Yesterday, XX/XX/XXXX, I received to calls in a row from XXXX and no voicemails. Later that day my sister and brother called me cause they were reached out to by the same phone number. I called the number back and learned it was NAR. I spoke with a girl. She said they are collecting a debt from an emergency room visit in XX/XX/XXXX. This was shocking to me as that was so long ago and I don't remember that at all. I tried asking her questions about it and she was extremely rude and just kept saying that they've been trying to contact me for a long time and even served me in XXXX. I asked for proof of this cause I honestly couldn't remember what this is even about. I asked for a statement and she said they've sent plenty of statements. I have lived at the same house for the last 8 years and so it's not like I've been hard to get a hold of. I just wanted proof that this was my debt. She told me that there is nothing I can do at this point cause it already has a judgement and they are going to start getting my wages garnished. She repeatedly cut me off and said you can either pay it or have it taken out of your check, that I've been given ample notices of this debt, and that it's just incurring XXXX % interest. I understand that being a debt collector wouldn't be an ideal job, but she was extremely rude to me and really thought it was a joke cause I said, if this is mine, I will take care of it I just want to know more about it. She finally said she would email me a statement. She never did. She kept telling me that were seeking a judgement and this was going to a lawyer, then she said they have a judgement already ... it was all over the place. I did call XXXX XXXX XXXX who did verify that I was the patient. They couldn't give me any billing statements or what services were done that day since it was so old. I again reached out to NAR today, XX/XX/XXXX, because I do want to resolve this and to get a statement. I requested to speak with someone different because I did not want to speak with the girl from yesterday. I spoke to a male supervisor. I explained everything from the day before and that I just wanted a statement and to see what we could work out. He started going through his " debt collector script '' and said that they've been reaching out to me numerous times. I asked for specifics cause I've had the same phone number, address, and employer this whole time. I said that I have my phone records to compare with theirs. He said they don't have to give me their phone records or any records they have all the time they have tried to collect. I asked when the last time before yesterday, that they reached out to me. He said numerous times in XXXX. I kept pressing for specifics and he finally said they have tried once a year. I asked when they contacted me in XXXX and he admitted that XX/XX/XXXX was the first time they have tried me since XXXX. I asked what took so long and they said they have thousands of accounts to work. Once they tried me in XXXX I went to the bottom of their workload and sometimes it takes a long time until they work on my case again. I asked for a statement and I finally received one. And all this time interest has continued incurring. The original debt was {$160.00} and is now {$760.00}. I asked if there could take some interest off if I can pay in full and be done. They said no cause either I can pay that or they will get that plus more getting my checks garnished. I am fine paying my debt, but I don't feel like the interest and fees are reasonable at all, especially where they won't send me proof of " all these collection attempts ''. There wasn't anyone else I could talk to as they are pretty rude and condescending at this company. They said I can't dispute anything or work out any deals and my interest is going to keep incurring while I make payments.

This year in XX/XX/XXXX I received a letter by a constable stay a public auction and a writ of execution is to be held in ten days I contacted the court via email it stated : Im contacting you due to a letter I received by a company stating they have a writ of execution to come into the house that I stay at and take any and all items such as appliances, TVs, stereos and other electronics. They state that they had a default judgement for which I was never notified. I was never given a date to any hearing date. I am emailing because I have no other way to contact you and the amount they are claiming to be award is over {$1700.00} and claim continuous 17 % penalty is what they state. I need to contest this as I have never owed the company that is trying to execute a default judgement in such matter. Plus they are stating that they will auction off items at the home, when I dont own anything to begin with. I definitely have never been given a chance to here what they claim and I never notified of any hearing to present anything or question the debt. Im contacting you to request the judgement be dismissed since no court date was ever made by the requester. and I was never served with a court date to be party to such suit. I learned that a default judgment this year during the height of the pandemic against me without ever making initial contact