we qualify per your terms provided. I will also point out that this process took 4 months which is absolutely unacceptable. We now have to reapply for the HELOC, have our credit run again and pay for a new appraisal due to the delays we have encountered. It was never once discussed with us that there would be a limitation on the amount we were allowed to withdraw from the HELOC. This was deceptive and it needs to be corrected immediately. We are requesting the subordination paperwork be reprocessed with a limit adjustment to {$50000.00}. We have provided statements and quotes as well as letters explaining in detail how this money will be spent. The bottom line is that we were never disclosed the limitation of funds we were able to pull and therefore incurring additional fees and credit inquiries because of this deception. If there was to be a limitation it was never disclosed. We don't have any documentation to include as we were never provided anything in writing from NACA. All conversations were completed by telephone which I am told each time I call that they are recorded.

TILA violations 1. Company removed contract out of the system to avoid TILA and it is notated that in my file with NACA. 2. I did not get anything in writing within the three-day time frame and NACA works on Saturday. 3. I also did not get anything in writing about XXXX accommodation. I had no frustration with my housing counselor, and she was wonderful, but my complaints came from management with my loan file. Providing Loan Estimates to Consumers- 1. When is a creditor required to provide a Loan Estimate to a consumer? Hide Generally, a creditor is responsible for ensuring that a Loan Estimate is delivered to a consumer or placed in the mail to the consumer no later than the third business day after receipt of the consumers application for a mortgage loan subject to the TRID Rule. 12 CFR 1026.19 ( e ) ( 1 ) ( iii ). For transactions subject to the TRID Rule, an application consists of the submission of the following six pieces of information : The consumers name ; The consumers income ; The consumers social security number to obtain a credit report ; The property address ; An estimate of the value of the property ; and The mortgage loan amount sought. 12 CFR 1026.2 ( a ) ( 3 ) ( ii ). If the consumer submits these six pieces of information, the requirement to provide a Loan Estimate is triggered, and the creditor must ensure that the Loan Estimate is delivered or placed in the mail within three business days. On XXXX XXXX, 2016, we accepted a contract on our house from a buyer who is a client of Neighborhood Assistance Corporation of America ( NACA ), with a closing date of XXXX XXXX, 2016. We were provided a nice letter from NACA ( attached ) stating that the buyer had been working with NACA, " and are qualified for the NACA Mortgage to purchase ... '' our property. After repeated requests for an update, on XXXX XXXX, NACA Mortgage Consultant XXXX XXXX notified our attorney and our realtor : " Lender is conducting their final review. Will provide an update as soon as it is available. '' Our attorney then made repeated attempts to get an update from XXXX XXXX, but there was no reply. On XXXX XXXX 2016, the day before our movers were scheduled to pack up our home, we were notified that : " The lender has not issued a clear to close on this file. The file has exceeded the typical review time and has been escalated to get a response as soon as possible. As soon as I have an update I will communicate progress. We will not be able to close on the XXXX at this point. So we will need an extension. '' A two day extension was requested and granted. On XXXX XXXX, 2016 the our movers completed loading and our family and possessions headed from XXXX to XXXX. On XXXX XXXX, 2016, our attorney then made repeated attempts to get an update from XXXX XXXX and schedule the closing, but there was no reply. On XXXX XXXX, 2016 we were notified : that they buyer 's attorney requested that the mortgage contingency and closing date be extended to XXXX XXXX, 2016. As we were still in our contingency window for the home we had under contract in XXXX, we agreed to the extension. On XXXX XXXX, 2016 our attorney started making attempts to contact NACA to get an update. NACA made no effort to respond. On XXXX XXXX, 2016 we were notified : that they buyer 's attorney requested that the mortgage contingency and closing date be extended to XXXX XXXX, 2016. Seeing as we had no recourse, except for canceling the sale, we agreed to the extension. We were able to secure an extension for the house we have under contract in XXXX. Monday, XXXX XXXX, 2016, once again there has been no communication from NACA, no closing was schedule and we are now a day or two away from having to terminate the contact on the home in XXXX. Additionally we are facing significant unanticipated expenses as a result of NACA lack of communication and follow through.

I have been in the NACA program for 2 years. I have jumped through every loop NACA requested me to. I followed NACA 's instructions to become NACA qualified to obtain a mortgage. I was recently qualified on XX/XX/XXXX in which I signed the qualification form and sent back to NACA. I was advised between my counselor and the HAND department to put a contract on my father 's house, which I did. I was also advised to pay for a home inspection, which I did {$400.00}. I was also told since I was rehabbing the home I would need architectural drawings for appraisal purposes, which I retained an architect and paid a deposit of {$750.00}. When my home inspection was complete, I received an email from NACA HAND Dept that they were now requiring a structural engineer and construction manager ( which is adding to the cost of my out of pocket expenses and mortgage amount ). I tried reaching out to NACA as I didn't understand the scope of the letter and why I need an engineer. I called the HAND Dept and requested a call back a week ago. Nobody ever called back and if your phone call is not returned within 24 hours, they state to call again. So I called everyday. I was told by a Rehab Specialist ( email is attached ) she would reach out to me this past Tuesday, she never did. I called again on Wednesday and I advised I wanted a call back yesterday as I have been waiting over a week and someone kept saying I'd get a call back but they were negligent in returning any calls and/or emails. I finally spoke w a XXXX XXXX, National Director of the HAND department on Wednesday XX/XX/XXXX. I questioned why I needed an engineer and construction manager when it was going to cost more. I was trying to explain to XXXX the whole purpose of the program was to make it affordable and they make it unaffordable requesting for more and more money to be spent. XXXX then said she is the National Director who is the only one who can approve my rehab loan and that she was denying my loan for my attitude. I advised I would file a formal complaint with the OIG and terminated the call. The entire NACA dept as well as myself was then emailed by XXXX stating she is terminating my contract and kicking me out of the program. She stated in the email that I was unwilling to cooperate when I never said I wasn't willing to cooperate. I was trying to find out the logistics of why now I have to hire more people after I've already hired who she told me to.

