The garnishment your firm filed with my employer was due to your firm 's lack of standard operating procedures. It is unethical. It is misrepresented. And it is illegal. On XX/XX/XXXX, I explicitly asked XXXX XXXX to set up a payment plan in a recorded phone conversation. On XX/XX/XXXX, I called again and spoke to XXXX asking for this and she hung up on me after 12 minutes. I called again on XX/XX/XXXX and spoke to XXXX XXXX. And again, I explicitly asked for directions on setting up a payment arrangement. XXXX didn't even look at the prior conversation with XXXX. He said he wasn't aware of the conversation until after I asked again. So I waited on the line and faxed the paystubs and other information he asked for to get the payment arrangement process set up. He confirmed that the fax was received and would be processed. He said that they couldn't read my paystubs, so I mailed them. I called on XX/XX/XXXX and spoke to XXXX XXXX and held the line for 9 more minutes. He said they hadn't received the paystubs yet. But the conversations reflecting the attempted payment arrangement with XXXX and XXXX was noted reflecting that I no longer wanted a hearing. The next day, I confirmed that the paystubs were received by your firm on XX/XX/XXXX. I confirmed with XXXX that I wanted to set up a payment plan. I called again on XX/XX/XXXX and spoke to XXXX who told me that my paystubs weren't paystubs ( I have no idea what that even means ). After 13 minutes on the phone, she hung up on me. I called again. I spoke to XXXX XXXX. She verified that she received my fax about clarification on my paystubs. I kept her on the line. And I refaxed the documents again to XXXX. I had her confirm that she received them. Amazingly, she was able to read the faxed paystubs, even though I was told that they were illegible before. She gave me her WORD that if they needed any additional documentation THEY WOULD FOLLOW UP WITH ME. This time, I was on the phone for 1 hour and 32 minutes. On XX/XX/XXXX I received a letter from the DOE following up on the hearing that I cancelled with XXXX on XX/XX/XXXX. I still hadn't heard ANYTHING from your firm, even though XXXX gave me her word. Then, on XX/XX/XXXX, I received an email from my employer stating that my wages are being garnished. NO ONE EVER INFORMED ME THAT THE PAPERWORK WASN'T ACCEPTED. No one every followed up. I have been willing to get into a payment arrangement since XX/XX/XXXX. All the calls are documented and recorded. There are 7 calls since that date explicitly asking for this. I have spent over 10 hours on the phone trying to resolve this so that a garnishment was NEVER on my record. As a result, I filed a formal complaint with the Department of Education. Just as a follow up, I called again on XX/XX/XXXX and spoke to XXXX. He asked me when I was making a payment. I told him that I'm waiting for the paperwork that I was told was " necessary '' to start the process. I told him my frustrations with the system. And I told him that I was told it would be reviewed by XXXX or XXXX ( the director and assistant director respectively ). He said he'd put me through to his manager. I said don't waste my time. I want those two specific people. He put XXXX on the line. I told XXXX that I asked explicitly to talk to the director and A Director. She put me through to the A Director. After she introduced herself, she said she was going to look at my file ( which was already the agreement from the XXXX ). I waited and the phone disconnected. Another 13 minutes of my life wasted. I filed a complaint with FSAid. Should hear back within 15 days. Filing another complaint with the CFPB. I called again on XX/XX/XXXX to ask where my loan rehabilitation paperwork was. XXXX XXXX said that it was sent on XX/XX/XXXX. I also called on XX/XX/XXXX and spoke to XXXX again. He said that months of on time payments, I have to request everything to be removed from credit report, collection costs are charged every month and request that the garnishment stops after 5 months XXXX is contact number. $ XXXX/month in addition to garnishment. I also have documented conversations with XXXX XXXX last week, because XXXX XXXX told me during our conversation that a supervisor would review the recorded conversations to resolve this garnishment. This garnishment affects my job. This affects my personal and public record. I made every effort within my power to prevent this from happening. It has not only caused me tremendous anxiety and stress, it impacts my job and my family. I have been willing to rehabilitate this loan. And you have those conversations documented. I was never even given a written warning about the garnishment in advance. I assumed that your firm was upholding it's portion of this agreement that we made verbally. A fair resolution to this problem is to have the garnishment permanently removed from my record, including my credit and that information should be forwarded to my employer. It should also be permanently removed from my U4 through FINRA. This error is a processing error by YOUR FIRM. It was NOT because of me or my lack of trying to work with you. It is unethical and you have used deceptive practices to start this collection process with my employer, which is illegal under the Fair Debt Collection Practices Act. Furthermore, this I still have never seen the actual accounting for this loan. You don't own it. The Department of Education does. These loans date back to XXXX and no original documents and/or accounting has been provided to verify the charges for them. From XXXX to XXXX, I was never even able to logon to see the accounts, due to a name change and a glitch in the FSAID system. No statements were ever sent after XXXX. So I had no written confirmation of interest or fees. And in recorded conversations with XXXX/XXXX, they didn't even have corroborating interest amounts on my account. If you do not remove it from my account, I will be forced to take legal action, in addition to the formal complaints with the Department of Education and the CFPB. And now, I am submitting ( what I was told last week ) were the ONLY supporting documents that I need : 2 tax returns, daycare statement/billing and a paystub to show medical bills ( even though they're apparently illegible to some, they will work for healthcare, according to XXXX XXXX ). And I have also been told for the last month, by every agent, that the notes and conversations will be reviewed to make this determination. I would appreciate a response, as all promised except XXXX XXXX, who said that she honestly couldn't make that promise.

