In XXXX, I closed on a mortgage refinance, through a mortgage broker who I have worked with before. Part of the process involved my receiving " Lender Credits. '' The process involved me bringing cash to the table and paying down the overall balance. While the transaction was perhaps a bit more complicated than normal, it should have been a pretty ordinary refinance. During the refinance process, the broker looked at how to " make use of '' the entire lender credit that I was entitled to. The broker negotiated a " principal credit '' on my loan, in the amount of {$1100.00}. Money that the lender would take off the balance of what I owe, after the loan was funded. After closing, I noticed that I had not received the credit after making a payment on the loan. I inquired with the broker on XX/XX/XXXX, and he let me know that I should contact Nations Direct to attempt to get it sorted out. Since that day, thats what I have been attempting to do. Through a series of disjointed exchanges, I have been given nothing but the runaround, and incorrect information from low-level representatives who have no interest in resolving the issue. When I request to speak with management personnel, I have been told they are not available. Unfortunately, I can only give you one employee name at this point, but I can explain when the calls were made and the substance of each conversation. Dates are all derived from my call records and emails. Had I known that the situation would get to this point, I would have started requesting employee names on each phone call. On XX/XX/2020 at XXXX XXXX I called Nations Direct, and explained the situation. The representative ( incorrectly XXXX told me that I had a packet of information on the way to me via mail, which would lay out how I would get my principal credit. She said that it was sent to me a few weeks previously, and I indicated that I thought this was strange since I had not received it yet, and if the information had been mailed when she indicated, I probably would have received it. We ended the call, and I resolved that I would continue to wait. On XX/XX/2020 at XXXX XXXX I contacted Nations Direct to inform them that I never received anything related to the principal credit, and explained that I called 3 weeks ago and was promised that information was coming to me in the mail but I never received it. The representative asked me for ( completely irrelevant ) details Such as Who had I talked to, When did I call? I said I can tell you when I called, if its relevant in some way. I looked up my logs from my phone provider and told her when I called. As I had suspected, the information was irrelevant. She then went on to inform me, that no, I had not been sent a packet of information related to how to get my principal credit. I asked why the previous rep had told me that I had, and she said she could not tell me, only that the packet that the previous rep was referencing did not pertain to my issue, but rather was something unrelated. ( We believed it was a welcome packet ). The resolution to this call, was that I needed to send an email to a generic customer support email to have this investigated. She then, as I am sure she is required to, invited me to complete a telephone survey. I responded positively to questions about professionalism, but negatively in terms of ability to resolve the issue, and general satisfaction with the call. After this call, I sent an email as instructed, that same day, XX/XX/XXXX, which is attached to this compliant. I received a generic auto-reply saying the company would work on it, Thank you for your email. This is a no-reply email address. We will process your request as soon as possible. On XX/XX/XXXX, I sent a second email to Nations Direct, requesting Would someone mind acknowledging receipt of this so that I know this being worked on? Thank you. As of this date, neither email has been responded to, in any way, except for generic automated responses. I also received, via printed mailed letter, a seemingly automated letter, to both my first email, and my second email, ( a few days apart ) stating that Nations Direct would investigate, and respond within the time required by law. I received a follow up call in the subsequent days, from an employee who I believe is XXXX XXXX this is what has led to the final straw, a letter I received just today, and why I am writing with this complaint. XXXX asked me about the call I made on XX/XX/XXXX, and why I had indicated that I left negative feedback in my phone survey on XX/XX/XXXX. While he, much like the representative I spoke on XX/XX/XXXX, was professional, he was not helpful. I explained the situation and he had informed me that it was being looked into, and he was not able to help me directly, at that time. I indicated that I would continue waiting. Subsequent to my conversation with XXXX, I made another attempt to resolve things with Nations Direct, on a call made on XX/XX/XXXX, to a separate representative. The call lasted 31 minutes, but most of that was hold time. The representative said that she had no information, nor access to information. She could see the status of my e-mail inquiry sent on XX/XX/XXXX, but could not tell me anything about it. Admittedly I lost my temper a bit on this call, and I said that I needed to speak with someone who was actually in a position to help me. I requested to speak with a manager. She said that a manager was not available, but that I could leave a voice mail for a manager. Given the companys responsiveness so far, I opted out of leaving a voicemail for a supervisor. She then told me that I had a response date is due, for Friday, XX/XX/XXXX. I informed her that I was so frustrated and upset at this point, that I was considering filing a complaint with a regulator or something like that, but I would give them until the date she provided me to contact me. As I expected unfortunately, XX/XX/XXXX came and went and I have not heard anything from them, or received any indication, in any form, that my issue is even being worked on. The final straw came, when I opened my mail today and it had a letter from Nations Direct, from XXXX XXXX, in the Research Department. I have attached it to this complaint. It is dated XX/XX/XXXX, and presumably took over two weeks to arrive to me. The letter says that As you stated in our conversation, you did not have any additional comments regarding the servicing of your mortgage at this time. That is patently false. I told him that I did not have any additional comments, related to the survey I submitted on XX/XX/XXXX. This was in the context of XXXX, already telling me that he was not in a position to address my issue, but that at some point, someone else would. This letter seems to indicate that they are closing out the research request, after over two months of runaround, providing inaccurate information, and a series of representatives who took no interest in resolving the issue.

I was contacted last week, XX/XX/XXXX. I unfortunately missed this call, after identifying that it was my mortgage company I double checked my loan activity and confirmed my payment was processed and in line so I assumed everything was fine and I would receive another call if there was an issue. I did not receive another call, two days later on a Saturday I received two letters via first class mail. One was a " Notice of Breach '' and that it was a document in an attempt to collect a debt. This letter stated that I failed to make the monthly mortgage payment ( s ) from XX/XX/XXXX to XX/XX/XXXX. It went on to state that late charges had accrued in the amount of {$0.00} ( which is odd, considering they are stating I had not paid for months. ) It said I was required to pay the entire amount ( which happened to be my mortgage payment to cure this default. It went on to tell me the level of XXXX I would be in if I didn't pay this and that it needed to be paid on or before XX/XX/XXXX. It went on to detail the legal action the could take against me, including suing me for attorney fees required to get the amount from me. It also gave me where to contact to dispute this ( or pay it ) and where to contact for an assistance program. The second letter I received on the SAME Saturday detailed that I was in default on my loan and they have requested a field representative from XXXX XXXX XXXX , XXXX ( XXXX ) to contact me on their behalf for an in home face-to-face interview. They went on to tell me that they expect the following things from me : verification I am the home owner, photo ID, that I talk to them about either alternatives to foreclosure or that I will be foreclosed on, that I listen to them transfer me to some other person to talk about hardships I may be experiencing. They also required the following for this " mitigation '' : Hardship letter signed and dated by all borrowers explaining what caused my financial issue, verification of my income, two pay stubs or year to date profits if I am self employed, income for children, copy of signed federal tax returns ( all pages required ), copy of the last three months of bank statements, my most recent property tax bill and home owners insurance statements. If I wanted a third party to represent me I needed to fill out more paperwork. Today they sent the same delinquency letter via certified mail that was signed for by someone who did NOT own the home. I contacted them on the phone the following Monday and after verifying who I was I was immediately asked if I was paying my delinquent amount. I asked for details on this issue and why I was being told via letter that I was not paying mortgage payments in a three month span despite the website, THEIR website, I long onto to pay saying NOTHING about this. They said it would not show late balances. I asked for specifics on what dates were missing, they stated that I failed to pay in XX/XX/XXXX but also XX/XX/XXXX, then it changed to that XX/XX/XXXX was late. They stated the payment was received XX/XX/XXXX. I asked how to dispute this and was transferred to a gal in customer service or dispute, something like that. I told them I was very aware I had made these payments and that my bank could confirm this, their records are wrong and I am disputing. I was given a fax number to send my information two, told three times it needed my signature. At my bank I found that my mortgage payment was processed and received XX/XX/XXXX. The following day I was charged an " Non-sufficient funds '' fee of {$30.00}. My bank assures me that I very much had the funds and it was processed and I was unlawfully charged that fee. More viewing of my account information shows that I paid my mortgage and it was posted and effected on the following dates : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX. They claim XX/XX/XXXX was unpaid and XX/XX/XXXX was late, my bank statements showing processed statements at the beginning of both months find this false. I took it a step farther and reviewed My Loan Activity through the same website I make monthly payments to. Their own website shows that my payment was posted and received XX/XX/XXXX however two days after this on XX/XX/XXXX there are two " advance reversal '' that I have no idea what they are. There is a " principal curtail '' immediately before and immediately after this payment. Again, there records clearly show that my payment for XX/XX/XXXX was posted and received on XX/XX/XXXX. There are FOUR " Advance reversals '' after this payment on XX/XX/XXXX ( which is the date they claimed on the phone I paid and paid late on. ) On XX/XX/XXXX there are TWO following " mortgage payments '' listed on my account activity for the full amount of my monthly payment that I did not make and it was already paid on XX/XX/XXXX. I have no idea what a " principal curtail '' is or an " advance reversal '' let alone the listed mortgage payments but I can see that they ALL effect my principal balance, some positively and some negatively. On the very same My Loan Activity statement it shows I have unpaid late charges of {$0.00}. My credit report shows they have reported all of my payments on time and in full since I purchased my home. When I mentioned this on the phone I was told that after XX/XX/XXXX if I do not pay they may report to my credit. Why wouldn't they report the initial " failure to pay '' that they say was in XX/XX/XXXX? Why is it all of a sudden XX/XX/XXXX I owe as well or need to pay by or my credit will be damaged after NO attempts to contact me after this initial " failure to pay? '' This is a company that called me any time my check was later than USUAL - on both occasions they called I said it was sent and got an " oh, okay, yeah, I see it's here. Thank you. '' I have NEVER made a late payment and I have never been contacted about paying late or not paying the dates they claim prior to XX/XX/XXXX when they sent these two letters that took over a week to get to me. I believe this company is mismanaging my account and my funds and is now attempting to force my into paying money I do not owe because of their own mistakes or into foreclosure on a home that has appreciated over $ 60k since purchasing it in an area that continues to rise in property value.