I have been mislead by NACA on several occasions and discriminated against. I have all this documented. I was even threaten to inactive my account by XXXX XXXX due to my XXXX XXXX my XXXX this is discrimination. I have been told several different things to qualify for NACA and each time I have done them. Now I have to wait 6 months to do a payment shock which I have been doing so but XXXX XXXX told me to pay down my DTI with my payment shock this whole call was documented. They are giving me a very hard time and I know its because of my XXXX. I know they dont do this for everyone Im in a NACA XXXX on XXXX and I have screenshoted several different members comments how NACA does not follow policy or guidelines they pick and chose who they qualify, I have proof of all of this. XXXX member said he didnt have to do certain things another member had to do, they are not following policy and guidelines for everyone. They told me my action plan and what to provide and I did that and once I did that they gave me a new action plan. They have mislead me, disrespected me, discriminated against me, threaten me, put me down, discourage me. I have XXXX children and I need a home. I have been doing everything I been told to do and its always something new added on. My first counselor ignored me and I have several emails to prove this and calls. My XXXX are really bad right now NACA is making them worst, I been crying all day because if I wasnt ignored and told this from the beginning I would of did so. My son was even crying he is XXXX because he knows I been working hard and doing everything that was told to me by XXXX and now all of a sudden it has changed. I told them Im contacting CFPB and HUD then I was threaten to inactivated my account. They also told me if I call again my account would be inactive. Only thing I trying to do is get me and my children a home. I been mislead and done the worst way possible. This isnt right. I was told when I signed my home purchase contract XX/XX/XXXX that I would close mid XX/XX/XXXX. My mortgage is through XXXX XXXX XXXX facilitated by NACA. Mid XXXX NACA Loan officer advised I needed to get my Home Owners and Flood insurance to close XX/XX/XXXX. I got the insurance through XXXX. Closing was moved to an estimated around end of XXXX, in the meantime I had a XXXX XXXX and received XXXX payment this past month. NACA loan officer now states I no longer qualify to close because of my long term XXXX payments. Despite for the last two years of going through this process I have done everything asked. I submitted an employment verification letter showing I am still a fulltime employee and my yearly salary. I have been discriminated against and because I had a XXXX XXXX medically certified and receiving XXXX payments in violation of ADA and FHA. Fair Housing Act The Fair Housing Act, 42 U.S.C. 3601 et seq., prohibits discrimination by direct providers of housing, such as landlords and real estate companies as well as other entities, such as municipalities, banks or other lending institutions and homeowners insurance companies whose discriminatory practices make housing unavailable to persons because of : race or color religion sex national origin familial status, or disability. In cases involving discrimination in mortgage loans or home improvement loans, the Department may file suit under both the Fair Housing Act and the Equal Credit Opportunity Act. Hi, I am asking and pleading for your help. Bringing this back to XX/XX/XXXX, we accepted an offer on our house from a woman using a NACA loan. This NACA loan is a government/state ( honestly it is not very clear who assists ) aide loan. This has been an absolute nightmare since. We were set to close XX/XX/XXXX, however, received notice on XX/XX/XXXX at XXXX that we would not close, and not given a reason why. All we were told at the time is that there was a minor hold up that they needed one week tops to clear. By that time, my family and I including my XXXX year old and XXXX month old were in a house with no furniture except a crib, and XXXX air mattresses, which is because every extension we have had has been this " short '' extension that seems counterproductive to move anything back in. When they asked for a week, we set the extension for a week and a half for XX/XX/XXXX, to ensure there would not be another extension. XX/XX/XXXX came and went without a word from NACA. Our contact person out of the XXXX office, XXXX XXXX, has been avoiding office calls, emails, and cell phone communication. We finally got a response from XXXX XXXX 's supervisor XXXX XXXX after our closing on XX/XX/XXXX had already passed. He then explained that it would need to be postponed again and that again it wAs just the bank reviewing the clear to close. Once again we signed an extension that brings us to XX/XX/XXXX, tomorrow. Once again no one can get ahold of XXXX XXXX. This whole process is unbelievable. This is a program that advertises being for a family, however, they have acknowledged the conditions my family has been living in and done nothing. My 18 month old was hospitalized during this time which we again expressed to them, yet nothing was done and calls, emails and texts were ignored. I think that this is something that would help many people to investigate. If you look up NACA there are many similar situations. If you look up XXXX XXXX and XXXX XXXX you can find many situations involving the same people. I purchased my home through NACA 's first time home buyers program and closed last year with XXXX XXXX XXXX. My home is in need of repairs which I was aware of at the time of purchased and added extra funds to my mortgage ( Escrow Hold Back XXXX repair loan ) to cover the home repairs. The contractor they provided and recommended was terminated due to poor communication, work and missing 2 deadlines. NACA 's HAND department only allows you to work with their vendors and currently there are only 2 contracted vendors to complete construction work in the XXXX XXXX area. I requested documents from my lender and was provided amended whited-out information which invalidated my case in court against the terminated contractor and is a violation of public policy. I have requested to have an meeting with the lender, myself and NACA 's HAND department but have only been told by NACA that it's their information and they don't have to share the lenders contact information or inform them of my requested meeting and I can write the lender but NACA 's HAND department will give them the letter. NACA 's HAND department and refusal to provide me the lender 's lenders contact information has caused delayed work on my home and finical hardship. Throughout my time working with NACA 's HAND department they have displayed poor communication, missed requested meetings, phone calls, unanswered questions regarding my home repair, and told that I am not being honest regarding my home repairs. I have tried to have my voice heard by those in leadership only to be sent an XXXX link with 2000 people discussing the NACA program and no one offering to help resolve the issues with the company, you aren't even allowed to file and complaint with the NACA program. When contacting XXXX XXXX XXXX I've been directed to communicate with NACA regarding any issues but when speaking with NACA HAND department I am directed to talk to XXXX XXXX XXXX regarding all issues. XXXX XXXX XXXX stated that NACA would be able to setup and meeting between the lender and myself but I have yet to get an response back from NACA 's HAND department. I was working with NACA for over ( XXXX current XXXX ) a year to acquire a mortgage loan. My mortgage counselor XXXX XXXX XXXX asked me if there was anyone I can add as a co-signer. When I told her I didnt want to add anyone else, she went through my income and saw my child support. My mortgage counselor XXXX XXXX, then began to continually ask me to put my XXXX XXXX on my mortgage application for income reasons. I qualify on my own as the sole borrower, and told her I was completely comfortable with the amount I qualified for and could afford with my income. I informed her multiple times that I am not comfortable reaching out to my XXXX XXXX, nor am I comfortable with having him on my mortgage. I informed her I wanted to be on my mortgage loan by myself. XXXX XXXX did not respect my feelings about the matter. She continually asked on multiple occasions to add him as a co signer, informing me that I would qualify for a much larger loan to get a bigger house by adding his income. She said she was trying to help me get a bigger house. I told her I could not afford to pay a larger mortgage on my own. I informed her I could only afford the amount I qualified for by myself. She still continued to push for me to add him fully aware that it would put me in a position to be struggling tremendously to make the mortgage payments that were out of my affordability. Also I have payed NACA multiple fees as well as monies to obtain a mortgage loan as well as to run my credit report. I did not receive one nor did I even come close to receiving one in the entire time I tried working with NACA.They advertise that they offer free mortgage loan assistance. This company has pulled my credit multiple times for no reason as well. Since I have reached out to her supervisor, she refuses to return my email or calls. My counselor has canceled multiple appointments without reason. This company is still taking money from my account and I am still unable to get in touch with my counselor. I have requested for a different mortgage counselor, and I have reached out to her supervisor in regards to this situation and have not received any response since reporting this matter.

