Name : XXXX XXXX XXXX. : Complaint - Suspicion of Unlawful Practices - Vehicle Repossession Bank : NBT Bank Bank Address : XXXX XXXX XXXX XXXX, XXXX, NY Account Type : Vehicle Loan Names of contact persons : XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX XXXX has responded to my complaint about the handling of the account and has notified me that all was handled appropriately. See email attachment and notes below. XX/XX/XXXX VEHICLE REPOSSESSION ISSUE / NBT BANK : My Vehicle : XXXX XXXXXXXX XXXX XXXX vin # XXXX, was purchased at XXXX XXXX, XXXX XXXX, NY on XX/XX/XXXX. A loan was Secured with NBT Bank, my personal financial institution at the time. ( See Welcome letter - Loan intro from NBT Bank ). Along with the vehicle purchase, undercoating was elected as an option and added to the value of the loan along with an extended warranty. ( See Associated Purchase Documents ) During the Covid period ( XX/XX/XXXX through XX/XX/XXXX ), my hours working for the XXXX XXXX XXXX XXXX XXXX were reduced to part time hours for about half of the first part of XXXX, during which time I requested a loan extension for my vehicle loan and was informed that I would be required to go inside my local XXXX institution in order to set that up. I decided during the height of covid conditions against that option. Unfortunately, that began an accumulation of some late fees on the account trying to make sure the payments were made each month. At the end of XXXX, I left the XXXX XXXX XXXX XXXX to find work where the health risk was less. I served my notice at the end of XXXX to start a new job at a different company. My intended start date was XX/XX/XXXX at the beginning of the new year. Unfortunately, that start date was cancelled, as there was a complete office Covid-19 outbreak at the new job preventing me from starting at that time. I became unexpected unemployed for approximately one month until XX/XX/XXXX. At that time, I applied for a loan extension with NBT Bank but I never did receive a response from them. ( See Loan Extention Request attached ) From that point forward it was a constant catch up game but I was making all good faith attempts to get caught up. I started receiving late payment notices starting in XX/XX/XXXX and they began coming approximately once a week with a different total each time. ( See attached ) By XX/XX/XXXX, I was receiving notices of being 2 payments past due. I never saw a full reconciliation of all payments received by NBT. As seen on the document showing transfers to NBT Bank for the loan note on the XXXX XXXX XXXX from My XXXX XXXXXXXX account, I calculate that by XXXX I should not have been behind on payments ( if my extension was granted? ) and by XXXX I should not have been 2 payments behind. I did try to catch up between XXXX and XXXX since by then, I was behind by 1 payment. This I agree with. In XX/XX/XXXX, I was terminated from my new job. Covid-19 restrictions created a situation where it was no longer required to have as full a staff and my position was going to be assumed by someone else in the company. I used my final paycheck to make a payment to NBT in XX/XX/XXXX ( See payment document ). I attempted several times to request another loan extension but the documentation online that I used previously is no longer available ( See document - " This Page No Longer Exists '' ) and I was told that lendees can only avail themselves of the provision 2 months per year, which I already used at the beginning of the year? If that is the case, why is my account 2 payments behind? Nevertheless, I logged into my online NBT account to download loan account records to work through the records and figure out what was going on with the payments. The account records function did not work properly. I was only able to retrieve the last 3 months at a time. I logged out at that time and decided to collect resources from my own banking institutation, XXXX XXXX, from which I paid the loan and also collect letters from NBT. I would revisit my NBT online account later when I have an appropriate amount of time to figure out how to retrieve more data. The next time I logged in to retry, a day later, my account was removed altogether with no records showing at all. I decided to at least take a screenshot of what was available at the time. ( See screenshot ) At this point, I received notices of 2 payments past due until XX/XX/XXXX. That particular letter, dated XX/XX/XXXX, did state that action, if past due is not paid, may include repossesson of collateral ( See document ). I was still unemployed at this juncture and looking for employment but I was also attempting to reconcile the account numbers and going through the letters and account details. When I received a new letter every few days, it noted a different amount owing. Sometimes it said past due and other times not. 14 days later, I received a notice that they may repo if what was owed isn't paid within 48 hrs. Without work still, I was trying to find work and also go through all documentation to make sure I didn't miss anything and was fairly confident that my payments would catch up with their notifications. ( See bank documents ) The next letter I received was dated XX/XX/XXXX ( Not sent XX/XX/XXXX ) that they may exercise their right and repo the collateral and less than XXXX weeks later the vehicle was repossessed ( By the time I actually RECEIVED their letter