I fell behind once on my car payment ( XXXX/XXXX/15, {$330.00} ) but have a grace period ( XXXX/XXXX/15, {$350.00} ) and made automatic payment arrangements to pay {$250.00} on XXXX/XXXX/15 but apparently something adverse occurred & the full payment was n't successful only {$200.00}. The representative that called my phone at XXXX had not only a nasty attitude but threatened to repossess the car if they did n't get the {$47.00} that 's remaining for the agreement but the whole time he 's threatening me I 'm trying to tell him that it 's not an issue I 'll go load the money on a card so they can get the remaining {$47.00} dollars. He continues with the threats saying if they do n't get the {$47.00} that they 're going to repossess the car, I told him that I did n't like how he was talking to me & threatening me when I 'm going to correct the simple issue by applying more money for the agreed payment but he kept on with threats & a very nasty attitude so I asked to speak with a supervisor & was told that " I am the supervisor! ". If I would n't lose money that I 've already invested in this car I would definitely send this car back because of this companies customer representative & if I manage to save another down payment I wo n't concern myself with the money I 've loss making payments & give the car back & take my money to another car dealership that deals with a different bank/loan company because that Nationwide Southeast customer service representative had absolutely no cs skills whatsoever, all he did was threaten & talk over me, he did not try to listen or get an understanding about what was going on, which is at the least what should 've been done so the issue could be rectified. I 'm going to make sure that I report this company complaint to every source available because people do not deserve to be talked to or handled like this under no circumstances! His attitude & behavior was atrocious & the fact that he was a self-proclaimed supervisor makes this issue even more appalling. I will try my hardest to save for another car down payment just to not do business with Nationwide Southeast again!

I am a federally protected consumer, and my name is XXXX XXXX and I am making this complaint against the Nationwide Cassel. On my Consumer Report I noticed that Nationwide Cassel with you states that it has been Charged-Off with Bad Debt Profit and Loss Write-Off. I mailed letter on XX/XX/2022 and I asked for them to send me documentation of proof of ownership, general ledger, and accounting trail for this Charge-Off. I have not received anything and the only notice is when I looked at my consumer report it states that this account disputed and resolved. That's false information and that's fraud. What is a charge-off? According, 7 CFR 1956.54 is the writing off of a debt and termination of collection activity. Collection Activity includes reporting delinquencies to my consumer reports and you know that know or have reason to know that this is false and misleading. They stated that you charged this account off right? Collection activity should have stopped, collection activity includes Nationwide Cassel furnishing this to my consumer report. I am aware that something being furnished to your consumer report is a part of collection activity pursuant to 31 USC 3711e. There should not be any collection activity on this account it should have stopped because it should have been terminated. All Collection activity includes you furnishing this to my credit report. If so, they are committing tax fraud. If they filed a 1099c they were supposed to send it to me. They wrote this off and cleared it from their books as income and this makes it uncollectible. This money has to be accounted for with the IRS. That means there is no more debt because it's considered income after that and income cant be reporting as debt on any consumer report. I want you to know that that are in Violation of the IRS and I will be filing a complaint with the IRS because they never issued me a 1099-C for taxable income for this charge-off. Please provide me with your prompt attention and response are both requested and required.