XX/XX/XXXX I was told to go to HR at the company I work for. When I got there I was told that this company called National Recoveries Inc had mailed some forms to them about garnishing my pay. They wanted to take 15 % of my income. This is a lot and it is going to cause a financial hardship on me and my wife. Plus 15 years ago XXXX XXXX after months of communicating back and forth with them about my loan. See I went to college because I wanted to work on a XXXX XXXX, so I had to major in XXXX and XXXX. I went to sign up for classes and met a financial aid person and she helped me sign up for a loan. I told her that I had a XXXX XXXX and she told me that was ok because in 2 years I would be working on a XXXX XXXX. I signed up for my classes. I failed 3 of my classes and got a XXXX on another one. So I had to take those classes all over again. I talked to financial aid and asked what I should do and she told me not to worry about it everything was going to be alright and she suggested that I just take other courses and then go back and repeat the failed courses last. I wanted to get math out of the way so I took it again and failed again. So once again I went to see the financial aid lady and she said for me not to worry about it. I got 2 XXXX and 2 XXXX. Coming back from spring break I went to see the financial aid lady and asked her what I should do she said for me not to worry about it she would go and talk to my math teacher to see what we could do. She told me just to think about working on a XXXX XXXX. I went to math class that day and after class the math teacher asked if he could see me after class. After class I went to see him and he introduced me to someone who was going to tutor me. I met with my tutor and I told her I am really trying but that I can't remember anything and that I didn't understand anything. She worked real hard. The big test came and the math teacher said I would need a XXXX on the test to pass the course. I got a XXXX. My tutor asked me how I was doing in my other classes and I should her my grades and she asked me why I was still in school. I told her that the financial aid lady told me that I would be working on a XXXX XXXX like I wanted to. I told my tutor that I went and talked to the financial aid lady about dropping out and she just kept telling me that I would be working on a XXXX XXXX when I leave college. My tutor asked me what I wanted to really do and I said I am just getting all XXXX and XXXX and I should probably drop out. I decided I was going to go and talk to the financial aid lady again but this time I asked my tutor if she would go with me. We went to the financial lady 's office and I told her that I wanted to drop out of school and she asked me why I told her I was getting all XXXX and XXXX and she told me that I had a dream of working on a XXXX XXXX and we will make sure it happens. While we were talking my tutor was reading my loan papers. The financial aid lady got me to sign the loan papers so I held my breath and signed them. I started to date my tutor and we ended up getting married and I did drop out of school. I went to work and my new wife continued her college and she graduated. She went to work in a XXXX XXXX Her older brother invited us to go and live in XXXX and he could get me a job where he works. So we moved to XXXX, to make a long story short me and my wife ended up homeless. I called XXXX XXXX and got a forbearance. My wife started getting really sick and all the drs in XXXX said it was in her head. We ended up going back to XXXX. Time went on and I got another forbearance and then another forbearance and now my wife is being rushed into XXXX. She was in the operating room for 9 and a half hours. She almost died. My wife was really sick it wasn't all in her head. She was XXXX XXXX for almost a year after that XXXX. During the time my wife was recuperating she reread my loan papers and on the back of the loan papers it said if a student doesn't keep up a XXXX GPA they would not qualify for any loans. My GPA was always way below a XXXX. My wife told me I should of never gotten those loans and that XXXX XXXX was irresponsible in giving you those loans. My wife knew other financial aid people and come to find out the lady that was getting me to stay in college was making commission on the loans. I started calling XXXX XXXX and a months of talking to them and they talked to others. XXXX XXXX said I fell threw the cracks and I shouldn't of been getting loans and because everyone failed me a young impressionable man they were going to write off my loan. I never thought anymore about it, until I showed up for work and HR showed me the forms. I never even heard from anyone. I tried to call the college to get any paper work I could and XXXX College closed.

Attached you will find all documents to prove that this company not only lies and bullies us on the phone and failed to notify XXXX prior to garnishing his XXXX payments and their numbers do not match regarding the final amounts deducted by the US Department of Treasury regarding total income for XXXX. Final deductions given to XXXX from the Social Security Administrations XXXX which shows every dollar that have retained and submitted to the US Department of Treasury on behalf of the US Department. As well as the interest collect does not match the interest from the Department of Treasury. I have not blacked out his social security number on the supporting documents as they are Tax Documents. Please print and black them out before processing or adding to file. Thank you! The student loan was discharged in Chapter XXXX ; XX/XX/XXXX due to being totally and permanently XXXX due to an XXXX XXXX XXXX and has been on XXXX since XXXX. XXXX filed taxes in XXXX because of an inheritance which triggered this debt to be brought to the surface and they have been taking his XXXX via XXXX after having the debt to have been discharged 11 years ago. XXXX has never received any written notification about this debt, nor had he been notified from the US Department of Treasury, US Department of Education, nor the Social Security Administration, in fact when I was assisting him in XXXX get his Medicare part B & D allocated, he had thought that the {$230.00} being held from his XXXX was allocated to Medicare and he was upset because everyone else only paid {$130.00} so I started looking into the situation and after calling the Department of Treasury, the Department of Education, and the Department of Social Security. All documents attached are my notes, letters from the Department of Education, which you need to pay special attention to, and my notes from phone call after phone call after phone call. Now I am turning all of this over to you as they are taking advantage our service men. He has received one notice from XXXX XXXX XXXX about the debt and all documentation is attached please review and contact me or XXXX XXXX XXXX, XXXX United States XXXX XXXX, XXXX XXXX, my name is XXXX XXXX XXXX and my information is printed below. I am assisting him in this matter because I am highly educated and they are taking advantage of him badly. I would like to point out also that the private note, attached, is 8 % max and they have been charging 16 %, but none of that matters because it was a private note that had been discharged since XXXX and they have been collecting without notice since XXXX. I would also like to point that none of the monies collected match. For example ; interest collected for the year from the US Department of Treasury does not match the amount collect from the US Department of Education. I have not attached the XXXX from the Social Security Administration but I can sent the XXXX for XXXX if you need it. National Recoveries Inc. have been attaching his XXXX since XXXX see attached letter. I have called everyone and the US DOE has me call National Recoveries Inc., and National Recoveries Inc. has me call XXXX XXXX which is a company for National Recoveries Inc. Two days ago I spoke with XXXX who I thought was the US Department of Education because that is who I had been on hold for 1 hour 15 minutes, and she told me that I shouldn't have received the Letter from the US Department of Education which states clearly that this loan had been discharged before, then placed me on hold for 10 minutes and she came back on the line being very rude and angry screaming that he owes the money and when I told here that he would like to place the garnishment on hold until we resolved this situation like the letter from the US DOE like it said he could and she said she would transfer me but instead she hung up on me. Finally I would like to point out that XXXX has received his first notice from the US Department of Treasury XX/XX/XXXX after they had been garnishing his XXXX since XXXX