in my mailbox, it was only a true 7 days later that the vehicle was repossessed ). On XX/XX/XXXX, I went outside and the vehicle was not there. I did not use the vehicle the day before so I couldn't say when it was taken but it was not on the property on the morning of XX/XX/XXXX, so sometime before then. I wasn't even sure that it had been repossessed because I had not gotten a final notice saying it had been decided. I understand this was a misunderstanding on my part that they are not required to notify me of their final decision to repossess. I called NBT several times to verify that it had been repossessed, with no answer. I got no responses or call backs. I logged into my NBT account to see if perhaps there was information on my account about a repossession before calling police and initially there was NOT. More NBT calls. ( See Visible Phone Provider call record - Provided directly from my phone provider ) I left several messages. Days later, I logged in again and I finally saw a note on the loan account that the vehicle had been repossessed. At least now I knew what happened! But what I still did not know was where it was or how to get my personal belongings or my XXXX license plates or other property back. I sent an email through my NBT account requesting that someone please respond to my calls and request and I got a pleasant, generic, " contact the repo desk, '' which, of course, I had been trying to do all along. ( See document ) So I called again. Nothing. I emailed XXXX XXXX at her secure account - XXXX because she had tried to contact me using that email previously so I thought it might be worth a try. She never responded. Even to date, she has not responded to that email. Finally, I felt I had to reach out to their legal department to find out what to do about this. I can't even say whether I found the appropriate person to contact but noone else was responding and trying to locate the appropriate person on their contact page on their web site was frustrating. XXXX XXXX, apparently from the legal department, responded, giving me the number to call for any repo concerns ( the one I had been calling all week ) and she informed me that records show there were many attempts to contact me. ( See document ) I informed her that while NBT was seeking past due payment, attempts were definitely made. I received nothing at all since the repossession. On XX/XX/XXXX, I finally got to speak to XXXX XXXX, who was apparently handling the account, and she claimed that she had been trying to get ahold of me and called several times at my current number. Again, while they were seeking past due payments, I got a call about every other day. ( See Phone Carrier records ) BUT from the time the vehicle was repossessed until then, I had heard NOTHING. At this point it had been 6 days since the vehicle was taken from the rental property. XXXX claimed she could not provide me with any information about the repossession impound company except the name and phone number, which I took down. I googled the information on my own after that and called them myself. I asked XXXX what was being done with the plates during this whole time while it was being held without my knowledge of its whereabouts. XXXX informed me that the plates had been returned to the Department of Motor Vehicles in XXXX. Prior to this call, I contacted my insurance company to ask what I should do about insurance on the vehicle because the bank was not responding to my inquiry and they strongly suggested that I not cancel the vehicle 's insurance because the NYS plates and vehicle registration were still active per their records. At the same time, I had logged into my own XXXX DMV account online to note what was recorded ( See screen shot from XXXXDMV account for regstration of XXXX XXXX XXXX ) and then did so again while I was speaking with XXXX. The registration was indeed still active and there had been no plate surrender within the previous 6 days. XXXX informed me that I had until the XXXX of XXXX to wire {$2200.00} to the bank to settle the account or the vehicle would be sold. No other options were presented to me. I did explain that I had lost my job and let her know that that amount would be impossible in just a few days. Furthermore, I question the amount owing. I did tell her I thought there was a stay on vehicle repossession during XXXX if the inability to pay was due to Covid-19 per the XXXX Repossession legislation? She did not respond. I was very clear that I had lost my job in XX/XX/XXXX in all emails I sent. Noone ever questioned it or informed me of any special circumstance that I might qualify for or should be aware of. Nor did she ask if my circumstance was related to Covid-19. She was not interested in what I said at all. She repeated several times that she was sorry to hear that " I didn't think I was notified properly about the repossession '' because there were many attempts to call me about the matter. This, I have come to learn, was a piece of legislation that was sadly and surprisingly, never enacted. See later note. When I hung up with XXXX, I called the repossession company, XXXX XXXX, and the lady I spoke with was very helpful. She scheduled a time for me to go to their impound lot in XXXX, NY, approximately an hour away, to collect my belongings from the vehicle. I was told I should do it the very next day, XX/XX/XXXX, or I would have to wait