NOTICE TO PRINCIPAL IS NOTICE TO AGENT NOTICE TO AGENT IS NOTICE TO PRINCIPAL No proof of original contract and signature, no valid debt verification, no evidence of itemized billing, and no proof of authority to collect debt in the state of North Carolina has been received after mailed requests. Upon reasonable public investigation none can be found in the XXXX and XXXX public registry databases for authorized debt collectors in North Carolina. Copies of the database entries and searches are attached. Mountain Run Solutions , LLC self misrepresents to me a consumer in their collection debt activities at my dwelling in North Carolina as a known authorized debt collector in the state of North Carolina and fraudulently reports to consumer reporting agencies. The unlawful collection of debt by U.S. Mail is prohibited by the Racketeer Influenced and Corrupt Organization Act. Upon information and observed actions by Mountain Run Solutions , LLC established a pattern of racketeering activity by using the U.S. Mail more than twice to collect an unlawful debt and the debt collector may be in violation of 18 U.S.C. 1341, 1343, 1961 and 1962. No evidence or rebuttal Mountain Run Solutions , LLC did not fraudulently defy indemnity and embezzle and usuriously collect on two sources has been provided : Social Security Cestui Que Trust Funds, and Payment demands using the U.S.P.S. Mail System. Mountain Run Solutions , LLC has not met the requirements mandated in the Fair Debt Collection Practices Act ( FDCPA ) or the North Carolina Collection Agency Act and the North Carolina Debt Collection Act, necessary to be a legal debt collector in this state. The FDCPA or the North Carolina Collection Agency Act and the North Carolina Debt Collection Act mandates Mountain Run Solutions , LLC have a license to be a debt collector, a bond, and they must be registered with the Attorney General in the State in which they are collecting. In this instance it would be the North Carolina Attorney General with authority over the debt collection activities in the state of North Carolina. Upon information and the observed actions by Mountain Run Solutions , LLC ; the debt collector is in violation of the FDCPA, they do not meet the legal requirements to be considered a debt collector and therefore have no standing before any court with unclean hands. Moreover, the Federal Law mandates any debt collection company attempting to collect debt within the State of North Carolina, must be bonded and licensed to do so. Failure of the Corporation to maintain active surety bond, warrants grounds for immediate ceasing of collection activities and reporting to major credit bureaus. The evidence of lacking registration in the State of North Carolina from the NMLS Consumer Access database, is attached with active debt collection activities in North Carolina. A third party collection agency that violates any provision of the FDCPA, NCDCPA, and North Carolina Debt Collection Act, is liable to civil and criminal penalties which may include monetary compensation to the victim. The debt collector company can not at any point engage in abuse, threats, coercion, misrepresentation, fraud, harassment, unfair means, and deception to collect debt. Mountain Run Solutions , LLC misrepresents who the original creditor is and the amount with the alleged finance charges collected. The original creditor is XXXX XXXX XXXXXXXX XXXX social security trust account the with the extension of consumer credit in thie transaction with the Social Security credit card with # XXXX. The extension of credit always begins with a indorsment or signature of the maker. Proceeding without full disclosure to the maker and consumer is fraud-in-the-factumn and a misrepresentation. The account is Paid-in-Full the instant credit was extended and recognized as a deposited cash equivalent. U.S. Code Title 12 U.S.C. 1813 ( l ) Deposit The term deposit means ( 1 ) the unpaid balance of money or its equivalent received or held by a bank or savings association in the usual course of business and for which it has given or is obligated to give credit, either conditionally or unconditionally, to a commercial, checking, savings, time, or thrift account, or which is evidenced by its certificate of deposit, thrift certificate, investment certificate, certificate of indebtedness, or other similar name, or a check or draft drawn against a deposit account and certified by the bank or savings association, or a letter of credit or a travelers check on which the bank or savings association is primarily liable : Provided, That, without limiting the generality of the term money or its equivalent, any such account or instrument must be regarded as evidencing the receipt of the equivalent of money when credited or issued in exchange for checks or drafts or for a promissory note upon which the person obtaining any such credit or instrument is primarily or secondarily liable, or for a charge against a deposit account, or in settlement of checks, drafts, or other instruments forwarded to such bank or savings association for collection. ( 2 ) trust funds as defined in this chapter received or held by such bank or savings association, whether held in the trust department or held or deposited in any other department of such bank or savings association. ( 3 ) money received or held by a bank or savings association, or the credit given for money or its equivalent received or held by a bank or savings association, in the usual course of business for a special or specific purpose, regardless of the legal relationship thereby established, including without being limited to, escrow funds, funds held as security for an obligation due to the bank or savings association or others ( including funds held as dealers reserves ) or for securities loaned by the bank or savings association, funds deposited by a debtor to meet maturing obligations, funds deposited as advance payment on subscriptions to United States Government securities, funds held for distribution or purchase of securities, funds held to meet its acceptances or letters of credit, and withheld taxes : Provided, That there shall not be included funds which are received by the bank or savings association for immediate application to the reduction of an indebtedness to the receiving bank or savings association, or under condition that the receipt thereof immediately reduces or extinguishes such an indebtedness. In U.S. Code Title 15 Section 1602 ( l ) The term credit card means any card, plate, coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. The aformentioned acts in general are a violation Federal and State of North Carolina Unfair and Deceptive Tade practices Act which applies to anyone misrepresenting as original creditor, Section 5 of the FTC Act and Dodd-Frank applies to general prohibition in absence of FDCPA coverage stating that even if the FDCPA doesnt apply, your collection activities are still covered by Section 5 of the FTC Acts general prohibition against deceptive or unfair practices .... [ T ] he FTC has taken action under Section 5 when first-party creditors engage in other practices expressly prohibited by the FDCPA. In 2013, the Cosumer Financial Protection Bureau issued Compliance Bulletin 2013-07 attached as evidence, clearly laid out its position : [ a ] lthough the FDCPA definition of debt collector does not include some persons who collect consumer debt, all covered persons and service providers must refrain from committing unfair, deceptive, or abusive acts or practices ( collectively, UDAAPs ) in violation of the Dodd-Frank Act. In this state, the North Carolina Fair Debt Collection Practices Act applies to original creditors collecting their debt. 15 U.S. Code 1611- Whoever willfully and knowingly ( 1 ) gives false or inaccurate information or fails to provide information which he is required to disclose under the provisions of this subchapter or any regulation issued thereunder, ( 2 ) uses any chart or table authorized by the Bureau under section 1606 of this title in such a manner as to consistently understate the annual percentage rate determined under section 1606 ( a ) ( 1 ) ( A ) of this title, or ( 3 ) otherwise fails to comply with any requirement imposed under this subchapter, shall be fined not more than {$5000.00} or imprisoned not more than one year, or both. XXXX XXXX Regarding Colection Agency : Mountain Runs Solutions Regarding Account number owned by XXXX XXXX in the amount of {$1200.00} I have no account with Mountain Run Solutions and have never done business with them. I requested Mountain Run Solutions to provide a contract and verification Validation ( not verify, not confirmation ) of the debt being bouhgt from " Vivent i.e. a contract between myself XXXX XXXX & Mountain Run Solutions ( specific proof ) that I did business with specifically Mountain Run Solutions on a written contract that would validate this debt. Instead they provided a letter with stating This letter is to confirm that the above referenced account has been purchased ( From XXXX ) by Mountain Run Solutions in XX/XX/XXXX using XXXX letter head is misleading to the credit bureaus and CFPB. XXXX no longer owns this debt nor is trying to collectthe debt and a collection agency Mountain Run Solutions owns the debt now. I have never done business with Mountain Run Solutions regarding the account # XXXX in the amount of {$370.00}. By using the confirmation that they bought the debt they are misleading FTC, Credit Bureaus and themselves. Mountain Run Solutions Also failed to give me a response within 30 days as the laws state below. You failed to provide proof that I did business with you. I am reporting this account fraudulently. I do not have a contract between mountain Run Solutions and myself that states that I owe mountain Run Solutions any debt, and XXXX no longer is an involved party. I was provided with a contract between myself and XXXX but not a valid contract between myself and Mountain Run Solutions. The Fair Debt Collection Practices Act ( FDCPA ) is a federal law that prohibits debt collectors from using practices that are abusive or deceptive. Mountain Run Solutions has also created a fraudulent agreement on a payment arrangement in which I have never agreed to. I have never agreed to any payment arrangements, I have never spoken to them on the phone. I keep getting harassing phone calls where they try to ask my information. I am afraid. This is clear and evident fraud. The Fair Debt Collection Practices Act ( FDCPA ) 809. Communication in connection with debt collection ( a ) Communication with the consumer generally Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt -- ( 1 ) at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after XXXX XXXX antemeridian and before XXXX XXXX postmeridian, local time at the consumer 's location ; ( 2 ) if the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney 's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer; or ( 3 ) at the consumer 's place of employment if the debt collector knows or has reason to know that the consumer 's employer prohibits the consumer from receiving such communication. 