My XXXX Federal Income tax refund in the amount of {$5000.00} was taken by National Credit Services ( NCS ) to offset the alleged defaulted student loan, while on XXXX XXXX Military. The alleged school loans were, supposedly, taken out by me, during a time that the XXXX XXXX GI Bill was paying for my schooling in XXXX. Pell Grants were covering any other expenses. The original loans were allegedly taken out at XXXX University in XXXX Texas. My school and expenses were covered by my XXXX XXXX GI Bill and Pell Grants. I did not need loans and I do not recall ever applying for loans. I believe XXXX received money from the Veterans Administration and also took out loans in my name. I did not attend any exit interviews upon my graduation because I moved from the state of Texas to Pennsylvania before my actual graduation and in fact completed my last 2 classes at a branch campus in Maryland while still technically attached to the campus at XXXX, TX. I didn't even know loans existed in my name till National Credit Services ( NCS ) notified me in XXXX or XXXX or XXXX of XXXX. I spoke with XXXX with NCS ( XXXX ) who was just attempting to collect the debt for the alleged defaulted school loans to the Dept. of Education before my pay would be offset. She gave me a direct number to contact them after I had some time to investigate the alleged loans. I told them I would contact XXXX University and I also asked the Veterans Administration ( VA ) to investigate these alleged loans. The VA just referred me to their website. The information from XXXX was conflicting and inconsistent. For example, right before my graduation, on XX/XX/XXXX, I received a note saying I was getting a refund of over {$1000.00} but had a balance due of {$11.00}. I never received this refund but evidently XXXX did. My payment plan for XX/XX/XXXX showed my first installment due XX/XX/XXXX showed an amount due {$6300.00}, payments received {$6300.00}, changed from {$3400.00}, remaining amount due of {$0.00} dollars. ( Copy attached ) By the way, I also learned the Financial Aid Director was reassigned or transferred during this time period to another position. Moreover, one loan used my wife 's birthday as the loan begin date in XXXX and my birthday as the loan end date in XXXX on loans taken out in XX/XX/XXXX. I was also told by NCS that once I gave them all this information, and they had noted all the information and recorded my information about what I had found out about the debt and notified the debtors that I was fine. They noted everything in their system. NCS assured me that my XXXX refund would not be offset while I tried to find out who, what, when, where, why and how these schools loans came to be and why I was not notified till they were in a default status. After my Federal Tax return was offset, I spoke with NCS, on or around XXXX XXXX XXXX. The representative requested and mailed the Department of Education appeal paperwork. He offered to help fill out a Department of Education appeal, but I have not received them. My family is in Indiana and I was XXXX in Pennsylvania and then recently transferred to XXXX, VA. I expect to get all of the information and file that paperwork within the next week. The NCS representative did admit that he could see in the system where I had notified them of the situation back in XXXX or XXXX or XXXX of XXXX. He took current notes about my situation. He looked at the old notes and everything that was stated. The conversations were recorded notes taken. When questioned about deferred loans and XXXX XXXX military, he did state that he did know that if the loan was in a deferred status that they could not collect the debt. I made sure he answered the question and stated this with the understanding that I was and he was being recorded. Even if a student loan was owed. My tax refund should not have been used to offset the debt. It should have been deferred while on XXXX XXXX in the XXXX. I was on XXXX XXXX orders to XXXX XXXX PA as the XXXX XXXX and armed watch XXXX XXXX as of XXXX when I was transferred to another XXXX XXXX location Med Hold XXXX XXXX. My XXXX Federal Tax Refund was offset to pay National Credit Services so they could collect a loan debt for the Department of Education. I am also still currently on XXXX XXXX orders in XXXX, VA. I am on XXXX XXXX awaiting XXXX XXXX. No one should have been authorized to offset or collect on a defaulted or current school loan that should be in a deferred status. I am an XXXX XXXX and XXXX XXXX XXXX XXXX with over 16 years of military service. I am still on XXXX XXXX military orders to XXXX XXXX. I am going to be getting XXXX XXXX XXXX in the next XXXX weeks and I need my income tax refund back from either the National Credit services or the Dept of Education to care for my wife and XXXX minor children. I need my money {$5000.00} federal tax return money. I filled my XXXX taxes with XXXX XXXX in XXXX XXXX, PA. They have the needed tax documents and I can also forward copies. I was TOLD by NATIONAL CREDIT SERVICES INC. ( NCS ) that I had a calculated payment of a particular amount that I needed to make in order to be enrolled into the Federal Student Loan Rehabilitation Program. I initiated a call to NCS in XXXX. I communicated to NCS my desire and intention to enroll in the Federal Loan Rehabilitation Program. At that time I also communicated my concern that the payment amount NCS was quoting to me was too much and above my means. NCS said that was what they had calculated and that it could be MORE. When probed, NCS also indicated at that time that with the proper paper work the Department of Education could calculate my repayment amount to a