We have experienced an extremely frustrating and stressful process while attempting to obtain a loan for the purchase of a new home with Nations Direct Mortgage , LLC. This lender is based in California doing business in the state of Florida ( XXXX ) .We entered into a contract to purchase a home, in a new development in XXXX XXXX Florida XXXX on XX/XX/XXXX and provided ( {$2500.00} ) in earnest ( EMD ) funds after receiving initial loan qualifying approval from Nations Direct. The loan application then went through the underwriting process and resulted in several conditional requirements. These conditions were addressed, and we received notification of final loan approval on XX/XX/XXXX. The conditions of the loan were never entirely relayed to us although multiple requests were made to obtain a list of said conditions so that we could address them in a timely manner. This resulted in over a three-month delay of the final loan approval from the time of the initial loan approval and property contract agreement until the loan final approval on XX/XX/XXXX. We thought about moving to a different lender but were informed by the company that no other lender would fund our mortgage, so we should just do what was asked believing that would be our only option. One of the conditions for loan approval was that the credit scores must be at or above 640. However, the lender made several hard credit inquires on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, resulting in the credit score dropping below the lender requirements, jeopardizing the loan funding. Although this was a direct result of the lenders actions, we were advised that if we did not raise the credit scores, we would not be able to close. As a result, we had to take additional actions and employ a third party at additional expense and pay down revolving credit to bring the credit scores back to the required target ( {$2200.00} ). We were successful in raising the credit score above the threshold again. We were promised that we would be cleared to close once the credit score item was resolved. The first closing date was set for XXXXWe took time off work to close at the prescheduled time. We arrived at the closing location a little before the scheduled time. We received a call approximately 5 minutes after the closing was to begin that stating that we would not be closing. We inquired as to the reason, but no reason was ever provided. Because the loan was approved, and we were scheduled to close on XX/XX/XXXX, we moved forward with the appraisal and inspection of the property, incurring those out-of-pocket expenses ( {$600.00} ). At the onset of our mortgage application, we applied for and received a grant award for down payment assistance through the state of Florida. The lender received our award letter on XX/XX/XXXX. The letter was sent to the lender via the loan processor on XX/XX/XXXX. The lender had approved our loan on XX/XX/XXXX with these funds applied and included in the truth in lending statement. During the XXXX timeframe, the lender relayed that the down payment grant funds may not be able to be used and this would need approval from senior management, which, again, delayed closing. The initial purchase contract was valid through XX/XX/XXXX. We were assured the clear to close was forthcoming and because the closing had been postponed multiple times, we had to initiate several contract extensions ( XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX ). The lender never provided communication as to the closing status, reason for delays, or requests for additional information/documentation that was needed to close the loan. We have also made several attempts on our own to contact the lender for answers. As of XX/XX/XXXX, no additional closing date was set, nor any additional information provided as to the status of the loan. Because of the lack of communication from the lender and the elapsed time from the initial contract and subsequent extensions, the seller refused to accept any additional extensions and said they would never do business with us again. The earnest money was forfeited due to the contract expiration and we lost the ability to purchase the home we had chosen and spend over six months working towards. Every time we asked questions about the loan or asked about the status, we were ignored or received responses such as we know what we are doing and dont ask questions. Questions regarding the loan status or process were never answered or relayed accurately. The scheduled closing did not occur, and no courtesy call was made to inform us we would not be closing. We were told that no other lender would fund the loan. The lender decided, after approving the loan through underwriting, that the down payment assistance grant funds may not be allowed. I believe the fact that we are non-married joint applicants played a factor in the issue. The lender continuously changed/impose different terms or conditions on the loan after the initial offer and throughout the process. When all the factors are taken into consideration, it appears that we are victims of discriminatory and predatory lending practices. We believe the lending company violated the Equal Credit Opportunity Act ( ECOA ) and the Fair Housing Act ( FHA ) Federal laws. We also believe the interest rate was inflated along with other fees that are not in line with reputable lenders risk-based pricing structures. As of today, XX/XX/XXXX, we have not received an approval, nor denial of the loan, and no representative from the lender will discuss and/or disclose information as to the status of the loan.

