Our evidence has been submitted to you and to mentioned competent INTERNATIONAL AUTHORITIES as it can be seen from our previous correspondence with CFPB. What we emphasize is that our assets have been misused worldwide, as already can be seen from the Letter to FED dated XX/XX/XXXX ( CLM 1 ( 1 ) ( 1 ) ( 6 ) ), which we have cited many times before. In addition, other offenses have to be added to the volume of damage, especially as billions of our assets are moved daily. These include money laundering, tax fraud, forgery and process-fraud. Those criminal activities have endangered the entire monetary system, affecting both, the US and the worlds finance systems. peRepeatedly we have pointed XXXX XXXX XXXX to the bank statement ( dated XX/XX/XXXX of XXXX XXXX XXXX XXXX ), of which you can derive our assets deposited in this bank and which are exactly listed there ( CDs in total, stockholders equity : USD XXXX XXXX XXXX, please see our FILE XXXX XXXX and documents, which already have been sent to you ). Due to the fact that there are binding insurance agreements confirmed and FDIC insured, related to XXXX XXXX XXXX XXXX / XXXX XXXX which confirm our assets at XXXX XXXX ( XXXX ) XXXX ( see our supplements sent to FDIC onXX/XX/XXXX, XXXX XXXX ( XXXX ) XXXX, guarantees, shares, common stock etc. ), according to the corresponding FDIC policy number, we kindly ask CFPB to assist us in making available above mentioned contracts and all account statements of our assets at ALL ABOVE MENTIONED BANKS and XXXX XXXX XXXX and their branches and subsidiaries to be sent to us immediately. Especially since our property is internationally registered and is insured with FDIC, we kindly ask that CFPB immediately will use its powers and enable us to protect our property and to provide us for free disposal. Such criminal activities of these banks in connection with the legally exclusive assets of XXXX XXXX XXXX XXXX / XXXX XXXX consistently have deceived US INSTITUTIONS. This, with obvious aim that by misusing our assets as described, they gain an improper enrichment in their favor, their customers and / or third parties. In addition, one must remember that these activities and methods already partially have been used for decades (! ). For XXXX XXXX XXXX XXXX this is completely inadmissible and unacceptable. Due to such global fraud of the managers personally responsible for the respective acting banks ( to our disadvantage ), also the US- and world-wide financial stability is extremely endangered. This, because of the gigantic sums and shifts of assets in the hundreds of Billions of USD. XXXX XXXX XXXX XXXX therefore requests, this because of apparent threat to our assets and the threat to international financial stability, to take all legal measures to protect our assets, accounts, deposits, guarantees, bank instruments and securities and to make them available. In addition, it is necessary immediately to take adequate sanctions against the banks mentioned. We therefore repeatedly and kindly ask CFPB for understanding that in view of such a gigantic, global scam with hundreds of billions of USD simple standard steps of the respective national supervisory authorities can not be expected. They are clearly overwhelmed. Further clearing and prosecution therefore primarily is in the responsibility of national and international law enforcement authorities. This is to register a complaint on the processing of our mortgage application to Morgan Stanley Private Bank, National Association between XX/XX/XXXX and XX/XX/XXXXof 2017, and its contractor XXXX XXXX. We have been shocked and suffered a high degree of mental anguish and damage by a process which included incompetence, reckless disregard for security, attempts to compel us to obtain from our accountant statements of fact that he could not legally make, intimidation, brinkmanship and false appraisal practices that are far outside best practices in the industry and a stark contrast to our experiences with two other prospective lenders we consulted during the same time period. We have brought these concerns to the attention of Morgan Stanley. We understand our experience is under review but there has been no redress. We therefore bring our complaint to the attention of the CFPB. Following are the particulars : 1. Incompetence : As is typical with mortgage applications, we provided details initially by telephone to XXXX XXXX of XXXX XXXX, including verifying or correcting information she obtained from an initial credit report. We were therefore shocked when, a few days later by mail, we received for signature the initial credit application in which nearly every fact was wrong, from the facts of which of us is the principal in our business, the XXXX XXXX XXXX XXXX XXXX, to the details of our credit history. We sent a lengthy memo outlining and correcting these facts.

Unfortunately, the pattern of incompetence continued throughout the process, with repeated demands to submit documents we had already submitted and to justify facts that were obvious. For example, we went around and around with XXXX staff in their demands that we explain the source of a subtotal in a monthly Morgan Stanley statement for funds that had come into the account. We had explained and documented the sources of funds repeatedly, but when asked to justify the subtotal again, could only point to basic math.

False Commitment Letter : When we applied with Morgan Stanley, they required we amend our Purchase and Sales Contract financing commitment date to XX/XX/XXXX. If we were unable to secure a commitment by that date, we stood to lose {$25000.00} in earnest money we had given to the sellers to secure the contract. As we got closer and closer to that date with no firm answer from Morgan Stanley, we telephoned and emailed repeatedly and got vague, non-committal replies or no returned calls. During the last several days prior to XX/XX/XXXX we lost sleep, fielded, frequent calls from the realtor in New Hampshire asking whether the deal was on or off, and learned that another prospective buyer was waiting in the wings should our application be denied characterized Our contact at XXXX, XXXX XXXX XXXX was, astoundingly out of the office on XX/XX/XXXX, and his associate, XXXX XXXX who picked up the case in his absence knew nothing about it. Facing a hard deadline, we were forced to call our Morgan Stanley financial advisor for help in getting an answer from XXXX, even though she has no formal role in this process. Finally, at XXXX XXXX on XX/XX/XXXX, as our realtor was writing a message to the sellers asking them to return our earnest money and cancel the sale, we got word from XXXX that our commitment letter had been approved. However we were stunned when we discovered that the letter, when we received it that evening by e mail and, subsequently by mail, included three conditions, two of which we had already met with previously supplied documents and another that was unclear. When we sought clarification by email from XXXX XXXX, he replied by email with several more, new demands for information, none of which were in the commitment letter. In other words, there was no real commitment letter on XX/XX/XXXX and the conditions in that letter were not the real conditions we had to meet in order to receive approval for our mortgage. It seemed to us the commitment letter was in fact not a commitment at all, but instead a tool to push resolution of our application beyond Morgan Stanleys own XX/XX/XXXX deadline.

2. Recklessness : Throughout this process, XXXX demanded submission of all documents through open email channels. Despite our frequent complaints, we were told to submit bank and credit card statements as well as all explanations for every question in this way. The result was not only a confusing tangle of email exchanges, but also the compromise of our privacy and potentially of our financial security. At one point, XXXX received a phone call from someone describing himself as a Morgan Stanley official offering an update on our application and leaving an extension at the bank. When she tried repeatedly to return the call, she got a message that the individual was not available and to call back. Only upon inquiring by email for the third time was she informed that no such extension existed at the bank. We can only surmise that some or all of the emails we submitted to XXXX in this process ended up in the possession of unauthorized persons, and that they have used them to wreak further damage to our financial well being.

On XX/XX/XXXX, XXXX received calls and phishing e mail attempts by persons impersonating XXXX XXXX XXXX who represented themselves as responsible for our credit card account. She provided their requested confirmation of our card details, only to discover that the card and her email account were hacked. Fortunately, she realized this almost immediately and took measures to secure the account and replace the cards. We can not link this directly to XXXX recklessness with our financial information but it is a disturbing coincidence that it happened during a time when we were being repeatedly asked to provide our financial and credit details to them. 3. Attempted Invitation to Fraud : On two occasions, XXXX officer XXXX XXXX demanded by email that we obtain from the CPA contractor we employ to supervise our accounting and prepare our tax returns a letter attesting to facts about our business which are not within his purview. On XXXX XXXX, XXXX XXXX demanded by email that we get a letter from our CPA attesting that our legal business can relocate to a new address and explaining a drop in our XX/XX/XXXX self-employment income over the XX/XX/XXXX level. We refused, because our accountant had no role in our decision to relocate and we have never discussed the matter with him other than to advise him that we were moving. Subsequently, XXXX XXXX again demanded on XX/XX/XXXX that we acquire a letter from our CPA verifying our self-employment, including the date on which the firmed opened for business, that it was currently open for business, and that it was in good standing. Again, we refused because none of these were facts that our CPA would know of or would be qualified to judge. In no circumstances would we ask our trusted accountant to make written statements that he could not legally make simply to do us a favor in facilitating our mortgage approval. It is offensive not only that such statements would be requested, twice, but also that Morgan Stanley Private Bank , NA would accept such documents.

4. False Appraisal : An appraisal ordered by Morgan Stanley was completed and submitted XX/XX/XXXX, but not shared with us until XX/XX/XXXX. That appraisal compared the property we were buying ( XXXX XXXX XXXX XXXX, XXXX, NH XXXX ), a 4,000 sq ft home on five+ acres, to five properties. None of the first three were within five miles of our new address. The other two were in the same neighborhood within one mile of our property, and in the same price range, but, inexplicably, on the appraisal their values were discounted by at least 13 %. In a phone conversation on XX/XX/XXXX with both XXXX and a Morgan Stanley Private Banking official, we were told that because XXXX XXXX XXXX is a property with a main house and an additional dwelling unit, it must be counted as two houses, not one. XXXX County tax records consider the property as one house and prohibit it ever being transferred as two properties ; we have checked. It has one electric meter. Another appraisal done around the same time frame by another lender arrived at a valuation of $ XXXXgreater than the sales price of {$610000.00}.

A 2,000 square foot, three bedroom, two bath home in this area generally sells for $ XXXX {$350000.00} in this part of New Hampshire . Logically, two properties should be more valuable, not less. Nonetheless, XXXX declared to us on XX/XX/XXXX that the fact of two buildings instead of one meant the aggregate value could only be was only {$560000.00}. They offered us a choice of either renegotiating the sale price, four days before the scheduled closing, providing an additional {$40000.00} in cash towards the sale price or accepting a higher rate on the mortgage. We consider this to have been rank manipulation to extort higher than fair market price from a consumer. XXXX, and we must assume, Morgan Stanley, knew of the appraisal on XX/XX/XXXX, but chose not to advise us of thiswhich meant that we had no opportunity to challenge the appraisala process that Morgan Stanley and XXXX both acknowledged to us on XX/XX/XXXX would take 14 days. Had we been advised about the appraisal on XX/XX/XXXX, when it was signed and provided to XXXX, we would have challenged it. This was no longer an option available to us by XX/XX/XXXX if we wanted to obtain a clear to close statement from Morgan Stanley in time to attend our closing on XX/XX/XXXX. Instead, we were faced with a fait accomplieeither accept the wildly divergent appraisal and a higher interest rate, or lose our change to close on this property.

XXXX. Intimidation : On XX/XX/XXXX, at XXXX XXXX XXXX received a call from Morgan Stanley Private Banker XXXX XXXX on a recorded line with the " senior underwriter '' at XXXX ( whose name she does not recall ) who said he was reviewing our file and inclined to " make an exception '' to approve it, but there was no one else at the office able to complete the review until the following day. When XXXX protested that people were planning travel to the closing on the XX/XX/XXXX, 600 miles away, and not having confirmation that it would proceed until 24 hours before the closing was not acceptable, the underwriter asserted that she should lower her voice when speaking to the person with the authority to approve the loan. When she protested the demands for what seemed to us to be improper letters from the CPA, which seemed like an inducement to fraud, he asserted indignantly that this was not fraud and she should not make that accusation. Nevertheless, she persisted. And he concluded the conversation with the promise that an answer would be forthcoming by noon on XX/XX/XXXX.

At XXXX XXXX on XX/XX/XXXX, XXXX XXXX and XXXX XXXX, calling on a recorded line, informed XXXX that the loan was " cleared to close, '' and verified the spelling of our names, the property address and various other facts. By that time, we had revived an earlier application with another prospective lender and could have closed at the end of XXXX on that loan ( the only outstanding condition of which was the prior sale of our current residence, closing on which is scheduled for XX/XX/XXXX ). Nevertheless, to avoid the additional expense and mental trauma of rescheduling the moving company and all the other contingencies involved with moving as previously scheduled, we accepted the Morgan Stanley loan and closed at XXXX XXXX on XX/XX/XXXX at XXXX XXXX XXXX in XXXX, New Hampshire, driving late into the night and all the next day in order to be present at the closing.