determine a payment based on official documents. Again, they stressed that this could be MORE money than their calculations. In accordance with my desire to be enrolled in the federal program I sent in the required paperwork and official documents to NCS and the United States Department of Education ( USDE ) to determine my monthly payment amount in hopes that the payment amount would be affordable.The USDE calculated the appropriate payment amount and communicated that amount with NCS. I signed up with NCS for the USDE federal loan rehab program with the USDE calculated payment amount. Unfortunately, it has come to my attention on review of my bank account that NCS Inc. has been taking out an amount not calculated or authorized by the federal government, or signed up for by me. I have not authorized NCS to collect another amount other than what was agreed and calculated by the government. I agreed to pay NCS in accordance with my agreement and terms set out by the United States Department of Education federal loan rehabilitation program. No more and no less. I called NCS in XXXX to inquire about the incorrect withrawl amounts. I inquired as to why this amount was being debited from my bank account and who authorized this amount. I asked NCS to cancel the incorrect payment and debit the authorized payment. I was told that I had agreed to pay this other amount and had been paying it and that people always pay OVER the amount owed so how would they know. I did not agree to any other amount than what is outlined in the federal documents that I signed to be in the rehabilitation program. In response to how they would know, they would know by looking at and referring to the federal documents that they collected and have on record that clearly specify the amount that it to be paid during the Federal Loan Rehabilitation Program. NCS has the signed paperwork of the amount I DID agree to pay. I signed paperwork and agreed to the calculated amount given by the Department of Education, then readjusted by the government and signed by me of a lower amount. NCS has the signed documents that indicate the amount I am to pay. At no time did I agree to make payments to NCS other than to be enrolled into the Federal Loan Rehabilitation program. NCS has no right to take an amount other than what was agreed on by and set forth in the loan rehab program. It is with confusion and anger that I write to report that NCS has chosen to continually ignore me and the signed federal documents that they have possession of. NCS claims that I want to pay more than what I am documented to and they are authorized to take it. I believe this is unethical, adverse, and fraudulent business practice on the part of National Credit Services Inc. After many calls to NCS and requests for call transcripts or a refund, there has been no resolution. I was told by NCS they would not comply except for on court order. I am eliciting outside help to rectify this issue.

Here is my complaint letter to national Credit Services sent today : My name is XXXX XXXX. I had arranged for a payment plan on XX/XX/2018 and then amended this on XX/XX/2018-Rehab program arranged. The first arrangement based on the notion that I would pay less because I have a heap of medical bills to pay from a XXXX XXXX in XX/XX/XXXX and was trying to create some kind of requested statement. I could not make that happen because of bills from several docs, surgeons, hospitals, etc. so out of honesty and complicated circumstances, I called back and said to forget about using those expenses to lower the monthly cost, I would pay higher rate. XX/XX/2018. The new plan was arranged, I gave my bank account information and was told that I would have to make 9 consecutive payments and then we could move on to the next phase of payments and out of default status and no garnishment to my account would be made. XX/XX/XXXX, I go to work and find that a garnishment was indeed made AND you are taking the arranged payment out of my account. This is problematic for several reasons : You pick on people that are obviously struggling. Your tactics of bullying and forcing them into arrangements that are not clearly explained is unethical and will be reported. You say you have reviewed all the conversations, yet I can not defend myself nor can I trust what you are saying since I can not afford to subpoena you to hear the recordings ( that may not even exist ). The documentation I sent to verify my income was sent as asked more than once and your system apparently can not decipher the information OR you do not respond to anything that goes to XXXX No one warned me that my wages would be garnished in enough time that I could try and make alternative plans even though I made an agreement with you Your representatives today are telling me that even though a signed contract was sent, because payment was not made in the 30 day time period, which I did not understand, I would still be garnished. I understood it to be to sign the papers. I did not want to give my financial information to you until I verified who and what you were. There are a lot of scammers out there and I ma still not trusting this situation. Why would I still sign an agreement for XXXX XXXX monthly payments to be voluntarily made knowing my wages would still be garnished {$200.00} per paycheck? My expenses exceed my income. How can I pay {$400.00} out of my monthly income without going to bankruptcy court? This creates an extreme hardship for me. Note my expense report attached. Your representatives are not clear with the deals being made and misrepresent what the outcome would be. Your company uses unethical practices to bait and