for another week because they would be closing for the holidays. She informed me that I was required to bring the vehicle keys to surrender as trade for my personal effects, which I did. I received a receipt for the pickup of my personal effects and the forfeit of the key fobs x2. ( See document ) Imagine my surprise when she informed me that the XXXX plates had NOT been returned to the XXXX DMV in XXXX and are still affixed to the vehicle. I retrieved them myself and returned them in person to the XXXX, NY DMV in my area on XX/XX/XXXX. ( See surrender documentation ) I then was able to call my insurance company, XXXX, and cancel the insurance coverage on the vehicle. I'm thankful that at least my insurance company was knowledgeable, and whose recommendations likely prevented a terrible and costly mistake of insurance lapse. I would most certainly just have canceled the insurance thinking it was a non-issue and they were secure at XXXX, NY DMV, had I listened to XXXX. Not happy about that. I feel the need to repeat again, I received exactly ZERO calls once the vehicle was taken to notify me that it had been repossessed or where I might collect my belongings. In retrospect, I should have been more proactive in researching what I might qualify for, rectifying accounts sooner, and contacting the lender sooner. With growing medical concerns and having just lost my job, it was not ideal circumstances and it was certainly taken advantage of, I believe. XXXX of note, too, I never believed it would come to this under these circumstances. It has happened before - many times- with this NBT vehicle loan account, that their notifications are sent at the same time a payment is made, or payment is made shortly afterward and it just comes to naught because I know its paid I so didn't worry about it overly much. I have several notification over the years with this account that look exactly like this one did. Suddenly this was different, how? I coud n't help but think they were taking full advantage of people in the unfortunate Covid situtation to profit from the high value of vehicles on the market. That's, of course, personal conjecture, but that's how it felt. I heard nothing again from anyone at NBT about the sale of the vehicle, which surprised me because I expected to be informed, per what I believe is XXXX law, of the where and when of the sale of the vehicle as it has to be disclosed prior to sale. The last notification I received was on XX/XX/XXXX ( Letter dated XX/XX/XXXX - that was the actual date of repo, BUT SENT BY NBT on XX/XX/XXXX - as seen on THEIR ENVELOPE per USPS tracker ) that they intend to sell the property and that they have already repossessed the vehicle ( This is the first written document I received about it having been repossessed - 6 days later? ) On XX/XX/XXXX, once I had a good, solid chance to reconcile all of the financial records that I could locate and retrieve all of the documents that I have- and verify through USPS tracker were the only ones I received from NBT and when- I sent an email to all of the persons who XXXX XXXX copied in her last email to me. I felt if she thought these persons should be included on the email, they must be ones whom I should include as well for this purpose. I wanted to addressed the issues I had with the way that this was handled and give them an opportunity to make ammends in some way, but didn't actually expect any good to come of it. It was more of formality and a courtesy. I also informed them that I would be filing a complaint about the way the repossession was handled because it needed to be made a matter of record. I did add in my email that I thought that New York State Legislation Bill 2849, protecting ones from repossession during XXXX would certainly have applied in my case. She responded, I feel, rather smuggly, that the piece of legislation I presented was never enacted into law and so they were perfectly within their right to repossess the vehicle. And that if I couldn't find the license plates, I should contact the DMV. Which definitely gave me the impression that she did not really read my email at all, as obviously, the plates are no longer still missing a half a year later. What I wanted to address was that I was misinformed about the license plates being surrendered in XXXX when they were not and that it took me 6 days to find them along with my personal belongings with no help from NBT, where, I feel certain, they must have had SOME legal obligation to provide me with this information sooner than they did. It felt outrageous to have to hunt this information down as hard as I did. ( See email thread attached ) IN SUMMARY : I received NO phone calls from NBT after the repossession except in the case where I continued to call and email and hound until the person who was handling my account, XXXX XXXX, finally picked up the phone. The only XXXX letters I received on or after the repossession were : XXXX : The letter dated XX/XX/XXXX ( but not sent XX/XX/XXXX ) the same day as the repossession, ( Sent XX/XX/XXXX - Received XX/XX/XXXX - see usps tracker ), stating they already took possession of the vehicle and intend to sell it after XX/XX/XXXX at a private sale unless past due payments are made, which I told XXXX I was not able to do since I was not working. NO information about when and where the sale would be. Also, this is the first mention of where my personal belongings, item belonging to my landlord ( Property parking tags ) and XXXX license plates could be located. By then I had already tracked it down myself and made arrangements to go take care of it myself before the impound lot was closed for the next several days for the holiday. 