The current issue is with the NACA HAND / Rehab Dept. I have been attempting to communicate and to have final inspection of the house / rehab work conducted. HAND needs to disburse rehab funds, to the contractor, that are held in escrow as part of the loan / funding agreement with XXXX XXXX XXXX. Funds will be disbursed, once rehab work is inspected by a NACA assigned and certified inspector. The initial request for final inspection, was sent XX/XX/XXXX ; via fax, as instructed on the HAND docs. Follow-up email sent to HAND Rep on XXXX XXXX 2016 - To no answer. After multiple phone calls, voice mails, faxes, and emails to the NACA HAND Dept / assigned rep of the past couple of months, I have not been able to functionally converse with anyone ; to finish this process. I have been contacted by over XXXX HAND reps, and have been copied on XXXX requests to inspectors, to no outcome. This has been on-going for nearly 3 months ( 80+ days ) which is highly unacceptable. Most recent email requesting to communicate sent on XXXX/XXXX/16. The contractor has threatened to file suit against myself, and NACA. Which at this point would be honestly justified. In accordance I, the loan holder, will also file suit against NACA. The HAND department has shown an abundance of avoidance, and gross negligence, to properly conduct a functioning business ; with reasonable and ethical standards of practice. As a personal result to this ; from the avoidance to pay the debt owed to the contractor ; by NACA. I now fear my phone ringing, in fear that it is the contractor. And I have no answer to provide on payment. In short : NACA owes the contractor for work completed in the property I reside in, and I am reminded of that fact daily. I am not used to collection practices, nor have accounts that are late or in collections. And in whole, this process has been interfering with my time, and interfering with my work. As the only time to attempt to reach HAND is during my working hours. More often than not, to a phone that goes un-answered. I can not continue to step away to hope someone at NACA answers a phone, or to send another email.

Last XX/XX/2019, NACA had its BIG EVENT held in XXXX XXXX XXXX XXXX, XXXX XXXX, CA. I attended the finalize my first time Home Buying goal and to submit other requirements and meet a Counsellor. They had me log in the computer to finish my membership requirements through the members portal. Then had me sit and wait to meet a counsellor, the called me after more than an hour and took all my documents and information including Bank Account Number and Routing Number. But after sitting for an hour with her and providing everything, another Counsellor who just happened to walk in her desk just said my application is not going through because the program was SUSPENDED. I have been working with NACA/XXXX for almost two years only for underwriting to deny me on the last day of the attorney review. They told it me it was because funds in my account went down, however, if they were monitoring my account, the could have been avoided prior to accepting a contract that I had submitted. Not only did they review and accept the contract, they had me, complete an inspection, secure an attorney, and purchase a condo questionnaire. My realtor sent emails to ensure that we were on track and we never got a no. There have been so many complaints online regarding naca but I still tried to give them the benefit of the doubt. There lack of responsiveness and perceived lack of care frustrated both my realtor and attorney. There has been constant mixed messages and doesnt seem like this program has any empathy for their clients. They seem to be preying on neighborhood clients versus helping them. Even after denying me, they still proceeded to take out fraudulent membership dues and money for a credit report. If you deny me of a loan I get approved for by the alternate lenders in 5 min. I sent a complaint to XXXX and NACA for a refund of the fees over the last year and they denied me again. They dont think there is anything wrong with there process and the offered no help at all instead went back and forth with me in an email war to try and prove he was right without even picking up the phone to talk to me. This is the second time that naca nearly caused me to lose a home. The first offer I submitted, was denied by the seller because they didnt want to work with naca due to a reputation of the process taking too long. They asked me to switch lenders and they would consider. Believing in naca, I stayed the course until I realized they werent really trying to help me. They never even offered an alternate solution. This process has been so long and complicated and all I want is for my money tp be refunded so that I can finally be done with naca for good. Please help me.