and never gave me the opportunity to dispute the debt.They obtained the default on XX/XX/XXXX XXXXthey claim they served me on XX/XX/2020 the court on XX/XX/2020by XX/XX/XXXX XXXX had a default judgment than on XX/XX/XXXX they apparently got a writ of garnishment and made contact with my employer but I had no idea I was fired on XX/XX/XXXX of 2020 I believe its because of the debt collectors writ of garnishment. I filed for a motion to set aside default judgment that was denied and now they are going to exacted on a warrant to take items the debt collector had never contacted me and has violated the FDCPA laws by never notifying me who they are and giving me 30 days to dispute the debt which I would have as this debt is supposedly from a line of credit my credit union account the company is a for profit debt collector who has no vested interest let alone provided a forged document to obtain and file lawsuit. They never even contacted me and or read the mini Miranda. The company is NAR Inc North American recovery and attorney XXXX and XXXX here in Utah According to the credit union they and I are bound to arbitration clause and that they never sell, assign, or transfer accounts to third parties. Yet the debt collector obtained the default judgment they never provided anything to prove they had a right to sue but yet they were granted a default judgment when their was never a court date set for me to even be able to answer. Or obligating me to appear before a court. Now what happens since they are extorting me I dont know what to do? They need to be accountable for violating the FDCPA for not giving me thirty days to dispute the debt because their first contact was a law suit and if that counts as their initial contact they had obtained a default on the XXXX th day from their initial contact. People need to be aware that debt collectors who have never made contact can apparently sue you and obtain a judgment and you will get a paper that will not have a court date or a case number but courts say its valid

FCRA 623 ( a ) ( b ) requires debt collector ( North American Recovery ) to accurately report the DOFD ( XXXX ) separately to the CRA ( XXXX ) no later than 90 days after commencing collection efforts. XXXX XXXX XXXX provided North American Recovery with the DOFD per FCRA 623 ( a ) ( 5 ) mandate. FCRA 605 ( c ) was created for XXXX purpose only, to affix a date on the commencement of the delinquency which proceeded the collection, thereby specifically preventing collection agencies from illegally changing and extending the DOFD once the original creditor establishes that date. An accurate DOFD can NEVER be legally changed, especially by a Collection Agency. TEXAS FINANCE CODE. XXXX. ( XXXX ) Prohibits collecting or attempting to collect interest or a charge, fee or an expense incidental to the obligation unless the interest or incidental charge, fee, or expense is expressly authorized by the agreement creating the obligation or legally chargeable to the consumer. North American Recovery failed to timely produce ALL documents requested. A 30-day Notice was submitted on XXXX/XXXX/2016 by Certified Mail Receipt. I contacted a representative with North American Recovery and informed them that I was trying to buy a home and inquired whether they would be interested in a " Pay For Delete Settlement '' and was told no. I asked the representative to verify DOFD and was informed that their records indicate their collection began XXXX and would continue reporting to the credit bureau until XXXX. On XXXX/XXXX/2016 I sent a dispute letter to North American Recovery disputing their implied DOFD and requested verification and to produce documents and all instruments bearing my signature. I also contacted a Manager at XXXX reporting agency. XXXX assured me that although North American Recovery began their reporting on XXXX the DOFD was already established by the original creditor and remains at XXXX and is scheduled for removal on XXXX. On XXXX/XXXX/2016 I called North American Recovery and spoke with XXXX to ask if they would reconsider the " Pay For Delete Settlement '' because I was still trying to purchase a home and my account is scheduled for removal on XXXX. XXXX stated no they would not accept my offer and North American Recovery had extended the DOFD to XXXX. After reviewing my credit report it turns out that North American Recovery has indeed illegally extended the DOFD by two months. On XXXX/XXXX/2016 XXXX began reporting DOFD as XXXX. FCRA 623 ( a ) ( 5 ), FCRA 605 ( c ) and TEXAS FINANCE CODE. XXXX. ( XXXX ) was specifically created to protect consumers from illegal and abusive tactics, unfair and unconscionable means by Collection Agencies and Original Creditors. North American Recovery should be held accountable for violating FCRA and TEXAS FINANCE CODES compliance standards that governs collection activities. Attached is a copy of the Account History provided by North American Recovery, a copy of XXXX reports, and a Certified Mail Receipt copy of my dispute to North American Recovery. I will be seeking immediate deletion of this negative trade as well as a settlement in damages for their illegal practices.