2 : The letter dated XX/XX/XXXX ( but not sent on XX/XX/XXXX ) the same day as the sale of the vehicle. This lets me know that the vehicle has been sold and now I owe {$4900.00}. Vehicle was SOLD : XX/XX/XXXX Sale Price in a Private Sale : {$7500.00} Payoff Loan Amount : {$12000.00} XXXX -- -- -?? Repossession Fees : {$520.00} XXXX -- -- -?? Amount of Deficiency : {$4900.00} The last screenshot I took in my NBT Online Portal before my account was deleted showed {$10000.00} - AFTER citing " Repossession '' and OTHER " Fees. NBT Bank and XXXX XXXX FACTS : XXXX. In the spring of XXXX I purchased solar from XXXX XXXX and financed by NBT Bank XXXX XXXX, NY. XXXX. Like other solar companies I spoke with, both NBT Bank ( XXXX ) and XXXX XXXX misrepresented the manner in which I would receive my Federal Tax Credit. They both said that I would receive the {$17000.00} plus on my tax return and that I had 18 months to pay this amount to NBT Bank, or my payments would increase {$100.00} per month. Receive additional amounts on my tax return was nothing new to me, as I raised my child with a low income and consistently receive more than I payed in. XXXX. Upon filing my wife and my XXXX taxes, I discovered that I would only receive {$3400.00} in solar tax return and that the then now, remainder of the {$20000.00} would be rolled over for 5 years. This violates FTCA Section XXXX dealing with Unfair or Deceptive Acts, because they assure me that I would receive the credit on my next tax return. Both of the contracts of NBT and XXXX violates the FTC on " Clear and Conspicuous '' What they said and what happened were XXXX different things, and this is happening ALL over the solar industry. XXXX. I called NBT Bank to try to get them to restructure the note, but no one would ever return my call. I decided to stop the auto pay and close my bank account in attempt to get NBT Bank to the bargaining table. XXXX. NBT Bank started their collection process and for at least the first XXXX contacts, NBT never informed me that " this is an attempt to collect a debt '', and NBT Bank never informed me that they would be reporting me to the credit bureaus, resulting in my credit score tanking XXXX points in XXXX day. As a result, I have had XXXX credit card companies drop my limits from {$5000.00} down to {$500.00}. XXXX. My wife was so disturbed by this and other events connected to the situation, that she moved out a month and a half ago. However, she is a collections manager for a large bank in XXXX XXXX Texas, and she says that NBT bank is violating OCC and FTC regulations. My XXXX personal bankers, XXXX is a President over multiple branches, are both baffled at how NBT Bank can get away with their fraudulent practices. XXXX. NBT Bank has not cooperated with me at all, even though I have stated every time that I want to pay my bill. NBT attempted to turn my system off remotely and when that did not work, they sent contractors to my place to do it manually. I was not home and the gate was shut. They left a letter in the weeds XXXX feet from my gate. Before this, the wind destroyed my ground mount system, on XX/XX/XXXX, because of faulty installation. XXXX finally warrantied their product as of XX/XX/XXXX. NBT Bank and XXXX XXXX are both crooked, and there are plenty of similar reports all over the internet. This has caused me physical, mental and financial hardships. I am legally XXXX. However, I do have a lump some to pay NBT Bank, but I do not believe they deserve XXXX dime, because of the injuries and violations that they have caused. I do have all dates and copies

To whom it may concern, Ref. NBT bank Account XXXX XXXX On XX/XX/XXXX at XXXXXXXX XXXX I paid the total amount due at the time, via phone, the customer service rep told me everything was fine and my next payment will be on XX/XX/XXXX. I specifically asked when was my next payment. ( Payment was made on XX/XX/XXXX their system reflects it on XX/XX/XXXX ). Unfortunately, they reported me on XX/XX/XXXX ( minus XXXX points on my score, this will appear on my records for 7 years ) on a Saturday, they were closed already. The information provided by the customer service rep was inaccurate and misleading as they did not say I was getting reported even though I paid. And I was reported after I paid. I placed a complaint through XXXX and they said the information was correct. If they cant return my points at least they have to say the true and add a note saying that they reported me after the account was paid. They damaged my credit, they do not address this issue either as I contacted them several times and they told me they were working on it, they were not they simple added more damage saying that their info was correct. I cant emphasize this enough they reported me even though the account was paid, they reported me after I paid. The information is not correct since they are not even making a note in my records telling that account was paid on XX/XX/XXXX however NBT reported it on XX/XX/XXXX, at least they have to give me that. Because XXXX the true. This was a loan for the education of my son, he is a special