XX/XX/XXXX, I enrolled in and enlisted mortgage modification assistance from my local NACA Program in XXXX, FL. It was confirmed that my mortgage situation met the criteria for assistance through the Program. I followed the process steps completely and I was presented with the modification option ; I was encouraged along the way by my assigned NACA Agency Counselor face to face, via telephone and email. As the process unfolded I received a XXXX package with the modification terms and details ; to my knowledge these specifics were negotiated by my NACA Counselor on my behalf. However, upon closer inspection this year, I 've discovered that this " modification deal '' contained many elements that has locked me into many years of hardship - specifically 'predatory lending ' at its best. For example, the new terms include ( 1 ) a XXXX and XXXX mortgage, ( 2 ) a final balloon payment and ( 3 ) loan maturity date extended out to year XX/XX/XXXX. Upon this discovery I contacted my former NACA Counselor and returned to my local NACA Agency office. To my surprise I was met with finger pointing suggesting that I had accepted a 'streamline ' offer and that NACA could not support my choice ; furthermore NACA had no paper trail of the offer I had accepted and they were certain that NACA had not negotiated a loan modification on my behalf XX/XX/XXXX. The NACA Counselor then asked that I provide copies of original loan modification agreement for her inspection. The documents were scanned at my local NACA Agency and I was contacted by my original NACA Agency Counselor ; she immediately pointed out that the deal was exorbitant, reeked of predatory lending and I should file a complaint with CFPB. Lastly, when I asked about a remedy the Counselor advised that there was no recourse through the NACA Program and that I ( 1 ) could just make the payments because the amount was nominal or ( 2 ) refinance the mortgage to mitigate the XXXX and XXXX mortgages and the large balloon payment.

Concern # 1 : Communication Due to the low interest rates offered during the pandemic, I understand that you all are very busy at the time. My mortgage counselor has been great but often it has been difficult to get in touch with her due to the increased volume. Furthermore, I noticed that the mortgage counselor acts as a middleman between me and the underwriter which prolongs the process. If possible, it would be great to communicate directly with the underwriter so I can provide them with the documents needed. This will make the overall process to be approved for the loan faster. Concern # 2 : Underwriting Process The underwriting process has been very frustrating. My mortgage counselor gave me an action plan and listed all the documents needed to be eligible for the loan which I provided. However, my mortgage counselor has submitted my application at least three times to the underwriter and each time they come back with new information that I need to provide. This prolongs the process of me being approved for the loan. Someone should look at my profile in its entirety and make a final determination of all the documents needed to move forward with the process. The information that NACA needs should not be staggered as they have been providing me. It is disappointing when I ask my mortgage counselor if I will be approved and she responds with a yes. Only later to find out that I am not approved because the underwriter needs additional information. In all fairness, I believe my application is not complicated and that I should have been more ahead with this process. I applied for a loan through NACA in XXXX of XXXX. They pulled my credit three times that I can see on my credit report. In XXXX, the mortgage officer said that he was working on getting my loan approved but there was some policy change that was about to come into effect that may affect the amount I was approved for. He assured me that he had a copy of the NACA policy stating that unreimbursed employee expenses should not reduce the amount approved for. In XXXX, he provided me with a qualification l letter for the amount requested ( attached ). In XXXX, after searching two months for houses and finding the one, I reached out to get an approval letter for the property to start the contract process. He responded back with the letter, but said that new policies are now an effect requiring the employee expenses to be taken out and this will affect affordability ( email attached ). But he still provided me with the letter ... also attached. I reached out to the National NACA director, XXXX, via XXXX, and he responded back that there should be an exemption process. When I provided this information to the XXXX Office director ( After camping out in the office when he would n't return my calls/emails ), he said that XXXX XXXX was incorrect and that the policy had been in effect for years. I showed him the email from the mortgage office in his office saying that it was a recent policy, showed him the letters, my income, etc. He said that I should have never received a letter to begin with for that amount and that he 'd call me the next day. That was in XXXX. I have not heard back since. I want all NACA inquiries removed from my credit. I went through NACA before to get a home in XXXX, and it was not like this. My husband and I attended a NACA workshop over a year ago. We were assigned to a counselor to begin our journey to homeownership. We spent many months submitting all required paperwork to our NACA file, paying for membership dues and paying for credit reports. We were expecting to get qualified by XX/XX/2018, as indicated by our assigned counselor, XXXX XXXX, in XXXX, NC. When XX/XX/XXXX arrived, our counselor missed our scheduled appointment ( which was to qualify us for a home loan ) and after calling and sending numerous times, I finally reached her and she was very rude, unprofessional and lied several times about our scheduled appointments and missing documentations. She made excuses that documents were missing from our NACA file, even though we submitted every document she requested in our action plan, to our file and to her email. Finally we requested to speak with her supervisor and even requested another counselor. No one contacted us. I sent numerous emails to her supervisors complaining about her behavior and requesting assistance with removing her off our case and assigning us a new counselor so our case could move forward and we could obtain homeownership before our rental lease expired. Needless to say, several days passed with no response. I finally called member services and requested a new counselor, since our previous counselor was unassigned to our case. The lack of communication, missing paperwork, a rude and incompetent counselor and numerous delays have caused many hours of frustrations for us. We would like more oversight and advocates who are willing and ready to assist members obtain homeownership in a timely manner and knows how to demonstrate excellent customer service.