We have been battling with the mortgage company for several years. They have always used fraud and deception throughout the entire case. The have used forged documents, robo signing, we were approved for $ XXXX from hud to catch up our mortgage and pay a year in advance, the lender lied and provided false documents to have that cancelled, We have docs that have two different notaries swearing on two separate Mortgage registrations, False MERS Contracts. Too much Fraud to list. The most recent complaint has to do with a short sale we tried to work out with XXXX mortgage servicer and the Lien holder Morgan Stanley XXXX XXXX. We Approached the lien holder through their Attorney. The claimed they were going to consider a short sale. This stopped the scheduled Sheriffs sale. We had a potential buyer. This was turned down because they claimed it had to be listed with a real estate agent and appraised by their appraiser. We secured a real estate agent.and listed the property. The Lien holder sent an appraiser. The appraiser returned a value of {$XXXX}. The agent Installed a lock box on the door and placed a sign in front of the house. We had four offers in about a week. The offer was for {$XXXX} but upon closer inspection the buyer lowered his offer. The real estate agent and I listed all the defects and problems with the house. This was all disclosed to the lien holder. The Agent contacted the lien holder and said the evaluation was not right. Upon talking with the workout specialist she said she would send another appraiser out. Upon waiting for a couple weeks a letter came stating we would have to file a formal appeal. I promptly filed the appeal and waited several more week. About XX/XX/XXXX we received a reply stating that our appeal was denied. They stated that they were not forclosing at that time and we could try to refile an appeal. I brought this to the real estate agent and he contacted the workout specialist. During this time we also received notice that our workout person was changed.The agent called loss mitigation and spoke to someone explaining they told us they were going to reevaluate the property. The workout agent told the real estate agent that she would call back the next day with an answer. The workout agent never called the real estate agent. The real estate agent followed up with the workout agent on the following Monday.The work out agent then told the real estate agent that they already sent out someone and the value came back at {$XXXX}. We know this is a lie because no one came to inspect the property when we where there. I also had the real estate agent provide a copy of the print out of the lock box that was on the door. No one can get inside of the house without opening the lock box. Evertime the lock box is open it sends a digital signal to the real estate agents tracking system. the real estate agent confirmed no one came to the house. While we were trying to work with the lien holder we received an advertisement in the mail from a bankruptcy attorney. The advertisement state that he could stop the foreclosure sheriff 's sale scheduled for XX/XX/XXXX. I was stunned because we were never notified by the court or attorney for the up coming sale. I went to the clerk of courts office in XXXX SC. I requested to see the files on the case. The file was reactivated but it did n't have any information on who filed for the sale. The Only attorney listed as receiving the receipt from the filing with the clerk was an electronic reciept for Att. XXXX XXXX. I questioned this because this attorney was n't part of the case for several years.I also looked and noticed that there was no NOTICE OF SERVICE filed by and attorney. The notice of service is proof that the attorney filed the motions with the court and served them to all parties in the case. This document was missing. The clerk did n't know the answers so they told me to contact the Judge, attorneys and the clerks office via email. Upon contacting all parties involved the attorney stated that he filed the Motion to reinstate the sale because he had orders from his client. He state that he filed the papers on XX/XX/XXXX. That would have been impossible because the Judge signed the order on XX/XX/XXXX. That would mean that the judge would have signed the order 12 days before the lawyer even filed. Once I brought this up to all parties the attorney later said he filed on the XX/XX/XXXX. Since the attorney never filed a 'notice of service '' with the court, the court recommended that he do that. The attorney filed a notice of service and mailed the copy to me. Up receiving the notice by mail I noticed it was blank. How could someone file a notice with no date stamp or any information from the clerk? I received these docs on XX/XX/XXXX. This is the first notice i received from the court. I received it on the XX/XX/XXXX and the sale is scheduled for XX/XX/XXXX four days before the sale date. I filed a motion with the court siting rule 5 violations. Rule 5 has to do with proper file and court procedure.I filed this motion to stop the sheriff 's sale. I also filed a motion requesting another hearing because of fraud on the apart of the lien holder. I filed this to request a hearing to vacate the foreclosure order. The judge said in order for me to stop the sale I would have to file a bond which I do n't have the money for. In the past it was ruled all this fraud and XXXX was not an issue because I filed for bankruptcy and by doing that " I claimed the debt ''. The only problem with that is the fraud was discovered after I filed for bankruptcy. The Lien holder sent me a letter when they switched servicers. The servicers sent me a letter asking me if this was my debt.I responded back that it was not my debt. I argued in court that if the defense can claim a debt that if the law is fair then the plaintiffs should be able to un-claim a debt. The judge never let me speak. I was not able to afford a forensic document examiner etc. But this is old but it shows a long pattern of fraud and deception by the lien holders, servicers and attorneys in the case.We also tried to do a work out with the lien holders. Very early on they offered us a work out deal that would have put us further in debt after paying for two years. I did not take that deal and have not paid anything on the mortgage since.

Refiling CFPB Complaint XXXX, correcting the language that misidentified the incident with XXXX XXXX XXXX XXXX The experience of XXXX XXXX XXXX was in XX/XX/XXXX and a XXXX banking branch -- not XXXX. On or around XXXX XX/XX/XXXX I opened a Checking account, Savings Account and Brokerage account with E*Trade/Morgan Stanley. After opening the accounts my ability to access features of the account, to include activating my debit card were restricted. The system alleged that it was for the safety of my financial assets and that E*Trade/Morgan Stanley needed to speak with me before enabling all account features. On or around XXXX XX/XX/XXXX I called the phone number per the instructions when logging into the web portal. I was unable to reach an individual and was on-hold for approximately twenty-five ( 25 ) minutes before disconnecting. I called again on XXXX XX/XX/XXXX around 0200 hours ( XXXX UTC ) and reached a representative named XXXX XXXX. I explained to XXXX XXXX that I was instructed by the system to contact account activation. XXXX XXXX explained I needed to provide a copy of my state issued ID and social security card in order to enable full features on my account. He suggested that I take pictures on my phone and upload them through the secure web portal while he was on the phone with me. I declined and explained that I was on my handset and that my wireless headphones were in my vehicle. I told him I would go ahead and image the items using my scanner and call back once I'd uploaded the documents to the secure web portal. I imaged my Driver 's license at a resolution of XXXX dpi, and uploaded it along with an image I already had of my social security card. I called back and reached XXXX XXXX again approximately forty-one minutes after my first call with him. As before I was asked to verify my name, DOB, last four, and e-mail address. Thereafter XXXX XXXX retrieved the files I uploaded. Upon reviewing the documents, XXXX XXXX explained that the documents were not valid because when he zoomed in " the image was pixelated. '' I asked XXXX XXXX if he was referring to my driver 's license or my SS card. XXXX XXXX stated this was the case for both. He explained that he would not accept " scanned '' images of documents and only would accept pictures taken with my phone, again instructing me to complete the process by taking pictures of the items with my phone. I asked XXXX XXXX what the policy was surrounding documentation, which documents were needed to verify my identity, what the image quality needed to be, etc. XXXX XXXX replied that " he was not going to explain the policy surrounding documents that were acceptable, nor the image quality necessary, and insisted I needed to comply with his request to proceed with document verification. I explained to XXXX XXXX that I work for an FFRDC and the explanation XXXX XXXX was providing me, and the restrictions placed, seemingly by XXXX XXXX is his distinction between " scanned '' and " imaged '' were more restrictive than those placed on me than the two FFRDC 's I've worked for in the past five ( 5 ) years. I explained to XXXX XXXX that the supposition that the camera image would be of higher resolution than a " scanned '' image was false because the quality of the image sensor ( camera ) on a phone is heavily dependent upon the phone manufacturer, the software stack used to down-sample the raw image data before saving into an image file, and the age of the phone. I explained to XXXX XXXX that he sounded like he " was full of $ XXXX '' and explained I would be contacting during first-shift to speak with the individual to which XXXX XXXX reported. While I would like to believe this situation was simply a cascading instances of miscommunication, it is of note to point out that the rejection of the documents based upon alleged " pixelation '' did not take place until after XXXX XXXX had opened up the documents I supplied which clearly showed an image of a XXXX man. That is, the extra scrutiny placed on the documentation I supplied was not rooted in the alleged poor quality of my resubmittals, but rather based on the fact that I am a XXXX man, and the supposition being that I was attempting defraud a financial services institution based upon my physical presentation and identifying information per my government ID. While with a twist, this is not at all dissimilar from the experience of XXXX XXXX XXXX in XXXX of XXXX, where as a XXXX woman in XXXX Michigan she attempted to cash a counter check from her winnings at casino with a local XXXX branch location, only to have three XXXX tellers claim the check was fraudulent with no justification other than her presentation as a XXXX woman. In my case the documents I resubmitted could be examined clearly at XXXX their original size without pixelation. Of note is that the camera on my phone has a crack in the lens, making images taken with my phone camera susceptible to artifacts. Moreover, image quality from an optical sensor is heavily dependent upon the lighting and does not guarantee higher image quality than that of documents that are " scanned. '' Finally, that XXXX XXXX would suggest I take a picture with my phone and subsequently take a screenshot of those images would seem to be a clear indicator that this is not about the quality of the provided images, but rather the suggestion that I needed to engage in a process similar to " XXXX '' by capturing the images of the necessary documents WHILE on the phone with XXXX XXXX. I highly doubt I would have been subjected to the same level of scrutiny had I presented in my ID as a " XXXX '' individual as opposed to a XXXX man. The sad thing is my current employer, one of the FFRDC 's mentioned earlier will be making a deposit of my weekly earnings on or around XXXX XX/XX/XXXX.

I opened E*Trade Morgan Stanley Private bank premium savings account XXXX on XX/XX/XXXX. I submitted my drivers license and verified my XXXX XXXX XXXX XXXX bank account via XXXX test deposits with activation specialist XXXX. XXXX worked to retract the money via XXXX by submitting test deposits to link to E*Trade. E*trade blocked the same external account from which funds were taken. I called and was told reason account closed was E*trade no longer wants to do business with me, to wait for a letter via mail. On XXXX, I called, spoke with act. spec. The letter states We are writing to notify you that the above-referenced Morgan Stanley Private Bank account was recently opened using your personal information. As part of our opening review process, we determined that your personal information may have been used fraudulently to open the account. Accordingly, we have closed the account. Correspondence XXXX XXXX I called agent XXXX after receiving this and advised her I did open the account, this letter was sent in error, i verified everything requested. XXXX said shed note the acct. but once it's closed, little can be done, said has seen money held without interest for as long as 2 years. I have : Verified external account Provided license 4 times Provided social security card 2 times Provided photo of me holding license Verified external bank, that Ive been a customer XXXX yrs and funds came from there Verified receipt of letter sent to my physical address, addressed to me asking me to call, by calling the number provided. Brief background : I am a XXXX year old single XXXX woman sharing my home with my best friend of over 30 years. She is a XXXX year old XXXX. We are the " XXXX XXXX - XX/XX/XXXX '' and need to stay in this home. The home that has been in my family since purchased brand new by my parents back in XX/XX/XXXX. My XXXX, along with the eleven different medications I was prescribed by my health care professionals made it impossible to return to work. I was a XX/XX/XXXX. It took 3 years to get my benefits through Social Security. I became delinquent on my mortgage payments, but I kept in contact with my mortgage company to the best of my ability. I have since discontinued all but one XXXX XXXX medication. It was very difficult to do but well worth it, the cloud has lifted. When I became able to pay my mortgage, they had already accelerated my loan, no notice was given, and refused to take anything less than the total amount that they say I owe. So we started working toward a loan modification to help me keep my home. First I was denied because I did not have sufficient income. My friend moved in to share expenses and I am now able to pay my mortgage as stated by the servicer in their denial. I am also being told that since I have equity I am not eligible. I even filed bankruptcy ch XXXX, in attempts to work out a situation with the lender so I may stay in my home. They refused. Then they mailed another loan modification application which I filled out and returned promptly, which included my roommate 's income as a non borrower contributor. Still denied. All this time, I have the trustee 's notice of sale and postponements coming in the mail three at a time. I believe they were dual tracking pushing forward with the sale even though I had a loan modification pending with the servicer. The servicer did not even have a record of the sale date, and if I had listened to them, I would have lost my home for certain, because I was not made aware that they had filed and been granted a lift of the stay of protection! So many things have been done that are outside the boundaries of what my California legislators have established. 1. I was never alerted as to all the foreclosure alternatives that the lender took part in, whether I qualified or not, and if not, the steps I needed to take to become eligible to stay in my home. I was never made aware of options available to avoid foreclosure. 2. Single Point of Contact was not established until quite recently and even then has changed three or four times within this last month. 3. Dual Tracking - The trustee for the sale has been relentless in pursuit of this property even though there is an active loan modification with the servicer. The date given on the last correspondence from the servicer to submit documents is XX/XX/XXXX, yet the date for the trustee sale is XX/XX/XXXX. It appears they are either not communicating with each other as they should be, or I am being deceived by the servicer. And this is not the first time the servicer told me there was no sale date, when in fact there was! 4. I was never given information on how to appeal a denial to my loan modification, including deadlines, or the parameters needed to qualify for a modification. 5. I should have been given opportunities for not just a loan modification, but all foreclosure alternatives to stay in my home. 6. Servicer used outdated credit score. 7. Servicer used outdated property valuation. 8. '' Single Point of Contact '' - " XXXX '' contends that even though I am requested to send in additional documentation for assistance, the result will not change. They refuse to give me a chance to save my home! He got annoyed with my questions and pleas for help. Talks down to me. 9. They are going to sell my home for the amount owed, {$270000.00} and I stand to lose over $ 100K in equity! 10. Other reps for the servicer have told me that it is not uncommon to start making payments again, and the balance I owe in arrears just gets tacked on to the back of the loan. My home is wrongfully in foreclosure. The following requests were not fulfilled : XXXX/XXXX/XXXX letter to XXXX I requested " copies of the debt/mortgage purchased/transfer from XXXX of .... property by Morgan Stanley XXXX '' ; letter dated XXXX/XXXX/XXXX from my attorney to XXXX of XXXX requesting " proof of the existence of any debt ... as well as proof of ownership of any alleged debt '' ; in a letter dated XXXX/XXXX/XXXX to XXXX of XXXX, my attorney requested " proof of ownership of any alleged debt referenced in your letter, including any assignment, allonge, or other indication of transfer of ownership ''. ( 2 ) Total debt amount of {$820000.00} as stated on Foreclosure Notice exhibit B is incorrect as a result of not going by terms of The Adjustable Rate Note as stated. Also, it states in the NC Construction Loan Addendum to Deed of Trust dated XXXX/XXXX/XXXX and recorded XXXX/XXXX/XXXX in Book No. XXXX at Page XXXX that the maximum amount, including present and future obligations which may be secured by this Deed of Trust at any one time is XXXX. ( 3 ) There are XXXX different law firms acting as the Substitute Trustee in the present foreclosure proceedings. On the actual Notice of Hearing on Foreclosure of Deed of Trust, the hearing date was XXXX/XXXX/XXXX and that the Substitute Trustee was XXXX. I had received via post a letter dated XXXX/XXXX/XXXX from XXXX that they were the now representing XXXX, etal. However at the Foreclosure hearing, an attorney from XXXX as well as XXXX for XXXX were there as Substitute Trustee. A new hearing of XXXX/XXXX/XXXX was set. Afterwards, in a letter from XXXX dated XXXX/XXXX/XXXX, they state that the hearing for XXXX/XXXX/XXXX was cancelled and the foreclosure was on hold. However, a signed Motion from XXXX stating that the Court had continued the hearing was not enclosed. Because of this and the confusion at the previous hearing, we called the Clerk of Court 's office twice on XXXX/XXXX/XXXX and once on XXXX/XXXX/XXXX to inquire if the hearing was still cancelled and all 3 times we was told that it was still on. We attended the XXXX/XXXX/XXXX hearing but no Substitute Trustee for XXXX was present. The Clerk then came back to us and stated that she had called both law firms and that an error had happened where there were XXXX hearings for " XXXX '' scheduled that day and both were for me. The XXXX scheduled by XXXX as Substitute Trustee had been cancelled by a phone call from them to the Clerk of Court office but the XXXX scheduled by XXXX as Substitute Trustee had not been. My lawyer asked for a dismissal of the Foreclosure because in XXXX hearings there was an issue as to who the Substitute Trustee actually is, they summoned us to this hearing but not appear. She stated, " That 's not how we do it here '' and gave him a post-it-note with a phone number written on it and instructed him to call it. The phone number was for XXXX. ( 4 ) XXXX offered me a " Trial Period Modification Plan '' asking for a total of {$27000.00} and for me to agree to a modification without me seeing what would be on the modification agreement, mainly what the principal amount or what the interest rate would be. Also, it did n't obligate what XXXX would do with the money sent or that I would get a modification. ( 5 ) XXXX letter dated XXXX/XXXX/XXXX denied my application for foreclosure prevention based on my financials I could not repay.I did n't apply for it.