A few years ago my husband and I went through a bankruptcy. After the bankruptcy was dismissed I received 2 bills from NAR requesting payment. I contacted them immediately and let them know they should have been covered in my bankruptcy. They told me to contact my attorney and find out if the debts are owed. I reached out to the attorney which took a while, but he stated that one of the bills they were trying to collect was in fact included in the bankruptcy however the other was not and I needed to make arrangements to pay that one as it was for a date of service a couple days after filing. I again contacted NAR and shared the information I had obtained. They said, " sorry '' for the " mistake '' of trying to collect on the debt that was dismissed and gave me the balance on the other which included several fees and negative credit reporting. I told them that they made the mistake to collect on a discharged debt and I made a mistake by thinking they were both in the bankruptcy however I had contacted right away and disputing those and now trying to make that right. I felt it was fair that they remove the fees and negative credit reporting. I was transferred to several different employees and back again. For at least 3 years now I have called off and on to try to get this debt settled and removed from my credit. Each time I go through their transfer game, get a voicemail that is never returned, and a promise for supervisor review and a call back within 48 hours that is never returned. I sent an email over a year ago regarding the situation and telling them I was going to file a complaint that they continue to report on my credit but on not following through to allow me to properly manage the debt, not returning my calls when I have been told it is noted in the file several times. Same thing, calls and promises of call back with nothing. They never sent me a bill in the mail since the one that raised the question to begin with and have not sent anything since. They just continue to refuse to have their upper management review the file and come to a solution since they obviously made mistakes that violate the debt collection act as well. Now they continue to cause harm by reporting and not returning calls I am making to them. They also at one point did offer me a settlement that took a portion of the fees they have added off but told me they could not put it in writing for me that it would satisfy the debt in full. Another issue since this company apparently can not be trusted to keep their word and not engage in shady collection practice. I would like them to provide me a copy of all of the file notes from representatives from the date that they opened the file. I also have copies available of the bills they sent available upon their request.

Third District Court has issued a Pretrial court date on XX/XX/XXXX at XXXX which I will provide the Judge XXXX the first police report of my home being broken into by criminals after I was threaten to not to go to the police and the second police report in regards of my XXXX accounts being taken over and fraudulent checks deposited and then used by criminal without my knowledge and then asking the bank to do a FRAUD investigation in which XXXX assumed I gave out my password which is FALSE there is just too many issues surrounding this case and NAR inc lack of disclosure to the courts that I am XXXX on XXXX benefits and all my assets are judgement proof. Secondly, NAR inc has withheld information to the courts of fraud stating there was no Fraud so I submitted to the courts copies of all the FORGERY checks put in my name that were documented by their client XXXX. Additionally NAR inc previously ignored my Debt validation letter stating it was frivolous even the though the law states clearly under the FDCPA of my rights to dispute the debt and collection activities must cease regardless if they feel the letter was generic it should have been honored especially considering there was FORGERY CHECKS on file. The verbiage was legal and they willfully ignored the law and pursued collection attempts anyways. Furthermore, they have notified the courts of a false alleged attempt of serving papers when I wasn't even in the state of XXXX after having my life threatened I left and went to XXXX for a period of time for my safety. As of now the Third District court after receiving the copies of FORGERY checks, and the fact I wasn't in XXXX set ASIDE the judgement and issued a court date XX/XX/XXXX at XXXX. Which I intend to explain to the Judge in full detail of the situation and information being withheld including the second police report which I will have in court. NAR inc needs to be investigated by the XXXX attorney general office for its shady and bad collection practices. Per my previous request from help from the XXXX, I filed a complaint against NAR - North American Recovery. They are collecting a debt on behalf of XXXXXXXX XXXX in which they state that they do have a signed consent form allowing XXXX XXXX to transfer my information to this collection agency. They have not provided me with any type of documentation showing that my information was allowed to be shared to NAR. I want confirmation and a copy of the documentation that has my signature or initials showing XXXX XXXX be allowed to share my personal information with NAR. I still to this day do n't know what this debt was for but a place called N.A.R Inc ( I only know this from seeing it on my credit report ) obtained a judgement against me ( only know thos because of my credit report ) for XXXX for what I do n't