I applied for a mortgage through NACA in XX/XX/2022. They told me I had 60 days to be approved but wanted me to wait for approval until after I had worked at my new employer for one full year. This occurred on XX/XX/2022 about a week before the 60 day window closed. In the meantime my mortgage processor ( there they call them counselors ) quit. I feel because of improper case management, my new case worker had insufficient time to process my application and I have now fallen outside the 60-day window. They are now requiring me to check my credit again which I don't want to do. I explained this to the national team as well as my local counselor. I'm not an expect but not processing timely applications I believe is a Regulation B violation. On the last day of the 60-day window, my counselor called me with final details. He said they may come back with questions. I thought that meant it would still be solved the same day as I have no loans and no debt beyond credit cards I pay off each month. Yet somehow my mortgage application was deemed " Not Qualified ''. What's worse, I receive this notification via text with no explanation. I wrote them today to ask for further clarification and why Regulation B was not followed. I also asked for a manager or supervisor to escalate this issue. Instead, I receive a 3 sentence response : " Your file has been returned with conditions. The underwriter needs a new credit report. Let me know what you want to do. '' I still have no idea why my application wasn't approved. The company is not being forthcoming and I am not getting any help even after I ask for it. I suspect their teams are severely understaffed, but that is not at no fault of mine.

I have been working with a NACA Mortgage Counselor since XX/XX/XXXX. They promote themselves as not relying on your credit score which is a complete fabrication. What do they think a credit score is comprised of ... well it's payment history ... payment behavior!! I knew going into this that I had late payments and some collections. However, the misguided instructions I have followed have left me worse off that where I began. I was told I needed to pay off my auto loans because of the late payments. If the accounts were paid in full with documentation provided. He would send my file over to underwriting. I spent {$20000.00} paying off my auto loans in order to move forward in the mortgage process. Then around XX/XX/XXXX, I was told I needed to pay off three collection accounts before my file could be sent to underwriting. These are the same collection items that were on my credit report Day 1. I paid one of them off and sent documentation regarding the others. As of XX/XX/XXXX, the " Reviewer '' not underwriter said I would need to wait 6 months to show good payment history. Well what about alternative forms of credit ... ie. utilities, phone, cable, internet, car insurance, etc. They never once mentioned this and he told me that my rental payment history couldn't be used because " we can not do that in our program ''. Really that's not what's in their Home Buyer 's Workbook. I'm no out money that could've been used for a down payment on a traditional mortgage. I put in a notice with my landlord for XX/XX/XXXX because I completed at the end of XX/XX/XXXX what I was asked to do in order for my file to move forward to underwriting.

I have been working with NACA since XXXX of XXXX as part of their home buying program. I have given them total visibility to my entire financial history. They have pulled credit reports, employment history, mortgage history and household history. They have received tax returns, bank statements, credit card statements, voter registration, social security cars, drivers license, student loan info and the lists goes on and on ... This organization has done nothing to assist me in the home buying process. I have been through underwriting multiple times only to be given unreasonable conditions or flat out denied. On yesterday XX/XX/XXXX, I was told that because my previous mortgage was not paid on or before the due date I do not qualify for their program. My mortgage was never reported late because according to the law I have 30 days to pay which keeps it in a current status. This means it is not delinquent. My credit report shows 7 years of no late payments. After months of back and forth with NACA and me paying off thousands of dollars of debt they are still denying me because they see on the required mortgage statement that my payment was not mad on or before the 1st of each month. I feel like this organization is purposely making it difficult for me to purchase a home using the benefits they offer and advertise. It may be my XXXX or XXXX, it could be my job title or it could be the area in which I desire to live. One thing for certain it is not because I don't meet the general program qualifications. NACA - Neighborhood Assistance Corporation of America at XXXX XXXX XXXX # XXXX, XXXX, CA XXXX. Has abused, harassed and neglected my file. I am a single women that has never purchased a home. The have asked me for the same EXACT paperwork 7 times since XXXX 2016. I have worked with 5 different counselors that have been fired. I was told that one of my counselors " lost '' my information and i needed to reply. There have been times I had to call up to 20 times and send up to 10 emails before I am approved. I do not see similarly situated people treated this way. Then when I am finally contacted I am told too many days have passed so my credit needs to be run again and that i need to pay to have it run. The reason so much time passes is because they do not answer my calls then force me to pay and have my credit run again. I only gave them permission ONCE to run my credit while they ran my credit another time without my consent. The first time they ran my credit they said they lost the forms and needed to start over. This is a complete mess. I would like to ask for a refund of my one credit check fee and also for my membership dues and the inquiry on my account removed. They are bullying me into running my credit. Since they know I do n't want my credit score to be lowered they just tell me they will have to run by credit once a month in order to get the loan and they keep telling me my file is complete and sent to underwriting and later i find out that it has not been submitted and that I am required to resend the SAME information again. This is becoming harassment.

