This report is concerning Butler Mortgage, XXXX, FL. I had been working with an agent at this company named XXXX. From the first contact I had with him, I informed him that I was currently a XXXX employed by a XXXX company who was XXXX to work for a third-party corporation. In spite of that, I was told that it would possible for us to receive a XXXX mortgage and was pre-qualified for {$250000.00}. We began to search for a home and found XXXX. The seller accepted my offer and the seller and I reached an agreement for my family to move in immediately as renters/tenants until the mortgage was closed because I was continually reassured by XXXX that my financials and application were in great shape and sure to be approved. Subsequently, I paid for an appraisal of the property that was completed. We placed our deposit of XXXX in escrow. On XXXX/XXXX/XXXX I was told that our original closing date of XXXX/XXXX/XXXX would need to be pushed back to XXXX/XXXX/XXXX due to the fact that, I was told, XXXX could not approve the mortgage because of my financials. However, XXXX insisted that there would be no trouble obtaining an FHA mortgage instead, if we could secure additional funds for a down payment and escrow account which we managed to do. As the XXXX of XXXX drew closer, I received a pre-approval letter from Butler mortgage, however, they kept demanding more and more paperwork from me regarding my current employment status. I obtained letters from the XXXX company I am employed by and also my supervisors at the third-party company I am XXXX to. However, it was finally said to me that I would need a letter which, untruthfully, stated that I was actually an employee of the third-party company I was XXXX to, and that the XXXX company I am actually employed by was simply a payroll service. When I refused to do this, two days before we were scheduled to close, Butler denied my mortgage application and the seller/landlord wanted myself, my wife our XXXX children and XXXX dogs out of his home immediately. This obviously caused a panic among our family, and while the seller relented and allowed us to stay in the home for one week while we secured a rental elsewhere, this whole scenario was completely unnecessary based on the fact that, as I discovered almost immediately after my application was denied, there was no way any underwriter would have ever approved my mortgage application based on my employment status. If XXXX as a representative of Butler mortgage had been honest about that fact upfront, instead of continually promising that he would get it " worked out, '' I could have secured other housing for my family from the start and not been put in such a compromising and, frankly, embarrassing position. As a result of the deadline for proof of funds passing on XXXX/XXXX/XXXX the homeowner/seller was entitled to my deposit. I appealed to Butler to pay back the money I had given the escrow company based on the new information I had obtained about the impossibility of my ever obtaining a mortgage given my current employment situation, but a supervisor from Butler simply attempted to pacify me by offering just {$500.00} of my deposit back - money taken from me which was given in good faith believing that it would be possible to obtain a mortgage. I feel as if I have been the victim of a scam. Attached is a email XXXX sent to our realtor admitting he was at fault and a transcript of text between the XXXX of us.