Greetings, I have a federal student loan from XXXX, which I attempted to dispute at around XXXX XXXX. I called them and was referred to a debt collection company called National Recoveries. When I contacted them, I had explained to the agent that answered that I wanted to dispute the loan because the school had not provided promised service, that I believed the school had breached the load agreement. The rep agent went on to tell me that if I wanted to dispute the balance I had to give them all my financial information and pay something toward the loan. I felt this was strange because I had only asked to file a dispute yet was being told that i could'nt. I was assured by the agent that I had to first make payments in good faith and that this was standard procedure. I was told by several agents in subsequent phone calls to National Recoveries that after about 8 months of payments they would take my dispute and review the loan and that maybe the loan would be discharged or placed into foreberance if my dispute checked out. They even said at that point i could even attend another college if I chose with a new round of loans. I felt coerced, but still cooperated by stating my financial and personal data as they requested. They had concluded that I should pay at least {$5.00} a month on autopay on my debit card. I plasced on card {$10.00} a month because my debit card charged for loading card and autopay {$2.00} each. at this time I was recieving $ XXXX unemployment and paying child support. Several months went by and National Recoveries was taking my funds from debit card. After about 3 months I had inquired about being able to began the process of disputing the balance. I was told that I still had not completed the initial payments and that I was supposed to sign a document that they must mail to me. this was the first time hearing this, I was upset about this because time had been wasted. they said they would send out a form ASAP. a week went by and nothing from the debt collector. Months went by and no forms were sent. My unemployment ran out and I had no source of income to pay. I tried calling the debt collector several times and was sent to voice mail recording saying someone would call me back in three days. which of course no one did. I had not heard anything from the National Recoveries since the end of XXXX On XXXX XXXX, XXXX I recieved a letter from XXXX. Payment center stating that they would take my taxes from this year forward unless I disputed the loan within 55 days from the day on the letter. I called them and I was instantly transferred to the National Recovies. I was both shocked and angered, because this company had previously stated in XXXX, that I had to make payments before being able to dispute the loan, but the letter i received from Dept. of Ed. said otherwise. the letter stated I needed to get a copy of the promissory note and my files from National Recoveries in order to file the dispute form. When I called National Recoveries, three weeks ago after receiving the letter from the Dept. of ED.. The debt collection agent that answered stated she had never heard of such a thing, being able to dispute the loan balance as I had discribed. I read the details of the letter I recieved to her. She then relented and said she would make a request for the documents to be sent and and that I should receive them in approximately five days. Two weeks later no mail from National Recoveries. the same pattern as in XXXX, I sent emails to their business head quarters stating unless they sent me the documents i needed to file a dispute I would file a complaint with the FTC. Still no response, I tried calling them back on XXXX XXXX to find out what happened, all calls were sent to voice mail after about 15 mins on hold on I need assistance.

It seems that National Recoveries , Inc. Is trying to make it as hard as possible for consumers to set up payment arrangements to avoid garnishment. I contacted National Recoveries, Inc. on Friday, XX/XX/XXXX to follow up on a notice of Garnishment that I received. I was given the option to set up a repayment plan, based on my income and expenses. I was informed on XX/XX/XXXX that I had until the XX/XX/XXXX to submit a Financial disclosure with proof of expenses and check stubs so that a payment amount could be calculated for me. I submitted everything on XX/XX/XXXX. On XX/XX/XXXX I still had n't received any information regarding my payment arrangement, so I called the company to follow up. On XX/XX/XXXX, I was informed that my paystubs were n't legible, which is ridiculous considering that I sent downloaded .pdf formatted stubs, which were sent along with all of the rest of my information. When I asked why I was n't informed of this prior to the deadline, I was told that the company called, but they " do n't leave voicemails ''. I find this utterly ridiculous, considering that most people do n't answer random calls from XXXX numbers, and may be at work or school during business hours. I 've also received voicemails from several debt collection agencies in the past. This alone should be considered unethical. I had 3 days to submit the paperwork to avoid garnishment, which I believe warrants a voicemail. On XX/XX/XXXX, I was told that the garnishment letter was scheduled to be sent to my employer today, XX/XX/XXXX. But, if I could fax my paystubs again, I could call in about 30 minutes to give them time to review them and set up a payment plan for me to avoid garnishment. I submitted 2 paystubs again on XX/XX/XXXX. I gave the company about 4 HOURS to receive and review the paystubs. I called again, and was informed that the payment plan still was n't processed. I was LIVID. The person that I spoke with advised me that if the payment arrangement was set up before the garnishment letter was sent, that I would be able to avoid the garnishment by making a payment. I was told to call back in the morning of the XX/XX/XXXX, and that they should have received and processed everything, hopefully before the garnishment letter was sent out. I waited until today, XX/XX/XXXX, and called again first thing in the morning. Today, I was informed that they supposedly only received one paystub, and AGAIN, I was n't contacted, and received no voicemail regarding this. I sent in BOTH PAYSTUBS FOR THE THIRD TIME. I sent the stubs at around XXXX, and at XXXX, 5 hours later, they still have n't processed the paystubs and made an arrangement for me. It is unfair and simply poor business practice to refuse to contact or leave voicemails for consumers that are doing everything that we need to do in order to resolve the debt. I 've been given the runaround for 6 days, when one simple voicemail on XX/XX/XXXX would have allowed me time to resubmit my paystubs with plenty of time to avoid garnishment. Now, if I 'm garnished, not only will I be destroyed financially, but I will be forced to sue National Recoveries , Inc. for money unfairly garnished, any other debt that is incurred due to lack of monies garnished, any bank fees associated with overdrafts due to money not being available to cover my bills, and attorney/court fees.