know??, XXXX XXXX ?? Dont know what position he stands in this. A lawyer, A constable or some guy off the street collect on a debt?? On XXXX XXXX he came with 2 others to my house and help up a paper like he had a warrant. He was even wearing some sort of gold star shaped metal on a long chain like a old sheriffs badge. They pushed their way through the door started grabbing my Tv 's, Computer, VCR anything worth value and putting prices on them. Writing them down as well. They wrote threatening letters to my father stating there was going to be a constable 's sale at my house on XXXX XXXX to sell all my personal belongings and so My father paid them {$1500.00} on XXXX XXXX triple the amount of what the debt of XXXX is on my credit report. My father and Friend recently passed away and I have been helping my mother with finacial records, taxes ect..when Icame across the letter they had sent him I had not seen until now. It pains me to know he paid this because I had told him of them doing a raid for valuables in my house and he was only trying to protect me. Whoever N.A.R is or XXXX XXXX these people never verified the debt, never served me papers and used threats to get my dad to pay 3 times what the judgement was for and to top it off Its still on my credit as a judgement against me paid leaves out the fact he overpaid. Will you please help me find out what this debt was for and can they do that act like police take my stuff then advertise there is going to be a constables sale on paper to the public. I tried to call the number and went by the address on this letter but they do n't exist at least not anymore. In XX/XX/XXXX, I noticed that my credit score had dropped dramatically due to a derogatory mark from North American Recovery for an account balance of {$730.00}. The debt was from the XXXX XXXX XXXX ( XXXX Hospital ). On XX/XX/XXXX, I submitted a dispute with XXXX because the account was not mine. The dispute resolution did not take the derogatory mark off my credit report as the the collection agency insisted the debt was mine, but they did not provide me any proof of debt. The balance continued to climb and pulled my credit score even lower. On XX/XX/XXXX I visited the original creditor to try and obtain more information about this account. XXXX Hospital said that they had no record of me ever being seen or treated at their facility. On XX/XX/XXXX, I called North American Recovery to try and resolve this. The first person I spoke with, a woman, said they could n't find any information based on the date of birth or social security and that I had to call XXXX to obtain the account number. I called XXXX and they were able to provide me with the account number and helped me file a second dispute. I called North American Recovery again. This time I spoke with a man who kept repeating that this call would be recorded. I gave him the account number and he said it belonged to someone with a birth year of XX/XX/XXXX. I am XXXX years old, I was born in XX/XX/XXXX. The address also did not match. He stated that the original creditor did not have to keep medical records because they had been transferred to them. I requested that he send me all the information that they had on file for proof of debt and provided them my current address. He proceeded to ask my place of employment and best contact number. I did not disclose my employer because I did not feel comfortable releasing that information. He stated that they could only hold the account until the end of the month at which point they would file a lawsuit against me. I am currently waiting for the file they are going to send me and for the results of the second dispute.

I have been the only point of contact that I have had with this company. ( Meaning, I call them, they never call me. ) My phone number has been the same for years. I have called them in in past and asked for documentation of accounts or funds owed. They have sent me paperwork to my corrected address in the past. I have been for the last three months trying to pay this debit which has been on my credit bureau reporting for years. It has always remained the same. When I attempt to pay, they change the balance that I owe. I finally was able to get someone to explain this to me. They are attempting to charge legal fees for doing nothing on a legal level. There has been not one letter from an attorney, there has been no legal filing with the court. I have called multiple times and attempted to pay, they continue to tell me that I over over XXXX for a balance reported at XXXX telling me that it will not be a balance paid in full. One time I called and spoke with a very rude XXXX in XXXX, who has falsified her documents to state that I have confirmed my address to the wrong apt number. I have not lived in apt XXXX XXXX in years. I have also informed EVERY creditor that the new Apt XXXX is XXXX for mailing purposes and I will be sure to receive my mail. At that time XXXX refused to inform me of what the additional debit is from. Once off the phone with her, the very next day she had it reported to the credit bureau at the XXXX plus balance. I disputed it, when it was replaced back on my report, it was put back to the XXXX balance. This proves they have not done a legal process and can not charge me for their invalid and bogus legal fees. I have been paying off accounts with them for the last year. They are aware that I am in Apt # XXXX for mailing purposes. Point is, I have attempted to pay this debit in full per the amount that shows on my credit report. they are refusing to mark it as a balance in full.