XXXX XXXX Loan with Nations Direct Mortgage Co # XXXX We got behind on our payments XXXX and XX/XX/XXXX. We started a loss mitigation package with nations direct. And along came another company called XXXX XXXX XXXX in which was supposed to help us save our home and reduce our payments and our interest rate. It was a loan modification program It sounded too good to be true. We paid them from XXXX to XXXX. XXXX we tried and tried to call them with no response. They basically took {$7500.00} from us to help us save our home but changed their phone numbers and address. So at the end of XXXX we contacted nations direct again, and started another loss mitigation package/application. I sent them everything that they requested, even several items I sent several times. They made it very difficult. I sent bank statements directly from our bank website. But that wasn't good enough. They made me print out every page, and sign and date it, and then send in every page separately, it is all listed on the website that they sent me to upload documents. It's called loansolutioncenter.com I can give you the username and password if needed because all the documents are still there. Early XXXX, they sent us a rejection letter stating that we did not provide the documents that they requested including paycheck stubs. They are all there uploaded onto the site, right there in front of their faces. They could've denied us, and that would've been different than them lying to us. The original foreclosure/auction date was XX/XX/XXXX. So the clock was ticking and we tried and tried to contact NationsDirect for help and no one responded. XXXX lady we called last week hung up on us. She said she was going to give us an email address and a fax number but she hung up before she did that. We were forced to go to the courthouse and file bankruptcy and we submitted the receipt to nations direct escrow attorneys to help stop the auction. They were able to postpone the auction until XX/XX/XXXX. But we are hoping that nations direct will let us resubmit another loss mitigation application or just review what we've already submitted and help us to lower the payment so that we can stay in our home. Our income has changed as my wife went back to work in XXXX working XXXX jobs to try to help us. XXXX XXXX XXXX XXXX, and Have not been able to travel like I used to. XXXX shut down my travels & income complete My wife and I are the cofounders of a business/ministry that we have managed for over 30 years. We do not feel like we were treated fairly with nations direct mortgage company in their loss mitigation department when we submitted everything they asked for. We will probably need to do a separate complaint for XXXX XXXX XXXX. But I wanted to include that part of it because that's the whole story of how we got here. We wanted to try and save our home from the very beginning of when we could not make the payments. We trusted XXXX XXXX XXXX and we trusted nations direct mortgage company to help us. We were at their mercy because we do not have tons of money to hire attorneys to fight this. Our XXXX son still lives with us. We don't have the finances to move to an apartment or a rental house and we want to stay and keep our home. We are XXXX & XXXX. We do not want to continue with the bankruptcy if we can get nations direct to help us.

Nations Direct Mortgage company refuses to pay my property tax that is being collected as a part of my FHA mortgage payment. XXXX, 2022, I received a letter from Nations Direct stating that their records indicate the property is currently undivided and listed by the taxing authority as To Be Apportioned ( TBA ). To enable our payment of taxes, contact the local tax collector about this issue and send a corrected tax bill. I contacted our XXXX XXXX for a corrected bill and they informed me the bill is correct and that they are not aware of any undivided or TBA on my parcel. I faxed over my tax bill as requested by the mortgage company. Upon my follow as suggested a week later, they had not received my fax so I was forced to pay my first half taxes {$1500.00}, out of pocket to avoid a XXXX XXXX penalty and potential lien on my house. After another week, I called Nations Direct and they received my fax and issued a check for tax payment. I contacted XXXX XXXX and they received the payment and issued me a check back for the payment made out of pocket. At this time, I believed this to be settled. To my surprise, I received yet another letter from Nations Direct with the same verbiage for my second half payment for taxes. I called Nations Direct again, and was told this is a mistake. They have what they need and not to worry. Weeks later I followed up again to ensure this was resolved and was told they are not sure why this is stuck! I asked for a reevaluation of my mortgage and I will pay everything out of pocket for insurance and taxes. They agreed. I received another letter so I called back and they told me I can not have a reevaluation because this is FHA. We went round and round for months. I paid out of pocket again. I spoke to a supervisor at XXXX point and she said they paid the second half taxes. She said they have to pay my taxes because its the law for an FHA loan. They did not pay it, as it is still in my escrow account AND they just increased my house payment and I do not know why. This has been going on now for almost XXXX year. This mortgage company is horrible to deal with and no one can give you any factual answer. The letters are signed the Tax division/Escrow Dept but they tell you there is no one in that department to speak with. I contacted an attorney and she sent a Demand letter. Nations Direct sent a reply advising they will look into the matter and reply in the days legally allowed for follow up. After 30 days then then sent a letter saying they can not reply to 3rd party signatures. Then how can they send their initial reply to the attorney?? They took this opportunity to tell me of all the letters they sent me but never address their attempts to assist me in resolving this matter. They were given full consent to contact XXXX XXXX themselves for the needed information. Then they advised me contact their customer service department. I cant afford a {$2000.00} retainer for the attorney as Im spending $ XXXX a year of taxes on top of surviving in todays economy. They are taking advantage of me and its completely unacceptable. I have done everything they have asked. Please help me in resolving this matter. If I have to refinance, I will ending up paying a larger interest rate and bigger payment all because they refuse to help me.

At closing, I was advised to send payments to Nations Direct and included were 2 payment stubs for their XXXX XXXX, California office. About 2 weeks before my first payment was due, not having received anything from Nations Direct, I mailed my payments to their California office. No advisement or acknowledgement received, and no payment envelopes or request ( s ) for payment for the second month, I mailed the second month payment to the same XXXX XXXX address. BOTH payments and checks had the loan number on the check and was rounded up. Included in both payments were notes for the additional money to be applied towards the principal. I FINALLY receive packet from Nations Direct, XXXX XXXX, Illinois office with payment stubs for XXXX, Texas. There's not been ANY credit or reference to payment being received or applied to my loan. I call the XXXX XXXX, Illinois office and advise them payments made, check number and date ( s ) of the check ( s ) and date ( s ) processed. I'm told it's just a clerical error and matter of payments and letters crossing, all will be adjusted accordingly ... in the meantime, I owe them another months payment. Mind you, with the payments I've made, I should be 3 months AHEAD ... the very next day, I receive 2 sets of documents from Nations Direct telling me we're going to court, mitigation over my property, " Nations Direct is trying to collect a debt, '' I need to call and resolve this matter immediately ... my 5th phone call to Nations Direct, still dealing with ineptness and inability to properly credit and apply payments to my loan/account ... I advise my loan officer and mortgage broker of the issues I'm having and include Nations Direct in the email. I'm told via email it's " an easy fix '' and one that will be taken care of immediately ... I receive an email from Nations Direct advising the issue is resolved ... one week later, I receive a new statement from Nations Direct, advising I owe a payment this month and still no adjustments made on the most recent statement ... the next day, a second set of documents advising mitigation AGAIN!! I advise Nations Direct Service Manager via email this is NOT resolved, I'm refinancing with another outfit, I can no longer deal with a company who does not know how to properly resolve complaints of inefficiency, lack of professionalism and properly train their employees on how to process payments! At this time, I should not have to make a house payment until XXXX, yet the last statement from Nations advised a payment was due for XXXX ... Nations Direct should reimburse me all expenses for both financing and re-financing! Included in the email chain with NO RESPONSE is Chief Operating Officer XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX who said he was one of the owners, via telephone conversation, but in email, denies ever saying such, and is advising he is only a service manager, and XXXX XXXX XXXX, XXXX XXXX and XXXX XXXX also included and no response from either of these 2 people. XXXX XXXX and XXXX XXXX XXXX also advised of the issues involved with Nations Direct. Initial email advising all parties listed above started XXXX XX/XX/2019. The last email to Nations Direct, all parties listed above was XXXX XX/XX/2019 and there's not been any response from Nations Direct since that time.