Our mortgage company requires home insurance, and also handles the payment of that insurance through our required escrow account. We were dropped by our insurance company ( as many homes in Florida were being dropped ) but were quickly able to secure new home insurance with XXXX XXXX -- the only company that would insure us at the time. We immediately sent proof of our new insurance policy and payment requirements to our mortgage company, so they could note the new coverage and pay the premium. They confirmed receipt, and had plenty of time ( 90 days ) from our notice to make the payment from our escrow account, but for some reason ( it's still unclear why ) they dropped the ball and payment did not go out in time. Our new insurance company, XXXX, sent a notice of rescission of our policy for non-payment on XXXX XXXX, XXXX, back-dated to the beginning of the policy on XX/XX/XXXX. I called our insurance company to explain the situation, but they said there was nothing they could do, even if our mortgage company sent out the payment, we could no longer get coverage with them -- our policy was cancelled. When I called our independent agent to try to get emergency/temporary coverage with another company, she told us there is no other insurance company in XXXX that would cover us, since on paper we had now been uninsured for several months. So, I called our mortgage company several times over the next 3 months, trying to get answers and/or someone to help us, but their only answer was that they would have the let the automatic process happen where they provide insurance coverage themselves, called " forced coverage ''. In the meantime, the rep I spoke with lied about the amount their " forced coverage '' insurance would be, quoting an amount similar to our previous policy in order to placate me, I'm guessing. They also told me a supervisor would contact me, which never happened. I received a warning letter on XX/XX/XXXX from the mortgage company, stating that my policy expired and to provide evidence of coverage, or they would have to " provide forced coverage '' that would be significantly more expensive than our previous policy. I then made a couple more calls to our mortgage company but was unable to get a supervisor on the phone, to which they said one would return my call. Still no phone call and no follow up. On XX/XX/XXXX we received the final warning letter that the " forced coverage '' insurance our mortgage company would provide would be {$7700.00} which is about double the amount of our previous policy, and because the coverage would be back-dated, that means that as of XX/XX/XXXX, we will have paid double the amount of insurance for 7 months ( to date ). This whole debacle is our mortgage company 's fault, and we have been unable to resolve this situation with them. I believe they have violated CFPB Statute 1024.31 because we did provide proof of home insurance coverage and the escrow funds were there, but the insurance policy was rescinded because of the mortgage company 's failure to pay the premium by the deadline.

The Mortgage Firm transferred my loan from one payment servicing center to another and changed my loan number. My loan remained with The Mortgage Firm. The Mortgage Firm has received and cashed my XXXX, XXXX and XXXX payments but they have not applied the payments to my loan. They have held my payments in suspense and are not responding to my repeated requests to have the payments applied to my loan. My XXXX payment cleared my bank on XX/XX/XXXX in the amount of {$570.00}. I provided XXXX at The Mortgage Firm with a copy of the cleared check on XX/XX/XXXX. I provided a copy of the cleared check to XXXX XXXX and Director of Loan Transitioning XXXX XXXX at The Mortgage Firm Corporate Office on XX/XX/XXXX. My XXXX payment cleared my bank on XX/XX/XXXX in the amount of {$570.00}. On XX/XX/XXXX, my bank, myself and XXXX at The Mortgage Firm conducted a conference call regarding my XXXX payment in which my bank told The Mortgage Firm that they had cashed my XXXX check. My bank stated they would email a copy of the cleared check to The Mortgage Firm. I emailed a copy of the cleared check to XXXX at The Mortgage Firm on XX/XX/XXXX and XXXX confirmed receipt. I provided a copy of the cleared check to XXXX XXXX and XXXX XXXX at The Mortgage Firm Corporate Office on XX/XX/XXXX. I provided XXXX XXXX and XXXX XXXX the tracking number and XXXX confirmation of delivery of the payment from the old servicer to The Mortgage Firm Corporate Office on XX/XX/XXXX. XXXX is listed on the XXXX confirmation as being the person to receive the delivery and XXXX XXXX confirmed that she was the one who would have received it. My XXXX payment cleared my bank on XX/XX/XXXX in the amount of {$570.00}. On, XX/XX/XXXX, I provided XXXX XXXX and XXXX XXXX with the check number and date my check cleared. I received a letter dated XX/XX/XXXX from The Mortgage Firm stating that my account was delinquent. I have been told by XXXX that RESPA covers my payments until XX/XX/XXXX. Mr. XXXX has not returned my phone calls or responded to my emails. As of today 's date my account shows my payments in suspense. Mr. XXXX has failed to resolve the issue of my payments not being applied to my loan. Mr. XXXX and Ms. XXXX have both failed to respond to my repeated requests for the contact information for the regulatory department with oversight of The Mortgage Firm.