I applied for a home loan with NACA located in XXXX Ma. I was approved for a mortgage for 90 days and wanted put an offer on a house. My mortgage rep left XXXX XXXX, and I could not get another appointment until after my 90 was up on XXXX/XXXX/XXXX. I was called right before XXXX/XXXX/XXXX and told my new consultant left and my appointment was moved to XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX, the secretary tried to bump me from my XXXX/XXXX/XXXX appointment for another customer. I told the secretary I would be there XXXX/XXXX/XXXX @ XXXX. I went the appointment XXXX and met the office manager XXXX XXXX in the XXXX office. I was told my file was reopened. I submitted all of the paperwork for the loan on XXXX/XXXX/XXXX, my credit was rerun and my membership due paid again. I was told the process would be easy because I had been approved prior. I was also told I would heard back in 7-10 business day with the amount I was approved for. I have not hear back as of today XXXX/XXXX/XXXX. I called the XXXX office, the XXXX office, and customer service with no follow up by mail, email, or by phone on the company 's as to the status of my loan approved amount until last week. I was told my file was never reopened even after the 2 hour appointment with the office manager. I have all of the submitted paperwork. I keep emailing and no one is assisting me. This process not only caused me to loose the house I really wanted, but more importantly, the interest increased one full percentage point, that will cost me hundreds of dollars over a 30 year mortgage loan. Hello, I am looking for an attorney to review my realestate case. I had been working with NACA, ( counselor : XXXX XXXX ),, Which is funded by HUD. They promise no down payment, 3.5 % interest rate, no closing costs and poor credit ok and loans up to 150 % of appraisal to make improvements. ( I lost all my rentals and my primary house in XX/XX/XXXXhousing crises/ predatory lending and was forced to file bankruptcy ) I bought a house on land contract with {$3000.00} down and 7 % interest, ballon in 5 years which was XX/XX/XXXX. You have to go to pay for membership with NACA and go to meetings, volunteer and complete extensive paperwork. I completed my paperwork beginning XX/XX/XXXX and completed in XX/XX/XXXX I was promised my loan info would go to under writing and within 10 days I would hear back of closing. As far as I know my loan never went to under writing. I have called left messages, sent emails then complained to Member services and then received an email asking for updated bank statements. Now the office does n't even answer my calls or respond to email. I do n't know if I am being discriminated as throughout the whole process I have not seen another XXXX. My landlord is stating he will be forced to start legal action. I was referred to NACA by a friend who used them 20 years ago. They advertise on their website that there is no down payment or closing costs as their program helps low income families of color. We signed up and were charged a {$25.00} fee that is charged annually and was told that we would be charged over {$15.00} each for them to pull our credit reports. We jumped through hoops uploading all out documents on their website, set up an appointment with a counselor who did not have access to our documents, ran our credit without reading the XXXX statement and did no answer any of our questions, but told her we would need to save for down payment and closing costs. We are feeling duped and feel this company if just taking our money. To add insult to inquiry, they want us each to support their business by representing them 10 times a year each, which is 20 times a year between me and my partner. I called NACA to complain and was transferred to a 'supervisor '. I got a voicemail where no on has ever called me back. I was told I could take my business elsewhere if I didn't like their practices. This company needs to be investigated because of false advertising amongst other lending practices that seems a bit sketchy. I requested to be assigned to a new counselor since me and my partner both felt we were being discriminated against because of our sexual orientation and we were told no. He never told us what we qualified for after running our credit. We're still wondering why our credit was run to begin with.

I submitted a previous complaint on XX/XX/XXXX to XXXX XXXX XXXX. I was told by them that I have a balance in my escrow account that I would either like to receive directly or use as a principal reduction on my loan amount. The attached letter shows I have a balance of {$10000.00}. The work is completed and the contractor will not be performing any more work at the property. The lender needs the full and final lien waiver from NACA as specified in the letter. Sent on XX/XX/XXXX A few years ago I had used a organization called NACA to obtain a affordable mortgage. I was able to have success using this process as I was able to close on our property in XX/XX/XXXX. The service provider that provided the mortgage through NACA was XXXX XXXX XXXX. The issue I have is that I used the HAND process through NACA to perform renovations on our property. During this process the NACA Hand Department was very difficult to deal with. This issue I have is that I did not use all of the funds that was allocated yet I am still paying a mortgage on the full amount of the renovation loan. The total amount of this loan that I suspect is still in escrow somewhere is around is between $ XXXX {$15000.00}. I am unsure of the exact amount. If possible I would like to have the balance of these funds returned back to me. I submitted a complaint to the company but did not reach a adequate resolution.

NACA promises you can apply for a mortgage if you spend hours attending seminars and going through and around hoops and red tape. I did all this in XX/XX/2017. I met with NACA Counselor XXXX XXXX in XX/XX/2017. I also paid membership fees at this time. He told me I could qualify for any amount ( up to their maximum non-jumbo limit ) once I was ready. Three years later, I decided I was ready. On XX/XX/XXXX, I was given a new appointment with NACA Counselor XXXX XXXX. Because of COVID-19, it was distantly set on XX/XX/XXXX at XXXX XXXX PST. On XX/XX/XXXX, I emailed XXXX and XXXX to confirm my appointment. Neither responded. On the day of the appointment, I called the phone number for my appointment. No one answered so I left a voicemail. Instead of a call back, I got an email saying I got pushed to XX/XX/XXXX. Ms. XXXX did email asking how she could help. I've written her three times and she has never responded. I've also tried multiple times calling/emailing the national center for help. None of the phone numbers get me to a live person. Each email I response I receive asks me not to reply to their response ( even though their response does not address my email ). I feel like this company is denying my access to apply and they are misrepresenting what it takes to apply for a mortgage. I also wonder if some sort of discrimination is taking place.

