I own a home that I bought in XXXX right before the pandemic that has an HOA attached to it. Due to a period of financial hardship at XXXX point in time and lack of understanding of how to pay the HOA along with the mortgage I got behind on the HOA payments. I thought the HOA payments was included in the payment of the mortgage. They are paid separately. By the time I figured it out ( about a year later ) and was ready and able to make the HOA payments, XXXX XXXX XXXX XXXX had already sold the debt to XXXX XXXX XXXX, XXXX located in XXXX, XXXX. XXXX XXXX XXXX sent me a statement in the mail and by email how much I owed to return my account back to good standing. The total amount owed at the time the statement was sent was {$2400.00} on XX/XX/XXXX. Since the beginning of XXXX I have been sending in payments monthly to pay off this debt ranging from $ XXXX {$900.00}, however instead of the debt going down XXXX XXXX XXXX continuously adds predatory fees to which the debt never goes down. Even though I have been paying monthly for the last XXXX years the total debt now owed is {$4100.00} instead of paid off and back in good standing. I have received in the mail their statement that if the debt isn't paid they will try to seize my property even though I have been religiously been paying to get rid of this debt. I have also kept receipts. I have emailed and have been in constant contact with XXXX XXXX who works for XXXX XXXX XXXX to resolve their predatory practices to no avail.

HOA Association XXXX XXXX sent my account to the Collection Agency Nagel and Zaller for XXXX. My Account was paid to the HOA agency before receiving the initial collection notice. Check payments noted on statement balance sheet. Notified HOA and Collection agency and account remained in collections. I have attempted to pay my account and settlement amount was denied. Attempted to make a payment arrangements and the payment arrangement submitted to me by the collection agency was incorrect. My account has excessive charges and fees that are not valid. My account has legal court charges for a case that did not go to court. Charges for preparation of an incorrect payment arrangement. Requested payment arrangement on the amount owed and I was sent an arrangement for double the amount that was owed.Email traffic with XXXX XXXX and account still remains with excessive charges and incorrect information. Account was paid in full for the collection amount of XXXX before I received the collection notice. Nagle and Zaller was recently sued for unfair collections practices, for practicing without a license. They are attempting to foreclose on Veterans home and rack up excessive collection charges.

My home is located in an HOA that was managed by XXXX until XX/XX/XXXX. During their management numerous accounting errors were made which resulted in a $ 300+ balance that was turned over to Nagle and Zaller in XX/XX/XXXXfor collection. Specifically, these accounting errors were the recording of returned check in XX/XX/XXXX and the non-payment of dues in XX/XX/XXXX. After receiving this account, Nagle and Zaller placed a lien against my title for the $ 1600+ outstanding balance owed. I became aware of this balance upon attempting to refinance my home in XX/XX/XXXX. Over the course of the last several days I 've sent two cancelled checks showing that payment was made on this account in both XXXX and XX/XX/XXXX, effectively showing that there was never a balance owed and that this account should not have been turned over to the law office for collection. Further this proved that the lien that was placed against my title should have been immediately released as it was stemming from accounting errors on the part of their client, XXXX.

My Homeowner 's Association ( HOA ) has changed management companies several times since I moved into my community. Presently, statements are not being mailed to residents. I set up an online account to make payments. Unfortunately, I misplaced that information. I made attempts to contact the HOA to obtain information about how to continue making payments and have been unsuccessful in receiving the information. I asked a neighbor for the website and was able to login. Instead of being able to make a payment, I was prompted with information that notified me that my account had been sent to collections. I received a notification from the law firm, Nagle and Zaller, P.C., that my account is in collections. I am being charged the following exorbitant fees. ( NOTE : I have not received a response from the law firm, and I am unable to pay the HOA fees online. {$300.00} - HOA fees {$45.00} - Late fees {$2.00} - Interest {$12.00} - Other costs {$300.00} - Legal fees