needs person. This is causing him tremendous stress, the past 2 years are been very difficult and the last thing we needed is something like this. He is dealing with XXXX and XXXX. NBT actions were unnecessary, a total lack of respect for a customer and a display of an institution doing what they want without any regards for their customers or peoples lives. We are more than a number, we are people dealing with many different issues and regardless of that we ALWAYS paid. The account was paid, however they reported me because they have the power to do so. Enclosed are copies of my records ( phone call record when I made the payment, payment, credit report ). I look forward to your reply and a resolution to my problem and will wait before seeking help from a consumer protection agency or the XXXX XXXX XXXX. Our mortgage lender NBT Bank has denied us access to government programs to help struggling homeowners and we are now in the first stages of foreclosure. My husband and I bought our home with a USDA loan and live here with our XXXX boys, ages XXXX, XXXX and XXXX. We had financial struggles during Covid and contacted our lender NBT Bank to see if they could offer any type of help. The agent was rude and condescending and said there were no programs except for find a way to pay us or we will take your house. I was not able to work due to Covid shutting down my position and we did not know about the CARES act forbearance and did not know that there were any loan modification programs for distressed homeowners and NBT Bank did not want to tell us about any options. We were very frightened and had to apply for a loan from my husband 's 401K to get caught up, a loan we are still having to make payments on from my husbands check. After getting caught up and going back to work we had no problems with payments for about a year until I got XXXX and it was a XXXX XXXX XXXXXXXX and the doctor told me I needed to stay off my feet and again we lost my income and the good news now we have a healthy XXXX XXXX XXXX son but it was hard to keep up with the mortgage payments. We contacted NBT Bank to see if they would work with us on the payments or if they could help us, and they said we would have to pay 100 % of missed payments and late fees and legal fees or they would put us into foreclosure. We just got letter from Attorney last week and we are now in foreclosure. My husband has a good job, he has worked as a XXXX and is now the XXXX XXXXXXXX XXXXXXXX at the local XXXX XXXX. I had been working as a XXXX XXXX but when Covid came they shut down my district for XXXX. A few months after I went back to work I became pregnant and we lost my income again. At this time my husband has taken a second job working as a XXXX XXXX XXXX XXXX. We no longer have a problem with the mortgage payment, the only issue is that NBT Bank is telling us we need to pay them {$15000.00} in one payment or we are going to lose our house. We now know that NBT Bank is required as a servicer of a USDA loan to consider us for several different distressed homeowner options which they have told us did not exist in the past.

On or before XX/XX/2022, an account with NBT Bank had a security breach. As Power of Attorney for the account holder, I contacted Customer Service to report the security breach. Customer Service had no POA documents on file and requested them. Luckily we were able to get the account holder on the phone and she requested the security breach response. Customer Service gave us an email, XXXX, to send POA documents too. On XX/XX/2022, at XXXX est, POA document were sent. At XXXX that same day, we were asked to get an Affidavit Power of Attorney and sent a blank form. On XX/XX/2022, The Affidavit was signed and certified by a Notary Public, who was also an attorney who review the documents as well. They were scanned with some additional information needed about myself who is the agent. The Bank then denied the power of attorney documents, because they were not original or a certified copy, despite being the scans of the originals as requested by the Bank with a Nortized affidavit of power of attorney with the documents. This is not the first time I have had this type of issue with NBT Bank. The Local branch in XXXX NY does not have a manager and the workers there will not help or even talk with me about POA. Moreover, the declination came via email with no explanation. We were told to contact customer service - who promptly hung up on me, transferred me, and then sent me to a random voicemail unaffiliated with the company. NBT Bank is currently withholding access to this account that I have legal power of Attorney over. Why would waste time and money on a Power of Attorney document if we can't use it? It seems ridiculous that NBT Bank and other financial institutions and regulations have a misguided stance on POA. The agent has the authority of the individual, plain and simple. The Document wouldn't have gotten signed and filled out by the individual, the public notary, or the lawyer who drafted it ; if they didn't know what they were doing and what power they were giving the agent. It is not NBT bank 's responsibility to advise their customer on legal matters, it is actually frowned upon. They are not the judge and jury in this situation, the account holder is. If something nefarious happens, it is on the agent, whom they have a record of, not the bank.