I was referred to XXXX XXXX, loan officer, at XXXX XXXX. I sent him all the information. He was impressed of my credit score, no debt and that I was starting a well paying job as an XXXX. He failed to tell me that he was changing companies. Once he changed companies to The Mortgage Firm, located at XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, FL XXXX, he called me and said that I had to switch companies because XXXX XXXX would not give me a loan and that I had to stay with him at his new company. I stupidly believed him. I then resent everything that I had previously sent. I was approved for a loan of $ XXXX with 25 % down for a condo located at XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX, XXXX, FL. Everything started on XX/XX/XXXX at new company and I was to close on either XX/XX/XXXX or XX/XX/XXXX depending on if everything could be processed. XXXX received the condo information during this period and on XX/XX/XXXX called me as I was on my way to do the final walk through and told me that I now had to pay $ XXXX more ( $ XXXX to $ XXXX down ) or I could not close on the condo. He blamed it on the associations rules. I told him I did not have any more money. He then said that I lost the loan and did not offer any other possibilities. Now, because of this, I am losing $ XXXX in escrow and The Mortgage Firm is billing me for the appraisal which I never received a copy of or any information from The Mortgage Firm that it was completed and did not know any upfront prices. XXXX 's manager is XXXX XXXX and she is demanding the money. I want to report this company for fraud. I lost the loan because they did not provide the required information in a timely manor. I appreciate any help you can provide.

I was contacted about a request for a mortgage pre-qualification that I made via email on the website XXXX. I was replied to by a XXXX XXXX, who works at The Mortgage Firm in XXXX XXXX, FL. He sent a very disturbingly-worded email to me. I told him he was upsetting me and asked that he not send any further emails. He ignored this and proceeded to send me an email that listed the name " XXXX XXXX '' as the subject line. I had recently contacted a XXXX XXXX, as he is a broker from whom I requested information on a property for sale ... and XXXX XXXX should have had no knowledge of my correspondence with XXXX XXXX. In my mind, there is no possibility that XXXX XXXX ' name could have been mentioned as mere coincidence, as XXXX XXXX and I had never discussed brokers or specific properties in any capacity. This leads me to believe that XXXX XXXX somehow gained access to my email inbox - the only other explanation is that the XXXX men may know each other, and happened to discuss me prior to this second email being sent to me ( this is not professional behavior on their part, if so ). Following my receipt of this second email, I blocked XXXX XXXX from contacting me, but I am still shaken by his knowledge of my personal contacts, and by his disturbing first letter to me. I filed a complaint with the XXXX, but The Mortgage Firm failed to respond to my complaint - they are behaving as if I never filed a complaint at all. I wrote to The Mortgage Firm directly, and also received no response ... I then attempted to call, and they put me on hold in order to hang up on me the moment I gave my name. The attempt I made to call back after this happened was not answered.

Hello I am a XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I was referred a loan from another XXXX XXXX from Georgia. The loan officer name is XXXX XXXX and her nmls id is XXXX. XXXX referred me a loan for XXXX XXXX - property address XXXX XXXX XXXX XXXX XXXX GA. This was a purchase loan. I got the loan approved and we closed the loan. After a month I get a letter from attorney for XXXX XXXX stating the loan had fraud bank statements and XXXX bank verified that the statements and the details/deposits did not belong to the borrower. The borrower couldnt understand English and XXXX was helping us communicate as the translator over the phone. All documents provided were through XXXX email. The bank asked me to refinance the loan but they cut all the ties with me. XXXX was the main lender I was working with. The borrower or the loan officer provided fraud documents to close this loan and I have ruined my relationship with the lender as I was cut off from doing business with them. I have all the proof that I did not do any fraud and I have all the chain of emails. The details on the bank statements were done so perfectly that I couldnt rectify as those were fraud, I want to report this against the loan officer and the borrower. I wasnt sure who did it but I want to report this so things like this doesnt happen in future with others.