switch to customer. I will be sure to report this to everyone that I can. Re : Discharge ( XXXX ) and XXXX XXXX. From the above heading XX/XX/XXXX I was eligible for social security XXXX Insurance and my next review date was determined after 8 years. XX/XX/XXXX and now XX/XX/XXXX. I have now attached the Certification -completed section 3 and had a physician sign. I have written to XXXX, recovery and National credit and XXXX XXXX Asking for Debt validation from XX/XX/XXXX and have not received anything from XXXX verifying the debt. I also asked for a previous statement of all payments that was transferred before they took the loan. I have proof of payment from XX/XX/XXXX until XX/XX/XXXX. As I was eligible for social security XXXX insurance from XX/XX/XXXX. I had previously applied for Forbearance in the month of XX/XX/XXXX. XXXX was deceiving ( me ) borrower, misallocating payments and steering me into costlier forbearances rather than income-based repayment programs. Deceptive Trade Practices Act, and the Nebraska Consumer Protection Act through increasing revenues by moving accounts of borrowers into forbearance or deferment To move my account to forbearance accommodated a delay in the processing of my renewal application, and violated the NW YORK Unlawful Trade Practices Act, the Nebraska Uniform XXXX fraudulently, deceptively, and illegally advertise, market, offer for sale, sell, and finance student debt relief services to thousands of consumers nationwide, including thousands of New Yorkers. I informed XXXX of my social security XXXX insurance from XX/XX/XXXX and mailed them several Copies via certified mail and registered mail. No Reply on documents to verify the loan and balance. In spite of knowing they still pursued the collection by forwarding me to XXXX XXXX and National Credit for a loan that they claim was in default. I got calls several times a day and on a Sunday from a local number XXXX XXXX and told the supervisor that I had sent documentation to XXXX on my discharge XXXX ( XXXX ) but pretended They had no file and was returning the case back to XXXX its on a prerecorded line. My loan was {$8500.00} and {$7600.00} was credited and the last offset payment of XXXX received on XX/XX/XXXX In XX/XX/XXXX they offset my account from XXXX social security funds of {$780.00} In XX/XX/XXXX they offset my account from XXXX social security funds of {$650.00} Come back in XX/XX/XXXX and take out from my XXXX social security funds {$480.00} From XX/XX/XXXX to XX/XX/XXXX I have paid the loan totaling {$7600.00} and they still try to use Ways to garnish my social security and tax loopholes. XXXX cancellation of this income-based repayment plan is a common and pervasive practice conducted by employees of this company. XXXX profited by this practice, known as " recycling, '' by referring me to other agencies knowingly that I was on permanent XXXX and had my review date after 7 years. My student loan is in default. The department of Education transferred my loan to a company named : NCS Collect. I was advised via mail to contact the company or risk wage garnishment. This company has been a nightmare to work with. I've been trying to obtain a reasonable payment plan to get my loan out of default since XX/XX/XXXX. I called and stayed on the phone for more than an hour providing financial information to calculate my repayment amount. After uploading sensitive documents including pay stubs and tax info, I was told that the info would have to be reviewed. I was supposed to receive a call back. That call never came. I tried to call them back the next day, and I couldn't get anyone to speak to me. I was either transferred to a voice mail by someone, or the call went directly to voicemail without me speaking to anyone. I called the Department of Education, and after demanding to speak to a supervisor, I filed a complaint. NCS called me during work hours which obviously isn't going to work, since I'm trying to make money to pay the money that's being demanded of me. I'd call back, and get someone different. I'd then have to go through the ENTIRE process of sending in documents and going through my bills to get a payment amount that was too high for me to pay. I went through this circle 3 times. Each call would take about an hour. I'd be directed to call back, and either my documents weren't received or they were under review. Finally I got to a point where I provided my debit card and scheduled a payment with someone only to be told to call back. When I called back, I had to send the same sensitive information, this time proof of medical receipts only to find out later that they hadn't even calculated my payments based on the documentation I sent in. I've emailed all of this sensitive info to 2 different email addresses and uploaded them to their portal MULTIPLE times. After calling again, and providing my card info again, and resubmitting a document to reflect an even higher amount than I agreed to which I accepted out of frustration, I was told ONCE AGAIN to call back Monday ( XX/XX/XXXX ). I called yesterday, and got voice mail. I wanted to stay on top of things. I can't take this anymore. I believe that I'm being given the run around, so that my wages can be garnished. I think this is intentional between this company and the Department of Education, and it is WRONG. If you review the XXXX XXXX reviews for this company, you'll see the same complaint over and over. Be threatened with wage garnishment only to not be able to work out a payment plan to be executed successfully. It's exasperating. No one wants the embarrassment of wage garnishment, but at this point, it seems as if it would be easier.