Began when I missed a mortgage payment in XX/XX/XXXX, there after the payments were made late until XX/XX/XXXX. I requested assistance with a loan modification so the mortgage company, Nations Direct Mortgage sent a loss mitigation packet in XX/XX/XXXX which was completed and emailed on XX/XX/XXXX. The result, I was approved in XX/XX/XXXX for a repayment plan in amount of {$2000.00} which was to start XX/XX/XXXX. I called Nations Direct Mortgage loss mitigation department who told me to contact, XXXX XXXX ( under writer ) regarding the repayment plan, so I sent the email on XX/XX/XXXX letting them know I could not afford this month repayment plan but I never received a email or return call from Mr. XXXX. On XX/XX/XXXX I received an email from the Loss Mitigation processor, XXXX XXXX who requested another loss mitigation packet due within 30 day, then on XX/XX/XXXX an email was received from the loss mitigation department which states " upon review the following is still being requsted " not a typo. The email asked for the same information sent prior but I sent it again and never heard anything from the mitigation department. Then on XX/XX/XXXX a email was received from loss mitigation requesting the following : a hardship letter, making Home Affordable, the 4506t form, child support payment summary and ( 3 ) months of bank statements which was sent via email on XX/XX/XXXX. I never heard back from Nations Direct Mortgage. I filed for bankruptcy XX/XX/XXXX using assistance from bankruptcy lawyer XXXX XXXX XXXX, office in XXXX MD who informed me that the mortgage company foreclosed on my property on XX/XX/XXXX, I was not aware. After filing process the Mr. XXXX informed me that Nations Direct does not want to work with me thru the bankruptcy process, I filed Chapter XXXX, therefore Mr. XXXX gave me the name of a third party company, XXXX XXXX XXXX non profit program were this company could purchase the property and resell to the owner. The contact person was Mr. XXXX XXXX, Negotiations Manager, contact number XXXX who tried to reach out to Nations Direct Mortgage but had no success. Mr. XXXX states he has never experience this unprofessional behavior from a business, but states he will keep my file opened for any future assistance. Recently I contacted another non profit company, XXXX XXXX XXXX, contact person Mr. XXXX XXXX, HUD housing counselor, phone number XXXX who also tried to contact Nations Direct Mortgage but they will not respond, so told me to file an complaint. I received a letter from XXXX City Circuit courts which states my automatic stay has been terminated as of XX/XX/XXXX. I take full responsibility on my current situation, it's my fault but I would like a fair chance to resolve without loosing my house. I worried that me and my children will be homeless but I'm also angry because I feel the company will not cooperate. I still reside in the property and I hope someone can help my situation.

On XX/XX/XXXX we had a forbearance plan ( due to the Covid pandemic ) until XX/XX/XXXX when we voluntarily took ourselves out and began making regular payments after the required three-month trial period. We were told that we could put the money on the back of the VA loan and make regular payments. We never received the modification agreement packages that we were promised. We continued to pay from XX/XX/XXXX to XX/XX/XXXX. They never sent the full modification paperwork agreement. However, they finally sent a partial claim but that was not what we agreed to. We originally were offered the full modification ( that program twilighted that we originally agreed to for a full modification ). Then they ( the mortgage company ) declined us and made a false report to the credit bureau and to the VA that we were not making our payments and that they are going to proceed with foreclosure. So we reported to the credit bureau that it was not true and to our VA that it was not true and sent in all of our payment receipts for review, The mortgage company corrected the credit bureaus to show that we are 100 % good, but filed a default judgment in the county office for nonpayment. We discovered that they did not apply any of the payments we made to any of our accounts ( without our knowledge for over a year it was put into a suspense account ) and charged us from XX/XX/XXXX to XX/XX/XXXX interest 3.25 % fee for all the payments that they did not register to our account although they were accepting payments. We tried to sell our house because of the negative remarks and the constant letters of foreclosure and knocking our credit scores from XXXX to XXXX whereas, by their false claims, we could not even do a refinance or borrow money from anywhere else because they messed up our credit score by continuously inquiring and denial of our credit when they assured us that we could do a home loan. And because it was our mortgage company that would do the loan whereas they even had us do an appraisal ( they ultimately refunded me the fee after I complained that they knew I did not qualify because of the low credit and the constant inquiries and denials, of course, brought my credit score down. And afterward informed me that my credit score was too low to do anything. Now that we are put in default we must sell our house for way under value. And threatened that if we do not do it we will lose our VA entitlement and credit be messed up even more. We believe that after we supplied the proof of our receipts to other agencies the mortgage company purposely stopped accepting our payments to be able to default on our home and this is unfair practice and should be investigated thoroughly. Furthermore, we tried to take equity from our property so that we could settle our bills and pay arrears but they constructively caused us financial upheaval while also ruing our reputation and creditworthiness.

I received a letter from Nations Direct on XX/XX/XXXX indicating they had performed an analysis and because they did not have my HOI renewal my mortgage would be changing from {$1800.00} to {$2500.00} starting XX/XX/XXXX. I called immediately and was told that was an error and to throw that notice out and they would be sending a correction. In XXXX after I paid my normal payment I noticed the XXXX amount was not updated. I called again and was told they did not have my HOI declaration page and once submitted the can update. I called my home owners agency they faxed it over and I received a confirmation from Nations Direct on XX/XX/XXXX the insurance was paid. XX/XX/XXXX I called again because I was attempting to pay XXXX mortgage at the original amount of {$1800.00} but the system would not take my payment. Upon calling I was told they could not change my payment and I needed to pay {$2500.00} for not only XXXX but also for XXXX because they could not change my payment back without proper notice. They did tell me that an Escrow Analysis indicated that I had overage and I would be receiving a refund check within 30 days of the XX/XX/XXXX notice. Today, XX/XX/XXXX I call to check on status of this refund and it is no where to be found and the request was placed today and I can call back in 72 hours to see if the refund had been issued. Not only did they give me misinformation and I waited for them to send an update I had to make payment arrangements so they would not ruin my credit with a late payment. My husband and I had to struggle to come up with the money to pay the EXTRA {$700.00} for XXXX and again in XXXX and Nations Direct knew they owes me {$2100.00} and made NO EFFORT to issue my refund. I am thoroughly disgusted to call them today and for them to tell me they had no idea as to why my refund was never issued and they have known about it since XX/XX/XXXX. This company needs to be hld accountable and someone should look into their business practices because it is a helpless feeling when no one is trying to help you and you tack on an extra {$700.00} expense as if it will not impact people. If I didnt pay it my credit would be ruined. I sent complaints to the company and they went unanswered because they do not care. No one has provided me any answers and now I am still waiting on a refund. I have attached the XXXX and XXXX escrow analysis. ALso the confirmation of the HOI being paid and no one ever said that I would still be responsible for the {$700.00} increase for 2 months until I called back on XX/XX/XXXX. This speaks to the inconsistencies I get when I called for help.

In the middle of escrow to purchase an investment property and considering my real estate agent 's legal obligation to represent me and my loan officer 's ability to close the loan, I discovered loan officer had been manipulating numbers, providing false disclosures, and deleting / editing words and numbers before they got to me, I voiced my concern and he said he di n't want to be part of this. Agent calls me and telling me loan officer has the right to cancel everything without me being notified. Agent also tried to have me sign a Buyer / Seller Cancelation of Agreement twice for 2 unrelated reasons, he has tried to have me sign this so I can be the one breaking the contract which would release him and loan officer of any of their obligations to close escrow. I reached out to the lender Nations Direct Mortgage and they had their secretary tell me 8 times in 2 days : " l 'll let them know you called ) but have gotten no call back or response to any of my several emails. I have reached out to their company 's managers several times and they had decided to stay quiet. Today, I sent one 1 email to all managers from all parties involved in the agreement and reminded everyone our escrow close date is in 5 days, and per the agreement I have performed all my duties and that they were putting me in a position to not meet the guideline, I also proposed for them to give me a signed declaration they want out so i can proceed to find another lender and agent, loan officer 's said he is going to have his attorneys contact me and that he is canceling my loan which i also find in violation of Fair Lending Act and as an act of retaliation to divert responsibilty. Also, loan officer when i refinanced 2 properties last XXXXI told him before the closing date I did not want to sign 1 of them because it was {$1000.00} off, he said i will get refunded {$1000.00}. The refund came about 2 months later form his business checking account in a written check, I asked him about it and he said that is how it is done, but now that i am reading about this case, i found out this was extortion, I reached out to send his money back and no response. Also several concern on predatory lending patters like inadequate or false disclosures, bait and switch practices, inflated fees ( like telling me the only 1 loan option for me was one with a {$28000.00} total closing costs which included a {$13000.00} commission for loan officer on a {$460000.00} )