on XX/XX/XXXX I contacted the 3rd party that handle my student loan for us dept of edu. National recovery and was advised I can do the rehabilitation program and make XXXX monthly payments for 9 months to get out of default. I adv them I could pay XXXX a month and set my first payment for XX/XX/XXXX there was an issue with payment going through that day and they called me adv that the payment did not go through and that anytime a payment does not go through I will get a call to have the payment resubmitted. there was a form I needed to return for the program and had an issue returning it due to schedule so they offered me to have the package picked up from my hom I left package on my door step for 3 days and it was never picked up. I then was able to drop it off myself and told them the package was on its way. I then was due for a payment in XXXX that went through. then in XXXX on XX/XX/XXXX the payment did not go through I did not get a call to have payment resubmitted like usual so I called them no answer left a mess. I did not get a call back and according to a rep at national recovery they called and there was no answer but there was no call to me then they said the call could not be completed. I then spoke with them on XX/XX/XXXX to let them know my taxes where offset and to see how this will impact my credit I was told the only was to have this completely removed from my credit was to do the rehabilitation program s opted back in the program after I was kicked out due to non payment I was to make a payment of XXXX on XX/XX/XXXX due to my bal left was so low that my option to pay XXXX would not allow me to complete the program in 9 months as required so I was told to just make the regular XXXX payment so XX/XX/XXXX came and no payment taken out I watched my account and funds where in there and not taken out. days go by I hear nothing from this collection agency to collect. so they called me in XXXX and told me the payment of XXXX did not go through when it was to be for XXXX. I adv them that im confused at this point and don't know what they want me to do after 2 yrs of my taxes being offset I owe them XXXX and if I pay them off I will have this on my credit for 7yrs as an collection acct pif. I am in process of working on my credit and don't need this to follow me for 7 yrs so I have been trying to work with them and cant seem to get around this program because I keep getting put out the program and having to start over. I have been told conflicting information by different reps and was told different amts I owe them and us dept of education I need help resolving this matter cause I don't trust them anymore. I feel they knew they were going to take my taxes so that's why they didn't bother calling me in XXXX for my payment I was told they don't leave messages if they call me back and I told them I have gotten messages from them when something was wrong for me to call them back they were not detail messages but they left messages now they don't leave messages when they try to call all call are recorded I would like the calls listened to and my acct audited. I received bills from them with different due dates for my payments as well that I can show at a later date and I can get a call record of the calls to my cell phone.

I have three federal student loans currently in default status. I was contacted by National Recoveries collections agency in XX/XX/XXXX stating that their office had received my loans and would like to offer their rehabilitation program to get my loans back in good standing. The program involved me making 10 consecutive monthly payments, after which my loans would be turned over to a new lender. From there i would be in good standing and begin making payments to that lender. I was told that in order to get started I would need to provide my income information to determine the amount my payments would be. I did so, and was given the amount of {$98.00}. This amount would be auto drafted from my checking account on the XX/XX/XXXX of each month. I provided all of this information over the phone, never receiving or provided anything in writing. I was informed that this program would be validated with an official agreement, in which i would receive by delivery service, then sign and returned to their office. I never received any such agreement from the collections agency. However, in XX/XX/XXXX the first payment of {$98.00} was drafted from my account. I did not contact the agency at that time because I thought that at some point I would received the agreement, and I was enrolled in the rehabilitation being that money was taken out of my account. The payments of {$98.00} was then also drafted from my account in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. On XX/XX/XXXX I received a call from a rep with the agency stating that I needed to provide some additional financial information to determine my monthly payments for the rehabilitation program and to sign an agreement. I asked for a further explanation for this request. I was told by the rep that i was not currently enrolled in the rehabilitation program because I only provided one check stub for income verification and I had not signed an agreement. I first asked the rep why it took this long for someone to contact me if there was additional information needed. I then also asked why has money been drafted from my account for 5 months if I am not currently enrolled in the program. He replied by saying the 5 payments of {$98.00} that have been made were going towards my principal balance, and my 10 month program would start once I provide two of my most recent check stubs and sign the agreement letter. I informed the rep that this is some completely different information than what I had received initially. I was only told that my payments of {$98.00} would be for the rehab program. I had no knowledge of my payments going to a principal balance and that I was not actually enrolled in the program. The agency clearly made no efforts to send me the agreement letter, nor make me aware that I was not previously enrolled in the rehab program. However, they were consistently drafting money from my account. It is only now that I am being informed that my payments are going towards something other than what I was told in the beginning. This is a dishonest attempt to collect a debt.