808. Unfair practices A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. ( 2 ) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector 's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit. ( 3 ) The solicitation by a debt collector of any postdated check or other postdated payment instrument for the purpose of threatening or instituting criminal prosecution. ( 4 ) Depositing or threatening to deposit any postdated check or other postdated payment instrument prior to the date on such check or instrument. ( 5 ) Causing charges to be made to any person for communications by concealment of the true purpose of the communication. Such charges include, but are not limited to, collect telephone calls and telegram fees. ( 6 ) Taking or threatening to take any nonjudicial action to effect dispossession or disablement of property if -- ( A ) there is no present right to possession of the property claimed as collateral through an enforceable security interest ; ( B ) there is no present intention to take possession of the property ; or ( C ) the property is exempt by law from such dispossession or disablement. ( 7 ) Communicating with a consumer regarding a debt by post card. ( 8 ) Using any language or symbol, other than the debt collector 's address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business. 15 USC 1692g 812. Furnishing certain deceptive forms ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. ( b ) Any person who violates this section shall be liable to the same extent and in the same manner as a debt collector is liable under section 1692k of this title for failure to comply with a provision of this subchapter. 15 USC 1692k 813. Civil liability 814. Administrative enforcement ( a ) Federal Trade Commission The Federal Trade Commission shall be authorized to enforce compliance with this subchapter, except to the extent that enforcement of the requirements imposed under this subchapter is specifically committed to another Government agency under any of paragraphs ( 1 ) through ( 5 ) of subsection ( b ), subject to subtitle B of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5511 et seq. ]. For purpose of the exercise by the Federal Trade Commission of its functions and powers under the Federal Trade Commission Act ( 15 U.S.C. 41 et seq. ), a violation of this subchapter shall be deemed an unfair or deceptive act or practice in violation of that Act. All of the functions and powers of the Federal Trade Commission under the Federal Trade Commission Act are available to the Federal Trade Commission to enforce compliance by any person with this subchapter, irrespective of whether that person is engaged in commerce or meets any other jurisdictional tests under the Federal Trade Commission Act, including the power to enforce the provisions of this subchapter, in the same manner as if the violation had been a violation of a Federal Trade Commission trade regulation rule.

Mountain Run Solutions LLC has never mailed me or notified me with any correspondence in the mail pertaining to this alleged debt. I have been receiving text messages stating I owe an alleged debt. Numerous disputes have been sent and ignored. There is no such alleged debt or valid agreement with Mountain Run Solutions LLC. An Alleged Debt has been purchased illegally and without a true and proper transaction between myself, any original creditor or any other company whatsoever. Mountain Run Solutions LLC has an alleged debt account with no proof of claim, true bill or documentation evidence to support such alleged debt collections. Mountain Run Solutions LLC has violated my rights, committed identity fraud, has obtained my information illegally without my consent and has trespassed on my property/information without properly paying me. Mountain Run Solutions is not registered in Texas to collect any types of debts. Each violation is {$1000.00} per violation. 15 U.S. Code 1692c - Communication in connection with debt collection ( a ) Communication with the consumer generally Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt ( I have never authorized Mountain Run Solutions LLC to communicate with me in any form of way. ) ( c ) Ceasing communication If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except ( 1 ) to advise the consumer that the debt collectors further efforts are being terminated ; ( 2 ) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or ( 3 ) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy. If such notice from the consumer is made by mail, notification shall be complete upon receipt. ( Notice of Cease and Desist has been sent to Mountain Run Solutions and has been ignored. ) 15 U.S. Code 1692g. ( 3 ) The false representation or implication that any individual is an attorney or that any communication is from an attorney. ( 4 ) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action. ( 5 ) The threat to take any action that can not legally be taken or that is not intended to be taken. ( 6 ) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to ( A ) lose any claim or defense to payment of the debt; or ( B ) become subject to any practice prohibited by this subchapter. ( 7 ) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer. ( 8 ) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed. ( 9 ) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval. ( 10 ) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer. ( 11 ) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action. ( 12 ) The false representation or implication that accounts have been turned over to innocent purchasers for value. ( 13 ) The false representation or implication that documents are legal process. ( 15 ) The false representation or implication that documents are not legal process forms or do not require action by the consumer. ( 16 ) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 1681a ( f ) of this title.

In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o'clock antemeridian and before 9 o'clock postmeridian, local time at the consumer 's location ; ( 2 ) if the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney 's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer; or ( 3 ) at the consumer 's place of employment if the debt collector knows or has reason to know that the consumer 's employer prohibits the consumer from receiving such communication. 808. Unfair practices A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. ( 2 ) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector 's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit. ( 3 ) The solicitation by a debt collector of any postdated check or other postdated payment instrument for the purpose of threatening or instituting criminal prosecution. ( 4 ) Depositing or threatening to deposit any postdated check or other postdated payment instrument prior to the date on such check or instrument. ( 5 ) Causing charges to be made to any person for communications by concealment of the true purpose of the communication. Such charges include, but are not limited to, collect telephone calls and telegram fees. ( 6 ) Taking or threatening to take any nonjudicial action to effect dispossession or disablement of property if -- ( A ) there is no present right to possession of the property claimed as collateral through an enforceable security interest ; ( B ) there is no present intention to take possession of the property ; or ( C ) the property is exempt by law from such dispossession or disablement. ( 7 ) Communicating with a consumer regarding a debt by post card. ( 8 ) Using any language or symbol, other than the debt collector 's address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business. 15 USC 1692g 812. Furnishing certain deceptive forms ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. ( b ) Any person who violates this section shall be liable to the same extent and in the same manner as a debt collector is liable under section 1692k of this title for failure to comply with a provision of this subchapter. 15 USC 1692k 813. Civil liability 814. Administrative enforcement ( a ) Federal Trade Commission The Federal Trade Commission shall be authorized to enforce compliance with this subchapter, except to the extent that enforcement of the requirements imposed under this subchapter is specifically committed to another Government agency under any of paragraphs ( 1 ) through ( 5 ) of subsection ( b ), subject to subtitle B of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5511 et seq. ]. I have a bankruptcy on my record that was filed in XXXX of XXXX and discharged in XXXX of XXXX. I have been patiently and diligently working on rebuilding my credit since then. In XXXX of XXXX I received an alert from a credit monitoring service notifying me of a new collections account that had reduced my credit rating. The amount owed was reported as {$120.00} and the Date account opened was reported as XX/XX/XXXX. I called the collection agency - Mountain Run Solutions - and their representative told me that the amount past due was for an alarm monitoring service from a home that I havent owned since XXXX. I asked for proof of the debt, and received a a contract for monitoring dated XXXX of XXXX, for a term of 39 months. The monthly payment was listed as {$44.00} per month. Further, after 39 months the account was to automatically renew on a month-by-month basis, and the service was permitted to increase the amount due by 5 % annually. A 30-day written notice was required for cancellation of service. The contract included the account number and routing number for my bank account ( which was my primary account until XXXX of XXXX ) alongside the option for autopay, which was selected. The contract further states that it may be cancelled in writing with 30 days prior notice. There is also a Limitation