Hello, I'm writing to formally file a dispute related to home insurance charges levied in the last 12 months and bring to your attention predatory and unethical practices at Morgan Stanley Private Bank ( Morgan Stanley Home Loans ). Issue Details 1. I have been charged a home insurance premium twice within the last twelve months. The charges are below. XX/XX/XXXX : About {$2500.00} XX/XX/XXXX : About {$2800.00} 2. Regarding the first charge in XX/XX/XXXX - the first time I reached out to the reps at MS loan administration, I was told it was related to the Flood/Hazard Insurance of the Condo building. This typically renews in XXXX of each year and is made available by the XXXX XXXX. So I had asked about why MS purchased an insurance for me ahead of time. The rep believed it was a mistake and told me she filed a request for it to be taken out and I assumed it would be done so. For some reason it wasn't. Much later and more recently when I realized it wasn't, I reached out again and was told it was related to home insurance instead. This reasoncame muchlater and I couldn't purchaseone myself toprovide MS with proof for any time period. I have been purchasing insurance coverage in previous years by procuring insurance myself. I've attached a sample of one such insurance coverage. You can see from the coverage details, that I paid around {$500.00} in annual premiums thatyear and it has more or less remained the same. Yet Morgan Stanley charged me almost 5x that amount to procure that insurance themselves. Upon looking closely at my online statements and realizing the amount, I called Morgan Stanley 's loan administration team twice to request the coverage details and why was such an insurance bought when it was not needed instead of simply matching the coverage I used to get. The coverage I used to get was more than sufficient with my XXXX XXXX, so there was absolutely no need for such extensive coverage. Furthermore, I've called in twice already to request the details for the coverage and the reps would not connect me with the insurance team at MS . They would simply tell me that the insurance team would forward the details to the rep, who would then forward it to the supervisor, who would then email it to me. I still don't have the details. 3. Since I had no details about the coverage from the MS team and the online portal didn't have it either, I asked the reps if the XXXX coverage they bought me was good for a year. They simply said yes. If you look at the coverage I used to purchase, the period would be XX/XX/XXXX onwards. This is why it was surprising that they levied another charge in XX/XX/XXXX. 4. I recently sold the property and closed on it on XX/XX/XXXX. Since the second charge was only levied on XX/XX/XXXX, Morgan Stanley should have pro-rated the charge and refunded the rest. However, I didn't hear from them about it nor saw any adjustment in the online account. I had to call in again to a ) completely dispute the charge since they had told me the previous charge was good for a year and b ) remind them that they should be pro-rating and refund the rest at the very least. The rep checked with the insurance team and confirmed they owe me a refund but until I called in, they had no intention of doing so. 5. I'm yet to receive coverage details or any details of the refund on the balance of the second charge. The reps simply refused to provide any details, saying the insurance team will be reaching out on that. I'm still waiting.

My mortgage loan is with Morgan Stanley, and this company, in conjunction with XXXX XXXX have made misrepresentations and obstructed my efforts to resolve my mortgage payments that recently increased over 200 %. I am a business owner and I make a solid income and have the means to afford a reasonable monthly payment and have tried repeatedly to work this out. However, these obstructionist tactics have led to me facing a foreclosure sale date on XX/XX/XXXX. I purchased my home 11 years ago and refinanced in 2014 into an interest only loan through XXXX. The monthly payment was {$2200.00}. I am a XXXX XXXX XXXX and have historically done well financially. A couple of years ago I began having some financial issues as I went through a divorce that hit me hard. In that same time frame the interest only period was ending, and the payment was going to double and increase to about {$5400.00} a month. I began trying to refinance my loan, but the internal appraisal team at XXXX claimed that the property was only worth XXXX XXXX. I personally paid for my own appraisal and B.P.O. and they came back with a value of XXXX XXXX. Even though the data and facts showed the true value, XXXX would not accept this valuation and I was not able to refinance the loan. Due to the divorce the new payment of {$5400.00} was difficult to afford and I began trying to apply for a loan modification. However, the agents at XXXX told me they would not offer any assistance since I was current. I consulted an Attorney as well, and he said that XXXX had a policy where they would not consider restructuring or modifying a mortgage when the payment doubled if the homeowner was current on their loan. I felt backed into a corner but knew I could not continue to afford this payment due to the divorce and defaulted on the loan. Once I defaulted, I began dealing with the XXXX loss mitigation department. They would request a list of documents. I would send all the paperwork in, and they would verify they had everything. Then two weeks later they would tell me, sorry, everything is outdated, and we need a new full package. This happened on at least 5 occasions. During this process XXXX raised my interest rate AGAIN and the payment went up to {$6000.00}. I tried in vain to get a review processed so I could be considered for a loan modification but went through a vicious cycle of XXXX intentionally obstructing the process and misleading me as to my status. They then set a foreclosure sale date and transferred the loan and said Morgan Stanley was handling it now. I have tried to engage with Morgan Stanley on multiple occasions and the same exact thing has happened. Apparently, Morgan Stanley and XXXX have some type of agreement linking them together on mortgage loans, and this must be true because both companies have purposely obstructed the modification process and manipulated information in order to seize my assets. As mentioned, I have a foreclosure sale date set for XX/XX/XXXX. I am a XXXX US Veteran who served in a XXXX XXXX unit for the XXXX XXXX. I am a business owner who is slowly rebuilding and increasing my monthly take home now that my divorce is settled. I have the means to afford a fair and reasonable payment. The issue is Morgan Stanley. They are not a trusted advisor ; they are an accomplice to obstruction and misrepresentation. This complaint is necessary because the loan servicers response to CFPB complaint # XXXX against the loan servicer claims Morgan Stanley Mortgage Capital Holdings, LLC is the only party who can authorize a settlement of the payoff amount in dispute. I stand by every word of that complaint as well as the previous complaint regarding actions the loan servicer took to escalate the issue in the first place, assessing nearly {$4000.00} of unnecessary charges against a {$10000.00} equity line. The series of actions the loan servicer and its failure to properly administer the note as outlined in prior complaints clearly indicate the loan servicers policy is to shed responsibility for this small note which was never particularly lucrative for them to begin with. The loan servicer provided false statements in their response as documented in my feedback regarding their response. The loan servicer has refused to communicate except to escalate. Simply stated, the loan servicer is refusing to own up to its contractual failures to Morgan Stanley Mortgage Capital Holdings and is rushing to avoid a fair settlement that might result in the loan servicer having to pay some or all of the costs that resulted from their mismanagement and aggressive, nonresponsive, and likely illegal tactics. This is my home and my hard earned equity at stake, but just a nuisance account to the loan servicers unqualified personnel seeking only to process and get the matter off their computer screens. Family members have been standing by for months to assist me in settling this matter and other means were suggested in prior complaints. Those include the estates yet to be settled of both my parents who died during the period of time that the loan servicer was taking its unfair and aggressive actions ( actions I believe were illegal as stated earlier ), a recent source new income secured finally after my own long recovery from health problems, and Social Security income to begin in XX/XX/XXXXthat will insure my total income each and every month is adequate even without other sources. The XXXX and XXXX estimates of the property value are about {$130000.00}. The total debt ( home loan and equity line ) is less than {$65000.00} even including disputed amounts. According to its response, the loan servicer is basing its judgment on a {$100000.00} value not accounting for the substantial improvements I made to the property with the home equity line in the first place. Regular market appreciation should also be considered just as a matter of common sense regardless of what heavily lobbied banking regulations may allow you to do. As a matter of basic human decency, Morgan Stanley Mortgage Capital Holdings should at least be willing to accept some payment amount as good faith in return for affording me the opportunity to protect my full equity through the sale of the property at or near fair market value. Please note the property is a duplex, so without the income from the rental unit, I will at least need the equity I earned if I am survive without owning a home of my own. ( Please note a similar concurrent complaint was filed under the wrong category. Realizing the error on reviewing the complaint as the CFPB received it, this is now being filed under what I believe to be the proper category necessary to meet the urgency this type of complaint. Morgan Stanley Home Loan ( MSHL ). On XX/XX/XXXX, we received a XXXX on the house that we live right now from MSHL in the amount of {$200000.00}. Of course this was a line of credit for that amount. We used this loan throughout the years of XX/XX/XXXX to XX/XX/2010 when this loan matured. ( It was a ten year line of credit loan. ) After XX/XX/XXXX, we continued making payment and started talking to MSHL about our options. Meanwhile we continued making our payment during those couple of years past the maturity of the loan. In XX/XX/XXXX MSHL sent us a refinancing loan package to refinance this loan. After reviewing the loan package, we realized that the loan amount is much higher than what we were expecting the loan balance to be. So we told them that we are not interested to refinance and we would like to pay off this loan. We sent them a qualified letter and requesting that they give us a complete loan history. This was in preparation to payoff this loan. MSHL as soon as receiving our certified letter they transferred the loan to XXXX XXXX XXXX XXXX. ( A collection company ). Ever since we are asking XXXX and MSHL for a complete loan history, they are not giving us the complete loan history. And we have not heard back from MSHL any more. We would like to demand MSHL to give us a complete loan history so we can pay off the correct loan amount. Secondly, if they can not give us a complete loan history, we are willing and already have fund to pay this loan. But we should not pay the interest that they are demanding us to pay for the past three years. We have gathered funds and kept it in a saving account for the past three years and collecting almost no interest, and the current collection company for MSHL, XXXX is demanding from us to pay the interest for the past three years. I believe that MSHL can not produce the complete accounting of our loan. Secondly we have learn through news and received a small check from a class action law suite against them that they have mis managed people 's fund and loan documents. So we believe we deserve to have a complete accounting of this loan before paying it. Also I have to emphasize that we have always kept the payment of this loan current. They refused to accept our payment, right after we requested the accounting of the loan. We have documentation to support all our statements above. We also received correspondences from this other company XXXX which is also related to MSHL company. Also I have to inform you that we did file a separate complaint against XXXX XXXX servicing company. XXXX is the company that has the note at this point. The XXXX XXXX XXXX claims that they are a debt collection company. The case number with CFPB for the XXXX is XXXX. The XXXX did respond to that complaint. They claim that they are giving us all the information that they have. Of course it does not go back to the date of origination of the loan. So not only their response to that complaint is not satisfactory but also there are some conflicting number. We are going to respond to their inadequate explanation. Using the Etrade online portal, I requested on XX/XX/XXXX that my account be closed and that the balance be transferred to my XXXX XXXX account. On XX/XX/XXXX I received an email notification from Etrade that the funds transfer was complete. On XX/XX/XXXX, I recieved an email notification from XXXX XXXX that my XXXX account had been closed on XX/XX/XXXX because I had a XXXX balance. Then I discovered that I could no longer fully access my ETrade account online. When I logged in to Etrade, an info-box said that restrictions had been placed on my account and that they could only be removed if I called them. I received no further information from Etrade until I contacted them on XX/XX/XXXX. I had a hard time reaching them sooner by phone due to long hold times. The rep I talked to told me that I needed to upload a copy of my photo ID with a signed letter stating the reason that the transfer was returned ( because unbeknownst to me XXXX had already closed my account with them ). As I kept asking questions and not getting satisfactory answers, the Etrade rep was impatient and dismissive and actually hung up on me. I still immediately uploaded the requested letter ( typed with an electronic signature ) with my ID. I didn't hear from Etrade again until I initiated an online chat on XX/XX/XXXX to ask why my account still had not been closed. The chat lasted more than an hour. I was told that my uploaded documents had been rejected and that I should have been notified of this. ( I had not been notified. ). They used vague terms, stating for example that my documents were " not in good order. '' I repeatedly asked clarifying questions about what this meant, which they refused to answer. Throughout the chat, which I can provide the transcript of, I was given confusing and contradictory instructions about what the problem was and what they were requiring. I was told that the letter had to be handwritten ( not just a wet signature, but the entire letter ). This was later contradicted in the chat by a different representative. Still, I submitted a new handwritten letter and was told they were not requiring anything further and that my request would be processed within a couple of days and that a check for the balance in my account would be mailed to me. Again, I heard nothing from Etrade and initiated another online chat today. I was told that my photo ID was not legible. When I complained that I had already submitted it multiple times, I was told that the photo ID I had submitted was ok after all. Then I was told that I need to submit a bank statement from XXXX XXXX proving that that account was closed. i asked why this was necessary and why I was not told of this requirement before. They would not answer those questions and just said that it's protocol. The rules and requirements just keep changing and all I'm asking for is that my account be closed. I have literally spent hours trying to get my account closed and it is not clear why they will not close it. I do not believe a bank statement from another bank should be required.