This debt is not mine and has previously been removed from my XXXX Credit report. This company " North American Recovery '' continues to keep putting this collection account on my credit reports even after the have failed to provide proof this account belongs to me. In fact they have deleted the collection account on my XXXX credit report then they resubmitted it on my XXXX credit report. I disputed it on XXXX credit report, but XXXX stated it was verified by North American Recovery but XXXX companies have failed to show how it was verified and refuse to show proof this disputed account belongs to me after several attempts of requesting the information. These companies need to be held accountable for their false reporting of collection accounts. I am requesting North American Recovery provide proof this collection account is valid and belongs to me. This dept shown more than once on credit report and does not show last payment date making very old collection look new. This account shows as XXXX this was dated back in XXXX. This was a voluntary repossession which was charged off in XXXX by old loan holder. They received their vehicles back sold at auction, marked as charge off, then still show as balance owed. This is causing me a huge hardship and holding me back from furthering myself in life. They have never provided documents to prove this dept is mine. I feel as though if this was an account of theirs they should have something to prove so I can confirm if this is valid or not. This is reporting on my credit report two times all with balance owed. I have tried many times to try and get answers/ resolve this with no help. I have also hired a credit repair company who disputed twice with no response in time and they still refuse to remove. When the credit repair company started the process this was on my report more than twice with different account numbers all with the same balance amount so this has been falsified many times by them. This dept is approaching the time to be deleted and as a courtesy I would like to request they delete this early for the hardship this has caused me with the falsified information. XXXX and I have grown up worked hard to build our credit and have tried to over come this since we were very young and couldn't afford much back then and just want this cleared and marked correctly. XX/XX/17 I received a phone call from my ex wife that a number, XXXX, has called several times but the women will not give her name what company she works for or what the call is about, she only claims she has business with me ( XXXX XXXX ) that is most urgent or else if she doesn't get in touch with me. When I called the number the person refused time and time again not give her name or company or what the call was even about, she just keep badgering me on my Name address, SS # etc and would divulge nothing till I did so. The company turned out to be NAR inc and the womans name is XXXX XXXX, once I was finally able to get what the call was about regarding a medical debt I had been paying out while waiting for insurance to verify if they had paid all they would I simply asked for a itemized bill and if the numbers matched I would pay the debt immediately. I did not get an itemized bill all I received was a one page letter saying the debt was verified. It also had 2 amounts one for {$42.00} ( the actual Debt ) plus a 40 % collection fee of {$16.00}. I have paid the full amount including the fee, however she called my ex wife several times after I said don't due to issues with her being my exwife and to be honest she has gone back to her maiden name so not sure how they got that number at all. I asked her several times not to call her and she did anyway. I also think the collection fee is unfair it isn't interest its obviously a fee they just decided to add for no good reason. I also have asked once again for an itemized bill so I can match it against the insurance payments but they refuse.

NAR INC, has been informed there is a pending police investigation for my second police report filed with XXXX here in XXXX XXXX XXXX Utah. However, knowing this knowledge they have received an affidavit with this information including a police report detailing my house had been broken into which my personal information and cards were compromised, I informed NAR, INC. again several times over the phone the XXXX police detective told me to file the police report after all credit cards and bank accounts involved had finished their fraud investigation to file one full police report and then submit it to the XXXX police department. NAR, INC regardless of knowing this information are now attempting to serve papers anyways for litigation for a debt that was a result of identity theft and fraud. These legal action are prohibited under the FCRA and FDCPA considering the account they are seeking attempt to collect on was involved in identity theft, scam, and fraud. The bank which they claim the debt from XXXX failed to do a proper legal Fraud investigation, they assumed I gave out my information and took no step to do a fraud investigation. I informed the police department that the bank XXXX didn't do a fraud investigation and they informed me to continue the procedures of waiting out for all credit cards and bank accounts to complete their fraud investigation still. NAR, INC is willingly in violation of my FRAUD VICTIM Bill of RIGHTS and pursing the debt anyways. I am seeking the CFPB to get involved in this matter again. I would like