of Action clause which reads as follows : Both parties agree that no action that relates in any way to this agreement ( whether by Contract, Negligence, or Otherwise ) shall be brought against the other more than one ( 1 ) year after the accrual of the cause of action therefrom. The demand for payment was accompanied by an unsigned statement from XXXX - the original account holder - that the account was sold in XXXX of XXXX to Mountain Run Solutions. There was no reference to a past due amount or any prior past due status. An additional letter from Mountain Run Solutions confirms that the original cancellation request was received on XX/XX/XXXX. I initially forwarded the collection effort to my Bankruptcy Attorney, who had us send a letter stating that the supposed bill was included in my bankruptcy, and they were not to proceed with any further collection attempts. At the end of XXXX, Mountain Run made an update to all of the CRAs. The account status was listed as current, the account opened date was still reported as XX/XX/XXXX, and the collection account was still appearing as a derogatory collections account on my credit, and is listed as an item responsible for reducing my credit score. On XX/XX/XXXX I called the agency to request that - as a matter of goodwill- they deleted the item from my credit report. I explained that my medical bills from a near-fatal accident earlier this year were extremely high, and that I had hoped to apply for a loan in order to pay them quickly. The supervisor I spoke to claimed that they never remove a collection account from credit report ( Because, then you would have perfect credit, and you filed bankruptcy because you didnt have money to pay ). She refused to change the date that the account was opened. She stated that she could not, by law, touch the account after I sent them the bankruptcy information. When I explained that I had yet to receive proof that I owed anything - no past due invoices or itemized bills - she reported that Mountain Run Solutions did have proof. I requested that this new proof be sent, and she refused - again stating that she would be breaking the law if she sent me the document. The supervisor then told me that if I wanted the collection removed from my credit reports that I needed to pay the bill. She confirmed the amount of the bill as {$120.00}. This collection attempt also seems to have been timed to have been executed almost exactly 5 years after my cancellation letter and what would have been my final autopay in XXXX of that year. Conveniently, banks are not required to retain bank statements after 5 years - which would make it difficult for me to show proof of payment. I believe that I have been targeted illegally by this company for several reasons : A ) The Automatic Renewal Period was on a month-by-month basis. B ) A 30 day notice of cancellation requirement was met. C ) This means that - in the unlikely events that an Autopay failed to debit, it would not be possible for there to be more than 30 days of Contract that I would have been obligated to pay. D ) The amount of {$120.00} is well over double the amount of automatically deducted from my bank account for my monthly payment for service. E ) The Limitation of Action clause prohibits ANY action towards either party more than one year after the initial cause of action - If the account was sold in XXXX, it was done so illegally. F ) The supervisor I spoke with claimed but refused to send me additional proof of the debt, and if they have said proof outside the original contract they failed to fully comply with my original request for that proof - which they were legally required to do. G XXXX The supervisor attempted to use this falsely reported account to extort me for payment on the account. I made a detailed record of the phone call on XX/XX/XXXX and can provide an verbatim account of the conversation. This agency is committing acts of fraud ( I do not believe for a second that this account was ever in arrears, and if it was the Limitation of Action clause made the sale of the alleged account illegal. They have parked the account on my credit report - illegally reporting the account as having been opened in XXXX of XXXX as leverage so that they can extort a payment that I do not owe from me. They have misreported the amount due and refused to provide alleged proof of debt.

XXXX has/is retaliating against a XXXX person on behalf and aided another company to further harass a XXXX after this XXXX person had problems with services and the refusal of services for XXXX to honor their contract. XXXX wouldn't honor their contract after giving the XXXX person grief and using their XXXX against them to justify not providing service. By not honoring their policies for their neglect, We filed a complaint with the FTC. XXXX continued to provide defective services in light of the complaint so we told them we no longer needed their negligent services and stopped services in XXXX since XXXX wouldnt honor its own contract by providing services that were not however still seeking payment for their breach of contract and failing to provide goods and services to a XXXX individual on dire t basis of XXXX and after valid oppositions were made of the violations of the Americans with XXXX XXXX and ongoing violations of 28 C.F.R. 36.206 ( b ) /42 U.S.C . 12203 ( b ) where I'm no being financially exploited. XXXX and Mountain Run Solutions LLC are in violation of Federal law ( 42 USC 407 ( a ) ) protects Social Security benefits even after deposited into a claimant 's bank account. Title II, Section 208 of the Social Security Act of 1935 provides the most broadly applicable exemption. It exempts Social Security benefits from all legal process, including garnishment. This situation does show further interference with services in for a XXXX person by these illicit mannerisms. The statute provides broad protection from any practice rendering benefits 'subject '' to " legal process. '' The Kilkers opposed Stillman 's claim of exemption, arguing that under code of civil Procedure section 704.080, only Social Security funds directly deposited into a bank account by the government are protected by the exemption. ( All further statutory references are to the code of civil Procedure unless otherwise specified. ) True, under section 704.080, subdivision ( b ), a judgment debtor, who receives Social Security payments by direct deposit, does not need to prove that the funds are exempt ( up to certain amounts ). Section 704.080, by providing such automatic exemption for direct deposit amounts, provides additional protection to Social Security payments that are directly deposited. But neither section 704.080, nor any other legal authority cited by the parties, supports the interpretation that section 704.080, subdivision ( b ) eliminates the availability of the 42 united States code section 407 ( a ) exemption as to Social Security payments that are not directly deposited into a bank account. I spoke to Mountain Run Solutions ( debt buying collection agency ) on XX/XX/21 at approximately XXXX hours. They alledge that I owe {$390.00} dollars from an old XXXX/XXXX XXXX alarm contract - a fact which I vehemently dispute. I recently noticed this on my credit report and disputed it with XXXX - who removed it. When I spoke to the agent from Mountain Run Solutions this morning, I was asking for a debt verification letter because, although it was removed from XXXX, it still remained active with another bureau. I gave her my email address and she confirmed that I would receive the debt verification via email in about 72 hours. I then asked the Mountain Run Solutions agent why they removed it from one bureau and not the others since I challenged the validity of the debt via dispute and won. The agent said that they simply no longer work with XXXX and that's why it was removed. She quickly told me that the collection would remain on XXXX and XXXX until I paid it. I told her that I guarantee it will be removed and that I'm not paying it - because I don't owe it. She very quickly said " Ok then, how about we not send you anything. Have a good day '' and immediately hung up the phone. My complaint is on 2 fronts : 1- I don't owe this {$390.00}. My contract term limit obligations with XXXX/XXXX ended ; however, they, without communication to me, converted me to month-to-month. There had even been years of inactivity with the alarm system as it didn't even have power running to it. It had been left unplugged due to its location. Regardless, I paid as agreed to fulfill my contract term limit obligations. Because this account was on auto-pay/automatic withdrawal from my checking account, they were able to keep taking the payment out each month - even after my contract obligations had been fulfilled. I did not pay that close attention to my bank statements and missed the continued charges for a long time. That is clearly my fault. However, when I noticed it I contacted them. They told me about the month-to-month extension and I told them I wanted to immediately cancel. Unfortunately, they continued to charge. I called back ( and emailed them ) to provide written notice that this should have already been canceled and that I was stopping future automatic payments - which I did. Unfortunately, my written notice to cancel was somehow apparently and surprisingly insufficient and they continued to charge without canceling as requested several times. With automatic payments turned off, they then apparently began adding them up. Their continued charges from that point on amount to fraud and theft. XXXX/XXXX later sold the debt of continued charges to Mountain Run Solutions for pennies on the dollar I'm sure. 2 - The Mountain Run Solutions agent threatened further negative reporting to the ther two bureaus besides XXXX unless I paid. Currently it is only on XXXX - so the agent was threatening to add it to XXXX. Further, and most alarming, after agreeing to send me a debt validation letter via email, the agent then changed her mind and said she wouldn't send me anything - after I told her I would not be paying this because I didn't owe it. The actions, by both companies, are predatory in nature. Their actions have caused financial harm by negative reporting, have been ectremely time consuming to fix, and have caused emotional damage with threats of continued and additional negative reporting - unless of course I agree to pay a debt that I don't owe. This is unfair and unacceptable.