On XXXX XXXX, 2016, I contacted Nationwide Southeast LLC to inquire about a letter I received over the past weekend from Nationwide Southeast LLC about my payment being past due. They informed me my {$210.00} payment was due XXXX XXXX, 2016 and now I owed $ XXXX.+ due to a past due amount. I informed them the car I purchased XXXX XXXX, 2016 was involved in an accident around XXXX XXXX, 2016 and the car was a total loss. I paid the payment in XX/XX/XXXX knowing the insurance claim would not have been processed by the payment due date. The insurance company sent a payment of $ XXXX.+ They confirmed they received that payment on XXXX XXXX, 2016 and it " went towards the balance, '' however, I still owed for the " payment due. '' I asked why the insurance payment was not used for a payment that would have been due XXXX XXXX, 2016. They stated it went towards the balance, but I still owed the payment due amount. I asked again why the insurance payment would not go towards both a balance and payment due. Of course it was a circular conversation at that point. I am filing a complaint because they are concrete in their explanation and it does not make sense to have a very much reduced balance that is not considered to have sufficed for the XXXX XXXX, 2016 payment. I called today to ask for a breakdown of how my payments have been used to pay against the balance. They stated they had to mail it to me because it is not their policy to email or fax that information. This will cause more interest to accrue against me. I do not mind paying the payment, however by the end of the month the GAP claim should provide the remaining balance to be paid and I am concerned that if I over pay, I may not get a refund in a timely manner or in the amount that would actually be due back to me. My view is that a reasonable resolution would be for this to not reflect negatively against my credit, and for the payment due on XXXX XXXX, 2016 to be considered the $ XXXX.+ amount sent by the insurance company.

In XXXX, I filed chapter XXXX Bankruptcy protection. In XX/XX/XXXX, I requested my plan to be dismissed. Roughly 5 months later I received notice for the first time from Nationwide that there was a balance due on the loan previously protected in the Chapter XXXX filing. Further the loan was " crammed down '' as part of my Bankruptcy XXXX filing. Nationwide reversed this " cram down '' after my Bankruptcy dismissed. Once I was notified that I owed on this vehicle I immediately settled the balance for less than what was owed but legally in full. After doing so, Nationwide has consistently reported erroneous information on my credit reports. Currently, on my XXXX report they are reporting that my vehicle was " Charged Off '' 6+ times ; in XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX. This account was settled and legally paid in full in XX/XX/XXXX. I was not given an reasonable opportunity to pay/settle the debt after my bankruptcy was dismissed so as to avoid a negative reporting by Nationwide on my credit report. I became aware of the debt in XX/XX/XXXX and immediately settled it once I became aware that it was due. For the past two years I have gone back and forth with Nationwide disputing and asking them to correct the unfair and inaccurate reporting of information on my credit report to no avail. They make one update and then add others that negatively impact my credit. THEY POSTED SIX CHARGE OFFS ON MY CREDIT REPORT. AS A RESULT MY TRADELINE FOR THIS ACCOUNT IS REPORTING 60+ DAYS. THEY POSTED OTHER INACCURATE PAYMENT INFORMATION ON MY CREDIT REPORT. NO PROOF OF CONTACT TO ME VIA PHONE OR OTHERWISE! AGREED ACCOUNT WAS SETTLED FOR LESS THAN FULL BALANCE, NOT THE ISSUE. Although I know that I am in collections, this company calls me more than 7 times daily. When they call and I am not able to talk they get very ugly and sayu mean things to me as well as threaten me. THis company even refused to give me a payoff amount and tried to force me to pay money before giving me a payoff to pay them off through a trade in. I was refused service, but then they turned around and released it to someone that I did not authorize them to do so. This company forced me into a deferment for COVID -19 and then added four months to back en of my loan ... .then mysteriously I now owe late fees that equal to monthly payments although I had no late fees at all when the pandemic hit. THey will lie and state that this is not what I was being told by their reps ; however, I started recording my calls with them because they have the reputation of not being honest about what they are telling the consumers. My deceased mother has been talked about negatively by a rep and I have been called several liars about the health status of my XXXX brother who I was caring for after a XXXX. I was threatened that " I would be walking and they are picking my car up since I am acting like I am at work and cant talk right now. '' When the rep talked negatively about my deceased mother and retalited, I was told that they were picking up my car because I was being nasty to the rep ... they completely ignored that my dead mother was talked about on the call. The Email I sent to their Senior Manger was " I am one of your clients that has just experienced a ruinous phone conversation this morning with one of your managers. Around XXXX hrs of today, I called to speak to XXXX of your staff members about my account in hopes of assistance with my payment thats scheduled for tomorrow. Ive been having complications with my payments for the past three months and was seeking further assistance when I spoke to your Manager XXXX. I was understanding, and respected him informing me of my account 's situation and was completely respectful the entire time ( recording would show ) However XXXX was not! XXXX was displaying an aggressive tone while talking to me making me feel attacked about a personal situation. His talking in a coercion manner and cutting me off was him displaying His professional representation of your company. He continuously tried to belittle me and talk to me as if I was ignorant or a juvenile was out of line. Monday XX/XX/XXXX I spoke to a representative from nationwide explained that i was in the hospital and to not call at this time. Wednesday XX/XX/XXXX i received another call from a representative from what seems to be a personal cellphone calling again getting aggressive asking for his car after I said I spoke with your company earlier this week explaining Im in the hospital and to not call me. It is harassment, its one thing to be called in attempt to collect a debt but when you ask for peace while in the hospital you should receive it. I answer the phone for nationwide on a frequent basis explaining to them theyve placed a garnishment on my wages and it is putting me in financial hardship and that i dont have the money to pay anything current they call everyday saying well we wanted to know if anything changed. I have had to yell and scream while in the hospital bed at this representative elevating my XXXX XXXX and causing pain because this company can not respect time in the hospital. Then i called to speak with a supervisor i spoke with XXXX XXXX she is no better than the representative instead of addressing the fact my time to recover has been disturb she starts going into how late the account is.