I am having trouble with getting a loan modification completed with my Morgage Company ( Nations Direct Mortgage ). I submitted a request to be taken off of forbearance back in XX/XX/2020 when I went back to work from being furloughed. I was originally told we would receive a package in the mail that we would fill out to complete the mitigation & that options would be provided to us for the repayment of the amount we owed for the two months forbearance we applied for. That package never came so I contacted them again asking for it to be emailed in which they said they would do. Still no email was sent. XXXX morgage statement was sent to us with the full amount due for the two month plus current months mortgage so we promptly called again because now it was reflecting derogatory on our credit report. The rep that assisted suggested we email XXXX To voice our concerns with them reporting late payments to the credit bureau since we had not rightfully been given the opportunity to repay the amount owed. He mentioned that our account was not late because it was their delay in getting the mitigation 's settled & not to worry he would send in a request as well on our behalf. He also stated at that time we were under review & should revive an answer with the next week because it had been 30 days. Fast forward to XXXX still no response had been given to us other than our account was under review & still waiting to be processed. We have called week after week to try to get this resolved and no one can assist. We wait on hold for hours while they " review the account '' then they say it's been passed to a manager & they will contact you in which they never do. I have called every month & can not resolve this. We are now well past 120 days of waiting to settle our mitigation. It has gotten to the point where they have stopped allowing us from making our monthly payments on the portal because they state the account is under review & that's been for two months now. We had to set up bill pay with our bank in order to send them our money. I can not spend anymore time or emails in getting this resolved. I need your assistance please. I have uploaded various attempts in us contacting them even up to today when I sent a screenshot of my call log where I waited 17 min on hold before they hung up on me while they were supposedly " researching the account ''

I am a veteran and have a VA Loan. On XX/XX/XXXX I submitted a complete package containing all required information to Nation Direct in conjunction with my request for mortgage assistance. I received a letter dated XX/XX/XXXX that they received my information and that a appraisal may be completed. XX/XX/XXXX I received notification of a foreclosure action dated XXXX/XXXX/XXXX. I spoke with XXXX in the Loss Mitigation Department and was advised that as of XX/XX/XXXX. She stated there was no letter sent or attempted contact made regarding the items that were missing. She also staed that there was no activity from XX/XX/XXXX. She advised that there was a note on XX/XX/XXXX that file was incomplete and that a incomplete notice of mailed on XX/XX/XXXX which I never received. I questioned as to why my loan was submitted to foreclosure if they did not make a decision on the request for modification and why a denial letter was not sent to me. She was unable to answer. I also told her I had a right to appeal the denial and that was not afforded to me. I gathered all financial information and submitted those documents through their portal, XXXX. The next following day, I logged back in to see if there was an update. It showed nothing was updated. On XX/XX/XXXX I submitted ALL required documents via e-mail to XXXX. I made contact on XX/XX/XXXX and verified that they acknowledged the e-mail and was reviewing the documents. XX/XX/XXXX I was notified that additional documents needed ; XXXX Bank Statements and all pay stubs through XX/XX/XXXX. XX/XX/XXXX I e-mailed the requested information. I reached out to them today and they are asking for more information although they confirmed that all my financials were up to date through XX/XX/XXXX and that my file will not be moved to underwriting until when the " Processor '' deems appropiate. Today then even asked me for my XXXX Bank Statements but the statements has not been released. I feel like I'm being setup to lose my home. I have complied with all information they have asked of me and I simply want a fair chance to keep my home. As we continue to go circles in request for documents, my foreclosure continues to advance although from a legal prospective I question whether this foreclosure is valid. I believe that the handling of my file has violated the " Homeowners Bill of Rights Act ''.

On XX/XX/2023, I contacted Nations Direct mortgage about a hardship we were experiencing. I was told to fill out an application and send it in. I quickly got an email right away to fill out the forms. I contacted them the next day to have them explain what the forms were for and how it worked. I was told that once the application was accepted, we would not be at risk for foreclosure, late fees, or being reported to the credit bureaus. I asked for something in writing at that time and was told it would come in the mail in the documents I received once our application was complete. When I received the letter in the mail saying the application was complete there was nothing in there about late fees or credit reporting, only about the foreclosure. After my application was fully turned in and complete I contacted the loss mitigation department. I called on XX/XX/XXXX, XX/XX/XXXX, twice on XX/XX/XXXX, on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. I was trying to get verification in writing that the account would not be reported and I talked to a few people who assured me it would not, one person was going to send me an email with the information but our call was cut off and when I called back the next person said that it was not guaranteed not to be reported but could not give me a definite answer on the negative either. I asked for something in writing stating it would be reported and was unable to get that either. I eventually got someone who stated that it will likely get reported and I explained the situation. She told me that due to the information I was given that if it did end up getting reported to contact the research department to have them adjust and correct it so that it does not report. In late XXXX is when I noticed that it had reported to the credit bureaus and contacted the research department only to be told that they would not change it because at least one person told me that it might be reported they were going to keep it as is. We entered into a forbearance as of XX/XX/XXXX and so I contacted them again once that was official and stated again, that we were now in a forbearance from the application that was deemed complete as of XX/XX/XXXX, prior to any late payment, and we would like the adjustment made. They explained that it would not be adjusted as the forbearance was only from XX/XX/XXXX.

I was hired by a company on Tuesday XX/XX/2019contingent on my background check screening. My background check was completed on Friday XXXX19. My start date was Tuesday XX/XX/XXXX. I was in orientation until about XXXX when I was then pulled out of conference room by Human Resources. I was sent to the Director of HR 's office and was told by the Director of Human Resources that the company had to Part ways with me and was handed a check for the day. I then asked why I was being fired and the Director stated my background check reflects I have 4 previous XXXX 's, which is False. I do NOT have 4 XXXX 's. The report is incorrect and I told her that and I also asked why they are telling me this now when the report was completed on Friday as I got an email stating the report was completed. She stated that she wasn't there on Friday to retrieve the report and then she showed me the report and I told her that the information reporting on the background check report was incorrect. She didn't give me a chance to explain or prove myself, instead I was escorted out by HR. It was humiliating and embarrassing beyond words. When I got home I went online and obtained a Driving Record report from the CA DMV 's website along with proof that I am XXXX XXXX XXXX Approved and I explained to her that I had to interview with XXXX and was finger printed and their background check is ran through the FBI 's database and that I was cleared and approved. I then emailed my supporting documentation to the Director of Human Resources and told her she made a mistake on reading the report and not giving me a chance to explain myself. I also texted message the hiring manager letting her know what happened because I really liked her and was excited to work there. The next day on XXXX19 the hiring manager messaged me back stating that she would talk to the Director to bring me back on board.That morning the Director of HR left me a voicemail stating she wanted to bring me back on board, but at that point I was so humiliated that I was not going to go back. I feel like I wasn't given the opportunity to prove myself at all. Her mind was made up as she had my check printed out already. I feel I was treated very unfair and was profiled and humiliated on my first day of employment.

I was approved for the Homeowners Assistance Fund through the Florida Department of Economic Opportunity in XX/XX/2022, but my mortgage company is not updating my account. The approval was for my reinstatement amount and 4 monthly payments ( XXXX payments total ). There were XXXX checks dispersed in XXXX XXXX for {$42000.00} and the XXXX for {$1600.00}. The XXXX check was dispersed in XXXX for {$1600.00} and same for XXXX. I notified Nations Direct Mortgage via the Loss Mitigation department back in XXXX that these funds will be coming and emailed them the grant letters, per their request. I began calling again about mid XXXX to check on the status of my account. It was suggested that I wait 30 days from the time the funds were sent out for an update. That is what I did, so I began calling again starting the second week in XXXX. Today is XX/XX/XXXX and despite calling 1-2 times per week for about a month now, the funds have not been applied to my account. The same action is performed everytime I call- they send an email to their HHF department for an update. I have even had the Florida DEO on the line with me on 2 occasions with no progress. The DEO confirmed that 2 payments were processed by the mortgage company, however Im not very clear on where that information was being pulled from. Nations Direct was even unable to confirm an address that payments should go to when the representative from the DOE asked for one. I fear that, at this point, there is no process in place at Nations Direct on how to accept these types of payments, despite me notifying them back in XXXX about it and emailing the grant letters that contain all the information they need. This mortgage company has already once erroneously sent my account to a Foreclosure attorney, but fortunately I was able to catch it early and get that stopped and reversed. However, they still charged me for the attorney fees. Im afraid of losing my home. Please help me.