To Whom it May Concern : It's been over three and a half years that I've been a past customer of XXXX. I had their full home security service. Unfortunately, I had to call to cancel my services after becoming a victim of Hurricane Harvey in XXXX, TX in XXXX. The home I was renting, with my mother and two other brothers, got flooded with over 7ft of water inside and a recorded 13ft of water on the exterior. We lost everything including our cars and even my cell phone. It was a very unforeseen and unforgettable experience. We were homeless for about two months. We thankfully had some assistance from FEMA. I was able to get myself a cheap cell phone. I then decided to call Vivint customer service and informed them about my situation. I had asked them to cancel my services because I have no home and had lost everything. They insisted that they'll be willing to put my account on hold. I told them that I would prefer to cancel because I had no idea what the future holds, as far as my living situation goes. Although I was in a contract with them, I figured being horribly affected by a natural disaster would be forgivable. Well, it seems XXXX could care less. I called back a few times to see if I could get it canceled, but it went nowhere. I eventually stopped calling and left it alone. We were able to finally find an apartment, a two-bedroom. It was the only thing available since so many others had lost their homes and had to get apartments that weren't affected by the flood in the meantime of recovering. At that apartment, we were unable to get any security systems installed. I had called XXXX again to cancel. It still went nowhere. I eventually gave up trying and left the situation alone. I hadn't heard back from XXXX or received any notices from XXXX since either. It was now XXXX, my credit report was hit with a collection. XXXX sold my account, which seems to be the remainder of my contract, to a debt collection company called Mountain Run Solutions. Without contacting the Mountain Run Solution, whom I have no business with, I tried my best to dispute this account through multiple credit bureaus, but it got rejected. I tried to explain my situation with the number of word characters I was allowed to send but I guess my story wasnt sad enough. Since I tried so hard to get my account canceled by XXXX during the times I was experiencing financial hardships and homelessness due to a natural disaster, I refuse to pay any of this debt. I wish Vivint wouldve been more considerate and thoughtful and honor my request due to my specific situation. Since I had lost everything, I had to find another job, I had to find money to make a downpayment on another car ( I had literally paid off a car the week before Harvey came and totaled it ), and I had to pay off other important debts that got heavily delayed due to my situation. I tried calling XXXX to see if there was anything they could do but they stated that they no longer have control over the account. Unfortunately, my credit score has been in slow recovery since and It sucks that when other services or companies have to pull my credit report, thats a negative thing they see that may affect my approval odds for getting credit cards needed to help rebuild my credit or even another apartment. I noticed an account from Mountain Run Solutions on my credit report last year when I began reviewing it during my mortgage application process. I immediately noticed inaccuracies in the account and disputed the account with the XXXX credit bureaus it was being reported to at the time, XXXX and XXXX. XXXX ultimately deleted the account but XXXX did not so I decided to contact Mountain Run directly. Below is a description of the violations by Mountain Run during our correspondence over the past few months. VIOLATION # 1 Due to my concerns with the accuracy of the account, I sent Mountain Run a debt validation request ( Enclosure # 1 ) which they received on XX/XX/XXXX per USPS cert mail # XXXX XXXX XXXX XXXX XXXX ( Enclosure # 2 ). I did not receive a response to this request until XX/XX/XXXX. Despite their failure to respond to the validation request within 30 days they continued to report the account to the credit bureaus which I believe is a violation of the FDCPA> VIOLATION # 2 In the debt validation letter, I requested that all communication going forward take place via US mail and no phone contact be made ( see highlighted portion of Enclosure # 1 ). Mountain Run completely ignored this request and sent a text to my cell phone on XX/XX/XXXX at XXXX pm XXXX ( please see document labeled " Enclosure # 3 '' from complaint # XXXX ). This communication came well after their receipt of the aforementioned debt validation letter on XX/XX/XXXX. I believe telephone contact with a consumer after theyve requested contact by US mail only is a clear violation. VIOLATION # 3 Lastly, Mountain Run has provided me with information that clearly supports my claims of the multiple inaccuracies associated with the account as reported to the credit bureaus. This strongly implies to me that they are aware of the discrepancies in their reporting, yet continue to do so anyway. I have outlined the issues citing their negligence below : a ) In an invoice generated by Mountain Run dated XX/XX/XXXX ( Enclosure # 4 ) they allege that {$1700.00} is owed for 23 months of unpaid monitoring services ; however, per the Customer Billing History ( Enclosure # 5 pgs. 2-3 ) provided by the original creditor only 7 months are unpaid ( XX/XX/XXXX XX/XX/XXXX ). b ) The invoice ( Enclosure # 4 ) also indicated I owe {$210.00} in interest charges ; however, the agreement with the original creditor ( Enclosure # 6 pg.1 highlighted portion ) does not authorize any finance/interest charges. c ) They provided me with a copy of the Alarm Monitoring Agreement ( Enclosure # 6 pg. 3 ) which indicates a monthly fee of {$68.00} for monitoring services ; however, the balance their reporting per the invoice ( Enclosure # 4 ) they sent me is based off a monthly amount of {$74.00}. How can they base their charges/balance off an amount thats different than the contractual agreement they have on file? Despite my brining these multiple discrepancies to their attention ( Enclosure # 7 ), they have failed to correct any information being reported on the account. Not only have they not corrected it, they just recently began reporting this erroneous information to XXXX. Please note, this is my second complaint submitted as the first complaint was initially sent to the FTC and did not include all of the information when forwarded for investigation.

On approximately XX/XX/XXXX, my wife had a collections item appear on her credit report for XXXX XXXX showing the collection was opened XX/XX/XXXX. She immediately contacted XXXX XXXX who confirmed they do not have, nor ever had, an account in her name, my name, or our home address, on file. She then contacted the collection company, Mountain Run Solutions, who told her a copy of the contract and itemized statement would be sent to her within a week. On XX/XX/XXXX, Mountain Run Solutions had never followed up and sent the information so, she contacted them once again. They were advised that we never had an account with XXXX XXXX. No reply was ever received. Then, on, or around, XX/XX/XXXX, the collections item was removed from her credit report and placed on mine under the name, XXXX XXXX. Again, I immediately contacted the company regarding this issue. Finally, on XX/XX/XXXX, XXXX XXXX sent the contract and a letter showing the debt from XXXX XXXX was bought by their company in XXXX of XXXX. Still, we never had an account with XXXX XXXX ; however, after reviewing the contract, we discovered the account was actually with XXXX XXXX and signed XX/XX/XXXX. At this time, we spoke with the agent that sold us the security system and confirmed we cancelled our services, as required in the contract, and made the equipment available to the seller, as required. If he did not pick the equipment up, that is no fault of our own. It was available. We were never notified that XXXX XXXX bought out XXXX XXXX, nor were we sent any type of bill showing what we owed, or for what- from any of these companies. To this day, this collection agency has not sent us an itemized bill to let us know what this debt is supposedly for. The only thing we received is the contract that shows the address the security system was being installed at, where motions were installed in the house, the monthly charge for monitoring ( {$44.00} per month for 36 months ), and your usual verbiage regarding cancellation and credit procedures, etc. We did everything we were required to do. If we owe something, we were not properly notified, nor would this debt be from XXXX of XXXX. Again, this contract was dated for XX/XX/XXXX and only for 36 months, which would be XX/XX/XXXX. No one from XXXX XXXX, or Mountain Run Solutions, attempted to contact us ; we only found out about the alleged debt when it appeared on my wifes credit report, then removed from hers, and added to mine. We thought our identity had been stolen because the fact XXXX XXXX confirmed no account was found in their system for us. We have reached out numerous times to this collection agency to no avail, disputed on both our credit reports, and nothing has been done to resolve the issue. The charge is for {$2000.00}. This is more than it would even cost for three years worth of monitoring. It is severely impacting our credit, and is not even correct or truthful. If you look at the dates of their demand letter and, proof of purchase, they are dated for the date I was finally able to contact them.