On XX/XX/2022 I rented a vehicle from XXXX XXXX XXXX XXXX. After 12 days I still needed the car, so my boyfriend went down to XXXX to extend the rentals. F.Y.I. when I rented the vehicle I was charged a deposit. Now, my boyfriend gave them my credit card and they were to charge XXXX XXXX but they accidentally charged XXXX XXXX I have text messages between me and them. They are apologizing in the messages saying they'll return the money, but my problem I'm taking up with you is not between me and XXXX, but between me and my bank. When I first rented the vehicle I bought all insurances possible -- I had to as I was taking the vehicle from XXXX to the United States. In the meantime I had a car accident, but my full coverage insurance was to pay that. After the accident they refused to pay me back for their XXXX $ accident on my credit card. They said they wanted to see the vehicle first, but I had already put up the deposit apon renting the vehicle and I purchased full coverage insurance. They refused to give me back my money but XXXX $ saying it's due to the accident and I did not take care of the vehicle because I wrecked it. That's what the full coverage insurance was for ; I thought -- in case of accident. I put in a dispute with my bank Etrade. They never sent me anything in writing about the dispute within 30 days of receiving the dispute. The only way I knew they were doing the dispute was because someone from Etrade did call me and ask me to upload all documentation I had. In the beginning of XXXX I still did not know the results of the dispute. To this day I still have not received in writing the outcome of the dispute. The only reason I know that I'm not getting my money back is because in the beginning of XXXX, XXXX to 5 months after I started the dispute I called in to ask what was going on with it. Then I was told that I would not be getting a refund because the car rental company was keeping my money due to negligence. In the middle of XXXX, I, too called Etrade to find out results of the dispute and at that time they did not have a decision yet. I was under the impression that a bank only had 3o, 45 days maximum to finish a dispute before they have to award you. As you can see. To this day I still have not received written notification on the outcome of the dispute. Also, my bank, who I thought would be on my side just takes the answer neglegence as a correct reason to not pay me back what was accidentally taken out of my account. Etrade did not even notify me asking for a reply to negligence. If so I would have stated that they are saying that due to the fact I accidentally wrecked their vehicle, but I had full coverage insurance to cover it. Not only did Etrade, my bank, not give me a chance to reply and not reimburse me my money based on one word XXXX XXXX XXXX says, but Etrade went way beyond their 3o, 45 day max time limit they had on finishing a dispute before a party is to be reimbursed. This complaint is in reference to a Modification filled with Saxon XXXX XXXX XXXX XXXX, XXXX XXXX, TX XXXX. My Loan number is XXXX. I have tried to get a Mortification for my home for 6 years. I am filing this complaint against my XXXX Modification Company, Saxon. They held my mortgage for 3 years. Then once the approved my modification they sold my loan and the process begins again. I became in financial trouble due to XXXX with friends. They XXXX left within a year and left me with all the financial debt. A {$60000.00} investment divided by XXXX was {$20000.00} each til they left and now I was left with a {$60000.00} debt in my name, during the worst financial times, because I financially funded the project. They left and XXXX after I taught them how. They left me in a financial mess. In XX/XX/XXXX my mortgage was current ; I called Saxon XXXX and explained the situation. I was told that I could not receive a modification unless I was 90 days behind in my mortgage. They told me I was eligible, so I decided to proceed and let my mortgage become delinquent so I could lower my payments. I figured I would get the modification right away and be on track. I was naive and made a big mistake. I should have gone to a traditional bank and apply for a standard 30 year mortgage. Now XX/XX/XXXX to XX/XX/XXXX with Saxon ( loan number XXXX ) no modification. I applied each month for 3 years and they never received the paperwork or the paperwork expired after 30 days and I would reapply. A terrifying experience, month after month, I applied with no modification. In the meantime, I realize, I am not qualified to deal with this situation alone. I hire a mortgage consultant to help me with this process. Finally XX/XX/XXXX, after 3 years of this nerve racking experience, they grant me a modification. During the trail modification, I pay early and on time for all XXXX XXXX payments. After the XXXX payment of the XXXX modification, I receive a letter from Saxon informing me that they sold my loan to XXXX ( a subsidiary of Saxon ). I do not get a modification from Saxon after three years of a terrifying experience. My mortgage is now in limbo. I am terrified, will I have a home? I did all the right things, followed all the instructions and no Mortgage. Now informed by XXXX ( loan number XXXX ), they do not honor trial modifications and I need to reapply for a XXXX modification with them. But, they give me the option to sell my home to them? The loan amount was {$370000.00}, my home is worth {$450000.00}. and they want my home? I was horrified, scared and bewildered. What was I to do? This complaint involves XXXX consecutive companies Saxon, loan number XXXX, XXXX ( loan number XXXX ) and now XXXX ( loan number XXXX ) I was told by CFPB, I need to file XXXX individual complaints against each company. I took my pension buyout money from a previous employer. It was in an annuity for a few years. I opened an E*TRADE Morgan Stanley account because I wanted to learn how to invest for myself. Now you will be able to follow these documents from their date & time. These emails are internal sent from E*TRADE Morgan Stanly to your account inbox. My account was open a few days earlier, and on XX/XX/23 @ XXXX XXXX I received an email saying my external funding account has been successfully added, which states XXXX XXXX and last four digits of your bank account number. Everything is fine I have full access to my account, and I can come and go as I please. Email dated XX/XX/23 @ XXXX XXXX E*TRADE Morgan Stanley states that it sent deposits for verification to my XXXX account, please check back in 2-3 business days. Email dated XX/XX/23 @ XXXX XXXX I received an email saying I successfully added an external account and can now transfer money from my bank account to E*TRADE Morgan Stanley XXXX Now on XX/XX/23 @ XXXX XXXX ET I received a confirmation email saying E*TRADE Morgan Stanley has received my funds transfer request, and the transfer has now been complete {$40000.00}. Now this {$40000.00} was put into a E*TRADE Morgan Stanley Premium Savings account XXXX This document has a Welcome Customer heading. I opened two other accounts as well a Roth IRA, and an Individual Brokerage account. This {$40000.00} sat in my savings account with no problems meaning I had access, here is where things change. I took {$20000.00} out of the Premium savings account and put it in my Brokerage account. Email dated XX/XX/23 XXXX XXXX transfer complete {$20.00} from Premium savings-XXXX to E*Trade BrokerageXXXX, now 2 hours and 4 minutes later. I received an internal email at XX/XX/23 @ XXXX XXXX saying due to unusual activity in your account certain feature may be temporarily disabled, until they speak with me, when I called to find out the problem, they say they are having trouble verifying my documents. Now these are the same documents I used to transfer the money to them. Things like social Security number, driver license, activation letter, previous history of the money ( meaning a yearly statement from my other investment firm ). Take a selfie with your driver license, take a selfie with your social security card. These are all the things I have done repeatedly in rotation. I have not been able to make any investments they basically locked the account as soon as I opened it. I just want my money back so I can take my business elsewhere. On XX/XX/23 @ XXXX XXXX I called and spoke to a representative named XXXX ; he asks me for another bank statement from XXXX XXXX, a XXXX Statement. I told him I already sent it a few times. He paused for a few seconds and then he hung up. This whole experience has been a nightmare.

The Trust took an insurance write off for the BK- per SEC XXXX XXXX XXXX obtained a charged off account as per their own ledger. XXXX in cahoots and parity with XXXX intended to steal and deceive by concealment and fraud for unjust enrichment through a foreclosure mill XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXXXXXX created a Collateral file ; had to validate the debt and violated FDCP by wrong amounts owed and claimed false Note holder- the document custodian trustee- XXXX XXXX XXXX There is NO valid lien. In XXXX, her debt service to income ratio on the mortgage will be somewhere in the 6 % to 19 % range based on profitability estimates of the business. 19 % being extremely conservative and will likely be around 10 %. She has attempted to pursue a forbearance or modification with Morgan Stanley Private Bank. She has provided all of the documentation they requested and 'INVESTMENT ADVISOR ' has prepared a detailed explanation of the situation for Morgan Stanley . Most of which was provided both by hard copy and electronically in mid XX/XX/XXXX. However, as of today XX/XX/XXXX, Morgan Stanley has still not reviewed the documentation and claims that there are documents missing which is not the case. 'INVESTMENT ADVISOR ' created a file title 'Documents Checklist ' with a statement related to every piece of documentation requested. 'BORROWER ' and 'INVESTMENT ADVISOR ' have called Morgan Stanley Private Bank multiple times every week since mid XXXX. As of our most recent phone call today, it is clear that Morgan Stanley Private Bank has not read the 'Documents Checklist ' and the loan has not yet been put in front of an internal underwriter who can make a decision regarding a forbearance or modification. Morgan Stanley is going in circles. The loan in question still has not been put in front of someone who can make a decision. This is 2 months after originally submitting the documents requested and with a foreclosure sale scheduled for less than a month from today. I question Morgan Stanley Private Bank 's professionalism and overall competence as a mortgage lender in the US, especially during a tenuous time for many borrowers. There is a history of a lack of professionalism and possible outright incompetence between 'BORROWER ' and her former Morgan Stanley Financial Advisor ( s ). She is now in a situation where her home could be foreclosed upon. She originally paid cash for the home which she owned free of any liens whatsoever. Later, her Morgan Stanley Financial Advisor advised her to borrow money in the form of a first mortgage, which is the loan in question now.

Both the trustee of my mortgage and the investor/holder of my mortgage have committed numerous mortgage related violations, some criminal and have both reached settlements with the Department of Justice for such. Even though both have consent agreements mandating homeowner relief with modifications, both have refused to allow a modification. The Libor rate was used to establish the interest rate on my mortgage. This in and of itself should make my loan, " the fruit of illegal activity '' null and void. Morgan Stanley and XXXX through their sub servicer XXXX have refused to allow me to modify my mortgage even though the mortgage is predicated on XXXX 's and Morgan Stanley 's criminal and illegal behavior that both have pled guilty to paying XXXX of dollars in fines and both have been mandated and agreed to offer consumer relief through loan modification. ( 1 ) Morgan Stanley Private Bank assumed loan servicing responsibility on XX/XX/2019. The prior loan servicing provider was XXXX. ( 2 ) Prior to Morgan Stanley Private Bank assuming servicing responsibility, they sent letters to us that contained erroneous information about the outstanding principal. I contacted them prior to the notice date and the issue was resolved. ( 3 ) I make additional principal payments with every monthly mortgage payment. ( 4 ) Beginning XX/XX/XXXX, and through XX/XX/2019 Morgan Stanley Private Bank has misapplied BOTH of my payments. The misapplication error results in Morgan Stanley Private Bank receiving additional interest on my mortgage, and overstates my outstanding balance. Simply stated, Morgan Stanley Private Bank take money designed to be additional principal and pays a future month mortgage payment first, then applies additional principal. ( 5 ) If I had not detected Morgan Stanley Private Banks erroneous practice, the estimated additional interest they would have collected from me would have been about {$4000.00} for the first twelve months. ( 6 ) Morgan Stanley Private Banks customer service blames me for their errors because I did not use their ACH system offered on their website. However, when I attempted to sign up for the ACH, I was rejected for a technicality between my bank and the website. In other words, I tried. Nevertheless, they blame their sloppy bookkeeping on me be cause I do not keep books for them. It is unacceptable. ( 7 ) Morgan Stanley Private Bank opened up a ticket on XX/XX/2019 to correct the misapplied XX/XX/2019 mortgage payment and instructed me it would take three business days to correct. ( 8 ) On XX/XX/2019, three business days after my XX/XX/2019 ticket, the correction had not been made. I was then instructed it would take until XX/XX/2019. ( 9 ) Morgan Stanley customer service department is not competent, and are clearly instructed to avoid the fact they are not keeping accurate records. In addition, their promises are not followed through. ( 10 ) I am a XXXX and pay close attention to my amortization schedule. I recognize that many people may not be as financially astute as me, and I am filing this complaint to alert customers of Morgan Stanley Private Bank of possible immoral or incompetent business practices that a non-financially astute person may not detect. To whom it may concern, My fianc and I were applying for a home mortgage loan through Morgan Stanley XXXX XXXX XXXX # XXXX ). We were told by our loan officer, XXXX XXXX ( XXXX # XXXX ) that our mortgage loan agreement would need a 20 % down payment with an interest rate 5.3 % ( locked until XX/XX/XXXX ). This was stated on the loan contract ( attached ), signed XX/XX/XXXX. We had entered escrow and were getting ready to close when XXXX XXXX ( XXXX # XXXX ) called us and said that upon reviewing the appraisal they had to change the terms of the loan agreement. They now wanted a 25 % down payment and the interest rate would be increased to 5.8 % ( see attached screenshot of emails ). The appraisal ( see attached appraisal, parts 1 & 2 ) of the home shows it is worth {$670000.00}, which is the sale price. The reason she cited for the increase for down payment and rate increase was the zip code of the home. She said that after further review they determined that the zip code was in a declining neighborhood and did not feel that it would appreciate as much as other zip codes. There is nothing wrong with the home and nothing on the appraisal which indicated that the price of the home would depreciate because of the zip code. Other lenders who I have explained my situation to say they have never heard of changing the terms of a loan after it has been signed because of the zip code. I feel the reason they provided to change the terms of the loan was not valid and were trying to find a way to get out of the loan after it had been signed. While looking for other lenders, I explained my situation to many who said that the loan officer probably underquoted us and is now trying to cover themselves because the reason they provided for changing the terms of the loan was ridiculous. I believe there may be a pattern of unscrupulous business practices and predatory lending by deceiving potential lenders with a low rate and changing the terms after the contract has been signed. The actions taken by Morgan Stanley have caused my fianc and I to suffer greatly. We have had to scramble to find a new lender and risk losing our deposit with escrow which has created unnecessary emotional turmoil in an already stressful process. This seeks to resolve a longstanding issue related to escrow practices that put my mortgage in jeopardy as addressed in previous complaint # XXXX . XXXX 's XXXX XXXX 's response only restates its policies, but fails to provide the information I need to bring this account into current standing. I also continue to hold that XXXX 's business model does not provide for the informed risk assessment necessary to have made the decision to place an escrow ( and fees ) on this account to begin with. I, having a clear majority of the property equity had the greater incentive to make a separate arrangement on the back tax amount at the time. Instead, XXXX sabotaged the note. That said, before I submit another payment on the belief my monthly payment will return to the normal amount of approximately {$500.00} per month including the monthly escrow payment, I need to make a very specific arrangement that again, XXXX 's business model does everything it can to prevent or avoid. In short, the only approach XXXX 's call centers offer is to ( 1 ) lay er even more fees onto the account without even explain the fees that are about to be applied and without ever reaching the {$500.00} normal payment amount or ( 2 ) to r oll all of that into a refinance through which XXXX would take even more fees. These are conflicts of interest that do not serve the lender Morgan Stanley and do not serve to reach the goal of returning to regular monthly payments and begin making progress against the principal again. To accomplish that I need the following information from XXXX : 1. What is the total amount of payments XXXX has received since the escrow was placed on the account? 2. W hat would have been the total amount of payments due at the normal monthly payment amount of approximately {$370.00} after the escrow was applied and {$500.00} per month since hazard insurance was added? ( If the regular monthly payments would have been significantly higher than {$370.00} and {$500.00}, please explain why. ) 3. What is the difference between # 1 and # 2 above, and how does that figure break down between unpaid escrow balance s ( if a ny ) and fees that have been layered into the account without ever being explained to me? Again, I seek to make an arrangement to satisfy the above to bring the monthly payment down to the regular amount of approximately {$500.00} without layering any more fees into the account.