Started to call : XXXX Started with an attorney XXXX/XXXX/XXXX Presented an possible option XXXX/XXXX/XXXX Submit required info : XXXX/XXXX/XXXX Sent Paystubs and ID for 3x XXXX/XXXX/XXXX Did not receive any communication by mail or phone until after my lawyer got involved. I also tried to email 2 different emails given to me by National recoveries ( after my lawyer was involved and they bounced back. ) This complaint is with XXXX XXXX XXXX, who has taken over my student loan. My loan was {$49000.00} after consolidation and this company added 13,000 to my balance. I tried to call the company 6 times and was transferred multiple times and then put on hold for 30 minutes to an 2 hours each call. No one would answer the call. I could never even get a voicemail. After multiple phone calls and hours on hold but could never get a person to handle my call. Shortly after they served a garnishment to my company. Now I was forced to hire an attorney to just simply try to set up payments. Per the federal government I am intitled to a rehabilitation program, but they will not allow me to initiate one even with an attorney involved. They will not even send me or my counsel a breakdown of the loans and the additional XXXX in fees added to my loan. Do they even own my loan?!!! They said they over nighted a packet twice now and I never received it. Then they stated my loans were in my maiden name and I had to proof my current last name. I provided ID and multiple other forms along 4 paycheck stubs. 3 times, directly off of my computer and the ID was enlarged. They stated they were not ledgable, so we sent them again making sure they were crystal clear and were told they were out for review. WHY would they need me to prove my identity when they have enough info to show who I am, as they are garnishing my wages through my employer. Now they will not even answer my attorneys calls and if I call from a different number and speak to a manager, when I disclose who i am, they say I am not allowed any information because I have an attorney. I am now being garnished on the 5th paycheck ( 4x higher than any payment ) and can not get resolution. I calleded the Student.ed.gov and prior student loan servicer and was told they can not do anything, This is taking a hit on me financially and killing my credit. I am now also not eledgible to help my daughter obtain student loans, so i am forced to pay out of pocket for her college. I am not trying to run from my loans, I am just trying to get into the rehab program. I am legally intitled to a rehab program after 9 payments BUT the XXXX that has already been garnished far surpasses the 9 payment option, that i should have been given 4 months ago. I need help in stopping the garnishment and getting put onto the rehab, which is my legal right ASAP. I am now also forced to keep paying an attorney to try to at least have a little help in the matter and that is not even helping.

In XX/XX/XXXX I entered into a contract with National Recoveries , Inc to rehabilitate my direct loans that were in default. I sent them all of the documents they requested, we made a payment agreement, and they started billing my debit card for a monthly payment of {$190.00}. I was told that after making 10 on time payments I would come out of default and be placed with a lender. During the course of the 10 months National Recoveries called me multiple times insisting they never received any documents from me, that my signature was cut off, that I needed to sign all pages on the side and re-fax, etc. I kept faxing documents in spite of the fact that they must have received them because we had established a payment based on my income. At the end of the repayment period, National Recoveries requested that I electronically sign agreement for them to request my tax information directly from the IRS, which I did. My payment was originally based on my XXXX tax return. National Recoveries requested my XXXX tax return despite my contract and payments beginning in XX/XX/XXXX. I worked a lot of overtime in XXXX as I had two sets of loans in rehabilitation and I was paying for my oldest son to go to college. Because my income was higher than the previous year, National Recoveries told me I would have to pay over {$3000.00} or be kicked out of the rehabilitation program. I was unable to pay the additional money. I contacted the department of education and they told me I was never even placed in rehabilitation by National Recoveries Inc. Eventually, after multiple phone calls, the department of ed agreed to start taking my payments through their default resolutions dept. Unfortunately, no matter how much I send, it does n't touch the principal, only interest and fees. Despite meeting my obligation and making 10 on time payments for the agreed upon amount, I have never been placed with a lender and continue to be in default despite those 10 payments and additional payments I have sent directly to the dept of ed including my XXXX federal tax refund. XXXX XXXX closed down for false practices, misleading their students, and making false promises with helping find a job in the industry after you graduate. XXXX XXXX was a for profit college. Six months after graduating, XXXX XXXX began calling me and asking for {$800.00} and to begin repaying my student loans. There was no way I could afford that and make my rent payments. I began to struggle with these payments and began looking for alternative options. I ended up consolidating my student loans, so that I can afford to make my monthly payments. After that, I began to get calls from XXXX XXXX and the agents would refuse to lower my monthly payment and advised me to get a " Better '' job, so that I can meet these payments. I believe this conversation along with all conversations are recorded. XXXX XXXX called my parents, due to them being Co-signers of my student loans and harassed them. They would continuously call my parents at all hours of the day to harass them for payments. One agent even told my parents, if they did n't make a payment, they could take away their house. Obviously, my parents got scared and my mother called me crying that day. When it became XXXX, I then setup an auto pay with them. They had agreed to a semi reasonable monthly payment - around $ XXXX ( do n't really recall ). Then one month they took more money from my account ( around {$800.00} ) leaving me to scatter around to make my rent payment. Since then, I could no longer trust them and cancelled my auto-payment. My student loans have crippled my credit and I was even denied when applying for an Apartment. I do n't qualify to purchase a house because of my crippled credit, therefore living in an apartment is my only option. However, it makes it difficult to even do that due to my student loans ruining my credit. I have proven documentation of being denied because of my student loans, they show as a " Debt '' not as a student loan. At this time, they are garnishing my wages and I am currently in a rehabilitation program in which consists of giving them an extra {$270.00}. My students loans were with XXXX XXXX, which later became XXXX. I 'm am not sure of the exact details, however XXXX sold my student loans to National Recoveries Inc. Overall I am giving them around {$500.00} per month, in which I can not afford, however I am making it work and cutting my budget to make ends meet. National Recoveries , INC. is the collection agency assigned to my defaulted Fed Student Loan accounts. My XX/XX/XXXX tax refund was offset to the amount of {$2000.00}. When I contacted National Recoveries, INC. on XX/XX/XXXX, they advised me to contact the " XXXX XXXX XXXX '' with the US Department of Education so that I could request a return of my tax refund. On that same day, XX/XX/XXXX, I requested a " hardship packet '' be sent to me because I am facing an eviction, have been served a " notice to vacate '' and according to their requirements stated to me over the phone, would unofficially pre-qualify to get my tax refund returned to me. It is now XX/XX/XXXX and I have yet to receive the