My XXXX credit shows a collection on my credit for {$390.00} reported by Mountain Run Solutions. Last Reported on XX/XX/XXXX. I have disputed this claim every month since XXXX with the credit bureaus, only to have Mountain Run Solutions report that I owe the money, month after month. I won't get into why I don't think I ever owed the money in the first place, because I did ultimately settle the account for less than the amount they claimed I owed in exchange for a letter of deletion to have the record removed from my account. Which I paid on XX/XX/XXXX. Here is where things get interesting. I had been contacted by a different company all together XXXX XXXX XXXX whom I paid. XXXX possible violation if multiple companies are trying to collect for the same debt. ) On XX/XX/XXXX I sent a certified letter to Mountain Run solutions disputing the reported debt. The letter was returned to me. I then sent letters to each of bureaus with a copy of the returned letter. Disputing the claim as obviously false information was being reported on my credit if the address was wrong and requested that they remove the record. The following month none of them had removed it or sent me any kink of response. However, the credit report did update saying that Mountain Run had verified the debt once again. I sent a second letter to each bureau threating suit if it was not removed. Two of the three bureaus removed it, the hold out being TransUnion. TransUnion just updated their records that the debt had been verified on XX/XX/XXXX. On XX/XX/XXXX I reached out by phone to Mountain Run Solutions. They were able to pull my account and the lady on the phone could see that the debt had been settled/paid. But refused to remove the collection since it was not paid in full. Keep in mind that at this point regardless of all else the amount being reported and the amount owed is different. Yet another piece of information that is undisputedly incorrect. ( Along with the Address ) I do have copies of an offer from XXXX XXXX XXXX. I have a letter from XXXX XXXX stating the account is paid in full. I can show proof of payment to XXXX XXXX XXXX. I have a certified letter returned to me that was addressed to Mountain Run Solutions. I have certified letters to the Credit Bureaus spanning several months. And, I have copies of my credit report spanning several months. It is my opinion that, It is not my responsibility to prove that I don't owe them. But instead It is the creditor and bureaus responsibility to prove I owe. And further more their responsibility to report true and accurate information. On XX/XX/XXXX, a Utah collection agency, Mountain Run Solutions , LLC, reported a collection account they claim to have acquired from an original creditor XXXX XXXX We never received any written correspondence in the mail regarding this alleged debt and we were not given the opportunity to dispute the alleged debt. We discovered the reporting on XX/XX/XXXX when we received an alert from our credit monitoring app. On XX/XX/XXXX, I received a text message from Mountain Run Solutions , LLC stating they have purchased the account from XXXX XXXX and demanding that I sent them {$800.00} to settle the account by XX/XX/XXXX to have the reporting removed from our credit files. I wrote the credit bureaus to dispute the reporting and each credit bureau wrote back claiming to have verified the account. I knew it had to be impossible because there was no such account. I then wrote a letter to Mountain Run Solutions , LLC explaining that we had no knowledge of such an account and requesting for them to provide me with documents to verify the alleged debt. I received an email on XXXX XXXX from an XXXX XXXX at MRS with documents attached. One of the documents was a service agreement. A few things immediately stood out on this service agreement : 1. The signatures on the service agreement for my husband and I were forged. The handwriting is obviously not ours. My husbands name is misspelled, and I was given the middle initial XXXX which I never had. 2. The company name on the agreement was XXXX XXXX XXXX XXXX not XXXX XXXX 3. The contract was dated XX/XX/XXXX which puts this action outside of the three year statute of limitation for debt collection in North Carolina. After reviewing the F rating and several of the over 400 complaints received at the XXXX XXXX XXXX on Mountain Run Solutions , LLC regarding the same type of fraudulent collection activities, I am appalled that this agency is still allowed to operate in the state of Utah. This company is practicing deceptive and unfair trade practices, forgery, and wire fraud. Personally, because of this fraud our credit scores have decreased by 30 points, we have suffered character defamation and we have been turned down for financing due to having a recent collection account added it to our credit files. I received a letter from the collection agency in XX/XX/XXXX when I called to ask what this debt was for and was told it belonged to XXXX XXXX. I explained that it could not be because I never had an account with XXXX XXXX in the last 8 years I asked for a validation on more than one occasion but they refused to send me anything. When I look at my credit report, I noticed that in XXXX there is a Mountain run Solution account that explains that the account is for a loan, like a charge account, and the credit limit increased from {$1500.00} to {$2500.00}, I did not. recognize this. account. I went to XXXX XXXX credit report which says I have been making payments since XXXX with no late payments and my balance in XXXX was XXXX. Then it shows up in collections and I don't understand why. I have never made any payments to an account like this, because that is not my account, and I have never seen that account on my credit report before. I check my credit report every year, and this account was never there, and it just popped up last year. I filed a dispute with the credit bureaus and they told me that the account is accurate because the collection agency says so The credit bureau as XXXX and XXXX, they asked me to prove that it is not my account, I told them that I can not prove it because there is no way I can prove any account that is not mine. Im confused and stressed and shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I reported this debt in XX/XX/XXXX when XXXX XXXX tried to collect on it and put this on my credit report. Complaint # XXXX. Now XXXX sold the debt to a collection agency, Mountain Run Solutions, who is now trying to collect on the same debt and threatening to put something on my credit report that is not mine. Here is my complaint again : In XXXX, XXXX, my husband contracted with XXXX through this XXXX XXXX for home monitoring alarm system. I was never party to this contract which by the way was for 60 payments from XX/XX/XXXX, was paid on time through the contract term and was on month to month after the end of the 60 months. My husband called them in XX/XX/XXXX and told them effective XXXX, he did not want to continue on month to month. They told him he had to sign something stating that he no longer wanted the services and they sent him something over electronically to sign stating this which he did twice after they claimed they did not receive it. The contract is over but they felt they had a right to continue to bill and a verbal was not enough. I never gave my social security number or gave any verbal agreement to be on this contract from the beginning. The signature or initials are not mine. I was not home the day this was done. This was entirely in my husband 's name. I called the company on XX/XX/XXXX when I discovered this was on my transunion credit report and they in fact told me this should have never been put on my report, that it was my husband who they put in collection on XX/XX/XXXX. I was not on the agreement. In fact, they offered to send a copy of the agreement which I am attaching. So how did they even get my ssn to place this? It's not on this agreement either. I repeat, this is very upsetting. To put something on someone's credit and then call it a utility company Resolution is that # 1, this is not my debt and take me off the collection. Resolution # 2, provide proof of payment history showing what was paid by my husband and when it became delinquent by him. Just sending a copy of a contract does not validate the debt being past due with no payment history. or proof of when it became delinquent. I was initially contacted by Mountain Run Solutions via text message on XX/XX/XXXX, stating that had purchased an account and there was a balance due of {$400.00}. I called the number from the text and explained that I didn't owe any money in that amount to them. I asked for documents and an explanation of the total. The lady stated it was for 8 months of monitoring services for {$39.00}. I explained again that information was false and wanted to dispute the balance. The representative stated that she will not accept a dispute. I asked for a letter in the mail or some documents. She later emailed an invoice that only showed their name an address and the balance, nothing showing how they come to XXXX. The lady then became irate and stated that the debt was valid. She hung up the phone. I attempted to county the company back serial times, however, they blocked my cell and home number and I was unable to contact them via phone. I then submitted a dispute on XX/XX/XXXX via email to the representative as well by mail. The company never responded with any information but instead without validating the balance submitted it to my credit report. I then phoned the monitoring service XXXX and they were not familiar with that company and it sounded like fraud and to dispute the account through XXXX and also obtain an attorney to communicate with the company. I have disputed the account serial times over the last 3 months and without any resolve it has not been resolved. Company Mountain Run Solutions purchased a debt from XXXX. This debt was for alarm system service agreement I did not purchase at an old Address I didn't live at for nearly 3 years prior to the time of agreement. I lived at address stated in contract for a few months in XXXX with my girlfriend at the time after which I had got my own apartment. I have submitted disputes to credit bureaus as well as Mountain Run Solutions. I have requested verification of debt and proof of statue of limitations. They have provided contract of service agreement showing date of contract as XX/XX/XXXX. This appeared on my credit report in XXXX of XXXX. Upon receipt of contract from collection company it further proved this wasn't my debt and I did not sign nor have any such knowledge of contract. I have requested they immediately remove from my credit report. Since then I have received additional notifications from XXXX advising they consider the debt to be accurate. On this Contract which I intend to submit additional disputes in writing it shows my name and social security number which I did not provide. The contract also advises that they will obtain a credit report before services was provided. They did not do so in accordance with their own contract as I have had a fraud alert on my credit report and would have been notified and could have confirmed this wasn't me that was opening the account. Furthermore, this contract didn't have my signature on it what so ever, nor did it have my phone number on the contract. So other than someone putting my name and social on this contract there was no agreement by me entering into such agreement. From XXXX to XXXX we had XXXX XXXX XXXX at our home in XXXX XXXX. That term was covered by a contract. Once the contract expired we tried to cancel the service as we were no longer happy with the service. They advised us that we had to cancel in writing, which we did in XX/XX/XXXX. Since we didn't hear from them again we assumed that was the end of it. We sold that house in XXXX. Fast forward to XXXX, and we see an item recently sent to collections on both my wife 's and my credit report from a company called Mountain Run Solutions, a debt collector, alleging that we owe them {$480.00}. They claim via the credit report entry that they filed in XXXX. They did not, as my wife and I qualified for a mortgage at 2.5 % in XXXX, which would not be the case had they done so. They claim we didn't cancel our XXXX agreement properly, and that the {$480.00} is fines and penalties.This is false, as the intervening time clearly proves. We have repeatedly asked them for proof of the debt, and they refuse to provide it, instead sending us only a copy of our contract, which clearly shows the term as being XXXX. XXXX was subsequently bought out by XXXX, but our calls to XXXX for proof result in our being sent back to Mountain Run Solutions. We checked the XXXX and there are hundreds and hundreds of complaints just like ours. It appears Mountain Run Solutions is running a scam, and hiding behind the pandemic to do it, counting on less oversight by yourselves. We insist that this intentional, extortive error be removed from our credit reports, and that Mountain Run Solutions be properly sanctioned for dishonest business practices. Their malfeasance has already inflicted financial harm to us. My wife had a credit card cancelled, and I had a credit limit lowered as a direct result of Mountain Run Solutions criminal actions in this case. You will almost certainly be getting hundreds of complaints about them that will seem very similar to our own. Please take action to put a stop this.