to dispute the enclosed collection notice from XXXX XXXX, XXXX ( XXXX XXXX XXXX XXXX in the amount of {$3600.00}. I called XXXX back XXXX minutes later to tell him we would not be renting the boat and equipment because our group thought it was too expensive. At that point, I received an immediate email saying the money is due and my credit card would be charged. He went on to say that I couldnt cancel and the website should have made that clear. I was never pointed to a website to read the fine-print they claimed would be non-refundable. Regardless, I never signed a contract and I never received services for anything. I could understand this more if I had cancelled the day before but this was 10 days prior and I cancelled my reservation XXXX minutes after he said he was just going to place a hold on it. I had a debt owed in the amount of {$1500.00}. I contacted the Debt Collector, North American Recovery, to begin the repayment process. I paid {$400.00} immediately, and entered into a payment plan to pay the remainder ( roughly {$32.00} every 2 weeks ). I received a document indicating that roughly {$860.00} had been paid or credited to my account, which seemed to me that the company matched my initial payment with a credit. However, they indicated that I still owed roughly {$1100.00}. I have contacted them at least 3 times regarding this discrepancy, and I have continued making payments during that time. On one occasion I was told that my concern was escalated and that I would be contacted by a supervisor ( I was not, despite providing my contact info ), on the second I was told to email XXXX with the statement I was sent as well as any other relevant details. My third attempt to resolve this involved me emailing the above referenced email on XX/XX/22, and I was told by my representative over the phone that I would hear back within 2 weeks. The automatic reply email I received indicated I would hear back within 30 days. I was never contacted during the 2-week period after the phone call. The 30 day period passed, and I still had not been contacted. I followed up via phone and was not provided any additional information. Per the company 's own communication, I should owe {$400.00} less than what they currently declare my remaining balance is. I have given them ample opportunity to respond, and made a good faith effort to address this issue, and it still has not been resolved.

I was taken to the emergency room of the XXXX XXXX XXXX on Friday, XX/XX/XXXX, after sustaining a serious injury from a XXXX XXXX. I submitted my insurance information and my dad helped pay off the {$220.00} remaining after insurance paid the rest. I assumed it was all taken care of by then. However, I received a phone call from North American Recovery on XX/XX/XXXX saying that I owed a debt of {$460.00} on that same bill. I called back a week later after confirming that North American Recovery was a legitimate agency and not a scam, and I told them that as far as I knew, the bill had been paid in full. I attempted to contact the XXXX XXXX XXXX to ask about the debt, but I did not receive any response. On XX/XX/XXXX, I sent an image of the receipt, and I received a response on XX/XX/XXXX that my dispute was not legitimate. I later discovered that this debt was to pay the XXXX doctor, which was different from anything that had been paid already. However, I did not receive any notice, written or oral, about this bill until XX/XX/XXXX, and it was added to my credit account on XX/XX/XXXX ( before I got notification that it was a legitimate bill and had not yet been paid ). I do not feel I was given enough notice that this bill existed. I did not receive any communication from the hospital that I had any outstanding debt, and furthermore, I do not feel like I was given adequate time to confirm the legitimacy of the debt after it was sent to collections.

Was initially contacted my a debt collector to collect a sum of money over {$9.00} for repairs to an apartment I used to live at. I vacated this apartment over XXXX year ago and my ex wife was the one remaining there. After move out in XX/XX/2021 I we were told we would be contacted with the final amount owed which never happened. I contacted the landlord about my security deposit and was told I would be called back. Missing the call back they left a voicemail stating the only amount I owed to them after move out was around {$500.00} for pro rated rent which was taken out of my security deposit along with a small repair. I didnt think much of it until XXXX years later I get a call from a collections agency saying I owe over XXXX for initially what was a flooding repair. I stated I have email proof emailing for maintenance to come out to fix the problem and each time they came they couldnt find anything wrong. I have disputed this account in which NAR is reporting on my credit report. This account does not belong to me. I never opened this account. I disputed this account as well with all three credit bureaus. I requested that they validate this account and verify it, I was sent back information saying the account was verified and updated. A medical debt was obtained by N.A.R. North American Recovery from XXXX XXXX XXXX XXXX Hospital and was billed to myself on XX/XX/XXXX for the amount of {$530.00}. In XXXX I forgot to update a reoccurring payment with XXXX XXXXXXXX Credit Card. I was unable to access the account for several months because of their office hours. In XXXX I again attempted to settle the