hardship packet. I was told that if I did not receive the hardship packet by today, the issue would be escalated but I have no proof or have received no correspondence that that has happened. I have eaten a minimal amount of food and have fallen further into financial trouble. The " XXXX XXXX XXXX '' is really a contracted company called XXXX, and each employee I spoke with over they phone misrepresented themselves as Department of Education employees. Those XXXX employees are XXXX ( Employee ID : XXXX XXXX ), XXXX ( Employee ID : XXXX XXXX ), XXXX ( XXXX XXXX ), XXXX ( XXXX XXXX ) and XXXX ( XXXX XXXX ). All of these employees also stated my current balance at greater than {$23000.00}, which is incorrect. Also, the website ( myeddebt.ed.gov ), the " XXXX XXXX XXXX XXXX '' website, was offline until today. XX/XX/XXXX. The XXXX XXXX XXXX also misinformed me about a contact email address. They stated that there was none however, an Official US Department of Education employee names XXXX XXXX, who is a business analyst with the call oversight team, provided me with an email address for them. It is XXXX. I have made numerous requests, numerous phone calls and have wasted hours of my life trying to compromise with National Recoveries , Inc. and the department they referred me to on XX/XX/XXXX, the " XXXX XXXX XXXX '' or XXXX located at XXXX XXXX XXXX, XXXX, TX. They have intentionally drawn out this process and also, have not had a complaint official or any US Department of Education employee on their site. This story goes pretty far back so I am going to try to be brief about it. In XX/XX/XXXX I took out a student loan, it went into default in XX/XX/XXXX. I got out of default on a rehabilitation program but due to lack of income and stable work I could not make my payments so it went back into default and into collections. At this time the company XXXX XXXX told me on the phone that my tax returns were flagged to be garnished to pay off the debt. I agreed and continued to file yearly and for 5 years I did not receive a return. I thought the loan was being paid off, as naive as it may sound, i thought this was all true. 5 years ago I started receiving my returns again and when I checked my credit score, low amd behold, my student loans read at {$0.00} balance and closed. I felt relief. XX/XX/XXXX of this year my employer brings me a wage garnishment letter [ attached ] and that I owe almost {$10000.00} on my student loan. When I called the company to ask what this was about, they informed me they bought my loan in XX/XX/XXXX and because I did not contact them, they have rights to garnsh my wages. I chose to dispute this as they gave me the option to. I even called IRS about all the returns I didnt receive. They said they were never told to garnish my returns and they have been sent to me every year. I couldnt believe it. The letter they sent back to my dispute [ also attached ] was plain ridiculous. They said it is the credit bureaus resposibilty to report there loans, not theres. This has not been reported to anyone and they claim I have to pay almost double my loan in penalties and oh yea, there commission of just under {$2000.00} [ in there letter ]. This can not be legal. All 3 credit bureuas told me that it is the loan holders responsibilty to report the collection account within 90 days, its been 4 years ....!!!!! Please help me resolve this, they refuse to budge on there standings and they are wrong on so many levels in this for letting a collection account gain interest and fines and penalties for 4 years and then try to take the last bit of my paycheck that puts food in my mouth. I am being collected from XXXX different companies for the same exact debt. I have tried several attempts via mail and over the phone to resolve this and the debt collection company National Recoveries are lacking in a lot of areas. They refuse to listen to anything I have to say and keep trying to tell me its a different debt but can not prove it. I asked for proof of the debt and they sent me bogus papers that have NOTHING to do with the debt they are collecting on. I have printed up all of my documents to prove that the amount they are asking me for is currently through XXXX and I am in good standing with XXXX. I had a subsidized and un-subsidized loan somehow end up in a consolidation loan with XXXX/ XXXX , this was not in anyway known from me, since the information they provided to me is not mine other than my social number and the name. None of the addresses or phone numbers matched, besides the point, I worked out a plan with Navient years ago and now National Recoveries is claiming I owe them either the subsidized or un-subsidized portion which they still wont tell me which one. They lack in proving what exactly the total amount is that I owe them for, not how much, but for. I want them to disregard the debt and look at the documentation I have from XXXX, showing XXXX is in fact collecting on both of these debts. I am a XXXX and have 2 more years to go, if they even tried to get one cent from me, they 'd be wasting their time. Its a crime to attempt to collect the same debt and they need to be prosecuted for their actions. They are also alleging that an amount of {$2600.00} was taken then refunded back to me from US Dept of Treasury, this is FALSE, I have proof, documents that my identity was stolen 3 times in past 5 years, the amount mentioned above, is from the person who stole my identity, that was refunded back to that person, not me. I have submitted previous complaints and the Lender continues to lie about their settlement of my resolution. My former compain # 's are # XXXX and # XXXX. I have been on XXXX XXXX and XXXX XXXX XXXX and due to my doctor having me out of work so long, I was terminated. Please refer to my previous two ( 2 ) claims submitted as both the Department of Education and National Recoveries have different totals and have NOt triEd to work with me. Mind you, there is almost a {$25000.00} disparity in the totals. I told them I was on XXXX and had little pay however, I could pay the agreed upon {$150.00}. I have a transaction # XXXX which was paid on XX/XX/XXXX at XXXX XXXX EST. When I went to make the next month 's payment, I was told that the employee that made the plan was moved to another department and my payment agreement was not acceptable. I was encouraged to get on the XXXX payment plan instead. I expressed my dissatisfaction and lack of professionalism of NRS and the DOE. I have not received ANY paperwork from them in over a year. I just recently got a letter from the Department of Education with much lower total amounts and was informed to call them immediately. I must tell you both entities are VERY unprofessional. They have put this on my credit report and threatened WAGE GARNISHMENT and Taking my TAX RETURNS. These entities should NOT be able to treat people like this as they are not telling your rganization the truth in their resolution responses as you can see from reading the aforementioned. HELP! In XX/XX/XXXX, I received a letter from National Recoveries stating that my loan was in default & had been turned over to them. I contacted them to set up a payment arrangement for my loan. On XX/XX/XXXX I contacted National Recoveries to see exactly what was going on, & I was informed by XXXX that they did not tell the U.S. Department of Education that I had entered into the loan rehabilitation program & was making voluntary payments & to take my loan out of default status & off tax offset. I asked if I could request a hearing & they said they didn't handle that. They also said they mailed me a letter informing me that they didn't have all the required information to enroll me into the loan rehabilitation program. I responded by telling them but yet and still y'all was taking my money since XX/XX/XXXX. The letter they mailed was dated XX/XX/XXXX to my old address. I had no idea my loan was still on tax offset until I went to IRS.gov. The letter I received from the U.S. Department of Treasury was dated XX/XX/XXXX, after I should've received my refund.