I had a debt filed by XXXX a couple years ago. I disputed this debt, as XXXX was in violation of our contract. I won the dispute, and all collections were removed from my credit reports. Fast-forward to XX/XX/21, and I receive a notice from a third-party collection agency ( Mountain Run Solutions LLC ) alleging that they have purchased this debt from XXXX, despite it having already been disputed and settled years ago. The notice from Mountain Run Solutions was dated XX/XX/21, but I did not receive it in the mail until XX/XX/21, leaving me with only 4 days to file a formal dispute. So I disputed the debt with them on XXXX via the email address provided on the notice, and Mountain Run Solutions acknowledged receipt of my dispute on XX/XX/21. On XX/XX/21 I received a text message from Mountain Run Solutions stating that they were going to report the debt to the credit bureaus if I do not pay them by the next day ( XX/XX/21 ). I told them that they can not purchase and try to collect on a debt that has already been resolved. In response, they offered to send proof of the debt to my mailing address, to which I agreed and provided my mailing address. Today ( XX/XX/21 ), just 3 days after Mountain Run Solutions said they would be mailing me proof of the debt, I received notifications from XXXX and XXXX that new collections from Mountain Run Solutions have been reported on my credit reports. I believe Mountain Run Solutions has violated the Fair Debt Collection Practices Act, because ( a ) they purchased and tried to collect on a debt that has already been disputed and resolved in my favor, and ( b ) they acknowledged my dispute of the alleged debt held by Mountain Run Solutions and indicated they would be sending me proof of the debt, but instead of doing so they immediately reported the collections to the credit bureaus. The company in complaint is mountain run solutions. I have an Alleged debt from XXXX XXXX. That has gone to collections. My aunt and I received a text on XX/XX/XXXX about it. My aunt is not on that policy. XXXX is a home security company and my aunt is an emergency contact for me since I don't have any family here in Colorado. But her signature or any financial information is not on that contract. She should not be tied financially in any way. I called and asked them for a debt validation letter. I did not receive anything and forgot about it. On XX/XX/XXXX i received another text and stating that they would be reporting the account to the credit bureau on XX/XX/XXXX if action was not taken. I called immediately and I asked for validation of the debt to which they just sent me a packet of their own alleged payment amount. That packet arrived XX/XX/XXXX They didn't include any original bills but they included a copy of the contract with no billing history. The only date regarding the debt is XX/XX/2020. I didn't even live in the property the debt is regarding at this time. I called again to say I don't believe this debt is correct please send me info with an original bill and breakdown. We spoke with XXXX XXXX at Mountain Run Solutions ( Collection Agency ) on XX/XX/XXXX. We let her know that we had never done business with XXXX. She sent over an alarm contract that was made between our XXXX restaurant in XXXX with XXXX XXXX. We sold the XXXX restaurant to a new owner and then they went out of business. The new owners might have been doing business with XXXX, but we never had an agreement between us and XXXX. We notified XXXX XXXX at Mountain Run Solutions that she needed to remove the claim on XXXX XXXX credit report. We let XXXX know that she was causing financial damage to XXXX XXXX fi she did not remove the invalid debt within XXXX to XXXX business days. XX/XX/XXXX we reached back out to XXXX to get a response, asking her how her company would like to proceed and if they wanted to continue causing damage without any financial obligation with XXXX XXXX and XXXX. She responded back that she has already validated XXXX debt and the account is valid. XX/XX/XXXX we reached out to XXXX and we spoke with XXXX at XXXX Customer Service in the XXXX office. He did some digging and came to the conclusion that this was not a valid collection and asked us to tell the collection agency ( Mountain Run Solutions ) to call the Loyalty Department with XXXX to have this taken off XXXX XXXX credit. We immediately relayed the message to XXXX XXXX at Mountain Run Solutions and then on XX/XX/XXXX she responded Sir we do not contact XXXX like that. I had an alarm service contract with XXXX in XXXX XXXX. They used XXXX to provide the service. In XXXX I stop receiving the service. When I called XXXX I found out they changed names to XXXX XXXX XXXX. I told them about the problem and they were not able to find my account. They found an old one ( many years back ), but never my current one. Since I was not receiving the service for about 8 months already and my account was no where to be found in order to cancel it, I asked the back to stop making the automatic payments. When the bank did so, XXXX XXXX contact me and told me I owed them that money that the bank didn't pay at my request. I told them about the situation and they said that i need to cancel in writing ( by email ) but first I had to pay everything I owed ( {$76.00} ). I paid the requested amount on XX/XX/XXXX. I then send the cancellation email and XXXX XXXX responded that the written cancelation was received. The account was then cancelled. When I called they said that I didn't cancel in writing. My bank was making the automatic payments until the end. I payed what was requested from XXXX XXXX to settle my account and cancelled it. I have called XXXX, XXXX XXXX and Mountain Run Solutions ( the collection agency ) and non of them can help me they say. I am contacting CFPB, since I don't think this is a legal practice. I looked online and there are a lot of people just like me that this appeared on their credit without any notification first. Neither XXXX XXXX, XXXX, XXXX nor Mountain Run Solutions sent me any invoice of notification of charges before impacting my credit negatively. To me this is not fair nor legal.