debt that was sent to collections. It was sent to to North American Recovery for collection. I worked with their representative to pay the debt over the phone. They collected my payment information but apparently never processed the payment. In the meantime I thought the debt was paid in full. 4 months later upon trying to apply for credit the debt showed it was still in default. I contacted the original creditor XXXX XXXX who said the collection was with still with NAR. I contacted NAR, whom told me the account was with XXXX XXXX XXXX their Attorney. The Attorneys told me the account was sent back to NAR. For 10 days I was unable to pay the debt because no one could tell me whom to pay. Eventually, NAR accepted my payment but refused to send me a paid a in full letter. XXXX XXXX has still refused to send me a paid in full letter 14 days after payment. There has been no communication to help settle this matter which is affecting my financial situation. It should not take a consumer 5 months to settle a debt they claim and want to pay off. The original creditor, XXXX XXXX apartments has claimed that I never paid the amount of {$2800.00} to break my lease. It was documented the payment was received between the dates of XXXX XXXX XXXX The leasing agent at the time also had me sign documents stating that I was breaking my lease early, months prior but failed to keep them on file. In XXXX I put another notice in the drop box at the XXXX XXXX office, and i moved out in XXXX. Few months later i called them to claim my deposit and was told they could not find my notice. I then went there to follow up and the manager repeated the same thing saying my notice could not be found, few seconds later, after she took time look again, she said she remembered seeing before but it was a late notice, and so she could not refund any deposit, they would keep it until I pay one more month or she would deduct that from the one month rent that was due. I told her that was not right, she could charge me because my notice could not be found, and left. Months later i started getting bills after bills urging to pay otherwise it would be sent to collection. A month ago I went to visit a banker and was told I have a debt collection on my credit report. XXXX XXXX XXXX and XXXX XXXX has advised that i owe a debt to XXXX XXXX - The Initial Phone Call the agent was extremely rude, condescending and extremely difficult to communicate with has she repeatedly cut me off and over talked me. This debt was a result of an ex boyfriend stealing my credit card and using it, i did not know about the debt - once i was made aware i paid it in full in XX/XX/2018. I contacted XXXX XXXX and they transferred me to the XXXX XXXX - XXXX XXXX to pay the account in full. I did so, i have a paid in full letter. The collection company had sued me for a car repossessed that I co-signed. They originally were asking an amount of {$10000.00} which was what the bank claimed they had in lost after they repossessed the car. After going back and forth on the how much the car was truly worth, the collection company made me an offer to lower that amount to {$5700.00}, which I ended up accepting since I didn't want to spend money on a lawyer or anything. So the final settlement is set at {$5700.00} to repay {$130.00} per month which was signed by the court from the XXXX Judicial District, XXXX XXXX County ( shown on the attached file ). since then I have made two payments which doesn't show on my credit record. I have communicated with the company ( N.A.R. Inc ) via mail to indicate that the collection does not belong to me. The company they are representing I have never had any affiliation with meaning the debt does not belong to me. It has been placed on my and my wife 's credit reports and I want it removed. I have a copy of the letter that I sent with details of my situation as well as dates when I have attempted to call them without any reprise. Inc. has in fact called me a couple of times today, within a 4 minute timeframe, I got a call from my mother stating that I needed to call her back because she received a call from XXXX directly after her attempt to call me. XXXX XXXX would not say who she worked for ... she did not tell my mother that she was a debt collector ... she did not say that this was an attempt to collect a debt. She gave my mother my personal information, including what phone number they had listed for me, and which address. She started the call by saying that she knew me, and that she was trying to get ahold of me. She said, I have the phone number ***-***-**** for her, is that correct? Also the address. Then proceeded to drill her for information on where I am currently working. She also said that she had left me a couple of messages when she in fact has not. This debt is not mine and has previously been removed from my XXXX Credit report. This company " North American Recovery '' continues to keep putting this collection account on my credit reports even after they have failed to provide proof this account belongs to me. In fact they have deleted the collection account on my XXXX credit report then they resubmitted it on my XXXX credit report. XX/XX/XXXX, XXXX XXXX XXXX from North American Recovery was contacted. First of all, she was rude, but I guess that is expected. She stated the amount owed was XXXX. XXXX also stated there is no interest being charged to the account. Which is great, however, the ending balance for this account was XXXX. There also seems