During XX/XX/XXXX we obtained a line of credit from Morgan Stanley Home Loan ( MSHL ) for the amount of {$200000.00}. We used this line of credit throughout its 10 years period. It matured XX/XX/XXXX. When it matured XX/XX/XXXX, we asked MSHL to give us some time to refinance it and payoff their loan. They did cooperate with us and we did continued making payment on time paying even above the regular payment. On XX/XX/XXXX we received a set of loan document from MSHL regarding a new Home equity Line of Credit Modification. The fees were very excessive, we told them that we are not interested in that loan. XX/XX/XXXX we send them a qualified letter ( RESPA 12 U.S.C. Sec. 2605 e ) and requested complete history and documentation for this loan. The reason for this request was that we received a check in the mail for small amount from an attorney for a class action settlement for MSHL misconduct and mishandling mortgage loans. Meanwhile we were making our regular monthly payment timely and sufficiently. MSHL after receiving our request RESPA letter, not only did not respond to our RESPA letter sent through certified mail, they transferred the servicing of this loan to XXXX their Collection company. They also stopped accepting our payment. We insisted on making our payment. They refused to take the payment. Since then, we have been trying hard to get a complete history of this loan to pay it off. We have not been successful Until a few months ago, we filed a complaint through Consumer Financial Protection Bureau cfpb. Thanks to cfpb we did finally got a satisfactory response to our request on XX/XX/XXXX. On XX/XX/XXXX we responded to their response. We brought to their attention a few mistakes in their response and also stated to them that we are ready to settle this loan immediately. The amount of the settlement has to be {$180000.00}. This is the amount of the loan at the time they stopped accepting our payment and were not able to give us a complete loan history according to RESPA law. So far we have not received any response to our offer dated XX/XX/XXXX. We are getting automated letter and settlement demand from XXXX for much higher amount. We expect a response to our offer of settlement. We have set aside {$180000.00} for paying off this loan for the past several years. We are still waiting to get a response and fair settlement for the right amount.

I inherited an IRA and other accounts from my deceased parents in XXXX of XXXX. XXXX XXXX nor Morgan Stanley ever discussed the management fees with me. In XXXX of the same year I realized I was being charged 2 %, it appears as if my mother was being charged 1 % but when the accounts moved to me the rate was increased to 2 %. At this point I had received offers from other investment firms and called XXXX and he setup a face to face meeting on XXXX/XXXX/XXXX. In the meeting he said he was dropping my fee to 1 % so I agreed to stay with Morgan Stanley. Fast forward to about 3-4 weeks ago. In reviewing statements I was able to discern I was still being charged 2 %. I called XXXX he said he would research. A couple weeks later I called again after getting no reply, XXXX said there was some manual work involved to figure out exactly when the rate may have changed and that was the reason for the delay. He finally calls again Wednesday, XXXX XXXX. This call was especially disturbing. XXXX said he believe the rate changed back to 2 % when the portfolio balance dropped below $ XXXX. I told him we never discussed any such arrangement and the rate was to be 1 %. He follows by saying well going back and correcting it now will open me up to a IRS audit so he 's just going to move the rate back to as close to 1 % as he can to try and make up the difference. I of course respond that 1 % is the rate, was to be the rate, and I want the $ that I 'm owed. He goes on to say that there are .5 - .7 % additional management fees as well. I ask what he means, we never discussed anything of the sort, 1 % was to be the rate and be all inclusive. The call ended with me insisting he refund what he overcharged and him saying, well I 'll run the numbers both ways and show you. I feel robbed. I feel as if he is trying to intimidate me with the threat of an IRS audit to get around doing the right thing. I feel as if he 's trying to be a smooth talker but it 's very transparent his intention is to side step this error by manipulating me. Also, I asked another firm to look over my statements and have verified the rate never changed from 2 % to 1 % going all the way back to XXXX. Finally I hired an attorney who sent a demand for a response by XXXX/XXXX/XXXX. There was response.

I recently opened a new account with ETrade. They keep putting my account in restricted state for no rhyme or reason. Whenever they do that, they ask you to call their Account Activation Services Department and they proudly mention that the wait time to talk to this department is always an hour plus. This is the second time they have put my account in restricted state. First time they did that, it took almost an hour to get it resolved. For the second time, they put my account in restricted state, I am summarizing my experience below. My first attempt to talk to this department, I had to give up after an hour and 15 minutes. I called the regular customer service after that and they said that they have put in a request for a callback and someone will call me back in 24 hours. It has been 5 days and no one has called me back. My second attempt to talk to this department, I waited for an hour and 24 minutes before someone picked up the phone. This lady then won't give me any reason as to why they they keep doing that, then she demanded that I send her some hand written letter saying that this is my account. That is the most non sensical thing I have ever heard from any bank. Finally she said that she will try to find someone who can remove this restriction but evern after being on hold with her for more than 2_ hours, she could not find anyone. She said she will call me back the next day and that did not happen either. My third attempt to talk this department, I had to wait an hour and 20 minutes to talk to someone. This guy was so rude that he hung up on me when I asked him what happens if I dont send this hand written letter. At this stage Etrade is holding my funds as ransom even though it is a total of only {$10.00} which they clearly know was transferred from my linked XXXX account. They have failed to provide me monthly account statement for this account which I believe is a violation of their bank charter. And if this was not bad enough, I keep getting calls from some other Etrade reps who want me to give more business to ETrade. It is pretty obvious this bank is being run by some brain dead idiots.

Below is the letter I sent to my bank, ETrade. I have received no response. E*Trade Customer Service , I was a victim of a condo rental scam in XXXX. After making a {$600.00} deposit to secure the rental for a business trip, I was pressured to deviate from the agreement and pay the entire balance ( {$1200.00} ) before checking-in. The landlord aggressively attempted to collect an additional {$400.00} ( see text messages PDF ), but I refused because it was not a part of the agreement ( see email PDF ). The text messages from the landlord were suspicious and confusing. I chose to cancel the reservation. I made several attempts to get a refund by calling him, but he did not answer nor return my calls. I spoke to the front desk staff where the condo unit was located but they had no record of my reservation. I made the deposit via XXXX XXXX but unfortunately after a formal inquiry, the XXXX support team could not reverse or refund the payment that I made ( see inquiry PDF ). I notified the law enforcement authorities in XXXX ( where the condo was located ) but beyond that, there was nothing more they could do. Im writing because Ive had several conversations with customer services representatives at E*Trade. I was promised that I would receive an e-mail or form in the mail that I would fill-out and forward back to start the investigation. Ive waited for months and still have not received anything. This is my final attempt at resolving this issue before I file a complaint with the FDIC. I also have been waiting months for a replacement debit card ( account ending in XXXX ). Every time I speak to a representative, I receive the same response were very sorry and/or well send it in the mail right away. Each time I would get a different timeframe on when I should expect a letter from them ( i.e. 7-10 days, or 10-20 days, or 3-5 days ). I have been an account holder for many years and this awful display of customer service and lack of integrity/responsiveness is deeply disappointing, unprofessional, and simply unacceptable.

We never met or spoke with a Mortgage Broker from XXXX XXXX and we have received no origination documents from XXXX XXXX which was signed by a member of their staff. We paid our mortgage faithfully and on time each month for 10 years. Suddenly, in XXXX, XXXX XXXX demanded that we pay the mortgage in full. They gave no reason, refused to work with us on renewing the loan as a normal amortizing mortgage and subsequently began foreclosure proceedings on our home. We asked them to renew the mortgage multiple times and proved we could afford to make monthly payments on an amortizing loan, but they refused to even consider our requests. We made these requests in good faith despite the fact that our home was, and remains, under water. After years of fighting with XXXX XXXX and their loan servicer, SLS, we sought help from a housing counseling agency and an attorney. We have made a cash offer to XXXX XXXX for a Short Payoff and have provided evidence of Proof of Funds from a private lender. They are reviewing our documents, but have refused to postpone the Sheriffs Auction on our property. We are asking with this letter of complaint that the Consumer Financial Protection Board investigate this complaint and intercede with XXXX XXXX to postpone the Sheriffs Auction scheduled for XXXX XXXX, XXXX. We have attached details on the case, an analysis of comparable property values, the communications from our attorney to XXXX XXXX and its servicer, and the Qualified Written Request submitted to SLS under Section 6 of RESPA. I tried to transfer my money out of my savings account from eTrade/Morgan Stanley . Every time I try to transfer money out of the savings account they flag it for fraudulent abuse. Every time I have to call in to verify that I am actually myself in order to transfer my money from my account and every time the verification process gets more and more ridiculous. I have to had to take pictures of my id and upload them using their app on 3 different occasions. The time before last they required a picture of a handwritten statement that they dictated to me on the phone to write. The last time they demanded another picture of my driver 's license and called not one but two other of my financial institutions ( XXXX XXXX XXXX XXXX and XXXX ) to cross reference my financial activity and verify my identity then they demanded a picture of my social security card. And no reasonable person carries their social security on them at work during working hours I couldn't meet their demands to re-re-re-re-verify my identity to them. They told me to upload the picture when I could. Etrade/Morgan Stanley has now locked me out of all the accounts I hold with them and I have made multiple hour-long phone calls waiting to speak to a human to check the upload section of my account profile. They are not picking up their phones. They have essentially locked my money in their bank and now refusing to open the doors to let me make a withdrawal, which if you gave me your personal money to hold and I refused to give back when you requested it and demanded you jump through a bunch of hoops and then cover my eyes and ears and pretended to ignore you. You'd call the cops and they'd arrest me for the theft. And as far as I can tell you guys are the people I file a report with about a bank refusing to give me my money that I had in a savings account with them. P.S. I have typed out and filled out this whole report while on hold with their automated phone services waiting over an hour to speak with a nonexistent human.

I had a loan with Saxon Mortgage Services , Inc. Loan # XXXX, I tried to do a cash out refinance to obtain about {$31000.00} for improvements on that property ( XXXX XXXX XXXX , XXXX , MD XXXX ), and Saxon approved Loan # XXXX ; however, when I went to the title Company ( XXXX XXXX ) to sign the papers, I discovered that the interest rate and the monthly payments were much higher then what was promised. At the advise of Saxon 's agent XXXX XXXX I signed the documents anyway that I had three days to decide if I wanted to keep the loan. Two days later I called Saxon and informed them that I wished to cancel the loan, they gave me the fax number to fax the Notice of Right of Rescission which I did and kept my copy. And for the next three months, I continued made my Mortgage payments on the previews loan # XXXX, those payments were never returned nor applied to the newly-cancelled loan. Some time in XX/XX/XXXX, I received a call from Saxon stating that I have failed to make the first payment on Loan # XXXX. I quickly reminded them of the cancellation of that loan and requested in writing an investigation on both loans, on XXXX XXXX, I received XXXX letters from Saxon confirmed my inquiry and stated they will clear the matter and will get back to me. A month later, XXXX XXXX, I received the CERTIFICATE OF SATISFACTION of loan # XXXX, and in XX/XX/XXXX Saxon hired the XXXX XXXX XXXX XXXX XXXX XXXX, XXXX to foreclose on the cancelled loan # XXXX. In an attempt trying to save my Home, I had to file XXXX bankruptcies and still lose everything that I have ever owned. Saxon wrongfully foreclosed and sold my property and I never received from Saxon that {$31000.00} cash out refinance from loan # XXXX had I not cancelled loan # XXXX. On Friday XX/XX/23 I received a call to my cell phone at XXXX am from E*Trade phone number XXXX claiming a fraud has been committed with my debit card and it needs to be canceled and replaced. I only picked up because I believed you were calling me about a charge dispute with XXXX XXXX which they never addressed to my disappointment. During the course of that call, I heard the same hold music I hear when I call E*Trade Bank and I received codes through SMS messages in the same stream where I usually receive their SMS messages. There was no reason whatsoever for me to believe that call was not from them. And I was distracted and rushing to get out, so I shared confidential information with a person I had no reason to believe was not their agent. And the person committed wire fraud by wire transferring nearly the entire content of my checking account during that conversation. I do blame Etrade for not stopping that : I believe such a transfer should have triggered their fraud alarms and been stopped immediately locking my account, particularly occurring XXXX minutes after a password change. I have no idea how did that not rise any suspicion. He also locked me out of my account, claiming he needed to do that for security purposes and that he would call me at XXXX XXXX to reestablish my online access. Once I did not receive that call, I called Etrade, and they told me that the first call was not about fraud but actual fraud. By then I received emails and learned about the extent of the damage. I spent nearly XXXX hours on the phone with their fraud prevention XXXX who said that the transfer would be reversed and money credited to my account, perhaps by Tuesday, which is today, and the money is still not credited back. And today they returned a check for car registration that I mailed XXXX weeks ago and charged me the insufficient funds fee, adding an insult to injury.