During XX/XX/XXXX, I received a derogatory letter from the company regarding a debt that should be paid off. I requested validation of the debt in XX/XX/XXXX, which the company responded promptly, but did not properly validate the debt. The company only sent a letter that they had purchased the debt and provided a contract, but no itemized payments and other pertinent information to help me determine the validity of the debt especially during an environment of increased scams. In my initial request for proper validation, I requested that the company only communicate with me in writing via U.S. Postal Mail, which they violated my right by sending me a text message in an attempt to collect the debt. I again, sent them a second letter in XX/XX/XXXX, requesting proper validation, outlining that what was received did not properly validate that the debt is actually owed and if they could not, they were bound by federal statutes under the FDCPA, FCBA, FCRA to cease and desist in their attempt and remove any negative reporting to the Credit Reporting Agencies. Creditor by the name of Protect Your Home filed a collection on all 3 of my credit bureau reports around XXXX with the collection agency listed as Mountain Run Solutions. I disputed the information online and the collection was removed from both XXXX and XXXX. XXXX stated the debt was verified after multiple attempts to dispute the debt. I have never had an account with this company or requested their services. Last month, XX/XX/2020, the collection has reappeared once again on all 3 reports despite it being removed from a previous dispute. I then filed another dispute with each bureau- XXXX would not allow another dispute on the account and the other two stated it as verified. I have sent multiple requests to the collection agency and original creditor for verification of debt and they have all went unanswered. On XX/XX/2020 the collection agency reached out to me via text message and sent a Dropbox link that supposedly contained my contract. This link, of course didnt work. He then volunteered to send it via text in that thread, to which he did not. He then said he could send it via email and I provided an email address and to date I have never received it. I directly asked in the text message if this document was a contract direct with protect your home complete with my signature etc, he stated that the FCRA requirements only state they have to provide a document certifiable that the debt was mine- literally a sheet of paper stating I certify this debt is valid and belongs to is all it needed to say and that a signed contract or document of any kind was not required. I received a collection notice in the mail from Mountain Run Solutuons on Saturday, XX/XX/XXXX, XXXX I dont have any collection accounts and pay my bills on time. I was a little bit taken aback by a collection notice. I called them to find out more information. The rep told me that this was from an old home security system that was charged off in XXXX. First of all, I pay every bill when its due. This is not my debt. However, my bigger concern is that this company used deceptive business practices to try to collect money from me. The first person I spoke with told me they have been sending notices to my home address since XX/XX/XXXX. I didnt live in this house at that time, so I knew this wasnt truthful. It was then that I was shocked by the deception and asked to speak to a supervisor. When I called back when the supervisor ( XXXX ) was on duty, she confirmed that I could be sued for this debt. But, from my research it seems its past the statute of limitations for legal action in my state. When I mentioned this, she got very defensive and said that I can report this to whoever I wanted but refused to give me an internal name I could write to. She continued to treat me as a low life person who simply refuses to pay bills by saying, you can report this to whoever you want, but you still have to pay your bills! 2 years after canceling an account with XXXX XXXX and not receiving any notice of an issue Mountain Run Solutions contacted me by text informing that they had purchased a debt and would report it in 16 days to credit. No other information was sent. I contacted XXXX and they had no knowledge of selling any debt to Mountain Run solutions and said that the company they used was Perfect Collections LLC. On the XXXX I attempted to contact XXXX XXXX XXXX as they had sent repeated text messages to me and made other attempts to contact during work hours. Mountain Run solutions then provided erroneous information about XXXX cancelation policy and ignored the provisions of cancelation in my contract. Mountain run solutions has ignored my dispute request and are still threatening to send an adverse report to the credit reporting agencies. During recorded conversation an agent stated they sent debt verification to my email address. I have not received this verification and the time they stated they sent verification was before my request for verification. In later email messages with the manager the manager stated the day after the agent stated that the verification had been sent that it had not been sent and that they would be sending it while again threatening to report on the XXXX but claiming they had 30 days to send the verification. The agent acknowledged that they did not know or have record of the Idaho consumers rights act. The agent confirmed they did not do due diligence to correctly obtain my mailing address.

I've been disputing fraud accounts on my credit report since XX/XX/2021. I keep sending multiple sets of letters to the bureaus and the creditors so the excuse of " we didn't get it '' doesn't happen. Furthermore, each letter is certified mail with tracking and each letter shows signed and delivered and yet the bureaus are still not taking any actions. The accounts are not showing in dispute nor are they removed from my report. The accounts always show up with different name variations and different account number variations and yet the bureaus seem to ignore the trend and let these fraud accounts affect my credit score. I have requested the investigation to be initiated and also verifiable proof to be submitted should the account claim to be mine. Not only have I not received any mail showing the verifiable proofs needed to justify the accounts to be on my report, I haven't even received any letters at all stating the investigations have begun. Per the FCRA and federal law, the process is supposed to be 30 days. 100 days later, I'm still here shelling out money for certified mail with no end in sight and no results to show. This is my last option before I take this up with my lawyers and sue for full compensations and damages incurred. Finally, it seems that when these complaints are submitted, the bureaus are using the excuse that they " can't confirm my identity '' to get away with taking no actions on my credit report. This collection is from a company called XXXX. I canceled the XXXX XXXX XXXX XXXX when I sold the property attached to it in XXXX. When I called, the representative made me aware that everything was good and that the current owner had taken over the system. Some time passes, and I review my credit port and find the XXXX account was sent to collections. I called XXXX and spoke to a representative and was told that something went wrong with my cancellation while they were going through some company change over. The representative told me I was responsible for the equipment. I complained and requested a supervisor who repeated that same story. I, at that time, told XXXX I should not be accountable for their employee errors and I would never pay for something I was not responsible for, and they needed to check their recordings. This was back in XXXX to XXXX. Now, fast forward to XXXX, I get a text from a debt collector that they have bought the debt, and I need to settle it before a specific date. I never received any documentation. I assume they plan on suing me to recoup more money from me. This is a false debt that I should not have to pay. I received a collection notice from Mountain Run Solutions in the amount of {$810.00}. I had no idea what this could be from. At that time my credit score was XXXX till they put an unwarranted and false collections ding on my credit. I had to do research to find out what this could possibly be from. On XX/XX/XXXX Mountain Run sent me documentation from an account with XXXX XXXX dated XXXX XXXX XXXX for a service set up for security at a recording studio which I have not been a part of for over 10 years. I signed on. behalf of the LLC not using my social and was not the owner of the Studio. That XXXX XXXX XXXX has been dissolved for over 10 years. The only document Mountain Run sent. was a copy of the order signed in XXXX of XXXX, there are no copies of subsequent bills, nothing that says unpaid, and nothing at all documenting the {$810.00} they say is owed. I do not understand how credit agencies could even think their claim was valid and ding my credit. Not once did I ever receive a late bill or any kind of notice of delinquency in all those years. Now they have hurt my credit. Mountain Run has texted me offering a reduced payment but I do not owe and it is way past statute of limitations. I looked at XXXX website and Mountain Run has 388 complaints, 251 of those complaints against them in the last 12 months. I am not alone in this.

This alarm company that I signed a contract with was XXXX and XXXX was never a company I was in contract with The home was sold I called multiple times provided all the documentation to the original creditor they asked me to sign a new contract for my new home and told them I wasn't interested because getting ahold of them took an act of God. Attached above is the address of the property on XXXX XXXX that had the alarm system installed in it that again was broken multiple window magnets not communicating with the front panel making the system useless. I couldn't get anybody out to repair the current system that was inoperable for at least six months they told me if I could get the new buyer to sign a contract for this system I wouldn't be liable. This company appears to be 're-aging ' debts. I asked for proof of ownership of this debt and to validate the amount owed and date of delinquency when I spoke with XXXX on or around XXXX XXXX XX/XX/XXXX of XXXX. I recently received a copy of my credit report which showed several unauthorized and fraudulent inquiries and accounts on my credit report that were not opened by me ( See attached Affidavit, and Police Report ) .after a short vacation in XXXX XXXX XXXX Florida . I don't have any knowledge of these accounts being open, and any contract bearing my physical WET signature is fraudulent and was not signed by me. On XX/XX/2018 after just moving in a new home XXXX was already installed. I called and asked if I could try it out in my name because it had keypads and we didnt know the code to get in and out the front door. I informed XXXX that I didnt know much about the brand besides what I read on XXXX prior to contacting the he company. He then stated that there was no contract and that it was month to month and that I could cancel anytime. I didnt have to pay a installment fee because it was already equipped with touchscreen monitor, keypad, and camera in the backyard. We signed a 5 year contract for an alarm system and after 5 years we were on a month to month contract. After 10 years we cancelled with the company we no longer get wanted or needed and alarm system. The company was XXXX now XXXX. After I verbally cancelled on the phone, XXXX continued to take money out of my account for 7 months before I caught it. Contacted the bank they investigated and returned my money for them illegally taking it out. On XX/XX/2020, I was sent a letter from Mountain Run Solutions that I allegedly owed XXXX {$1600.00}. I do not owe this company any money and this was my first time hearing that I allegedly owed a debt to this company. On XX/XX/2020, Mountian Run Solutions received a debt validation letter from me asking them to validate the debt and not simply to verify it. As of XXXX XXXX, I have not recieved anything from Mountain Run Solutions that validates this debt and they illegally put the collection on my XXXX and XXXX credit report without providing me validation of the alleged debt. The law states that if collection agencies fail to respond to validation requests within 30 days from receipt of the validation letter, all references to the account must be deleted and completely removed from my credit file. In XXXX of 2020, I disputed this alleged debt with both XXXX and XXXX and both companies said Mountain Run Solutions said the debt was accurate, which is totally false. I temporarily relocated to a new area, but I rented my house to a tenant. I did not see a need for continuing services for a home alarm since the new tenant did not have any interest in having nor paying for it. I called the center ( XXXX ) and indicated so. I was forwarded documents to signed, and the gentleman I spoke to indicated he would send me additional documents to look at and sign them if decided to continue services at a lower premium; said documents were never received by me. I'm truly baffled to find out there is an existing debt or account when no one attempted to get in touch with me nor even visited my house in order to reconnect/connect the services said company claims I own them money for. In the meantime said company is hurting my credit for a meager amount, which I will not pay based on principle. Mountain Run Solutions, a debt collector, has purchased and is attempting to collect on an an account that has been charged off or placed in Default by XXXX. In the course of this attempt they have committed Mail Fraud and Identity Theft ; please see the following laws : 18 USC 1341 and 15 USC 1681q ( 3 ). Referring back to the original letter to Mountain Run Solutions, there are three issue s I brought to their attention. Their response to that letter only partially addressed one ; debt verification. The MOUNTAIN RUN SOLUTIONS LLC collection agency that may must comply with that same date for the charged-off account. This clearly means the debt collector such as MOUNTAIN RUN SOLUTIONS LLC reports the date of first delinquency XX/XX/2019 to the credit bureaus and the original creditor previously reported an date than is more then 9 years since the last reported collection bill from monotronics and first delinquency. The XX/XX/2019 date must be the same date of first delinquency. The date of first delinquency is what determines when the tradeline should be removed from your credit reports. The date of first delinquency is based off the first time of the missed payment and no other payments were made which lead to the account being put in charge-off status approximately 180 days later. The states statute of limitations on the debt is 4 years. Any different date constitutes illegal re-aging.