At XXXX CST on XXXX XX/XX/XXXX I was contacted on my cellphone by NCS. After verifying my name, the agent did not identify herself nor her agency, openly announced my current address, and then asked my DOB. At that time, I asked who the agent was with and what this was regarding, and she identified her agency, which was NCS. I asked her if it was illegal for her to proceed without identifying herself, and she told me it was in fact illegal for her to identify herself before verifying my DOB. I then verified my DOB and asked permission to continue recording, to which I consented. She then went on a script that this was an attempt to collect a debt ( I know that they are contracted to service my student loan - which is protected from collection efforts until the CARES Act expires XXXX XX/XX/XXXX ). She then went on to read more about the Cares Act and it expiring in XXXX of next year. As I was unable to understand her due to fast pace and mumbling, I asked her to clarify. She in no way clarified, but simply repeated herself in a way that I almost understood as Rehabilitation of my student loan that is currently in default. She then provided me with an incorrect amount due of {$11.00}, xxx. Due to the zero interest for the better part of XXXX, regularly checking my credit report, and an effortless check of my current balance at XXXX I was knew that my balance due is {$9700.00}. At this time I made efforts to end the call, as trying to collect an incorrect balance is a direct violation of my rights. She then got agitated and said something under her breath, which was the moment I terminated the call. This agency makes practice of not identifying themselves and has done so on every occasion that they have called me from the time that they acquired my account in late XXXX. They have also provided incorrect information in XX/XX/XXXX, on a call to the same number, stating the only way that I can get my loan out of default would to be to pay it off completely. Considering they called 9 months later offering to rehabilitate that same loan, Im going to go ahead and say that their collection efforts are not only abusive but illegal and a violation of rights. I will be filling this complaint and multiple disputes on federal, state, and credit bureau platforms. The American people deserve better than what this company is providing on a tax dollar paid government contract.

Hi, my problem is when I was XXXX yrs old I went to get a XXXX at the local XXXX college where I grew up. I was automatically enrolled in a quarter ( I was XXXX, mind you, I had no clue what was happening ) so I figured I 'd give it a shot and it was under a PELL grant. I decided that was not for me, as I was going to be a XXXX, which I am now. So ... here we are, decades later. I am told I was enrolled in a different XXXX college, rather some distance from where I lived. I did not. I am told there is a consolidated loan on this. I did not do this, either. I have tried explaining this until my face is blue and get nowhere. At this time, I do n't even know what this other college is! So, I was contacted by NCS and it seemed I could finally get a resolution. I filled out so much paperwork it seemed to me, maybe someone would actually look into this and fix it. Not so much. They took all my info and proceeded to garnish my wages. I can not have this much taken from me, especially since I do n't owe it. I called NCS and was told I was put under a financial hardship and they would not take more than XXXX $ per monthly check. Surprise! It was 15 % of my ENTIRE check, garnished. I 'll end up with no power and no apartment within months if they do this. My plan was to go ahead and let them take a garnishment ( small, not fun, but managable ) while I contacted a lawyer to see what I could do about this, as all I get is a runaround and they really do not care to even listen to what is going on, or care if I lose everything so they can just do whatever they want. I was suppose to get a phone interview, did not happen. They say they wo n't take more than XXXX $ but took twice that amount. I was XXXX and did n't know what I was doing ( parents were not involved, just me. ) I have tried, many years, to just talk to, and find out what this is even about. No info is given, they just take my money for some school I never went to. I never, at any point in my life, spoke with anyone about, or, consolidated any loans. I need help, and did contact a lawyer, who directed me here. Mostly because I have no info on what this even is, as nobody will tell me. All they care about is robbing me. And this is robbery. They ca n't even get my name right on this. I am a professional, and this is BAD for my reputation.