XXXX XXXX and his associate, XXXX XXXX, formulated a financial plan designed to preserve and raise enough money so that I could retire and live comfortably by XX/XX/XXXX due to serious medical considerations. I fully trusted them to manage my accounts and assests. However, since XX/XX/XXXX, they have lost well over {$60000.00} of my money -- {$43.00}, XXXX of this was lost in the first 11 months of XX/XX/XXXX, when the market was up. During this time, they also charged me over {$17000.00} in fees. I have had XXXX financial experts reveiw my accounts, and all agree that there is no explanation or justification for such massive losses in an up year. XXXX XXXX took " big bets '' puttig my money in very risky funds in amounts as big as {$20000.00}. During the course of our work together, he represented to me over and over via email on the phone that the funds, ETFs, and stocks he was choosing for me were appropriate for my short time frame and small amount of savings. And, he was aware of my need for the money for medical care. Still, he took huge risks, that lost money, with my funds. The horrid losses from my accounts in a year that the market did well speaks to the obvious neglect and inappropriate management of my accounts by XXXX XXXX. I called multiple times in XX/XX/XXXX to express my concerns to XXXX XXXX, and he told me just to trust him. We also had email discussions. On XX/XX/XXXX, I sent a letter to XXXX XXXX, the Branch Manager for XXXX XXXX office, and to XXXX XXXX outlining my concerns and complaints, and requseted to discuss a fair an equitable resolution. I have followed up by email three times now, and I have only received the comment that Morgan Stanley is reviewing my letter. As of XX/XX/XXXX, over a month later, I have no substantive response or willingness to engage with me in any dicussion.

I had a checking account and savings account with E TRADE Financial and after setting up direct deposit with my employer and funds were available in my checking account, E-Trade Financial placed a block on my account and asked me to send in documents to verify my identity to release the block on my account. After sending in requested documents over and over again, because everytime I'd call in to check status of my account a new representative would ask me to send in the same documents over and over. Finally after calling for several weeks I was advised that my accounts have been closed and at first I was advised that I would not be able to access my funds. Then after escalation I was advised again to send in the same verifying documents to be able to change the account to withdraw status only so they could send me a check of the balance in my account. I called again on XX/XX/23 and the rep that I spoke with again stated that he is unable to locate any of the documents I've sent in and I would have to send them in again. I've been going on over a month now where I have not been able to access the funds in the account that are from my employer. This has tremendously impacted my life in many different aspects as well as causing me to become late on most of my bills because of not being able to access my funds that I worked hard for, because E-Trade has a block on my funds. Everytime I call in the reps never seem to no what's going on based on notes on the account or able to find the documents that I've submitted more than enough times to verify my identity. I desperately need assistance in being able to access my funds in the account whether that's via a check or allowing me to use the debit card one last time to withdrawal the funds. I am very close to losing everything because of not having access to my funds

This complaint is related to, and an extension of, a previous complaint filed against XXXX XXXX ( CFPB complaint ID XXXX ). To summarize, I took out a construction loan from XXXX XXXX XXXX XXXX XXXX. XXXX stopped funding the loan prior to construction completion and filed foreclosure proceedings once the note matured. This note was apparently acquired by XXXX, XXXX, in Trust for Morgan Stanley XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX. XXXX appears on the notice of foreclosure as the current holder of evidence of debt. I received no notice of the sale of the note. As best as I can tell, XXXX is working in concert with the XXXX fraudsters. It was my contention in the previous complaint that XXXX never had the funds to lend in the transaction or intentionally sabotaged the transaction to create a foreclosure opportunity ( which had now been picked up by XXXX ). ___________________ In the course of the foreclosure process, FV has violated CRS 38-38-102.5 ( Colorado 's notice statute ) ; CRS 38-38-103.1 ( Colorado 's single point of contact statute ) ; and CRS 38-38-103.2 ( Colorado 's dual tracking statute ). XXXX XXXX, XXXX and Morgan Stanley XXXX XXXXXXXX XXXX, XXXX is/are no strangers to litigation concerning foreclosure actions. The SEC recently issued a Cease and Desist Order against Morgan Stanley based on various foreclosure shenanigans. It is believed that XXXX and Morgan Stanley or essentially the same organization. XXXX There is likely a prior working relationship between XXXX and XXXX to the point of suggesting complicity between the two organizations to defraud consumers through the foreclosure process. Both XXXX and XXXX should be required to turn over all records and communications between the two relative to this transaction.

On XX/XX/23 my wife initiated a transfer of {$25000.00} from our E-Trade Premium Savings account to our checking account at another institution. E-Trade temporarily disabled our account due to unusual activity. I called E-Trade today to attempt to unfreeze the account so we could complete the transaction. After spending over 25 minutes on the phone with numerous representatives I was told I would have to make a 3-way call between E-Trade, myself, and my regular bank to verify that the account the funds were going into was a joint account. Evidently they didn't feel my wife should have the ability to make the transfer herself. However, over the period of XXXX my wife moved {$300000.00} from this same E-Trade account to the same bank account to pay our taxes. I was out of time that I could spend on the phone and demanded that the representative from E-Trade unlock my account. They refused and said they could not do this. I called back about one hour later and tried again to unfreeze my account. This time I was told I would have to send in copies of the bank statements for the account I wanted to transfer into. I requested them to close my account and move all funds to my bank, as I am done with E-Trade. The representative on the phone said they could not do this, they could not get their manager or supervisor to help me, and said one of their managers would call me back. I have waited all day and there has been no return call from E-Trade. I want E-Trade to unfreeze my account so that I can pull all funds from them and close the account. They were going to lose {$25000.00} in deposited accounts that we were going to transfer to our bank, they are now loosing {$63000.00} in deposited accounts.

I called Morgan Stanley Private Bank, formerly Etrade Bank, to ask about a joint checking account held by my wife and I. I mentioned that we are going through a separation and I wanted to know what the procedure was to remove her from the joint account. I was told that because I told the customer service agent that my wife and I were separating, the checking account was to be immediately frozen and neither of us would have access to the checking account. This account is the main account that I receive pay from my employer and pay bills through autopay and everyday expenses. My wife is aware of this account and the funds and what the funds are used for. Freezing this account puts both of us in a serious bind due to the fact this account is used to pay mortgage, loans and utilities. The customer service agent explained that I would have to open a new checking account, get a signed letter from myself and my wife saying that both of are aware this joint account is being closed and the funds would be moved to the new checking account. A signed letter from my wife and I along with copies of our drivers license was uploaded on to the banks website. At this time I am still not sure if the letter and copies of drivers license will suffice to regain access to the funds in the frozen account. My complaint lies with the freezing of the account with only a question as to how to remove a person from a joint account. The bank did not verify with my wife as to the validity of the marriage separation. No legal document was provided or asked for as to the validity of the marriage separation. I only asked a question and now I am scrambling to regain my funds and pay my obligations.

I login in and see my account is frozen and that I need to call account activations. I already had an active account. I had very little i the account and when i received interest I tried to withdraw that amount to a verified external account at customers bank. I had 3 accounts at customers bank. The account I had saved was closed by the bank because they have newer better online accounts. Simple easy mistake. The {$50.00} was returned to my account. I believe this is the reason frozen. Etrade does not send any formal letters telling me account is frozen and why. I ask for their policies and they do not provide that as well. I was told that only a 3 way call was needed to verify my bank accounts. Not sure why but this step has never been completed. When I call again and again and after long hold times Im told a different answer each day. I need to provide my license and social security card. I am not send my security card anywhere. It hasnt moved from its safe in over 20 years. Them im told i need to write a letter? Stating what i do not know. Them im told just a copy of my license. Which I have sent 4 times and a fifth after this complaint. Im told its illegible. What does that even mean? I never get any follow calls emails nothing. I feel like this company is using illegal practices and trying to aquire my funds. I have never bounced a check but its like bouncing a check or maybe not even because the money was returned to my account from a transaction that i made not a stranger. I attempted to open a savings account with ETrade twice, once on XX/XX/XXXX and again, at their request, on XX/XX/XXXX. Both times I was declined. I received mail from ETrade dated XX/XX/XXXX that I was declined for the XX/XX/XXXX application due to information at XXXX. I requested on online a report from XXXX, which I received dated XX/XX/XXXX. All of the information from XXXX was correct, and matched what was provided to ETrade. On XX/XX/XXXX I contacted ETrade and requested more information. They advised me to resubmit my request. I did so on XX/XX/XXXX. This request was also denied. I followed up with ETrade on XX/XX/XXXX. On XX/XX/XXXX ETrade responded that I needed to verify my identity with XXXX. Although I am not sure of they date, sometime after this and before XX/XX/XXXX I called XXXX, which put my on hold several times while they reviewed my information but provided no resolution. They eventually sent me a new report, date XX/XX/XXXX, with the same information as before, with the additional inquiry from ETrade added. After receiving this mail I called XXXX again and was told they do not verify identity. On XX/XX/XXXX I called ETrade and was told the accounts were denied because of the response from XXXX, with no additional detail. on XX/XX/XXXX I called XXXX and was told they will not provide any details on the inquiries from ETrade and will only send the same report I have already received twice, which all has accurate information, and that I should check with ETrade as to whyI was denied. My issue is with Morgan Stanley and an Inherited IRA. M.S. will not release my late husband 's IRA to me of which I am the sole beneficiary. The IRA in question was not originally opened at M/S ; it was opened with XXXX XXXX. XXXX was taken over several years ago by Morgan Stanley, which meant M/S also ended up as the new owner of my husband 's IRA by default. I do n't know who XXXX XXXX is and do n't care ; I just want to be able to transfer the money to an account of my choice. XX/XX/XXXX I reached out to Etrade for being unable to log into my accounts. I had a bank account and two brokerage accounts. During this phone call ( 2 hours long with an agent ) I updated my phone number my mailing address, we did a conference call with an old bank account of mine and at the end of the call I verified my information and was able to access my account. So I proceeded to initiate a transfer of money from my XXXX account. Towards the end of the call the agent asks me to clear up any unwanted or closed accounts attached to my brokerage account. And he read me the account ending in numbers as well as the institution, and with all the information I gave him and what he had on his screen he proceeds to ask if i wanted to remove an account ending with numbers i didn't recognize as he also stated that it seemed like a duplicate of my wells fargo account so I agreed to remove it. Then he tells me he removed all my accounts except one which was a go 2 account through XXXX XXXX. He removed my XXXX account which my transfer was coming from and said he couldn't undo it that he was sorry. So today I get 4 pieces of mail dated XX/XX/2023 stating all my accounts were closed due to what they said they determined my personal information may have been used fraudulently to open my accounts, so they closed all of them. After verifying everything 2 days prior and with no emails or text messages. Here it is XX/XX/2023 and they took this action on the XXXX. When I called them today the agent i spoke to said it was due to possible identity theft.

XXXX XXXX Morgan Stanley froze my checking and brokerage account for no apparent reason. Both of my checking and brokerage accounts have not had any activity in months and have had minimal activity in the last year. When I reached out to inquire about why my account was frozen, they did not state that I had any unusual activity, but they stated that they needed some answers from me to comply with their KYC ( Know Your Client ) requirements. They then proceeded to ask me personal and invasive questions about my family, my travels overseas, my parents and what properties may parents own..etc. When I opened my account, I provided Morgan Stanley with all the identity verification information required, my SS #, my employment information, my address, drivers license and everything that they requested. I answered some of their KYC questions, but when the questions started becoming more personal, I informed the agent that I no longer want to do business with Morgan Stanley and wished to close my accounts. They refused to close my accounts and stated that their " compliance group '' needed to authorize the closing of my account. As of this time, they refuse to close my account and my account is still frozen and I can not get my money out. I have approximately {$36000.00} in cash and approximately {$2500.00} in stocks for a total of {$40000.00} that I can not withdraw. Account # XXXX ; reported late payments XXXX XXXX . We applied for a loan modification on a property we owned. We were told that they would only grant a modification on a loan that was 90 days in default before they would even talk to us. We allowed the mortgage to go the 90 days and were then told that if we made any payments, it might restart the calendar, so we deposited the mortgage payments into a savings account so we could settle the account at the end of the process. In the meantime, their collection department called on a regular basis, threatening foreclosure. We told them we were applying for a loan modification, but they refused to verify this with the loan modification department. The collection department sent the loan into foreclosure while the loan modification was still in process. We paid the default amounts, legal and court fees and THEN got an offer of a loan modification. The terms of the modification were actually WORSE than the original loan, so we turned down the loan modification. We feel that Saxon Mortgage acted in bad faith during the transaction. We followed their instructions and they reported us as being delinquent. We only followed their instructions for getting a loan modification. We had the money to pay during the application and they took a whole year to offer a loan modification with terms worse than the original note, which we chose to reinstate. We feel they acted in bad faith and then damage our credit for following their instructions.

My financial advisor referred me to their XXXX XXXX department when I told them thay I was going to buy a house. I was approved for a loan and I started looking for houses in my price range. When I found the house that I wanted I locked in my rate and started the application process. Throughout the process they exhibited poor communication and started asking for documents a couple of days before closing. Two days before closing they contacted me to finalize numbers, including my monthly payment which was quoted to be {$1500.00}. When I got to the closing table I discovered that monthly payment would actually be {$1700.00}. When they informed me of this payment I felt like my back was against the wall because I was afraid being sued by the seller and I felt I had no choice but to sign. Since my closing two weeks ago I have been under duress on how I am going to make my monthly payment. On my Truth In Lending Disclosure they quoted my taxes and insurance to be {$290.00} a month. As a normal consumer this number did n't seem out of the ordinary to me. In doing my research I have been made aware that several professionals from Morgan Stanley Home Loans neglected to change the property tax number to the correct amount even after they were told by the title company on XXXX occasions that their estimated property taxes needed to be adjusted. Morgan Stanley Home Loans were negligent on several occasions. I am now stuck with a mortgage payment I ca n't afford.

I contacted Morgan Stanley in XXXX to apply for a 3-month forbearance on my loan # XXXX and they were able to apply a 3-month forbearance on my account. Upon further follow-up on XX/XX/XXXX, I was told that they would provide me with an additional 6-month forbearance so that I would not have a payment due until XX/XX/2021. Unfortunately, the representative gave me the wrong information and actually did not even process the second forbearance request. I followed up on XX/XX/XXXX and was told that the previous representative had misinformed me and that they were only doing an additional 3-month extension. In addition, I was sent a letter that my original forbearance plan had been canceled on XX/XX/XXXX, which was not initiated by me. I wanted an extension not a cancellation. I agreed that I would like to have the additional 3-months applied at that time as they did not give me a 6-month option ; however, it is now XX/XX/XXXX and I still have not received confirmation that the 3-month forbearance extension was applied. I keep receiving notices that I have " DEFAULTED '' on my mortgage obligations but I was told by several Morgan Stanley Home Loan representatives that the non-payments would not be reported on my credit report. I am concerned that Morgan Stanley has reported a default and/or late payment to the credit reporting agencies when they specifically told me they would not be reporting these as late payments and/or any derogatory information.