I attempted to contact XXXX to obtain information and dispute a collection account that just showed up on my husbands credit report. This is the only collection item between the 2 of us, and we have excellent credit. XXXX referred us to a company called Mountain Run ( XXXX XXXX XXXX ). After confirming that Mountain Run purchased this account, I agreed to contact Mountain Run. I explained to the collections agent at Mountain Run why we wouldnt be paying this account, and I wanted to know what date this was purchased. The representative transferred me to a supervisor. She ( XXXX XXXX. ) sounded bored and disinterested and parroted back a few less relevant statements that I gave to the previous representative. Eventually we came to a point where she was condescending and said you dont have a single piece of documentation that you dont owe this debt ( after I explained that we made numerous attempts to contact XXXX to cancel our contract ). I received a letter from Mountain Run Solutions, acct # XXXX stating I owe a debt of {$550.00} that is in collections. It states my name, XXXX XXXX, XXXX XXXX XXXX XXXX XXXX and the name of a business after it, for which I have no affliation with whatsoever. I have researched and such a business exists in XXXX, I have NEVER been there and do not owe such a debt. I sent a certified letter to the company from my legal advisor which was REFUSED. Upon further review I found that the suite number on the letter head was different from that in the body by one digit, eventhough the suite was next door AND owned by said company they refused the letter unopened. Mountain Run solutions is trying to collect on a debt from " XXXX XXXX XXXX '' for {$4000.00} from me. I have never done any business with Mountain Run Solutions or XXXX XXXX XXXX in my life. Hello, mountain run solutions collection agency out of Oregon is reporting a debt that was released in XXXX XXXX of federal bankruptcy in XX/XX/XXXX. They were at that time, notified included on the bankruptcy, and now they are reporting it to XXXX as a collection. I called them twice this morning to try and resolve this, and A ) they kept talking over me And belittling me with lines such as if you paid your debt you wouldnt be in this mess. B ) would not tell me the amount of the debt when asked, and C ). they kept hanging up. The debt is a 10-year-old debt for {$110.00} that was owed to an alarm company, who went bankrupt and went out of business ordered by the court, and was impossible to reach to pay the debt in XXXX to XXXX. On XX/XX/2020 ; I received a verification letter of debt including contract from Mountain Run Solutions. The letter states that they will delete the account if I agreed to pay {$2900.00}. I ignored the letter until today when I discovered that XXXX had a class action law suit against them for falsify contracts. I searched hard and long for the original contract and found it today in my email. Mountain Run Solutions signed a fake signature on the the contract that they sent me. It does not match the original contract. Also the original documents I received from XXXX has someone else name on the contract. I never noticed it or paid attention to it. I also challenged this with the Credit Bureau but to no avail it was verified by XXXX. I would like the Mountain Run Solutions to be removed from my credit report and also cease XXXX from reporting any false information on any of my credit reports. I had two 36 month contracts with XXXX which ended in 2014. I formally cancelled the contracts in writing however XXXX only cancelled one account. XXXX continued to bill me for services for one of the two contracts after the written cancellation. I notified XXXX multiple times via emails and telephone calls. I purchased a home security system for our home. When the contract was activated we kept our end of the deal and the company XXXX XXXX did not. I was told before and during signing that my monthly payment would remain the same throughout the duration of the contract. After receiving the defective equipment from the company XXXX they said I would have to write a letter to opt out of any agreement I sent the letter a on XXXX XXXX and they were supposed to remove me from remaining product out of my house and then I receive notice that XXXX had purchased them and took over any contracts or existing clients and they kept trying to charge me for something I had opted out and already discussed with the purchased company. I informed them if they installed equipment I would be willing to do a contract with brinks but no response from them. The payments stop for and then two years later they send a bill saying I owe them for the balance for the remaining period when I never received the services or anything after the first month. And they harassed me about paying this for months during the pandemic. I told them the situation and they said our job is to collect a debt not talk to you about your problems so either pay or its going on your credit for 5 years.

After I found this collection agency, Mountain Run Solutions, on my 3 Consumer Reports I sent them a Notice of Dispute and Demand for Proof of Claim. I requested full verification of the alleged debt owed within 10 days or I would " construe their failure to comply as their absolute waiver of any and all claims against me. On XX/XX/2021, I had written to MOUNTAIN RUN SOLUTIONS LLC, and ask that they validate the debt. I received a validation letter from them and it was not my signature. Which I already knew because this debt had been sold from a previous collection agency that I had to contact you about before. In their response letter on XX/XX/2021, included the falsified signature which I knew, and a letter stating they purchase the debt from XXXX whom I have never signed a contract to do any business with. Mountain Run Solutions , LLC is a predatory collection agency. They were somehow able to purchase a debt that I had already resolved with the original creditor and initiated unfounded collections against me. I asked XXXX XXXX a collector with Mountain Run Solutions to get a transcript of my customer service interaction with the original creditor, XXXX, and he refused to provide me with said information. If Mountain Run Solutions , LLC could access the transcript from XXXX that occurred some five years ago they would see that XXXX took no further action on collecting on what XXXX initially claimed was a balance due but then ultimately took no further action to collect. I do not have time to deal with being harassed by this unscrupulous collector. Please review my complaint and advise. I notified XXXX that an account apparently owned by MOUNTAIN RUN SOLUTIONS LLC corresponds to an account that was over 10 years old which should no longer appear on my credit report. They claim to have investigated the dispute but they claim to have verified that it was accurate despite the account being over 10 years old. Ok XX/XX/21 I called Mountain Run to settle the debt. I asked to speak with a supervisor to help me settle the amount owed on this almost XXXX XXXX XXXX debt that I wasnt aware of until it recently posted on my credit. I am a victim of identity theft .This collection agency is not only reporting fraudulent account but also aware that is account is fraudulent in deed. This company continues to violate my rights. InXX/XX/XXXX, a company sold the debt to Mountain Run Solutions saying I went delinquent inXX/XX/XXXX. Thats impossible because I hadnt paid them since XXXX. I can not get anyone to give me an original date of delinquency nor are they reporting the original date of delinquency on any of my credit reports. I believe they are illegally re-aging my account.

The original creditor provided us with a service that was not working and I canceled my service, at the time I canceled they said nothing was owed and service canceled. I recently pulled my credit report and I was unsure of what this was, I then saw the original creditors name next to collection company and I called them, they stated they charged me an early termination fee.