I have received a debt collection notice from NCS ( National Credit Services Inc. ) located at [ XXXX XXXX XXXX XXXX, WA XXXX ] today XX/XX/XXXX in my residence mailbox. The notice is dated for XX/XX/XXXX. The debt in question is from creditor XXXX ( XXXX XXXX XXXX XXXX ) for an unconfirmed and presumed parking violation on XX/XX/XXXX. The letter also encloses the principle amount and interest. Enclosed in this letter is no proof of violation or contact number for the parking management company. I had called the debt collection agency ( NCS ) about the claim and they informed me of which parking lot the alleged violation is in as well as asking me if I wanted proof of the violation. ( of course I do ) But now they have to mail it out to me again. I have no recollection of being at this parking lot the date that is posted. Here are my issues with this whole process so far... 1. Like any normal parking violation, one would expect a ticket on the windshield of their car if violated. This was not done. 2. No attempts were made to communicate to me that a violation had been associated with my license plate. The company has an online portal for payment/checking. I check the mail twice a week. 3. Instead of trying to communicate with me through writing or other means, the parking company ( XXXX ) immediate first response is to file a debt collection against my name. This is serious business as it appears on credit reports. 4. I tried looking up my plate through their online portal at XXXX XXXX XXXX # /citation/citationSearch and my license plate did not show up in their database. Thus I proceeded to email the company to ask about the violation. Their response was that they could see the record but refused to communicate with me about the violation, provide evidence, or offer a resolution. Only said I could communicate via NCS. 5. The debt collection agency was extremely slow with their correspondence. My debt owed is only {$70.00} and although interested may amount to a few dollars, this may not be the case for people who have outstanding debts in the thousands. The lack of professionalism or empathy from either company is appalling. The debt collector only sent me a letter noting I owed money, how is one to trust this. Also communication can only be done through writing, this is the XXXX.

The collection agency named ACT Account Control Technology intercepted my entire tax return without proper notice of their attempt to collect any debt. They were collecting for a student loan and sent the letter of intercept to my old address intentionally to make it look as if I was ignoring their request. The party they were collecting for had my new address since XXXX XXXX, I was receiving mail from the original party regularly. However ACT maliciously sent the intercept notice to my prior address on XXXX XXXX, XXXX which I still have never received or seen. I moved from my previous address XXXX XXXX, XXXX. If this company was collecting for a Federal Student Loan and sent a notice to intercept on XXXX XXXX, XXXX to a place I no longer resided and have n't resided for over 3 months at time of alleged mailing. Why and how did the original party have my current new address and the collection agency did not? Do they not communicate with each other? The company ACT Account Control Technology is a very crooked company and will fabricate and or deceive by any means necessary to take peoples money without proper notification and or mailing. I also told them via telephone that I disagreed with their approach and or action to collect and requested appeal information and or documents. I was told the company ACT Account Control Technology would email me the needed documents that same day and I never received anything via email on any day pertaining to my request. This company stole almost {$2500.00} from me and my daughter, yes I am a single parent and yes {$1500.00} of the money they stole was supposed to go toward my daughters dental work that we had to cancel because these crooks deceived the Internal Revenue Service making them believe I was ignoring their attempts to collect when in reality I have never even seen one of their letters or notices to collect ... even to this day I still have never seen this notice that was supposedly mailed to the wrong address.

On XX/XX/XXXX, I received a letter from NCS ( National Credit Services-a contracted collection agency ), stating that my wages would be garnished if I didn't make an agreement with them within 30 days. I tried calling several times. They are closed after XXXX. I finally got ahold of them at XXXX one day and set up an agreement to pay {$14.00} with the understanding that I would get back with them about additional medical bills that were weighing heavy on me from an injury I received in XXXX which resulted in XXXX and some time off work. After finding that I owed 4 or 5 providers and that it would become too difficult to create a 'statement ', I got back with them letting them know that I would take the larger amount regardless of the additional medical bills. I thought that when I had made and agreement with them on XX/XX/XXXX, that all was good to go, we would start the rehabilitiation program and I would start to feel relief about this debt hanging over my head. They took a payment from my account on XX/XX/XXXX and another out of my account on XX/XX/XXXX. I thought everything was good. And then on XX/XX/XXXX, I was informed by our Human Resources person that my wages would be garnished {$200.00}. When I phoned them today, they gave many excuses for this action : 1. It was over 30 days from XX/XX/XXXX 2. My pay stubs were not dated properly 3. They said they tried to phone me, but I do not answer my phone on work hours and they never left a message. I was totally under the impression that all was good and that my rehabilitation agreement would ensure that I would not have my wages garnished. I neither heard nor understand that when I spoke with XXXX on XX/XX/XXXX, that my wages would be garnished. All or most of the communication I had with them was pushy and 'urgent '. It was very stressful and difficult. Now, I have to make the rehabilitation agreement AND they are taking the garnishment. This is unfair, dishonest and unethical.