through this CFPB complaint portal I was able to obtain some additional information regarding the extent of my identity theft. it was initially though of to have begun in or around XXXX as the police report stated, also all info that I was able to get came directly from my credit report as these accounts are not mine. I was informed that there is another vehicle that was accepted as a trade in also in my name. I have never traded in a vehicle in my life. furthermore I had fought my employer to prove that I was not liable for the wage assignment to the point where I won a case with my union after resigning my position. it was also said in the response to the complaint that my personal identification was used " same picture '', also it was mention that my police report stated XX/XX/XXXX was when the theft of my identity began, well that was all I had knowledge of at the point, so a revision of my police report will be done but this company seems to suggest that since my personal info was used to obtain these goods then the debt is valid, also as explained I had been granted a discharge by federal guidelines of all debt in XXXX, and this debt would have been included if it were valid NAC act # XXXX

Upon receiving a credit denial letter from Nationwide Northwest LLC I was concerned since I had not applied for credit and I checked my credit monitoring service to find I had an inquiry with this company which was labeled for " auto loan ''. I did not ask for an auto loan or give this company authorization to pull and check my consumer credit report. I found that someone had used my personal information on the internet to apply for loans online. Upon notifying this company in writing with a certified letter which was received by their company on XXXX . They responded to my letter stating that they received an electronic application from XXXX XXXX , and despite me not applying for credit with this company, and Nationwide Northwest LLC not providing any evidence or documentation that I did in fact provide authorization to have my consumer report pulled they are refusing to remove the inquiry. I have sent a second letter and demand in hopes they will honor the rights and protections afforded to the public under the Fair Credit Reporting Act as well as the Federal Laws. I have asked that this unauthorized inquiry be removed immediately.

Nationwide Acceptance 's website says I owe a certain amount of money significantly less than my monthly payment. They acknowledge their website is wrong and says it does not calculate interest correctly when overpaying the monthly loan amount. Then the debt collection phone calls started, where 80 % of the calls came from blocked numbers ( says No Caller ID ). I have been hung up on and told the phone calls will not stopped. Additionally, when trying to resolve the issues and be current, I called two days before the next payment was due to fix the issue and they choose to only disclose the amount I owed for one month instead of two ( due to their errors on the website ). Later, still trying to fix the problem and be current, I was told there were little notes on the discussion and I was mistaken. When talking to an actual branch in Nevada ( different from their collections office located in Illinois who never returned my call ), when I told them about the blocked calls they denied ever doing it and their legal team is big and welcome complaints.