Due to a recent health condition that happens when I was in XXXX, I struggled to make my loan payment for five months. After returning back to the XXXX called NBT bank and made the past balance in full. On XX/XX/XXXX I made a back payment in the amount of {$2100.00} and continue since then to make regular monthly payments in the amount of {$420.00}. Since XX/XX/XXXX until now I am trying to receive regular monthly statements with payment tickets which will allow me to send checks to NBT bank rather than calling every month to make payments over the phone. Sometimes I am not in a position to call the bank to make a payment. I tried to sign in online for automatic payments and was told I can't do that due to my past balance. Every month I called and bagged the bank to send me payment slips with the statement so I can mail back the check rather than calling but every month I was told the statement will be mailed and nothing happens. I also asked why they don't update the loan information on my account online so at least I can see the remaining balance however nobody ever answered that question I was always transferred to the collection department even though I was current on my payment I still made over phone payment within bank collection department. When I asked why I am been transferred to the collection department when I am current on my payment I was told that my balance was written off and that only the collection department can collect funds from me. So the question is if my balance is written off by the bank to whom in the world I am making payment? Well, I did finally receive a letter, not a payment slip just a letter stating that my payment should be sent by XX/XX/XXXX in the amount of XXXX to NBT bank in an enclosed envelope which was not there, no payment slip to detach and mail with a check so my question to this bank do I deserve some respect as a human and why I been treated without the respect all the time when I had health issues like humans and struggle but show my will to make payments on time as I promised when I took the loan

Per original complaint XXXX, which I can no longer access because it was closed based on the " goodwill gesture '' of NBT Bank on XXXX XXXX XXXX I was provided with the following statement ( See below & attachment ) : QUOTE : Therefore, as a goodwill gesture, we will be removing the repossession from your credit history and we are working to eliminate the remaining balance of the loan. You can consider this letter as evidence that there is no longer a deficiency balance and your loan is considered paid in full. We hope that in the future, should a similar situation present itself, you would speak with members of our collections and/or customer service teams to keep us informed of your situation and allow us the opportunity to work through the challenges and avoid repossession altogether. Sincerely, XXXX XXXX XXXX XXXX XXXX MONETARY RELIEF AMOUNT {$3300.00} Instead, the debt was reported AGAIN after this as a repossession at the close of that month dropping my credit score again. After nearly 3 months with no intervention on the company 's part, I submitted a dispute with credit agencies using this document provided by XXXX XXXX as " evidence '' for removal from my credit report. Instead of the result of the dispute being a removal, NBT 's response, despite furnishing the credit agencies with this document from the XXXX XXXX XXXX XXXXXXXX XXXX as it was presented in the original complaint through the Consumer Financial Protection Bureau, was to immediately report the debt TWICE in ONE WEEK as DELINQUENT ACCOUNT, DEROGATORY, COLLECTION/CHARGE OFF, amount owing ( TWO different amounts on TWO different days - See attached ), which dropped my credit score with XXXX ANOTHER XXXX points!! XXXX is showing recent delinquent reporting from NBT ( see attached ) - actual score will be updated within a week. XXXX Dispute is currently still pending. I shudder to think what the end result of that will be. There are hardly words.

My name is XXXX XXXX. XXXX years ago I opened a landlord/tenant security deposit at NBT Bank XXXX XXXX XXXX XXXX XXXX. I opened the account with the branch manager XXXX. Recently my tenant moved out so I went on XXXX to retrieve her security deposit with any interest. I was told by the teller that the account had a XXXX balance. I explained how this was impossible and asked her to double check, upon some investigation the teller learned the money had been withdrawn by the bank yet the account wasn't closed. I waited an hour and a half to speak with the branch manager ( same person I opened the account with ) who stated the account was deemed dormant and the money was given to the state. He told me not to worry and he would get it resolved, he stated that tenant security accounts are not supposed to go dormant and the account was indeed set up properly. He later called me at home to tell me the State had the money and the woman ( my tenant ) would have to retrieve it from there. I feel I am responsible for returning this security deposit to the tenant, she has been patient but explained to me she needs the money for upcoming expenses. This mistake was clearly and admittedly the banks fault. Whether the account was set up incorrectly or not is not my problem. I followed the state guidelines with tenant security deposits. The branch manager XXXX later checked again and reported to me the account was set up properly ... they keep passing the buck as to who's fault it is. Either way, it wasn't mine! My main concern is I have checked the state website for unclaimed funds on my tenants behalf and the funds are not even there! This is an erroneous error that needs to be rectified.