This is to report an apparent illegal foreclosure. The CFPB has received a number of complaints about mortgage servicing issues. I was unable to reply to the loan servicer 's evasive response because it asked for information related to charges on monthly statements the loan servicer refused to ever send through the entire term of the home equity line. How does someone reply to thin air? I have received word indirectly that the loan servicer only used that response to sneak through a foreclosure for which I again, was served no legal notice! I have repeatedly sought to resolve this through the loan servicers, always at the risk left hand not knowing what the right hand is doing. The people the loan servicers have made no one available to discuss the financing of the property, both the primary home and equity line made and owned by the same lender on the same date by Morgan Stanley. The loans servicer 's customer handlers at call centers have blocked every effort to reach anyone in authority as the servicing company or at Morgan Stanley who could discuss other options relating to a new income source that allows me pay down balances but not all at one time, attaching or factoring inherited assets pending two estate settlements, a possible sale by owner at the property 's fair market value nearing three times the debt on the property, and additional Social Security income I will likely choose to begin receiving in XXXX.

I have an E*Trade checking account. I deposited a valid check into my account, after the mandatory 4 day waiting period the funds were declared available. I attempted a wire transfer and normal bank transfer of some of the funds. The next day the transfers were canceled and my account t was frozen. I called the company and was told the external account I was attempting to transfer to had to be verified. I proceeded to have it verified. I was then told my deposit was suspicious, so needed to verify that. This required getting my employer on the phone and calling the issuing bank there. The issuing bank rightfully wont discuss PII on a 4 way call. They offered a fax option. I have submitted proof of my employment including contract and invoicing for the work associated with my deposit. And have been told for over a week that this is under review. Its now been two weeks since my deposit was accepted and my account is still frozen. I am unable to cancel or transfer my money out and am missing payments. Ive been told my case was escalated and is under additional review last weekend, but no updates. Every time I call I am stuck with someone who has no power to affect my situation, and I learned yesterday that E*Trade never followed up on the fax option to verify my deposit last week. E*Trade is holding my money against my wishes and is causing my family and I financial and emotional damage at this point.

Some times this financial institution encounters balance errors unknown to me of how they occur. Generally my brokerage account will show a a balance with more money than what is in the account??? When I call them to question how it happened they simply say they don't know why it happens. A day or two later the brokerage account suddenly has a negative balance. My checking account is with the same financial institution and has been frozen and I am not able to withdraw funds because the brokerage account with this institution has a negative balance. How this occurred is unknown? I now need access to my direct deposit and cash in the checking account. My card is being declined and I can not pay my financial obligations. A direct deposit is attached to the brokerage and would have cleared this up if they had simply looked at the history of the past year or more. Freezing someone's account is a serious problem. The history of direct deposits should have provided a clear solution that the brokerage account would have been brought back to a positive balance. My part would have been resolved by the direct deposit. What about their ongoing problem with not showing the correct balance. This would not have happened if their system was reliable to show the correct balance 100 % of the time. How quickly a bank will punish someone for the mistake made by the bank and not the consumer.

On XX/XX/XXXX of this year, I transferred {$5000.00} ( from the sale of a house ) to a new ETrade XXXXXXXX XXXX Account in my name, and a further {$95000.00} on XX/XX/XXXX. At this time, I was in the XXXX and have only recently returned. For some reason, and after many phone calls, I was told that the bank was unable to validate my account and they were going to close it. They told me that I had to get my US bank ( XXXX XXXX XXXX ) to initiate the transfer, which I did, and received my {$100000.00} on XX/XX/XXXX. I also asked them about the interest, and was told that it would be mailed to me. Having just returned to the US, I did not find a letter or any other communication from ETrade. I phoned them today and was told that there is over {$200.00} dollars of interest in the account but the account is closed and therefore they can not send the money to me! Although the amount is small, the bank is being dishonest. Surely they can not keep interest earned on my money. Their reason given - that they have closed the account- is a problem they created by closing the account in the first place, and completely beyond my control. Also, I have spent hours on the phone, mostly waiting to speak to a human and also providing multiple documents many times- in short, abysmal customer service followed by a dishonest outcome. In early XX/XX/2021 I received a letter from E*TRADE Financial informing me that my wife and I had two cash savings accounts, totaling {$23000.00}, that to them appeared to be inactive. We were given until XX/XX/2021 to reactivate them, or the funds would be sent to the XXXX Treasury, Unclaimed Property Division. I reactivated them, per instructions from an E*TRADE customer rep, by going online and changing the passwords. As of XX/XX/2021, a week after the deadline, the funds were still in the accounts. On XX/XX/2021 E*TRADE BANK unilaterally, without my knowledge or consent, closed both the accounts, without further contact or explanation. The funds seem to have vaporized from that point forward. I go to the XXXX Unclaimed Property website at least once a week, and call them by phone once a month. There is no trace of the funds, after almost 18 months. I have spent literally hours on the phone with upwards of 20 E*TRADE customer reps and supervisors all of whom profess to be sympathetic to my plight ; each one of them has promised to get back to me, after researching the issue, and only once have I ever gotten a follow up call. And that was just recently, after I sent E*TRADE a demand letter, asking for my money, or tell me where the funds were sent. As of today I have received absolutely NO information about the whereabouts of our funds.

My beloved wife XXXX and I each received a XXXX letter from Morgan Stanley advising each of us that our accounts with Morgan Stanley were breached and that our Social Security numbers were stolen! Morgan Stanley conveniently does not tell us why our accounts were breached despite the repeated assurances that breaking our accounts is impossible because Morgan Stanley has in place sufficient security protections to prevent this from happening. Claptrap! Morgan Stanley did not take the precautions necessary to protect our accounts. And I dare so the accounts of huge numbers of other people. Just last week my beloved wife received an anonymous telephone call inquiring about her Social Security number. She hung up. Morgan Stanley is trying to convince the public that it did everything it could to protect accounts and that all is well. But all is not well as aforementioned! Morgan Stanley should be and must be brought to task for this deception, this misrepresentation, and this incompetence! Period! But Morgan Stanley is rich and has an army of well paid attorneys and public relations/customer relations/marketing people to pull the wool over our eyes and those of the public! Submitted a payroll payment from XXXX XXXX bank via payroll processor XXXX on XXXX. Our contractor informed us that he didnt receive the payroll payment days later after the processing period had passed. Due to this, we had our contractor who was the intended recipient reach out to his banking institution which is E-trade to get the status. It appears that E-trade deposited the money into the wrong account which didnt belong to our contractor however another E-trade account. The contractor called E-trade and they told him that they can not reverse the funds and that they would have to reach out to the account owner to notify them of the error. After weeks, e-trade finally told the contractor that they can not move the funds and to call XXXX XXXX which is the banking institution that it was drafted from. I then contacted XXXX XXXX ( my XXXX bank ) and opened a claim with them to have the funds reversed from e-trade. XXXX XXXX said they claim would take up to 10 business days and after which time I was informed that they was not able to retrieve the funds. E-trade has neglected to follow proper business practices which subsequently has resulted in the funds never being deposited into the correct account. I would like this investigated ASAP so that we can receive the {$1200.00} that was deposited into the wrong account at E-trade.

Loan matured XX/XX/XXXX. Loan extension was requested prior to maturity but terms of modification were never disclosed to me. I was not willing to pay trial payments without knowledge of the modification terms. In XX/XX/XXXX, I requested a payoff amount to pay loan in full. I received a payoff quote charging me interest up to the end of XXXX which is way pass the maturity date. I requested to have an updated payoff with interest up to the maturity day. the investor stated this is not allowed. I checked the credit agreement today on XX/XX/XXXX and no where in the agreement it says they can charge interest past maturity. in fact, there is language that talks about a balloon payment at maturity where all interest and principal is due up to that point. that is all I want to do - I want to pay the account accurately and in full up to the maturity date. they stated if I pay less than that then the account will reflect as settled and non paid in full on my credit history. I do n't agree with this. in addition, today 's representative " XXXX '' stated that there is default language in the agreement that states they can charge interest pass the maturity date. this is a lie as nothing is stated in the agreement regarding default. he proceeded to hang up the phone when I asked for the language he was referencing.

My troubles started when I had to change phone carriers. In the process I was given a new phone number. I had no trouble establishing my identity with XXXX, XXXX XXXX XXXX, XXXX XXXX, and XXXX. E*trade insisted on sending me a 6 digit code to several different old phone numbers they had on file. They never gave me the option of responding via email with their codes. I contacted an agent who sent me my new new Morgan Stanley Debit card and said he'd try to erase all my old nmbers on file. I waited a week and again tried to log onto my checking acct and was again given a code, and again, to another old phone number. I tried anyway. By this time my account was flagged for what they term, " Unusual Activity ''. I called them again and was told to submit a Customer Verification Form with a copy of my signature on any State ID 's. I waited several weeks and tried one more time to access my checking account to no avail. I sent another verification form to them with my new driver 's license and my notarized signature by my local XXXX XXXXXXXX XXXX XXXXXXXX. I don't know what else to do other then seek out help from you. These funds are all I have as a retired veteran. I've already been charged {$100.00} for two small checks I wrote to pay my water bill returned for insufficient funds. Thank you so much.

In XXXX of 2020 I entered into a forbearance/deference agreement with Morgan Stanley Home loans. Initially, it was for 3 months and it was extended to 6 months. When I last spoke to a representative on XX/XX/2020 I requested that they extend for another 2 months and the representative said that shouldn't be a problem. I received another call and someone else told me something different in that I could not extend another 2 months and that I would have to agree to a deferment so I did so. They told me that I could in a sense put the XXXX payment into the deferment plan and possibility of putting the XXXX payment in the deferment agreement so essentially I would extend for another 2 months. I kept getting automated calls to call Morgan Stanley, everytime I called I would get a different response, this time the representative told me that I had to make the XXXX payment immediately. I would have liked to have extended my forbearance for another 2 months and put that into the deferment plan but I keep getting told different things. At one point a couple of months ago when I asked for the modification package to be sent to me another representative told me that I would only be able to defer 3 months of the payments and the other 3 months I would have to pay as a lump sum.

I disputed with XXXX a charge incurred in XX/XX/2017 on my Morgan Stanley-XXXX card against a hotel in XXXX XXXX, XXXX in the amount of {$1600.00}. Basically, I was tricked by the hotel into booking a 7-day stay for a business trip that was totally nonrefundable. And then the hotel was entirely non-responsive in addressing any of my pre-stay requests to discuss various business needs, such as assistance with hosting a business luncheon and other meetings, arranging for me to be picked up at the airport, and facilitating other transportation needs. The hotel assured me that they could support my business needs, took my money, and then ignored me. I was forced to switch to another hotel in XXXX to ensure the success of my business trip, which I did weeks before my scheduled stay. After receiving no satisfaction from XXXX, I provided all of the above information in great detail both in writing and orally to Morgan Stanley, whose name brands my card. But Morgan Stanley has refused to take any interest in this issue. No one from Morgan Stanley spoke with me, and Morgan Stanley clearly gave no consideration whatsoever to my clear and legitimate concerns. Not too long after recovering from XXXX, I deposited funds in E Trade Bank 's Max-Rate Checking Account. I then forgot that I had deposited it, as I was trying to get my life back in order after recovering from the devastating effects of XXXX XXXXXXXX. I didn't discover the checkbook until I moved to XXXX last year. When I called E-trade, representative XXXX told me that my funds had been transferred/dispersed to the the XXXX Treasury Department XXXX but I had NEVER gotten any statements from E trade Bank over all those years and they NEVER contacted me to let me know that they were going to, or that they had transferred my funds to the state! I have had a brokerage account with E*trade.com since the early 2000 's. I just recently opened a guardian saving and checking account with E*Trade for my self and my father. In order for this bank to open these accounts I had to download a copy of my father and I drivers license. On the IDs you can clearly see we are both XXXX XXXX. After the accounts were opened, I deposited a check from my fathers XXXX account in the amount of over {$92000.00} to the newly opened accounts at E*Trade. E*Trade kelp the check on hold longer than the time frame listed on there website. They never given me a explanation for the long hold time. They called XXXX and verified the check with them then they released the funds. Once I started moving funds around into the different accounts they put restrictions on all the accounts. Once I called them to ask why the restrictions were there they lift the restrictions. I then tried to wire myself {$20000.00} from the account they put a restriction on the account and now they will not remove it. The only reason I can see them placing restrictions at all on the account is because my father and I are XXXX XXXX. They do not like seeing XXXX customers with this kind of money.

I contacted ETrade Bank by secure messages, live chat, and phone numerous times already over the past month over this issue, and I still see one of the {$25.00} fees not being reversed, despite their claims otherwise. This is a continuation of a previous case I filed with you ( # XXXX ). Facts : On XX/XX/2023 someone hacked into my account and wired out nearly the entire content of it without my consent or authorization, causing also a wire transfer fee to be charged. Note the unauthorized transfers of {$3300.00} and {$25.00} on that day. On XX/XX/2023 a previously written check # XXXX in the amount of {$76.00} was posted and was returned for insufficient funds, causing also a fee of {$25.00} to be charged. On XX/XX/2023 that fee was reversed. On XX/XX/2023 check # XXXX was presented again and paid. On XX/XX/2023 the fraudulent transfer of {$3300.00} was reversed and credited back to the account. However, the wire transfer fee of {$25.00} was not reversed and credited back at that time. And it was still not refunded until this day. As this fee was caused by fraudulent activity that was reversed by now, the fee also needs to be reversed.