to be interest added of XXXX. I told her that we have not gotten any correspondence since 2016. She said that is not a problem that she can send us the new information via mail or email. I asked for both. I never got an email from her and I am still waiting on the information in the mail. XX/XX/XXXX, XXXX XXXX from North American Recovery was contacted. She was also rude. She also stated that a settlement can not be reached due to company policy. I asked her about why we are getting interest of XXXX when no interest is being charged on the account? Hello, Upon review of my credit file with XXXX and XXXX I noticed XXXX collection accounts from N.A.R. ( North American Recovery ). I had no idea who this company was or the money stated I owe. I filed A dispute with XXXX and XXXX for validation. I also sent A Certified letter directly to N.A.R. requesting validation/verification of debt. In return N.A.R. sent me a statement from their own company not from the original creditor. I have no knowledge of any account with XXXX XXXX XXXX ( original creditor ). In XXXX of XXXX I did a credit check and seen that this was on my credit so I called NAR thinking this was my fianc bill found out it was for my son. A few months after my visit to XXXX XXXX XXXX XXXX I got a bill which I paid, but then 11 month after my visit I got an alert on my credit report. I had a collection from " XXXX XXXX XXXX '', a collection agency and the original creditor was " XXXX XXXX XXXX XXXX XXXX ''. After many calls I discovered that XXXX is the billing agency for the doctors at XXXX XXXX XXXX XXXX, and that they never filed a claim with my insurance. I have a collection on credit with XXXX XXXX that I have been trying to settle and satisfy. Through my research, XXXX XXXX does do settlements with their customers. In speaking to XXXX XXXX, they have a 3rd party, NAR or North American Recovery handling their collection of this account. When calling NAR, they state that they do not own this debt and are collecting on behalf of XXXX XXXX. I tried to settle this account out with them and they are stating that they do not do settlement agreements. I find this to be against XXXX XXXX 's practices and as a violation of the FCRA collection rules. I received a letter in the mail today from a bankruptcy office stating that a company named NAR INC. was awarded a judgment against me on XXXX/XXXX/2015. This is the first Ive heard of it. Previously, I had tried to work out a payment plan with NAR, INC ( North American Recovery ), but they would not accept anything lower than {$50.00} per month. I failed to pay them the XXXX payment due to the fact I could n't afford this payment, now 1 month later they were awarded a judgement? They would not accept the {$25.00} a month payment I offered them. Then I never heard from them again. Now I 'm getting a notice from a bankruptcy lawyer wanting my business. I had a health provider who filed a claim with my insurance company, who in return paid for a percentage of the original bill. The Explanation of Benefits from my Health insurance company showed that I was covered 100 % for the bill, and that I did not owe any amount to the provider. However, the health provider still sent me a bill for the balance of the original total, less the amount paid by the insurance company. The Health provider subsequently sent the debt to a collection agency, who immediately reported it to the credit agencies, XXXX XXXX and XXXX. I have since written letters to both the Health provider and the collection company explaining to them why I do not owe any amount for this bill, and provided them with a copy of my EOB from the insurance company. XXXX XXXX XXXX quoted us ( homeowners ) up to {$1200.00} for complete water remediation AND repairs to our property. Nothing was signed by us but we agreed to pay a {$600.00} deposit to start. Over the past two weeks, I have received over 50 calls from this number XXXX. When I pick up the phone, the call is IMMEDIATELY disconnected. I started ignoring their calls, however they continue to leave voicemails that are one second of silence. I had no idea who they were or why they were calling me. When I attempt to call them back, I am placed on hold for 20 minutes and was never connected to a person, the line went dead. I disputed this account XXXX times with the creditor NAR INC and also specifically requested for validation from the creditor to provide me validation of the account. NOTIFIED NAR over the phone I I would be sending first an affadavit letter by certified mail with RETURN receipt and then a followup letter including my police report to show the XXXX account was closed due to fraud. Under federal law I am within my rights to exercise my FCRA and FDCPA rights under the section of the federal Bill of rights and fraud rights of Identity theft under federal law. The collection company NAr ( north American recovery ) never provided me with the documentation on the Medical bill they were collecting for. I sent a letter with Texas State guidelines for debt validation and received no response. Hello, I have made several phone calls to this agency and I have written and mailed certified/notorized letters regarding this debt with no relief. They did not use abusive language. The problem is they called me looking for someone else. They ask me if I knew the person and i never responded. The person XXXX ( unknown spelling ) proceeded to tell me their clients personal information in an attempt to gather more info.