To Whom It May Concern, In XXXX of this year, I received a letter from National Recoveries. A company I have never heard of until I recently researched to find they are a fraudulent collection agency. I responded to this letter stating I owed nothing on a false debt they were trying to collect. When you call the number it rings then disconnects. When the dept of education investigated my complaint and found the fraud, deception and predatory lending that occurred to me back in 2009, both of my cases were closed stating I owed NO DEBT. Both the schools not only kept money owed to me, they along with the dept of housing literally put me on the street for 7 yrs. Both schools knew all along I never qualified for any loans for I never had the education to start the schools to begin with let alone how they continued to lie to me causing me lose my home causing me to be unable to even do school work or have the right equipment to do the school work. A few weeks ago I received a letter and a copy of a loan document ( one of which I already had ) that I did not ask for stating I owed the debt. Which tells me they did not do their job to see I did not owe the debt they were trying to collect. Yet their harassment has continued and enough is enough. I am tired of being taken advantage of by the US Govt. The US Govt allowed my acreage to be taken illegally then allowed TWO schools to take advantage and defraud the Govt and myself for trying to better my self after everything that was taken from me. I contacted National Recoveries when I first started new employment and entered into a loan repay program. All of the paperwork was submitted by email and fax. My name and address was to be corrected. The company did collect from my bank account the agreed upon amount for 8 of the 9 months. The repay program was for 9 months. The bank account had my correct address and name. The debt collector should have had this information corrected. I never received a notice that I needed to sign a new repay agreement. I was told after the repay program I could enter into a deferment. However, upon realizing the last payments at 9 months was not taken out of my bank account, I contacted National Recoveries. At this time I was told that they sent me a packet ( to the incorrect address and incorrect name ) and that I would need to reinter into a new agreement and pay another 9 months. I decided to let my lawyer handle this, as I quickly realized this company is a scam, and makes money off of keeping clients in debt rather than helping to get them out of default. The longer they keep you in their company and as a non payer, the more money they receive from the US Dept. of Edu. Fast forward to 2016 and my entire tax return is withheld due to this debt, that they continue to hold me under rather than letting me complete my repay agreement so I can enter into a default. As a single mother of XXXX children, working a state job, and receiving state benefits just to make it paycheck to paycheck this is a disgusting tactic employed by this company. I do not understand why the EDU continues to use them as a contractor.

I consolidated my student loans. Somehow one loan was left out. I recieved collection papers from National Recovery Services on behalf of the department of education. I attempted multiple times to make payment to National Recovery to avoid garnishment. National Recovery would not accept payment because my last name is now hyphenated. They requested a copy of my drivers license before payment could be accepted. I sent a copy of my drivers license to them via email. They confirmed receipt. A month later it still has not been updated " in their system '' and they still claim they can not accept payment. I filed a request for hearing with the department of education to stop garnishment while waiting for National Recovery to update their system. My request was granted by the US department of education and garishment was stopped. I have a letter stating the US department of education granted me and extension. However, National Recovery proceeded to contact my employer and initiate garnishment! National Recovery is garnishing my wages on behalf of the US dept of education illegally and they are garnishing my wages under my maiden name. It makes no sense to me that they garnish my wages under a name that is not my legal name but they can not accept payment now that my name is hyphenated. I have done everything within my power to make payments to National Recovery. The US department of education states the garnishment order was stopped. However, National Recovery has proceeded to garnish my wages without proper authority and in my belief in violation of the law.

Today I received a letter from the US Department of Treasury about my joint tax return refund being applied to a delinquent debt I owe. It states that the debt is to the US Department of Education Federal Offset Unit. When I called the Treasury Offset Program it states that National Recoveries a collection agency has my debt. I paid off my student loans years ago and know nothing of this debt, nor have I ever been contacted by anyone about the debt. I've tried reaching out to National Recoveries today to fix this and have had no luck. I tried by phone and I have tried contacting via their website which is stating it's unable to send the communication. My concern is that I don't know why I have an unknown student loan and why is the first time I am hearing about this? I XXXX college approximately XXXX years ago, and don't understand where this loan is coming from. On the document I received today it states " Before sending a debt to XXXX XXXX, an agency must send notice to you at the address in its records. The notice explains the amount and type of debt you owe, the rights available to you and the agency 's intention to collect the debt by applying eligible federal payments made to you. '' I have not been contacted by National Recoveries about sending this unknown debt to the XXXX XXXX and I have not been notified or communicated the amount and type of debt I owe. I feel this is a very unfair practice by National Recoveries and would like an explanation of what is happening and I would like them to help resolve the confusion.