This is a reopening of the NBT XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, NY Phone : XXXX. They did not answer the question, I believe they are scamming me. {$2100.00} ( XXXX XXXX XXXX XXXX and XXXXXXXX dollars ) is missing from my account. I felt harassed when I made transactions on XX/XX/2023 due to strange door noises, no pens at desk, felt they were going to scam me. After I made the transactions, I went XXXX minutes later to another NBT Branch to get a printout. The printout said I made a {$1800.00} ( XXXX XXXX XXXX XXXX dollars ) withdrawal and {$2100.00} ( XXXX XXXX XXXX XXXX and XXXX dollars ) deposit. On XX/XX/2023, It says that around {$2200.00} was on hold. NBT said on the phone the XX/XX/2023 on hold is impossible even though I have a NBT printout. The {$2100.00} ( XXXX XXXX XXXX XXXX XXXX dollars ) is missing from my bank statement. I believe NBT Bank XXXX XXXX is stealing from me using some sort of advanced scamming method. The deposit does not appear on my monthly NBT statement. They stated that the bank teller of XX/XX/2023 left my account open and deposited someone else 's check but I received no evidence. I believe this is their scamming technology. I am a pre-senior and do not recall that day much, but remember I felt uncomfortable enough at the NBT XXXX XXXX to go to another NBT Branch later that day to get a printout of transactions. I have never done that before. I am trying to find the deposit slip, but I may have discarded it. I am a mixed race female.

On XX/XX/2022, my partner and I submitted a pre-qualification construction loan application for a house we were auctioning for. Later that day, the loan originator sent us another link to start a pre-qualification process. This created two loan applications. The loan originator said he had canceled the first application, but the bank nonetheless made two hard inquiries on our credit reports, one on XX/XX/2022, and another one on XX/XX/2022. On XX/XX/2022, we followed up with the loan originator, and asked him about this, since we never authorized two hard inquiries. We again followed up on XX/XX/2022, when he said he had sent this to upper management. We again followed up on XX/XX/2022. On XX/XX/2022, he just responded that he had " sent this on a while ago. '' On XX/XX/XXXX, he said he would send it to their credit agency representative to ask for removal. On XX/XX/XXXX, we called the three major credit agencies, and only XXXX took it off the credit report. However, XXXX and XXXX required a letter from NBT Bank specifically requesting the removal. We sent him that via email, and we tried calling the bank several times but we could not get ahold of someone that would talk to us about it. They only took our information and never called back. The loan originator never responded to our email. So now we have an additional credit inquiry that shouldn't be there and a bank that won't help us.

On XX/XX/2023 an order was placed to XXXX XXXX in the amount of {$1000.00}. After approximately 4 days of no order update I tried to call the merchant. There was no answer and the voicemail stated they do not discuss orders over the phone. I then sent a message through their online contact form. I received no response. I then sent a new message through their XXXX business page. They replied that they do not discuss orders through XXXX. So I used their contact form again but this time was a little more assertive and expressed my discontent. The company then canceled my order and returned only 80 % of the monies paid to them. They told my husband it is a fee kept due to my disgruntled email. They later added this clause to their return policy page. They provided no services whatsoever. It is theft. I have filed a dispute twice through our bank ; NBT Bank with being denied the claim both times as they say the policy is stated on the website which was not there until my husband contacted them about the refund being shorted. The company has no other contact information other than the phone number listed. I am thinking the company is potentially a scam and that they do this as a way to get money. NBT Bank should be protecting its consumers from problems like this. We have used NBT for all of our banking needs for many years and the service has been exceptional until this current issue.