I received an insurance check from my Insurance company made payable to me and the mortgage company. The mortgage company signed the back of the check and returned it to me, to be deposited into my Etrade checking account. I submitted the check using the mobile banking app, as there is no physical branch in my state. The check was rejected, per email sent to me, because it was made payable to me and the mortgage company. I called Etrade bank and was informed they do not accept checks made payable to the account holder when someone else is listed as the payee and not listed jointly on the account. When someone receives a claim check related to a property insurance claim and a mortage is associated, the mortgage company will always be listed on the check as a joint payee. This bank has placed me in a difficult postion and I can not begin to rebuild my home until this check is deposited and funds are available. I am left we no option to deposit my check with Etrade because their system rejects the check when attempting to re-deposit. I reached out to the insurance carrier and they said never before has this happened to any other clients.

Attempted to log into account online and web page stated account was locked to call for more information. I called and was told account was locked due to multiple log in attempts, I supplied all the requested documentation and was allowed access after about an hour on the phone, additional set up company fraud prevention items such as XXXX, and a pass phase and answer for future verification, this was all done on XXXX XX/XX/2023 and account was unlocked and able to use. Attempted to pay a bill online with debit card on XX/XX/2023 and was declined, attempted to log into account online and =web page stated account inactive, to call in. I called in and was told my account has been closed due to fraudulent activity. A few months ago the servicing of my loan was transferred from XXXX to XXXX ... in almost 3 years there has never been an issue with making a payment which is sent via my bill pay every month. Once the servicing was transferred, the are suddenly having an issue receiving the payment and now they are assessing late fees when payments are sent before the final due date. The payment is mailed on the 12th every month for almost 3 years with no issue until XXXX took over. They assessed me with a late fees and I contacted them via phone a few weeks ago and was assured by a phone rep that no late fee would be charged. Now I have my coupon and there are late fees. I sent a request to them to retract the late fees on XX/XX/2019 and they responded today with we are unable to accommodate your request to waive your late fee. I have been victimized by the XXXX real estate crisis. Was given bad information pertaining to a re-fi loan application back in XXXX. Had perfect credit score until that point when I was instructed by advisors to miss at least 6 mortgage payments to become eligible. While following their directions my mortgage company began the foreclosure process. I had to scramble to maintain my home. Had to pay {$15000.00} to reestablish a 40 year mortgage at 7.75 % interest rate to keep from losing my home. Since XXXX, my guaranteed mortgage was converted into a none guaranteed mortgage causing me a problem getting any refinance consideration due to the fact it was now a none guaranteed mortgage. This process whereby my mortgage is bought and sold has occurred no less than a half dozen times. I have dealt with Morgan Stanley Private Bank on numerous occasions. They charged me for insurance that I didn't need and have fought for years to correct it. I actually had someone tell me that I can't fix that because we didn't service the loan at that time even though MS via XXXX serviced the loan. I've had numerous phone calls lasting more than an hour trying to explain the situation to get it corrected and every time I call its like starting over. I have been told on at least 6 occasions a MSPB supervisor will call me back and have never once had anyone call me back. I requested a simple document three times and was told repeatedly it will be to you in 24-48 hours. Its a week later and it is holding up a refinance that I am doing. Are they doing it on purpose so I can not refinance? The service people do not have the ability to transfer you to a supervisor. Entire departments don't take phone calls. No one will accept responsibility to take care of their customers.

I opened a checking account online on XX/XX/22 with XXXXMorgan Stanley XXXX They allowed me to mobile deposit 2 checks, 1 from XXXX XXXX for closing that account and the other being my MN XXXX XXXX. Both checks cleared and posted to my account totaling {$3500.00}. Then the bank decided to freeze all my funds for no reason at all. I was instructed to call to fix the issue. When I called I was told to write a letter requesting that they look into why my account was frozen and upload it along with my state ID. I had to renew my MN DL in XXXX and still haven't received my hard card yet so I had to upload my temporary paper government issued ID with the letter. They refused to use that as a government ID. I called them 5 times in 2 weeks trying to get my funds unfroze to no avail. So I finally just requested that they just close my account then and return my funds to me. I went to the ATM to withdrawal money from my ETRADE checking debit card ending in XXXX using XXXX ATM in the amount of {$500.00}. Morgan stanley Etrade financial sent a letter after I made a complaint and closed my account. The stated reason was because of a XXXX balance. My balance is currently XXXX cents. If Etrade closed my account they should have sent me a check of any funds in the account. Etrade is refusing to give me my funds. Customer service representative asking me if I was willing to let the money go. I cant believe I was asked this. I asked for a supervisor and told person I was recording him. Representative got angry and put me on long holds to avoid being recorded. Supervisor never responded. These are all bad practices that should not be ignored. I am not sure how a bank can decide when to close an account. If a bank closes an account just send any funds to the account holder and be done with it. I asked why my account was being closed and representative would not provide information. Please forward this to both Morgan Stanley and Etrade.

In XX/XX/2022 I opened an 3 accounts with E-Trade. The whole time the account was open they would not let me use it. After about 6 weeks they told me that they were shutting the account down. E*Trade Banking decided to lock my checking account, believed to be XX/XX/2023, when it was believed someone else was trying to access my account from a different state which I do not live nor traveled to. My credit rating for all three companies continuously shows delinquent charges even when Morgan Stanley & their Mortgage company XXXX XXXX has formally submitted a mortgage condemnation 1099 to the IRS. All three credit reporting companies have not updated my credit rating since XX/XX/2020 even after being shown proof that the claims are fraudulent claims by Morgan Stanley & their Mortgage company XXXX XXXX. They have repeatedly denied any wrong doing and tell me how to repair my credit rating which I have tried but produce no results. Saxon sold our borrowers loan to XXXX and I have been trying to get a release, XXXX got back to me and said yes. The release dept discovered that yes they did receive this file from Saxon when they closed but Saxon had already liquidated and charged off the account so all XXXX did was upload the file and did nothing on it as they realized Saxon sent them an already closed out file. They said they have several like this. With Saxon no longer in business, XXXX did give me XXXX number that is still in use where they just handle archived files. I called that number and it is nothing more than a message and it states if you are looking for a release you have to mail it in and gave a XXXX then says thank you goodbye and hangs up. You can not get a live person at all. I can mail it out however I can not even do XXXX with a XXXX. Just let me know what you would like me to do.

This complaint is necessary to involve the loan originator and debt owner in reviewing complaints # XXXX and # XXXX . Morgan Stanley needs to exercise oversight of its loan servicers to ensure that its customers are treated fairly and respectfully, and to keep them from creating more risk than they protect. That is certainly the case here. Customers do not consume their homes. They are a necessity of life. Loan servicers do consume them. I have {$70000.00} to {$80000.00} of hard earned equity in my property against the {$55000.00} total debt. That merits fair treatment and direct communication to resolve the issues. I have arranged the means but need reasonable deadlines and timely responses to requests for the necessary information have I needed. I need to be allowed to speak directly and consistently with someone in authority, not a call center.

In XX/XX/2023 I attempted to transfer money from my credit union to Etrade. I was distracted so accidentally did not verify I had enough money in the credit union account to make the transfer. When the credit union saw my mistake they charged me a fee and that's it. When Etrade saw my mistake they charged me a fee and put a hold on my account. I have been trying ever since to lift that restriction. I have tried 4 times, the last time being XX/XX/2023. They will not lift the restriction until I send them a photo of my drivers license ( done ), a letter explaining that I want to withdraw my funds and close my account ( done ), and a copy of my bank statement from my credit union. Saxon Mortgage is inaccurately reporting the mortgage that I had financed with them. 1 ) The account is still reporting open on my credit. The account was sold to XXXX in XX/XX/2009. This account should be reporting closed. My wife and I have XXXX IRAs with Morgan Stanley. Since our balances were below a certain amount ( XXXX have a little less that {$2900.00}, but over {$2500.00} ) they have been selling off shares every year to pay a " past due acct fee '' totaling {$50.00} to {$150.00} per year ( the statements and wording is hard to understand ) Last year was the first time I realized what they were doing. So of course the accounts have never gained much in value, as the fees wo n't allow it. My wife 's account ends is XXXX So the company that should be helping me accumulate wealth is doing just the opposite to me and my wife. What is surprising is that I 've been with them since around 1996 and have a third account that has had values between {$25000.00} to {$50000.00} and no advisor has ever suggested that I do something different to avoid these fees.

Etrade has now prevented access to my money for a week. They keep having me jump through hoops to access my funds which they were more than happy to transfer in. They keep restricting my account and telling me I have to verify things ( which were already verified ). I do what they ask and waste literally days of my time doing things after they already gladly took my money. Each time they tell me everything is resolved and the restriction is removed, but then they restrict my account again and tell me to do the same things once again which they already told me were satisfied ( which were clearly satisfied even before the restriction seeing as they were more than happy to transfer in my money ). This is beyond absurd, entirely unacceptable, and undoubtedly against the law. They must me held accountable and punished to the fully extent.

In XXXX {$90000.00} was transferred from my XXXX XXXX XXXX account to an E-Trade savings account. They froze my account after taking the XXXX in funds plus another XXXX in a brokerage account. I called and eventually got it unfrozen. After I got my account unlocked after lengthy calls with customer service they reopened it. Once it was reopened i was so frustrated with how long I was locked out of my account. When I got back in the first thing I did was send the funds to my XXXX account. E-trade sent the funds to my XXXX account on XX/XX/XXXX and on XX/XX/XXXX took the funds back out of my XXXX account and permanently put a hold on my money. They won't unlock my account and have given me no recourse to receive my funds which are stuck in limbo even though I have supplied them with pictures of XXXX card, Passport, drivers license.

I opened an account with E-trade the beginning of 2022. Since XXXX I have spent over 20XXXX hours on hold trying to get my account unlocked. Soon as they unlock it, it gets locked again. XXXX XXXX was looking into this and supposed to get back to me when resolved, This was back in XXXX. Now he no longer responds to emails etc. I have also sent email to XXXX XXXX and no response. Every time I have to call there is a 3+ hour hold time and then soon as I hang up my account is locked again and it's back to the beginning. I just want to get this closed out as I have never had such bad experience. They denied a check when there was plenty of funds for it to clear and would not pay the {$32.00} fee I was charged by my credit union for the returned check. This is the worst institution I have ever dealt with. Please help.

Etrade keeps restricting my account. I asked for the policy that governs this but I have yet to see it. I had to verify multiple bank accounts with invasive questions. The account was unlocked/unrestricted 4 times and then restricted again and again. When I made many transfers into the account I never had any restrictions. I withdrew my brokerage account funds in the past but the account remains open. One of my checking accounts has been attached to Etrade for years but I still had to verify the account. Its very hard to get connected to the activations team. When connected it seems they shoot from the hip as to why account is restricted and what is needed to remove the restriction. No bank should be allowed this much power over any persons account. I lost interest and fees due to Etrade restricting my account.

eTrade froze my savings account ( XXXX ) because of a " suspicious '' transaction where I electronically transferred money into the eTrade account on XX/XX/22 and then transferred the same amount of money out of eTrade on XX/XX/22. They were not able to say what was actually " suspicious '' and they were not able to tell me their rules for moving money into and out of their savings account. I thought that a savings account by definition is a liquid account where you put money in and take money out. The eTrade rep was XXXX XXXX. My account is completely frozen, I can not even move the money into my eTrade brokerage account. I spent an hour on the telephone with E-trade/Morgan Stanley trying to make XXXX wire transfer.I was told that it would be there within an hour. I just got an email from them telling me that due to suspicious activity they were locking me out of my accounts. I told them that I will just close my account and move my money to my local bank ( XXXX XXXX XXXX ). I tried to transfer my money from both my savings and checking account. To whom it may concern, To those that follow the markets you might know that XXXX interest rates will rise over the next few years. But if you 're not aware of financial trends, a 1 year adjustable mortgage might sound tempting but it is utterly foolish since such a mortgage will only get more expensive over the next few years. Hence my surprise when XXXX sent me offer to swap my 30 year fixed rate mortgage for a 1 year adjustable mortgage based on the XXXX. I utilized Etrade/Morgan Stanley Bank account to redeem a set of Series I savings bonds from the Treasurydirect.gov. Funds credited to account and then the account was frozen. I called to inquire as to why, and they asked to verify deposits. I provided them with emails I received from treasurydirect.gov as well as screenshots showing detailed account information and redemption info matching the deposits. The Etrade/Morgan Stanley representative then asked for statements. I explained that these are Savings Bonds and there are no monthly statements available. Morgan Stanley mis-reported our XXXX XXXX contributions to the XXXX, incorrectly completing XXXX forms XXXX ; causing the XXXX to review our tax return and assess a liability not actually owed to them. We discussed this with XXXX, and they said they just needed the amended XXXX 's accurately reporting the deposits and applicable tax years from Morgan Stanley, then would retract the liability and close the file. Morgan Stanley has consistently refused for months and months now to revise the forms. Eventually XXXX withheld funds from our XXXX tax refund to satisfy the improperly assessed liability. Morgan Stanley Home Loans keeps saying they will modify the loan with respect to lowering the interest. Instead, they keep sending repeated forms about being in the military which is not applicable. They have offered no assistance during covid, despite assertions to the contrary, except to require all payments be made in month four. We have excellent history and this lousy company keeps making promises and does nothing to help or keep their word about modifying the interest rate to a more reasonable number. Last call they promised to send information and application to modify and this was third promise. Instead all they send is some form nonsense about military service which does not apply. In 2011, we lost our home in XXXX XXXX, Indiana, in a short sale. Our mortgages were being held by XXXX XXXX and XXXX XXXX. Neither of these companies still exist ( or so we have been told ). We lived in Illinoos at that time and recently received a letter from the Treasurer of Illinois that they are holding funds as unclaimed property due to an Insurance claim that was submitted on our behalf as a result of the final inspection of the property ( something apparently to do with hail damage to the roof ). Later in XXXX I discovered that the modification program does not require income qualification and that the payment would lower my current mortgage payment by {$540.00} a month. I have requested my mortgage servicer escrow and pay both homeowners insurance and property taxes. A few weeks later I logged in and saw the account was restricted so I called and was told to send in a copy of my passport and social security card, which I did. I over the period of about 10 years basically wiped out my Rollover IRA. This was done via email through Letters of Authorization.