I wasn't sure how to classify this. InXX/XX/XXXXI filed a complaint against NACA here w the CFPB about a problem I was experiencing with their counselors at the local office. When I initially filed the complaint, I explicitly asked for the NACA office to truncate my information so that those involved in the incident did not have access to my personal information. The DM never responded as to how he was going to secure my personal information. Recently, I was NACA qualified and sent back to the local office in XXXX. I am now finding out that in XXXX of XXXX, someone at NACA pulled my credit report without my authorization and they're telling me I can't purchase a home without paying for the credit report. I did not authorize NACA to pull my credit in XXXX of XXXX. I was actually in the process of getting a new remote XXXX from XXXX to XXXX so I was not even an active participant of NACA in XXXX of XXXX. Someone at NACA pulled my credit report without my authorization and this leads me to believe someone there is trying to steal my identity as there was no other reason for them to pull my credit. This violates the FCRA as I did NOT authorize my credit to be pulled. I started the home ownership process with NACA in XXXX of XXXX, On XX/XX/XXXX, I met with a mortgage consultant by the name of XXXX XXXX to discuss the next steps to me becoming a home owner. On this date we also talked about the fact that I was separated from my husband. I was told that there were ways to get around this. On XX/XX/XXXX, I received an email form XXXX XXXX that directed me to a Law Firm about a Free Trader Agreement. I was able to have my estranged husband sign the document, have it notori it notarized, and gave the document to NACA for upload into my file in XXXX. In XXXX, when all of my information went to the Underwriter, I was told that I was " Not Qualified '' due to conditions. Two of the three conditions had to do with my estranged husbands income that they were requesting, and also documentation as to whether he owned property. The third condition was regarding my student loan and what amount that I would pay. Please keep in mind that we are all still in deferment at this time. I paid {$20.00} to have the document notarized as will as {$310.00} to the Law firm for this document that apparently did not mean anything. I would like my money back. I was instructed to bring down money orders by a remote counselor with NACA to the XXXX office. While there, I was threatened by one of the counselors. At this time, I do not feel safe with the counselor and receptionist having access to my personal information such as my social security number, bank accounts, credit report, address, and children 's personal information.I requested from the District Manager to have my informational locked and secured in their system but he has yet to respond. I do not feel safe at this time with people who are threatening me who have access to my personal information. XXXX, the counselor who threatened me made it seem like he was going to do something with my personal information. I do not want to be a victim of identity theft and I do not want anyone having access to my bank account information to be stealing money out of my account. The staff at that office has been caught in numerous lies on voice recording. With these kind of practices, it leads me to believe they will use my personal information other than what it is intended for. NACA has several complaints online about the professionalism of the mortgage counselors which is what makes me feel like they do n't follow any ethical procedures. I became a NACA member with the belief that they could help me " Achieve the Dream '' of home ownership. I worked with them for over a year, doing EVERYHING I was told to do until I finally became " Qualified '' and instructed to look for a home. Found a home and became excited!!! I was given several closing disclosures, and several clear to close notifications beginning in XXXX but never moved to closing to this date XXXX. I went into contract on the property XX/XX/ and the seller became inpatient with the process and no real answer to what was holding up the process, she put the house back on the market. I was instructed to get inspections, structural engineering report ( costly ) and now I've loss the property at no fault of my own. I just don't think it's fair. I've been advised to look for another home but without knowing why I didn't get this one, I'm very discouraged about the whole process. I didn't get a denial just not an approval and the house is not available to me any longer. There has got to be something someone can do to help me. II started with the program over a year and a half and in this time they have consistently given me the run around charged me for the membership as well as are tricking people to giving them good reviews on various social media and XXXX services to contribute to their reputation to receive funding for their program. In this past year and half they have collected my personal data info and allowed it to sit never moving forward on their promise to assist. They force you into thinking if you do not give them a good review they will not help you. they finally stated that I had to give them 5 different reviews all good because I was afraid they would not help and now they will not answer emails or calls never following up and will not help me in the process. They are a fraud of a NPO and receiving government funds this should be stopped. They informed me not to move forward with any home offers until they helped and never did for more than a year and half and now the prices are very difficult for me to purchase affordably. I closed a NACA home loan in XXXX of 2015. Because the seller was not willing to make repairs to items a NACA certified home inspector required to be fixed, NACA impounded or held back XXXX dollars for these repairs after closing. These reapairs must be made by NACA certified contractors. After repeated requests to NACA for NACA certified contractors, they have ignored my requests after providing me with contacts that either do not do business with NACA anymore due to non payment or do not work in the specific trades needed to make the repairs. This has left my home unsafe for many months including exposed electrical and improper plumbing. I do not feel safe in my home and am fearful failures in my home based on the home inspector 's report will lead to additional issues that I can not be financially responsible for. Additionally, I am paying interest on these funds that have not been utilized for my benefit in the meantime. I alerted NACA last week or so that I would be reporting them to the CFPB if they ignored my request which they have.