Hello, I have been making small payments to my defaulted student loan though XXXX since XX/XX/XXXX and wanted to repay in full the existing balance. Up until today XX/XX/XXXX the website showed that my balance was XXXX ( XXXX principal XXXX interest ) The last time I logged in before today was Saturday XX/XX/XXXX. Since XX/XX/XXXX there is a new field " Projected PCA Fee '' in the balance spreadsheet on myeddebt.ed.gov that was not there before today. I have a screenshot from XX/XX/XXXX of how the website looked, the presentation from a year ago has changed and it is apparent that the " Projected PCA Fee '' was not included in the balance. The " Projected PCA Fee '' disputed is for XXXX. My issue is that this fee was not stated before and in order to repay the loan amount through the website I would have to pay this fee that appeared without prior notice. When I called the collections agency " National Credit Services '' of XXXX, WA today, they said I would have to pay this fee to satisfy the amount but I was not made aware of it through the government website myeddebt.ed.gov until I logged in today. They also stated that the last mail they sent that would have this information was sent in XXXX. By the end of the call, the offered to " start a settlement '' and that the loan would still not be considered " paid in full '' I ended the call without starting the settlement. On XX/XX/20 after MONTHS of trying to reach National Credit Service ( NCS ) I was finally able to get someone on the phone to make payment arrangements. At this time they informed me that my account would be in delinquent status unless I pay the loan off in full for {$20000.00}. I am unable to do this so I started payment arrangements. I called again on XX/XX/20 to see if I could get proof of my payment plan including information on if my payments are going to interest or principal etc. I was informed that they could not tell me but could send out a paper showing my payment and they referred me to look at XXXX for information. I again asked if my payments could change the status of the account and was told that I would have to pay {$20000.00} to change the status of my loan. I was able to log onto XXXX and I can see that my balance is {$17000.00} to pay the loan in full. NCS is being deceptive to exhort additional funds from me against my remaining balance. This is obviously unfair collection practices and fraudulent actions on their part. The Department of Education gave my loan balance as {$13000.00} as of XX/XX/20 with NSC trying to collect a {$3000.00} fee and interest on top of that. NCS 's deceptive actions leave me no choice but to report them for this to be resolved. Their poor ethics, terrible customer service and unfair practices leave no room for anyone to pay down a loan. The payments that I am making are going ONLY to NCS fees and not even toward my loan balance. This needs resolved immediately.

Back inXX/XX/XXXX I gave a debt collector representative from National Credit Services my information to process one payment of XXXX on XX/XX/XXXX. They took my information and processed two payments of the amount stated above, which caused my bank account to go into a negative. Due to this unauthorized payment they processed twice, I was negative in my account with XXXX XXXX. I filed a complaint with Consumer Financial Protection Bureau XX/XX/XXXX case number XXXX. They looked into this issue, had the bank do a reversal of payment because of my information being abused. Also this same company that abused my information ( National Credit Services ) sent me a two separate letters, stating my must sign authorizing the payments. I refused to sign and brought this letter to XXXX XXXX to scan and save. Today two National Credit Services representatives on the same line, called me on the phone at work, hassling me for my information and payment. I explained to them i 'm at work and am uncomfortable with giving them my information, due to the prior unauthorized payments. However I was willing to set up a monthly payment of {$100.00} usc on their online site. They explained to they were n't going to accept my monthly payment and said i was refusing to pay my debt, threatened to ruin my credit and keep me from being able to unfreeze my account and go back to and city or state school. XX/XX/17 : I am writing to complain about a company who self-identified as " NCS ''. They have been calling me everyday for the last three months looking for my brother. I have asked them three times to take me off their list and told them I do n't know how to contact my brother. When I asked how they got my contact information, they refused to tell me. I later spoke with my grandfather, who is 94 years old, and he told me the same company called him inquiring about my brother ( his grandson ), only this time they were calling him for a " job reference ''. That is a lie. They asked him several personal questions about my brother and our family, including contact information, employment information, location information, and debt information. Thnking he was helping my brother, my grandfather gave NCS the information they requested. I work in legal aid and sit on a statewide committee to end elder abuse. NCS knowingly took advantage of my aging grandfather, lied to him to obtain personal information he would never give otherwise, and led him to believe this was in benefit of his grandson. This alone warrants an investigation into NCS, accordingly to CA law. Please take this complaint seriously and investigate. I will be following up. Thank you.