On XX/XX/2020 when the COVID-19 pandemic started I was left without a job. I was XXXX by the time. After three months without working and XXXX, I had to move to my moms house, I was XXXX. I couldnt pay rent, bills and car payment. I stopped making the car payments like around XXXX. I didnt have any money and I couldnt work because I was XXXX and it was very risky for me to work by the time. I started to get phone calls from an agent debt collector. I explained my situation and everything I was going thru. They obviously didnt care and were charging me a ridiculous amount I didnt not had at the time {$14000.00}. They kept calling me every day. They even contacted my mom. I also did not had possession of the car because I took it to a mechanic because it was having problems and I just left it there. Nationwide Cassel lending has not sent me a monthly statement for my vehicle loan. They are refusing to repo the vehicle and allow me to pay what is left. I have tried to settle on this account. My " high balance '' is {$19000.00} and I owe {$12000.00}. I offered to settle on the loan for {$6000.00} ( my employer has been trying to work with them ) they refused and wanted {$9000.00}. If is settle for the {$9000.00} then I am paying back more than what I borrowed. Also, the lender has told my employer " I would NEVER be able to pay this loan off even if I make the payments and catch up the loan '' I feel they do not want the vehicle because it is not worth at all what they charged me, they have no intentions in resolving the debt because they are loan sharks. They just want the interest. My employer has tried several ways to pay this debt, settle the debt and find a resolution. I do not feel this is legal, I just want to resolve this debt. I have contacted XXXX ( inquiry XX/XX/XXXX ), Nationwide Cassel ( inquiries XX/XX/XXXX and XX/XX/XXXX ), and XXXX XXXX ( inquiry XX/XX/XXXX ). I let each of these companies know that I did not recognize the inquiries that THEY placed on my credit report. I asked each company to provide me with a written consent from me indicating that I agreed to the credit inquiry. After several hours on the phone getting nowhere with each of these companies and getting the runaround, I decided to send a formal letter to them ( each letter is attached ). I have found that most of the companies that are reporting information out on my credit report are receiving their " inquiry '' from a 3rd party and are not the actual furnisher of the data. This fact makes it even more imperative to see the written approval with my signature.

Every morning I get a call from Nationwide ( the company that i got a loan from ), during business hours when Im at work and I keep repeating to them not to call me at work to resolve the issue and they still repeat the same thing. Also they call me after XXXX as well. Also yesterday they called me in the morning as well as in the afternoon when I told them not to contact me at work. They usually call me multiple times within the same day as well. I recently told the manager of this company to stop calling my cell phone and they didnt listen to me, and still call me. Also when they call me on my personal number, they not only call from their business line but also several different personal numbers.

I asked for verification of the alleged debt that is charged-off. I have not received a response on the verification of this debt and this company continues to increase the balance of the charge-off as well as the high balance on my credit report at all three credit bureaus. On XXXX XXXX, XXXX I contacted them over the phone and asked why this charged-off account is continuing to increase without verification he along with his account manger stated that interest still accrues after charge-offs. I do n't understand how a debt can be reported that is n't verified. I contacted them several times and have not been successful at all. I contacted in XXXX XXXX and XXXX XXXX as well.

Everyday for the past month and a half the finance company for my car call me and my boss repeatedly at work threatening me and my boss. I am not allowed these kind of calls at work. they will call every 30 seconds until someone answers the phone. Our company handles hundreds of calls a day and they are interfering with company business by tieing up our phone lines. I have told them and so has my boss these calls are not allowed over and over. The calls are unprofessional and involve curse words. I have been told if this keeps up I will loose my job. Last week started complaint with WA state AG, as I received a garnishment notification on a debt judgement dated XX/XX/2014. Washington state statute of limitations is 6 years. I do not recognize the company. There are not public records for my person in the said county on the written threat of garnishment mailed to my address. Some of the judges listed in the order do not exist and/or are in other states, jurisdictions, not related to the state or county the garnishment is said to be filed in.