Let me start at the beginning, that works best. On XX/XX/18 I received an appraisal of {$71000.00} to buy the property my wife and I own at present. On or about XX/XX/18 we closed on the property and the loan balance at that time was {$63000.00}. By XX/XX/18 we had made additional payments on the balance of the mortgage and reduced the balance to {$57000.00}. Also by XX/XX/18 we had put a new shed ( {$5000.00} ) on the property and installed a new laminate wood floor ( {$2000.00} ). The new balance was about 75 % of the appraised value of the property. On XX/XX/18 I made a written request and email request to the lender to cancel the PMI for the mortgage because the balance of the mortgage was less than 80 % of the appraised property value. The lender responded that I must have a certified appraisal done in order to have the PMI canceled. The lender also informed me that the new appraisal would be valid for a period of 12 months. When I sent the lender my appraisal it was less then 6 months old, but the lender would not accept my appraisal. On the one hand the lender will not honor my appraisal that is less then 6 months old, but will honor their appraisal for 12 months. Since that time I have paid the PMI and made additional payments to the loan balance. To date the balance is about 32 % LTV. When I contact the lender I get the same song about a new appraisal to cancel the PMI. We are living in the home and made it comfortable since it is our only property. We are paying taxes on the property and all utilities are connected. I feel like the lender is being unreasonable and charging the PMI without regard to the terms of the mortgage. Also they have one standard for the appraisal they would provide and another standard for the appraisal that I provided in order to get the mortgage. Your help is requested to have the PMI canceled and a refund made of the premiums from XX/XX/18. Thanks XXXX XXXX

My loan was placed in Forbearance status in XX/XX/XXXX. Then, I applied for a loan modification through my current Lender in XX/XX/XXXX. I did not receive a response to my loan modification request until XX/XX/XXXX. I did however continue to make mortgage payments between XXXX and XXXX while my modification was in process. These payments were applied to a suspense account and not my principal balance. In XXXX, the modification offer I received contained conflicting and unclear information ( i.e. different amounts/totals on different pages, inconsistent dates, missed information in regards to my current loan, etc. ). I made a multitude of calls to my current Lender in XXXX for clarification and corrections to the paperwork but received no resolve. Therefore, I declined the offer in XX/XX/XXXX and requested my account be brought current by applying the funds in the suspense account to my principle balance. This took approximately 4 5 weeks and several more phone calls to correct. I have made every monthly payment on time since XXXX through XX/XX/XXXX. However, my current Lender has been incorrectly reporting my account status to all three credit bureaus as 60-89 days late for XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and as Unknown for XX/XX/XXXX and XX/XX/XXXX. This has adversely impacted my credit scores. One bureau score dropped by 140 points and the other two by 40 points each. I currently do not qualify to refinance my mortgage loan as needed. I also have been unable to obtain additional credit to finance repairs to my home. I have made numerous phones calls to my Lender for correction. I was told I needed to submit a request to their Research Dept., which I did in XXXX. I followed up on this request four to five times since via phone and email and have not received a response or status update as of yet. This issue is still unresolved today.

We was contacted by XXXX XXXX from Nations Mortgage Advisors on XXXX XXXX told me have you heard that the interest rate has dropped to 2.99. I told him I didnt think we could do anything because we refinanced on XXXX XXXX. XXXX had me fax over W2 and Leanders copy of information and he would take a look. XXXX called me on XXXX XXXX sent me over information with a financial worksheet to fill out and mail back with XXXX retainer fee for title search and appraisal cost and so on. XXXX said he called our XXXX XXXX for the equity and said they will accept 10 % of Forgivness. XXXX said we needed to pay Nations Mortgage Advisors fill out the forms and send check of XXXX. My husband submitted paperwork into 401K to pay the money for XXXX. I put the money in the bank on XXXX XXXX. XXXX worked up the forms for us to sign emailed it to me. My husband and I filled out the information and mailed the check on XXXX XXXX certified mail with tracking #. Nations Mortgage Advisors funds Department received it on XXXX XXXX. XXXX XXXX the check cleared I could get hold of someone in the office until XXXX XXXX then no one would answer there phones or call me back. On XXXX XXXX I called the office again and left a message that my husband and I was cancelling XXXX XXXX I faxed cancellation letter in and on XXXX XXXX I sent certified letter of cancellation. We had talked to the XXXX XXXX XXXX that we had they didnt get any calls or received any money for our loan. We feel we have been scammed.

In XXXX of XXXX my son found a house he wanted to purchase so we began the process of getting qualified since I was to be a co-signer I also had to qualify..the process took until XXXX of XXXX and we closed the loan on the XXXX of XXXX at the title company where we gave the money down and signed docs..On the XXXX of XXXX Nations Direct Mortgage came back and said oh the pest control report which included a schedule XXXX needed to be fixed prior to loan being funded..Why after they had the pest control report in their possession for 2 months did they come back 9 days after loan close to state this needed to be done..in addition they informed XXXX XXXX mortgage that if the pest control company could take the schedule XXXX off the report or change it to a XXXX then they could fund the loan..I have this email..The items that needed to be completed would cost the seller XXXX dollars plus which she of course refused to pay and she also had signed docs. So our money sits at the title company and we have to go through the process again which affects our credit since our credit will have to be checked again by a new lender plus the time and trouble we will have to go through getting the required information that a new lender might want. In addition we were never notified by the lender Nations Direct and or XXXX XXXX mortgage that we would be responsible for paying rate lock fees but we were indeed billed for approximately XXXX locks which amounted to over XXXX dollars..this is ridiculous..another issue was that XXXX mortgage shared income tax information with XXXX real estate agents of which I have the emails. I have already made this complaint to FHA and I was directed here..This was a horrible expierence for both my son and myself but especially for him as he is 1st time home owner..I hope the preverbial buck stops here..and that something can be done about this travesty