Apparently I have a student loan over 33 years old that was supposed to be disposed of due to the school in question XXXX XXXX XXXX in XXXX Ohio. I attended for 2 weeks. The school was supposed to return the loan, I myself never received any funds. A few years later the school goes out of business and is sued for it's practices. I never heard anything else about the matter. Every few years I would be contacted by the US Dept of Ed attempting to collect. I would speak to someone and nothing would come of it. Here recently I have a debt collection company that is threatening garnishment if I do not respond in a timely matter. I have and sent the correspondence by certified mail with a change of address. I do not live at the address stated, but they continue to send time sensitive material to this address. They are trying to force a default judgement and I need to know what is my recourse. I have requested a hearing from the US Dept of Ed I do not have any information from 33 years ago showing what I stated was true. But they should have knowledge of this action taken against this school. I contacted National credit services and made arrangements in XX/XX/XXXX. In XX/XX/XXXX I faxed XXXX my paperwork and emailed them the paperwork to XXXX Then I heard nothing from the company. Now the company NCS states that a payment from my account at XXXX XXXX was declined and that they emailed me and sent me letters and called me 23 times, however I have no emails, no letters from the NCS and no missed calls or at least one voicemail from this company. I have been trying for years to have my loans rehabilitated by the National Credit Services. I check my credit report on XX/XX/2021, and see that my loans still show that I am in collections. I called National Credit services and they state the last payment that would put my student loans in good standing FAILED. And because that payment didn't fail in XXXX I would have to go back through the program allowing the defaulted loans to stay on my credit report for another 9 months. I never received any communication about a failed payment and if I did I would have happily provided new details for my last payment to have my loans in good standing. National Credit Services even has a record that I contacted in XXXX. I called in XXXX to find out why my loans weren't out of default and I was told that paperwork needed to be submitted to have my loans returned back in good standing and that I should wait for communication from the Department of Education. I filled out a form of cancellation for a XXXX located in XXXX, Washington and they misfiled it back in late-XX/XX/XXXX/early-XX/XX/2016. The debit card connected to membership, around the same time of my membership cancellation, got lost so I cancelled it as well. I did n't inform them of the card cancellation because I thought I had cancelled my membership effectively. They continued trying to charge my cancelled debit card into the coming XX/XX/XXXX before they informed me that the National Credit Services would take on the debt. National Credit Services sent mail to an old address of mine to which I could not retrieve it. They are trying to collect debt from me, but I should not have to pay this debt because the gym themselves misfiled my cancellation. What if they did this on purpose to profit off my cancellation? I was scanning through my credit and noticed some inaccurate information and accounts on my credit report. I have two separate accounts from National Credit Services. One of the amounts is XXXX and the second one is XXXX both account numbers are listed the same, XXXX. I sent a letter to them to dispute these errors being reported and also wanted to get verification of the debt, that letter was signed for them on XX/XX/2022. I received a letter from them dated XX/XX/2022 basically saying it was verified. I then proceeded on and sent another letter to them which was received by them on XX/XX/2022 and received the exact same letter back from them, which was dated XX/XX/2022. I had student loans and I did go into default and enter a rehabilitation with XXXX XXXX XXXX. My loan came out of default and was in good standing. The XXXX XXXX XXXX then transferred my loan to XXXX but I was not informed of this transfer and my auto payments were stopped. So then my student loans went back into default. For each semester of school, it was tracked by the XXXX XXXX XXXX as a separate loan ( totaling 23 ) which showed 23 defaulted loans. These were transferred to National Credit Services back in default and are not on the credit bureau reporting. I am attempting to purchase a home and got way into the purchasing process only to find out that FHA found something pointing to defaulted student loan debt but the credit bureaues reporting did not show them. When I tried to work with National Credit Services, they are not able to offer any type of resolution to get out of default other pay in full or payments for 20 years and stay derrogatory for 20 years.