My wife and I have been working with NACA ( Neighborhood Assistance Corporation of America ) to buy a home. I had quite a few issues with communication and our first housing coordinator. I requested a new one after being told that we going to underwriting and communication stopping. I climbed the ladder with phone calls and emails and after two weeks was assigned a new counselor. He pulled my work history, and more duplicates of financial documents that i have submitted multiple times, gave me a housing price and told me we were going underwriting. He has said he would call, which was last wednesday, and I have called multiple times to see if they need anything else and to see if we made it to underwriting. No one has returned my calls, or emails. The file does not have notes as everytime I talk to a customer services representative, they say their are no notes. On XX/XX/2019 I was qualified to obtain a mortgage through NACA. On XX/XX/2019 XXXX XXXX discriminated against my disability and cancelled my qualification, told the lawyers not to accept my executed contract and had me spend money I did not have. I emailed XXXX XXXX on XX/XX/XXXX to request an adverse action letter as NACA has been consistently pulling my credit as this was a credit based loan, and himself as well as XXXX XXXX emailed me back they do not need to send out an adverse action letter as to why I am now being denied a mortgage after I was already qualified. I believe this goes against the FCRA. As a consumer, if I apply for credit based loan and am denied, I am entitled by Federal Law to receive an adverse action letter. Since my credit was pulled multiple times by NACA, I am requesting for an adverse action letter to be sent to me. NACA is a predator and they're using unfair business practices. I was lured into the program under false pretenses and false advertising.

I placed funds in an escrow account to cover repair expenses after closing on my home. I was advised I could pay for the repairs out of pocket and then be reimbursed from the escrow account that I put funds in before closing by submitting a draw request with receipts/bank statements and Notarized documents from the companies showing that a lien had not been placed on the property. My closing is set for XXXX today I received a call from the title company that I need to wire {$11000.00} to close NACA is a non profit that advertises no closing cost. I started the process with NACA almost 3 years ago. My process was deliberately delayed by XXXX Washington at NACA, time after time causing me to pay much more for the loan in terms of a higher rate and funds I needed to buy down the rate. On the closing disclosure I received after hours on XX/XX/25 it states the XXXX XXXX XXXX is giving or crediting NACA in excess of {$12000.00} why would XXXX receive {$12000.00} from the builder and I wire XXXX to the title closing company? This makes no sense. No closing cost is no closing cost which is a bedrock of NACA advertising.

I have a mortgage with XXXX XXXX XXXX through XXXX. The structure of my home was recently damaged due to a neighbor / property owners negligence with treating the tree. The tree is dead, and the property owner was notified that the tree was dead prior to the damage to my home. On XX/XX/XXXX, after receiving a preapproval letter and qualifying for a mortgage purchase back in XX/XX/XXXX, we were advised by our local NACA office that they were declining to allow us to put a contract on a house due to maternity leave despite the fact that we are no longer on maternity leave and have returned to work and despite the fact that when we were off for maternity leave we utilized banked leave time and our pay never changed. After a chain of phone calls and emails over the past couple of days, we were again advised, this time in writing that, as a broker, they are exempt from the fair housing act portion that states denial solely due to maternity leave status is a violation.

I was under contract on a home after receiving lending approval on XX/XX/2018 and an approved purchase amount from NACA. 14 days prior ( closing was scheduled for XX/XX/XXXX ) to my scheduled closing date NACA informs me that they are unable to honor the approval. Which are due to the errors of their own underwriters, licensed mortgage counselors and home counseling staff. I have multiple written correspondences with the approval date and amount, as well as attempts to eliminate any potential issues prior to the end of due diligence periods however their counselors, management staff and underwriters were non responsive via phone and email.

Upon becoming a member with the naca organization my realtor was aware of homes i could afford. While viewing homes i was informed i that i was eligible for a home that was shown to me. I then proceeded to the next step which was paying the expense of all inspection cost. Which came out to be a total of {$640.00}. A break down of {$320.00} towards building inspection, {$220.00} towards plumbing inspection, and {$95.00} towards termite inspection. With such disappointed, shortly after i was informed by XXXX XXXX XXXX that i could not be approved for that home. I also inquired about receiving a refund of my membership fee of {$30.00} dollars.

I attended a workshop and applied for a NACA mortgage. I completed my application and they took my money, but I have not been able to get a hold of a single person at any point in time during this process. I have called, their phone doesn't even ring through. You get the initial answering system and then it hangs up no matter how many extensions you try. I have emailed, with no response. This has been going on for MONTHS! They took my money and ignored me. They are supposed to let you know if your application has been denied by 60 days after applying. This company is fraudulent and misleading and a scam.

No one from NACA has responded to my emails or provided a written response stating that is was discussed in the last meeting in XXXX. I have an email dating back to XX/XX/XXXX with no response and I several other emails with no response. I have emails requesting support, help and how to move forward. All emails are also being sent to my NACA client portal file. My pervious CFPB complaint was answered by XXXX XXXX XXXX XXXX. NACA XXXX XXXX XXXX, XXXX XXXX XXXX, MA XXXX but this person has never spoken with me or emailed me and I am unsure of her role with the NACA company.

I have been approved to the section 8 homeowners program. The problem Im having is due to my XXXX, I get social security payments with a representative. I have been on section 8 for over 10 years and have always paid my bills on time. My income is used toward the amount of my rent payments. Now that Im in the process of purchasing a home, that is no longer my income. I dont understand why one agency uses disability payments as income and another says its not. I feel that is being used against me because of my XXXX, which is the requirement.

NACA took me work through the stressful process of qualifying for a home loan. It stated in the paper work that I qualified for Down payment assistance as a XXXX. On the day I was supposed to close on my home, I was informed that I no longer qualified for the home I was purchasing. I spent money for inspection, re inspection, NACA fees, etc. I also have XXXX XXXX XXXX contacting me about the loan I was approved for. NACA was negligent and owes me money and an apology.