NBT Bank, a New York bank, failed to cancel a car loan payment made through their internal bill pay services after I had explicitly canceled internal bank payment. On XX/XX/2022, I called to have their internal payment canceled. This was in order to control my payment through their provided web portal. In the call with customer service, I was sent a form to fill out, sign, and return by email to cancel their internal payment. I returned that same form on XX/XX/2022 to XXXX. On XX/XX/2022, I found that not only did they NOT cancel their internal payment for my auto loan, but also the payment that I setup to replace their internal payment was charged. I called their customer service questioning why my cancelation request was not put through. I was informed that they had received the request but had failed to cancel their internal payment. I was then informed that they could not cancel, refund, or stop either payment made to NBT Bank. As a result of this, I have been double billed for an auto loan payment and was required to make efforts with my own bank to cover the unexpected expense of double billing.

NBT Bank paid an ACH payment that came thru my account. I believe it was for a partial amt. At the time I was in the XXXX XXXX jail for a violation of my supervised release. The judge sent me back for 9 months. At which time I didn't realize I was over drafted. It wasn't until some time after I came home that I realized of the debt. I had contacted NBT Corporate because the branch was no longer open. I tried to make an offer to settle the bill, I didn't agree with why they charged me that amt. before closing my account. I had contacted the CFPB for guidance on the matter and asked what i could do I was told that I should offer a fair settlement and they don't except it then that's on them and it should be removed. So I offered the 50 % they didn't take it. I disputed it. The collection account was removed. After receiving the removal verification I still called NBT bank back to offer the 50 %. They refused. What I cant understand is why in a dispute it was removed. And it ended right back on my credit report. I would like to have the item removed please.

Vehicle loan that was sold to an insurance company that has submitted incorrect information to credit burues multiple times. After disputing the information via XXXX, which resulted in no update or any information changes. The creditor has continued to report incorrect information to negatively affect my ability to obtain a loan deliberately. I have contacted them directly multiple times and they deny the accounts existence. Intentionally doing this to prevent me from having this issue resolved to allow them more time to continue to submit detrimental information to credit burues. This includes their denying payoff by the dealership that the car was sold to by me when I purchased another vehicle. Items such as repossession of the vehicle over and over continue to display on my report and I am unable to get any assistance with this. I know the dealership went through a great deal just to locate this creditor and if it is resolved after almost a year of them having the vehicle I was not updated nor does it display that on my credit report.

I bought a car and the dealership did the loan through NBT Bank. NBT Bank charged me twice for the first month for my car payment. They took {$390.00} on XX/XX/XXXX and {$390.00} on XX/XX/XXXX. After calling XXXX times and not getting the issue resolved, I disputed the second charge with my bank ( XXXX ). On XX/XX/XXXX they charged me a {$20.00} fee for revoking the second payment. I have called XXXX more times. A representative claimed that there was an internal and external payment set up and she deleted the second one. That apparently wasn't true as the XXXX time I called both payments were still set up. This XXXX representative claimed the second payment was deleted and I could put in a request to get my {$20.00} back, but based on the fact I've had to call them XXXX times to try to get a normal monthly autopay set up and they can not figure it out, I highly doubt they'll get it together. I want the {$20.00} back and I want confirmation they will just take XXXX monthly payment a month ( they can use the external payment set up ).

Long story short.. NBT Bank partnering with XXXX XXXX and did not have a proper procedure to investigate or vetted a local solar company for licensing. They partnering with an UNLICENSED solar company name XXXX XXXX XXXX XXXX XXXX and put me in over $ XXXX loan and the solar systems in INOPERATABLE but they want me to pay for the loan? I filed a complaint with State of Hawaii Department of Consumer Protection and they investigate that this XXXX company does not have license to install solar and also that company hire unlicensed contractors to install solar for both of my properties. Fast forward, the state investigator told me that I do not have to pay until the system is operational or at least pass and closed out the permits with the state. I email them multiple times but they only extending my loan and now they report it to my credit report that I did not pay. This causing a tremendous negative impact on me as I am in the middle of applying for a mortgage for my investment property. Please see attachments.

NBT has been a terrible experience throughout the term of my loan. Between a faulty XXXX system that randomly cancels itself and charges you a late fee and puts a late payment on your credit, and rude customer service, I regretted going with this company from the start. When my vehicle was totaled by an XXXX XXXX, my XXXX XXXX included coverage for the remaining balance of the loan and any other outstanding fees. NBT is now claiming that I still owe over XXXX and has made this a charge off on my credit. I have tried to solve this with the company by telling them my XXXX XXXX was willing to pay for it, to which they reply that they wont cooperate with the insurance. This bank has single-handedly ruined my chances at getting a home.