Good morning, I just recently contacted National Recoveries in regards to my student loan account. It was 2 weeks ago when I found out they were going to be garnishing my wages. I lost my job and signed up at the XXXX XXXX XXXX. they had me in class the next day. I XXXX made about $ XXXX year income. I was receiving grants. I got to XXXX. Then I had a XXXX. I had a XXXX 9 months earlier. I had a XXXX. I did not have stamina to continue financially. They would n't give me time off until I was better withdrew me and told me that I had no more grant money. They told me that I did n't make enough money to pay them. so they put me on defer ments. you have to understand I basicly worked XXXX jobs. I signed to consolidate a couple times with a reasonable amount I could pay {$110.00} a month. then the payments went up to a XXXX a month. I quit. that was 20 years ago Now 14 years at my job and 20 years later they are garnishing my wages for 15 % of my disposable income. In XX/XX/2018 I had called into National Recoveries Incorporated who is collecting this debt on behalf of the US Department of Education. After speaking to them that day I advised them to not call my cell phone XXXX as it is a work phone that my employer pays for. I again called in on XX/XX/2018 to gather some information and before hanging up, again advised them they could not call my cell phone. Then on XX/XX/2018 I called in to see how much it would be to bring my account current. While speaking with a representative I received a call from National Recoveries Inc. XXXX XXXX Ext XXXX called me while I was speaking with National Recoveries Inc. What was odd is that the number she called from was XXXX area code so I am not sure if they were making sure I didn't know it was them. But after asking she advised me she was with National Recoveries Inc. I advised her that I was already speaking with them and advised her that she was not allowed to call my cell phone. This clearly violates the FDCPA as XXXX at ext XXXX said she showed my account as cease all cell phone calls as I had told them the previous 2 times. At this point I can either take this to court and have my loans dismissed with additional FDCPA fees and or they can put my balance to XXXX considered paid in full with no tax burden on myself.

My situation is in regards to National Recoveries withholding the tax returns belonging to my parents and myself. My parents file taxes jointly but separate from myself. This withholding is reportedly for debt owed to the dept. of education ( $ XXXX ) for which my parents were co-signers of loan of origin. This debt has already been paid to completion in good faith through a mixture of monthly payments and multiple past years of tax withholding which in excess of the amount of the debt owed. The completion of these payments is reflected clearly on my credit report and with the financial aid department of the original university. For the years XXXX and XXXX, my tax return was withheld in an attempt to service the " debt. '' Receipts of completion of payment provided to National Recoveries ( XXXX ). Additionally, no prior notice was ever delivered to either household in regards to this withholding which is suggested by federal guidance. Therefore there was no opportunity to contest the withholding and present evidence. Other than this debt, neither of our households have shared any other expenses for over a decade. The IRS does not assist in these affairs. I am having great difficulty in resolving this matter and am considering legal representation.

My husbands student loan is currently being serviced by National recoveries inc. we have been trying to get his student loan out of default since XX/XX/XXXX. The loan servicer said we had to make 9 consecutive payments to get him out of default. We have our payments set up for automatic withdrawal and they said they also need the loan agreement which we have signed and mailed in twice and they said they need reference we told them we do not have any reference to give them because we are already making the payments each month we don't want them bothering our friends and family. They said even if we still make the payments and send in the loan agreement with out the reference they wont take the loan out of default and still try to take my taxes each year. We are not applying for a new loan so we don't know why they need reference if we are already making payments the women told us they need the reference so in case they can't get a hold of him but every time they call he answers. National recoveries XXXX started having my wages garnished without ever contacting me first. They had an old address that they were sending my mail to and I never seen it coming. It put me in an extreme hardship. So my ex girlfriend who happened to work for a collection agency called them without my consent, stated we were married when asked, which is not true, and got all the details about my debt. They even allowed her to stop automatic payments I had set up on a credit card of mine and allowed her to use a different credit card, which I am not associated with. This caused a lot of problems between us and is why we are no longer together. I do n't see how they can just give my info out to a person without any verification and Stop an automatic payment on a credit card which I gave them. I feel unsafe with the way they handled this situation. Good Day, On XXXX XXXX I received a letter stating it was from the US Department of Education and that they were attempting to collect on a defaulted student loan of mine which I owed {$3200.00} ( Approximately ) in principal ( I have no idea how high this figure actually is as I stopped receiving notices at least 5 years ago ). In these documents was a notice for hearing and some paperwork to fill out for financial earnings. I filed a request for a hearing with the Department of Education as well as signed a notice to voluntarily pay {$50.00} a month towards this debt. On Tuesday, XXXX XXXX I received a letter from a collection agency called National Recoveries based out of XXXX XXXX Minnesota, asking me to submit documents for my hearing which is not at the Education Department but with National Recoveries. If I knew that it was not the Department of Education that was contacting me but a collection agency I would never have asked for a hearing or signed the voluntary garnishment form. My student loan is in default. I attempted to remedy this inXX/XX/XXXX, but no one could tell me who was servicing my loan So I did not know where to send the information or who to contact to correct the errors in the amount owed, when money was dispersed and withdraw dates. I recv 'd a letter dated XX/XX/18 from the US Dept. of Tres. stating they were going to with hold 15 % of my social security XXXX to collect a past due fed student loan. I have req 'd deferments over the past few years until I was told I could not do so anymore, I was not given a reason except that I had exceeded my limit. I hired an attorney ( XXXX XXXX XXXX XXXX XXXX to prepare and submit a rehabilitation agreement on my government backed student loans. National Recovery Inc., is the collection agent for some of those student loans. XXXX XXXX submitted my rehabilitation paperwork along with my XXXX tax return in XXXX, XXXX. I have defaulted on my student loan and fully accept that portion of my actions. My complaint, however, centers on the collection agency assigned to my debt : National Recoveries. I have contacted them by phone and letter ; their phone number is a single line that leads to a voicemail to which they have failed to either ( 1 ) answer at any given attempt of my 23 attempts and ( 2 ) have failed to contact me during times I have stated I would be open and available to talking to them about my debt issue. Only a very small part of my request was sent to me. They are seeking to attach, seize, or take my only continuing monthly financial asset. I just received a Wage Garnishment from my employer for National Recoveries for my student loans. I have never heard of this company. I have not received any written notification from this company of how much my debt was, any repayment options, or any settlement agreements. I contacted the collection agency that states that they have an extremely expensive amount of loans in my name. I was told I had to pay XXXX dollars a month and get garnished. I am now approved for a consolidation I took out with out the collection agencies help because they said I did not qualify.