On XX/XX/XXXX I opened a case with CFPB ( Case XXXX ) against The Mortgage Firm , Inc. in which they responded on XX/XX/XXXX and stated they made an error but it would be corrected within 30 days. It has now been way more than 30 days and they still have not corrected the issue. The issue being, that loan modification documents were to have been sent to us last XXXX, XXXX and it has been more than seven months and they still have not sent the new loan modification documents even though they were approved back in XXXX, XXXX. Furthermore, I found out on XX/XX/XXXX from a customer care agent that The Mortgage Firm had made another error in XXXX, XXXX and that is why we still do not have our loan modification documents even after our last CFPB case was opened and closed. The customer care agent we spoke with said our docs were once again re-ran on XX/XX/XXXX and would be on the way to us soon but could not pinpoint a date. We have heard this exact statement many, many times before over the past seven months to no avail. I am attaching a document with a timeline of all the issues we have encountered.

Called customer service XXXX to confirm that new mortgage had received payment and additional funds had been applied to principal. Two separate payments are being sent for the monthly payment to mortgage company. Talked with rep and then supervisor. They said they dont accept partial payments and this would cause errors. I received my statement for XXXX showing an overdue payment of {$480.00} when in fact 2 partial payments of {$700.00} had been received by this company 3 weeks earlier well covering the {$1100.00} payment. I called again on XX/XX/XXXX and talked to 2 different reps and the 2 supervisors, XXXX and XXXX. I ask to speak to the quality department or their manager but they both stated that there was only the supervisor. I only ask that the funds sent to them with my account number be credited in a timely manner every month to my mortgage. They are unable to do this. I am sending them my money to pay on my mortgage and this company can not guarantee where my money will end up in their payment process. This is unacceptable.

On XX/XX/XXXX, I contacted the Mortgage Firm who then purchased our loan within 10 days of closing from another branch of The Mortgage Firm in XXXX, Fl. We closed on XX/XX/XXXX, with escrow being collected for both taxes and insurance. On XX/XX/XXXX, while in my online mortgage account I noticed that my mortgage had dropped down in the monthly billed amount of {$950.00} to {$850.00} with no explanation or documentation. Therefore, my escrow account is short with no explanation as to why after we have spent hours asking the mortgage firm questions. I called because in XXXX of XXXX my wife was notified that us nor is it listed in our loan portal. Now our mortgage payment just went back up again with no explanation as to why. We have a log of all of the Mortagage Firm staff that we have spoken with including today 's with the exception she refused to give me her name at the XXXX XXXX Fl XXXX XXXX.

On XX/XX/XXXX I requested information from the Mortgage Firm, who I currently have my Mortgage with. All I asked was if now would be a good time to refinance. Before I received a response email I had a hard inquiry show up on my credit report. They never asked if they could pull our reports but instead ran them because they already had our information on file from the current mortgage. They ran a report on both me and my boyfriend who is also on the current loan. I complained and they didn't seem the be too concerned about it but rather tried to justify it by saying they had to pull it to give us an accurate rate. All I wanted to know was if now would be a good time based on the market. This gives the illusion that they are trying to run someone's credit to get them roped into working with them.

The complaint relates to unsavory practices on behalf of the mortgage lender. The applicant only has social security benefits as declared income and it alone will not suffice. The processors have recommended that I make a " distribution '' for a period of 3 months only of {$2900.00} from my IRA to satisfy Federal Agencies Requirements. It appears fraudulent on it 's face and deceptive in its action. I can not morally do this. A processor, in order to secure a document, asked that I log into my Bank account using her computer so she could use the URL to secure a deposit of mine made to my bank. I have never been told that I have a mortgage commitment without contingencies, but one day ago I received an attorneys missive telling me about a closing.

XXXX XXXX, IL XXXX XXXX. Tel. XXXX. FAX # XXXX. While the mortgage was still under the previous servicing company, I made my payment there on time. Monthly payment {$2100.00}, Since the transfer of my mortgage, the new servicing company is stating that they dont have record of my payment to the previous loan holder and they are charging me interests and threatening to take my account to collection. This individual XXXX XXXX pulled my credit score illegally and is harassing me months later and sending me private information about myself and others over text messages. This is incredibly unprofessional and an insecure way to transfer private data. I want to report this person immediately.