I was in the process of refinancing. My old mortgage company " Nations Direct Mortgage '' did everything they could to delay the process. I would pay {$150.00} for a payoff report and less than two weeks later it was n't any good so I 'd have to pay for another. We were finally at the end of XX/XX/XXXX. They had taken my XX/XX/XXXX mortgage payment without authorization via automatic withdraw and told me they would n't reimburse my account and I was just going to let it slide. I signed papers and then three days later I received a check from Nations Direct identified as " Escrow Reimbursement. '' So I cashed it. Then all XXXX broke loose. They sent me that money in error. Their error. The escrow reimbursement money was actually withdrawn from the mortgage account and they refused to close until I wired them {$1500.00}. I did that immediately and the process was closed. But from the end ofXX/XX/XXXXtill even today three weeks after the close and transfer of my mortgage I receive collection calls daily. Yesterday XX/XX/XXXX I received my 9th letter of collection notice and a form for Loss Mitigation Alternative Program. I 've called Nations Direct at least a dozen times and explained to debt collections who call me at work, what the situation is but to no avail. Now I find that my credit rating has been affected by a delinquent mark for a mistake they made. When I ask them to retract the mark they tell me no, that I 'll have to write a letter and dispute the mark. Why should I have to fix their mistake? And as of today I still have n't received any of the money that is sitting in an escrow account. because I paid my property taxes for the year ALL of that money should be coming back to me but has n't. I started this process back in XXXX when the pandemic affected my financial life. I was placed into a forbearance from XXXX through XXXX. Once I was back on my feet with income the lender received a loss mitigation package for a modification review. I was told in XX/XX/XXXX that my file had been moved to the underwriting dept for the final review. A weekly update has been made on my file and escalations after the initial 30 day review turned to 45 and then 60 days. Due to the lender not updating my file, I decided to on XX/XX/XXXX just to resubmit. Documents were requested and received by the lender within 48 hours per request. on XX/XX/XXXX the file was deemed complete we were told by representative XXXX XXXX that the file was pending approval and the documents for the trial agreement were in the process of being drawn up. XX/XX/XXXX additional documents were being requested. The weekly updates on XXXX with XXXX # XXXX, XX/XX/XXXX with XXXX # XXXX, XX/XX/XXXX with XXXX XXXX XXXX XXXX requested information on the timeline for the decision ( no call back ), XXXX with XXXX XXXX # XXXX XX/XX/XXXX with XXXX # XXXX, XX/XX/XXXX with XXXX #, XXXX with XXXX # XXXX, XX/XX/XXXX with XXXX # XXXX, XX/XX/XXXX with XXXX XXXX # XXXX called back XXXX XXXX XXXX # XXXX requested supervisor for a call back XXXX XXXX Supervisor ( no call back ), XXXX with XXXX # XX/XX/XXXX who tried to get a team lead to speak with me and was not able to find one requested team member team lead XX/XX/XXXX There has been no response other than one letter dated on XX/XX/XXXX indicating that an investigation still had yet to be completed on the file, yet it appears not one rep, team lead, or supervisor can state what the investigation is? It has been extremely frustrating because there are extreme delays on receiving the information. I have called several times to try and get set-up on the loan solution portal system however it does not recognize my loan number, social security XXXX or zip code. Every time I call Nations Direct Mortgage, they have no idea on how to add my loan to the portal system. I have sent items that were being requested 3 to 4 times before properly being reviewed. In the meantime, our mortgage payments are outstanding since the loss mitigation department can not properly approve the submitted information. We are fully aware of the outstanding balance. I have been calling Nations Direct Mortgage every day sometimes multiple times a day to get our application process correctly. Regarding the face-to-face interview, phone conference etc. we have no problem having a phone conference call with Nations Direct Mortgage. We have been trying to have someone in the management team contact us for months and no one has returned any of our phone calls. Basically, we are extremely frustrated on how the loss mitigation department can not properly submit our information. In the meantime, our mortgage payments are getting behind since the staff at Nations Direct Mortgage can not properly submit our loss mitigation paperwork. My husband and I previously had a mortgage with Nations Direct Mortgage , LLC. On XX/XX/2022, the mortgage was paid in full. At closing, XX/XX/2022, our new address was provided for escrow refund and any other monies owed or correspondence that may need to be sent to us. As of the date of this complaint, XX/XX/2022, we have not received the escrow refund. We have called Nations Direct to follow up on the payment and have been told each time that a check was sent and they could not determine why it was not received. They verified they have the correct mailing address for our new residence, but still did not have an explanation for why we have yet to receive the check. During each call, even just to follow-up on the status, we were told they would have to cancel the check and issue a new one which could take 30-60 business days. It has now been more than 5 months since we closed on the house and the mortgage has been paid in full. We contacted Nations Direct again today, XX/XX/2022, and spoke to three people who all said the same thing - the check was sent, they aren't sure why it wasn't received, they will have to issue a new one, we will have to wait 30-60 business days. We were refused the opportunity to speak to anyone in leadership or someone who can actually provide a resolution and ensure we receive our payment, rather than give us the same scripted, useless response we receive every time we call. There is no proof they ever attempted to send a check nor will they provide documentation or proof that they sent a check. Nations Direct has far surpassed a timely escrow refund disbursement in accordance with federal regulations and they refuse to resolve the issue appropriately or provide money owed to us.

I am writing to address a significant concern regarding the recent disbursement of funds from my escrow account. On XX/XX/2023, a payment of {$4300.00} was made to my local county from my mortgage account. However, there is a critical discrepancy that needs immediate attention. A letter was sent to the company on XX/XX/2023, notifying them that I am exempt from property taxes due to my 100 % XXXX veteran status. This exemption should have been recognized, and no taxes should have been withdrawn from our escrow account. My wife and I have made numerous attempts to rectify this situation by contacting their customer service department daily. Regrettably, we have received conflicting information regarding the resolution process. Initially, we were informed that a refund check would be issued within a week. However, we have since been told that we must maintain a balance of {$5500.00} in our escrow account to receive a refund. It is essential to emphasize that withholding funds from our escrow account is both concerning and unlawful. Illinois state laws clearly outline the exemption status for XXXX veterans, which should have been acknowledged and respected by Nations Direct Mortgage. We request immediate attention to this matter. It is of utmost importance that the incorrect disbursement of funds be corrected promptly, any withheld amounts returned to our escrow account, and a check written to us for the amount. The assumption department never can get rich, the customer services does not provide true information, they never calling back, they lie to me. I am currently in foreclosure with a selling date of about 3 weeks from todays date. I have been requesting assistance and multiple modifications from my lender who has been making it very difficult. From the beginning of the default I have provided all the documents requested multiple times, and have been denied several times. Causing our mortgage late payments and fees to become unobtainable and impossible to catch up. We still have not given up and have tried everything possible and requested assistance right away but have been unsuccessful. This has also caused a strain on the relationship and a divorce is currently pending, causing a deeper hardship. We have tried to refinance our loan but due to the foreclosure prematurely on our credit report and late payments it has caused banks and other services to look the other way. Currently our home is showing as sold in XX/XX/2019 as a Foreclosure this is false advertising and has caused realtors and attorneys to obtain our personal information and allowed soliciting at our homes front door. We have reached out to a home save company who turned out to be predatory lender who took payments from us and we later found out they had not contacted our servicer at all. We have filed bankruptcy chapter XXXX last year in XXXX, the case was dismissed in XXXX due to the escalation of the arrears payments, We could not afford both. Since then the foreclosure has been sped up after the dismissal.

Our address was updated to our mortgage company on XX/XX/2023. They acknowledged this in writing, and it was correct on our online portal. The mortgage company sent the XX/XX/XXXX billing statement to the old address, as well as the subsequent letters about a missed payment to that old address. We have auto pay, however there was an error in payment. We received no notice of the error so didn't realize it had occurred. We wrote to them telling them about the error, and they said that since they tried contacting us via phone ( no voicemails were left to our knowledge ) that they can't do anything. We believe that since they are required by Federal Law to provide written notice of billing statements to us, that they should remove the late payment from our credit, as it was resolved once we got notice of it. They acknowledged they sent it to the wrong address, and we have written documentation showing that they sent to the wrong address. Furthermore, the next month they didn't send the statement until XX/XX/XXXX, which, given a few days to mail it, would have arrived almost after a late payment would have been applied. We believe that these practices are not allowed, and should be rectified, and not ruin our credit. Thanks.

In the middle of the XXXX winter, approx XX/XX/XXXX, our furnace shut down, and we needed it repaired immediately, as we had elderly and a XXXX XXXX XXXX XXXX living in the house, and the heat was not working. I had to call my oil company to service it, and it was an unexpected expense. Due to the high cost of oil, and the service and repair charges, we were unable to pay our mortgage. In the beginning of XX/XX/XXXX, we applied for home owners assistance from the New Hampshire HAF. We were told that we could get assistance if we applied for a loan modification and were denied. We submitted a request for a loan modification on XXXX XXXX... I was asked to submit some missing documents, which I did.. Several days later I called my servicer for an update. They requested more documents. Eventually I faxed, and e-mailed everything they asked for. For the past several weeks I have called for updates, and was told there were no updates. This has been going on for 2 months, with no update. We need the servicer to make a decision ( approve or deny ) the loan modification request so that we can get current and avoid foreclosure. I feel the servicer is taking much longer than they should, and need a decision ASAP. THANK YOU.