This concerning a collection agency, name ( National Credit Services ). Wasn't notified of atempted to garnish my Social Security or any pending court date. Was told they didn't have to. The collection agency uses random addresses for purpose of claiming individual was notified at a address they didn't live. They coerce people into making payment arrangements through intimidation and threats just to end up getting their bank accounts cleaned out and large amounts of money taken from what ever source of income an individual has. I contacted this company after I was given their name to help pay back my student loan. They gave me a monthly amount of XXXX+ to pay back but I offered XXXX a month. They told me that when the loan was paid, they would report to the credit agency and it would not show as a loan collected through a debt collector. I was also told that this would prevent my tax refund being taken as well. Well my tax refund was kept and they said they did not know why that happened, maybe my name was on a list for them to be held. I said my taxes were n't held the year before so it was something they must have done such as putting my name on a list to hold my tax refund. Even though it went towards my account, I was told that because the loan would be paid off early now, I was not entitled to the benefits of having this be reported to credit agencies as paid off without debt collection. I had a missed call from National Credit Services at about XXXX XXXX on XX/XX/19. I returned the call and verified my date of birth but refused to give the last four of my social security number. I asked the rep who they represented and she kept giving me her company 's name. I asked for a supervisor the rep asked me to hold and then came back onto the line to ask me to continue holding. I advised her that wasn't necessary and to please just remove my telephone number. We ended the call. The next morning I received another call. I have attempted on several occasion to tend to the account of my student loan debt. I have been garnished by IRS on all tax returns for the past several years, during which time I have been denied any and all access to information about the dispersal of these funds in relation to my account. I can gather no actual data on the thousands of dollars that have been taken from my Tax Returns and applied to the " Student Loan Debt ''. The best that I have been able to gather over the phone is that they have applied 100 % of the monies that they have collected from me to the interest on the loans and not one penny towards the principle whatsoever, which leaves me in a position of perpetual debt with no possible routes to a meaningful resolution. I was forced out of forbearance by XXXX XXXX in XX/XX/XXXX ; at this time NCS contacted me about debt and I started the rehab program and completed my 9 months of payments and around the end of the 9 month I didnt have a job but they were calling me everyday because they wanted to add a card to the account. I was unemployed and borrowing from relatives to make my last few payments. In XX/XX/XXXX of this year, me and my wife became aware that were are victims of identity theft. I have been actively disputing the ( XXXX XXXX outstanding collections that this company is reporting as my debt. Apparently, multiple checks were written to a grocery store XXXX, WA back sometime between XXXX - XXXX XXXX 2010. I was placed under a Federal Rehabilitation Program for my outstanding student loans, which expired 2019. Once my program expired, I applied for a income based driven repayment program that was under review because I have sent all financial documents as requested, and was was waiting for a approval per their representatives. Unbeknownst to myself and my family, my 2019 income tax was taken without notice by the Federal Offset Unit. I attempted to contact the Collection Agency as instructed and was consistently misled about the process and not informed of my rights. In 2013 I consolidated ALL of my loans to make one bulk payment of {$12000.00} to National Credit Services to pay off all of those loans and I was told that total would pay off all of those loans. After paying that, I did not receive any calls or notices that I had payments due. I looked at my credit report in the last year and saw that this account was still open, so then I launched an investigation via my credit bureau to look into why this account was open, but did not get an answer. This really caught my attention when my tax refund was taken by this company. On XX/XX/XXXX around XXXX EST, I made a phone call to clear up the situation with the National Credit Services. Hello, My income tax has been garnished last year and this year about $ 10k+. I never received an offset letter so that I could make arrangements. When I initially called NCS National Credit Services on behalf of the Dep. of Education to get more info about the loan they could not provide me any information about what the loan was for. Now that all this amount has been taken out I can not get through anyone or get account information with my SS number when calling. Recordings say there is nothing on file. Websites dont work. In 1993 I took a student loan out ... i had to repay XXXX. After growing up and having a family the student loan was at the end of my list to worry about. Around 2015, i applied for a graduate program in XXXX XXXX which i was granted and i was given a grant of 2,000 plus, but in my admission letter, it was not stated that i will pay back the grant if i drop out of the College, but the college wanted me to pay back the grant after, they have me pay the loan i borrowed for the little time i was there. Upon review of my credit report in XX/XX/2019 it was brought to my attention there was several accounts that reported negatively that needed my attention. A few separate accounts were owned by the separate collection agencies, one being National Credit Services. The loan was put in default by error. We were contacted about payment and put the loan in forbearance due to a financial hardship. However, the people we were contacted by was not the actual loan servicer, but a scam company masking as our loan servicer. Now the result has placed the loan in default, which should not be because the original loan payments should no t be due until completion of college.