I sent a payment via negotiable instr ument ( p romissory note ) which is legal tender according to th e 1912 Hague treaty and the U.C.C. laws of the United States. To Nations Direct Mortgage/ XXXX for full payment of mortgage on my propery. This institution accepted and received payment which is acknowledged in the letter that I have attached from them in this complaint. They were at that time only asking for the intrest that accrued from the time of reciept of instrument to when they recieved payment from Treasur y Dept. That letter was also responded to and another negotiable instrument was issued to cover that amount. Nations Direct Mortgage is in violation of the terms of the note. They did not notify me that they recieved it within the 3 day period alotted by law. Aft er three days, law states that the prommissory note is accepted. And the debt in question should have been released. This institution is still trying to collect on a paid debt. They have no more claim to XXXX XXXX XXXX . Th ey are to cease all collection action and release the lean on the propery. For your reference I have attached copies of the notes sent with all quoted U.C.C. la ws on them.

Our mortgage company incorrectly read a bill from our Home Owner 's Insurance Policy prior to closing. They " thought '' it was paid but never called either us as the borrowers or the insurance company to confirm that there was a zero balance. They never asked for confirmation of the payment. They then wrote our contract to reflect that the insurance was paid prior to closing and did not collect the premium during closing. It was never explained to us that this was happening. We were unaware until after closing when our Insurance company started sending us letters letting us know that this was not paid there was an issue. We called the mortgage company to see why it was n't paid and it was at that time ( almost a month later ) that we were advised of this. They refuse to adjust our escrow so that we can pay the insurance monthly, tried to make us take force insurance which is 4 times higher then our XXXX XXXX policy, and refuse to admit their error or assist us in any way. They were sent multiple bills from the insurance company that they did not follow up on and from the beginning we were advised that they would be taking all insurance and taxes out of escrow.

I was approved for Homeowner Assistance Fund payments in late XXXX. I received an award letter for my entire past due balance of {$27000.00} and 13 months of forward payments ( {$1600.00} ) on XX/XX/2022. I was contacted by my HAF counselor and informed that the past due check was sent on XX/XX/2022 and that forward payments would begin on XX/XX/2022. I have contacted my mortgage company several times and have been unable to find out if they have received any payments. I was initially told in the end of XXXX that they received my approval letter and that my account was in the loss mitigation closing department awaiting the payment from HAF. I called again and was told that no payment had been received yet but someone would call me within 24 hours to let me know the status of my account. I did not receive a return phone call. I waited a couple of weeks and called back and was told the same thing. No payment applied, no return phone call. I never received my escrow refund in XXXX and XXXX ( loan # XXXX ). The property address is XXXX XXXX XXXX XXXX XXXX XXXX Texas XXXX. I have called Nations Direct Mortgage ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX IL XXXX ) monthly for the past 6 months about my refund for escrow and overpayment of {$1000.00} ( XXXX ) and {$620.00} ( XXXX ) and each time they say that they will send it but they never send it. Every time I call they say that I have to wait 30 business days and then they can update their accounts. They have try to say that that do not have record of a refund and they have removed my electronic history for more than 365 days so I can't even see my account for years past XXXX. I have sent proof of documentation from physical copies I printed even though they have restricted my account history and then they change their story ( different story every phone call! ) to say they never received the request for the refund or they forgot to send it. My wife and I were hospitalized with XXXX XXXX during XXXX of 2021 and subsequently my wife had a XXXX XXXX and is still hospitalized. During this time my property was for sale but the transaction was not finalized until XX/XX/2021. We are in the process of buying a replacement property utilizing a XXXX exchange but the lender who is processing our loan advised us that that there are two late payments been reported by Nations Direct Mortgage, XX/XX/2021 and XX/XX/2021. I contacted Nations Direct Mortgage, explained our delicate and challenging time we endured but completely disregarded our request. Now if my XXXX mortgage payment was not received by the first, shouldn't they have assessed a late payment fee but not a late reporting on my credit when they, Nations Direct Mortgage, were paid off on XX/XX/2021. ( Payment was due for XXXX, payment was added to total payoff demand and paid again on XX/XX/2021 ). I assumed everything was ok and was prepared to make payments in XXXX On the first week of XXXX get an alert from XXXX XXXX That your bank informed the credit bureaus That i am late in my mortgage payment and my credit score went from XXXX to XXXX. I attempted to refinance with my existing mortgage company Nations Direct Mortgage and they were not able to meet or beat the rate I was able to get through another lender. I received a refund from Nations Direct XX/XX/XXXX and deposited the refund check on Saturday, XX/XX/XXXX which was the weekend close to the checks expiration. As with most people, I've remained home not traveling outside the home except for necessities due to Covid 19. XXXX XXXX XXXX XXXX XXXX returned my refund check because it expired before the next business day. I contacted Nations Direct and explained the issue and requested a replacement check from my them XX/XX/XXXX and was told a refund check would be processed. Since the initial communication, I've contacted this company 3 or 4 times each time the time required to have a check reissued has changed from 2 weeks, 30 days, 45 days. My mortgage is late on the XXXX day and if mortgage payments had not been paid within the timeframe I've been waiting for a check to be reissued, foreclosure proceedings would have been initiated.

In XXXX of 2020, I applied for a loan modification due to problems with income. Then COVID 19 hit. I thought this lender would continue to work on my file, which they stated they are. It is now 11 months, and I have not received ANYTHING about my loan modification. I am under COVID 19 plan, however, this is due to the fact my home is in foreclosure, and I need to have some type of protection. In the mean time my balance keeps increasing. You can not get through to them on the telephone. It is up to the bank to hire adequate staffing for clients. You will only get a machine, and then it states a recording and hangs up on you. In XXXX of XXXX my mortgage company ( Nations Direct ), put a {$4500.00} force placed flood insurance plan on my mortgage. The fees were to be collected and held in the escrow portion of my mortgage. After procuring and sending Nations Direct all the necessary documents proving my home doesn't need any such coverage, they sent me a letter on XX/XX/XXXX acknowledging that I didn't need the insurance, and I'd be refunded the money. Sadly, this didn't happen, They left the initial {$4500.00} charge in my escrow account as a negative balance, and applied the refunded overage charges to it. What they should've done, AND STILL NEED TO DO, is reverse the initial {$4500.00} charge to XXXX, then give me back the overage charges they've collected, AND ARE STILL COLLECTING! Finally, they need to recalculate my monthly payment to reflect the true cost of my HAZARD INSURANCE ONLY, which would be held in the escrow portion of my mortgage, AND QUIT SCREWING ME ARROUND!!!!!!!

I just got a new home and our broker did our loan with a mortgage company in CA, by the name of Nations Direct Mortgage and it looks like someone in that company got in hold of my wife and my personal information including Social Security, income information and more and are starting to setup fraudulent credit account and utility services ( Wireless account ) in our name. My wife and I work in the financial system and we are extremely careful with our private information, after evaluating the address were the mortgage company is located and the address of the places the individual who stollen our personal information had comited the crimes we had come to the conclusion that the only place were our personal information was expose was at the mortgage company already mention. Hi I had a mortgage for my property with Nations Direct Mortgage , LLC, who sold my mortgage to XXXX XXXX XXXX XXXX ( XXXX ) in mid XXXX. My escrow account had {$6400.00} at the time of transition. And then there was no follow up from anyone, including many managers. When I finally was able to get with someone they stated that I would have to start the modification process all over because their agent submitted the wrong application.
